This article engages the considerations of imagination in Kierkegaard and Ricoeur to argue for a moral dimension of the imagination and its objects. Imaginary objects are taken to be mental representations in images and narratives of people or courses of action that are not real in the sense that they are not actual, or have not yet happened. Three claims are made in the article. First, by drawing on the category of possibility, a conceptual distinction is established between imagination and (...) fantasy, (1) I claim that imagination has a moral dimension because it is engaged in considering real-life possibilities. Second, (2) drawing on Kierkegaard and Ricoeur, it is argued that mental representations of selfhood in imagination have a moral dimension because they essentially allow people to understand the development of agency in human selfhood by means of representations of would-be selves and narrative figurations of the self. Third, (3) mental representations of human selves have a moral dimension because they form important points of reference for moral orientations in the field of human praxis (moral pointers). Early twelfth-century logicians invoked past-tensed statements with future-oriented contents to undermine the assumption that every proposition ‘about the past’ is determinate. In the second half of the century, the notion of future-dependence was used to restrict the scope of necessity per accidens. At some point, this idea began to be applied in theology to solve puzzles surrounding predestination, prescience, prophecy, and faith. In the mid-1160s, Magister Udo quotes some thinkers who insisted that the principle of the necessity of the past (...) should exclude dicta that ‘relate to the future’, such as that he has been predestined. Peter of Poitiers adopted this ‘Ockhamist’ strategy around 1170. We find similar accounts in Simon of Tournai and Alan of Lille, who invoked it in other contexts as well. By the time of Praepositinus of Cremona, Hubert of Pirovano, and Stephen Langton, the restricted principle became something of a common view at Paris. (shrink)

The most‐critical point of reproductive development in all sexually reproducing species is the transition from mitotic to meiotic cell cycle. Studies in unicellular fungi have indicated that the decision to enter meiosis must be made before the beginning of the premeiotic S phase. Recent data from the mouse1 suggest that this timing of meiosis initiation is a universal feature shared also by multicellular eukaryotes. The doctrine of the Intelligent Design offers an intuitive explanation of why the ordering in the Universe is authored by an intentional agency. Due to its appeal to common-sense perception, this doctrine is endorsed even by scientifically literate circles despite of its obvious contradiction with the discoveries of science. In this article, an attempt to apply the tools of the cognitive science of religion to the appraisal of the methodological and epistemic status of the ID doctrine is presented. It is (...) concluded that the ID doctrine may serve as means of the real-time metaphorical reassurance of the creative power of God while it cannot give grounds to any literal inferences on the nature of the Divine action. During the last half of the twentieth century, legal philosophy (or legal theory or jurisprudence) has grown significantly. It is no longer the domain of a few isolated scholars in law and philosophy. Hundreds of scholars from diverse fields attend international meetings on the subject. In some universities, large lecture courses of five hundred students or more study it. The primary aim of the Law and Philosophy Library is to present some of the best original work on legal philosophy from (...) both the Anglo-American and European traditions. Not only does it help make some of the best work avail able to an international audience, but it also encourages increased awareness of, and interaction between, the two major traditions. The primary focus is on full-length scholarly monographs, although some edited volumes of original papers are also included. The Library editors are assisted by an Editorial Advisory Board of internationally renowed scholars. Legal philosophy should not be considered a narrowly circumscribed field. (shrink)

It particularly refers to the amendment to the Polish Act on the Professions of Physician and Dentist, also discussed in this issue in the article by Rafał Kubiak "Criminal liability for crimes related to the illegal conduct of a medical experiment.".

W niniejszej analizie poddane badaniu zostały szczególne działania państwa, które przeciwdziałają szkodzeniu dobru wspólnoty, a mianowicie śmiercionośne działania funkcjonariuszy policyjnych. W tym celu pokazano najpierw, czym odróżniają się one od innych typów państwowego zabijania, a mianowicie zabijania wskutek wyroku sądowego oraz zabijania w ramach konfliktu zbrojnego. Następnie, rozważone zostały dwa główne typy śmiercionośnych działań policyjnych: (1) działania niosące ryzyko pozbawienia kogoś życia oraz (2) działania zmierzające bezpośrednio do śmierci jednostki. Wskazano szczegółowo, kiedy policjanci mają uprawnienie do podjęcia się takich działań. (...) Zagadnienie śmiercionośnych działań policyjnych zostało przeanalizowane z perspektywy tomistycznej. Poza odwoływaniem się do pism Akwinaty, poddane krytycznej analizie zostały stanowiska współczesnych badaczy, czerpiących z tradycji tomistycznej – Johna Finnisa, Edwarda Fesera, Gregory’ego Reichberga, Wendy Hicks oraz Benjamina Wisniewskiego. This is an account of the Uprising fights of a young machinegunner of the “Baszta” Unit from the “W” hour to the honorable surrender at the end of September.

The paper characterizes axiomatically a class of temptation-driven preferences. The key (but not the only) novelty of the paper is the idea that the alternative which tempts when an item x is consumed may not be the same as the alternative which tempts when another item y is consumed. For any single item to be ultimately consumed, the other items can be ranked by how much they tempt. An individual contemplates, as an alternative consumption, only the item that tempts most. (...) The utility of a menu is then equal to the utility of the item that is consumed less a (psychological) cost of resisting temptation; this cost depends on both: the item to be consumed and the item that tempts. Unlike most of the existing literature, the axioms are imposed on deterministic menus, not on menus of lotteries. (shrink)

Współcześnie można zaobserwować pewien paradoks. Z jednej strony wiele słyszy się o wolności sumienia, więźniach sumienia, konflikcie sumienia, klauzuli sumienia. Z drugiej zaś sumienie jest powszechnie ignorowane, przynajmniej w filozofii. Inny rodzaj paradoksu jest następujący: sumienie, które częstokroć w historii jawiło się jako sprzymierzeniec wszystkich walczących przeciw bezprawiu i przeciw arbitralności tyranów, dziś stawiane jest w opozycji wobec obiektywnego prawa moralnego, albo jako racja usprawiedliwiająca wybór po linii zła moralnego. Filozof ma obowiązek zadać pytanie: dlaczego tak sie dzieje? Artykuł poświęcony (...) jest zagadnieniu sumienia. Na początku przypomniana zostaje tradycyjna dystynkcja: intentio, synderesis i conscientia. Sumienie zostaje wprowadzone jako schemat syntetyzujący teorię praktycznej racjonalności i koncepcję wolnej woli. Duch ludzki doświadcza szczególnego napięcia pomiędzy wezwaniem do posłuszeństwa absolutnym i obiektywnym wymogom prawa naturalnego a skłonnością do niezależności płynącą z doświadczenia własnej indywidualności. "Veritatis Splendor" pomaga wyjaśnić owe różne typy paradoksów. (shrink)

In [2], Bar-Hillel, Gaifman, and Shamir prove that the simple phrase structure grammars (SPGs) defined by Chomsky are equivalent in a certain sense to Bar-Hillel's bidirectional categorial grammars (BCGs). On the other hand, Cohen [3] proves the equivalence of the latter ones to what the calls free categorial grammars (FCGs). They are closely related to Lambek's syntactic calculus which, in turn, is based on the idea due to Ajdukiewicz [1]. For the reasons which will be discussed in the last section, (...) The article is dedicated to the problems of European political identity and European identity as a whole conception and as a foundation for European integration. Before 24 February 2022, European political identity had been in crisis. The contradictions between the EU member states seemed to be hardly resolvable. The Russian aggression against Ukraine gave a strong impetus to the formation of European identity. However, it is still a negative incentive for unity and solidarity rather than cohesion around positive values, as (...) well as from the outset the European integration was caused by devastating World War II as a negative experience, which should never be repeated. The text makes use of methods peculiar to the philosophical sciences, i.e. critical textual analysis, historical-analytical and comparative methods. (shrink)

Self-esteem and emotional reactivity may be important personality determinants of human functioning in situations of social exposure. In this study, we compared the levels of these personality variables in a group of professional theater actors and a group of professional illusionists with a control group of participants who were neither actors nor illusionists and had no artistic education. We also examined the correlations between emotional reactivity and self-esteem in the three groups. For emotional reactivity, we found (1) very strong evidence (...) that the level is less for magicians than for controls, (2) substantial evidence that the level is less for magicians than for actors, (3) anecdotal evidence that the level is less for actors than for controls, and (4) decisive evidence that the average score is less for males than for females. For self-esteem, we found (1) anecdotal evidence that the level is higher for magicians than for controls, (2) substantial evidence that there is no difference between actors and magicians, (3) anecdotal evidence against a difference between actors and controls, and (4) anecdotal evidence against a difference between males and females. Based on the entire sample we found a moderate correlation between self-esteem and emotional reactivity (r = -.30, p < 0.001). Our results are compatible with the notion that emotional reactivity – as part of the temperament concept – is a factor influencing the choice of an artistic profession. (shrink)

Action logic of Pratt [21] can be presented as Full Lambek Calculus FL [14, 17] enriched with Kleene star *; it is equivalent to the equational theory of residuated Kleene algebras (lattices). Some results on axiom systems, complexity and models of this logic were obtained in [4, 3, 18]. Here we prove a stronger form of *-elimination for the logic of *-continuous action lattices and the –completeness of the equational theories of action lattices of subsets of a finite monoid and (...) action lattices of binary relations on a finite universe. This paper claims that the intuitive and widespread legitimating power of majority rule (MR) arises from the link between majority rule and the principle of equality of political opportunity. The egalitarian character of MR is established by exploring “puzzles” in democratic theory, such as the insensitivity of democratic voting procedures to unequal intensity of citizens' preferences, and the relationship between the principle of unanimity (sometimes thought better to respect citizens' equality) and MR. Special attention is directed to the relationship between (...) political equality and equality in the outcomes of political decisions: The claim is made that the language of equal political opportunity captures well the idea of equal political influence, in the circumstance of disagreement about what is required to achieve equal treatment through the outcomes of political decisions. This book carefully examines the most recent wave of the emergence and case law of activist constitutional courts: those that were set up after the fall of communism in Central and Eastern Europe. ABSTRACT This article argues for a unique role of imagination and mental images in the moral education of students. Imagination is rendered here as a capacity oriented toward realizable and salient goals; mental images are understood as particular future-oriented self-representations (FOSRs) devised by and held in imagination. FOSRs have four moral attributes: they are 1) expressive of us as moral agents, 2) shape our moral identity, 3) serve as moral pointers, and 4) help devise mitigating strategies. FOSRs can be created (...) and utilized in educational settings to further the goals of moral education by i) fostering sensitivity to moral situations among students, ii) motivating learners to act morally, iii) facilitating environments supportive of moral practice and moral habituation, and iv) helping strengthen cross-situational consistency of moral action. The four moral attributes of future-oriented self-representations (FOSRs) (1–4) that are to be engaged in moral education to further its goals (i–iv) are correlated with four elements of moral education, namely: a) moral awareness; b) moral competency; c) moral motivation; and d) moral capacity. To argue for the special role of imagination and mental images in moral education this paper integrates philosophical research and conceptual and empirical studies in psychology and education on the morality of imagination and mental images. An axiomatics of the product-free syntactic calculus L ofLambek has been presented whose only rule is the cut rule. It was alsoproved that there is no finite axiomatics of that kind. The proofs weresubsequently simplified. Analogous results for the nonassociativevariant NL of L were obtained by Kandulski. InLambek's original version of the calculus, sequent antecedents arerequired to be nonempty. By removing this restriction, we obtain theextensions L 0 and NL 0 ofL and NL, respectively. Later, the finiteaxiomatization problem for L (...) 0 andNL 0 was partially solved, viz., for formulas withoutleft (or, equivalently, right) division and an (infinite) cut-ruleaxiomatics for the whole of L 0 has been given. lt is a commonplace that law and morality intersect and interpenetrate in all the areas of legal decision-making; that in order to make sense of constitutional, statutory or common-law questions, judges and other legal decision-makers must first resolve certain philosophical issues which include moral judgments of right and wrang_ This is particularly evident with regard to constitutional interpretation, especially when constitutions give a mandate for the protection of the substantive norms and values entrenched as constitutional rights. In these Situations, as (...) a leading contemporary legal philosopher observed, the "Constitution fuses legal and moral issues, by making the validity of a law depend on an answer to complex moral 1 problems". But the need for substantive value elucidation is not confined, of course, only to constitutional interpretation under Bills of Rights. This, however, immediately raises a dilemma stemming from the moral diversity and pluralism of modern liberal societies. How can law remain sensitive to this pluralism and yet provide clear answers to the problems which call for a legal resolution? Sharply conflicting values in modern societies clash in the debates over the death penalty, abortion, homosexuality, separation of state and religion, the scope of the freedom of the press, or affirmative action. lt would often be difficult to discern a broader consensus within which these clashes of values operate, unless this consensus were described in such vague terms as to render it practically meaningless. In the paper, the formal model of the noetic synthesis functions is presented. Together with the functions of noematic synthesis, they are understood as components of functions of intentional reference, which are meant to be, in turn, formalizations of intentional acts of reference performed in the stream of consciousness. This research perspective allows us to extend the category of speech acts to the category of all intentional acts of reference. The functions of noetic synthesis are understood as composed of the (...) function of noetic intention acting on qualia, noetic moods and noetic modes. The model allows us to explain the phenomenon of autism as having its source in disorders of the noetic synthesis functions. The constructed model is not intended as the faithful reconstruction of the Husserlian conception of noesis. Intuitions of the creator of phenomenology are treated as the only source of inspiration. In this paper, representational structures of arithmetical thinking, encoded in human minds, are described. On the basis of empirical research, it is possible to distinguish four types of mental number lines: the shortest mental number line, summation mental number lines, point-place mental number lines and mental lines of exact numbers. These structures may be treated as generative mechanisms of forming arithmetical representations underlying our numerical acts of reference towards cardinalities, ordinals and magnitudes. In the paper, the theoretical framework for a (...) formal model of mental arithmetical representations is constructed. Many competitive conceptions of the mental system responsible for our arithmetical thinking may be unified within the presented framework. The paradigm underlying our research may be interpreted philosophically as a neo-Kantian approach to modeling the mind’s representational structures. (shrink)

Are there things that we must never do, no matter how untypical the circumstances and “unorthodox” our deontic ideas might be? In this essay I try to make evident that acts I call “pure sadist acts” satisfy this description. I discuss several examples of such acts and alert to their being not always easy to distinguish from certain others. Norms prohibiting such acts I call “true”, and I suggest that other, less suggestive, norms might also be (derivatively) true, if the (...) pertinent acts stand in certain relations with the former ones. I incorporate some ideas from Hume, as well as from elementary model theory, to make mine clearer. (shrink)

This book examines the relationship between the idea of legitimacy of law in a democratic system and equality, conceived in a tripartite sense: political, legal, and social. Exploring the constituent elements of the legal philosophy underlying concepts of legitimacy, this book seeks to demonstrate how a conception of democratic legitimacy is necessary for understanding and reconciling equality and political legitimacy by tracing and examining the conceptions of equality in political, legal, and social dimensions. -/- In the sphere of political equality (...) this book argues that the best construction of equality in a democratic system - which resonates with the legitimizing function of majority rule - is that of equality of political opportunity. It is largely procedural, but those procedures represent important substantive values built into a majoritarian system. In the sphere of legal equality it argues that a plausible conception of non-discrimination can be constructed through a "reflective equilibrium" process, and should reject a thoughtless assumption that the presence of some particular criteria of differentiations necessarily taints a legal classification as discriminatory. Finally, the chapters on social equality explore, in some detail, the currently influential, and presumptively attractive, "luck egalitarianism": the idea that social equality calls for neutralizing the disparate effects of bad brute luck upon a person's position in society. The article focuses on the issue of access to experimental therapy under the Convention for the Protection of Human Rights and Fundamental Freedoms, and more specifically in the case law of the European Court of Human Rights. To date, this issue has been the subject of three cases decided by the Court. In none of these cases the Court has recognized a right to experimental therapy. The article has two main research objectives. The first is to reconstruct the arguments for (...) the validity of the right to experimental therapy provided by the applicants in the cases considered by the Court. Anscombe znalazła w Etyce nikomachejskiej Arystotelesa pewną niekonsekwencję: Arystoteles zdaje się twierdzić, że cokolwiek wynika z namysłu, jest wyborem, i że słaby wolą może się skutecznie namyślać, ale i że — z drugiej strony — on nie wybiera. Anscombe znajduje rozwiązanie tej sprzeczności: Arystoteles powinien był, jej zdaniem, zaznaczyć, że by z namysłu wynikał wybór, to, ze względu na co się namyślamy, musiałby sam być przedmiotem uprzedniego wyboru. Badam to rozwiązanie i znajduję jego słabe strony, jak niebezpieczeństwo nieskończonego regresu, (...) trudność prześledzenia genealogii wyborów i nieosiągalność pierwotnego celu. Pomimo to próbuję je ulepszyć, poddając pod dyskusję, czy tego rodzaju pierwotne wybory, jakich wymaga rozwiązanie Anscombe, nie są jednak czasem naprawdę podejmowane i czy ich cele nie są rozkładalne na takie, które można realistycznie mieć nadzieję osiągnąć. ABSTRACTWhile in the 1960s Allan Bloom suggested to read William Shakespeare’s works through the prism of political philosophy, a decade earlier Carl Schmitt used the works of English poet in a reverse way: he read political philosophy and history through Shakespeare. Deprived – under the influence of Leo Strauss – from the possibility of considering Thomas Hobbes a decisionist thinker, Schmitt in his ‘Hamlet or Hecuba’ used Shakespeare’s most famous work to interpret origins of disappearance of the state of emergency (...) from English soil. Shakespeare was seen by Schmitt as a writer who captured the Sixteenth and seventeenth century changes in thinking about sovereignty and the state. Interestingly, Schmitt did not use Shakespeare as method for the first time: in first decades of twentieth century, in his diary, he made ‘Othello’ a prism through which he read his love life. Because the author of ‘The Concept of the Political’ is one of the less methodologically cohesive writers of twentieth century, his usage of Shakespeare twice, in different circumstances, is interesting. In an article, author links ‘Hamlet or Hecuba’ with Schmitt’s geopolitical works and presents Shakespeare’s works as the coherent method of interpretation in Schmitt’s philosophy of decisionism. The purpose of the article is to investigate the philosophical and theological validity and coherence of the classical concept of a miracle within the contemporary scientific world view. The main tool in this process will be the cognitive standard model of the formation of religious beliefs operative in the cognitive science of religion. The application of this model shows why an intentional agent is assigned as responsible for the occurrence of events with no visible cause such as a miracle: miracles (...) are events that violate the intuitively expected behaviors observable in the physical reality. It will become evident that much of the conceptual content of the classical understanding of miracles can be retained despite of the ontological and epistemological challenges of the contemporary science. In particular, this concerns the semantic view of miracles in which a miracle does not occur as an objective Divine intervention but qualifies as religious interpretation of the natural course of events always in reference to a cultural and personal context that is unique to those who directly experience these events either as direct recipients or as observers. Experiential Foundationalism, Linguistic Practice, and Historicity.

This article explores the dream descriptions submitted in 1973–1974 by former Polish prisoners of the Auschwitz concentration camp in response to a questionnaire sent out by Polish psychiatrists. These descriptions are being investigated as testimonies that represent the Auschwitz inmates’ experiences commonly regarded as “unspeakable.” Not only the dream experience itself, but also the respondents’ attitudes toward and beliefs about dreams are taken into consideration in an attempt to understand the impact of the Holocaust on the survivors. Their general inability (...) of comprehending the Auschwitz and post‐Auschwitz dreams seems to be the most important and significant aspect of their testimonies. The experience of dreams as completely strange and astonishing phenomena is being explained in this article in connection with the respondents’ ability and inability to recover from their Holocaust trauma.
