A simple transposition in the text would, I venture to suggest, remove one or two of the many difficulties of this obscure chapter.

Theology and the University in Nineteenth-Century Germany examines the dual transformation of institutions and ideas that led to the emergence of theology as science, the paradigmatic project of modern theology associated with Friedrich Schleiermacher. Beginning with earlier educational reforms across central Europe and especially following the upheavals of the Napoleonic period, an impressive list of provocateurs, iconoclasts, and guardians of the old faith all confronted the nature of the university, the organization of knowledge, and the unity of theology's various parts, (...) quandaries which together bore the collective name of 'theological encyclopedia'. Schleiermacher's remarkably influential programme pioneered the structure and content of the theological curriculum and laid the groundwork for theology's historicization. Zachary Purvis offers a comprehensive investigation of Schleiermacher's programme through the era's two predominant schools: speculative theology and mediating theology. Purvis highlights that the endeavour ultimately collapsed in the context of Wilhelmine Germany and the Weimar Republic, beset by the rise of religious studies, radical disciplinary specialization, a crisis of historicism, and the attacks of dialectical theology. In short, the project represented university theology par excellence. Engaging in detail with these developments, Purvis weaves the story of modern university theology into the broader tapestry of German and European intellectual culture, with periodic comparisons to other national contexts. In doing so, he Purvis presents a substantially new way to understand the relationship between theology and the university, both in nineteenth-century Germany and, indeed, beyond. (shrink)

In this essay I attempt to answer a fundamental question about Žižek’s heterodox reading of Hegel’s dialectic: What project sustains this reading in the first place? That is, what is at stake for Žižek himself? The purpose of this essay is to develop in this fashion a reading of Žižek, although not one that is necessarily meant to compete against other alternatives. My argument, then, is that Žižek’s ontological and hermeneutical project is ultimately political, that when Žižek says we need (...) Hegel “now more than ever,” he has a political situation in mind. By finding an element of Hegel’s thought, the political subjectivity of the “rabble,” that resists the traditional picture of dialectical system, Žižek can overturn the distinction between Hegelian method and system by suggesting that there’s no comprehensible distinction at all. And by politicizing Hegel and drawing out the seeds of Lacanian thought that were nonetheless incomplete until Lacan, Žižek’s historiographical project takes on the character of ideological critique. As such, Hegel and Lacan reach us anew, as theoretical players in an anti-postmodern political gambit. (shrink)

Doxastic normativism is the thesis that norms are constitutive of or essential to belief, such that no mental state not subject to those norms counts as a belief. A common normativist view is that belief is essentially governed by a norm of truth. According to Krister Bykvist and Anandi Hattiangadi, truth norms for belief cannot be formulated without unpalatable consequences: they are either false or they impose unsatisfiable requirements on believers. I propose that we construe the fundamental norm of belief (...) as a knowledge norm, rather than a truth norm. I argue that a specific kind of knowledge norm—one that has a subject's obligation to believe that p depend on her being in a position to know that p—might avoid the well-known formulation problems with truth norms. Australia's Coalition Against Duck Shooting sees duck-shooting as a social problem and as an injustice with moral, legal and environmental consequences. The small animal liberationist group has succeeded in dramatically reducing the numbers of duck shooters in Victoria, which is the home of duck-shooting in Australia. The Coalition's framing work with the public via the electronic media involves three parts: a diagnosis , a prognosis and a motivational frame , all of which construct hunting as a cruel, antisocial blood sport (...) that ought to be banned. In this article, television news bulletins and feature stories from the 1993 and 1994 campaigns are analyzed to show how CADS makes and sustains its claims. In addition to 90 pages of transcripts of news commentaries and descriptive accounts of the visuals, the data include tape-recorded interviews with some of the duck liberationists involved in the campaign. In the heart of southeast Texas, an industrial powerhouse often referred to as the 'Golden Triangle', the oil refineries and petrochemical plants stand as stalwart testaments to the region's economic evolution. Interestingly, before the discovery of oil at Spindletop, the lumber and cattle industries powered this region's economy. A profound shift occurred when the Lucas Gusher, a fountain of oil spurting thousands of feet into the air, struck the lands of Spindletop Hill on January 10, 1901. This remarkable discovery of (...) the Spindletop oilfield on a slat dome formation south of Beaumont, Texas, marked the birth of the modern petroleum industry and fundamentally transformed the region's geopolitical, economic, and cultural landscapes. People from all over the country relocated to Gladys City and Beaumont in search of work and new opportunities, creating a boomtown as the town's population swelled from 10,000 to 50,000. The newfound urbanization brought by the oil industry transformed the town and the surrounding areas, creating a ripple effect across the region that would be felt for generations to come. The surge in oil-driven economic activity transmuted the region into a vibrant nexus of commerce, with the oil industry emerging as a critical architect of growth and advancement. This newfound affluence incited by the petroleum sector ushered in an era of economic diversification, laying the groundwork for industrialization’s further evolution. The Spindletop Oil Fields not only underscored the United States’ ascent as the foremost petroleum-producing nation but also signaled the nation’s initiation into the Petroleum Age. It was Spindletop that solidified its position as America’s first significant oil field, becoming an enduring symbol of its industrial might. By 1985, over 153,000,000 barrels of oil had been produced and extracted from the Spindletop oil fields, underscoring the magnitude of this extraordinary resource. (shrink)

There has been an exponential rise in use of the term vulnerability across a number of political and policy arenas, including child protection, sexual offences, poverty, development, care for the elderly, patient autonomy, globalisation, war, public health and ecology. Yet despite its increasing deployment, the exact meaning and parameters of this concept remain somewhat elusive. In this article, we explore the interaction of two very different strategies—one in which vulnerability is relied upon by those seeking improved social justice as a (...) mechanism by which to identify, problematise and compel state responses to a universal condition of precarious dependency, and the other in which it is used as a category of neo-liberal governance which legitimates state encroachment whilst constructing ‘vulnerable’ individuals as ‘risk-managers’ who must behave ‘responsibly’ in the face of disadvantage. We suggest that the co-existence of these divergent approaches highlights the fluidity and malleability of the concept of vulnerability. Using sex work as a specific case study, we explore the ways in which vulnerability bears multiple meanings, and has been used in recent times in the furtherance of moralistic and regressive agendas, which collude with, rather than challenge, state power. Without seeking to reject the label or normative import of vulnerability, we call, therefore, for a more circumspect approach to its usage, and a more critical evaluation of recent claims which hail it as a mechanism, preferable to the conventional use of equality paradigms, by which to secure progressive feminist outcomes. This chapter examines one intuitively appealing legal practice for which retributivist accounts struggle to find justification: multiple-offense sentencing discounts. It also considers several proposed strategies for justifying bulk discounts on the basis of retributivism. Three strategies are discussed: those that appeal to an absolute punishment maximum, those that appeal to interpersonal practices of blame and making amends, and those that suggest that perpetrators of multiple offenses sometimes have reduced culpability. The chapter argues that each of these strategies either is implausible (...) as a ground for bulk-sentencing discounts or is plausible only insofar as it incorporates nonretributivist considerations into its account — thus is in fact a hybrid view. It concludes by looking at hybrid theories as an alternative, suggesting that such approaches not only can provide justification for bulk-sentencing discounts, but are also more plausible in general than is generally assumed. Recent work by Keyser in applied epistemology of experiment has focused on the iterative ‘production’ of knowledge: knowledge stabilizes within a given physical context and it is iteratively tested within that context to meet standards of reliability. This implies that in a given physical context (e.g., laboratory), the inferences, methods/techniques, and physical products form coherence relations with one another. We apply this epistemological stabilization account to the martial arts in order to argue that the context of stabilization dictates the training (...) methods, techniques, and even the philosophical concepts of a given martial arts system. We describe key elements of stabilization pertaining to rules, training methodology, warrior philosophy, and spectator/media tropes. The account of stabilization requires a case study that shows how a dynamic system is stabilized. We describe the stabilization of modern mixed martial arts by tracking it on a time scale, but also in different contexts (e.g., Pancrase, Pride, UFC). (shrink)

This paper attempts to establish that, and explain why, the practice of punishing offenders is in principle morally permissible. My account is a nonstandard version of the fair play view, according to which punishment 's permissibility derives from reciprocal obligations shared by members of a political community, understood as a mutually beneficial, cooperative venture. Most fair play views portray punishment as an appropriate means of removing the unfair advantage an offender gains relative to law-abiding members of the community. Such views (...) struggle, however, to provide a plausible account of this unfairly gained benefit. By contrast, on my account punishment 's permissibility follows more straightforwardly from the fair play view of political obligation: Specifically, the rule instituting punishment is itself among those rules with which members of the political community are obliged to comply. For criminal offenders, compliance requires submitting to the prospect of punishment. (shrink)

American politicians often claim a moral imperative to ensure quality affordable health care to all Americans, but as Donald Munro points out, leaders rarely outline the content of this moral standard and whether it can be applied to all societies. Munro turns to recent research in cognitive science and evolutionary psychology to identify the ethical principles that help humans succeed as individuals and as cooperative groups. He then applies these principles to two practical problems affecting contemporary China: the moral complexity (...) of responding to global warming and the lack of consistency within the Chinese legal system. Normativists about belief hold that belief formation is essentially rule- or norm-guided. On this view, certain norms are constitutive of or essential to belief in such a way that no mental state not guided by those norms counts as a belief, properly construed. In recent influential work, Kathrin Glüer and Åsa Wikforss develop novel arguments against normativism. According to their regress of motivations argument, not all belief formation can be rule- or norm-guided, on pain of a vicious infinite regress. I (...) argue that the regress of motivations argument is unsuccessful: an appeal to the notion of blind rule-following, drawn from a plausible interpretation of Ludwig Wittgenstein’s remarks on rule-following, stops the regress of motivations in its tracks. Attribution theorists assume that character information informs judgments of blame. But there is disagreement over why. One camp holds that character information is a fundamental determinant of blame. Another camp holds that character information merely provides evidence about the mental states and processes that determine responsibility. We argue for a two-channel view, where character simultaneously has fundamental and evidential effects on blame. In two large factorial studies (n = 495), participants rate whether someone is blameworthy when he makes a mistake (...) (burns a cake or misses a bus stop). Although mental state inferences predict blame judgments, character information does not. Using mediation analyses, we find that character information influences responsibility via two channels (Studies 3–4; n = 447), which are sensitive to different kinds of information (Study 5; n = 149). On the one hand, forgetfulness increases judgments of responsibility, because mental lapses manifest an objectionable character flaw. On the other hand, forgetfulness decreases judgments of state control, which in turn decreases responsibility judgments. These two channels cancel out, which is why we find no aggregate effect of forgetfulness on responsibility. Our results challenge several fundamental assumptions about the role of character information in moral judgment, including that good character typically mitigates blame. (shrink)

In a 1917 letter to Gershom Scholem, Walter Benjamin writes, "Theory is like a surging sea." This small book takes more than its title from that line - it takes that line as a point of departure in Erich Auerbach's sense, an Ansatzpunkt, as a compositional principle so that what follows can be read in its entirety as a gloss on the remainder of Benjamin's sentence: "Theory is like a surging sea, but the only thing that matters to the wave (...) [...] is to surrender itself to its motion in such a way that it crests and breaks." That motion, in the pages to follow, takes up in its sweep two threads: it folds an episodic meditation on the negative and the problematic into a series of singular interrogations exemplary of the positive being of the problematic, the objective being of problems and questions, in a movement of implication and explication between poetry and philosophy in the tradition of what's come to be known as theory. For decades, scholars in the social sciences and humanities have questioned the appropriateness and utility of prior review of their research by human subjects' ethics committees. This essay seeks to organize thematically some of their published complaints and to serve as a brief restatement of the major critiques of ethics review. In particular, it argues that 1) ethics committees impose silly restrictions, 2) ethics review is a solution in search of a problem, 3) ethics committees lack expertise, 4) ethics committees (...) apply inappropriate principles, 5) ethics review harms the innocent, and 6) better options exist. Motivated reasoning occurs when we reason differently about evidence that supports our prior beliefs than when it contradicts those beliefs. Adult participants (N = 377) from Amazon’s Mechanical Turk (MTurk) system completed written responses critically evaluating strengths and weaknesses in a vignette on the topic of anthropogenic climate change (ACC). The vignette had two fictional scientists present prototypical arguments for and against anthropogenic climate change that were constructed with equally flawed and conflicting reasoning. The current study tested and found support (...) for three main hypotheses: cognitive style, personality, and ideology would predict both motivated reasoning and endorsement of human caused climate change; those who accept human-caused climate change will be less likely to engage in biased reasoning and more likely to engage in objective reasoning about climate change than those who deny human activity as a cause of climate change. Although mind-wandering occupies up to half of our waking thoughts, it is seldom discussed in philosophy. My paper brings these neglected thoughts into focus. I propose that mind-wandering is unguided attention. Guidance in my sense concerns how attention is monitored and regulated as it unfolds over time. Roughly speaking, someone’s attention is guided if she would feel pulled back, were she distracted from her current focus. Because our wandering thoughts drift unchecked from topic to topic, they are unguided. One motivation (...) for my theory is what I call the “Puzzle of the Purposeful Wanderer”. On the one hand, mind-wandering seems essentially purposeless; almost by definition, it contrasts with goal-directed cognition. On the other hand, empirical evidence suggests that our minds frequently wander to our goals. My solution to the puzzle is this: mind-wandering is purposeless in one way—it is unguided—but purposeful in another—it is frequently caused, and thus motivated, by our goals. Another motivation for my theory is to distinguish mind-wandering from two antithetical forms of cognition: absorption and rumination. Surprisingly, previous theories cannot capture these distinctions. I can: on my view, absorption and rumination are guided, whereas mind-wandering is not. My paper has four parts. Section 1 spells out the puzzle. Sections 2 and 3 explicate two extant views of mind-wandering—the first held by most cognitive scientists, the second by Thomas Metzinger. Section 4 uses the limitations of these theories to motivate my own: mind-wandering is unguided attention. (shrink)

This article addresses a countermovement to the animal liberation movement and its campaigns against vivisection, factory farming, and recreational hunting in the United States, the United Kingdom, and Australia. As moderate welfarists, pragmatic animal liberationists , and radical abolitionists who advocate animal rights, animal protectionists campaign for animals. The countermovement defends acts that animal protectionists decry. Meanwhile, sociologists accord little study to interplay between the movements . In Buechler's and Cylke's collection of 34 papers on social movements , only one (...) paper focused on countermovements, describing the connection between social movement and countermovement as "a continuous dialect of social change" . Although extensive writings exist on the main campaigns of the animal liberation movement, little scholarly material exists on the defenses mounted by the countermovement. This article examines key elements of a values war, a struggle over moral capital waged by animal protectionists and their countermovement opponents. (shrink)

The history of the vivisection debate is a case study in the use of vilification not unlike its rhetorical use by adversaries in the pro-life/pro-choice controversy. According to Vanderford, vilification in that debate serves a number of functions: to identify adversaries as ; to cast opponents in an exclusively negative light; to attribute diabolical motives to one's adversaries; and to magnify the opposition's power as an enemy capable of doing great evil. In the vivisection debate, both sides have attempted to (...) delegitimize each other by one or more of these means. On the antivivisection side, Samuel Johnson in 1758 produced the fiercest attack up to that time on and When the antivivisectionist movement peaked in England in the 1870s, the animal experimentalists began to organize in earnest to fend off the charge that vivisection was both cruel and useless. By the turn of the century an American neurologist, Charles Loomis Dana, identified a way to discredit the mainly female antiscience in the antivivisection movement by inventing the disease to describe one of the diseases affecting mainly women who, having no children or a useful occupation, joined animal protection societies and campaigned against vivisection. Zoophil-psychosis, it was claimed, was a form of mental illness, an incurable insanity that afflicted the hysterical opponents of vivisection. (shrink)

A large body of research has indicated international students in the United States and abroad experience difficulties understanding what academic integrity is and how to avoid academic misconduct, 159–172 2011; Brown & Howell, 2001; Gullifer and Tyson Studies in Higher Education, 39, 1202-1218 2014). While most studies focus on academic misconduct and academic corruption in research ethics, 339-358 2014), this study analyzes the length, English-language readability, and translation of academic integrity policies of 453 four-year U.S. institutions of higher education. Findings (...) indicate average academic integrity policies are over 2000 words long, are written above the 16th-grade reading level, and are very rarely translated into a language other than English. In addition, no institutions published their academic integrity policies in full on their institutional international student website, possibly rendering the policy difficult to locate on the institution’s website for international students. In an anonymous referee report written in 1945, Church suggested a sweeping argument against verificiationism, the thesis that every truth is knowable. The argument, which was published with due acknowledgement by Fitch almost two decades later, has generated significant attention as well as some interesting successor arguments. In this paper, we present the most important episodes in this intellectual history using the logic that Church himself favoured, and we give reasons for thinking that the arguments are less than decisive. The contours of sustainable systems are defined according to communities’ goals and values. As researchers shift from sustainability-in-the-abstract to sustainability-as-a-concrete-research-challenge, democratic deliberation is essential for ensuring that communities determine what systems ought to be sustained. Discourse analysis of dialogue with Michigan direct marketing farmers suggests eight sustainability values – economic efficiency, community connectedness, stewardship, justice, ecologism, self-reliance, preservationism and health – which informed the practices of these farmers. Whereas common heuristics of sustainability suggest values can be pursued harmoniously, we discuss (...) how this typology reflects the more intricate project of balancing values in tension with one another. This paper profiles the animal activism of the late American animal activist Henry Spira, whose campaign strategies and tactics suggest a number of links with the nineteenth century pioneers of animal protection as well as with approaches favored by contemporary animal activists. However, the article argues that Spira's style of animal advocacy differed from conventional approaches in the mainstream animal movement in that he preferred to work with, rather than against, animal user industries. To this end, he pioneered the use (...) of "reintegrative shaming" in animal protection, an accommodation strategy that relied on moralizing with opponents as opposed to the more common approach in animal advocacy of adversarial vilification, and hence, disintegrative shaming. The article describes the framing of some of Spira's best-known anti-cruelty campaigns and his use of reintegrative shaming to induce animal users to change their ways. (shrink)
