During the last half of the twentieth century, legal philosophy (or legal theory or jurisprudence) has grown significantly. It is no longer the domain of a few isolated scholars in law and philosophy. Hundreds of scholars from diverse fields attend international meetings on the subject. In some universities, large lecture courses of five hundred students or more study it. The primary aim of the Law and Philosophy Library is to present some of the best original work on legal philosophy from (...) both the Anglo-American and European traditions. Not only does it help make some of the best work avail able to an international audience, but it also encourages increased awareness of, and interaction between, the two major traditions. The primary focus is on full-length scholarly monographs, although some edited volumes of original papers are also included. The Library editors are assisted by an Editorial Advisory Board of internationally renowed scholars. Legal philosophy should not be considered a narrowly circumscribed field. (shrink)

This article engages the considerations of imagination in Kierkegaard and Ricoeur to argue for a moral dimension of the imagination and its objects. Imaginary objects are taken to be mental representations in images and narratives of people or courses of action that are not real in the sense that they are not actual, or have not yet happened. Three claims are made in the article. First, by drawing on the category of possibility, a conceptual distinction is established between imagination and (...) fantasy, (1) I claim that imagination has a moral dimension because it is engaged in considering real-life possibilities. Second, (2) drawing on Kierkegaard and Ricoeur, it is argued that mental representations of selfhood in imagination have a moral dimension because they essentially allow people to understand the development of agency in human selfhood by means of representations of would-be selves and narrative figurations of the self. Third, (3) mental representations of human selves have a moral dimension because they form important points of reference for moral orientations in the field of human praxis (moral pointers). The most‐critical point of reproductive development in all sexually reproducing species is the transition from mitotic to meiotic cell cycle. Studies in unicellular fungi have indicated that the decision to enter meiosis must be made before the beginning of the premeiotic S phase. Recent data from the mouse1 suggest that this timing of meiosis initiation is a universal feature shared also by multicellular eukaryotes. Some notions of the logic of questions (presupposition of a question, validation, entailment) are used for defining certain kinds of completeness of elementary theories. Presuppositional completeness, closely related to -completeness ([3], [6]), is shown to be fulfilled by strong elementary theories like Peano arithmetic.

This book carefully examines the most recent wave of the emergence and case law of activist constitutional courts: those that were set up after the fall of communism in Central and Eastern Europe. In contrast to most other analysts and scholars, the study does not take for granted that they are a "force for good" but rather subjects them to critical scrutiny against a (...) background of wide-ranging comparative and theoretical analysis of constitutional judicial review in the modern world. In this work, an intuitionistic propositional logic with a Galois connection is introduced. In addition to the intuitionistic logic axioms and inference rule of modus ponens, the logic contains only two rules of inference mimicking the performance of Galois connections. Both Kripke-style and algebraic semantics are presented for IntGC, and IntGC is proved to be complete with respect to both of these semantics. We show that IntGC has the finite model property and is decidable, but Glivenko's Theorem does not hold. (...) Duality between algebraic and Kripke semantics is presented, and a representation theorem for Heyting algebras with Galois connections is proved. Early twelfth-century logicians invoked past-tensed statements with future-oriented contents to undermine the assumption that every proposition ‘about the past’ is determinate. In the second half of the century, the notion of future-dependence was used to restrict the scope of necessity per accidens. At some point, this idea began to be applied in theology to solve puzzles surrounding predestination, prescience, prophecy, and faith. In the mid-1160s, Magister Udo quotes some thinkers who insisted that the principle of the necessity of the past (...) should exclude dicta that ‘relate to the future’, such as that he has been predestined. Peter of Poitiers adopted this ‘Ockhamist’ strategy around 1170. We find similar accounts in Simon of Tournai and Alan of Lille, who invoked it in other contexts as well. By the time of Praepositinus of Cremona, Hubert of Pirovano, and Stephen Langton, the restricted principle became something of a common view at Paris. (shrink)

Konsekwentny rozwój myśli sadycznej ukazuje filozoficzną odyseję ludzkiego poszukiwania suwerenności. Ma ona swój początek (...) w oświeceniowej negacji Boga, lecz nie zatrzymuje się na niej. W pełni zautonomizowany rozum wchodzi w sojusz z Naturą, lecz jego również musi zakwestionować, tak jak musi zanegować Innego oraz samo Ego, by ostatecznie osiągnąć stanowisko nihilistycznego immoralizmu przejawiającego się apatycznym ponawianiem zbrodni. The doctrine of the Intelligent Design offers an intuitive explanation of why the ordering in the Universe is authored by an intentional agency. Due to its appeal to common-sense perception, this doctrine is endorsed even by scientifically literate circles despite of its obvious contradiction with the discoveries of science. In this article, an attempt to apply the tools of the cognitive science of religion to the appraisal of the methodological and epistemic status of the ID doctrine is presented. It is (...) concluded that the ID doctrine may serve as means of the real-time metaphorical reassurance of the creative power of God while it cannot give grounds to any literal inferences on the nature of the Divine action. The following text is a voice in the discussion around normative problems of innovative therapies. It particularly refers to the amendment to the Polish Act on the Professions of Physician and Dentist, also discussed in this issue in the article by Rafał Kubiak "Criminal liability for crimes related to the illegal conduct of a medical experiment.".

The equivalence of (classical) categorial grammars and context-free grammars, proved by Gaifman [4], is a very basic result of the theory of formal grammars (an essentially equivalent result is known as the Greibach normal form theorem [1], [14]). We analyse the contents of Gaifman's theorem within the framework of structure and type transformations. We give a new proof of this theorem which relies on the algebra of phrase structures and exhibit a possibility to justify the key construction used in Gaifman's (...) proof by means of the Lambek calculus of syntactic types [15]. W niniejszej analizie poddane badaniu zostały szczególne działania państwa, które przeciwdziałają szkodzeniu dobru wspólnoty, a mianowicie śmiercionośne działania funkcjonariuszy policyjnych. W tym celu pokazano najpierw, czym odróżniają się one od innych typów państwowego zabijania, a mianowicie zabijania wskutek wyroku sądowego oraz zabijania w ramach konfliktu zbrojnego. Następnie, rozważone zostały dwa główne typy śmiercionośnych działań policyjnych: (1) działania niosące ryzyko pozbawienia kogoś życia oraz (2) działania zmierzające bezpośrednio do śmierci jednostki. Wskazano szczegółowo, kiedy policjanci mają uprawnienie do podjęcia się takich działań. (...) Zagadnienie śmiercionośnych działań policyjnych zostało przeanalizowane z perspektywy tomistycznej. Poza odwoływaniem się do pism Akwinaty, poddane krytycznej analizie zostały stanowiska współczesnych badaczy, czerpiących z tradycji tomistycznej – Johna Finnisa, Edwarda Fesera, Gregory’ego Reichberga, Wendy Hicks oraz Benjamina Wisniewskiego. Artykuł przedstawia analizę historii zakończeń dwóch wierszy Anny Kamieńskiej – „Kiedy odchodzą wielcy” oraz „Jesteś mi ciepły młody”. Znane nam dokumenty literackie pozwalają znaleźć wspólny element tych dwóch procesów, z których jeden polegał na nieoczekiwanym dopisaniem puenty do ostatniej znanej nam wersji rękopiśmiennej wiersza, a drugi puentą uczynił w ostatnim etapie prac nad utworem zapis ze środka wcześniejszego brulionu. Tą częścią wspólną jest medytacyjny, nieretoryczny charakter warsztatu pisarskiego dojrzałej poetki. Jeśli pominąć oczywiste różnicy między obiema wierszami i procesami, z których (...) się wyłoniły, pozostanie silne podobieństwo, prawdopodobnie cecha charakterystyczna dla sposobu, w jaki pisała Anna Kamieńska przynajmniej od lat sześćdziesiątych minionego wieku, gdy proces twórczy był dla niej nie tyle okazją do znalezienia formy myśli, ale sam był myślorodny. In [2], Bar-Hillel, Gaifman, and Shamir prove that the simple phrase structure grammars (SPGs) defined by Chomsky are equivalent in a certain sense to Bar-Hillel's bidirectional categorial grammars (BCGs). On the other hand, Cohen [3] proves the equivalence of the latter ones to what the calls free categorial grammars (FCGs). They are closely related to Lambek's syntactic calculus which, in turn, is based on the idea due to Ajdukiewicz [1]. For the reasons which will be discussed in the last section, (...) An axiomatics of the product-free syntactic calculus L ofLambek has been presented whose only rule is the cut rule. It was alsoproved that there is no finite axiomatics of that kind. The proofs weresubsequently simplified. Analogous results for the nonassociativevariant NL of L were obtained by Kandulski. InLambek's original version of the calculus, sequent antecedents arerequired to be nonempty. By removing this restriction, we obtain theextensions L 0 and NL 0 ofL and NL, respectively. Later, the finiteaxiomatization problem for L (...) 0 andNL 0 was partially solved, viz., for formulas withoutleft (or, equivalently, right) division and an (infinite) cut-ruleaxiomatics for the whole of L 0 has been given. Thepresent paper yields an analogous axiomatics forNL 0. Like in the author's previous work, the notionof rank of an axiom is introduced which, although inessentialfor the results given below, may be useful for the expectednonfinite-axiomatizability proof. The paper presents the semantic model of logical content processing in the environment of tabooed sentences. Such sentences occur both in academic and colloquial discourses. They can be interpreted as infected formulas with the value of an insult. The proposed model assumes that the inferential mechanism of argumentative activities realised in discourses in the environment of such formulas is based on Bochvar's logical matrices and Kripke’s possible worlds semantic structures. This mechanism is determined by semantic consequence operators of three types. (...) The presented theory can be viewed as a formal tool for reconstructing the logical mental mechanism which stops deductive actions aiming at the development of narrative worlds in discourse practices during epistemic wars. It postulates that these practices, which occur in processes of developing science, are governed by special logical mechanisms of inference. (shrink)

This book examines the relationship between the idea of legitimacy of law in a democratic system and equality, conceived in a tripartite sense: political, legal, and social. Exploring the constituent elements of the legal philosophy underlying concepts of legitimacy, this book seeks to demonstrate how a conception of democratic legitimacy is necessary for understanding and reconciling equality and political legitimacy by tracing and examining the conceptions of equality in political, legal, and social dimensions. -/- In the sphere of political equality (...) this book argues that the best construction of equality in a democratic system - which resonates with the legitimizing function of majority rule - is that of equality of political opportunity. It is largely procedural, but those procedures represent important substantive values built into a majoritarian system. In the sphere of legal equality it argues that a plausible conception of non-discrimination can be constructed through a "reflective equilibrium" process, and should reject a thoughtless assumption that the presence of some particular criteria of differentiations necessarily taints a legal classification as discriminatory. Finally, the chapters on social equality explore, in some detail, the currently influential, and presumptively attractive, "luck egalitarianism": the idea that social equality calls for neutralizing the disparate effects of bad brute luck upon a person's position in society. The presentation of the formal conception of noemata is the main aim of the article. In the first section, three informal approaches to noemata are discussed. The goal of this chapter is specifying main controversies and their sources concerned with different ways of the understanding of noemata. In the second section, basic assumptions determining the proposed way of understanding noemata are presented. The third section is devoted to the formal set-theoretic construction needed for the formal comprehension of noemata. In the (...) fourth section, definitions of noemata and their various kinds, as well as definitions of other phenomenological notions are formulated. In the last section, possibilities of further developing the proposed formal conception are indicated. (shrink)

Action logic of Pratt [21] can be presented as Full Lambek Calculus FL [14, 17] enriched with Kleene star *; it is equivalent to the equational theory of residuated Kleene algebras (lattices). Some results on axiom systems, complexity and models of this logic were obtained in [4, 3, 18]. Here we prove a stronger form of *-elimination for the logic of *-continuous action lattices and the –completeness of the equational theories of action lattices of subsets of a finite monoid and (...) action lattices of binary relations on a finite universe. The problem of identity at least these days, is not a directly philosophical problem, but rather the subject of disputes in the well-known newspapers. Identity is rarely the subject of modern famous thinkers' speeches. This is because in the present process of uniting Europe, the main debate centres around the economic and political aspects of the process, whilst the cultural aspects are put to one side. It is worth mentioning here C. Adenauer's assertion: „The ground of European unity is an (...) idea of Christian community, culture and European civilization." In this context we can also mention the previous chairman of the European Commission, J. Dolors, who states: „If Europe does not have its own soul, it will not define itself as cultural, it will not be Europe. But if it is only a political or economical community, it will not absolutely fulfil its task." It is not difficult to notice the difference between these two statements; the first highlights the problem of cultural unity, formulated as a postulate, a kind of program which must be carried out in the future. We can interpret Dolors' thought as a kind of warning against neglecting the problem of cultural identity. (shrink)

ABSTRACTWhile in the 1960s Allan Bloom suggested to read William Shakespeare’s works through the prism of political philosophy, a decade earlier Carl Schmitt used the works of English poet in a reverse way: he read political philosophy and history through Shakespeare. Deprived – under the influence of Leo Strauss – from the possibility of considering Thomas Hobbes a decisionist thinker, Schmitt in his ‘Hamlet or Hecuba’ used Shakespeare’s most famous work to interpret origins of disappearance of the state of emergency (...) from English soil. Shakespeare was seen by Schmitt as a writer who captured the Sixteenth and seventeenth century changes in thinking about sovereignty and the state. Interestingly, Schmitt did not use Shakespeare as method for the first time: in first decades of twentieth century, in his diary, he made ‘Othello’ a prism through which he read his love life. Because the author of ‘The Concept of the Political’ is one of the less methodologically cohesive writers of twentieth century, his usage of Shakespeare twice, in different circumstances, is interesting. In an article, author links ‘Hamlet or Hecuba’ with Schmitt’s geopolitical works and presents Shakespeare’s works as the coherent method of interpretation in Schmitt’s philosophy of decisionism. With the meaning of trust, good faith and respect for promises made, protection, or assistance, fides in the non-exclusively religious sense of the word comes from the demand for ethical perfection: as such, it is omnipresent in human relations and in the dynamic of societies in the Middle Ages.

Труд представляет собой некоторый метод формализации логического следствия на основе исчисления квантификаторов. Этот метод, основанный Бетом, является очень удобным инструментом, позволяющим в большинстве случаев отрицать исчисление или же обосновывать его путвм нахоидвния контрмодвли, или we путём доказательства, что контрмодели нет. Настоящая работа осуществляет некоторую систематизацию проблемы семантического следствия. Начальный фрагмент посвящён некоторым важным семантическим понятиям в исчислении квантификаторов. Затем приведены правила графика семантических диаграмм. Рассмотрены танжа вопросы сопоставления формул с тан называемыми деревьями. В дальнейших рассуждениях были подданы дискуссии типы графиков (...) закрытых формул исчисления нвантифинаторов. Занлючивльнан часть работы содержит импозантные примеры для отличиыльмых типов графиков, кроме того, каждый пример графически проиллюстрирован соответствующим ему деревом. (shrink)

The paper characterizes axiomatically a class of temptation-driven preferences. The key (but not the only) novelty of the paper is the idea that the alternative which tempts when an item x is consumed may not be the same as the alternative which tempts when another item y is consumed. For any single item to be ultimately consumed, the other items can be ranked by how much they tempt. An individual contemplates, as an alternative consumption, only the item that tempts most. (...) The utility of a menu is then equal to the utility of the item that is consumed less a (psychological) cost of resisting temptation; this cost depends on both: the item to be consumed and the item that tempts. Unlike most of the existing literature, the axioms are imposed on deterministic menus, not on menus of lotteries. (shrink)

This article explores the dream descriptions submitted in 1973–1974 by former Polish prisoners of the Auschwitz concentration camp in response to a questionnaire sent out by Polish psychiatrists. These descriptions are being investigated as testimonies that represent the Auschwitz inmates’ experiences commonly regarded as “unspeakable.” Not only the dream experience itself, but also the respondents’ attitudes toward and beliefs about dreams are taken into consideration in an attempt to understand the impact of the Holocaust on the survivors. Their general inability (...) of comprehending the Auschwitz and post‐Auschwitz dreams seems to be the most important and significant aspect of their testimonies. The experience of dreams as completely strange and astonishing phenomena is being explained in this article in connection with the respondents’ ability and inability to recover from their Holocaust trauma. Play and Exploration in Animals — A Comparative Analysis Exploratory behavior and play are very often discussed together. However, despite many similarities they are two distinct forms of behavior. They have different evolutionary histories and they develop in different ways. Both forms of behavior play a crucial role in the development of sophisticated and complex psyche. The paper discusses similarities and differences between exploration and play. The hypothesis of the joint development of exploration, play and animal intelligence is proposed.

I agree with many of Adam Grobler’s theses, but several others raised my objection. (1) A.G. does not want to call scientific claims true. It is not so: very much of what scientists say about the world is true (in the classic sense), and scientists know it is. (2) A.G. leads us astray when he writes that the acceptance or rejection of hypotheses is determined, at least sometimes, by expert votes. It is not so: further research is the decisive factor (...) in accepting or rejecting hypotheses in science. (3) While A.G. is aware of some social determinants of knowledge, he ultimately states: “individuals are the subjects of scientific knowledge.” Contrary to this, I argue that one can only be a scientist as a member of a scientific thought collective. (4) A.G. believes that scientific knowledge is based on presuppositions, accepted unconsciously, that give meaning to statements made openly. After Wittgenstein, I repeat: “After all, nothing is concealed.”. (shrink)
