This is a theoretical treatment of the term "Sha Zhu Pan" (杀猪盘) in Chinese, which translates to “Pig-Butchering” in English. The article critically examines the propagation and validation of "Pig Butchering," an animal metaphor, and its implications for the dehumanisation of victims of online fraud across various discourses. The study provides background information about this type of fraud before investigating its theoretical foundations and linking its emergence to the dehumanisation of fraud victims. The analysis highlights the (...) disparity between academic literature, subjected to rigorous peer-review processes, and sensationalised narratives prevalent in the media. While academic works subject "pig butchering" to critical scrutiny and refrain from endorsing derogatory terms to depict fraud victims, numerous media outlets employ this term uncritically, further worsening the predicament of these victims. "Pig butchering" is firmly rooted in the concept of dehumanisation, and this article underscores how language moulds perceptions of fraud and behaviour, extending to the development of preventive strategies. The role of law enforcement agencies in generating and disseminating materials is also a central theme, emphasising their responsibility as trusted sources of information. We suggest that these agencies should adopt non-victim shaming language to encourage victims to report crimes and alleviate the stigma attached to victimisation. Additionally, the article offers valuable cross-cultural insights by comparing metaphors from Chinese and Nigerian contexts. This comparative analysis enriches our comprehension of the global dimensions of online fraud and its cultural diversities, highlighting the substantial impact of language on perceptions and behaviours. We advocate for a departure from victim-blaming tendencies perpetuated by select media outlets, urging a more compassionate and accurate portrayal of those affected by online fraud. We, therefore, call for a more empathetic and accurate portrayal of individuals affected by online fraud, aligning with the broader objective of promoting understanding and support for these victims. Dehumanisation is a puzzling phenomenon. Nazi propaganda likened the Jews to rats, but also portrayed them as ‘poisoners of culture’. In the Soviet Union, the Stalinist regime called opponents vermin, yet put them on show trials. During the Rwandan genocide, the Hutus identified the Tutsis with cockroaches, but nonetheless raped Tutsi women. These examples reveal tensions in the way in which dehumanisers perceive, portray and treat victims. Dehumanisation seems to require that perpetrators both deny and acknowledge the (...) humanity of their victims in certain ways. Several scholars have proposed solutions to this so-called ‘paradox of dehumanisation’ that question the usefulness of dehumanisation as a concept to explain genocidal violence, claim that dehumanisation is characterised by an unstable belief in the non-human essence of the dehumanised, or contend that dehumanisation revolves around a denial of metaphysical human status. The main aim of this article is to present a novel framework for theorising dehumanisation that offers a more straightforward solution to this paradox based on the idea that perpetrators deny their victims’ human standing in a moral sense without necessarily negating their biological human status or human subjectivity. If the legitimacy of international humanitarian and human rights law lies, in part at least, in its capacity to confront dehumanising actions in the modern world, we may speak of the limits of this achievement. It is well known that people who commit genocide or crimes against humanity typically dehumanise those against whom their crimes are committed and that the humanitarian and human rights dimensions of international law were developed in response to the radicalisation of this phenomenon. The expanded scope (...) of international criminal justice caught a cosmopolitan imagination because it seemed to restore an idea of humanity in the face of organised attempts to eradicate the very idea of universal humanity. It also caught a cosmopolitan imagination because it seemed to restore the humanity of the perpetrators as well. They were no longer to be treated as beasts liable to the 'punishment' of the victors but to be brought to trial, held accountable for their deeds and converted back into responsible human beings. Today, however, I suggest that we face a double temptation: in confronting those who commit crimes against humanity to represent them as inhuman monsters rather than responsible human beings; in our compassion for victims of crimes against humanity, it is to represent them merely as victims and not as moral and political subjects. In either case, there can arise a reversal of the problem we are trying to address. I do not suggest this tendency is inevitable but where it is present it indicates an insufficiently reflective relation to international law. I address the problem of reversal through a discussion of three authors (Rawls, Habermas and Arendt) and three issues ('pariah peoples', 'criminal states' and 'monstrous perpetrators'). (shrink)

The accurate illustration of the contemporary refugee subject has presented an unprecedented theoretical, epistemological and methodological challenge to all fields of academic research. Seeking for alternative philosophical modalities capable of liberating refugee representation from the suffocating threat–victim bipolarity, this article critically investigates Giorgio Agamben and Judith Butler’s theoretical perspectives on refugee subjectivity. Section 1 systematises the dominant tropes of refugee representation either as dehumanised threats or depoliticised victims. Section 2 introduces the readers to Giorgio Agamben’s emblematic homo sacer as (...) a potentially fertile reconceptualisation of refugee subjectivity. In this context, Judith Butler’s critique on the Agambenian bare life is presented in two core pillars. Following one Butlerian claim, we trace the Agambenian inadequacy to successfully overcome the contemporary threat–victim mode of refugee representation in the absence of an empowering theoretical account of the homo sacer’s agentic and resisting capacities. In Section 4, we explore Judith Butler’s main argument regarding the constitutively political character of vulnerable refugee existence. By designating the Butlerian constellation of vulnerability and agency as an invigorating alternative perspective on modern refugee representation, we finally argue that Butler’s epistemological framework provides a more agonistic and nuanced theorisation of refugee subjectivity than Agamben. In this article, we take a novel approach to analysing English sentencing remarks in cases of women who kill. We apply computational, quantitative, and qualitative methods from corpus linguistics to analyse recurrent patterns in a collection of English Crown Court sentencing remarks from 2012 to 2015, where a female defendant was convicted of a homicide offence. We detail the ways in which women who kill are referred to by judges in the sentencing remarks, providing frequency information on pronominal, nominative, and (...) categorising naming strategies. In discussion of the various patterns of preference both across and within these categories, we remark upon the identities constructed through the references provided. In so doing, we: quantify the extent to which members of the judiciary invoke patriarchal values and gender stereotypes within their sentencing remarks to construct female defendants, and identify particular identities and narratives that emerge within sentencing remarks for women who kill. We find that judges refer to women who kill in a number of ways that systematically create dichotomous narratives of degraded victims or dehumanised monsters. We also identify marked absences in naming strategies, notably: physical identification normally associated with narrativization of women’s experiences; and the first person pronoun, reflecting omissions of women’s own voices and narratives of their lived experiences in the courtroom. The most accessible expression of François Laruelles non-philosophical, or non-standard, thought, _General Theory of Victims_ forges a new role for contemporary philosophers and intellectuals by rethinking their relation to victims. A key text in recent continental philosophy, it is indispensable for anyone interested in the debates surrounding materialism, philosophy of religion, and ethics. Transforming Joseph de Maistres adage that the executioner is the cornerstone of society, _General Theory of Victims_ instead proposes the victim as the cornerstone of humanity and (...) the key figure for contemporary thought. Laruelle condemns philosophy for participating in and legitimating the great persecutions of the twentieth century, and lays out a new vision of victim-oriented ethics. To do this, he engages the resources of both quantum physics and theology in order to adapt a key concept of non-philosophy, Man-in-person, for a new understanding of the victim. As Man-in-person, the victim is no longer exclusively defined by suffering, but has the capacity to rise up against the worlds persecution. Based on this, Laruelle develops a new ethical role for the intellectual in which he does not merely represent the victim, but imitates or clones it, thereby assisting the victims uprising within thought. Violence is a known risk factor for health problems. In this epidemiological study across 5,385 male patients, we investigate the prevalence of perpetrated violence, exposure to violence, their overlap and the relationship between violence, mental, and psychosomatic health, as well as adverse health behaviors, such as self-harming behavior and the consumption of drugs. Participants completed an anonymous questionnaire addressing violence experience, age of victimization/perpetration, frequency, and perceived severity of violence exposure. We considered physical, psychological as well as sexual violence. Information (...) on health status and adverse health behaviors complemented the data. Results showed that 48.4% of the sample reported having experienced violence. The victim-perpetrator overlap formed the largest group, in which the incidence of having experienced multiple types of violence was significantly higher compared to victims and perpetrators. The age-crime curve flattened more slowly with increasing age in this group. Although the perceived severity of exposure to violence is lower in the overlap group, its health status and adverse health behaviors were worse. Interventions should focus on this group since they constitute a burden for the healthcare system. (shrink)

Are all norms cognized in the same way? I present experimental evidence suggesting that they are not. I propose a distinction between two main classes of violations—the victimful and the victimless—and show that while people tend to rate acts belonging to either category as impermissible, the justifications for their judgments refer to salient features of the act only in the former case. This article explores the development of victim rights in sentencing through a comparative analysis of the rights of family victims in homicide sentencing proceedings across Australia, the United States, England and Wales and Canada. Of the various rights afforded to victims of crime, the use of family victim impact evidence in the sentencing of homicide offenders has proven most contentious, with various courts grappling with the weight such evidence ought to play in sentencing proceedings. In homicide cases where (...) the family of the deceased victim submits a statement, all Australian and international jurisdictions except the Australian state of New South Wales (NSW) have resolved to allow the consideration of such statements on the basis inter alia that family victims may incur harms potentially relevant to the sentencing process. New South Wales continues to reject such evidence on the basis that family statements may value the deceased’s life above that of another. This article considers the status of family impact statements in homicide cases by examining the treatment of family victims in sentencing law on an international basis, with particular focus on pilot schemes in England and Wales, where family victims have been provided personal counsel at public expense, for use in homicide cases. Exhumations aim to restore victims’ dignity because they constitute a step towards their individualisation and recognition as members not only of a particular family but of the human family. This article aims to contribute to the critical assessment of how the notion of human dignity and dignification are used in the context of mechanisms of transitional justice, such as exhumations. It focuses on the Colombian case from an interdisciplinary perspective based on socio-legal studies. The research is based on participant (...) observation, interviews, and thematic analysis of the uses of the term dignity and dignification in the texts of the laws and protocols for the exhumations of victims of the armed conflict in Colombia. We theorize that victim anonymity is an important factor in ethical decision making, such that actors engage in more self-interested and unethical behaviors toward anonymous victims than they do toward identifiable victims. Three experiments provided empirical support for this argument. In Study 1, participants withheld more life-saving products from anonymous than from identifiable victims. In Study 2, participants allocated a sum of payment more unfairly when interacting with an anonymous than with an identifiable partner. Finally, in Study (...) 3, participants cheated more from an anonymous than from an identifiable person. Anticipated guilt fully mediated these effects in all three studies. Taken together, our research suggests that anonymous victims may be more likely to incur unethical treatment, which could explain many unethical business behaviors. (shrink)

The paper examines three aspects of the debate over the introduction of victim impact statements (VIS) in criminal cases. The first is the challenge VIS presents to the wholly public conception of criminal justice, in which the offender is prosecuted, tried and punished in the name of the state and not the individual victim. The second is the claim by supporters of VIS that the enhancement of victim input contributes to repairing an imbalance between offender and victim, created by the (...) crime itself and exacerbated by existing criminal justice processes. The third is the claim that victim impact evidence is necessary to ensure that punishment is properly calibrated to the blameworthiness of the offender. In respect of each question, a key role is played in supporting VIS by two presuppositions: that criminal justice should be thought of as a field of conflict among individuals seeking their due, and that the courts suffer an institutional deficiency of human understanding that requires a special remedy. The paper argues that the case for VIS is seriously weakened if these presuppositions are not accepted, and draws attention to their derivation from a wider political culture characterised by the dominance of neo-liberalism or market individualism. In this article, I focus on the work of the Movement of Victims of State Crimes in Colombia. The work of Movice, I suggest, is an example of how the category of “victim” from international law discourse is adopted and used from below by victims of mass atrocities. I show that, through this category, Movice attempts to introduce an alternative narrative of the internal armed conflict in which the state is a perpetrator of violence against civilian population as (...) part of a practice of elimination of political opposition through violent means. To do this, I focus on three political opportunities in which Movice deployed the category of victim between 2005 and 2016. I suggest that Movice is an example of how a movement of victims can adopt categories of international law to frame their struggles and, in doing so, infuse them with new contents. (shrink)

Do victims’ emotions underlie preschoolers’ moral judgment abilities? Study 1 asked preschoolers (n = 72) to judge actions directed at characters who could and could not feel hurt and who did and did not cry. These judgments took into account only the nature of the action, not the nature of the victim. To further investigate how victims’ emotions might impact children’s moral judgments, Study 2 presented preschoolers (n = 37) with stories that varied in transgression type (Moral, Conventional, (...) or None) and victim’s reaction (Crying Present or Crying Absent). As in Study 1, children’s judgments were affected primarily by transgression type, and not by emotion. In an analogous task, judgments of children with autism spectrum disorders (Study 3; n = 12) were affected by both transgression type and crying. Typically developing children’s moral judgments are thus concerned primarily with action type, not with emotional displays, but the judgments of children with autism spectrum disorders can be swayed by victims’ emotions. Despite the police preventing special fraud victimisation of older adults, both the number of cases and the amount of damage have remained high in Japan. ‘Special fraud’, in Japan, is a crime in which victims are tricked by fraudsters who through phone or postcards impersonate the victims’ relatives, employees and other associates, to dupe the victims of their cash or other valuables. The number of recognised cases of special fraud has been turned to increase in 2021. Although (...) police or consumer affairs administrations have been conducting all-encompassing enlightenment or public education for prevention, it is also necessary to reach out to those who are vulnerable to fraud. In this study, we determine the psychosocial characteristics of victims of special fraud in Japanese older adults. We analysed the age, gender, education, residential status, household satisfaction, risk perception and scam vulnerability scale of 56 older adults aged 60 years or older who had been victims of special fraud and 99 older adults aged 60 years or older who had never been victims of special fraud. The study found that the victimised older adults were more likely to be females who live alone and go out less frequently than the non-victimised older adults. The total scores of the scam vulnerability scale were higher among the elderly victims of special fraud compared to those who had never been scammed, suggesting that the psychosocial characteristics of victims of special fraud among older adults are being female, living alone, going out infrequently, having high confidence against fraud victimisation and responding quickly to phone calls and unknown visitors. Therefore, government agencies or family members should take care of older women who meet these characteristics to reduce their contact with fraudsters. (shrink)

We examine the concept of personhood in relation to people living with dementia and implications for the humanity of care, drawing on a body of ethnographic work. Much debate has searched for an adequate account of the person for these purposes. Broad contrasts can be made between accounts focusing on cognition and mental faculties, and accounts focusing on embodied and relational aspects of the person. Some have suggested the concept of the person is critical for good care; others suggest the (...) vexed debates mean that the concept should be abandoned. We argue instead that the competing accounts illuminate the very tensions in personhood which are manifest for all of us, but especially for people living with dementia, and argue that our account has explanatory power in shedding light on how precisely dehumanisation and constraints on agency may arise for people living with dementia, and for staff, within an institutional context. Magna Carta Libertatum is one of the few documents that continuously imply thorough discussions about fundamental principles of the law. In 2011, Lord McNelly, Justice Minister of UK at the time, has emphasized the core and everlasting principles that derived from this document: ᠅ that the power of the state is not absolute ᠅ that whoever governs the state must obey the law ᠅ and that whoever governs the state must take account of the views of those who are governed. (...) These are the fundamental principles of any government that strives to be distinguished as democratic, these are the self-evident truths that have been developed in the theory of social contract that established the modern day democracies. It is very common that article 39 of Magna Carta that provides for the right to due process, as well as article 40 that provides for the right to access to justice and justice itself, to be usually analyzed from the point of view of the rights of the person accused of a crime. However, it must be taken into consideration, that failure to guarantee these two very important human rights makes the accused person a victim of abuse of power. This article aims to analyze the relevance of Magna Carta in the rise of the concept of rights of victims of abuse of power. Although it is a concept developed later in history, the clauses of Magna Carta that remain in power can be directly linked to this category of victims. The thirteenth century provides a very important perspective on the position of the victim of crime and can be analyzed in a comparative aspect regarding the Common Law and the Civil Law historical development. The article will briefly explain the evolution of the concept of victims’ rights throughout these eight centuries to the modern times when these rights have become a crucial part of the national legislations of Western Balkan countries. Bullying is a global issue that, beyond school, is present in different social contexts, such as sport environments. The main objective of this study was to get to know the experiences of victims of bullying in sport throughout their youth sport training. Semi-structured interviews to four Spanish women and seven Spanish men were carried out, within an age range of 17–27. The following main themes were established by means of a hierarchical content analysis: “bullying characterization,” “dealing with bullying,” and (...) “consequences of bullying.” The results show the presence of physical, verbal and social bullying in the sport context, with the changing room being the space where this type of behavior is most frequently developed. Most victims show an internal attribution for the bullying event, related to their motor skills and their personal physical and psychological characteristics. Double victimization can be observed, at the sport club and at the educational center. Passive strategies are used to deal with the situation, while little support is shown by sport agents. The victims, as a consequence of the bullying experience, suffer from short and long-term negative effects on a psychosocial level. The study highlights the necessity to design and implement programs focused on the prevention, detection and intervention of bullying for sport organizations, bearing in mind all the agents that make them up. Furthermore, the importance of promoting the creation of safe sport environments, free from any kind of violence, is emphasized. (shrink)

This article explores the impact of war-related traumatic experiences on political identities and political behavior by exploring different pieces of empirical evidence from the Spanish Civil War, the Franco dictatorship, and its aftermath. On one hand, the author analyzes semistructured interviews of survivors of the civil war and the dictatorship; on the other hand, she assesses data from a specialized survey implemented on a representative sample of the Spanish population. The analyses broadly suggest that, controlling for family leanings during the (...) civil war, victimization experiences during the civil war and the subsequent dictatorship lead to the rejection of the perpetrators’ identities along the political cleavage that was salient during the war. The survey analysis also indicates that although grudges related to severe wartime violations are transmitted through generations, moderate wartime violations do not have such a long-term political impact; the political effects of victimization do not increase with proximity to the traumatic events ; and victimization experiences do not have a significant impact on identities along cleavages that were not salient during the war. This edited collection explores the agency of women who do violence and have violence done to them. Topics covered include rape, pornography, prostitution, suicide bombing and domestic violence. The volume addresses such debates as the extent of women's agency in frameworks of the victim, survivor, or perpetrator; the power of gendered norms, constructs and stereotypes about female violence; and practical concerns about how feminists can escape polarisations in understandings of agency in order to deal with violence done to and by (...) women. The volume contributes to the theoretical debate and is philosophical in its focus, whilst also seeking to draw on the insights of other disciplines. Victim's Stories and the Advancement of Human Rights takes on a set of questions suggested by the worldwide persistence of human rights abuse and the prevalence of victims' stories in human rights campaigns, truth commissions, and international criminal tribunals: What conceptions of victims are presumed in contemporary human rights discourse? How do conventional narrative templates fail victims of human rights abuse and resist raising novel human rights issues? What is empathy, and how can victims frame their (...) stories to overcome empathetic obstacles and promote commitment to human rights? How can victims' stories be used ethically in the service of human rights? The book addresses these concerns by analyzing the rhetorical resources for and constraints on victims' ability to articulate their stories and by clarifying how their stories can contribute to enlarged understandings of human rights protections and deepened commitments to realizing human rights. It theorizes the normative content that victims' stories can convey and the bearing of that normative content on human rights. Throughout the book, published victims' stories-including stories of torture, slavery, genocide, rape in wartime, and child soldiering-are analyzed in conjunction with philosophical arguments. This book mobilizes philosophical theory to illuminate victims' stories and appeals to victims' stories to enrich the philosophy of human rights. (shrink)

This article centres on some of the dilemmas contained within victim positioning. Such dilemmas are often overlooked by the authorities involved with people subjected to relational aggression. 2 For example, when teachers rule out cases of bullying because the victim has ‘participated in’ or ‘laughed at’ some of the bullies’ initiatives, or when a rape victim’s status as a victim is questioned because, in the lead up to the assault, she was supposedly friendly to the rapist. In these cases, it (...) could be useful to explore the reason for the bullying victim’s apparent collusion or to better understand the premises for the rape victim’s positioning options in relation to the perpetrator. In other words, it could be fruitful to explore the dynamics and dilemmas of the victim position. In this article, I aim to reflect on the motivational conditions of the victim phenomenon. These reflections are based on an analysis of qualitative data produced through interviews with school children as well as on relevant secondary literature. (shrink)

This paper analyses the discourse surrounding a high-profile sexual assault case in South Korea. While most research on language and sexual violence has focused on the media portrayal or online resistance movement, not much has focused on the language and the law. Using Critical Discourse Analysis and rhetoric, this present paper seeks to show the importance of value of paying closer attention to legal decision-making process, showing how this can make a significant contribution to the literature. The analysis reveals two (...) distinctive discourses at work. One is that victims must embody and display certain characteristics as a ‘pure and destroyed’ individual in order to avoid being dismissed or appearing untrustworthy. The second is that the perpetrators represent themselves as victims seeking to makes it the goal of the court to protect the perpetrators’ rights, rather than those of the victims. (shrink)

The complexities of domestic abuse as both a lived experience and a crime generate unique communicative challenges at the scene of emergency police call-outs. Space is a prominent and complex feature of these ecounters, entailing a juxtaposition of the institutional and the private, whereby frontline officers seek evidence of abuse from victims in the same space in which the abuse occurred. This paper explores how speakers manage one evidentially salient aspect of these encounters: officers’ advancement into victim’s immediate personal (...) space to inspect and photograph their injuries. As compared with the attention dedicated to preserving vulnerable victims’ personal ‘bubble’ of space in formal investigative interviews, first response guidelines allow participants more leeway to adapt their behaviour according to the unpredictable demands of each situation. I present two case studies here which form part of a wider study of first response call-outs to domestic abuse incidents reported to a UK police force. The audio data have been extracted from police body-worn video footage and transcribed, with visual information represented intralinearly. Through conversation analysis, I examine the microinteractional means by which personal space is made relevant and consequential to the unfolding talk, with a focus on how ownership rights and control over the space are (re)constructed discursively. Analysis demonstrates that entering victims’ personal space can be managed in ways that either reinforce their disempowered position or afford them some control. The findings have implications in relation to victims’ potential vulnerability, police-victim relations and the nature of the evidence produced. (shrink)

Social scientists who conduct qualitative research frequently use emotional engagement to gather information about participants’ thoughts, feelings, and behaviours in relation to a particularly research question. When the subject under investigation is related to trauma, listening to, or being exposed to personal accounts of participants’ traumatic experiences can carry a significant emotional cost for researchers. This may place them at risk of secondary trauma. In this article, I examine these issues from the context of my doctoral field research in South (...) Africa, which focused on intergenerational trauma amongst descendants of victims of apartheid-era gross human rights violations. I reflect on my positionality as both an insider and outsider and feelings of guilt that emanated from my sense of being privileged and an imposter. I also reflect on the emotional turmoil brought about by my engagement with the trauma of participants and their families. I conclude by sharing the lessons I have learnt, and that have enabled me to sustain my scholarly engagement with intergenerational trauma. Ultimately, this article gives insight into, and raises awareness about, the emotional consequences of conducting trauma research. It offers practical suggestions to help researchers navigate the emotional minefield involved in conducting trauma research. (shrink)

The Law Society recently published a practice note titled 'Prosecutions of victims of trafficking'. This practice note comes many years after many lawyers had highlighted the problem and after the government machinery had chuntered into action and passed the UK Modern Slavery Act 2015 with explanatory notes and non-statutory guidelines for corporations. Since 2012 there had been issued warnings about the way defence lawyers, the Crown Prosecution Service and the UK police were dealing with trafficking and the Criminal Cases (...) Review Commission as far back as 2012 had note the severe failings by defence solicitors, prosecution and police, leading to many appeals and potential miscarriages of justice. Even in 2012 there were 946 known human trafficking victims, including 234 children. There was an attempt at a Human Trafficking Bill in 2010 which came to a halt and several reports including one by the Prison Reform Trust and Cambridge University Press, notwithstanding many books by notable academics for many years before today. This article examines the inadequacies of the Law Society practice note on defending victims and the jumble of high-ideals but short-sighted and impractical parts of the UK Modern Slavery Act 2015. A review of Francoise Laruelle's General Theory of Victims, which places Laruelle's theory in the context of post-colonial theories of the subaltern subject after Gayatri Spivak and Edward Said. The review questions whether Laruelle's General Theory of Victims really allows the so-called victims to speak for themselves, or simply represents another attempt by Western (French?) intellectuals to speak to/through the victims, for their own political and theoretical purposes.

This article empirically analyzes how victims’ remains were recovered, identified, repatriated, and retained after the World Trade Center terrorist attacks of September 11, 2001. It does so by asking the question whose body is it. This question brings to the fore issues related to personhood and ownership: how are anonymous and unrecognizable bodily remains given back an identity; and who has ownership of or custody over identified and unidentified human remains? It is in this respect that the article engages (...) with technoscientific and legal, or “technolegal,” trajectories of human remains in the wake of the WTC tragedy. By using the metaphor of “materialization,” it becomes possible to trace how remains are forensically identified and implicated in legal regimes. “Technolegal materialization” as a concept and methodological sensitivity contributes to the current “actor-network theory” -inspired legal scholarship, which tends to focus on legal practices in courtrooms but not those beyond them. In this article, 9/11 victims’ remains are followed from “Ground Zero” to the forensic laboratory and beyond and articulates five instances of technolegal materialization of bodily remains and their past and contemporary existences. Bullying often results in negative coping in victims, including an increased consumption of alcohol. Recently, however, an increase in alcohol use has also been reported among perpetrators of bullying. The factors triggering this pattern are still unclear. We investigated the role of empathy in the interaction between bullying and alcohol use in an adolescent sample (IMAGEN) at age 13.97 (±0.53) years (baseline (BL), N = 2165, 50.9% female) and age 16.51 (±0.61) years (follow-up 1 (FU1), N = 1185, 54.9% (...) female). General empathic distress served as a significant moderator of alcohol use in perpetrators (F9, 493 = 17.978, p < 0.01), which was specific for males and FU1. Male perpetrators, who are generally less sensitive to distress, might thus be more vulnerable to alcohol abuse. (shrink)

In this article I shall reflect on the issue of humanising pedagogy, taking a view that dehumanisation, in general, comes from two kinds of oppression. I shall argue that, apart from oppression of the political type, tertiary education is also a victim of another type of oppression which contributes to its dehumanisation, viz. the oppression exercised by the economic system that South Africa has chosen to adopt after 1994. In the context of these two factors, I shall discuss (...) what humanising pedagogy is, as presented in selected literature. I shall then discuss the political oppression and Freire’s educational solution. Further, I shall present the effect of neoliberal economy on higher education. Finally, I shall, in full circle, go back to the issue of humanising pedagogy and the possible solutions, coming from Freire, but also Fanon, Said, and Bhabha. I shall conclude with a personal reflection on the situation in South Africa and the role it could play in remedying the educational quandary. Ex Africa semper aliquid novi! (shrink)

:Recent behavioral economics studies have shown that third parties compensate players in Dictator, Ultimatum, and Trust games. However, there are almost no studies about what drives third parties to compensate victims in such games. It can be argued that compensation is a form of helping; and helping behavior, in a variety of forms, has been widely researched, especially with regard to motivators. Previous work on helping behavior has focused on empathic concern as a primary driver. In sharp contrast, anger (...) is often seen as an antisocial motivator resulting in aggression. However, other research has shown that moral outrage, anger evoked by the violation of a moral rule or a social norm, can lead to the punishment of a perpetrator, often described as altruistic or pro-social punishment. Some of the motivations for pro-social punishment, namely a concern for justice or the restoration of community values, can also be realized through victim compensation. We therefore propose the hypothesis that moral outrage leads to compensating behavior above and beyond what is predicted by empathic concern, but only when a social norm has been violated. We test this hypothesis in two studies, both of which use modified trust games in which the investor experiences a loss due either to a social norm violation or some other cause. Study 1 shows that trait moral outrage predicts third-party compensatory behavior above and beyond empathic concern, but only when a social norm is violated. To better understand the causal mechanism, Study 2 directly manipulated moral outrage, showing again that moral outrage leads to compensation, but only when a social norm is violated. The aim of this article is to discuss the role that victim groups and organizations may have in framing and supporting an accountability agenda, as well as their potential for endorsing a distributive justice agenda. The article explores two empirical cases where victims' rights have been introduced and applied by victim organizations to promote accountability—Colombia and Peru. It will be argued that if transitional justice in general and victim reparations in particular are to embark in a quest for distributive (...) justice, it cannot do so without considering victims as political actors, and putting forward demands in terms of victims’ rights. BackgroundDifferent types of maltreatment lead to distortions in emotion and attention processing. The present study investigated whether the experience of peer victimization in childhood and adolescence has an additional influence on attention processing in adulthood.MethodsTwo non-clinical samples consisting of individuals with different levels of experiences of maltreatment were recruited. In an evaluative conditioning task, images of faces with neutral emotional expression were either associated with short videos of intense negative statements, or associated with neutral videos. Subsequently, these faces were used (...) as stimuli in an emotional Stroop task as well as a dot-probe task.ResultsIn both tasks, hierarchical regression analyses revealed that retrospective reports of relational peer victimization made an incremental contribution to the prediction of attentional biases beyond child maltreatment. In the emotional Stroop task, emotional abuse was the strongest predictor for an attentional bias showing delayed responses to negatively associated faces, while peer victimization was associated with faster responses to negatively associated faces. In the dot-probe task, relational peer victimization was the strongest predictor for an attentional bias. When the attentional bias was examined in more detail, though, peer victimization did not show incremental contributions although emotional abuse remained the strongest predictor for facilitated attention toward negatively associated neutral faces.ConclusionExperiences of peer victimization leave additional cognitive scars beyond effects of childhood maltreatment by caregivers. It is likely that attentional biases in the aftermath of victimization put individuals at risk for the development of psychopathology. (shrink)

This study explores the dark side of leadership, treats creative self-efficacy as a mediator, and frames supervisor bullying and employee creativity in the context of social cognition and social comparison. We theorize that with a high social comparison orientation, the combination of high supervisory abuse toward themselves (own abusive supervision) and low supervisory abuse toward other team members (peer abusive supervision) leads to a double whammy effect: When employees are “singled out” for abuse, these victims suffer from not only (...) low creative self-efficacy due to supervisory abuse but also low supervisory creativity ratings. Results based on our two-wave data collected from multiple sources—253 employees and their 77 immediate supervisors—support our theory. The significant three-way interaction effect reveals that when social comparison orientation is high and peer abusive supervision is low (Time 1), own abusive supervision (Time 1) creates the strongest negative impact on creative self-efficacy (Time 2), which is significantly related to supervisory low creativity rating (Time 2). Our discoveries of egregious bullying offer provocative theoretical, empirical, and practical implications to the fields of leadership, abusive supervision, creativity, and business ethics. (shrink)

The debate in acknowledging street harassment as an existing social problem renders research necessary on the topic. Street harassment is said to occur when it takes place in a public setting and is initiated by a stranger. Through this correlation research, we aimed to establish the relationship between experiencing street harassment and fear of victimization. A positive correlation between the experience of street harassment and fear of victimization was hypothesized and a positive correlation between street harassment and negative reaction to (...) harassment was also hypothesized. Additionally, the most recurring type of public harassing behaviors was identified as well. Two self report questionnaires were administered; A gender based harassment scale assessing the frequency of 8 harassing behaviors which ranged on a likert scale from 0 to 4 and a modified version of The Fear of Crime survey measuring fear of victimization. These questionnaires were administered to a sample of 250 females recruited via convenient sampling technique that had experienced street harassment previously. Percentages, mode and Pearson’s Product correlation were used to statistically analyze data. Results showed a significant, weak positive correlation between street harassment and fear of victimization and a moderate positive correlation between experiencing street harassment and negative reaction towards harassment. The most frequent harassing behavior was being stared in a manner that made the victims uncomfortable with 98% of participants experiencing it, followed by 83.5% of the participants experiencing non-verbal sounds. Through this research, we were able to conclude street harassment does have negative implications for women. (shrink)

The signature of the peace agreement between FARC guerrillas and the Colombian government has prompted reflection on the role that different sectors of society, including the mainstream media, have played in the perpetuation of the internal conflict. Based on CDA and SFL concepts, this paper contrasts the representation of victims in a 300,000+ word corpus of newspaper reports of violent acts committed by right-wing paramilitaries and Marxist guerrillas between 1998 and 2006, the most violent period of the conflict. The (...) results clearly show not only a significantly higher word count for guerrilla victims’ statements, but also significantly more frequent examples of personalisation such as given names, kinship and emotional language. On the other hand, paramilitary victims are backgrounded by the significantly more frequent use of generic terms. These findings are consistent with previous studies on the topic which identified the systematic concealment of the responsibility of the paramilitaries in serious human right violations. (shrink)
