Fundamental questions in value sensitive design include whether and how high-tech products/artefacts could embody values and ethical ideals, and how plural and incommensurable values of ethical and social importance could be chosen rationally and objectively at a collective level. By using a humanitarian cargo drone study as a starting point, this paper tackles the challenges that VSD’s lack of commitment to a specific ethical theory generates in practical applications. Besides, it highlights how mainstream ethical approaches usually related to VSD (...) are incapable of solving main ethical dilemmas raised by technological design for well-being in democratic settings. Accordingly, it is argued that VSD’s ethical-democratic import would substantially be enhanced by the espousal of a procedural ethics stance and the deliberative approach to value and welfare entailed by Amartya Sen’s capability approach. Differently from rival ethical–political theories, its normative and meta-ethical foundations better handle human diversity, value-goal pluralism, conflicting vested interests as well as the epistemic-moral disagreements typical of contemporary complex democracies. Particularly, Sen’s capability approach procedural-deliberative tenets result in an “objective-impartial” choice procedure selecting a “hierarchy” of plural incommensurable values and rational goals thus, suitable to validate an applied science such as welfare-oriented technological design in concrete social environments. Conclusions suggest that refining VSD with a capability-based procedural approach to ethics fosters the concern for democracy and social justice while preserving vital scientific-technical standards. Major advantages are at an applied level to delivering ethically and socially justified, but yet highly functional technologies and high-tech products/artefacts. (shrink)

In this book the practical dimension of social justice is explained using the analysis and discussion of a variety of well-known topics. These include: the relation between theory and practice in normative political philosophy; the issue of justice under uncertainty; the question of whether we can and should unmask social injustices by means of conspiracy theories; the issues of privacy and the right to privacy; the issue of how certain psychological states may affect our moral obligations, in particular the obligation (...) to treat others fairly; and finally the concepts of morality, fairness, and self-deception. The primary goal of the book is to provide readers with an updated discussion of some important and practical social justice issues. These issues are presented from a new perspective, based on the author ́s research. It is hoped that bringing these topics together in a single book will promote the emergence of new insights and challenges for future research. The symbolism introduced earlier provides a convenient vehicle for examining the status and consistency of Aristotle's three diverse justifications and for explaining how he means to avoid Protagorean relativism without embracing Platonic absolutism. When the variables ‘ x ’ and ‘ y ’ are allowed to range over the groups of free men in a given polis as well as over individual free men, the formula for the Aristotelian conception of justice expresses the major premiss of Aristotle's three justifications: (1) (...) These justifications are compatible with each other since they apply to different situations. The polises where democracy and true aristocracy are justified contain no godlike men, and the polis in which democracy is justified differs from that in which true aristocracy is justified in containing a large group of free men who individually have little virtue ( Pol. III.11.1281b23-25, 1282a25-26). Each of the justifications is a valid deductive argument. Aristotle affirms the major premiss they share on the basis of a twofold appeal to nature. The principle of distributive justice, the concept as distinguished from the various conceptions of distributive justice, is itself according to nature ( Pol. VII.3.1325b7-10) and so too is one particular standard of worth, the standard of the best polis. Consequently, the question of the status of these three justifications, whether they are purely hypothetical or not, is a question about the minor premiss or premisses of each. In the case of the democratic premiss Aristotle's answer is straightforward: it is sometimes but not always true ( Pol. III.11.1281bl5-21). Hence the justification of democracy is not purely hypothetical. Nor is the justification of absolute kingship. The man who is “like a god among men” ( Pol. III.13.1284a10-11) would be a man of heroic virtue (see VII.14.1332bl6-27); and such a man, Aristotle says, is “rare” ( σπávιoη ) (not nonexistent) ( E.N. VII.1.1145a27-28). The minor premisses of the aristocratic argument describe a situation where all of the free men in a given polis have sufficient wealth for the exercise of the moral and intellectual virtues and where all of the older free men of the polis are men of practical wisdom. In the Politics Aristotle makes only the modest claim that such a situation is possible: It is not possible for the best constitution to come into being without appropriate equipment [that is, the appropriate quality and quantity of territory and of citizens and noncitizens]. Hence one must presuppose many things as one would wish them to be, though none of them must be impossible ( Pol. VII.4.1325b37-38; see also II.6.1265al7-18). But Aristotle appears to subscribe to the principle that every possibility is realized at some moment of time ( Top. 11.11.115bl7-18, Met. Θ.4.1047b3-6, N.2.1088b23-25). This principle together with the claim that the situation described is possible entails that the situation sometimes occurs. Thus even Aristotle's justification of true aristocracy is not purely hypothetical. The final question is Aristotle's way of avoiding Protagorean relativism without embracing Platonic absolutism. The relativist, along with everyone else ( E.N. V.3.1131a13-14, Pol. III.12.1282bl8), can accept the principle of distributive justice: Q(x)/Q(y) = V(T(x))/V(T(y)) And he can concede that particular instances of this principle, particular conceptions of justice, accurately describe the modes of distributing political authority that appear just to particular polises and to particular philosophers. What he denies is that there is any basis for ranking these various conceptions of justice or for singling one out as the best (Plato, Theaet. 172A-B). Aristotle, following in Plato's track ( Laws X.888D7-890D8), maintains against the relativist that nature provides such a basis. But he departs from Plato in his conception of nature. For Plato “the just by nature” ( τó ρυσει δίκ↑oν }) ( Rep. VI.501B2) is the Form of justice, an incorporeal entity ( Phdo. 65D4-5, Soph. 246B8) that exists beyond time and space ( Tim. 37C6-38C3, 51E6-52B2), whereas for Aristotle the sensible world is the realm of nature ( Met. A.1.1069a30-b2). Thus in appealing to nature Aristotle does not appeal to a transcendent standard. Nor does he appeal to his main criterion of the natural, namely, happening always or for the most part. Aristotle's theory of justice is anchored to nature by means of the polis described in Politics VII and VIII, and he regards this polis as natural because it fosters the true end of human life and because its social and political structure reflects the natural hierarchy of human beings and the natural stages of life. Thus the nature that Aristotle's theory of justice is ultimately founded on is human nature. (shrink)

Applied analytical political philosophy has not been a thriving enterprise in the United States in recent years. Certainly it has made little discernible impact on public culture. Political philosophers absorb topics and ideas from the Zeitgeist, but it shows little inclination to return the favor. After the publication of his monumental work A Theory of Justice back in 1971, John Rawls became a deservedly famous intellectual, but who has ever heard political critics or commentators refer to the difference principle or (...) fair equality of opportunity in discussions aimed at a wide audience? Writing philosophically astute and beautifully accessible prose, often in not strictly academic journals of opinion, Ronald Dworkin has been in some ways the very model of a public intellectual, but the only reference to his opinions that I have seen in any newspaper occurred in a New York Times review of a restaurant near London along the Thames (as I recall, Dworkin was quoted as saying it was at the very least the best restaurant in the northern hemisphere). You might chalk up the situation to the fact that political philosophers tend to be liberal and the public political culture in the United States has been growing decidedly conservative, but that mismatch can hardly be the whole story. Right-wing libertarianism is a popular doctrine, but Robert Nozick’s classical and never superseded 1974 exploration of that view in his brilliant Anarchy, State, and Utopia is not cited. Nor is there a significant literature that seeks to derive practical policy recommendations from Nozick’s theory and relevant factual claims. Moreover, the isolation of political philosophy stands in marked contrast to the wide influence of theory in some disciplines. For example, consider the enormous germinating impact of Richard Posner’s ideas on law and economics over the past thirty years on academic and extra-academic American legal culture. (shrink)

This book challenges the dominant approach to problems of justice in global normative theory and offers a radical alternative designed to transform our thinking about what kind of problem injustice is and how political theorists might do better in understanding and addressing it. It argues that the dominant approach, ideal moral theory (IMT), takes a fundamentally wrong-headed approach to the problem of justice. IMT seeks to work out what an ideally just society would look like, and only then outlines our (...) moral obligations in realizing that ideal. In other words, it ignores the realities of everyday politics. As Michael Goodhart asserts, IMT postpones engagement with actually existing injustices and distorts our understanding of them, and it normalizes many problematic features of our world. On the other hand, the leading alternatives to IMT struggle to make sense of the role values play in politics. This book sees justice as an ideology and develops an innovative bifocal theoretical framework for making sense of it. This framework provides two complementary perspectives on justice: a theoretical perspective that situates competing ideological claims about justice in a broader political context and a partisan perspective that evaluates the structure and coherence of particular conceptions of justice. As opposed to IMT, it focuses on barriers to justice and advocates an activist political theory that takes sides in political struggles against injustice. Goodhart argues that theorists can help to generate the countervailing power necessary for social transformation through the work of articulation, translation, and mapping, work which contributes to a more comprehensive social science of injustice. Conceptual engineering is the design, evaluation and implementation of concepts. Despite its popularity, some have argued that the methodology is not worthwhile, because the implementation of new concepts is both inscrutable and beyond our control. In the recent literature we see different responses to this worry. Some have argued that it is for political reasons just as well that implementation is such a difficult task, while others have challenged the metasemantic and social assumptions that underlie this skepticism about implementation. (...) In this paper, I argue that even if implementation is as difficult as critics maintain, there is at least one context in which conceptual engineering is extremely impactful and demonstrably so: the design of new technology. Different conceptions of control, freedom, trust, etc. lead to different designs and implementations of systems that are built to embed those concepts. This means that if we want to design for control, freedom, trust, etc., we have to decide which conception we ought to use. When we determine what the appropriate conception of a concept is in a technological context and use this conception to operationalize a norm or value, we generate requirements which have real-world effects. This not only shows that conceptual engineering can be extremely impactful, the fact that it leads to different design requirements means that we have a way to evaluate our conceptual choices and that we can use this feedback loop to improve upon our conceptual work By illustrating the direct impacts of different conceptions on technology design, this paper underscores the practical applicability and value of conceptual engineering, demonstrating how it serves as a crucial bridge between abstract philosophical analysis and concrete technological innovation. We created Justice: The Game, an educational, role-immersion game designed to be used in philosophy courses. We seek to describe Justice in sufficent detail so that it is understandable to readers not already familiar with role-immersion pedagogy. We hope some instructors will be sufficiently interested in using the game. In addition to describing the game we also evaluate it, thereby highlighting the pedagogical potential of role-immersion games designed to teach political philosophy. We analyze the game by drawing on our observations (...) as designers and playtesters of Justice, along with feedback from students obtained in focus-groups conducted shortly after playtesting ended. We present evidence that Justice, compared to conventional instructional methods alone, plausibly enhances student learning of philosophical skills and content by requiring them to practice those skills and put their content-area knowledge to use in a highly-motivating and engaging context. The ongoing debate on the ethics of self-driving cars typically focuses on two approaches to answering such questions: moral philosophy and social science. I argue that these two approaches are both lacking. We should neither deduce answers from individual moral theories nor should we expect social science to give us complete answers. To supplement these approaches, we should turn to political philosophy. The issues we face are collective decisions that we make together rather than individual decisions we make in (...) light of what we each have reason to value. Political philosophy adds three basic concerns to our conceptual toolkit: reasonable pluralism, human agency, and legitimacy. These three concerns have so far been largely overlooked in the debate on the ethics of self-driving cars. (shrink)

PurposeAs interest in technology ethics is increasing, so is the interest in bringing schools of ethics from non-Western philosophical traditions to the field, particularly when it comes to information and communication technology. In light of this development and recent publications that result from it, this paper aims to present responds critically to recent work on Confucian virtue ethics (CVE) and technology.Design/methodology/approachFour critiques are presented as theoretical challenges to CVE in technology, claiming that (...) current literature insufficiently addresses: overall applicability, collective ethics issues, epistemic overconfidence within technology corporations and amplification of epistemic overconfidence by the implementation of CVE. These challenges make use of general CVE literature and work on technology critique, political philosophy, epistemology and business ethics.FindingsImplementing CVE in technology may yield some benefits, but these may be outweighed by other outcomes, include strengthening hierarchies, widening inequities, increasing, rather than limiting, predictive activity, personal data collection, misinformation, privacy violations and challenges to the democratic process.Originality/valueThough not directly advocating against CVE, the paper reveals hitherto unidentified and serious issues that should be addressed before CVE are used to inform ethics guidelines or regulatory policies. It also serves as a foundation for further inquiry into how Eastern philosophy more broadly can inform technology ethics in the West. (shrink)

Safe-by-Design (SBD) frameworks for the development of emerging technologies have become an ever more popular means by which scholars argue that transformative emerging technologies can safely incorporate human values. One such popular SBD methodology is called Value Sensitive Design (VSD). A central tenet of this design methodology is to investigate stakeholder values and design those values into technologies during early stage research and development (R&D). To accomplish this, the VSD framework mandates that designers consult the philosophical (...) and ethical literature to best determine how to weigh moral trade-offs. However, the VSD framework also concedes the universalism of moral values, particularly the values of freedom, autonomy, equality trust and privacy justice. This paper argues that the VSD methodology, particularly applied to nano-bio-info-cogno (NBIC) technologies, has an insufficient grounding for the determination of moral values. As such, an exploration of the value-investigations of VSD are deconstructed to illustrate both its strengths and weaknesses. This paper also provides possible modalities for the strengthening of the VSD methodology, particularly through the application of moral imagination and how moral imagination exceed the boundaries of moral intuitions in the development of novel technologies. How can we achieve and sustain a "decent" liberal society, one that aspires to justice and equal opportunity for all and inspires individuals to sacrifice for the common good? In this book, a continuation of her explorations of emotions and the nature of social justice, Martha Nussbaum makes the case for love. Amid the fears, resentments, and competitive concerns that are endemic even to good societies, public emotions rooted in love—in intense attachments to things outside our control—can foster commitment to (...) shared goals and keep at bay the forces of disgust and envy. Great democratic leaders, including Abraham Lincoln, Mohandas Gandhi, and Martin Luther King Jr., have understood the importance of cultivating emotions. But people attached to liberalism sometimes assume that a theory of public sentiments would run afoul of commitments to freedom and autonomy. Calling into question this perspective, Nussbaum investigates historical proposals for a public "civil religion" or "religion of humanity" by Jean-Jacques Rousseau, Auguste Comte, John Stuart Mill, and Rabindranath Tagore. She offers an account of how a decent society can use resources inherent in human psychology, while limiting the damage done by the darker side of our personalities. And finally she explores the cultivation of emotions that support justice in examples drawn from literature, song, political rhetoric, festivals, memorials, and even the design of public parks. Most theories of justice rest on the idea that emotions need to be contained or set aside and that rationality serves as the best, if not exclusive, criterion for identifying the principles of a fair distribution. In recent years, however, two important claims have been made. One is that rationality and emotions are not in conflict with one another, but should be conceived of as strictly interconnected; the other is that social justice is not just about distribution, but also – (...) or especially – about social relations. This paper aims to bridge these claims and argues that (a) the role of emotions should be recognised by theories of justice, as it is compatible with the importance such theories attribute to rationality, and (b) an inquiry into emotions is particularly important to investigate the socio-relational dimension of justice. Moreover, the paper claims that (c) in order to adequately investigate the role of emotions in social justice, it is important to acknowledge that emotions are structurally mediated and shaped by powerful transformative forces, among which technologies – especially so-called socially disruptive technologies (SDTs) – prove to be particularly relevant. This paper addresses an important multi-disciplinary issue of current interest, that is, the implications of technological design for fairness. A visual, graphical methodology centered on the Taylor-Russell diagram is proposed to address this issue. The Taylor-Russell diagram helps to identify and explore ways in which predictions built into designs can pit the interests of different constituencies against one another. The configuration of the design represents a trade-off between the interests of the communities involved. Whether or not the trade-off (...) is appropriate constitutes a problem of fairness or distributive justice. The breadth of this methodology is supported by a diversity of examples analyzed. These include a surveillance system, an automotive safety system, a civic information system, and the international food distribution system. These examples provide models for application of the methodology to the analysis of designs in further areas of concern. Limitations of the methodology are also discussed. While it helps to identify and clarify issues of fairness in technology design, the methodology does not provide a general theory of fairness, nor can it provide fair solutions to such issues without appeal to further principles or concepts. A leading international expert on environmental issues, Shrader-Frechette brings a new standard of rigor to philosophical discussions of environmental justice in her latest work. Observing that environmental activists often value environmental concerns over basic human rights, she points out the importance of recognising that minority groups and the poor in general are frequently the biggest victims of environmental degradation, a phenomenon with serious social and political implications that the environmental movement has failed to adequately address. She argues for their equal (...) rights to 'environmental justice' and maintains that they should not have to bear most of the weight of the burdens of pollution and resource depletion. Advocating a greater awareness on the part of professionals in a position to help these victims, Shrader-Frechette proposes a more equitable distribution of environmental resources and, in doing so, makes an important contribution to the fields of environmental ethics and applied philosophy. In the center of the fifth book of the Nicomachean Ethics, Aristotle elliptically characterizes political justice as a form of reciprocal rule that exists between free and equal persons pursuing a common life directed toward self-sufficiency under the rule of law. My dissertation analyzes Aristotle's thematic treatments of political justice in the Nicomachean Ethics and Politics in order to elucidate its meaning, clarify its relationship to the other forms of justice that he also discusses, and compare it (...) to contemporary neo-Aristotelian accounts of justice. ;The first chapter examines the unclear and disputed passages of Ethics V.6--7 and explains why Aristotle discusses political justice in his ethical treatise. The second chapter makes use of Aristotle's juxtaposition of political justice to household justice on the one hand and despotic justice on the other hand in order to explicate the necessary conditions of political justice, namely, freedom, equality, commonality, self-sufficiency, and the rule of law. To make sense of these concepts, the chapter explores such topics as Aristotle's understanding of the household, his notion of the self and his political criticisms of Socrates. The third chapter examines political justice or reciprocal rule in the Politics in order to understand how political justice can be both a human virtue and an institutional arrangement of offices. The fourth chapter offers a critique of Fred Miller's reconstruction of Aristotelian natural rights. Although Miller is correct to say that Aristotle recognized and understood "rights claims," he is mistaken in claiming that they are an integral part of Aristotle's practical philosophy. Aristotle understood the problems for political compromise posed by rights conceived as "trumps," and he rejects rights as philosophically fundamental on the grounds that they are an inadequate solution to both the political problem of justice and the stability of flourishing political institutions. The integration of ethical analysis in Health Technology Assessment (HTA) has proven difficult to implement even though it is explicitly recognized as an important component of such assessments in HTA literature. When compared to the standardized scientific method for systematic reviews in HTA, the diversity of ethical analysis has been characterized as a fundamental barrier to the integration of ethics. The present paper aims to identify the theoretical and practical differences between the approaches underpinning ethical analysis in HTA (...) and clarify the reasons for such diversity. Our systematic review of HTA literature pertaining to the barriers to the integration of ethics in HTA identified nine ethical approaches: Principlism, Casuistry, Coherence Analysis, Wide Reflective Equilibrium, Axiology, the Socratic approach, the Triangular model, Constructive Technology Assessment and Social Shaping of Technology. Citations pertaining to each approach were extracted and categorized according to three constitutive components of ethical argumentation established in a previous research evaluating nanotechnologies: i) the disciplinary foundation that grounds the validity of the ethical evaluation, ii) the characteristics of such evaluation, iii) the operational process involved in applying it to a particular case (i.e., its practical reasoning). This comparison shows that, 1) the difference between these approaches rests primarily on their disciplinary foundation (rooted in philosophy, philosophy/theology, or sociology), 2) their complexity can be observed in the distinct characteristics of ethical evaluation deriving from their differing disciplinary foundation, and 3) although four different types of operationalization procedure were identified, little information was available in regards to the practical reasoning associated with these approaches. Christian ethics is rooted in Christian worship, community, and identity, yet must cooperate across traditions to alleviate global injustices that violate love of God and neighbor. Although practical ethical commitment may be contingent on an experience of ultimacy that is ‘outside ethics’, this experience is not limited to confessing Christians.

The purpose of this paper is to explore the epistemological tensions embedded within big data and data-driven technologies to advance a socio-political reconsideration of the public dimension in the assessment of their implementation.,This paper builds upon (and revisits) the European Union’s (EU) normative understanding of artificial intelligence (AI) and data-driven technologies, blending reflections rooted in philosophy of technology with issues of democratic participation in tech-related matters.,This paper proposes the conceptual design of sectorial and/or local-level e-participation platforms to ignite (...) an ongoing discussion – involving experts, private actors, as well as cognizant citizens – over the implementation of data-driven technologies, to avoid siloed, tech-solutionist decisions.,This paper inscribes the EU’s normative approach to AI and data-driven technologies, as well as critical work on the governance of these technologies, into a broader political dimension, suggesting a way to democratically and epistocratically opening up the decisional processes over the development and implementation of these technologies and turn such processes into a systemic civic involvement. In the debate over Spanish treatment of the natives of the New World, both sides regularly invoked Aristotle on natural slaves. This paper argues that the interpretation of the Spanish Dominican Domingo de Soto displays a greater understanding of Aristotle and the Aristotelian tradition of justice than that of Juan Gines de Sepúlveda, the Spanish Humanist. The paper goes on to argue that it is the humanist tradition itself that disposes Sepúlveda to misconstrue Aristotle and the tradition of political justice.

Leo Strauss’s political philosophy spurs recognition that (i) an adequate political philosophy of technology must be able to integrate domestic and geopolitical ideals that are often expressed separately; (ii) technologies alter the formation of publics around issues, which depend less on the traditional overlap between people and place, so the political concept of sovereignty must be reconsidered; and (iii) both the polis and its technologies lift individuals beyond themselves, so a political philosophy of technology must include an aspirational (...) element: the technologies we make, use, and maintain are expressions of our interests, values, and concerns. This study aims to identify the stance and distinctions proper to beginning to think about technology philosophically. It begins with a personal background and some historical events that have influenced the philosophy of technology. Chapter two then considers the historico-philosophical traditions of engineering and humanities philosophy of technology . With EPT, technological activity is primary, and other aspects of human experience are explained as aspects of a technological monism. With HPT, technology itself is placed within a (...) pluralistic framework. Following arguments for HPT as the proper stance for beginning to think about technology, chapter three surveys the relevant philosophical issues. ;But the philosophy of technology must also be a philosophy of technology. Chapter four articulates such a transition, which is then pursued in chapters five and six by means of a series of detailed distinctions. Chapter five examines technology as object and as knowledge. Types of technology as object include structures, tools, machines, automata, etc. The engineering analysis of machines is contrasted with their general human experience. As knowledge, types of technology range from sensorimotor skills through maxims and rules to technological theories. Such distinctions in artifact and technical cognition suggest various conceptual, epistemological, ethical-political, and metaphysical issues echoing those surveyed by chapter three. ;Chapter six extends the exploration into technology as activity and as volition. Types of the former include the action of making and the process of using. With regard to making, there is an explication of engineering discussions of the nature design. With regard to using, there are analyses of maintaining and management. Analyses of technology as volition revive those historico-philosophical and ethical considerations from which the study began. All four models of the manifestation of technology point toward a fundamental distinction between ancient and modern technology in beginning to think about technology philosophically. ;A final chapter reviews the study and considers some objections while pointing out the centrality of the philosophy of technology for science-technology-society studies and for the humanities in a technological culture. The particular design of any technology may have profound social implications. Computing technologies are deeply intermeshed with the activities of daily life, playing an ever more central role in how we work, learn, communicate, socialize, and participate in government. Despite the many ways they have improved life, they cannot be regarded as unambiguously beneficial or even value-neutral. Recent experience shows they can lead to unintended but harmful consequences. Some technologies are thought to threaten democracy through the spread of (...) propaganda on online social networks, or to threaten privacy through the aggregation of datasets that include increasingly personal information, or to threaten justice when machine learning is used in such high-stakes, decision-making contexts as loan application reviews, employment procedures, or parole hearings. It is insufficient to ethically assess technology after it has produced negative social impacts, as has happened, for example, with facial recognition software that discriminates against people of color and with self-driving cars that are unable to cope with pedestrians who jay-walk. Developers of new technologies should aim to identify potential harmful consequences early in the design process and take steps to eliminate or mitigate them. This task is not easy. Designers will often have to negotiate among competing values—for instance, between efficiency and accessibility for a diverse user population, or between maximizing benefits and avoiding harm. There is no simple recipe for identifying and solving ethical problems. -/- Computer science education can help meet these challenges by making ethical reasoning about computing technologies a central element in the curriculum. Students can learn to think not only about what technology they could create, but also whether they should create that technology. Learning to reason this way requires courses unlike those currently standard in computer science curricula. A range of university courses on topics in areas of computing, ethics, society and public policy are emerging to meet this need. Some cover computer science broadly, while others focus on specific problems like privacy and security; typically, these classes exist as stand-alone courses in the computer science curriculum. In the past few decades social changes have impacted how we understand justice, as societies become both more multicultural and more interconnected globally. Much philosophical thought, however, seems to proceed in isolation from these developments. While philosophers from Plato onwards have portrayed justice as an abstract, universal ideal, Miller argues that principles of justice are always rooted in particular social contexts, and connects these ideas to the changing conditions of human life. Purpose The purpose of this paper is to explore an emerging ethical theory for the Digital Age – Flourishing Ethics – which will likely be applicable in many different cultures worldwide, addressing not only human concerns but also activities, decisions and consequences of robots, cyborgs, artificially intelligent agents and other new digital technologies. Design/methodology/approach In the past, a number of influential ethical theories in Western philosophy have focused upon choice and autonomy, or pleasure and pain or fairness and (...) justice. These are important ethical concepts, but we consider “flourishing” to be a broader “umbrella concept” under which all of the above ideas can be included, plus additional ethical ideas from cultures in other regions of the world. Before explaining the applied approach, this study discusses relevant ideas of four example thinkers who emphasize flourishing in their ethics writings: Aristotle, Norbert Wiener, James Moor and Simon Rogerson. Findings Flourishing Ethics is not a single ethical theory. It is “an approach,” a “family” of similar ethical theories which can be successfully applied to humans in many different cultures, as well as to non-human agents arising from new digital technologies. This article endeavors to do just that by presenting an ethical analysis and design of technology intended to gather and act upon information on behalf of its users. Drawing on William F. Ogburn's cultural lag thesis, an inherent conflict is proposed between the rapid speed of modern technological advances and the slower speed by which ethical guidelines for utilization of new technologies are developed. Ogburn's cultural lag thesis proposes that material culture advances more rapidly than non-material culture. Technology is viewed as part of material culture and ethical guidelines for technology utilization are viewed as an adaptive aspect of non-material culture. Cultural lag is seen as a (...) critical ethical issue because failure to develop broad social consensus on appropriate applications of modern technology may lead to breakdowns in social solidarity and the rise of social conflict. Reasons for cultural lag between technology and ethics include the social structural and market conditions under which each are developed. The thesis is illustrated by reviews of technological trends involving computer-telecommunications electronics and bio- genetic engineering, and the implications of these and other technologies for privacy rights, electronic commerce, control of essential resources and social definitions of life are discussed. Through modern driver assistant systems, algorithmic decisions already have a significant impact on the behavior of vehicles in everyday traffic. This will become even more prominent in the near future considering the development of autonomous driving functionality. The need to consider ethical principles in the design of such systems is generally acknowledged. However, scope, principles and strategies for their implementations are not yet clear. Most of the current discussions concentrate on situations of unavoidable crashes in which the life of (...) human beings is existentially affected. In this paper, we argue that ethical considerations should be mandatory for any algorithmic decision of autonomous vehicles, instead of a limitation to hazard situations. Such an ethically aligned behavior is relevant because autonomous vehicles, like any other traffic participants, operate in a shared public space, where every behavioral decision impacts the operational possibilities of others. These possibilities concern the fulfillment of a road-user’s safety, utility and comfort needs. We propose that, to operate ethically in such space, an autonomous vehicle will have to take its behavior decisions according to a just distribution of operational possibilities among all traffic participants. Using an application on a partially-autonomous prototype vehicle, we describe how to apply and implement concepts of distributive justice to the driving environment and demonstrate the impact on its behavior in comparison to an advanced but egoistic decision maker. This research project aims to accomplish two primary objectives: (1) propose an argument that a posthuman ethics in the design of technologies is sound and thus warranted and, (2) how can existent SBD approaches begin to envision principled and methodological ways of incorporating nonhuman values into design. In order to do this this MRP will provide a rudimentary outline of what constitutes SBD approaches. A particular design approach - Value Sensitive Design (VSD) - is taken (...) up as an illustrative example given that it, among the other SBD frameworks, most clearly illustrates a principled approach to the integration of values in design. -/- This explication will be followed by the strongest arguments for a posthumanist ethic, primarily drawing from the works of the Italian philosophers Leonardo Caffo and Roberto Marchesini and Francesa Ferrando. In doing so I will show how the human imperative to account for nonhuman values is a duty and as such must be continually ready-to-hand when making value-critical decision. (shrink)

John Rawls’ gamification of justice leads him – along with many other monist political philosophers, not least Ronald Dworkin – to fail to take politics seriously enough. I begin with why we consider games frivolous and then show how Rawls’ theory of justice is not merely analogous to a game, as he himself seems to claim, but is in fact a kind of game. As such, it is harmful to political practice in two ways: one as regards the citizens (...) who participate directly in it, and the other as regards those who do no more than follow it. Similar harms, I then argue, come from taking politics too seriously, which is the attitude I ascribe to pluralist political philosophers such as Isaiah Berlin, Stuart Hampshire, and Bernard Williams. To them, the plural, incommensurable nature of values means that they cannot be reconciled and so that politics must be a matter of negotiating dirty, and often tragic, compromises. What we need instead, I conclude, is a third way, one that is neither monist nor pluralist but in-between the two extremes. (shrink)

offers an evolutionary approach to morality, in which moral rules form a cultural system that is robust and evolutionarily stable. The folk theorem is the analytical basis for his theory of justice. I argue that this is a mistake, as the equilibria described by the folk theorem lack dynamic stability in games with several players. While the dependence of Binmore's argument on the folk theorem is more tactical than strategic, this choice does have policy implications. I do not believe that (...) moral rules are solutions to the Nash bargaining problem. Rather, I believe that human beings are emotionally constituted, by virtue of their evolutionary history, to embrace prosocial and altruistic notions of in-group–out-group identification and reciprocity. These aspects of human nature are incompatible with Binmore's notion that humans are self-regarding creatures. This paper develops some foundations for an Aristotelian ethics of the built environment by combining the formal elements of Aristotelian justice with the design theory of Christopher Alexander. The resulting ordered set of human actions and their corresponding built environments require social deliberation about the integration of activities. This deliberation is required at all levels of human action, is characterized by local and step-wise decision making, and in important ways makes it possible for us to know if and (...) how we are harming others. On the political level this is embodied in the “public square,” whose essential purpose as integrative and moral-epistemological has deep and provocative implications for our built environment. For example, walkable human communities should be the default ethical choice for our built environment. I conclude by discussing a two-fold challenge to the New Urbanism movement for the light this sheds on the overall argument. (shrink)
