Both theology and jurisprudence deal with the exegesis of texts. Textual exegesis respectively textual interpretation aims at giving an explanation of the meaning of the text itself but also refers to wider social contexts. Since theology and jurisprudence share this objective, this article wants to line out the method of theological exegesis on the one side and legal exegesis on the other side.Both sciences are closely related to basic conditions of social life. Yet, biblical texts are ,,holy“ and immune (...) to textual changes. Legal codifications however are - in general - open to change. Nevertheless, there exist certain codifications, namely constitutions or articles of a constitution, that are seen as expressions of quasi-religious faith. (shrink)

The article is devoted to the historical analysis of teleological argumentation evolution in the legal interpretation. The ideas of ancient Greek and Roman orators, philosophers and lawyers, which served as the basis for development of the idea of teleological interpretation in the European legal tradition, are examined. The history of teleological interpretation method development in European legal theory from Medieval jurists to sociological legal approach of the late 19 th and 20 th centuries is observed, as well (...) the existence of two main approaches in understanding the teleological method of interpretation, namely subjective-teleological and objective-teleological, is ascertained. The author states that there is a direct correlation between the concept of law and the approach to understanding of the teleological interpretation method. Christian Hiebaum untersucht die politische Dimension der juristischen Argumentation. Er zeigt, wie sich zwei weit verbreitete Überzeugungen, die einander zu widersprechen scheinen, doch vereinbaren lassen: die Überzeugung, dass Rechtsanwendung ein politisches Unternehmen ist, und die Überzeugung, dass Rechtsanwender notwendig wahrheitsorientiert verfahren. Dies erfordert eine gründliche Auseinandersetzung mit der Interpretation von Rechtsnormen einerseits und mit dem Begriff des Gemeinwohls und seiner Rolle im Rechtsdiskurs andererseits. Insgesamt ist die Analyse als Dekonstruktion der Dworkin'schen Unterscheidung zwischen Prinzipien- und Policy-Argumenten angelegt.

The aim of this paper is to study interpretation, specifically, to work toward an account of interpretation that seems descriptively and explanatorily correct. No account of interpretation can be philosophically helpful, I submit, if it is incompatible with a correct account of what people actually do when they interpret others. My question, then, is: how does the (naive) interpreter arrive at his/her judgments about the mental attitudes of others? Philosophers who have addressed this question have not, in (...) my view, been sufficiently psychological, or cognitivist, even those who are otherwise psychologically inclined. We show that monadic intuitionistic quantifiers admit the following temporal interpretation: “always in the future” (for$\forall $) and “sometime in the past” (for$\exists $). It is well known that Prior’s intuitionistic modal logic${\sf MIPC}$axiomatizes the monadic fragment of the intuitionistic predicate logic, and that${\sf MIPC}$is translated fully and faithfully into the monadic fragment${\sf MS4}$of the predicate${\sf S4}$via the Gödel translation. To realize the temporal interpretation mentioned above, we introduce a new tense extension${\sf TS4}$of${\sf S4}$and provide a full and (...) faithful translation of${\sf MIPC}$into${\sf TS4}$. We compare this new translation of${\sf MIPC}$with the Gödel translation by showing that both${\sf TS4}$and${\sf MS4}$can be translated fully and faithfully into a tense extension of${\sf MS4}$, which we denote by${\sf MS4.t}$. This is done by utilizing the relational semantics for these logics. As a result, we arrive at the diagram of full and faithful translations shown in Figure 1 which is commutative up to logical equivalence. We prove the finite model property (fmp) for${\sf MS4.t}$using algebraic semantics, and show that the fmp for the other logics involved can be derived as a consequence of the fullness and faithfulness of the translations considered. This paper presents a formal account of how to determine the discourse relations between propositions introduced in a text, and the relations between the events they describe. The distinct natural interpretations of texts with similar syntax are explained in terms of defeasible rules. These characterise the effects of causal knowledge and knowledge of language use on interpretation. Patterns of defeasible entailment that are supported by the logic in which the theory is expressed are shown to underly temporal interpretation.

This paper shows how reasoning from best explanation combines with linguistic and factual presumptions during the process of retrieving a speaker’s intention. It is shown how differences between presumptions need to be used to pick the best explanation of a pragmatic manifestation of a dialogical intention. This study attempts to describe the notion of the ‘self’ using dynamical systems language based on the results of our robot learning experiments. A neural network model consisting of multiple modules is proposed, in which the interactive dynamics between the bottom-up perception and the top-down prediction are investigated. Our experiments with a real mobile robot showed that the incremental learning of the robot switches spontaneously between steady and unsteady phases. In the steady phase, the top-down prediction for the bottom-up perception (...) works well when coherence is achieved between the internal and the environmental dynamics. In the unsteady phase, conflicts arise between the bottom-up perception and the top-down prediction; the coherence is lost, and a chaotic attractor is observed in the internal neural dynamics. By investigating possible analogies between this result and the phenomenological literature on the ‘self', we draw the conclusions that the structure of the ‘self’ corresponds to the ‘open dynamic structure’ which is characterized by co-existence of stability in terms of goal-directedness and instability caused by embodiment; the open dynamic structure causes the system's spontaneous transition to the unsteady phase where the ‘self’ becomes aware. I argue that quantum decoherence—understood as a dynamical process entailed by the standard formalism alone—carries us beyond conceptual aspects of non-relativistic quantum mechanics deemed insurmountable by many contributors to the recent quantum gravity and cosmology literature. These aspects include various incarnations of the measurement problem and of the quantum -to-classical puzzle. Not only can such problems be largely bypassed or dissolved without default to a particular interpretation, but theoretical work in relativistic arenas stands to gain substantial physical and philosophical (...) insight by incorporating decoherence phenomena. This article deals with Kurt Wolff’s interpretation of Karl Mannheim, with reference to his writings on social planning. Wolff’s interpretation is presented and discussed in the context provided by other interpreters of Mannheim. They have, generally speaking, given scant attention to the late works by Mannheim, and rather focused on Ideology and Utopia, Mannheim’s most celebrated work. Interpreters who have considered these writings on planning have been mostly or entirely critical of them, objecting to their vagueness and inadequacy (...) as a project of social reform, and the unsatisfactory conceptualization of the élites. These objections have been raised by several interpreters of different ideological persuasions, from the Marxist thinkers Adorno and Lukacs to the conservative T.S. Eliot. Wolff’s interpretation stands out in that it pays less attention to the social and political contents of Mannheim’s reform project, but brings into light its psychological background; namely, the deep anguish Mannheim experienced because of the widespread tendencies to the formation of a mass society, prone to the forces of irrationalism and authoritarianism. A perusal of Mannheim’s works on planning bears out Wolff’s interpretation. (shrink)

The subject of this study are the argumentation strategies applied by the Polish and German apex courts competent in criminal matters, namely the Supreme Court and the Federal Court of Justice, respectively. The investigation encompasses a total of 200 rulings issued by the criminal panels of these bodies. Particular focus was put on examining which arguments both courts apply to solve interpretation problems, and secondly, how these courts systematize the interpretation process. Methodologically, the examination utilizes, inter alia, the (...) principles of qualitative research, without neglecting the legal dogmatic perspective. A crucial theoretical foundation underlying this study is the distinction between formalistic and substantive legal cultures. The examination reveals that neither the Polish nor the German legal culture is purely formalistic or value-oriented. Nevertheless, the Supreme Court of Poland shows greater affinity for formalistic arguments, whereas the substantive interpretation methods are more widespread in the judicature of the German Federal Court of Justice. In particular, the Polish Court prefers the linguistic interpretation, whereas the German Court favours the purposive approach. (shrink)

Quantum Mechanics can be viewed as a linear dynamical theory having a familiar mathematical framework but a mysterious probabilistic interpretation, or as a probabilistic theory having a familiar interpretation but a mysterious formal framework. These points of view are usually taken to be somewhat in tension with one another. The first has generated a vast literature aiming at a “realistic” and “collapse-free” interpretation of quantum mechanics that will account for its statistical predictions. The second has generated an (...) at least equally large literature aiming to derive, or at any rate motivate, the formal structure of quantum theory in probabilistically intelligible terms. In this paper I explore, in a preliminary way, the possibility that these two programmes have something to offer one another. In particular, I show that a version of the measurement problem occurs in essentially any non-classical probabilistic theory, and ask to what extent various interpretations of quantum mechanics continue to make sense in such a general setting. I make a start on answering this question in the case of a rudimentary version of the Everett interpretation. (shrink)

According to the Principle of Charity, we ought to interpret each other charitably. That is, we ought to adopt the interpretation that shows the interpreted person in the best light. The Principle of Charity is motivated by appealing to a harm asymmetry: it is worse (the thought goes) to mistakenly criticize someone than to fail to rightfully criticize them. This chapter argues that in oppressive contexts, charity is not enough. First, the Principle of Charity is myopic. Charitable interpretation (...) only considers harm to the person being interpreted and ignores third party harms. Second, under conditions of oppression, our conceptual resources and evidential standards will be systematically biased against marginalized perspectives. So charitable interpretations will overlook harm to marginalized persons. Finally, the chapter give a diagnosis of the Principle of Charity: It misunderstands the interpersonal interpretive aim. The interpersonal interpretive aim is to interpret one another in a way that accurately captures the normative features that are crucial to our interpersonal relationships. What we need is not a Principle of Charity, but an Aim of Justice. The chapter’s conclusion explains what an Aim of Justice would require of us, notably, empathetic engagement and intellectual humility. (shrink)

This chapter’s main topic revolves around Davidson’s account of radical interpretation and the concept of triangulation as a necessary feature of communication and the formation of beliefs. There are two important implications of this model of belief formation for feminists studying the effects of social location on knowledge production generally, and the production of scientific knowledge in particular.
