When Professor Georges Gurvitch, the highly esteemed occupant of the chair of philosophy at the University of Strausbourg before World War ll and the author of a series of brilliant studies in the pluralist philosophy of law, referred to Pierre—Joseph Proudhon as the central figure in the development of modern social and judicial philosophy, the basis of his highly flattering judgment was the philosophy of law that serves as the basis of Proudhon’s mutualism, a socio-legal conceptualization that had not only (...) greatly infiuenced Gurvitch’s own thinking but which had exerted tremendous infiuence as well over the thought of such outstanding social theorists as Herzen, Tolstoi, and Kropotkinl To state, therefore, that Proudhon was not only the first to call himself an anarchist but also “the most important" anarchist thinker of the modern period} is to establish his right to be heard. We are not entitled to skip lightly over his conception of law and justice as past generations have done. After outlining Proudhon’s legal theory and his conception of natural right, this paper will attempt to demonstrate that Proudhon’s thinking on law is an outstanding contribution to modern political theory. It is not too much to say, in fact, that his philosophy of law and natural right stands as a highly suggestive antidote to the hopeless confusion in contemporary political theory, a confusion that stems not only from the cloudy conception of justice posited by the social contract theorists but from the defective conception of justice advanced by the advocates of state socialism as well. Fish comes dangerously close to identifying the meaning of a statement with its illocutionary force. At one point he says that "the meaning of a sentence is a function of its illocutionary force". At another he says that a move from a situation in which "I have to study for an exam" is heard as a statement to one in which it is heard as a rejection of a proposal is a move "from one meaning that emerges in a set (...) of circumstances to another meaning that emerges in another set of circumstances". Since "meaning" is so tricky a term, it may be well to remind ourselves that in a situation in which the sentences "I have to tie my shoes," "I have to eat popcorn," and "I hate movies" would all be understood as rejections of an invitation to the movies, no one would mistake the meaning of one for that of either of the other two. The three sentences make different statements, convey different information, and offer different reasons for not going to the movies. There is a sense in which Y's saying "I hate movies" means that he rejects the proposal. But even in that situation, the meaning of "I hate movies" isn't reducible to "I reject your proposal." If we are capable of changing our minds—of rejecting, that is, one hypothesis for another—the issue becomes one of the criteria which govern our choices. Are they, as [Stanley] Fish would argue, dependent on "beliefs" and "assumptions"? Perhaps, at some very fundamental level, they are. But I do not think Fish has succeeded in showing them to be so. Certainly the criteria are independent of anything so specific as beliefs about the nature of literature or the human mind. Who among (...) us, for example, whatever the object of interpretation, would choose one on the grounds of its greater inconsistency, or on the grounds of its accounting for fewer of the facts that we want to explain, or on the grounds of its being unnecessarily complicated? On the contrary, do we not tend to argue, as Fish does so effectively, as if counterexamples and inconsistencies tell against an hypothesis? It may be the case that our cherished beliefs often make it difficult in practice even to formulate our questions in ways that allow such criteria as I have hinted at to come into play. Why are some autocrats able to personalize power within their regimes while others are not? Past studies have focused on the balance of power between the autocrat and his or her supporting coalition of peer or subordinate elites, but we find that often the crucial relationship is between the autocrat and the “old guard”—retired leaders, party elders, and other elites of the outgoing generation. Using an original data set of authoritarian leadership transitions, we argue that when members of the old (...) guard retain oversight capacity over their incoming successor, he or she is less likely to overturn power-sharing arrangements and consolidate individual power. We illustrate this argument with a case study of three leadership transitions in China between 1989 and 2012. This study’s findings advance our understanding of elite politics and intergenerational conflict in authoritarian regimes. (shrink)

In _I Can Learn from You_, Michael Reichert and Richard Hawley—the authors of _Reaching Boys, Teaching Boys_—set out to probe deeply into the relational dynamics that help boys succeed as learners. Drawing on interviews with students and teachers in thirty-five schools across six countries, they examine the particular ways boys extend and receive empathy—modes of interaction that remain consistent across a wide range of schools, teachers, countries, and cultures. The book shows how teachers can help boys form productive learning (...) relationships and how schools can support the development of teachers’ relational capacities. Formal control systems are a common instrument to align employees’ interests with those of managers and companies. However, research shows that employees perceive formal controls as a sign of distrust and restraint, which can lead to costs of control in the form of lower employee cooperation and effort. We propose that charitable giving reduces these costs of control. We draw on the halo effect and propose that corporate charitable giving alters employees’ perception of and reaction to formal controls. In a (...) laboratory experiment, we find that charitable giving by a company creates a higher level of employee trust in a manager who decides to implement a control and a more positive assessment of formal control. These positive effects of charitable giving lead to lower costs of control compared to the absence of charitable giving. We thereby provide an example of how charitable giving as a corporate social responsibility activity yields positive benefits by altering the behavior of internal company stakeholders. (shrink)

Conversely, given that almost all trajectories spend almost all of their time (...) in a certain region, that region is of overwhelming phase-space measure. In total, the time and phase-space average of the equilibrium state approximately coincide. Consequently, equilibrium can be defined equivalently in terms of the time or the phase-space average. Moreover, since the two averages are almost equal, the behaviour of the system is essentially ergodic. This paper analyzes the ergodic hypothesis in the context of Boltzmann’s late work in statistical mechanics, where Boltzmann lays the foundations for what is today known as the typicality account. I argue that, based on the concepts of stationarity (of the measure) and typicality (of the equilibrium state), the ergodic hypothesis, as an idealization, is a consequence rather than an assumption of Boltzmann’s account. More precisely, it can be shown that every system with a stationary measure and an equilibrium state (...) (be it a typical state with respect to the phase space or the time average) behaves essentially as if it were ergodic. I claim that Boltzmann was aware of this fact as it grounds both his notion of equilibrium, relating it to the thermodynamic notion of equilibrium, and his estimate of the fluctuation rates. The fifth chapter of _Experience Embodied_ is devoted to Herder’s theory of cognition and the epistemic merits of the capacity for ‘sympathy’, or ‘empathy’ – what Herder calls _Einfühlung_, and which Waldow renders more accurately as ‘affective immersion’. I situate Waldow’s reading of Herder as a member of the epistemological tradition within the debate on Herder’s relationship to the Enlightenment. Waldow’s reading, I contend, is congruent with the view of Herder as an Enlightenment, rather than anti-Enlightenment, figure. I focus on (...) what Waldow calls ‘the problem of the conceivability of difference’ (Waldow 2020, 185) and how she charts Herder’s proposed method of Einfühlung and the need for ‘affective immersion’ to address this problem. However, I also identify three potential problems, which Waldow does not address, that can arise when _Einfühlung_is taken too far: the first is that it may lead to relativism, and thus to incoherence; the second is reductionism, which can eliminate, rather than draw attention to, difference – thereby achieving the opposite goal; while the third is that relying solely on _Einfühlung_as a method can lead us into error, as it is speculative and lacks an external truth criterion. AbstractBohmian mechanics grounds the predictions of quantum mechanics in precise dynamical laws for a primitive ontology of point particles. In an appraisal of the de-Broglie–Bohm theory, the paper discusses the crucial epistemological and conceptual role that a primitive ontology plays within a physical theory. It argues that quantum theories without primitive ontology fail to make contact with observable reality in a clear and consistent manner. Finally, it discusses Einstein’s epistemological model and why it supports the primitive ontology approach.

We analyze the points of total collision of the Newtonian gravitational system on shape space (the relational configuration space of the system). While the Newtonian equations of motion, formulated with respect to absolute space and time, are singular at the point of total collision due to the singularity of the Newton potential at that point, this need not be the case on shape space where absolute scale doesn’t exist. We investigate whether, adopting a relational description of the system, the shape (...) degrees of freedom, which are merely angles and their conjugate momenta, can be evolved through the points of total collision. Unfortunately, this is not the case. Even without scale, the equations of motion are singular at the points of total collision (and only there). This follows from the special behavior of the shape momenta. While this behavior induces the singularity, it at the same time provides a purely shape-dynamical description of total collisions. By help of this, we are able to discern total-collision solutions from non-collision solutions on shape space, that is, without reference to (external) scale. We can further use the shape-dynamical description to show that total-collision solutions form a set of measure zero among all solutions. (shrink)

The history of the human face is the history of its social coding and the media- conditions of its appearance. The best way to explain the »selfie«-practices of today’s digital culture is to understand such practices as both participative and commercialized cultural techniques that allow their users to fashion their selves in ways they consider relevant for their identities as individuals. Whereas they may put their image of themselves front stage with their selfies, such images for being socially shared have (...) to match determinate role-expectations, body-norms and ideals of beauty. Against this backdrop, collectively shared repertoires of images of normalized subjectivity have developed and leave their mark on the culture of digital communication. In the critical and reflexive discourses that surround the exigencies of auto-medial self-thematization we find reactions that are critical of self-representation as such, and we find strategies of de-subjectification with reflexive awareness of their media conditions. Both strands of critical reactions however remain ambivalent as reactions of protest. The final part of the present article focuses on inter-discourses, in particular discourses that construe the phenomenon of selfies thoroughly as an expression of juvenile narcissism. The author shows how this commonly accepted reading which has precedents in the history of pictorial art reproduces resentment against women and tends to stylize adolescent persons into a homogenous »generation« lost in self-love. We discuss the total collision singularities of the gravitational N-body problem on shape space. Shape space is the relational configuration space of the system obtained by quotienting ordinary configuration space with respect to the similarity group of total translations, rotations, and scalings. For the zero-energy gravitating N-body system, the dynamics on shape space can be constructed explicitly and the points of total collision, which are the points of central configuration and zero shape momenta, can be analyzed in detail. It turns (...) out that, even on shape space where scale is not part of the description, the equations of motion diverge at (and only at) the points of total collision. We construct and study the stratified total-collision manifold and show that, at the points of total collision on shape space, the singularity is essential. There is, thus, no way to evolve the solutions through these points. This mirrors closely the big bang singularity of general relativity, where the homogeneous-but-not-isotropic cosmological model of Bianchi IX shows an essential singularity at the big bang. A simple modification of the general-relativistic model (the addition of a stiff matter field) changes the system into one whose shape-dynamical description allows for a deterministic evolution through the singularity. We suspect that, similarly, some modification of the dynamics would be required in order to regularize the total collision singularity of the N-body model. (shrink)

We discuss Boltzmann’s probabilistic explanation of the second law of thermodynamics providing a comprehensive presentation of what is called today the typicality account. Countering its misconception as an alternative explanation, we examine the relation between Boltzmann’s H-theorem and the general typicality argument demonstrating the conceptual continuity between the two. We then discuss the philosophical dimensions of the concept of typicality and its relevance for scientific reasoning in general, in particular for understanding the reduction of macroscopic laws to microscopic laws. Although microfinance organizations are generally considered as inherently ethical, recent events have challenged the legitimacy of the sector. High interest rates and the excessive profitability of some market leaders have raised the question of how to define a fair profit level for social enterprise. In this article, we construct a fair profit framework based on four dimensions: profitability, social mission, pricing, and surplus distribution. We then apply this framework using an empirical sample of 496 microfinance institutions. Results indicate that satisfying (...) all four criteria is a difficult, although not impossible, task. According to our framework, 24 MFIs emerge as true double bottom line organizations. These MFIs are characterized by higher outreach to women, lower portfolio risk, and higher productivity in high-density environments such as South Asia. We argue that excessive profits can be better understood relative to pricing, the outreach of the MFI, and organizational commitment to clients in the form of reduced interest rates. (shrink)

The paper discusses recent proposals by Carroll and Chen, as well as Barbour, Koslowski, and Mercati to explain the arrow of time without a Past Hypothesis, i.e. the assumption of a special initial state of the universe. After discussing the role of the Past Hypothesis and the controversy about its status, we explain why Carroll's model - which establishes an arrow of time as typical - can ground sensible predictions and retrodictions without assuming something akin to a Past Hypothesis. We (...) then propose a definition of a Boltzmann entropy for a classical N-particle system with gravity, suggesting that a Newtonian gravitating universe might provide a relevant example of Carroll's entropy model. This invites comparison with the work of Barbour, Koslowski, and Mercati that identifies typical arrows of time in a relational formulation of classical gravity on shape space. We clarify the difference between this gravitational arrow in terms of shape complexity and the entropic arrow in absolute spacetime, and work out the key advantages of the relationalist theory. We end by pointing out why the entropy concept relies on absolute scales and is thus not relational. (shrink)

Despite the rapid adoption of technology in human resource departments, there is little empirical work that examines the potential challenges of algorithmic decision-making in the recruitment process. In this paper, we take the perspective of job applicants and examine how they perceive the use of algorithms in selection and recruitment. Across four studies on Amazon Mechanical Turk, we show that people in the role of a job applicant perceive algorithm-driven recruitment processes as less fair compared to human only or algorithm-assisted (...) human processes. This effect persists regardless of whether the outcome is favorable to the applicant or not. A potential mechanism underlying algorithm resistance is the belief that algorithms will not be able to recognize their uniqueness as a candidate. Although the use of algorithms has several benefits for organizations such as improved efficiency and bias reduction, our results highlight a potential cost of using them to screen potential employees during recruitment. A random sample of 146 fortune 500 firms were surveyed in 1996 to determine whether firm size and industry type affect employers' level of involvement and support of ethical and environmental policies and practices. The study found relationships between firm size and ethical and environmental policies and practices. While the majority of firms (90.3%), regardless of size, have a formal written code of ethics, large firms are more likely to employ an ombudsperson to handle ethical concerns and to have a (...) network confidentiality policy. Although most firms (83.5%) have a formal written environmental policy, large firms are more inclined to invest in new ways to reduce the production of various types of waste. Another interesting twist to the study has to do with the relationships found between industry type and ethical and environmental policies and practices. Industries, such as the computers and electronics and scientific and photographics sectors, that are involved with high precision products and industries, such as mining, crude oil, and petroleum refining, that utilize natural resources are more inclined to have a formal written code of ethics and social responsibility. In addition, industries that utilize natural resources are more likely than other industries to have formal written environmental policies and practices. (shrink)

Investors with standard monetary preferences will give a fund manager incentives to increase firm profits, which can be achieved through a share in profits via carried interest. When investors have social preferences, it is not clear which incentives the manager should receive. We explore this puzzle by applying an agency theory perspective to impact investing, a practice where investors seek both financial returns and a measurable social or environmental impact. Using an inductive, qualitative approach, we identify and describe the ethical (...) tensions and challenges faced by fund managers to structure and implement impact-based variable compensation schemes. Our results indicate that economic incentives tied to non-financial objectives are useful to alleviate goal incongruity between principals and agents during fund creation but have the potential to lead to perverse effects during the fund lifecycle, where managers may exploit subjective non-financial metrics to maximize personal wealth. We introduce the concept of impact fidelity, a conceptual equivalent of fiduciary duty, to ensure that investment decisions reflect the asset owner’s impact preferences. (shrink)

Spontaneous eye blink rate has been linked to attention and memory, specifically working memory. sEBR is also related to striatal dopamine activity with schizophrenia and Parkinson’s disease showing increases and decreases, respectively, in sEBR. A weakness of past studies of sEBR and WM is that correlations have been reported using blink rates taken at baseline either before or after performance of the tasks used to assess WM. The goal of the present study was to understand how fluctuations in sEBR during (...) different phases of a visual WM task predict task accuracy. In two experiments, with recordings of sEBR collected inside and outside of a magnetic resonance imaging bore, we observed sEBR to be positively correlated with WM task accuracy during the WM delay period. We also found task-related modulation of sEBR, including higher sEBR during the delay period compared to rest, and lower sEBR during task phases that place demands on visual attention. These results provide further evidence that sEBR could be an important predictor of WM task performance with the changes during the delay period suggesting a role in WM maintenance. The relationship of sEBR to DA activity and WM maintenance is discussed. (shrink)

But the confusion surrounding the publication.of the posthumous fragments, particularly in the wake of the Schlechta-Edition controversy, caused the two men to question existing German editions. Montinari's visit to the Nietzsche Archive in Weimar in 1961 confirmed their growing conviction that the only way to eliminate the inaccuracies and BOOK REVIEWS 129 omissions with respect to the late fragments was to work from the original manuscripts. Since they had to go to Weimar anyway, they reasoned, why not take the bull by the horns and attempt a truly critical German edition of all of Niet.z.sche's writings as well? Now that nine of the planned thirty volumes of the German edition have been published, in particular IV, 4 (commentary to Section IV) and VIII, 2 (posthumous fragments of 1887-1888), it appears that the editors have an excellent chance of achieving not only a critical, but a definitive edition of Nietzsche's works. 1 Volumes IV, 4 and VIII, 2 are of special importance to our evaluation as, more than the other volumes published thus far, they reveal the critical and innovative features of the edition. It will pay to examine them in some detail. The first thing we encounter in volume IV, 4 is a statement of editorial principles. We learn that with regard to works which Nietzsche himself had published, both first editions and later editions approved by Nietzsche were consulted--a double-check was needed since Nietzsche with his bad eyesight was a poor proofreader. In the case of obvious printing errors that were retained through all the printed editions, final manuscripts were also referred to; usually several, as the scribes occasionally misunderstood Nietzsche when he dictated to them. The procedure is careful but it is also selective. What is to assure us that the editors made the right selection? This problem is dealt with in the 380 pages which collate all the variants found in the principal manuscripts and editions. Whenever possible, the reason for having variants is given. The explanation of the critical apparatus is a model of painstaking thoroughness. So far authenticity and objectivity have been achieved to a high degree. However, a principal difficulty in editing Nietzsche's works is chronology, determining the order in which the fragments and manuscripts were written. How did the editors proceed here? There is a section eighteen pages long on manuscript chronology and genesis in which the editors detail their reasoning and conclusions. To back this up there are two additional sections: (1) a page-by-page inventory of every manuscript used, summarizing the content of each page and listing such facts as the designation number, the presumed scribe, the kind... An analysis of two heuristic strategies for the development of mechanistic models, illustrated with historical examples from the life sciences. In Discovering Complexity, William Bechtel and Robert Richardson examine two heuristics that guided the development of mechanistic models in the life sciences: decomposition and localization. Drawing on historical cases from disciplines including cell biology, cognitive neuroscience, and genetics, they identify a number of "choice points" that life scientists confront in developing mechanistic explanations and show how different choices result in (...) divergent explanatory models. Describing decomposition as the attempt to differentiate functional and structural components of a system and localization as the assignment of responsibility for specific functions to specific structures, Bechtel and Richardson examine the usefulness of these heuristics as well as their fallibility—the sometimes false assumption underlying them that nature is significantly decomposable and hierarchically organized. When Discovering Complexity was originally published in 1993, few philosophers of science perceived the centrality of seeking mechanisms to explain phenomena in biology, relying instead on the model of nomological explanation advanced by the logical positivists (a model Bechtel and Richardson found to be utterly inapplicable to the examples from the life sciences in their study). Since then, mechanism and mechanistic explanation have become widely discussed. In a substantive new introduction to this MIT Press edition of their book, Bechtel and Richardson examine both philosophical and scientific developments in research on mechanistic models since 1993.
