This article documents the response of cooperative institutions that were required to adhere to new capital adequacy regulations traditionally geared for profit-maximising organisations. Using data from the Australian credit union industry, we demonstrate that the cooperative philosophy and internal corporate governance structure of cooperatives will lead management to increase capital adequacy ratios through the application of accounting window dressing techniques. This is opposite to the intended purpose of template regulation aimed at efficiently increasing operating margins and lowering risk. This paper investigates the determinants of regulatory compliance in corporate organizations. Exploiting a unique enforcement and reporting framework for insider trading in Italy, we present three main findings. First, board governance, such as chief executive–chairman duality and the proportion of non-executive directors, does not increase the propensity of firms to comply with regulation. Second, family firms and firms with a high degree of separation of ownership from control are most likely to comply with regulation. This article examines the conception of the everyday city as presented in the work of architect Christopher Alexander and architectural theorist Bill Hillier. Both thinkers suggest that, in the past, lively urban places arose unself-consciously through the routine daily behaviors of many individual users coming together in supportive space and place. In different ways, both thinkers ask whether, today, a similar sort of vital urban district can be made to happen self-consciouslythrough explicit understanding transformed into design and policy principles. (...) The aim for both Alexander and Hillier is place-based urban communities marked by lively streets, serendipitous public encounters, and informal sociability. The article begins by examining commonalities and differences in Alexander and Hillier’s conception of environmental wholeness and urban place. Next, the article considers implications for urban design and, finally, indicates the considerable value that the two thinkers’ ideas offer environmental philosophy, particularly for understanding environmental wholes. In this paper I defend epistemic circularity by arguing that the “No Self-Support” principle (NSS) is false. This principle, ultimately due to Fumerton ( 1995 ), states that one cannot acquire a justified belief in the reliability of a source of belief by trusting that very source. I argue that NSS has the skeptical consequence that the trustworthiness of all of our sources ultimately depends upon the trustworthiness of certain fundamental sources – sources that we cannot justifiably believe to be (...) reliable. This is a problem, I claim, because if the trustworthiness of all of our sources depends upon sources that we should not believe to be reliable, then a reflective individual should not trust any of his sources at all. The hidden cost of rejecting epistemic circularity is thus the unacceptable skeptical thesis that reflective individuals like you and I have no justified beliefs whatsoever. (shrink)

I distinguish between two conceptually different kinds of physical space: a space of ordinary material bodies, which is the space of points at which I could imaginably place the tip of my finger, or the center of a billiard-ball, and a space of elementary physical determinables, which is the smallest space of points such that stipulating what is happening at each one of those points, at every time, amounts to an exhaustive physical history of the universe. In all classical physical (...) theories, these two spaces happen to coincide – and what we mean by calling a theory “classical”, and all we mean by calling a theory “classical”, is precisely that these two spaces coincide. But once the distinction between these two spaces in on the table, it becomes clear that there is no logical or conceptual reason why they must coincide – and it turns out that a very simple way of pulling them apart from one another gives us quantum mechanics. In this multi-faceted study, David Clarke explores Tippett's complex creative imagination - its dialogue between a romantic's aspirations to the ideal and absolute, and a modernist's sceptical realism. He shows how the musical formations of works such as The Midsummer Marriage, King Priam, and The Vision of Saint Augustine resonate with the aesthetic and theoretical ideas of key figures (...) in modern Western culture - some known to have been influential to the composer, others not usually associated with him. Analyses of late works such as the Triple Concerto and Byzantium also speculate on Tippett's sexuality as a critical element in his creative and political consciousness. (shrink)

When patients are admitted to the hospital, they are generally expected to remain in or within close proximity to their assigned rooms in order to promote their safety and appropriate medical care. Although there are circumstances when patients may safely leave their hospital room or floor, guidance within the medical literature for the management of patient movement within the hospital are lacking. Excessive restrictions on patient movement may be seen as overly paternalistic, while lax requirements may interfere with high quality (...) care, patient safety and efficient hospital practice. As a result, guidance in the form of institutional policy is warranted. Such policy development should take into consideration the potential clinical, legal, and ethical concerns in balancing the competing values of patients’ preferences and respect for autonomy, while ensuring high quality, safe, and efficacious medical care. This paper will provide a framework for hospitals to create institution-specific patient movement policies that are fair, systematic, and transparent. (shrink)

In this paper, I consider the question of whether crime victims can be said to have a moral right to see their victimizers punished that could explain why they often feel wronged or cheated when the state fails to punish offenders. In the first part, I explain what I mean by a “right to punishment” and what it is for such a right to “explain” the frustrated crime victim’s reaction. In the second part, I distinguish such a right from a (...) Lockean-style right to punish, which is also shown incapable of providing the needed explanation. In the third part I argue that it is difficult to identify any benefit such that the right to punishment could plausibly be understood as a right to that benefit. I discuss two main candidates here: the vaguely Hegelian idea that punishment is itself some sort of restitution for the wrong done to the victim; and the idea, due to Victor Tadros, that punishment is a form of compensation for wrongdoing by contributing indirectly to protecting victims from future harm. In the final section, I suggest instead that the frustrated crime victim’s reaction, when justified, is best explained, not by the violation of any right to punishment, but rather by the state’s failure to treat the victim as an equal. Atomism is defined as the view that the moral value of any object is ultimately determined by simple features whose contribution to the value of an object is always the same, independently of context. A morally fundamental feature, in a given context, is defined as one whose contribution in that context is determined by no other value fact. Three theses are defended, which together entail atomism: (1) All objects have their moral value ultimately in virtue of morally fundamental features; (2) (...) In this paper I discuss, on behalf of the materialist, a consideration against the modal or conceivability argument against materialism which was first voiced in the third lecture of Naming and Necessity. This consideration is based on intertheoretic identities, statements in which both terms flanking the identity sign are theoretical. I argue that the defender of the conceivability argument has trouble to account for the appearance of contingency in those types of necessary identities. In fact, intertheoretic identities pose a formidable (...) dilemma for the defender of the modal argument and actually force the antimaterialist to say more about the semantics of theoretical terms than is implicit in standard discussions of the argument. I myself consider several options in this regard, the upshot being, however, that none of the alternative semantics for theoretical terms available to the antimaterialist is good enough to achieve the twofold aim which her modal argument requires, namely, to account for the a posteriori necessity of identities of this sort and, at the same time, to preserve her antimaterialist argument. Finally, in the last part of the paper, I argue that my defense of materialism can withstand some worries coming from David Chalmers’ recent views on a priori scrutability. (shrink)

Terry Eagleton is the foremost Marxist cultural theorist of our time. In the first book-length study of this highly influential figure, David Alderson provides detailed discussions of Eagleton's Marxism and his engagements with postmodernism, as well as an evaluation of his interventions in Irish Studies. Each of the chapters in this important intervention in current theoretical debates offers accessible contextualization of the key issues and provides detailed analyses of Eagleton's literary criticism. Of the things needing to be forgotten if we are to partake in the oneness of Dao, language is perhaps the hardest. Since the purpose of words is to delimit things, words create an artificial division between things and their image qua form. While humanity views images as distinct entities, Dao leaves them in their jumbled collectivity; while humanity feels compelled to act upon our thoughts and feelings, Dao remains silent and empty. This leads to the following question: Will modelling (...) ourselves after Dao result in a more creative form of thinking and if so, can it be carried-out without words and images? To demonstrate why the answer to this question is yes, we will first analyze why words are an obstacle to deeper thinking before looking at how images, despite their ability to connect with Dao, are nevertheless hindered by their dependency on being. It thus falls to spirit to lay bare the constant non-image of Dao, the core of the Daoist imagination and focus of the final section of this paper. (shrink)

The author tries to put into perspective the relevance of searching for an ?ethical university? by proposing to integrate the (...) important notion of Enlightenment as formulated by Kant, Newman's idea of the university and other similar western ideals, with the eastern ideas of the Confucian Classic The Great Learning, in order to suggest how the quest for an ?ethical university? might materialize in the future. This article pursues Rahner’s idea that the Holy Spirit has the role of “Spirit of Christ” even before the Incarnation, namely as “entelechy” directed to the Christ event. In the article, particular use is made of a biblical text hitherto not invoked in this connection, namely 1 Peter 1:11, from which a biblical base for this theology is developed. The article also investigates Teilhard de Chardin’s theory of evolution encompassing the world religions and Christianity, the absolute religion. The idea of (...) the Spirit of Christ as entelechy is clarified and refined by application of the author’s construct of the “return” model of the Trinity, in which the Son does not just come forth from the Father, but returns to him in the power of the Spirit (see his newly published book, Deus Trinitas). Before, and in reparation for, the Son’s historical return to the Father, in Christ, the Spirit, precisely as entelechy, has to seek him in history, that is, through the creation and evolution of the cosmos, the arrival of humans, the consequent and new operation of the Spirit as grace, and the history of Israel culminating in the lives of Mary and, finally, Jesus, in whom this operation finds its final goal. Moreover, the role of the Spirit as entelechy complements and forms a unity with that of the same Spirit (again “Spirit of Christ”) as sent historically by the glorified Christ upon the Church, and continues even after the Incarnation, in leading to Christ (as “anonymous Christians”) men and women of goodwill, including those belonging to the world religions who have not yet had the gospel effectively preached to them. Finally, the paper notes that it covers some of the same ground as the Vatican Declaration Dominus Iesus, but in a different way, namely as instructed by the work of Teilhard and Rahner. (shrink)

While many neuroscientists and philosophers share an interest in integrating neuroscience, both camps suggest that this integration is challenging. Why is this the case? In this paper, I account for why tools, or the materials and technologies that researchers use to study brain structure and activity, are obstructions to integrating neuroscience. The constraints of tools and their productivity create neuroscience practices that can be in tension with methodological, data, and explanatory integration. My account explains why integration in neuroscience likely will (...) not occur unless new tools are developed. At the same time, my account explains why new tools can facilitate local integration between neuroscience subfields for the same reasons why they can obstruct it. (shrink)

Those who have a brief against the analytic-synthetic distinction raise problems for what seem to supporters of the distinction to be some of the clearest cases. That bachelors are unmarried seems to many to be analytically true. But to hold this seems to imply that there is a definition of "bachelor" that includes being unmarried. But critics of the analytic-synthetic distinction, such as Jerry Fodor, deny that there are true definitions (reportive, not stipulative). So there can be no definition of (...) "bachelor". Development ethicists from one society may help understand and evaluate social change in another society. After examining several types of such cross-cultural assessments, the author argues that insider-outsider hybrids are the most promising cross-cultural dialogue partners.

The oeuvre of Olivier-Thomas Venard, O.P. offers a sensitive delineation of the central role which Aquinas gives to language and its careful composition in pursuing his intellectual inquiry. By suggesting a way of aligning “medieval” modes of inquiry with “postmodern,” this study brings to light the inescapable role which the language of religious expression plays in Aquinas’s manner of leading us to understand recondite matters which he avows we are able at best to “imperfectly signify.” All of this contributes to (...) the strategy of manuductio for which his work is celebrated, as well as accounting for the chiseled clarity of expression which continues to impresscommentators on his work and clearly distinguishes him from erstwhile peers. Nietzsche Unbound presents a new and unusual interpretation of Nietzsche as a genuinely religious thinker who not only grasped the nature of humanity's current spiritual predicament, but also set forth an overlooked and truly revolutionary solution to it.

In this paper I offer a partial defense of a constitutivist view according to which it is possible to defend fundamental requirements of practical reason by appeal to facts about what is constitutive of rational agency. I show how it is possible for that approach to circumvent the ‘is’/’ought’ problem as well as the requirement that it be possible to act contrary to practical reason. But I do not attempt to establish any particular fundamental requirement. The key ideas are that (...) such a requirement is not genuine if it is arbitrary, and that it is arbitrary just in case (a) it needs explanation and (b) that explanation could not, even in principle, be provided.
