Credit unions are one of the most widely established corporate entities in the financial systems of most of the world’s nations. Their historical support to the financing needs of small savers, as well as their assimilation into the framework of contemporary microfinance, gives them an important specific weight in the economic-financial literature of our time. In this sense, our research has carried out a systematic review of the main contributions focused on the area of credit unions (...) over the period 1936–2020, using Scopus and WoS as bibliographic databases. In summary, the main countries, journals, authors, articles, and the main collaborative research networks at the level of authors or countries have been analyzed. In the same way, the implementation of strategic diagrams based on Callon’s procedure has facilitated the classification of the most important terms linked to financial cooperativism, which has served to detect future lines of research related to the terms : asymmetric-information, capital-provision, cooperative-principles, customer-reduction, gender-issues, neoinstitutionalism, poverty, and urban-economy. However, like banks and savings banks, they have to be as efficient and competitive as possible to survive in today’s business environment, especially at times of crisis. To date, there have been very few studies on their efficiency and practically none for the crisis period. Moreover, almost all the existing studies assess only financial efficiency, without considering their social function. This study (...) examines the levels of both financial and social efficiency in Spanish credit unions as well as their main determinants during the recent crisis. We apply the two-stage double bootstrap data envelopment analysis methodology based on panel data corresponding to all the credit unions active in Spain between 2008 and 2013. The empirical results indicate that financial and social efficiency achieved an acceptable level, although on average the former was slightly greater than the latter. We also find that both age and merger and acquisition activity were positively influential on the financial efficiency of credit unions but had a significant negative effect on their social efficiency. Moreover, the regional location of such entities and the financial crisis were also crucial determinants of both types of efficiency. Our findings are therefore useful for all the stakeholders of credit unions to know if these entities have been efficient according to a double bottom line accounting in the crisis period and hence to maintain successful social management that is compatible with satisfactory financial efficiency. This article documents the response of cooperative institutions that were required to adhere to new capital adequacy regulations traditionally geared for profit-maximising organisations. Using data from the Australian credit union industry, we demonstrate that the cooperative philosophy and internal corporate governance structure of cooperatives will lead management to increase capital adequacy ratios through the application of accounting window dressing techniques. This is opposite to the intended purpose of template regulation aimed at efficiently increasing operating margins and lowering risk. In 1948, when the State of Israel was founded, 125,000 people were members of credit cooperative societies, which provided over 20 percent of all market financing. For several years this number continued to rise, reaching a total of 250,000 members in more than 100 credit cooperative societies. Credit associations — part of the thriving cooperative movement of early Zionism — symbolized the attempt to create a new and just Jewish society by fusing socialist and capitalist ideals. From (...) the mid-1950s, however, in a rapid process of centralization of Israel’s capital market and financial institutions, almost all credit associations were absorbed into Israel’s commercial banks and dissolved. Today, Israel’s two largest banks control over 63 percent of credit provision, and 90 percent of credit is provided to less than 1 percent of borrowers. The official policy of the Bank of Israel is to rule out the establishment of credit associations, credit unions or other non-bank financial institutions. In the light of current renewed interest in "social businesses," i.e., innovative business models designed to achieve desired social outcomes, this Article traces the waning of credit associations in Israel, and the role law has played in that process. Their disappearance from the capital market marked not only a change in economic policy, but also the final abandonment of the ideals which underlay the provision of cooperative financial services: mutuality, partnership and solidarity. In this study, I examine the role racial minorities in the boardroom can play in reducing social injustice by promoting more equal access to mortgage credit to minority households. I develop a simple theoretical model that posits directors who are racial minorities provide the credit unions they govern with a perspective that shapes lenders’ trust of minority applicants. This trust is shaped by homophily and the tendency of individuals to prefer interactions with similar individuals. Using mortgage loan (...) data from a cross-section of credit unions in the United States from 185,446 applications, I find that credit unions where the majority of board members are minorities are less likely to reject a similarly qualified minority applicant than their counterparts. Governance by minority directors significantly reduces the effects of discrimination faced by minority applicants. The board’s effect is strongest in minority neighborhoods and where the homophily is stronger between directors and applicants. (shrink)

Après avoir présenté ce paradoxe dans les textes, nous suggérons que l’accent mis sur les expériences ordinaires tient à la place occupée par le droit dans la construction européenne. Le contrôle des (...) libertés de circulation par la Cour de justice de l’Union européenne, caractéristique du marché intérieur, est à l’origine d’une intégration plus large, qui a étendu les droits des opérateurs économiques et forgé le statut de citoyen européen. La jurisprudence de la CJUE a en effet permis d’élargir la portée des droits transnationaux, dans la continuité du droit cosmopolitique kantien, sans dissoudre les États membres dans une association supranationale. Une affiliation postnationale, alternative au modèle de la souveraineté étatique classique, semble ainsi se concrétiser dans l’Union européenne. Cependant, nous suggérons que le crédit accordé à la construction, par la jurisprudence de la CJUE, de la citoyenneté postnationale, risque d’occulter les effets problématiques d’une intégration judiciaire vouée à être essentiellement négative. This research is part of the project "Corporate Social Responsibility in Ecuadorian savings and credit cooperatives. A multi-case analysis and proposal for the development of a cooperative education program" and examines the synergy between cooperative principles, the Sustainable Development Goals (SDGs) and the dimensions proposed for a Cooperative Social Responsibility (CSR) measurement model in Ecuador. It explores how these dimensions converge to promote ethical, sustainable and socially responsible practices, aligned with current regulatory compliance. CSR has become increasingly important in (...) cooperatives, becoming a fundamental practice that encompasses cooperative governance, economic, social, environmental, ethical and technological dimensions. This study describes the methodological process for the validation of a CSR instrument in cooperatives, reviewed and validated by experts from Spain, Ecuador, Guatemala, Argentina and Cuba, using the Delphi method to reach a consensus on the relevance and clarity of the questionnaire items. State aids law has become a major subject in its own right. Article 107 of the Treaty on the Functioning of the European Union (TFEU), which lays down the substantive rules on state aid, and Article 108 TFEU, which provides for the procedural rules, form part of the treaty chapter on competition. However, there are now several important pieces of legislation. The first is Council Regulation 994/98/EC, which applies Articles 107 and 108 TFEU. The gist of the regulation is that (...) the Commission is authorized to adopt block exemptions for certain categories of aid. On this basis, the Commission has adopted a number of regulations, which will be discussed in this chapter. The enforcement of the state aid rules by the Commission has been essential in containing the crisis. Although non-profit organisations typically have high representation of females on their boards, relatively little is known about the effects of gender diversity in these organisations particularly in relation to financial management. In this archival study, resource dependency theory and agency analysis are combined to provide theoretical insight and empirical analysis of gender diversity on effective financial management in member-governed, community financial institutions. The investigation is possible due to the unique characteristics of the organisational form and region being examined—credit (...) class='Hi'>unions in Northern Ireland. The sector has not been subject to external regulation on board gender, yet a wide array of gender mix on boards ranging from 100 % male to 100 % female are in existence. In addition, effective financial management is crucial to their survival and their ability to meet member objectives. Boards with higher female representation exhibit superior financial management first, in respect of loan book quality in the period of austerity following the financial crisis and second when measured against return on assets. For several years, MBA students enrolled in a Business & Society/Business Ethics class at the University of Wisconsin-Madison have been volunteering their services at homeless shelters and in low-income communities. Students also work with low-income residents and relevant stakeholders on evolutionary team projects aimed at improving living conditions in low-income communities. These projects include starting a grocery co-op, credit union, day-care center, job training center and a transportation business. In addition, student groups develop service networks that link low-income communities (...) with student organizations, other university professors and United Way volunteers. In this paper I argue that large cooperative organizations, in particular cooperative banks, are better positioned than business firms to be ethically responsible, global citizens. These organizations include cooperative networks in France, the Netherlands, and Germany, provident societies in the United Kingdom, and Mouvement des caisses populaires Desjardins and credit unions in Canada. Large cooperatives are distinct from firms but compete with them and are major socio-economic actors in their respective communities. They are more predisposed to implement policies (...) that are compatible with local expectations and simultaneously reflect fundamental macro-social principles or hypernorms. The advantage of these particular economic organizations springs from their institutional and historical background, and particularly from the cooperative values on which they are founded and which make them different from firms. How can finance be durably democratized? In the centers of financial power in both the United States and the United Kingdom, proposals now circulate to give workers and the public more say over how flows of credit are allocated. This article examines five democratization proposals: credit union franchises, public investment banks, sovereign wealth funds, inclusive ownership funds, and bank nationalization. It considers how these plans might activate worker and public engagement in decision making about finance by focusing on (...) three modes of public participation: representative democracy, direct democracy, and deliberative minipublics. It then considers the degree to which democratization plans might be resilient to de-democratization threats from business. It argues that of the five, bank nationalization goes furthest in guarding against de-democratization threats but is still pocked with pitfalls if it relies solely on representative democracy. It argues that two criteria appear necessary for democratically durable alternatives: the active direct participation of workers and citizens and the weakening of businesses’ capacity for democratic retrenchment. Attempting to apply the logic of conflict analysis developed by Thucydides to the chaotic spasms and clashes triggered by the collapse of the Soviet Union might appear inappropriate to many classical scholars, and entirely artificial to most Eurasian security experts. However, the two strategic landscapes, though separated by a period of some 2400 years, share a number of common features, and the ideas of the ancient strategic analyst may prove helpful for discovering structure in the chaotic violence of more recent (...) times. The notion of the ‘strategic dilemma’—one that Thucydides never used but is credited with inventing—lies at the centre of this investigation, which seeks to test the applicability of the notion in three distinctive settings: in a bipolar confrontation; in conflict manipulation by a third party; and in secessionist conflicts. The article suggests that, as an instrument of political analysis, the security dilemma tends to overpredict conflicts and essentially comes out as a trap of self-fulfilling ‘worst-case’ expectations, so that nowadays—much as in ancient Greece—whenever a security dilemma determines a political decision, disaster follows. The last surviving signatory to the manifesto was Joseph Rotblat, who died on 31 August 2005. In 1995, Rotblat and the Pugwash Conferences were awarded the Nobel Prize for Peace. During World War ii, Joseph Rotblat participated in the Manhattan Project to develop an atomic bomb. An Encyclopaedia Britannica article on his Nobel prize explains that “Although he was uncomfortable about participating in the creation of an atomic bomb, Rotblat initially believed that the weapon would be used only to deter a German threat. After learning in 1944 that it would be used to contain the Soviet Union, a World War ii ally, he left the project….” Upon returning to England in 1945, Rotblat left defence work for medical research. He served as founding secretary-general and later as president of the Pugwash Conferences on Science and World Affairs, which began in 1957 and at which key scientists and others from different countries could confer about the peril of nuclear weapons facing the world. As a medical physicist at London University’s St. Bartholomew’s Hospital Medical College (1950–76), Rotblat directed attention toward the biological hazards of nuclear radiation and the severity of fallout from atmospheric testing. In the prevention of conflict, “Often the success of such efforts may be unknown to the wider world just because the criterion of success is simply that nothing happens” (p. 198). Hinde and Rotblat urge their readers to understand the absolute need to abolish war if humanity is to endure in this nuclear age. Their position is that “the very possession of nuclear weapons is immoral. Their enormous destructive power, inflicted on civilians even more than on the military, would make their use unforgiveable” (p. 139). The authors expressly credit Bertrand Russell and Albert Einstein with having taken the initiative for international action on this front (p. 189). Money markets are at the heart of financialized capitalism, as those markets that provide the funding liquidity needed for credit creation and leveraged trading. How have these markets evolved, grown, and become critical for larger financial flows? To answer this question, I distinguish an early period of financial globalization marked by regulatory arbitrage, offshoring, deregulation, and informal trading practices from a period of regime-consolidation marked by formal institutionalization. Concentrating on repo markets as the key funding sources for market-based banking, (...) I demonstrate that new institutional arrangements for these markets were initiated by private sector associations, but supported and authorized by public authorities. Bond trader groups codified new contractual arrangements and these were validated via reforms of bankruptcy codes and changes in central banks’ policy frameworks in the United States and European Union. Through these modifications and re-articulations in institutional conditions, transactions and large exposures on money markets became routine affairs—for shadow banking actors like money market funds as well as for commercial banks. The article concludes by discussing the continuity of regime-consolidation efforts after the transatlantic financial crisis and hypothesizes that they reveal “neo-patrimonial” features. (shrink)

This paper draws out what Derrida’s work—in particular as concerns law, democracy, and intergenerational justice in the context of the European heritage—can contribute to constitutionalism and the legal relation to future people, at the national level and the supranational one of the European Union. The first section outlines some of Derrida’s contributions to legal scholarship and European identity, and then, in the following two sections, argue for two main points. First, Derrida can help us understand the much-discussed double bind of (...) the constitutional relation to future people as merely an instance of a more general aporia. The double bind consists in the fact that the constitutional promise to safeguard future freedom also limits and binds future people. I will show how this aporia results from the temporal structure of the constitutional founding of law. Accordingly, the double bind cannot be resolved, either conceptually or in constitutional practice, but only be negotiated with greater awareness. Second, the same aporia of time entails that future generations are already implicated in the founding and re-founding of law here and now. Because the present moment is constitutively related to the past and the future, the meaning of a constitutional founding can become legible only from the future. Hence, the present generation, whose unity is never given, cannot but draw an advance credit on the future whose cooperation it anticipates. As a result, the political promise of Europe depends on its relation to its geographical, but also to its temporal others. (shrink)

The financial arrangements are the cornerstone of any lasting federal organization of the state. A delicate balance has to be struck between financial responsibility, solidarity, and the constraints imposed by theeconomie and monetary union. On the average member states in existing federal countries rely for two thirds on autonomous sources of finance, and for one third on solidarity.In the Belgian devolution act of 1980 the financial provisions run counter to the financial orthodoxy for a cooperative federalism. What constitutes a scientific discovery? What role do discoveries play in science, its dynamics and social practices? Must every discovery be attributed to an individual discoverer (or a small number of discoverers)? The paper explores these questions by first critically examining extant philosophical explications of scientific discovery—the models of scientific discovery, propounded by Kuhn, McArthur, Hudson, and Schindler. As a simple, natural and powerful alternative, we proffer the “change-driver model”: in a nutshell, it takes discoveries to be cognitive scientific results (...) that have epistemically advanced science. The model overcomes the shortcomings of its precursors, whilst preserving their insights. We demonstrate its intensional and extensional superiority, especially with respect to the link between scientific discoveries and the dynamics of science, as well as the award system of science. Both as an illustration, and as an application to a recent scientific and political controversy, we apply the considered models of discovery to one of the most momentous discoveries of science: the expansion of the universe. We oppose the 2018 proposal of the International Astronomers’ Union as too simplistic vis-`a-vis the historical complexity of the episode. The change- driver model yields a more nuanced and circumspect verdict: (i) The redshift-distance relation shouldn’t be named the “Hubble-Lemaître Law”, but “Slipher-Lundmark-Hubble-Humason Law”; (ii) Its interpretation in terms of an expanding universe, however, Lemaître ought to be given credit for; but (iii) The establishment of the expansion of the universe, as an evidentially sufficiently warranted result, is a communal achievement, emerging in the 1950s or 1960s. Catherine of Siena has been credited with original views regarding the crusade as political policy and with influencing Gregory XI to carry this out. In this article, I argued that while Catherine of Siena did not succeed in furthering the crusade – nor did she initiate this policy – her crusade correspondence leaves us a legacy that reveals significant aspects of her spirituality. Over 40 letters to ecclesiastical authorities, Kings, Queens, leaders of city states, knights and her own followers reveal (...) a religious intent, although addressing a policy with both religious and political consequences. The latter were important to Catherine because she considered political-cultural context vital for salvation and transformation; she advocated for the crusade because she considered that the crusade pilgrimage and holy war to recover the Holy Land would be critical for the salvation of many. Her epistles further witness to the prophetic, missionary nature of Catherine’s spirituality, and we see how she crafted her own version of crusade spirituality out of the wisdom on transformation learned through her union with God, fused with early Christian martyr spirituality and early crusade spirituality preached in medieval Europe. This thematisation of Catherine’s crusade letters is based on textual analysis of all crusade related letters in the 2002 critical text, on the most complete dating of Catherine’s letters (finished in 2008); and in dialogue with literary and other historical advances, making it an innovative study. Contribution: Catherine of Siena’s crusade letters reveal significant aspects of her spirituality rather than contributions to crusade politics. The letters evidence her prophetic-missionary spirituality and her conviction that socio-political context is significant for a journey of transformation; as well, this analysis details the importance of early Christian martyr spirituality for Catherine’s crusade spirituality. Proponents have been developing exhaustive rationales for the existence of school music from the moment that the subject was introduced into the public schools, attempting to convince an apparently skeptical public of the merits of (...) school music, and trying to pull endangered programs—usually their own—out of the fire. Today, as has been the case in the past, rescue and salvation discourses and initiatives abound. Moving music to a more secure place in the curriculum was cited as a rationale for the development of national music standards in 1994.1 In recent years saving the music has become a favorite project of major corporations, especially as privatization of public schooling has gained momentum. For example, in 1998 one of the National Association for Music Education's (MENC) corporate partners credited the school/partnership that promoted the Disney movie, Mr. Holland's Opus, with saving school music.2 The corporate-sponsored initiative "VH1 Save the Music" claims not only to help flailing school music programs but also, through the donation of musical instruments to schools, to rescue children as well—more than 250,0000 of them since 1997.3 [End Page 23]Because music outside of school seems to be thriving and probably will never be in need of rescue—although specific styles, genres, and practices may be in their twilight—"the music" to which "VH1 Save the Music" refers presumably is school music. As a music educator who perennially is called upon to "save the music," I will take a brief look at the object of salvation, the salvific discourses that surround it, and some of the systems of reasoning that construct it. I propose modifications in these systems of reasoning, which may lead to more culturally relevant, joyful, and sustainable school music.School Music: An Alchemized Constellation of Systems of Reasoning and PracticesTo conceptualize school music as an entity is both problematic and useful. On the one hand, doing so assumes the existence of an exteriority from which it can be clearly differentiated, that is, outside-of-school music, and yet these culturally constructed categories are leaky. The fact that the American Federation of Musicians joined forces with MENC to establish guidelines, which attempt to prevent school performing groups from encroaching on the turf of unionized professional musicians, indicates that the line of distinction between school music and its exteriority sometimes has been blurred.4Furthermore, when VH1 refers to it as "the music," school music seems to be not only clearly defined but also static and monolithic. I argue, however, that it consists of a whole constellation of systems of reasoning as well as the varied practices resulting from these systems. Differences between the various elements in this constellation may be as numerous as commonalities. School music in the U.S. is diverse in the sense that it encompasses a variety of sub-categories or sub-cultures (for example, elementary general music, secondary instrumental music, and so on), each with somewhat distinct systems of reasoning and practices. When suggesting that school music should be saved, we are faced with the complex question of whether all of these sub-categories, their systems of reasoning, and their consequent practices are to be objects of salvation.In addition to having to address the variety within school music, any mapping of relationships between school music and it exteriority should take into account the variety and dynamism of the musical world outside of school. This exteriority consists of a multiplicity of sub-cultures, each with a set of governing practices that may or may not be shared.On the other hand, astonishing within-category similarity exists, which supports the view that school music is an entity. In addition, some commonalities may not only unite all of the sub-categories but also may be shared with non-music school subjects, as well. The traditional understanding of coercion as exemplified by the use of force and violence to constrain the actions of agents has been challenged by theories that describe coercion instead in terms of the pressure it puts on some agents to act or refrain from acting. Building on earlier work defending the traditional understanding and rejecting the ‘pressure’ accounts of coercion, I argue in this paper that the traditional understanding of coercion, which I dub ‘coercion as enforcement’, provides a helpful analytic (...) tool for identifying coercion in peripheral cases, and thereby supporting the theoretical implications that are supposed to follow from the claim that someone has been coerced. In particular I analyze the coerciveness of the practices of credit-card issuers and institutions of higher education, and the demands by Greece’s creditors that the Greek government institute fiscal austerity, or else leave the European Monetary Union. He was 91 years old. Professor Abe was given a quiet funeral service reserved to family and close friends, according to sources in Kyoto.After the death of his mentor D. T. Suzuki, Abe became a leading exponent of Zen in the West and a (...) driving force in the encounter between Buddhism and Christianity. Abe must be credited with much of the intellectual vitality of this dialogue, as well as its relevance to contemporary social problems.Abe was a tireless exponent of the Buddhist doctrine of emptiness as the standpoint for realizing the True Self, yet was also willing to place this basic Buddhist teaching in dialogue with Christianity. Rejecting the notion that Christianity and Buddhism were either fundamentally similar or completely different, Abe saw in interreligious dialogue an opportunity for the mutual transformation of dialogue partners and pursued dialogue to help Buddhists and Christians in confronting the threat of nihilism in the modern world.In the ruins of postwar Japan, Abe began his studies with Hajime Tanabe at the University of Kyoto, a prominent figure in the Kyoto school of contemporary Zen Buddhist philosophy in Japan. This encounter began a distinguished career of teaching, writing, and, above all, dialogue with leading Christian thinkers, including David Tracy, Langdon Gilkey, Rosemary Radford Ruether, Jurgen Moltmann, and Hans Kung. Abe served as visiting professor at the University of Chicago, Purdue University, Claremont College, Columbia University, Princeton University, the University of Hawai'i, and other schools. Explainable AI (XAI) provides methods to understand non-interpretable machine learning models. However, we have little knowledge about what legal experts expect from these explanations, including their legal compliance with, and value against European Union legislation. To close this gap, we present the Explanation Dialogues, an expert focus study to uncover the expectations, reasoning, and understanding of legal experts and practitioners towards XAI, with a specific focus on the European General Data Protection Regulation. The study consists of an online questionnaire and (...) follow-up interviews, and is centered around a use-case in the credit domain. We extract both a set of hierarchical and interconnected codes using grounded theory, and present the standpoints of the participating experts towards XAI. We find that the presented explanations are hard to understand and lack information, and discuss issues that can arise from the different interests of the data controller and subject. Finally, we present a set of recommendations for developers of XAI methods, and indications of legal areas of discussion. Among others, recommendations address the presentation, choice, and content of an explanation, technical risks as well as the end-user, while we provide legal pointers to the contestability of explanations, transparency thresholds, intellectual property rights as well as the relationship between involved parties. These essays, first presented at a conference, “Coping with Sickness,” held in Italy in 1997, address ethical and regulatory medical issues within a historical context. Many of the essays, while addressing interesting topics, combine policy analysis and critical cultural theory. Critical cultural theory can be intellectually engaging at times but is generally irrelevant to public officials concerned with specific policy issues.Coping with Sickness is the third and final volume derived from a series of conferences cosponsored by the European Science Foundation (...) and the Euroconferences Activity of the European Union. The eight essays are organized chronologically and cover a range of disparate topics: medical practitioners and the Spanish Inquisition , the history of autopsy legislation in German since 1800 , the history of “sadism” as a medical term in the nineteenth century , folk medicine in Holland in the late nineteenth century , abortion in Weimar Germany , drug testing in Africa in the early twentieth century , comparative policies toward STDs , and the debate over brain death in Germany . As might be expected in an anthology of this sort, the quality varies considerably. Nonetheless, the subjects addressed in this volume are engaging—much to the credit of the editors.Two pieces in particular represent the range of these collected essays. In “Vacher the Ripper and the Construction of the Nineteenth‐Century Sadist,” Angus McLaren, one of the best historians writing on the history of sexuality today, explores the “discovery” of sadism in the late nineteenth century by focusing on the dramatic trial of Joseph Vacher, who was charged in 1895 for the brutal sexual murder of a woman in Champuis. He later confessed to the murder and the sexual violation of another seven females and four males. Vacher had a long history of mental illness; indeed, he had been institutionalized in July 1893 following a failed attempt at suicide that left a bullet lodged in his head. At the trial the criminologist Alexandre Lacassagne was brought in as an expert witness to testify that Vacher was not insane but an antisocial sadist, as revealed by his dabbling in anarchism, vagabondism, and homosexuality. As a consequence, Vacher was found guilty and given a death sentence.McLaren finds in this trial an example of the social construction of a new medical concept, “sadism.” The emergence of the concept of sadism, he argues, reflected a “gendered notion” of defining appropriate male and female behavior; physicians at the turn of the century believed that “civilized men were most threatened, not by excess passion, but by the enervation spawned by urban life” . The concept of sadism was also employed by doctors to enhance their own authority and to alert the public to the dangers of a male manifesting “feminine traits” and to “beat back” homosexuality.There is much interesting conjecture to McLaren's study, but what policy lessons should be drawn from this remains unclear. If every concept is actually a social construction, reflecting the social anxieties of the age, then is the fashionable concept of social construction itself socially constructed to enhance the authority of the medical historian?More interesting methodologically is Claudia Wiesemann's absorbing essay on the historical debate in Germany over “brain death.” Relying on Ulrich Beck's social theory of simple and reflexive modernization, she shows that, when confronted with complex scientific questions, the public has to decide between competing plausible scientific claims; as a result, political groups make use of scientific expertise and counterexpertise to push their favorite practical and legal solutions. As this Royal Commission indicated in its first report, Challenges and Choices, the scope and implications of these changes call "into question basic assumptions, values, and institutions at every level of society, from the (...) shop floor to the cabinet room, to the international economic system," but while many values change, others endure."--. This article sets out to research and resolve the conceptual lag between the family as defined and recognised in law and the multiplicity of queer constellations of ‘intimate citizenship’ in which families are actually done. The focus is on adult unions outside of conjugal coupledom. The family law practices, and awareness and expectations of adults in such unions were analysed through 21 interviews and the content analysis of 40 documents and were projected against the applicable legal mould. The (...) article then proposes to resolve the existing conceptual lag by advancing a conception of the family as a malleable, open-ended assemblage, in lieu of the current rigid status approach in family law, which is both under- and overinclusive. The proposed conception does justice to the increasing fluidity of family formations, which are not always already domestic, dyadic and sexual. (shrink)

A view of knowledge—what I call the "Deserving Credit View of Knowledge" —found in much of the recent epistemological literature, particularly among so-called virtue epistemologists, centres around the thesis that knowledge is something for which a subject deserves credit. Indeed, this is said to be the central difference between those true beliefs that qualify as knowledge and those that are true merely by luck—the former, unlike the latter, are achievements of the subject and are thereby creditable to her. (...) Moreover, it is often further noted that deserving credit is what explains the additional value that knowledge has over merely lucky true belief. In this paper, I argue that the general conception of knowledge found in the DCVK is fundamentally incorrect. In particular, I show that deserving credit cannot be what distinguishes knowledge from merely lucky true belief since knowledge is not something for which a subject always deserves credit. (shrink)

In combining the micropolitics approach in international management, the industrial relations literature and business ethics, this article conceptualizes global framework agreements as an alliance between central CSR managers of transnational corporations and central actors within trade unions to monitor subsidiaries in the implementation of CSR policies. The empirical investigation, based on the qualitative analysis of ten French multinational companies, confirms the relevance of such a conceptualization. It particularly shows that central CSR managers hope mobilizing the union network to increase (...) their capacity to supervise subsidiaries. Over there, it helps understanding concrete mechanisms adopted to implement global framework agreements since, in some of the studied cases, the managerial and union channels are coordinated precisely to strengthen this capacity. It, then, highlights the procedural nature of policies regarding global framework agreements. Overall, this paper examines the conditions necessary for mobilization of the union network and suggests avenues for future research. (shrink)

Marriage promotion is a government strategy aimed at ensuring that children are raised in married, heterosexual families, preferably by their biological parents. This article places critical heterosexuality studies in dialogue with feminist state theory to examine marriage promotion as a reaction of the gendered and sexualized state to crisis tendencies of institutionalized heterosexuality. Drawing on the first in-depth study of marriage promotion politics, the author examines polycentric state practices that seek to stabilize the norm of the white, middle-class, heterosexual family. (...) While explicit policy concerns focus on race and class, state-sponsored marriage workshops teach about gender hierarchy to rehearse an implicit ideology of marital heterosexuality. In contrast to feminist state theories that present a monolithic, top-down model of state control, the author offers a more nuanced examination of the relationship between macro and micro levels of power and their uneven consequences for social change.
