During the last half of the twentieth century, legal philosophy (or legal theory or jurisprudence) has grown significantly. It is no longer the domain of a few isolated scholars in law and philosophy. Hundreds of scholars from diverse fields attend international meetings on the subject. In some universities, large lecture courses of five hundred students or more study it. The primary aim of the Law and Philosophy Library is to present some of the best original work on legal philosophy from (...) both the Anglo-American and European traditions. Not only does it help make some of the best work avail able to an international audience, but it also encourages increased awareness of, and interaction between, the two major traditions. The primary focus is on full-length scholarly monographs, although some edited volumes of original papers are also included. The Library editors are assisted by an Editorial Advisory Board of internationally renowed scholars. Legal philosophy should not be considered a narrowly circumscribed field. (shrink)

Action logic of Pratt [21] can be presented as Full Lambek Calculus FL [14, 17] enriched with Kleene star *; it is equivalent to the equational theory of residuated Kleene algebras (lattices). Some results on axiom systems, complexity and models of this logic were obtained in [4, 3, 18]. Here we prove a stronger form of *-elimination for the logic of *-continuous action lattices and the –completeness of the equational theories of action lattices of subsets of a finite monoid and (...) action lattices of binary relations on a finite universe. Forecasts predicting the reunification of the Korean Peninsula were common throughout the 1990s. Since then, enthusiasm for such predictions has dampened, and though the fundamental assumption of reunification remains, predictions of when and how this will happen have been more restrained. Reunification leaves two unresolved yet interdependent issues: reunification itself, which is the urgent challenge; and the strategic issues that emerge from reunification, which have the potential to fundamentally transform strategic relations in the region of Northeast Asia. Within this context, (...) this paper examines the prospects of Korean reunification against the background of the interstate relations. Initially, it will establish the framework from which such scenarios will emerge: the historical background of the division, the extreme differences between the two states, the role played by the North Korean nuclear threats and the impact of the September 11, 2001 on the interstate relations, and finally general situation and relations in the East Asian region. Then, three possible scenarios of the unification will be developed: through peaceful integration, through the fall of North Korea or through a war. Summing up, even the death of Kim Jong Il will not bring change in the domestic and foreign policy of North Korea which is going to continue an aggressive approach toward the South. In the short-term reunification is definitely not in the interest of the current ROK administration, and the South has no intention of encouraging it. None of the considered scenarios envisions early reunification, and it seems that for the future, the status quo on the Korean Peninsula will remain. (shrink)

In the paper, there is presented the theory of logical consequence operators indexed with taboo functions. It describes the mechanisms of logical inference in the environment of forbidden sentences. This kind of processes take place in ideological discourses within which their participants create various narrative worlds (mental worlds). A peculiar feature of ideological discourses is their association with taboo structures of deduction which penalize speech acts. The development of discourse involves, among others, transforming its deduction structure towards the proliferation of (...) consequence operators and modifying penalty functions. The presented theory enables to define various processes of these transformations in the precise way. It may be used in analyses of conflicts between competing elm experts acting within a discourse. ABSTRACT This article argues for a unique role of imagination and mental images in the moral education of students. Imagination is rendered here as a capacity oriented toward realizable and salient goals; mental images are understood as particular future-oriented self-representations (FOSRs) devised by and held in imagination. FOSRs have four moral attributes: they are 1) expressive of us as moral agents, 2) shape our moral identity, 3) serve as moral pointers, and 4) help devise mitigating strategies. FOSRs can be created (...) and utilized in educational settings to further the goals of moral education by i) fostering sensitivity to moral situations among students, ii) motivating learners to act morally, iii) facilitating environments supportive of moral practice and moral habituation, and iv) helping strengthen cross-situational consistency of moral action. The four moral attributes of future-oriented self-representations (FOSRs) (1–4) that are to be engaged in moral education to further its goals (i–iv) are correlated with four elements of moral education, namely: a) moral awareness; b) moral competency; c) moral motivation; and d) moral capacity. To argue for the special role of imagination and mental images in moral education this paper integrates philosophical research and conceptual and empirical studies in psychology and education on the morality of imagination and mental images. The presentation of the formal conception of noemata is the main aim of the article. In the first section, three informal approaches to noemata are discussed. The goal of this chapter is specifying main controversies and their sources concerned with different ways of the understanding of noemata. In the second section, basic assumptions determining the proposed way of understanding noemata are presented. The third section is devoted to the formal set-theoretic construction needed for the formal comprehension of noemata. In the (...) fourth section, definitions of noemata and their various kinds, as well as definitions of other phenomenological notions are formulated. An axiomatics of the product-free syntactic calculus L ofLambek has been presented whose only rule is the cut rule. It was alsoproved that there is no finite axiomatics of that kind. The proofs weresubsequently simplified. Analogous results for the nonassociativevariant NL of L were obtained by Kandulski. InLambek's original version of the calculus, sequent antecedents arerequired to be nonempty. By removing this restriction, we obtain theextensions L 0 and NL 0 ofL and NL, respectively. Later, the finiteaxiomatization problem for L (...) 0 andNL 0 was partially solved, viz., for formulas withoutleft (or, equivalently, right) division and an (infinite) cut-ruleaxiomatics for the whole of L 0 has been given. Thepresent paper yields an analogous axiomatics forNL 0. Like in the author's previous work, the notionof rank of an axiom is introduced which, although inessentialfor the results given below, may be useful for the expectednonfinite-axiomatizability proof. The author argues that it is possible to develop a metaphysical interpretation of Aquinas's doctrine of natural law that still deserves serious philosophical consideration today; examines Aquinas's theoretical reflections on the metaphysical and epistemological aspects of human natural goodness, applying them to moral contexts as found in the Secunda secundae.

Poppera i Tarskiego wiele łączyło. Obaj urodzili się na początku XX wieku i obaj pochodzili z rodzin żydowskich zasymilowanych w swoich ojczyznach. Obaj emigrowali w czasie wojny ze swych krajów i obaj do końca życia przebywali na obczyźnie. Zarówno Popper jak i Tarski żywo interesowali się filozofią, ale obaj odebrali też akademickie wyksztalcenie matematyczne. Podobny był przedmiot ich głównych zainteresowań: obaj analizowali teorie naukowe. Popper zajmował się metodologią nauk empirycznych, natomiast Tarski badaniami systemów dedukcyjnych. Popper ponadto uprawiał filozofię i wielokrotnie (...) wyrażał swoje stanowisko w kwestiach filozoficznych. Inaczej było z Tarskim: zasadniczo unikał wypowiadania się na tematy filozoficzne, będąc bardzo ostrożnym w wyciąganiu wniosków natury światopoglądowej z logiki, co nie przeszkadzało, że rezultaty jego badań logicznych uznawane były przez wielu, w tym również przez Poppera, za brzemienne w konsekwencje filozoficzne. Obaj byli, każdy w swojej dziedzinie, myślicielami oryginalnymi, więcej - wybitnymi i obaj aktywnie uczestniczyli w życiu naukowym swoich czasów. Kiedy w latach 30. zbliżyli się do Koła Wiedeńskiego, zarówno Popper jak i Tarski zaznaczyli swoją odrębność wobec koncepcji głoszonych przez jego członków. To właśnie za sprawy Koła Wiedeńskiego doszło do ich spotkania - spotkania, o którym później wielokrotnie wspominał Popper. Popper poszukujący teoretycznej podstawy dla swej filozofii nauki znalazł ją. w semantyce Tarskiego. (shrink)

This article engages the considerations of imagination in Kierkegaard and Ricoeur to argue for a moral dimension of the imagination and its objects. Imaginary objects are taken to be mental representations in images and narratives of people or courses of action that are not real in the sense that they are not actual, or have not yet happened. Three claims are made in the article. First, by drawing on the category of possibility, a conceptual distinction is established between imagination and (...) fantasy, (1) I claim that imagination has a moral dimension because it is engaged in considering real-life possibilities. Second, (2) drawing on Kierkegaard and Ricoeur, it is argued that mental representations of selfhood in imagination have a moral dimension because they essentially allow people to understand the development of agency in human selfhood by means of representations of would-be selves and narrative figurations of the self. Third, (3) mental representations of human selves have a moral dimension because they form important points of reference for moral orientations in the field of human praxis (moral pointers). ABSTRAKT: Centralnym tematem artykułu jest pojęcie wolności, które – wespół z odpowiedzialnością – było dla Szasza pojęciem najważniejszym, „cywilizującym”. W części pierwszej przedstawiam i analizuję definicję i uwarunkowania wolności w ujęciu Szasza, w części zaś drugiej przypominam odpowiedź Szasza na fundamentalne, zawsze aktualne pytanie: „jak ocalić nie tylko religijną, lecz i medyczną wolność”? Na zakończenie staram się uwidocznić sens tytułu książki Szasza na tle jego własnych poglądów. -/- *** -/- ABSTRACT: The central topic of the article is the concept of (...) freedom, which – together with responsibility – was the most important, “civilizing” concept for Szasz. In the first part, I present and analyse the definition and conditions of freedom according to Szasz, and in the second part I recall Szasz’s answer to the fundamental, always relevant question: “how to save not only religious, but also medical freedom”? Finally, I try to highlight the meaning of the title of Szasz’s book against the background of his own views. (shrink)

Traditional martial arts continue to be interesting and inspiring to many people around the globe. Some of their contemporary adaptations attract enthusiasts for whom they are especially important. In this article, the author bases his observations on his own long-term participation. The analysis takes into account the influence of the perspectives of Jigoro Kano and several other creators of modern varieties of Japanese budo. It can be concluded that regular, even daily, practice—cultivating martial arts and internalizing its values—co-creates the lifestyle (...) of instructors and advanced students. (shrink)

In [2], Bar-Hillel, Gaifman, and Shamir prove that the simple phrase structure grammars (SPGs) defined by Chomsky are equivalent in a certain sense to Bar-Hillel's bidirectional categorial grammars (BCGs). On the other hand, Cohen [3] proves the equivalence of the latter ones to what the calls free categorial grammars (FCGs). They are closely related to Lambek's syntactic calculus which, in turn, is based on the idea due to Ajdukiewicz [1]. For the reasons which will be discussed in the last section, (...) Cohen's proof seems to be at least incomplete. This paper yields a direct proof of the equivalence ofFCGs andSPGs. (shrink)

Krzysztof Matuszewski, tom 1-6) – aby zarysować szczególną historię towarzyszącą publikacji tego dzieła, a także by przypomnieć ewentualnym czytelnikom o jego znaczeniu literackim i filozoficznym w opozycji do popularnych aczkolwiek trywialnych twierdzeń, że twórczość Sade’a to nic więcej jak pornografia. Konsekwentny rozwój myśli sadycznej ukazuje filozoficzną odyseję ludzkiego poszukiwania suwerenności. Ma ona swój początek (...) w oświeceniowej negacji Boga, lecz nie zatrzymuje się na niej. W pełni zautonomizowany rozum wchodzi w sojusz z Naturą, lecz jego również musi zakwestionować, tak jak musi zanegować Innego oraz samo Ego, by ostatecznie osiągnąć stanowisko nihilistycznego immoralizmu przejawiającego się apatycznym ponawianiem zbrodni. Some notions of the logic of questions (presupposition of a question, validation, entailment) are used for defining certain kinds of completeness of elementary theories. Presuppositional completeness, closely related to -completeness ([3], [6]), is shown to be fulfilled by strong elementary theories like Peano arithmetic.

We characterize all finitary consequence relations over S4.3, both syntactically, by exhibiting so-called passive rules that extend the given logic, and semantically, by providing suitable strongly adequate classes of algebras. This is achieved by applying an earlier result stating that a modal logic L extending S4 has projective unification if and only if L contains S4.3. In particular, we show that these consequence relations enjoy the strong finite model property, and are finitely based. In this way, we extend the known (...) results by Bull and Fine, from logics, to consequence relations. We also show that the lattice of consequence relations over S4.3 is countable and distributive and it forms a Heyting algebra. (shrink)

Abstract“Reason of state” is a concept that is rarely used in contemporary legal and political philosophy, compared to everyday parlance; “public reason,” in contrast, is ubiquitous, especially in liberal philosophy, as a legitimacy‐conferring device. In this article it is argued that the unpopularity of the notion of “reason of state” is partly due to its notorious ambiguity. Three different usages of the notion can be identified: a “thin” usage (where “reason of state” is equivalent to the common good); an “ironical” (...) usage (where it is used pejoratively to denounce it as a pretext for application of illegitimate or illegal means); and a “pre‐emptive” usage (where “reason of state” functions as a legitimate second‐order exclusionary reason used to override otherwise mandatory first‐order rules of action). It is argued that only the “thin” usage is helpful in a by‐and‐large liberal‐democratic context. The article then discusses the main dilemmas related to the concept of public reason, especially in its most influential, Rawlsian interpretation, and defends the concept against common critiques. Finally, the two concepts of “reason of state” and public reason are compared, and it is argued that a “thin” usage of “reason of state” is functionally equivalent to public reason, and that both resonate with the theory of “input democracy” (focusing, as it does, on the legitimacy of reasons—or motivations—for applying coercive rules to individuals). The article also identifies a problematic feature of “reason of state”: its emphasis on the state as a privileged interpreter of such reasons and/or as identifying the pool of actors within which the “constituency” of public reason is ascertained. There are good reasons to resist both of these consequences: the former because of its potentially authoritarian consequences, the latter because of reasons provided by cosmopolitan political conceptions. This article reevaluates the origins of Kierkegaard’s concept of imitation. It challenges the general approach to the genealogy of the phenomenon in question, which privileges the influence of various religious traditions on the thinker and ignores his exposure to the non-Christian literature. I contend that a close reading of the Apology, the Sophist, the Republic, and the Phaedo alongside Kierkegaard’s texts from the so-called second authorship reveals in the dialogues of Plato the three crucial aspects of Kierkegaard’s concept of imitation, (...) namely the phenomenon of following after, the existential, and the non-imitative character of imitation. Lastly, I show that, apart from striving to be a follower/an imitator of Christ, Kierkegaard perceives himself as a follower/an imitator of Socrates. This means that the life of the imitator of Christ is the examined life in the Socratic sense. (shrink)

This book examines the relationship between the idea of legitimacy of law in a democratic system and equality, conceived in a tripartite sense: political, legal, and social. Exploring the constituent elements of the legal philosophy underlying concepts of legitimacy, this book seeks to demonstrate how a conception of democratic legitimacy is necessary for understanding and reconciling equality and political legitimacy by tracing and examining the conceptions of equality in political, legal, and social dimensions. -/- In the sphere of political equality (...) this book argues that the best construction of equality in a democratic system - which resonates with the legitimizing function of majority rule - is that of equality of political opportunity. It is largely procedural, but those procedures represent important substantive values built into a majoritarian system. In the sphere of legal equality it argues that a plausible conception of non-discrimination can be constructed through a "reflective equilibrium" process, and should reject a thoughtless assumption that the presence of some particular criteria of differentiations necessarily taints a legal classification as discriminatory. Finally, the chapters on social equality explore, in some detail, the currently influential, and presumptively attractive, "luck egalitarianism": the idea that social equality calls for neutralizing the disparate effects of bad brute luck upon a person's position in society. Wojciech Torzewski What Kind of ‘History’ are We? – the Historicity of Human from Ethical PerspectiveThis article presents the ethical aspect of the concept of narrative identity, especially in relation to the concept of Charles Taylor. The author makes also attemption to reconstruct the two main objections that can be drawn at this concept. Namely, firstly, the complaint relativization of the ethical and, secondly, the complaint absolutizing ethical perspective. In this paper, we present two experimental studies on reference of complex demonstratives. The results of our experiments challenge the dominant view in philosophy of language, according to which demonstrative reference is determined by the speaker's intentions. The first experiment shows that in a context where there are two candidates for the referent—one determined by the speaker’s intention, the other by some “external” factors—people prefer to identify the referent of a demonstrative with the latter object. The external factors for which (...) this prediction has been confirmed include the speaker’s demonstration and the descriptive content of a demonstrative. The second experiment shows that while this preference can be explained in terms of the speakers’ having different sorts of referential intentions, the relevant kind of intentions are fully opaque to the subjects. At the end of our paper, we point to some alternative accounts of demonstrative reference, including a pluralistic and hybrid approach, which can accommodate our experimental results. (shrink)

G.E.M. Anscombe znalazła w Etyce nikomachejskiej Arystotelesa pewną niekonsekwencję: Arystoteles zdaje się twierdzić, że cokolwiek wynika z namysłu, jest wyborem, i że słaby wolą może się skutecznie namyślać, ale i że — z drugiej strony — on nie wybiera. Anscombe znajduje rozwiązanie tej sprzeczności: Arystoteles powinien był, jej zdaniem, zaznaczyć, że by z namysłu wynikał wybór, to, ze względu na co się namyślamy, musiałby sam być przedmiotem uprzedniego wyboru. Badam to rozwiązanie i znajduję jego słabe strony, jak niebezpieczeństwo nieskończonego regresu, (...) trudność prześledzenia genealogii wyborów i nieosiągalność pierwotnego celu. Pomimo to próbuję je ulepszyć, poddając pod dyskusję, czy tego rodzaju pierwotne wybory, jakich wymaga rozwiązanie Anscombe, nie są jednak czasem naprawdę podejmowane i czy ich cele nie są rozkładalne na takie, które można realistycznie mieć nadzieję osiągnąć. Spinoza is often presented as an important source for Kant’s view on Judaism and the Old Testament. This claim is often made on the basis of the alleged affinity between the relevant ideas of the two thinkers. In this article, I agree with scholars who point out that Spinoza’s direct influence on Kant’s view of the Old Covenant can be doubted, and further argue that the substance of their ideas about the Hebrew Bible is fundamentally different. I discuss their views (...) on biblical hermeneutics (here showing some affinity between them), the Mosaic law (its content and divinity), and especially the significance of Judaism for Christianity, where the discrepancy between Kant and Spinoza regarding the Old Covenant becomes particularly evident.
