Dans cet article, nous analysons comment et dans quelle mesure les changements dans les modalités d’allocation des financements publics génèrent des transformations dans les pratiques, les temporalités et l’organisation de la recherche en histoire. Face aux deux thèses qui s’affrontent autour de cette problématique, l’une soutenant l’hypothèse de la déprofessionnalisation et de la perte d’autonomie des chercheurs, et l’autre celle d’une recomposition de la profession académique, le travail d’enquête réalisé dans trois laboratoires d’histoire en France montre qu’il n’y a pas (...) de modèle unique d’adaptation des équipes et des chercheurs par rapport à la montée en puissance des financements sur projet (FSP). La prise en compte du niveau organisationnel, avec ses spécificités contextuelles, se révèle essentielle pour saisir les modalités d’ajustement des laboratoires et des chercheurs face au renforcement des mécanismes de contractualisation. Par ailleurs, contrairement aux disciplines nécessitant des dispositifs expérimentaux coûteux, le niveau plus modeste des ressources mobilisées pour la conduite des recherches en histoire permet plus facilement aux historiens d’adopter une position de repli face aux FSP. Cette posture est également renforcée par le système de reconnaissance de la qualité académique propre au champ historiographique qui accorde une importance particulière au travail individuel et à l’investissement de longue durée. This essay considers the political economic ideology in recent popular cinematic depictions of finance in terms of Immanuel Kant’s aesthetics of the sublime. Think, for instance, of the contingent and risky peaks and valleys of the stock market’s price paths as the jagged mountains that inspire the fear and terror necessary for sublime feeling. I give a sustained reading of how the Kantian sublime operates in Neil Burger’s 2011 film Limitless. By subordinating both the technics of neuro-augmentation and the (...) contingency of the economy to an innate human reason, the protagonist shows audiences what it might mean today to experience sublimity – but not without hinting at a latent anti-Kantian fissure that would reorient us against this bourgeois discourse. This article reveals the outcome of a study on the perceptions of elders, family members, and healthcare professionals and administration providing care in a range of different long-term care facilities in Hong Kong with primary focus on the concepts of autonomy and dignity of elders, quality and location of care, decision making, and financing of long term care. It was found that aging in place and family care were considered the best approaches to long term care insofar as procuring (...) and balancing the values of dignity, autonomy, family integrity and social sustainability were concerned. An elder having the final say was generally accepted. The results also initiated the importance of sharing of financial responsibility among elders, children and government albeit the emphasis was placed on individuals. Furthermore, dignity of elders was not considered purely a synonym of autonomy, but it had also to do with respect, family and social connections. (shrink)

Property rights of personal data have been advocated for some time. From the perspective of economics of law some argued that they could lower transaction costs for contracts involving personal data. This may be the case, but new transaction costs are introduced by propertization and the issue has not been settled. In this paper, I focus on a different and potentially more important aspect. In the actual situation, data collectors externalize costs and internalize benefits. An ownership regime that enables every (...) citizen to hold a personal data account, like a bank account, and that gives people ownership rights over secondary use of personal data could correct these misallocations. I hope to shed new light on the normative implications of the issue by offering normative justifications for property rights of personal data (Sections 2–4). Secondly, I present fundamental goals and building blocks of a property regime of personal data (Section 5) and, thirdly, I illustrate how income from personal data ownership could for instance contribute to financing pensions under proper regulation (Section 6). The various institutional reforms which have led since the end of the 70s to the « privatisation of currency » have formed the main base on which the subsequent power of finance has been built, and, concurently, the dismantling of Welfare could take place. Core of this was the so-called autonomy of central banks, as their « umbilical cord » to national treasuries was severed. From then on, deficit financing and « keynesian » social expenditures became near-impossible. Emphasizing (...) the autonomy of central banks from politics was mostly an institutional mutation meant to free monetary policies from social pressure and make it totally subordinate to rent creation and financial accumulation. No wonder then that « securitisation » of the public debt closely followed on the prohibition to deficit financing social expenditures. And then the outcome was not a reduction, but an explosion of public debt! And as debt servicing becomes a principal item on the budget, the « excessive costs » of welfare provisions is blamed, and a further break-down of social services is called for. It is in the same vein that price inflation is controlled, but assets inflation and speculative bubbles dominate « developped » economies. Meanwhile, in order to compensate for increasing income inequalities and diminishing welfare benefits, an exacerbated form of « private households deficit spending »has come into its own, as witnessed by the subprime crisis and mounting credit card defaults. So we are moving from an entitlements-based provision of social goods to one based on the pure logic of capital and its cycles. The only way out lies in the resocialisation of currency, profound fiscal reforms, the demise of rent-seeking, and the institution of an universal « basic income ». (shrink)

This Chapter studies legislative initiatives around sustainable finance deriving from the Action Plan: Financing Sustainable Growth (also called ‘Sustainable Finance Action Plan’, ‘Action Plan’ henceforth), published by the European Commission (‘Commission’) in 2018 (Communication 2018/97). I evaluate various instruments proposed in the Action Plan, using a reflexive law approach coupled with insights from business ethics and epistemology (De Bruin, 2013, 2015). I point to the challenges such an approach encounters, and offer suggestions how to address them. Reflexive law (...) approaches to legislation (Farber 1994, Hess 1999, Orts 1994, Farmer & Teubner 1994) acknowledge the limits of law as an instrument to realize social or political goals, and stress the need to encourage self-reflection and transparency among stakeholders through procedural rather than ‘command-and-control’ legislation. Typical reflexive law instruments involve disclosure, reporting, and labelling. Examining the Action Plan, I show that the main legislative instruments it puts forward are reflexive. I use empirical and theoretical work that challenges the effectiveness of some of these instruments. Drawing on recent work from behavioural economics I suggest that these problems may be overcome once we integrate more fully in reflexive law what it means for people ‘reflectively’ to recruit evidence and gather knowledge, and once we appreciate the value knowledge has over and above mere belief. My argument here is not so much to the effect that more interventionist regulatory tools are needed (they are dearly needed, but that is not the point here). Rather I argue that once a regulator opts for a reflexive law approach, a richer notion of information should be deployed. I call this ‘epistemic’ instead of ‘reflexive’ law. The Chapter gives some background information about the Action Plan, introduces the core ideas of reflexive law, shows how the Action Plan is reflexive law par excellence, considers the challenges, and offers a few modest suggestions. The main characteristic of the French local tax system undoubtedly resides in a convoluted structure which impedes any progress in the development of tax competition between local authorities. On the contrary, recent legislative evolutions make obvious a trend of recentralization of the French local finance system illustrated by the fact the State is presently the first tax contributor to the local authorities’ budgets. As a result, it becomes blatant that any new competence transfer to the local authorities without setting (...) up an explicit financing scheme for these transfers will put an end to the local authorities’ autonomy.L’ensemble du système fiscal local français est caractérisé par une structure complexe peu propice au développement de la concurrence fiscale entre collectivités locales. Bien au contraire, les évolutions récentes témoignent d’un phénomène de recentralisation des finances locales françaises par lequel l’Etat devient le premier contributeur à la fiscalité des collectivités locales. Au total, il semble évident que tout accroissement de transfert de compétences non accompagné d’une remise à plat du système fiscal local français ne peut conduire à terme qu’à la fin de l’autonomie des collectivités locales. ABSTRACT While Samuel DeCanio is correct to maintain that the state has considerable autonomy due to the public’s vast ignorance of the government’s affairs, he neglects to consider that the public’s ignorance also stems from the deceptions of the politically powerful, who withhold and distort information in a variety of ways. This can take the form of outright lies; anonymous leaks; press and video releases that don’t mention the originating group or its interests; giving reporters access to otherwise inaccessible (...) information, so that they will report favorably on a certain program or event; publicity stunts from groups as far afield as nasa and the Los Angeles Homeless Service Authority; or the financing of periodicals that are sympathetic towards one’s cause. State autonomy induced by public ignorance may thus be generated by the state itself. (shrink)

Green bioethics is an area of research and scholarship that examines the impact of healthcare practices and policies on the environment and emphasises environmental values, such as ecological sustainability and stewardship. Some green bioethicists have argued that healthcare providers should inform patients about the environmental impacts of treatments and advocate for options that minimise adverse impacts. While disclosure of information pertaining to the environmental impacts of treatments could facilitate autonomous decision-making and strengthen the patient–provider relationship in situations where patients have (...) clearly expressed environmental concerns, it may have the opposite effect in other situations if makes patients feel like they are being judged or manipulated. We argue, therefore, that there is not a generalisable duty to disclose environmental impact information to all patients during the consent process. Providers who practice green bioethics should focus on advocating for system-level changes in healthcare financing, organisation and delivery and use discretion when bringing up environmental concerns in their encounters with patients. L’étude du financement des films documentaires par ses deux sources principales (chaînes de télévision et cinéma) permet de mettre au jour les conditions de possibilité de l’autonomie des auteurs/réalisateurs. Elle révèle une opposition entre deux « modèles »: une logique de « flux » dans le circuit audiovisuel (la télévision), et une logique de la « rareté » dans le circuit cinématographique, que viennent compléter de nouvelles formes de soutien financier.

This article documents the results of a study on the perceptions of long-term elder care in Beijing in the People's Republic of China by those most intimately involved. The study asked a sample of elderly, family members, and health care professionals, all of whom are involved in care at a variety of long-term care facilities in Beijing, about their perceptions of the care given at these facilities from their particular standpoints as regards issues such as the quality and ideal location (...) of care, decision-making regarding the care receiving, who should be responsible for the financing of care, and the meaning of dignity for the elderly in these facilities. The results showed adherence to traditional family values at least on one level regarding the ideal location of care being with the family and in the home, but also the desire to pass on financing of long-term care facilities and the health care they provide the elderly on to the government. These results are not altogether surprising, but they also clearly demonstrate the larger conflict between traditional views about morality and economic considerations regarding health care financing in the China. Justifying his proposal for “health savings accounts,” which would allow individuals to set aside tax-free dollars against future healthcare needs, President Bush has said that “Health savings accounts all aim at empowering people to make decisions for themselves.” Who could disagree with such a sentiment? Although bioethicists may be among those who express skepticism that personal health savings accounts will be part of the needed “fix” of our healthcare financing system, self determination has long been part of their mantra. The principles of biomedical ethics – autonomy, non-maleficence, beneficence, and justice – are of paradigmatic importance for framing ethical problems in medicine and for teaching ethics to medical students and professionals. In order to underline this significance, Tom L. Beauchamp and James F. Childress base the principles in the common morality, i.e. they claim that the principles represent basic moral values shared by all persons committed to morality and are thus grounded in human moral psychology. We empirically investigated the (...) relationship of the principles to other moral and non-moral values that provide orientations in medicine. In this nicely written book, Dale Murray critically discusses the moral rights posited by Robert Nozick in Anarchy, State, and Utopia. His focus is on these rights and not on Nozick's arguments about the justness of the state. He argues that Nozick's rights to compensation give rise to rights to government-financed health care and that Nozick should recognize a natural right to enough goods to ensure a reasonable chance of living a decent and meaningful life (if feasible for all). Murray (...) also discusses issues such as the role of invisible hand arguments, moralized conceptions of freedom, and the issue of whether just steps (transactions) preserve the justice of situations. The article emphasizes the importance of the Charter of Local Self-Government to the Lithuanian national legal system. Lithuania has ratified the Charter, not only acknowledged, but also committed to implement its provisions. The Charter consists of 13 items representing the essence of local self-government, which sets the content and is the principal purpose of local public. The principles should be not only a declaratory move into the national legal system, but also recognized as a state’s obligation to follow them. During the study noted that between the executive and local authorities are the differences of interpreting and dysfunctions implemented a few principles of the Charter: subsidiary and decentralization, local government financial autonomy and the freedom of formation executive local bodies. In The Uprising: On Poetry and Finance, Franco ‘Bifo’ Berardi unfolds a political and clinical diagnosis of contemporary society, stating that the crisis we experience today is a permanent state of absent social autonomy and political agency. This crisis is not solely economic but is caused by semio-capitalism impacting all spheres of human life, affecting sensibility in particular—the linguistic and physical-sensuous link between the individual and the world. Taking up the term sensibility as a bodily basis of experience (...) and as an aesthetic notion, in this article I will explore the relation between individual and collective bodies, the crisis as a suspension of change, and literature, focusing on the Danish poet Ursula Andkjær Olsen’s 2017 lunatic and fragmented novel of love and economy The Crisis Notebooks, but also with reference to some of her other work. I argue that the bodily experience of crisis, as expressed in this novel, leads to an inhibited social sensibility but also, paradoxically, to a radical openness towards the world. With reference to the Danish literary scholar Anne Fastrup’s interpretation of French vitalism’s idea of sensibility in The Movement of Sensibility, I suggest that a more ambiguous, material notion of both a constructive and a destructive sensibility is crucial for its understanding, and hence—for an understanding of the relationship between body and crisis as expressed in The Crisis Notebooks. Finally, I suggest that an aesthetic notion of sensibility can provide a prism through which relations between today’s financial mechanisms and a sociocultural experience of crisis are rendered visible—if not sensuous—and it is from here that alternatives to the crisis can be found, felt, formulated or fabulated. Autonomy is conceptualized as the need for agency, self-actualization and independence. Nowadays, financial independence and academic achievement for young populations may be considered as key aspects in the transition to adulthood in response to some contextual demands of different cultural environments. By means of a multi-level model, the present study aims to determine the influence and contribution of factors at individual-level (e.g. sex, age, socioeconomic status, family financial support, awarded scholarships, personal finance, student loans) and school-level (e.g. programme (...) quality, online programs, face to face programs) on the academic achievement of young higher education Colombian students. Data come from the scores of the national standardized academic achievement test administered in 2018 in Colombia. The sample included 234,386 students enrolled in 3,389 higher education institutions in Colombia. After controlling the effects of program quality, and the student's previous academic abilities and socio-economic conditions, results showed that students with scholarships had higher scores than financially-dependent students (those who had students loans) and financially-independent students (those who self-funded their studies or who worked during the week) who had low-scores in the national standardized academic achievement test. What makes political freedom valuable to us? Two well-known arguments are that freedom contributes to our desire satisfaction and to our personal responsibility. Here, Boudewijn de Bruin argues that freedom is valuable when it is accompanied by knowledge. In the last two decades the Israeli educational system has undergone major changes which have transformed it from a state-controlled, overly bureaucratic and almost fully state-financed system into a decentralized, partly locally controlled and increasingly privately financed system. Advocates of this transformation of the educational system appeal to the ideal of parental choice. They argue that the implementation of parental choice programs in education shows more respect to the children and their unique talents, take their self-realization seriously and promotes equal (...) opportunities in education. The ideal of parental choice is also upheld in relation to value of cultural pluralism. Supporters of educational autonomy advocate the restructuring of schools in a way allowing them to develop a unique climate and curriculum consistent with respective communities and parents' preferences. The aim of this paper is to assess critically the changes that Israeli educational system has undergone against the background of the principle of equal educational opportunities. The main claim of the paper is that these changes undermine this principle. It will be argued that these changes actually cater mainly to the educational interests of middle and upper middle classes in Israeli society. (shrink)

Self-regulation refers to the self's ability to control its own thoughts, emotions, and actions. Through self-regulation, we consciously control how much we eat, whether we give in to impulse, task performance, obsessive thoughts, and even the extent to which we allow ourselves recognition of our emotions. Considerations of autonomy and independence, properly understood, support strictly egalitarian provision of necessary medical treatment. If the financially better-off can purchase access to necessary medical treatments that the financially less well-off cannot purchase without help, then their discretionary power to give or to withhold monetary gifts indirectly gives them the power to make life-and-death or sickness-and-health decisions for others. To prevent private citizens from having this objectionable form of power, government must ensure that citizens’ finances do not affect their (...) access to medical treatments that significantly prolong life, relieve suffering, or cure or mitigate disabilities. Government should ensure this even if doing so involves leveling down and even if it is unclear whether egalitarian provision of necessary treatment would provide better care to the poor than a less egalitarian health care system would. The capacity to provide satisfactory nursing care is being increasingly compromised by current trajectories of healthcare funding and governance. The purpose of this paper is to examine how well Marxist theories of the state and its relationship with capital can explain these trajectories in this period of ever‐increasing austerity. Following a brief history of the current crisis, it examines empirically the effects of the crisis, and of the current trajectory of capitalism in general, upon the funding and organization of the (...) UK and US healthcare systems. The deleterious effect of growing income inequalities to the health of the population is also addressed. Marx's writings on the state and its relation to the capitalist class were fragmentary and historically and geographically specific. From them, we can extract three theoretical variants: the instrumentalist theory of the state, where the state has no autonomy from capital; the abdication theory, whereby capital abstains from direct political power and relies on the state to serve its interests; and the class‐balance theory, whereby the struggle between two opposed classes allows the state to assert itself. Discussion of modern Marxist interpretations includes Poulantzas's abdication theory and Miliband's instrumentalist theory. It is concluded that, despite the pluralism of electoral democracies, the bourgeoisie do have an overweening influence upon the state. The bourgeoisie's ownership of the means of production provides the foundation for its influence because the state is obliged to rely on it to manage the supply of goods and services and the creation of wealth. That power is further reinforced by the infiltration of the bourgeoisie into the organs of state. The level of influence has accelerated rapidly over recent decades. One of the consequences of this has been that healthcare systems have become rich pickings for the evermore confident bourgeoisie. (shrink)

The essence of the financial stability of public and communal higher educational establishments in the context of current socioeconomic situation in Ukraine has been determined as a state of the financial resources which enables educational establishments to organize the qualitative educational and scientific activity and form the occupational competitiveness of graduates on the base of complete and timely financing of submitted expenditures. The basis of efficient economical activity (including fulfillment of special-purpose programmes) and qualitative educational services is the reception of (...) plan special-purpose financial recourses. The author has explored that current practice of the assessment of the financial stability of state higher educational establishments doesn’t take into account the main aspects of this process in their interconnection and interdependence. The intellectual model of estimating the financial stability of state higher educational establishments has been developed on the base of fuzzy logic which enables to assess the level of the financial stability of educational establishments via simultaneous application of quantitative (maneuverability equity ratio, autonomy coefficient, funding coefficient, the ratio of correlation conducted expenditures and income received, the ratio of payables and receivables, the ratio of the approved cost estimate of special and general funds, the ratio of cash and actual expenditures) and qualitative (assessment of scientific and educational potential quality, assessment of education quality, evaluation of international recognition, the graduates satisfaction of received education and the opportunity to use it in work, employers perception of quality of education in Ukrainian universities, experts perceptions of the quality of education in Ukrainian universities, cooperation between universities and companies-employers) indexes. Central banks have accumulated unparalleled power over the conduct of macroeconomic policy. Key for this development was the articulation and differentiation of monetary policy as a distinct policy domain. While political economists emphasize the foundational institutional changes that enabled this development, recent performativity-studies focus on central bankers’ invention of expectation management techniques. In line with a few other works, this article aims to bring these two aspects together. The key argument is that, over the last few decades, central banks have (...) identified different strategies to assume authority over “expectational politics” and reinforced dominant institutional forces within them. I introduce a comparative scheme to distinguish two different expectational governance regimes. My own empirical investigation focuses on a monetarist regime that emerged from corporatist contexts, where central banks enjoyed “embedded autonomy” and where commercial banks maintained conservative reserve management routines. I further argue that innovations towards inflation targeting took place in countries with non-existent or disintegrating corporatist structures and where central banks turned to finance to establish a different version of expectation coordination. A widespread adoption of this “financialized” expectational governance has been made possible by broader processes of institutional convergence that were supported by central bankers themselves. Offering a political optic on transnationalism, this article shows how the Partido Acción Nacional from Guanajuato, Mexico, seeks to reconstitute Guanajuatense transnational migrants as clients and funders of state policies, as political subjects with “dual loyalty” but limited political autonomy. To co-opt migrants into development projects designed bythe state but financed bythe migrants, partyelites reconfigure the meanings of “migrant,” “region,” and “citizen.” This is contested by migrant leaders whose views of extraterritorial citizenship, translocal community, and partyloy alty differ from (...) views of the partyelites. In Spain the different Statutes of Autonomy are undergoing substantial revision. That revision is being made with repeated invocations of the federal model, without noticing that it would never permit a process in which the federated pieces did not form a whole with the federal pieces. There must first exist an overall agreement on such fundamental questions as competencies, financing, institutional relations, etc. Lacking such an agreement at the political level, the situation must be corrected at the legal level. In Germany, which has been the great model for Spanish constitutional design, the notion of constitutional loyalty has been a key element, developed, among others, by the Federal Constitutional Court. The Spanish Constitutional Court, however, until now has not gone into the sacramental foundation of the principle, there where it hides its ultimate authority and, therefore, it finds itself detained for the moment at the starting point of a road it has yet to cover. Because loyalty is the hinge of the state, the lubrication that “serves to facilitate movement”, it reconciles the pieces of the decentralised federal system (federal, regional, or whatever you want to call it). Loyalty acts as the backdrop, which is what in the theatre strictly speaking closes the scene, giving sense to the whole set. (shrink)

In the early 1980s, Edward Shils, together with others, undertook the task of defining what he called ‘The Academic Ethic’. It is perhaps best to think of this task in terms defined by Alasdair MacIntyre in many of his writings, in which he observes that the formulation of an ethic typically came at the point where it was no longer a matter of general tacit acceptance but was becoming lost. Shils’s exchanges with his friends and collaborators who commented on the (...) project bear this out: they understood the changes in circumstances that had made the traditional academic ethic obsolete. So did Shils himself. He understood science in terms of what might be called ‘the liberal theory of science’, which treated scientists, and by extension all of academia, as independent agents seeking truth in their own ways, governed by their own sense of what was promising to research, bound together only by a strong tradition of truth-seeking and mutual respect. This, however, required independence of finance – something that the high costs of science rendered prohibitive. The grants system undermined autonomy, and similar issues undermined the autonomy of non-science academics. What is the relevance of traditional academic values today? If the liberal theory of science is dead, what has replaced it? Answering these questions takes us to the heart of problems of the organisation and financing of academic life, the audit culture and the question of truth itself. (shrink)

Background The German Diagnosis-Related Groups (G-DRG) system has led to a revenue-orientated hospital financing system. This article examines the ethical implications and consequences of this system using the example of reconstructive measures (defect care) in patients with oral cavity carcinoma. At the same time, the interplay between the G‑DRG system and guideline development must also be scrutinized. This is preceded by introductory information on oral cavity carcinoma and the existing treatment options: conventional reconstruction techniques versus cost-intensive high-end surgery. Methods The (...) case scenario “treatment of medium-sized defects after tumor resection” forms the methodological basis and argumentative reference point of the study. Results and discussion The G‑DRG system and the economic incentives lead to far-reaching ethical implications concerning the demand-orientated treatment of patients and lead to multidimensional interactions. The existing tendency towards high-end surgery harbors the risk of overuse and misuse and, therefore, runs counter to the principles of beneficence and nonmaleficence. The one-sided indication in favor of high-end surgery also suggests that patient information is given in a directive manner (violation of respect for patient autonomy). Moreover, costly high-end procedures counteract the principle of economic efficiency and, thus, touch on issues of distributive justice. Finally, the clinical favoring of high-end procedures also affects logic within medicine, namely the publication landscape (publication bias), the design of the relevant guidelines, and surgical expertise. In the current era of the Sustainable Development Goals, many countries are attempting to strengthen their health system and achieving Universal Health Coverage. The Korean National Health Insurance system functions as a core element of health financing, contributing to achieving UHC by promoting public health and social security through insurance benefits for prevention, diagnosis, treatment, rehabilitation, childbirth, and health promotion. The Republic of Korea achieved 100% NHI coverage of the target population in 1989, 12 years after the introduction of the (...) social insurance system. However, poor coverage of health services and lack of financial protection are major obstacles to achieving UHC. Therefore, the Korean government announced and implemented ‘Moon Jae-in Care’ in August 2017 to enhance the coverage rate of NHI by 70%. First, this study reviews the existing health insurance system in Korea from the perspective of health financing and UHC. Second, it analyses ‘Moon Jae-in Care’, based on the main framework of UHC. Third, it considers the ethical implications of these developments, with focus on the principles of equity, fairness, autonomy, and solidarity. Although the NHI reform is expected to propel Korean health care closer to UHC, many ethical, social, and political issues remain. (shrink)

The law of december 30, 1975 sanctioned the plan, established by the government to merge the larger part of the Belgian municipalities.From january 1, 1977 on, the number of communes would thereby be reduced from 2,359 to 596. Whereas in 1975 more than 81 % of the communes still counted less than 5,000 inhabitants, this percentage will in the future amount only to 18.6 %.The legislator and the government have primarily considered the strengthening of the municipal governmental capacity as a (...) normal result of the scale effect. Since the mergers would result in a higher number of inhabitants - and necessarily also in larger areas - it was taken for granted that the necessary means would now be available to ameliorate the municipal services. Such a scale-effect can actually be noticed for the following items : the actual municipal services, the number and qualifications of the municipal personnel and the financial strength. Complementary, both legislator and government took a few measures concerning the professional situation of the municipal personnel and concerning the municipal finances. Same of these measures however don't stimulate the normal results of the scale-effect but rather tend to slow these down. Yet, reassuming, one may say that the scale-effect wilt have a positive result in strengthening the municipal governmental capacity. However, the mergers leave quite some questions unanswered concerning several important aspects of municipal governmental capacity - especially regarding the municipal autonomy and competencies, and thedemocratic organisation and functioning. Also, some important points need to be clarified as to the future position of the inter- or supramunicipal cooperation structures, which remain necessary. (shrink)

Artificial Intelligence is supposed to perform tasks autonomously, make competent decisions, and interact socially with people. From a psychological perspective, AI can thus be expected to impact users’ three Basic Psychological Needs, namely autonomy, competence, and relatedness to others. While research highlights the fulfillment of these needs as central to human motivation and well-being, their role in the acceptance of AI applications has hitherto received little consideration. Addressing this research gap, our study examined the influence of BPN Satisfaction on (...) Intention to Use an AI assistant for personal banking. In a 2×2 factorial online experiment, 282 participants watched a video of an AI finance coach with a female or male synthetic voice that exhibited either high or low agency. In combination, these factors resulted either in AI assistants conforming to traditional gender stereotypes or in non-conforming conditions. Although the experimental manipulations had no significant influence on participants’ relatedness and competence satisfaction, a strong effect on autonomy satisfaction was found. As further analyses revealed, this effect was attributable only to male participants, who felt their autonomy need significantly more satisfied by the low-agency female assistant, consistent with stereotypical images of women, than by the high-agency female assistant. A significant indirect effects model showed that the greater autonomy satisfaction that men, unlike women, experienced from the low-agency female assistant led to higher ITU. The findings are discussed in terms of their practical relevance and the risk of reproducing traditional gender stereotypes through technology design. (shrink)

The quality of end-of-life care in this country is often poor. There is abundant literature indicating that dying individuals do not receive adequate pain medication or palliative care, are tethered to machines and tubes in a way that challenges their dignity and autonomy, and are not helped to deal with the emotional grief and psychological angst that may accompany the dying process. While this is true for individuals in many settings, it seems to be especially true for individuals in (...) nursing homes. This is somewhat puzzling given that considerable resources have been devoted to bringing public attention to this problem, we have the knowledge and expertise to provide such care, and we have a government-financed benefit that covers this type of care - the Medicare hospice benefit.While utilization of hospice care has increased during the last decade, there is considerable evidence that hospice care remains underutilized particularly in the long term care setting. Equity is clearly central to Hobbes’s theory of the laws of nature, and it has an important place in his doctrine of the duties and exercise of sovereignty. It is also prominent in his general theory of law, especially as it is articulated in the late Dialogue between a Philosopher and a Student of the Common Laws of England. Still, it is not more central to Hobbes’s ethics, politics and legal philosophy than his concept of justice, or even as central. (...) On the contrary, his theory of justice is presupposed by his views about equity – in the sense that fidelity to a social contract is a condition of adjudication and definitive interpretation of law. Nor does equity contribute to a genuinely anti-authoritarian strand in Hobbes’s political philosophy. It is not as if, between the lines of that philosophy, Hobbes is a liberal. He does not think that the sovereign should exercise self-restraint because liberty and autonomy are good and sovereign self-restraint creates a space for both. Rather, he thinks that heavy-handed rule saps initiative, wealth and other resources from the people, making them less able to participate in or finance military action or internal state security. In other words, heavy-handed rule can make it harder for the sovereign to discharge the principal duty of sovereignty – ensuring public safety. (shrink)

What economic conditions are necessary for us to arrive at a post-work future, and what should a post-work future look like? This chapter argues that only through the democratization of core economic institutions can we properly experiment with post-work imaginaries. I argue, based on principles of participatory autonomy and relational equality, for the democratization of workplaces, finance and investment, and the knowledge commons. Given these necessary structural changes, the possibility of a post-work future becomes a democratic choice by (...) placing democratic decision-making power in the hands of those who are directly affected by workplace decisions, investment decisions, and the collective production of knowledge. Through this democratization process, the potential to reduce working hours, the possibility of building meaningful work, and the chance to decenter work as the mechanism for economic security and meaning-making, all become subject to democratic deliberation and decision-making. Most writing on informed consent in Africa highlights different cultural and social attributes that influence informed consent practices, especially in research settings. This review presents a composite picture of informed consent in Nigeria using empirical studies and legal and regulatory prescriptions, as well as clinical experience. It shows that Nigeria, like most other nations in Africa, is a mixture of sociocultural entities, and, notwithstanding the multitude of factors affecting it, informed consent is evolving along a purely Western model.Empirical studies show (...) that 70–95% of Nigerian patients report giving consent for their surgical treatments. Regulatory prescriptions and adjudicated cases in Nigeria follow the Western model of informed consent. However, adversarial legal proceedings, for a multiplicity of reasons, do not play significant roles in enforcing good medical practice in Nigeria. Gender prejudices are evident, but not a norm. Individual autonomy is recognized even when decisions are made within the family. Consent practices are influenced by the level of education, extended family system, urbanization, religious practices, and health care financing options available. All limitations notwithstanding, consent discussions improved with increasing level of education of the patients, suggesting that improved physician's knowledge and increasing awareness and education of patients can override other influences.Nigerian medical schools should restructure their teaching of medical ethics to improve the knowledge and practices of physicians. More research is needed on the preferences of the Nigerian people regarding informed consent so as to adequately train physicians and positively influence physicians’ behaviors. (shrink)

Various human groups, from food foragers to inner-city urban Americans, have used widespread sharing of resources through kin networks as a means of buffering themselves against fluctuations in resource availability in their environments. This paper addresses the effects of progressive incorporation into a wage-labor economy on the benefits of traditional kin networks for two social classes in urban South India. Predictions regarding the effects of kin network wealth, education, and size on child and spouse characteristics and methods of financing marriages (...) are tested using various regression techniques. Despite the rapid growth of participation in a wage-labor economy, it is found that kin network characteristics still have an important impact on investment behavior among families in Bangalore in both social classes. Network wealth is found to have a positive effect on child and spouse characteristics, and large networks are found to act as significant drains on family resources. However, the results for education are broadly consistent with an interpretation of increasing family autonomy as parents’ education has a far stronger influence on child and spouse characteristics across categories than network education does. Finally, professional-class parents are found to prefer financing marriages using formal mechanisms such as savings and bank loans while working-class parents preferentially finance marriages using credit from relatives and friends. The credit policy of the«Communal Bank» is based on objective criteria in order to respect local autonomy. The financial results of the consolidation are difficult to determine. Several factors could have influenced the present state of municipal finances : the consolidation being done in a period of economic difficulties, the crisis of the public finances, the reform of the Municipal Fund, and the transformation of the Centers for Public Assistance into Public Centers for Social Welf are. With respect to budget balancing, the amalgamated municipalities should do better than the non-amalgamated municipalities. To keep the increase of expenses low in comparison with the revenues, the municipalities had to make cuts in several sectors.As to the current fniancial situation in the three regions, the municipalities of the Brussels regon are in a very painful situation ; in Flanders, the number of municipalities with deficits is higher than in Wallonia, but the deficits in W allonia are bigger. There is currently a public debate in the Netherlands about the desirability about article 23 of the Dutch constitution, on the freedom of education. This freedom has come under attack because it facilitates the foundation of Muslim schools, which are entitled to support from public finances. Critics argue that, as a result of this support, the state officially sponsors the spread of Muslim segregation in Dutch society. Moreover, some liberals are now inclined to openly argue that freedom of education is (...) in contradiction with liberalism itself. This paper attempts ascertain whether freedom of education can be reconciled with liberalism. The structure of the proposed answer to this question is as follows. First, I will interpret the nature of liberalism, exploring two types of liberalism: Locke and Montesquieu. I will argue that these two liberalisms involve fundamentally different commitments: the one to autonomy and bourgeois interest, the other to liberty and civic virtue. Second, the two brands of liberalism are compared in their relation to the Enlightenment, which is a recurring theme in recent public discussions. In this section, I argue that the French Enlightenment, although not liberal in character, owes more to its own interpretation of Locke than to Montesquieu. Third, I relate the two brands of liberalism to the defense and attack of freedom of religion. The argument is that Montesquieu’s liberalism speaks to a defense of freedom of education in a pluralist state of selfgoverning citizens,while Locke’s liberalism endorses its rejection because it contradicts his vision of the bourgeois state, designed to pacify religious conflict and de-politicize cultural identities. In 1997, the Japanese Diet revised the Bank of Japan law thereby granting the central bank greater independence in monetary policy making. The revision was an attempt by Japan's political class to weaken the authority of the powerful Ministry of Finance over the central bank and augment its own influence. The Bank of Japan, however, gained more autonomy than politicians ever intended, leading to frequent confrontations between the government and the central bank over monetary policy. This paper explores (...) the new strategic relationship that emerged between the Bank of Japan and government and the nature of monetary policy implemented in the post-reform period. We demonstrate that several factors contributed to the Bank's unexpected ability to enhance its independence: the astute leadership of the first post-reform governor Hayami Masaru; the Bank's ability to turn politicization of monetary policy to its advantage; and its pursuit of a strategy achieved by augmenting its own research capacity. On a theoretical level, our findings show that the passage of a new legal framework only marks the completion of one stage of institutional change and the start of the next; post-enactment politics have as much importance as pre-enactment politics in shaping outcomes. In the post-enactment phase, various factors, including the state of the economy and informal institutions or processes, matter greatly and may shift the direction of institutional change away from the intended path. The concept of Islamic economics as a coherent economic and financial system basically does not exist. Some authors take it, however, for simplicity, under-standing by this description any entities and legal regulations, mainly in the financial markets, driven – either declaratively or in fact – on the principles derived from religious precepts of Islam. The emphasis is put on so-called inter-est-free banking, which involves the concept of usury (riba). By referring to the essence of Islamic economics, the author shows the (...) dif-ferences and similarities between "interest-free" Islamic banking and conven-tional banking (Western-style). It turns out that the differences are almost exclu-sively at the level of declarations and similarities that arise from attempts to circumvent religious regulations, as in the riba, are much more numerous than it might seem. They result from the need to fuse Islamic finances with global fi-nancial markets, which at least at the point of contact eliminates the capability of maintaining the autonomy of the local banking system. In addition, interest-free Islamic banking development meets an obstacle in the shape of the market pres-ence of conventional banks, which are its natural ideological competition. Thus, although the Islamic Development Bank estimates the size of the market of the Islamic system of financial services in 2015 at between 2 to 8 trillion dollars, one seems to be entitled to conclude that, in practice, between Islamic economics and capitalist economies of the West, at least in terms of banking services, the dif-ferences are purely semantic, and both Western and Islamic deposit, credit and investment products are in fact identical. Does AI conform to humans, or will we conform to AI? An ethical evaluation of AI-intensive companies will allow investors to knowledgeably participate in the decision. The evaluation is built from nine performance indicators that can be analyzed and scored to reflect a technology’s human-centering. When summed, the scores convert into objective investment guidance. The strategy of incorporating ethics into financial decisions will be recognizable to participants in environmental, social, and governance investing, however, this paper argues that conventional ESG frameworks (...) are inadequate for AI-intensive companies. To fully account for contemporary technology, the following categories of evaluation will be developed and featured as vital investing criteria: autonomy, dignity, privacy, performance. With these priorities established, the larger goal is a model for humanitarian investing in AI-intensive companies that is intellectually robust, manageable for analysts, useful for portfolio managers, and credible for investors. In the course of the eighteenth and nineteenth centuries the paradigm of a new science, political economy, was established. It was a science distinct from the Aristotelian sub-disciplines of practical philosophy named oikonomía and politiké, and emphasis on its character of science not unlike the natural sciences – still called ‘natural philosophy’ – mirrored precisely a willingness to stress its autonomy from two other sub-disciplines of practical philosophy, that is, ethics and politics. However, the new science resulted from a (...) transformation of part of traditional practical philosophy, allowing the inclusion of bodies of knowledge accumulated by experts of commerce and public finance. Such bodies of knowledge were unified by the (true or alleged) discovery of regularities, mechanisms, causal connections making for a new partial order within the overall social order. How far this paved the way to a science similar to mathematics rather left a normative discipline as alive as ever was a recurrent question for at least a century, until the marginalist revolution opened the way for a sharp division, leaving ‘economics’ as a science of causes and effects facing ‘economic policy’ as a discourse on ends.
