Existence of state-supported academies of science is a distinctive feature of the fundamental-science organization in Ukraine. Their research staff is divided into two groups: (i) personal members (academicians and corresponding members) and the rest of the researchers. First-group members have numerous economic and status privileges. It is officially purported that personal members are scientifically qualified than their colleagues. We analyzed this hypothesis on the basis of international indicators of the scientifi c activity (numbers of publications in the (...) international peer-reviewed journals and citations in them). The indicators testify that there are no distinctions between representatives of both groups being of the same age and qualifi cation. A conclusion is made that the lifelong privileges of the first group are ill-founded. (shrink)

How do we refer to people in everyday conversation? No matter the language or culture, we must choose from a range of options: full name ('Robert Smith'), reduced name ('Bob'), description ('tall guy'), kin term ('my son') etc. Our choices reflect how we know that person in context, and allow us to take a particular perspective on them. This book brings together a team of leading linguists, sociologists and anthropologists to show that there is more to person reference than meets (...) the eye. Drawing on video-recorded, everyday interactions in nine languages, it examines the fascinating ways in which we exploit person reference for social and cultural purposes, and reveals the underlying principles of person reference across cultures from the Americas to Asia to the South Pacific. This article chronicles the correspondence between Theodosius Dobzhansky and his colleagues in the USSR in the years following his arrival in the United States on what was to have been a one-year fellowship working in the laboratory of T.H. Morgan at Columbia University. These letters chronicle a period during which Dobzhansky not only realized the enormous potential of Drosophila genetics for unlocking the secrets of evolution, but also that con­tinuing this research would require finding a way to remain in the (...) United States longer than either the Soviet Academy of Sciences, or the Rockefeller Foundation, would allow. Dobzhansky’s exchanges during this period with mentors such as Yuri Filipchenko and Nikolai Vavilov, as well as fellow students and colleagues such as Nikolai Medvedev, highlight the precarious game Dobzhansky played as he attempted to appear eager to return to his homeland, while secretly maneuvering to delay it. By the time it was over Filipchenko would die an early death of meningitis and Vavilov—who had originally been urging Dobzhansky to return and contribute to development of genetics in Russia—would now advise him to remain in the USA. Dobzhansky was nearly forced to return to the USSR after a routine trip to Canada to renew his visa, an outcome that would surely have resulted in imprisonment or worse. In the end he was allowed to stay, however Dobzhansky’s defection was so resented by the Soviet regime that even decades later he would remain an “un-person” in his homeland, whose name and contributions were never officially acknowledged during his lifetime, and his attempts at reconciliation were rejected. U~5-1274), two of the greatest theologians of the Jewish and Christian faiths, had much in oommon.1 Like other Ohristian.writers, Aquinas made several criticisms of Maimonides' views on divine predication. Yet, the legal doctrines of consent and informed consent differ in their applications. In patient care, the judicial doctrines of consent and informed (...) consent are disclosure doctrines based on the obligation of physicians to inform their patients of the following types of information: the nature of the procedure the physician is recommending in the patent’s care (P), the alternatives to the physician‐recommendation (A), and the risks of procedure and its alternatives (R). In addition, the physician must provide truthful answers to the patient’s questions (Q) to the best of the physician’s abilities. In research on humans, the onus of disclosure by study sponsors and principal investigators is much greater than in patient care precisely because the purpose of research is not patient care. The purpose of research is the identification and development of new generalizable knowledge. Thus, participation in a research study or trial may not benefit the study volunteer at all. In addition, the participant may carry a heavy risk burden in relationship to any testing of a newly designed drug or device as part of their experiences in the research study. Presently, despite the risks borne by the research study participant, the raw data collected from volunteers in research trials are treated by courts as if they were the private property of the study sponsor rather than generally owed to the public as would be expected by an effort like research participation aimed at contributing to the development of generalizable knowledge. This paper reviews the obligations that study sponsors owe to their study participants based on the very definition of research as a systematic activity whose purpose is to develop generalizable knowledge to help all humans. De‐Identified (Anonymized) Raw Data A current approach to identifying (anonymizinig) raw data is based on the Health Insurance Portability and Accountability Act (HIPAA) of 1996 (P.L.104‐191). HIPAA was enacted by the U.S. Congress in 1996 to keep a person’s medical information private. In a research study, a person’s private medical information can become research data. HIPAA’s Privacy Rule allows a covered entity to de‐identify data by removing all 18 elements that could be used to identify the individual or the individual’s relatives, employers, or household members; these elements are enumerated in the Privacy Rule. The covered entity must also have no actual knowledge that the remaining information could be used alone or in combination with other information to identify the individual who is the subject of the information. Under this method, the identifiers that must be removed are the following: 1 Names. 2 All geographic subdivisions smaller than a state, including street address, city, county, precinct, ZIP Code, and their equivalent geographical codes, except for the initial three digits of a ZIP Code if, according to the current publicly available data from the Bureau of the Census: 2a. The geographic unit formed by combining all ZIP Codes with the same three initial digits contains more than 20,000 people. 2b. The initial three digits of a ZIP Code for all such geographic units containing 20,000 or fewer people are changed to 000. 3 All elements of dates (except year) for dates directly related to an individual, including birth date, admission date, discharge date, and date of death, and all ages over 89 and all elements of dates (including year) indicative of such age, except that such ages and elements may be aggregated into a single category of age 90 or older. 4 Telephone numbers. 5 Facsimile numbers. 6 Electronic mail addresses. 7 Social security numbers. 8 Medical record numbers. 9 Health plan beneficiary numbers. 10 Account numbers. 11 Certificate/license numbers. 12 Vehicle identifiers and serial numbers, including license plate numbers. 13 Device identifiers and serial numbers. 14 Web universal resource locators (URLs). 15 Internet protocol (IP) address numbers. 16 Biometric identifiers, including fingerprints and voiceprints. 17 Full‐face photographic images and any comparable images. 18 Any other unique identifying number, characteristic, or code, unless otherwise permitted by the Privacy Rule for re‐identification. Even though ‘raw data’ can be de‐identified (anonymized) so that there is no way to trace back the data to the study participant from which it was drawn, there are still questions whether the ‘de‐identified raw data’ can be given to other researchers or made public without the original study participant’s approval. It may be the case that this approval could be done at the start of any research study where the individual considering study participation would be counseled on what the process of de‐identification consists of and would be asked whether the participant would allow use of the data by other researchers or made available to the public in a de‐identified state. However, there may be questions of the study participants as to whether the data are truly de‐identified and untraceable back to the study participant since the participant would not be able to see the process actually being carried out in detail in all relevant circumstances. Using Raw Data in Context Simply being in possession of raw data is never enough to build on that data from a research perspective. Researchers need to understand the context of the scientific research study in which the data were collected. This research context includes (but is not limited to): (i) the scientific hypothesis of the research study, (ii) the inclusion and exclusion criteria selected by the research designers of the study to determine which study participants were included and which were excluded from the study, (iii) the methods used to collect the data and possibilities of errors in the data collection processes, and (iv) answers to questions regarding whether any data were excluded from the study data and why these data were excluded. Ownership Rights Over Data There are ownership rights over data. Ownership rights include court decision making related to the question which parties are to be considered as the owners of the data. Possible owners here include (but are not limited to) (i) the study sponsor whose only role was to fund that study, (ii) the principal investigator(s) who developed the scientific hypothesis, and (iii) individual study participants through special contracts made by individual participants who negotiate such contracts with study sponsors and principal investigators to share in the ownership of data. Examples of such data are participant sources of unique gene lines or unique cell lines to be used in future research. Objections to Data Sharing Finally, individual researchers may simply object to sharing data. A researcher’s arguments here may be simply stating that he or she has a right to fully analyze the data since the collection of the data was the researchers’ idea in the first place. These researchers may argue that they have the right to mine the data as fully as they can before deciding to make the data open to the public for others to analyze. Seminar/project Idea Draw a timeline of the development of the basic concepts of consent and informed consent in patient care and in patient research. On this timeline, first place the dates of the key court cases in England, the United States, Canada, and Australia on consent and informed consent. Then place the date of the development of the Belmont Report. Why do differences exist between these four countries in terms of the legal requirements of informedness of a patient (in medical care) and a study participant (in medical research)? What roles if any do the concepts of self‐determination and self‐decision have in consent and informed consent in patient care and in informed consent in research on humans among the four countries of interest? What are the realities of research on human participants that require a new standard of informed consent, the reasonable volunteer standard, to be developed beyond the two standards in patient care, the professional standard, and the reasonable person standard? Counterpoint Arguments The following are counterpoint arguments that need to be appreciated to more fully understand the concepts that impact the thesis that ‘raw data’ should be open to the public to allow the opportunity of checking of the results of its associated scientific paper and for further analysis. De‐Identified (Anonymized) Raw Data A current approach to identifying (anonymizinig) raw data is based on the Health Insurance Portability and Accountability Act (HIPAA) of 1996 (P.L.104‐191). HIPAA was enacted by the U.S. Congress in 1996 to keep a person’s medical information private. In a research study, a person’s private medical information can become research data. HIPAA’s Privacy Rule allows a covered entity to de‐identify data by removing all 18 elements that could be used to identify the individual or the individual’s relatives, employers, or household members; these elements are enumerated in the Privacy Rule. The covered entity must also have no actual knowledge that the remaining information could be used alone or in combination with other information to identify the individual who is the subject of the information. Under this method, the identifiers that must be removed are the following: 1 Names. 2 All geographic subdivisions smaller than a state, including street address, city, county, precinct, ZIP Code, and their equivalent geographical codes, except for the initial three digits of a ZIP Code if, according to the current publicly available data from the Bureau of the Census: 2a. The geographic unit formed by combining all ZIP Codes with the same three initial digits contains more than 20,000 people. 2b. The initial three digits of a ZIP Code for all such geographic units containing 20,000 or fewer people are changed to 000. 3 All elements of dates (except year) for dates directly related to an individual, including birth date, admission date, discharge date, and date of death, and all ages over 89 and all elements of dates (including year) indicative of such age, except that such ages and elements may be aggregated into a single category of age 90 or older. 4 Telephone numbers. 5 Facsimile numbers. 6 Electronic mail addresses. 7 Social security numbers. 8 Medical record numbers. 9 Health plan beneficiary numbers. 10 Account numbers. 11 Certificate/license numbers. 12 Vehicle identifiers and serial numbers, including license plate numbers. 13 Device identifiers and serial numbers. 14 Web universal resource locators (URLs). 15 Internet protocol (IP) address numbers. 16 Biometric identifiers, including fingerprints and voiceprints. 17 Full‐face photographic images and any comparable images. 18 Any other unique identifying number, characteristic, or code, unless otherwise permitted by the Privacy Rule for re‐identification. Even though ‘raw data’ can be de‐identified (anonymized) so that there is no way to trace back the data to the study participant from which it was drawn, there are still questions whether the ‘de‐identified raw data’ can be given to other researchers or made public without the original study participant’s approval. It may be the case that this approval could be done at the start of any research study where the individual considering study participation would be counseled on what the process of de‐identification consists of and would be asked whether the participant would allow use of the data by other researchers or made available to the public in a de‐identified state. However, there may be questions of the study participants as to whether the data are truly de‐identified and untraceable back to the study participant since the participant would not be able to see the process actually being carried out in detail in all relevant circumstances. Using Raw Data in Context Simply being in possession of raw data is never enough to build on that data from a research perspective. Researchers need to understand the context of the scientific research study in which the data were collected. This research context includes (but is not limited to): (i) the scientific hypothesis of the research study, (ii) the inclusion and exclusion criteria selected by the research designers of the study to determine which study participants were included and which were excluded from the study, (iii) the methods used to collect the data and possibilities of errors in the data collection processes, and (iv) answers to questions regarding whether any data were excluded from the study data and why these data were excluded. Ownership Rights Over Data There are ownership rights over data. Ownership rights include court decision making related to the question which parties are to be considered as the owners of the data. Possible owners here include (but are not limited to) (i) the study sponsor whose only role was to fund that study, (ii) the principal investigator(s) who developed the scientific hypothesis, and (iii) individual study participants through special contracts made by individual participants who negotiate such contracts with study sponsors and principal investigators to share in the ownership of data. Examples of such data are participant sources of unique gene lines or unique cell lines to be used in future research. Objections to Data Sharing Finally, individual researchers may simply object to sharing data. A researcher’s arguments here may be simply stating that he or she has a right to fully analyze the data since the collection of the data was the researchers’ idea in the first place. These researchers may argue that they have the right to mine the data as fully as they can before deciding to make the data open to the public for others to analyze. It is by now no secret that some scientific articles are ghost authored – that is, written by someone other than the person whose name appears at the top of the article. Ghost authorship, however, is only one sort of ghosting. In this article, we present evidence that pharmaceutical companies engage in the ghost management of the scientific literature, by controlling or shaping several crucial steps in the research, writing, and publication of scientific articles. Ghost management allows the pharmaceutical industry (...) to shape the literature in ways that serve its interests. This article aims to reinforce and expand publication ethics as an important area of concern for bioethics. Since ghost-managed research is primarily undertaken in the interests of marketing, large quantities of medical research violate not just publication norms but also research ethics. Much of this research involves human subjects, and yet is performed not primarily to increase knowledge for broad human benefit, but to disseminate results in the service of profits. Those who sponsor, manage, conduct, and publish such research therefore behave unethically, since they put patients at risk without justification. This leads us to a strong conclusion: if medical journals want to ensure that the research they publish is ethically sound, they should not publish articles that are commercially sponsored. (shrink)

Feldman Introduction Conscience is not a topic of terribly heated debate in Hobbes research. 1 Nevertheless, my claim in this article is that conscience in the Leviathan, which Hobbes poses as an example of the dangers of metaphor, is not merely an example of the dangers of metaphor, (...) but rather is the most dangerous metaphor, the metaphor that corrupts knowledge and thereby makes error and deception possible. Hobbes's brief account of conscience, which appears in the chapter of Leviathan on the ends of discourse, tells the story of the insinuation of metaphor into proper nomenclature; however, his example of the metaphorical use of the word conscience turns the story into one in which public knowledge itself is made private and thereby corrupted. Moreover, according to the story, private conscience is itself invented by means of a metaphor; it is in effect metaphorized into being. 2 With the emergence of private conscience, the potential of privatization expands from the privatization of the meaning of words to an entire private sphere of opinion. The metaphorical corruption of conscience invents a new understanding of knowledge as isolated from other witnesses, and the resultant privatization of truth lends itself to the corruption of that truth. Thus, whereas Hobbes characterizes the wrong use of names (of which metaphor is an instance) as a threat to accurate judgment and reason (L 22-23, 34, 161-62), as I will argue in the sections following, Hobbes's demand for the preservation of proper meaning in Leviathan corresponds to an anxiety regarding privacy and its peculiar potential for corrupting truth and knowledge. Hobbes's worries as to the dangers that metaphor poses to the stability of the commonwealth thereby converge with his worries about the dangers of conscience to the principle of public authority (cf. Strong 1993). [End Page 21] Hobbes's condemnations of conscience In Leviathan, conscience is condemned as a source of principles of human decision and action in a commonwealth. The problem with conscience as a principle of action is that it renders each individual inventor of his own rules and judge of his own actions. In brief, individual conscience is incommensurable with the public authority that defines a commonwealth: Another doctrine repugnant to civil society, is, that whatsoever a man does against his conscience, is sin; and it dependeth on the presumption of making himself judge of good and evil. For a man's conscience, and his judgment is the same thing, and as the judgment, so also the conscience may be erroneous. Therefore, though he that is subject to no civil law, sinneth in all he does against his conscience, because he has no other rule to follow but his own reason; yet it is not so with him that lives in a commonwealth; because the law is the public conscience, by which he hath already undertaken to be guided. Otherwise in such diversity, as there is of private consciences, which are but private opinions, the commonwealth must needs be distracted, and no man dare to obey the sovereign power, further than it shall seem good in his own eyes. (L 311) In this account, conscience is not just inferior to civil law as a principle guiding action, but at odds with civil society and the good of the commonwealth. The fact that conscience is private renders it problematic for the commonwealth for several reasons: First, as privately invented, it may be erroneous. Likewise, because it is private, conscience does not possess any binding power outside the individual, private sphere. Each person may be bound by his own conscience, but insofar as consciences differ, standards of action differ, and this leads to the undermining and distraction of the commonwealth. Likewise, private consciences may be divergent from one another, and the conflicts in private judgment produce conflicting actions that disturb the peace of the commonwealth. In this paper, we start by comparing the two agents, Ann and Bob, who are involved in two car crashes. Whereas Ann crashes her car through no fault of her own, Bob crashes as a result of reckless driving. Unlike Ann, Bob is held criminally responsible, and the insurance company refuses to cover the car’s damages. Nonetheless, Ann and Bob both receive emergency hospital treatment that a third party covers, regardless of any assessment of personal responsibility. What warrants such (...) apparent exceptionalism with respect to personal responsibility in the healthcare context? We turn our attention to an understudied aspect of the debate on personal health responsibility, namely, the conceptualisation of the person in need of emergency hospital treatment. Drawing on the research of Joshua Knobe and Shaun Nichols, we propose that a context-dependent conceptualisation of the person may help explain a reluctance to ascribe responsibility to the individual for negative health outcomes. In this article I consider whether there a right to incestuous marriage. I begin by suggesting that the liberal state get out of the "marriage" business by leveling down to a universal civil union or "registered domestic partnership" status. Removing the symbolism of the term "marriage" from political conflict, privatizing it in the same way as religion, would have the advantage of both consistency and political reconciliation. The question is then whether incestuous unions should be both legal and eligible for (...) this status. I argue that the arguments compatible with public reason for prohibiting them outright, or even for excluding them from the permissible types of legally registered partnerships, are quite weak. The objections to allowing such relations are those from (1) child abuse; (2) unfair burdening of society; and (3) the creation of bad lives. I argue that while rape and other forms of child abuse would be no more legal or tolerated than they are now, the concern about any form of weakening a society's legal and political resources to combat such abuses does indeed register on the justificatory scale, but does not prove that such first-degree incestuous sexual relations are inherently bad enough to warrant intervention in their own right. I then argue that the concern about unfairly burdening society with unhealthy persons is not as dangerously totalitarian as we might initially fear, but nor is it strong enough to justify an outright prohibition. Finally, I argue that a concern to dissuade persons from creating certain kinds of lives (children with extreme birth defects) is also not as dangerously totalitarian as we might initially fear, and in fact goes further towards explaining why we might have a legitimate interest in intervening. Nonetheless, I argue that the criminalization of such acts only make sense when they are indicators of other offenses, namely negligence or abuse, and it thus seems that the act of consanguineous reproduction is itself insufficient. One potentially surprising conclusion of this inquiry is that far from creating strong reasons for tolerating these practices, religious or cultural reasons for valuing incest (as well as polygamy) actually seem to count against tolerating them. The reason is that from a liberal perspective, tolerating polygamy and incest involves the assumption that it is possible to disassociate polygamy and incest simpliciter from abusive practices associated with them, including environments where children are raised to devalue their own sexual (and other) autonomy. However, the presence of comprehensive doctrines which include polygyny or incest as part of a good life actually makes it harder to justify disassociating polygamy and incest themselves from the likely abuse and coercion practiced by those who would value polygyny or incest. This study focuses on the life, works, scholarly personality and place of Abu Bakr Ahmad, one of the pioneers of the science of Qiraat in the Ottoman Empire. Abū Bakr Aḥmad was the son of Ibn al-Jazari, one of the authoritative figures in the science of Qiraat, and the author is called Ibn al-Nāzim after his father. Abū Bakr Aḥmad is an important figure who came to the forefront in the field of Qiraat by being educated by the leading scholars (...) of the period, especially Ibn al-Jazari, and wrote qualified works. Abu Bakr Ahmad distinguished himself among Ibn al-Jazari's other children. Abū Bakr Aḥmad served as a muderris in various madrasas in Damascus, such as the Great Ādiliyya, Atabekiyya and Umayyad mosques, and taught many students throughout his life. Among his students were the children of Bayezid Yildirim. After Ibn al-Jazari came to Bursa, Abu Bakr Ahmad took many books with him and taught what he learned from him to many people, especially the sultan's children. The works written by Abū Bakr Aḥmad also reveal his knowledge of scientific subjects. As a matter of fact, Ibn al-Jazari said that he liked his son Abū Bakr Aḥmad's commentary on Tayyibah very much, “...Although he did not even have a copy of my previous commentary on the same work, he commented it very well. Before that, he had also commented on two poems of mine very well...”. Apart from this commentary, which was praised by Ibn al-Jazari, he also wrote other works. Considering the works of Abū Bakr Aḥmad, it can be said that he was a commentator. This is because most of his works have the quality of a commentary. It is reported that when Ibn al-Nāzim was a professor in the madrasas in Damascus, the chief qadi of the period and many scholars attended his lectures. Ibn al-Nāzim was also the first commentator of Tayyibat al-Nashr, which is used as the main source of Qiraat education both in our country and in other Islamic countries and on which dozens of commentaries have been written. All this reflects the author's knowledge in the field of qiraat.While Abu Bakr Ahmad's personal effort, perseverance and intelligence played an important role in his reaching such a position, the fact that he was the son of a father like Ibn al-Jazari, who left his mark on the history of Qiraat and is considered an authority in his field, was undoubtedly effective. As a matter of fact, Ibn al-Jazari is a valuable figure who came to the forefront among his contemporaries in the shar'i sciences in general and in the field of Qiraat in particular. Aside from the words of praise uttered about him by scholars, the great works he penned and the vibrant community of students he left behind demonstrate this in the best way possible. Abu Bakr Ahmad was one of the first among the students who grew up under the tutelage of such an important scholar. When the studies on the life of Abū Bakr Aḥmad were examined, it was seen that there was no extensive and satisfactory information about the author. In fact, when the sources and documents that directly or indirectly mention the life of the commentator since his time are examined, it is seen that the information in the aforementioned sources is a repetition of what is given in Ibn al-Jazari's Ghāyat al-nihāya and sometimes contains contradictions within itself. For example, many issues such as the date of Abu Bakr Ahmad's death, the number and identity of his siblings, his position as imam-hatip of the Ulucamii, the name of one of his students, Ashraf Musa, the catalog information of some of his works or their attribution to the author are either erroneous or controversial. Nevertheless, sources such as manuscript library catalogs, archival records, and works on the life of Abū Bakr Ahmad such as tabāqat, terājim, and qiraat, academic, modern, or encyclopedic works have been searched, and the information obtained has been compiled and presented in this study. At the same time, the information about his life, which is assumed to be erroneous, has been identified and corrected by going to the main sources, and finally, the correct or close to the truth has been tried to be revealed. The general opinion formed by us as a result of our research on the life of Abu Bakr Ahmad led us to such a study. The main theme of the article is the life of Abū Bakr Ahmad and it is aimed to make a humble contribution to the literature through this study. (shrink)

There are various ways of attempting to defend an extreme liberal view on abortion, according to which a woman always has the right to control what happens inside her own body. First of all, there is the popular view that appeals to the idea that there is a fundamental, underived right that women have to control what occurs within their own bodies. Secondly, there is a related type of philosophical argument advanced by Judith Jarvis Thomson in her famous and oft-reprinted (...) article “A Defense of Abortion” for the slightly weaker claim that while abortion is not always permissible, since, as she says near the end of her essay, it is impermissible in, and only in, the following circumstances: “There may well be cases where carrying the child to term requires only Minimally Decent Samaritanism of the mother, and this is a standard w must not fall below.” Subsequently, Thomson’s type of argument was then developed and defended at much greater length by David Boonin in his very carefully argued book A Defense of Abortion, though Boonin does not discuss the case of the Minimally Decent Samaritan. I believe that there is a strong objection to the Thomson/Boonin approach to justifying abortion. It was set out in an article by Richard Langer, namely, in ‘Silverstein and the “Responsibility Objection”’, Social Theory and Practice 19/3. 345-58. Langer’s discussion is not, in general, very strong, but in a very important paragraph, on pages 351-2, Langer argues that if the responsibility objection to Thomson is unsound, then it follows that there will also be circumstances in which allowing one’s children to die, simply because one no longer wishes to care for them, will also be morally permissible. David Boonin replies to Langer’s objection in his A Defense of Abortion, but in discussing, on pages 182-3, Langer’s point about a parent’s responsibility to his or her children, Boonin relies upon a tacit consent argument that appears open to decisive objections. It seems to me, then, that the only possibility for a successful defense of an extreme liberal view concerning the justification of abortion will have to involve setting out a plausible account of what it is that gives something a right to life, and I think that the right answer is that neo-Lockean persons, and only neo-Lockean persons, have a right to continued existence. This leaves one with the scientific question of when developing humans become neo-Lockean persons. The answer to that question is perhaps still not firmly settled, although the extensive research that I carried out back in the 1970s seemed to me to support the conclusion that it is not until sometime that humans acquire the capacity for thought, a capacity that is necessary if a developing human is to be a neo-Lockean person. The upshot is that if one defends an extreme liberal view on abortion in the only way that seems to be satisfactory – that is, by setting out an account of what it is that gives something a right to life, and arguing that humans before birth do not have the relevant property, one must also address the question of infanticide, and that to fail to do so is intellectually unacceptable. To do so, I explore the intellectual and creative narratives of individuals who, with tenure newly in hand, position themselves to engage with beauty and to pursue its meanings, expressed distinctively through the subjects, creations, and questions of scholarly disciplines and professional fields. In (...) interviews, scholars — professors with tenure in major research universities — described the sparks of beauty they experience in their scholarly work. For many, such moments of beauty, and often of deep engrossment, had recurred through life. Yet these were truly "moments": brief, bounded, hard to evoke, and by no means continuous, assured, or predictable. They were hard won. Many of the professors I interviewed referred to persistent struggles to craft scholarly agendas, communities, collaborations, and work lives that might invite the aesthetic glimmer, however brief. Many drew for insight and inspiration on childhood memories of beauty to guide their intellectual and creative pursuits in adulthood. They hitched present-day desires for moments of passionate thought to vivid memories — what they saw and felt in their earliest, often out-of-school encounters with an aesthetic they would pursue through their lives. Even now, in tenured university professorships, they relied on these deeply imprinted images to light their intellectual ways.1I also claim that scholars may experience aesthetic moments as deeply emotional and personal. This is not something I inferred; this is something the professors I interviewed said to me — directly, repeatedly, with emotion. [End Page 68] Yet I am something of an organizational realist, and the social sciences strand of my conscience impels me to pepper these scholars' accounts of recurrent beauty in their lives with less than beauteous recognition of a hard academic fact: that within the normative structure of academe, the personal (and emotional) meanings infusing professors' scholarly learning get short shrift. Public academic talk about the personal meanings of one's work, or the emotional content of study, is largely taboo. The press for institutional survival, social legitimacy, and financial and political gain typically call for presentations of scholarship as objective and outwardly directed, negating the personal origins of research in researchers' lives.2 Scholarly learning as an aesthetic awareness — as moments of fused insight and emotion, as dazzling sensations of coming to know, as frustration over ideas that unravel or that will not gel — is often lost in translation between the personal life from which it derives and the modern profession, career, and organization within which it is housed and enacted.I worry that this lost awareness of scholarly learning, occurring in large scale, forces questions about its social worth. Yet to persist, scholarly learning requires substantial social legitimation, appreciation, and support. I suggest further that this state of affairs calls for response: that to garner societal understanding for and support of scholarly learning as a setting for pursuits of beauty and as the communal mission of higher education, we must learn to talk out loud, and in educative ways, about it. However, we, as scholars and learners ourselves, must understand, first, what it is that we are defending and then represent its worth to publics who may learn to care about it. We must first define among ourselves what scholarly learning means, what it takes to engage it, and what it entails — cognitively, professionally, aesthetically, and emotionally. My aim in this paper is to advance this collegial conversation by addressing its possibly most contentious element: its beauty, its emotion, its personal meanings in scholars' lives.3Roots of the StudyGiven that we have no well-honed public-professional vocabulary for speaking coherently about professors' scholarly learning and aesthetic experience, I devote this article to defining and exploring these terms. How may feelings of love and hate impact people’s attention? We used a modified Attentional Blink (AB) task in which 300 participants were asked to categorise a name representing a person towards whom they felt either hate, love, or neutral (first target) plus identify a number word (second target), both embedded in a rapidly presented stream of other words. The lag to the second target was systematically varied. Contrary to our hypothesis, results revealed that both hated and loved names resulted (...) in higher accuracy for the second target than neutral names, which was largely independent of lag. Also, there we observed no sustained transfer effects of love and hate onto neutral name trials. The findings differ from prior research on attentional blink and transient, non-personal, stimulus-driven emotions, suggesting that interpersonal feelings activate different attention-relevant mechanisms. Relevant to future research, we speculate that love and hate are motivators of goal-directed behaviour that facilitate subsequent information processing. (shrink)

Should scientists value simple theories? Is fruitfulness an important criterion to assess scientific theories? What role moral, social, and political values should have in the assessment of scientific theories? In recent years, there has been an increasing interest among philosophers of science in studying how cognitive and non-cognitive values influence and should influence the assessment and comparison of scientific theories. While cognitive values (such as simplicity and fruitfulness) are features of scientific theories that are indicative of the truth or empirical (...) adequacy of theories, non-cognitive values are moral, political, social, and economic values. Understanding the roles of values in science is a particularly urgent issue. Clarifying the importance of cognitive values is important in order to be able to make accurate comparisons of scientific theories. Understanding the influence of non-cognitive values on science is crucial because moral, social, and political values are involved in many stages of research, such as decisions on methodologies and allocation of funds. Since these decisions affect all the members of the society (scientists, non-experts, and political institutions), understanding the impact of non-cognitive values on these choices is of primary importance. Although a large body of literature has investigated the roles of cognitive and non-cognitive values in theory appraisal, several questions remain to be analysed. In this dissertation, I address four questions by using two main methods, namely the analysis of case studies from evolutionary psychology and the experimental method. First, while philosophers have clarified the importance and roles in theory appraisal of some cognitive values, little or no attention has been paid to other values. In this dissertation, I have started filling this gap by formulating a clear explication and a simple strategy to be employed in theory appraisal for one of the values that have attracted little attention, namely fruitfulness. I have explicated fruitfulness as the ability of programs to extend their content and suggested considering research questions and discovery heuristics to assess this ability. Moreover, I have used my account to assess the fruitfulness of evolutionary psychology. Second, some philosophers of science argue that cognitive values are desirable and relevant to the assessment of theories because they are indicative of the truth or empirical adequacy of theories. However, why is it so? In my dissertation, I develop a context-sensitive approach to values and I argue that in order to understand the ground for the desirability of cognitive values and make an accurate appraisal of theories, we have to consider specific factors of the context in which theories are assessed, such as the availability of methodologies and the way cognitive values are interrelated to each other in that context. Third, philosophers have traditionally argued that the influence of non-cognitive values on scientific reasoning threatens the epistemic authority of science. I have challenged this view and argued that some non-cognitive values can play a cognitive role in science, i.e., they can be epistemically beneficial to the assessment of scientific theories. On the basis of a case study (the account of human mating in evolutionary psychology), I have argued that feminist values have positively contributed to theory appraisal in various ways, such as by raising sensitivity to evidence that was neglected because of gender bias. Fourth, some philosophers have argued that non-cognitive values play a legitimate role in cases of inductive risk, namely cases in which scientists may wrongly assess scientific hypotheses (e.g. accepting a hypothesis that should be rejected) because of some uncertainty due to mixed results or disagreement on the reliability of methodologies. Mistakes can have consequences that can be morally or economically undesirable and non-cognitive values, some philosophers argue, provide the standards to evaluate and compare these possible consequences. However, little is known on how - specifically - non-cognitive values influence this evaluation. To address this issue, I have conducted an experimental study clarifying how personal features, political values, and specific aspects of a risk (e.g. the chance of incurring Type I vs. Type II errors) determine people’s reasoning about cases of inductive risk. On the basis of these results, I have discussed recent institutional calls for the need to align research agendas and technological development to citizens’ values, needs, and expectations. (shrink)

An individual's health, genetic, or environmental-exposure data, placed in an online repository, creates a valuable shared resource that can accelerate biomedical research and even open opportunities for crowd-sourcing discoveries by members of the public. But these data become “immortalized” in ways that may create lasting risk as well as benefit. Once shared on the Internet, the data are difficult or impossible to redact, and identities may be revealed by a process called data linkage, in which online data sets are matched (...) to each other. Reidentification, the process of associating an individual's name with data that were considered deidentified, poses risks such as insurance or employment discrimination, social stigma, and breach of the promises often made in informed-consent documents. At the same time, re-ID poses risks to researchers and indeed to the future of science, should re-ID end up undermining the trust and participation of potential research participants. The ethical challenges of online data sharing are heightened as so-called big data becomes an increasingly important research tool and driver of new research structures. Big data is shifting research to include large numbers of researchers and institutions as well as large numbers of participants providing diverse types of data, so the participants’ consent relationship is no longer with a person or even a research institution. In addition, consent is further transformed because big data analysis often begins with descriptive inquiry and generation of a hypothesis, and the research questions cannot be clearly defined at the outset and may be unforeseeable over the long term. In this article, we consider how expanded data sharing poses new challenges, illustrated by genomics and the transition to new models of consent. We draw on the experiences of participants in an open data platform—the Personal Genome Project—to allow study participants to contribute their voices to inform ethical consent practices and protocol reviews for big-data research. A multitude of legislation impacts the use of samples and data for research in South Africa. With the coming into effect of the Protection of Personal Information Act No. 4 of 2013 in July 2021, recent attention has been given to safeguarding research participants’ personal information. The protection of participants’ privacy in research is essential, but it is not the only risk at stake in the use and sharing of personal information. Other rights and interests that must (...) also be considered and safeguarded include the right to non-discrimination, the right to dignity, and the right to enjoy the benefits of scientific progress. This can be achieved by ensuring that the ethical values and universal principles that underpin the research landscape, namely equity, reciprocity, justice and solidarity, are embedded in the regulatory framework for the management and use of personal information. This paper advocates an integrated bioethics approach to the use of personal information for research in SA. A key feature in embedding such an approach is a Data Transfer Agreement that appropriately integrates the safeguards and protections set out by our regulatory framework with bioethical rules and procedures when personal information is used and shared for research purposes. This paper thus calls for the development of a national DTA that is guided by key ethical principles when data are shared for research purposes. This paper will be followed by a webinar on 23 June 2022 hosted by the Department of Science and Innovation and the SA Medical Research Council, where the recommendations and suggestions set out herein will be unpacked, discussed and debated by relevant stakeholders. Psychologists and moral philosophers have much to say about self-awareness and so it is no surprise that in leadership research self-awareness also has come to play an important role. For some time now, leadership research has been dominated by psychologists and we argue that their version of the self-awareness is very thin. It is empty of morality and therefore offers only a partial understanding of humanity. That make its conclusions for leadership ineffective and unethical. Psychology-driven approaches to leadership stress effectiveness: (...) leaders make followers work towards a given goal in an effective manner. Self-awareness, to them, is a thorough understanding of one’s strengths, weaknesses, values, how others see one, all with the goal of turning people into followers. Since ethics is excluded, this view of self-awareness lacks a foundational moral concept: respect/dignity and is closer to self-assessment. Building on Immanuel Kant and other German Idealists, Georg Friedrich Wilhelm Hegel proposed a theory of the development of self-awareness that is more holistic as it situates the individual in a social and moral context and thus transcends the purely functional view of the self-other relationship propagated in psychological approaches. We concretely argue that psychological approaches to leadership systematically drive managers into a catastrophic situation that Hegel describes in the Master-Slave Dialectic. Understanding Hegelian self-awareness prevents leaders becoming self-less masters. Truly self-aware leaders heed the warning of the Humanity Formulation of Kant’s Categorial Imperative, namely that they must always treat humanity, whether in their own person or in the person of any other, never merely as a means to an end, but always at the same time as an end. They understand their self, they understand its social and moral dimension, and they see their self-reflected in the other. (shrink)

Artificial Intelligence is supposed to perform tasks autonomously, make competent decisions, and interact socially with people. From a psychological perspective, AI can thus be expected to impact users’ three Basic Psychological Needs, namely autonomy, competence, and relatedness to others. While research highlights the fulfillment of these needs as central to human motivation and well-being, their role in the acceptance of AI applications has hitherto received little consideration. Addressing this research gap, our study examined the influence of BPN Satisfaction on Intention (...) to Use an AI assistant for personal banking. In a 2×2 factorial online experiment, 282 participants watched a video of an AI finance coach with a female or male synthetic voice that exhibited either high or low agency. In combination, these factors resulted either in AI assistants conforming to traditional gender stereotypes or in non-conforming conditions. Although the experimental manipulations had no significant influence on participants’ relatedness and competence satisfaction, a strong effect on autonomy satisfaction was found. As further analyses revealed, this effect was attributable only to male participants, who felt their autonomy need significantly more satisfied by the low-agency female assistant, consistent with stereotypical images of women, than by the high-agency female assistant. A significant indirect effects model showed that the greater autonomy satisfaction that men, unlike women, experienced from the low-agency female assistant led to higher ITU. The findings are discussed in terms of their practical relevance and the risk of reproducing traditional gender stereotypes through technology design. (shrink)

BackgroundStigma refers to a distinguishing personal trait that is perceived as or actually is physically, socially, or psychologically disadvantageous. Little is known about the opinion of those who have more or less stigmatizing health conditions regarding the need for consent for use of their personal information for health research.MethodsWe surveyed the opinions of people 18 years and older with seven health conditions. Participants were drawn from: physicians' offices and clinics in southern Ontario; and from a cross-Canada marketing panel (...) of individuals with the target health conditions. For each of five research scenarios presented, respondents chose one of five consent choices: (1) no need for me to know; (2) notice with opt-out; (3) broad opt-in; (4) project-specific permission; and (5) this information should not be used. Consent choices were regressed onto: demographics; health condition; and attitude measures of privacy, disclosure concern, and the benefits of health research. We conducted focus groups to discuss possible reasons for observed consent choices.ResultsWe observed substantial variation in the control that people wish to have over use of their personal information for research. However, consent choice profiles were similar across health conditions, possibly due to sampling bias. Research involving profit or requiring linkage of health information with income, education, or occupation were associated with more restrictive consent choices. People were more willing to link their health information with biological samples than with information about their income, occupation, or education.ConclusionsThe heterogeneity in consent choices suggests individuals should be offered some choice in use of their information for different types of health research, even if limited to selectively opting-out. Some of the implementation challenges could be designed into the interoperable electronic health record. However, many questions remain, including how best to capture the opinions of those who are more privacy sensitive. (shrink)

The papers of this special issue are the outcome of a two-­‐day conference entitled “The Second-­‐Person Standpoint in Law and Morality,” that took place at the University of Vienna in March 2013 and was organized by the ERC Advanced Research Grant “Distortions of Normativity.” -/- The aim of the conference was to explore and discuss Stephen Darwall’s innovative and influential second-­‐personal account of foundational moral concepts such as „obligation“, „responsibility“, and „rights“, as developed in his book The Second-­‐Person Standpoint: (...) Morality, Respect, and Accountability (Harvard University Press 2006) and further elaborated in Morality, Authority and Law: Essays in Second-­‐Personal Ethics I and Honor, History, and Relationships: Essays in Second-­‐Personal Ethics II (both Oxford University Press 2013). -/- With the second-­‐person standpoint Darwall refers to the unique conceptual normative space that practical deliberators and agents occupy when they address claims and demands to one another (and to themselves). The very first sentence of Darwall’s examination of the second-­‐personal conceptual paradigm summarizes the gist of the argument succinctly when he claims that “the second-­‐person standpoint [is] the perspective that you and I take up when we make and acknowledge claims on one another’s conduct and will.” (Darwall 2006, 3) The Second-­‐Person Standpoint reminds us that this perspective has been ignored for much too long and that it better take centre stage in any philosophical analysis of moral phenomena, in order to yield a satisfying account of morality as a social institution. The negative part of Darwall’s strategy is to show that neither a purely first-­‐personal approach (represented by Kant and contemporary Kantians), nor a third-­‐personal state-­‐of-­‐affairs-­‐perspective (represented by most varieties of contemporary consequentialism) are capable of accounting for the categorical bindingness characteristic of moral obligation. The latter feat can only be accomplished, and this is the positive part of Darwall’s argument, when those second-­‐ personal normative “felicity conditions” and conceptual presuppositions are acknowledged and spelled out that are already presupposed in every instance of issuing (putatively valid) claims and demands. It is especially second-­‐personal competence and second-­‐personal authority that are the bedrock of these normative conceptual presuppositions, without which engaging in any meaningful address would be impossible. Kantians and utilitarians alike have neglected this critical dimension of the normative landscape. -/- In addition to working out an original conception of moral obligation, the first eight chapters of The Second-­‐Person Standpoint articulate this fundamental insight with respect to a variety of traditional projects in ethical theory such as developing accounts of moral responsibility, rights, dignity, and autonomy. In this context, special emphasis is to be awarded, on the one hand, to Darwall’s refreshing second-­‐personal interpretation of Strawson’s influential account of reactive attitudes and moral responsibility and, on the other, to his historically well-­‐informed reconstruction of Samuel Pufendorf’s often neglected version of an enlightened theistic voluntarism concerning moral authority. Darwall dedicates the second part of The Second-­‐Person Standpoint to the urgent question: how should one respond to the sceptical challenge that expresses utter indifference to the second-­‐person standpoint, including all its multifarious normative presuppositions and implications? What commits us to all this? It is at this point that Darwall, firstly, refines his criticisms of the Kantian, first-­‐personal, paradigm of normativity and emphasizes that only if one already incorporates the second-­‐personal conceptual apparatus into a Kantian analysis of moral obligation is the latter going to yield a convincing account. Secondly, and this certainly is one of the highlights of Darwall’s theory, the Second-­‐Person Standpoint employs themes from Fichte’s philosophy of right in order to strengthen the case for the inescapability of taking up the second-­‐person standpoint of moral obligation. In his contribution for this special issue Darwall further develops his diagnosis that Fichte’s thought offers in many respects a more promising, since more second-­‐personal, foundation of morality than, for example, Kant’s. -/- By now, the impact of Darwall’s second-­‐person standpoint theory has far transcended the confines of contemporary debates on moral obligation. Darwall has put to use the second-­‐personal apparatus to critical engagements with Joseph Raz’s theory of legal authority and Derek Parfit’s convergence arguments for his recent Triple Theory of moral wrongness. The constant theme that unifies all these diverse applications remains the one so impressively presented in The Second-­‐Person Standpoint: without paying attention to the “interdefinable” and “irreducible” circle of (four) foundational second-­‐ personal concepts (valid demand, practical authority, second-­‐personal reason, and accountability), neither superior epistemic status (Raz) nor the identification of optimific states of affairs (Parfit) are potent enough sources to generate anything close to the authority relationships that underlie the idea involved in obligating ourselves and one another. Given all of the above, it comes as no surprise that Darwall reserves his strongest sympathies for a specific ethical theory, namely contractualism. Our commitment to equal basic second-­‐personal authority, that Darwall arrives at through his Fichtean rectification of the Kantian project, leads him to the endorsement of a contractualist paradigm in the spirit of broadly Rawls and Scanlon. -/- . To support healthcare professionals in dealing with ethically difficult situations, Clinical Ethics Support (CES) services like Moral Case Deliberation (MCD) are increasingly implemented. To assess the impact of CES, it is important to evaluate outcomes. Despite general claims about outcomes from MCD experts and some qualitative research, there exists no conceptual analysis of outcomes yet. Therefore, the aim of this study was to systematically define and categorize MCD outcomes. An additional aim was to compare these outcomes with the outcomes in (...) the Euro-MCD Instrument from 2014, to further validate this Instrument. The concept mapping method was used and involves qualitative and quantitative steps including brainstorming, individual structuring, computation of concept maps (by principal component analysis and cluster analysis), group interpretation and utilization. In total, 12 experienced MCD participants from a variety of professional backgrounds participated in two sessions. The focus group brainstorm resulted in a list of 85 possible MCD outcomes, of which a point map and concept maps were constructed. After a thorough discussion of each cluster, final consensus was reached on the names and position of 8 clusters of MCD outcomes: 1) Organisation and Policy; 2) Team development; 3) Personal development focused on the Other Person; 4) Personal development as Professional, focused on Skills; 5) Personal development as Professional, focused on Knowledge; 6) Personal development as an Individual; 7) Perception and Connection; and 8) Concrete action. This study explored and categorized MCD outcomes in a concept mapping focus group. When comparing the results with the Euro-MCD Instrument, our study confirms that outcomes of MCD can be categorized in clusters referring to the organisational level, team development, personal development (both as an individual and a professional) and the concrete case-level. In developing CES evaluation tools, it is important to be explicit if an outcome refers to the individual or the team, to knowledge or skills, to the organisation or the specific case. The findings will be used in the further validation of the Euro-MCD Instrument. The current study further contributes to the field of evaluating CES in general and defining outcomes of MCD in particular. (shrink)

This paper challenges the recommendation of 1981 President's Commission for the Study of Ethical Problems in Medicine and Biomedical and Behavioral Research that all jurisdictions in the United States should adopt the Uniform Determination of Death Act, which endorses a whole-brain, rather than a higher-brain, definition of death. I argue that the Commission was wrong to reject the "personhood argument" for the higher-brain definition on the grounds that there is no consensus among philosophers or the general population as to what (...) constitutes "personhood". I claim that philosophers agree that some potential for cognitive function is necessary for personhood and that, when this is absent in cases of anencephaly and persistent vegetative state (PVS), the individual should be considered dead. I further argue that the lack of consensus among the general population is due in large measure to misunderstandings about the medical reality of PVS and beliefs influenced by feelings for a specific individual in PVS. I also examine and reject two tutiorist arguments which have been used to support the Commission's position: that the higher-brain definition would threaten the severely senile and severely retarded, and that there are not currently adequate medical techniques for determining when all higher-brain activities have ceased. The recent alleged doping case of the figure skater Kamila Valieva at the Winter Olympic Games in Beijing 2022 dramatically raised the issue of the protection of minors in anti-doping policy. We firstly present the literature on doping in relation to minors. Secondly, we present WADA’s Protected Person (PP) concept and its implications. Thirdly, we analyse the WADA Code’s purpose and the vulnerability of minors under the Code, and fourthly, we identify the real threats from which minors should be protected (...) by analysing the ineffective PP concept, and showing how it cannot be a real protection. We explain how preventing one threat can generate another, thus converting minor athletes from victims into suspects. We conclude by stressing the necessity for further research, and we indicate our future research direction, towards the development of a much wider concept of protection, and its application into sporting contexts. Although a large body of research exists concerning connections between personality traits and blood types, no studies can be found within the literature on the links between morality and one’s blood type. We have conducted research examining whether blood type has any impact on the degree to which moral foundations, according to Haidt, are observable in an individual. Our study focused on 240 adult male and female subjects, with an average age of 43.47 years; each group was based on the (...) ABO blood type system and consisted of 60 subjects in total. Based on the data obtained, we can conclude that there is a connection between the Harm and Purity moral foundations and blood group. (shrink)

Architecture and Deconstruction Case of Peter Eisenman and Bernard Tschumi -/- Introduction Towards deconstruction in architecture Intensive relations between philosophical deconstruction and architecture, which were present in the late 1980s and early 1990s, belong to the past and therefore may be described from a greater than before distance. Within these relations three basic variations can be distinguished: the first one, in which philosophy of deconstruction deals with architectural terms but does not interfere with real architecture, the second one, in which (...) a collaboration between Jacques Derrida and a group of architects interested in his concepts is commenced, and the third one, in which completed or only designed objects or new concepts of deconstruction created by architects gain their supremacy over philosophy. The following book analyses these three possible ways, first of all with the reference to Peter Eisenman and Bernard Tschumi. -/- Peter Eisenman -/- Misreading… and Other Errors -/- The issue of relations between Peter Eisenman’s work and philosophy of deconstruction may be referred to his activity more than ten years preceding his direct collaboration with Jacques Derrida (in 1985) and organisation of the exhibition Deconstructivist Architecture at Museum of Modern Art in New York (in 1988). As soon as at the stage of designing the first houses (House I-III, 1967-1970), which almost entirely inscribed in formalistic aesthetics of Modernism, the architect analysed the problem of architecture dependence on its assumptions. All his later designs may be treated as consequence of this initial interest in relations between practice and theory, and at the same time as an introduction to manipulations later on led at the level of metaphysics of architecture. Beginning with the issue of presence, considered in comments to House VI (1972), the number of ideas having their analogies in philosophy of deconstruction increased. The text entitled The End of the Classical: The End of the Beginning, The End of the End (1984), in which Eisenman criticised questions of representation in architecture, its delusive strive for truth and comparably unattainable attempts at ultimate definition of elementary rules, should be acclaimed the breaking point. This attitude was extended by numerous strategies disturbing architecture rules defined at metaphysical level in an essay Moving Arrows, Eros, and Other Errors: an Architecture of Absence (1986). The issue of Eisenman’s passage from formalism to deconstruction has already been much discussed in the literature (Rosalind Krauss, Thomas Patin among others), still it should be mentioned that the threads similar to Derrida’s concept included in Eisenman’s writing reveal untranslatability of architecture and philosophy. -/- Choral Works or Separate tricks -/- In 1985-1986 a series of seven disputes between Jacques Derrida and Peter Eisenman took place. The pretext for them were designs concerning Parc de la Villette in Paris. The situation of many months of collaboration between a notable philosopher of the second half of the 20th c. and an architect that already had a huge theoretical oeuvre, ended up with a publication of a large volume entitled Chora L Works and it became at the same time a vast study area for historians of contemporary architecture and philosophers. Derrida’s contribution to concept works were his considerations over the idea of chôra, the properties related to this concept were about to be reflected in shapes of the park. Therefore, Chora L Works became an example of the abilities of contemporary art, both in its capability of translation from philosophical ideas to artistic forms and its resistance to tradition of representing in architecture some phenomena and values originating outside this discipline. In the final period of their collaboration both interlocutors started to polemicise with each other more decidedly, what became a separate part of their thought exchange. The exchange of letters between Derrida and Eisenman at the turn of 1989 ended up the period of their direct contacts, nevertheless, at this time precisely a large group of experts in issues of deconstruction joined the discussion and extended the revealed in the former dispute problems into more than ten years of further considerations and publications. Except for a long text by Jeffrey Kipnis, who had participated in the meetings of the philosopher and the architect, there appeared also comments of researchers of artistic theories (K. Michael Hays, Thomas Patin), philosophers (Andrew Benjamin), and even experts in Greek literature (Maria Theodorou or Ann Bergren). Following these debates a contemporary reflection on architecture has saturated with indeed numerous concepts originating in philosophy of deconstruction. -/- Architecture which imitates mute philosophy -/- The series of Jacques Derrida and Peter Eisenman meetings, which took place in the period of 1985-1987, induced many authors to make comments. Some of them (Jeffrey Kipnis, Ann Bergren, Maria Theodorou) developed the subject of chôra which was introduced to the discussion by Derrida. The problem that was about to be solved was the question of tying up the concept of chôra with architecture, including Eisenman’s architecture and the series of meetings within frames of Chora L Works project. Kipnis on this occasion paid attention to chôra and its character of anachronia which infects any being created within chôra. In other words any event has its counterpart (analogon) in another, earlier event. He demonstrated the similarity of structure of many events and statements from the times of Derrida and Eisenman’s meetings to the almost identical behaviour of figures in Plato’s dialogue Timaeus. The loss of beginning present in this phenomenon was appropriate to both features of chôra and the effects of typical analyses of philosophy of deconstruction. Bergren’s analyses focused on accentuating gender of chôra, which, according to this author, had been neglected hitherto in discussions. She collated chôra descriptions with characteristics of women in myths, early Greek epic and philosophy and she arrived at a conclusion that chôra has features of a single woman and a married one at the same time. And yet Theodorou’s studies showed that in the Homeric epics chôra is not treated as an idea but is related with single things and events. The other part of the comments (represented by Andrew Benjamin and K. Michael Hays’ utterances) concerns Eisenman’s attitude to tradition which was treated as a variety of iteration understood philosophically. Benjamin commenced his considerations at the point of closeness between a definition of tradition and a concept of chôra understood as perpetuation (placement). A problematic issue was for him Eisenman’s complex relation to tradition based on its contest and affirmation at the same time. Overcoming the simple subordination to tradition – according to Benjamin – was based on awareness of the role of repetition in culture not known before. Hays made an attempt to explain the pleasure and torment of repetition with the support of Sigmund Freud and Roland Barthes’ concepts. According to Hays repetitions are attempts of a single being to a certain primal state perceived as free of any tension. In a similar way Rosalind Krauss explained a motif of a grate present in Modernistic art and also exceptionally frequent in Eisenman’s work. -/- Annex Architecture is still writing Balzac novels. Peter Eisenman and literature -/- Architecture’s approach to writing, script or literature, present within Peter Eisenman’s work, is an exceptional phenomenon, furthermore a complex one. The article considers four possible relations. The first one relates to Eisenman’s characteristics as a person extremely gifted with the ability to wordplay, which very ‘play’ reveals skills to create architectural images. In the second approach the attention has been paid to Eisenman’s interests – in the first period of his oeuvre – in linguistic works by Noam Chomsky and his transformational-generative grammar. The third kind of relations applied to overcoming the need for autonomy of architecture (and of modernist aesthetics at the same time) and renew interests in questions of meaning in architecture. The fourth sort of relations occurred when Eisenman started to create reflections of historic or literary narrations in architecture – ‘stone stories’ and architectural fictions of their kind. -/- Bernard Tschumi -/- From perversion to deconstruction In Bernard Tschumi’s writings from the 1970s and 1980s we can find a transposition of important threads of post-structuralist ideas deriving from Georges Bataille, Roland Barthes and Jacques Derrida’s works. The analysis of the architect’s writings also shows roots in Phillippe Sollers, Michel Foucault and Denis Hollier’s works. The analysis of borrowed elements from the beginnings of Tschumi’s theoretical activity may be helpful in explaining the contents of his later writings motre inspired by philosophy of deconstruction. The set of his earliest views was inspired by Marxism, Neo Marxism and French Structuralism, mainly by the writings of Henri Levebre and Guy Debord. From the thought of Levebre Tschumi took interest for city as not only a question of urbanistics but also a political issue. From Debord’s concepts he borrowed a conviction about the role of situational violation for changes in the society structure. Some of these beliefs were preserved in his own concepts of architecture as an event. From this period derived also his will to change conservative elements of social structure not by means of political revolution but of theoretical and creative activity. Tschumi acknowledged that the effective way of the proceedings towards achieving his aims would be accepting the role of both a critical intellectualist and architecture expert who would not hide away his left-wing orientation. The speculations defined by the architect as ‘revolting analyses’ were about to characterise contradictions which tear the society apart, penetrate architecture and constitute the basis of culture. Spreading away of the conscience of false assumptions hidden away in various disciplines could have weakened cohesion of a conservative society and influence the will to change among the elites. This way the beginnings of political revolution were rooted in philosophy of architecture. In 1977 Tschumi published his text entitled The Pleasure of Architecture inspired by Roland Barthes’s The Pleasure of the Text, it also included some concepts derived from Georges Bataille and Jacques Derrida. First of all the author used Barthes’s concept which made an assumption that literary activity is pervaded by the spirit of resistance towards social rules, and Tschudi transferred this remark onto architecture. From the ideas of Bataille, acquainted via Holier’s work, he derived his belief that two concepts of space, a conceptual one (defined as Pyramid) and a sensual one (defined as Labirynth), not losing their distinct features, they join in the concept of experienced space which exceeds contradictions. The exceeding itself was defined as the basic rule of architecture and it was referred to situations in which architecture not only negates social needs, but also disavows its own tradition. Crossing the borders applies not only to political issues or permanent rules of the very discipline but also interfering with other fields (especially literature and film). The fact that architecture is associated with organising events turned Tschumi’s attention to questions of violence that result from upsetting architectural order of a given building by its users and the one hand, and on the other from forcing the users to specific acts imposed by this very order. The analysis of the concepts used by Tschumi in his early writings indicates that they are close to definitions that would occur in his reflection in the following years influenced by philosophy of deconstruction. -/- Approaching deconstruction Tschumi in his theories developed in the 1980s presumed that the current social world had undergone a deep process of decay, and the reaction against which ought to be based on ordering-up actions, and also preserving the main outline of disintegration of the whole and its elements in the state of conflict. The statements concerning the nature of the contemporary to Tschumi social relations were applied by him to the world of architecture, this led him to coming up with designing strategies that took into consideration the destabilised character of conditions in which works of architecture were created. New ways of conduct invented by Tschumi drew their inspiration from literature and research on literature, psychoanalysis, structural linguistics, structuralism and post structuralism, and eventually also deconstruction philosophy. The proposed methods were opposed by their author both to functionalism continuity trends and postmodern architecture. Tschumi’s proposals contradicted any forms of conservatism or traditionalism in political sphere as well as in reference to tendencies in architecture. They were not simple contradictions of social or architectural rules, they intrude them from the inside, weaken or escalate the already existing incongruities, they move the boundaries between the areas. Revolutionary illusions about the possibility of radical changes were replaced with strategies which completed, tainted or test former rules in the series of formal games of permutation and combination. Quite different from avant-garde formalism Tschumi’s games were not about maintaining the autonomy of a given area, but on the contrary – polluting it with other areas’ influences. Tschumi enjoyed demonstrating illusions of architecture concerning simple relations between form and function, or between form and meaning. Making use of Freud, Lacan and Foucault’s research he introduced a category of “madness” into architecture allowing an observation that the recognised norms are nothing but merely ones of many possible principles of behaviour, and their recognised status resulted from unjustified hindering innovativeness which is crucial for architecture. To reborn architecture’s capability of changing Tschumi also made use of Barthes’s discoveries concerning rules of narration and works by writers who applied in their writing knowledge on linguistics. Making a work’s author unclear by various mechanical transformations of its elements was however apparent only, and formal rigours imposed on the process of designing liberated possibilities difficult to obtain in more traditional creative action. Another mode of acting introduced by Tschumi was combining his work of elements deriving from outside architecture; joining space records with notation of motion and events accompanying architectural objects among others. These architectural and extra-architectural elements were not unified, on the contrary their heterogenous and conflictual character was stressed. This is how shock, anxiety and instability, typical for live in great metropolises, infiltrated architecture. Taking some ideas of deconstruction philosophy as a pattern Tschumi also took into critical consideration in his essays traditional in architecture oppositions between form and figuration, or theory and practice. By combining various inspirations he eventually worked out an idea of architectural event, which he understood as a series of actions contesting its own field, redefining its sources, principles and elements. An event, understood in this way, was not so much producing works as rather creating conditions of their production and at the same time designing the society different from a hierarchic one. -/- Park of deconstruction Among numerous philosophical strategies of deconstruction most frequently used was questioning the practice of strong opposition of two reasons. In many cases Bernard Tschumi’s writings just consider functioning of the conflict juxtaposition of the ideas of structure and ornament or theory and practice in history of architecture. Violation of traditional relations between terms of this kind, both old and modern, raised Jacques Derrida’s objections, when he was induced for the first time to co-operate with architects’ milieu. During this long lasting thought exchange the philosopher eventually acknowledged Bernard Tschumi’s arguments for reasoning the encroachment of architecture’s fundamental rules. Deconstruction applied in architecture was not a simple transposition or analogy of practices that had been applied by philosophy of deconstruction. We may even say that considering architectural terms became an important formula of deconstruction. Architecture understood in philosophical way became something beyond the practice and theory of its own discipline, a sort of metaphysics of both philosophy and architecture. The deliberate encroachment of simplicity of dividing architecture into theory and practice, for the first time became a clear aim for Tschumi in his drawings and texts entitled The Manhattan Transcripts. The contents of this series of works was a record of characteristic features of this New York district in such a way that not only objects were the subject of the record but also relations between objects, people and events. The record was about to take into consideration a conflict character of elements of this representation and at the same time to avoid applying to them the rule of mimetism. The record became a form of reflection over the very record by an increased control over the ways of representation. Architecture which was considered in the The Manhattan Transcripts was not directed to fulfill the needs of inhabitation or production, it was rather related with hitherto usually marginalised liminal situations: building ostentatiously big monuments, religious cult, war etc. Architecture operating in these relations focused also the attention on the included in it continuous tendency to overpass its own restrictions, the role of violence as its not recognised factor, or the meaning of excess and shock in its operation. Architecture moving from reason towards madness became even more visible in the design of Parisian Parc de la Villette, whose pavilions were defined as folies (in French it means both small park buildings and follies). The park was supposed to be on the one hand a reflection of traditional society disintegration while on the other it questioned basic rules of producing a work of architecture. The traditional rules of designing, based on ordering up, were replaced with the strategies of dysfunction and dissociation. In Tschumi’s opinion methods of this kind may be equivalent of what Derrida named différance. Instead of aiming at mergence, any diversity, plays or variations were strengthen. Tschumi’s texts, in which he explained his attitude, were completed by Derrida’s extent statement entitled Point de folie – Maintenant l’architecture. Derrida’s article is the most significant of all his statements on architecture as a form of thinking and activity. According to the philosopher, architecture should divide space (in French defined as espacement), what enables both thinking and action – it arranges the space of an event. Tschumi’s buildings, defined as folies, in an essential way destabilise any created order, and at the same time they refresh it. Derrida’s statement suggests that architecture may become both metaphor of an order merging a language or a society but also of inner forces which deconstruct and reconstruct it. Therefore architecture is at the same time a construction, a deconstruction and a reconstruction. Parc de la Villette stands out in this system with its attempt to step beyond the scheme of an easy repetition and its heading for chances of achieving more radical otherness. -/- Conclusion Destruction as construction. Paradoxes of deconstruction in architecture -/- Scepticism about persistence and common importance of fundamental values of human culture evinced in philosophers and writers’ works as early as in Greek antiquity, nevertheless it was not expressed so strongly as in the second half of the 20th century. Especially in Heidegger’s work Being and Time (although originated in 1927, still influential in all later philosophy) the following states were characterised: the state of losing the ground (Abgrund), of being out of sight (Unheimlichkeit) and of being out of dwelling (Un-zuhause-sein) – as the basis of self-confidence of conscious being there (Dasein). The entire criticism of philosophy of home and dwelling draws the inspiration from this early writing of the German philosopher, it combines crisis of basic terms of metaphysics with social conditions which are dictated by living in large metropolis. The crisis of both metaphysical foundation and home appears to be similar to the situation of weakening the relations between a man and his dwelling in extensively expanding cities. Whereas philosophy, as well as many disciplines of social sciences, have diagnosed for a long time the destabilisation of fundamental ideas of Western culture and crucial changes in the ways of dwelling, architecture itself occurred to be “the last fortress of metaphysics” (J. Derrida). Among contemporary architects, Peter Eisenman and Bernard Tschumi were the ones who engaged most decidedly in the issues of critical analysis of architecture foundation and its social role. Both the architects noticed new formulas of contemporary social and individual existence, tremendously different from the entire history, and at the same time they affirmed lack of adequacy of architecture concepts to new situations. Both Eisenman and Tschumi used to describe the existing architecture as a tool for consolidation of highly integrated and hierarchised societies, and also as a discipline extremely uncoincidental with the current character of social life based on ideas of freedom and diversity. The means to transform architecture and make a factor of further social changes out of it, was a concept that accentuated revealing the inner contradictions of this discipline, and considering them in designing strategies. Eisenman’s activity, in regard of what has just been noticed, was focused on questioning the basic rules of traditionally comprehended architecture, especially the rule of purpose. The American architect noticed that the concept of architecture as fulfilment the need of location, hides away the fact that the location has to be constantly reconsidered, and hence it is overtaken by change (dislocation). Therefore new concept of architecture propounded architectural activity to translocate the concept of location – more than before – but also to change its status perpetually. Such comprehended architecture should claim, as its main purpose, the constant revision of this purpose and create itself anew permanently. Even Eisenman’s earliest designs of houses nos. I-IV broke with such values as the sense of safety, closeness and familiarity, and just on the contrary they accentuated senses of strangeness, homelessness and loss of confidence. The contradictions within architecture noticed by Tschumi referred to combination of intellectual and sensual values in architecture, when their non-appropriation was defeated by an additional condition, namely the way of experience based on pleasure of excess, marked by insanity. The features of folly were especially visible in his designs of gardens, where the order of planning was mixed with sensual experience introduced by particular elements (both the ones created by nature, and the buildings defined as folies). Parc de la Villette designed by the French architect in Paris put in question not only the common understanding of purpose in architecture but also the ideas of order and integrity, as its plan was based on the combination of independent layers with records of grids of points, various lines and planes. The architecture that collides inadequate elements with each other was supposed to be a kind of an event with no beginning and no end. The architecture treated as an event became a form of a space weakened articulation that maintains its diversity and lack of accordance of the elements building it up. The analyses of Eisenman and Tschumi’s theoretical writings indicate how much the aims of architecture have actually changed; instead of supporting social persistence, the architecture is rather intensifying contradictions, and instead of providing people with the sense of safety, it sublimes danger. From simple acts of defamiliarisation, increasing the distance to itself and enhancing the role of theory, through discomfort, anxiety, not feeling someone at home, weirdness, excess, shock and violence, architecture reached the edge of stability and uncertainty, only to make an attempt at penetrating what is impossible and unutterable, and recording what cannot become the subject of any records. -/- . If ever a prize is to be given for the most cantankerous figure in the history of science and medicine, Almroth Wright will surely be on the short list. With the exception of himself, Wright was a man who did not tolerate fools lightly. Even the author of this biography, who tries very hard to see Wright's point of view, becomes exasperated with him at times. More commonly known today as Sir Colenso Ridgeon in George Bernard Shaw's The Doctor's Dilemma, (...) Wright was born of stern, fanatical Irish Protestant parents in 1861. Extremely gifted, Wright graduated first in modern languages at Trinity College, Dublin. After switching to and qualifying in medicine, a gadfly postgraduate career followed. His first permanent job was as pathologist at the army's medical headquarters at Netley near Southampton, where Wright developed the agent for which his name remains inscribed on the bacteriologists' roll of honor: prophylactic typhoid vaccine. Its passage into common use, however, was far from easy. Statisticians, clinicians, and military authorities lined up against him. Wright's belief in the vaccine's value was vindicated in World War I. The controversy over its efficacy has been analyzed by J. Rosser Matthews in his Quantification and the Quest for Medical Certainty . Dunnill does not refer to this, but, there again, scarcely any modern secondary source is recognized in this book. This is not that sort of a biography, which is not to decry its great merits. Dunnill is a pathologist who sticks very close to the primary sources, including large amounts of hitherto‐unpublished manuscript material. His approach is very evaluative of what Wright got scientifically right and wrong by today's criteria, but the judgments are made in a subdued and relatively unobtrusive way. This is a great virtue in dealing with any aspect of the volatile Wright. His views on woman's place in the world and her claim for the right to vote would drive any intolerant feminist historian to apoplexy. Dunnill, however, takes great pains to situate Wright's views in context.A man like Wright was never going to be happy at Netley since the military hierarchy weighed on him, crushing his individualism. Only the dictatorial control of an autonomous empire would suit him, and this is what he eventually got. Wright became the head of the pathology department at St. Mary's Hospital, London, and there he was effectively responsible to nobody. This was possible because he turned his laboratory into a vaccine‐producing factory and used the drug company Parke Davies to market his products. These included not only prophylactic agents but now‐discredited ones for the treatment of the then‐common bacterial diseases such as pneumonia. The Great War saw Wright in France struggling to introduce another innovation that was finally accepted. “Listerian antisepsis” was a hallowed phrase among surgeons, and the more infected war wounds became the more intense became their antiseptic applications—sadly, to little effect. Wright campaigned for simple saline washing of wounds, a practice eventually adopted with much better results. After the war, separated from his wife, at odds with the Medical Research Council, and estranged from some of his colleagues , Wright turned to the consolations of philosophy—unfortunately writing rather than just reading it. His otiose productions solving the riddle of the universe now lie unread. This conventional but highly readable biography offers no new insights into the science of the period, but it does merit attention as a study of the relations of personality and empire building. The ethical issues of health research are well documented. Ethical issues in occupational therapy research are beginning to attract the interest of researchers. However, no research has documented the ethical issues experienced by occupational therapists conducting research in academic settings in Quebec. This is revealed by the literature review that was the basis for this qualitative research, the results of which are presented here. This article also presents the results of a qualitative research conducted with eleven women occupational therapy (...) researchers in Quebec. A phenomenologically inspired qualitative approach was used. Semi-structured interviews were conducted to discuss the ethical issues experienced in occupational therapy research. Three units of meaning emerge from the narrative data, namely that ethical issues are related to: 1) the research environment; 2) people and their interactions; or 3) the occupation that is research. Overall, the results of the study and the literature review agree that health researchers, including occupational therapy researchers, operate in an environment that is not conducive to scientific discovery and responsible conduct of research. Ethical issues in research are primarily systemic in nature, contributing to the creation of unhealthy work environments that not only harm interpersonal relationships, but also adversely affect researchers’ occupational health and well-being and negatively affect researchers’ personal and family lives. Four new findings emerge from the study: 1) the academic world values individualism; 2) occupational therapists are rebellious towards research ethics boards; 3) clinical and academic environments are too disconnected; and 4) quantitative approaches can contribute to the exclusion of vulnerable populations. Each narration or text, as it informs about an event, situation or person in history, has a history that sheds light on both its formation and how it arrived to us. The illumination of this history is at least as important as the content analysis of the information. For this reason, it is necessary both to examine whether the source in which the information is given has survived to the present day as it was created by the author without being (...) exposed to any external intervention, and to analyze the narration in terms of reliability and indication within the integrity of the isnād-text. In that case, when the word “text criticism” is mentioned, an understanding of a specific criticism should come to mind, which includes both critical edition (scholarly editing) of the first source and the critique of the narration by making sound research in terms of isnād and literary criticism (naqd al-isnād wa-l-matn). Due to reasons such as the inability to follow a standard method, the limited number of the copies and/or the distance of the copies from the author in terms of history and commercial concerns, many classical works published with relative verification contain such errors require a re-examination. One of these works is Ibn Hibbān’s (d. 354/965) book al-Majrūhīn. In his work al-Majrūhīn, Ibn Hibbān divided the narrators into two groups according to their reliability and collected the ones that he determined as weak according to his opinion. In this work, he placed Abū Ḥanīfa (d. 150/767) at the top of the list. First, he denounced Abū Ḥanīfa with the following expressions: Sahib al-ra’y, child of slaves, bicker, hypocrite, had little knowledge of hadith, a Murji’ī propagandist, a narrator who was blamed by imams. Then he tried to justify these claims by about thirty narrations from various salaf scholars. These narratives are completely different from the largely intellecutal discussions and criticisms of scholars such as al-Awza'i (d. 157/774), Ibn Abī Laylā (d. 148/765) and Ibn Abī Shayba (d. 235/849) on Abu Ḥanīfa and his school. The narrations compiled by Ibn Hibbān are display insulting and polemical narrations against Abu Ḥanīfa’s personality and reliability. In terms of being a source for later periods, it is important to examine and criticize these narratives in terms of the narration techniques. The al-jarḥ wa-l-taʿdīl is important part of the hadith science. al-Mejrūhīn, one of the leading works of this science is remarkable in many respects. According to this narration Abū Ḥanīfa Nuʿmān b. S̱ābit b. Zūtā b. Māh’ın (öl. 150/767) said, "If a man worships this mule to get closer to Allah, I see no harm in it." According to our analysis, there are the following determinations about the narrators in the chain of this narrative. Ibn Abī Mushir is unknown (majhūl), the narrator who is written as “Mahfūz b. Abī Savba” but his correct name is “Tawba” is matrūk. Ahmad b. al-Walīd al-Mahramī al-Karkhī is weak, and Yahyā b. Hamza, source person, is qadari who narrates from people with munkar al-hadith; but is also considered as a thiḳa narrator. As for Sa‘īd b. Abd al-Azīz, he has nothing to do with the reception and transmission of the narrative. In addition, there is also a break in the chain. First of all, what is expected from a basic work such as al-Majrūhīn, whose subject and purpose is purely a narrator analysis, is that the report in it should be acceptable, at least in terms of isnād. When the narrative in question, which is also included in earlier sources such as al-Fesewī (d. 277/890), is evaluated in terms of both the isnād and the text, one realizes the transformation of an expression circulating in the form of gossip against Abu Ḥanīfa in Damascus around the subject of ʾirjāʾ. ʾIrjāʾ was at the forefront of the heated debates in the second half of the second century into semā form in terms of isnād and text, besides, the word النعل/clog is transformed into البغل/mule. Apart from the weak points of the chain, Sa‘īd b. Abd al-Azīz, who has nothing to do with the reception and transmission of the narrative, has also been turned into the narrator/source of the report with the samā expression. Regardless of the purpose and the criteria of the narration technically, during the conversation with Sa‘īd, Yahyā b. Hamza’s sincere friend and teacher, a special speech in which a common report attributed to Abu Ḥanīfa was expressed, was transformed into Yahyâ’s samā‘ in the form of jazm. As a result, the word “shoe” or “clog” has evolved into mule. It would be a reductionist and over optimistic approach to assume that all this may have resulted from tashīf and tahrīf of the copyists. The narration we discussed is a typical example in terms of showing the effect of the conflict of ideas between Ahl al-Hadīth and Ahl ar-Ra’y on the narrations. Honest signalling theory suggests that humans and chimpanzees can extract socially relevant information relating to personality from the faces of their conspecifics. Humans are also able to extract information from chimpanzees’ faces. Here, we examine whether personality characteristics of chimpanzees, including measures of psychopathy, can be discerned based purely on facial morphology in photographs. Twenty-one chimpanzees were given naïve and expert personality ratings on the Ten Item Personality Inventory (TIPI) and the Chimpanzee Triarchic Model of Psychopathy (CHMP-Tri) before and following (...) behavioural observations. Characteristics relating to openness, conscientiousness, extraversion, and disinhibition could be distinguished from the faces of chimpanzees. Individuals higher on disinhibition have lower scores on conscientiousness and emotional stability and higher scores on extraversion, while those higher on meanness have lower conscientiousness and agreeableness. Facial expressions are linked to personality traits present in the TIPI and CHMP-Tri models: the Relaxed Face and the Grooming Face were displayed more by chimpanzees higher on agreeableness, whereas the Compressed Lips Face was observed more in those individuals higher on boldness, and the Full Open Grin was displayed more by chimpanzees higher on extraversion but lower on emotional stability and conscientiousness. Facial expressions were also found to be associated with particular behavioural contexts, namely the Grooming Face in affiliative contexts and the Relaxed and Relaxed Open Mouth Faces in neutral contexts. Dominant chimpanzees display higher levels of boldness and more Compressed Lips Faces, Relaxed Open Mouth Faces, and Grooming Faces than subordinate individuals. These findings support and extend evidence for an honest signalling system and a personality structure shared between humans and chimpanzees. Future research could further explore how personality is conveyed through the face, perhaps through more than just singular aspects of character, and maybe reflecting what chimpanzees themselves are able to do. Lynne Rudder Baker and many others think that paradigmatic instances of one object constituting another—a piece of marble constituting a statue, or an aggregate of particles constituting a living body—involve two distinct objects in the same place at the same time. Some who say this believe in the doctrine of temporal parts; but others, like Baker, reject this doctrine. Such philosophers, whom one might call “coincidentalists”, cannot say that these objects manage to share space in virtue of sharing a temporal (...) part confined to just that place and time. But what can or should coincidentalists say about the nature of constitution? Many have analyzed the relation as one of sharing, “at some level”, all and only the same parts. Most have agreed that such massive part-sharing is at least a central component of and necessary condition for constitution. The heart of Baker’s Persons and Bodies, and its most significant contribution to the development of coincidentalism, is a theory of constitution that makes no appeal to mereology. The leading idea in Baker’s account is, instead, a modal one: objects belonging to constituted kinds are the necessary result of putting objects belonging to appropriate constituting kinds in the right circumstances, circumstances which the constituting objects need not have been in. So putting a piece of man-shaped marble in the right circumstances necessarily results in the existence of a second object, a statue, constituted by the marble; but the piece of marble need not have fallen into these circumstances or any others in which it would constitute a statue. BackgroundThe role of consent for research use of health information is contentious. Most discussion has focused on when project-specific consent may be waived but, recently, a broader range of consent options has been entertained, including broad opt-in for multiple studies with restrictions and notification with opt-out. We sought to elicit public values in this matter and to work toward an agreement about a common approach to consent for use of personal information for health research through deliberative public dialogues.MethodsWe conducted (...) seven day-long public dialogues, involving 98 participants across Canada. Immediately before and after each dialogue, participants completed a fixed-response questionnaire rating individuals' support for 3 approaches to consent in the abstract and their consent choices for 5 health research scenarios using personal information. They also rated how confident different safeguards made them feel that their information was being used responsibly.ResultsBroad opt-in consent for use of personal information garnered the greatest support in the abstract. When presented with specific research scenarios, no one approach to consent predominated. When profit was introduced into the scenarios, consent choices shifted toward greater control over use. Despite lively and constructive dialogues, and considerable shifting in opinion at the individual level, at the end of the day, there was no substantive aggregate movement in opinion. Personal controls were among the most commonly cited approaches to improving people's confidence in the responsible use of their information for research.ConclusionBecause no one approach to consent satisfied even a simple majority of dialogue participants and the importance placed on personal controls, a mechanism should be developed for documenting consent choice for different types of research, including ways for individuals to check who has accessed their medical record for purposes other than clinical care. This could be done, for example, through a web-based patient portal to their electronic health record. Researchers and policy makers should continue to engage the public to promote greater public understanding of the research process and to look for feasible alternatives to existing approaches to project-specific consent for observational research. The research focuses on the patterns of traditional religious and cultural practices of the Idoma People of Nigeria. The study also seeks to investigate the cultural beliefs and practices of the Idoma traditional society which were affected by the advent of Christianity in the area. Some of the cultural beliefs and practices of the Idoma people before the advent of Christianity will be examined, as well as the people response to the new faith and the propelling factors behind the responses (...) of the people. The study adopted qualitative phenomenological research design and descriptive method of data analysis. Personal interview forms a primary source of data collection while the secondary source includes library sources. The study reveals that the advent of Christianity in the Idoma traditional society had some impact and consequences on their traditional and cultural practices. Some of the Idoma beliefs and practices affected include ancestor veneration, polygamous marriage, burial rites, widowhood practices, naming ceremony among others which are no longer practiced the way it used to be practiced before the advent of Christianity. The study recommends among other things that, there should be a synergy between Idoma traditional beliefs and practices and Christianity for peaceful co-existence, progress and developments in the area. Many studies have investigated the effect of multilingualism on improving personality traits, namely cultural empathy, open-mindedness, flexibility, emotional stability, and social initiative of international students, or students in an international degree program. However, few studies have examined such an issue for EFL learners as they further their academic levels in English as a medium of instruction setting. The main tool used in this exploratory descriptive study was the short version of the multicultural personality questionnaire that was developed by Van der (...) Zee et al. Five hundred and seventy-seven Saudi female EFL undergraduates participated voluntarily across various academic levels, as well as recently graduated students; all of whom were exposed to various amounts of EMI. Prior to the study and before administering the questionnaire, the IELTS test was used to measure language proficiency of EFL learners to make sure that the collected data of the MPQ were analyzed statistically to generate means and standard deviations. The results of ANOVA test revealed that not only did all participants improved in cultural empathy followed by open-mindedness, but their improvement of the other dimensions of flexibility, social initiative, and emotional stability appeared to be randomly similar between only two or three groups of academic levels. The results also showed that there was no gradual sequence of developments or deterioration of any multicultural personality dimensions as students advanced in their academic levels or as a result of getting exposed to various amounts of EMI. Finally, this research provides some implications related to widening the scope of the study for further research such as comparing trilingual and bilingual learners and modifying the diagnostic ability of the MPQ. Although it is widely accepted that personal values of Self-Transcendence are a positive predictor of environmentalism, and Self-Enhancement values are a negative one, these results are not conclusive for all cultural contexts. Regarding political ideologies, research concludes that liberals tend to be more concerned about the environment than conservatives. However, this two-dimensional take on political ideologies does not grasp the diversity of political views, which could be achieved by focusing on political values. In this research, we studied the role (...) of personal and political values in predicting environmental attitudes and behavior in Kazakhstan, a developing country in Central Asia. Using an online survey, we found that Security was a strong predictor of both environmental concern and New Environmental Paradigm, overshadowing the effect of traditionally accepted value dimensions of Self-Transcendence and Self-Enhancement. While Self-Direction positively predicted environmental concern, Universalism and Benevolence were positive predictors of NEP. Among political values, Civil Liberties predicted NEP positively, and had no significant effect on environmental concern, while Free Enterprise predicted environmental concern negatively, and had no significant effect on NEP. Environmental concern was a strong predictor of all pro-environmental behaviors included in the study, fully mediating the effect of NEP. Based on personal and political values, three profiles of Kazakhstanis who engaged differently in pro-environmental behavior were identified. (shrink)

The damage caused by non-military aircraft to persons or property on the ground has long been a subject of international concern. Two key conventions were established to regulate liability arising from such damage: the 1952 Rome Convention, commonly known as the Rome Convention on “Damage Caused by Foreign Aircraft to Third Parties on the Surface,” and, later, the Montreal Convention of 2009, formally known as the “Convention on Compensation for Damage Caused by Aircraft to Third Parties.” The Montreal Convention was (...) a result of the signatory states to the Rome Convention recognizing the need to review and update certain provisions. Both the United Arab Emirates and the Kingdom of Saudi Arabia are signatories to this convention. While international regulations play a significant role, domestic legislation is equally critical. It is therefore incumbent upon nations to enact clear legal provisions to regulate the liability of aviation investors for damage caused by aircraft to third parties on the ground, from a national legal perspective. This study addresses an issue of critical importance, namely the need for precise regulations that clarify the conditions of an aviation investor’s liability for damage to third parties on the ground within the national legal frameworks of the UAE and Saudi Arabia. Through comparative analysis, this research seeks to address the legislative gaps found in the UAE’s Civil Aviation Law No. 20 of 1991 on this matter. (shrink)

This study investigated the circumstances and problems that departments of forensic medicine encounter with bereaved families regarding samples obtained from medico-legal autopsies. A questionnaire was posted to all 76 departments of forensic medicine performing medico-legal autopsies in Japan, and responses were received from 48 . Of the respondents, 12.8% had approached and communicated with bereaved families about collecting samples from the deceased person during an autopsy and the storage of the samples. In addition, 23.4% of these had informed families that (...) samples might be used in research. Eighteen departments had received enquiries and requests from families about the samples, with most requests concerning their return. The response to such requests varied according to the department. Few departments interacted with the bereaved families regarding the procedure for obtaining autopsy samples, and their methods for handling family concerns differed depending on the person within the department authorised to contact the family. Moreover, the procedures for engaging in such communication have long been unclear, and no legal or ethical consensus or agreement with the general public has been established. It is important for researchers to further discuss the correct way for forensic medicine departments to communicate with bereaved families. (shrink)

This paper is concerned with the semantics of proper names from two different points of view. As everyboy knows, there is a standard account of the semantics of proper names - it is Kripke's account, essentially. And there is a certain amount of neuropsychological research on proper names, or on the mental representation, or processing of proper names -not too small an amount, at this point. There is a certain amount of evidence, and there are a few theories, none of (...) them regarded as definitive, if I read the state of the art correctly. It may be thought that such neuropsychological work is simply irrelevant to the concerns of semantics, and vice-versa. For semantics is concerned with the truth conditions of sentences per se, and neuropsychology has nothing to say about that; neuropsychology, on the other hand, is concerned with several mental performances involving proper names -retrieving them from memory, or using them as cues to a person's face- and with their place within semantic memory, and semantics has nothing to say about that. The truth conditions that semantics is after are defined on the ground of a metaphysical notion of truth, whereas the only notion of truth that can be relevant to psychology is an epistemological notion: i.e. psychology may be interested in, and may have something to say about the procedures by which we come to regard a sentence as true, not about the conditions on which it is "objectively" true. The person most often credited as the first to free humanity from its bonds in the chain of being was the Renaissance humanist Giovanni Pico della Mirandola. Scholars have asserted that Pico's chain-of-being doctrine was either inspired or predated by earlier European thinkers, namely Marsilio Ficino, Nicholas of Cusa, Allan of Lille, and John Scotus Eriugena. By analyzing the works of the previously listed philosophers, this article argues that Pico's philosophical doctrine was in fact predated by no European writer. Instead, (...) as the analysis of his works will show, the Muslim mystic al-Ghazali was the first to elucidate the ideas that are presently attributed to Pico. Furthermore, after researching Pico's library and scholarly development, the possibility that Pico was inspired by al-Ghazali's writings is assessed. It may be the case that a large part of the philosophical underpinning of Renaissance Humanism has its origins in eleventh-twelfth century Muslim thought. (shrink)

A configuration of infantile attributes including a large head, large eyes, with a small nose and mouth low on the head comprise the visual baby schema or Kindchenschema that English speakers call “cute.” In contrast to the stimulus gestalt that evokes it, the evoked emotional response to cuteness has been little studied, perhaps because the emotion has no specific name in English, Norwegian, or German. We hypothesize that cuteness typically evokes kama muta, a social-relational emotion that in other contexts is (...) often labeled in English as being moved or touched, heartwarming, nostalgia, patriotic feeling, being touched by the Spirit, the feels, etcetera. What evokes kama muta is sudden intensification of a communal sharing relationship, either communal sharing between the person and another, or communal sharing between observed others. In accord with kama muta theory, we hypothesize that a kama muta response to cuteness results from a sudden feeling of communal sharing with the cute target. In colloquial terms, the perceiver adores the cute kittens and their heart goes out to them. When a person perceives cute targets interacting affectionately - that is, intensifying communal sharing between them - this should strengthen a kama muta response. We experimentally investigated these predictions in two studies (N = 356). Study 1 revealed that videos of cute targets evoked significantly more kama muta than videos of targets that were not particularly cute. Study 2, pre-registered, found that, as hypothesized, when cute targets interacted affectionately they evoked more kama muta and were humanized more than when they were not interacting. We measured the level of kama muta by self-reports of sensations and signs and of feelings labelled heartwarming, being moved, and being touched. Participants' ratings of kama muta were positively correlated with reported cuteness. In addition, as in our previous research on kama muta elicited by other types of stimuli, trait empathic concern predicted kama muta responses and perceived cuteness. One hundred and fifty years ago, a hopeful young researcher reported a recent discovery he had made. Working in the bowels of a medieval castle in the German city of Tübingen, he had isolated a then entirely new type of molecule. This was the birth of a field that would fundamentally change the course of biology, medicine, and beyond. His discovery: DNA. His name: Friedrich Miescher. In this article, the authors try to find answers to the question why—despite the fact (...) that virtually everyone nowadays knows DNA—hardly anyone remembers the man who discovered it. In the history of science, the discovery of DNA was a seminal moment. Why then did it not enter into public memory? Ground‐breaking discoveries can occur in a historical context that is not ready to appreciate them. But that's not all that decides who is remembered and who is forgotten. Scientific pioneers sometimes fail to publicize their findings in a way that ensures that they receive the attention they merit. As discussed here, their personalities and habits may cause discoveries to be “overwritten” by more recent researchers, resulting in distorted cultural memories no longer reflecting the initial event. Among the letters, memorabilia, manu­scripts, films, and tapes in the eighty-four warehouse boxes of the John Dewey Papers that came to Southern Illinois University at Carbondale in 1972 were a number of boxes that contained the books and journals from Dewey’s personal and professional library. The circumstances surrounding the growth of that library were these: after John Dewey died in 1952, the second Mrs. Dewey, Roberta Grant Dewey, continued to live in the same apartment with the couple’s two adopted (...) children. Upon her death in 1970, the household was dismantled and all the books there were packed away. The library therefore comprises the many volumes col­lected through the years by the two families of John Dewey: the first, John and Alice Chipman Dewey and their children—Lucy, Evelyn, Jane, Fred, Gordon, and Sabino; the second, John and Roberta Dewey and their adopted children—Adrienne and John, Jr. In addition to the books signed or anno­tated by Dewey—well over a hundred have marginalia—or inscribed to him, a number of books with the names of other family members have been included in this checklist because evidence exists that Dewey also used them; others have been included because they were available for possible use. Only school textbooks have been excluded. The checklist is divided into two basic sections: works in English and works in other languages; entries in both sections are anno­tated to indicate Dewey’s notes, marginalia, inscriptions, and similar information. Beyond its use as a research tool, both in editing the Collected Works and in verifying Dewey’s references, this checklist of Dewey’s library provides interesting, often important, insights into his life and work. No survey of the literature alone will yield these criteria; reasoned decisions about larger matters must be made. Vroom's inability to decide the meta-questions about truth and goodness is less significant in his final chapter on inter-religious dialogue, where he (...) looks for a schema of mutual understanding rather than for norms of successful communication. The stress on family resemblance helps him to avoid two mistakes. First is the idea that all religions are variations on one universal human activity, a position made untenable by the multitude of concerns embraced by every religious tradition and the absence of any one integrating feature. The second mistake he escapes is the belief that every religion is a unit having no overlap with any other and that consequently dialogue is impossible. Religions and the Truth traces the major world traditions so carefully that the overlap is obvious, hut it also makes clear that the overlap is various and fluctuating. Vroom has made a major contribution to the understanding of religion and to the conversation of religious people. Sabat (bio)Keywordslabeling, mild cognitive impairment, recall memory, selfhood, stereotype threatCorner and Bond (2006) raise a number of important conceptual issues related to the problems involved in defining mild cognitive impairment (MCI), differentiating it from normal aging, the definition of normal aging itself, and ethical issues surrounding the possible adverse effects of a diagnosis of MCI on the individuals thus described. It would (...) seem that portentous ramifications are involved and that clarifying the conceptual issues would be of great value, not only to researchers but also to the ever-growing population of elderly people. In what follows, I address some of these issues further.Problems of Definition and MeasurementOne of the problems that the authors discuss at the outset of their article concerns what methods are appropriate for detecting those with MCI: "Neuropsychological tests alone do not discriminate between normal aged-related memory loss and MCI or dementia and clinical judgment remains central to diagnosis" (Corner and Bond 2006, 5). Of course, to be able to discriminate between normal aged-related memory problems and MCI, we must first be able to define the former. What exactly is normal? As the authors correctly point out, the term has different meanings, one being normative (usual), another being nonpathologic. Is it normal (usual) for some sort of breakdown to occur in brain systems as a function of increased age? If so, is there a threshold age below which the very same physiologic breakdown is unusual? Would such a threshold age, if one existed, be the same for everyone, regardless of genotype and the cumulative interactive effects of nutrition, health, and stress-related factors over a period of decades? In effect, is some sort of memory impairment part of the natural (usual) process of aging for some people at particular ages rather than for others? And exactly what does it mean to be mildly impaired in the cognitive domain?Hogan and McKeith (2001) presented a working group's definition characterizing MCI such that people who complain about memory problems and who also provide objective evidence of such problems, yet who simultaneously display "normal general cognitive function and intact activities of daily living" (Hogan and McKeith 2001, 1131), should be identified and followed. Here again, however, we confront the problem of defining "normal general cognitive function" as well as "normal activities of daily living." Can one have normal general cognitive function without normal memory function? If so, what exactly constitutes [End Page 13] general cognitive function and on what conceptual or theoretical basis is such a definition valid? Furthermore, what sort of memory function are we talking about? Memory can be said to involve a number of stages: encoding, storage, and retrieval. Retrieval can be of the explicit type (conscious recall or recognition of specific information) with which people with Alzheimer's disease (AD) often reveal deficits or of the implicit type (a change in behavior as a result of previous experience of which the person may have no conscious recollection) as demonstrated in people with AD (Knopman and Nissen 1987). The greatest intensity of “live” life is captured from as close as possible in order to be borne as far as possible away. Jacques Derrida. Echographies of Television . Rainer Ganahl has made a study of studying. As part of his extensive autobiographical art practice, he documents and presents many of the ambitious educational activities he undertakes. For example, he has been videotaping hundreds of hours of solitary study that show him struggling to learn Chinese, Arabic and a host of (...) other languages. The stacked boxes of tapes are then presented like minimalist monoliths, dense archives of effort. About fifteen years ago, Ganahl began photographing the lectures that he attends. At the time, he hadn’t seen anyone else doing it, so besides his spare selection of images of the speaker and the audience, much of the time the lectures would just pass into memory, undocumented, or recorded in writing alone. Since then, he has felt the transition to digital cause a significant shift in his process. At the same time, he has seen the habit become ubiquitous as others photograph, record, and videotape the lectures all around him. In keeping with the theme of this inaugural issue of continent. , can we propose each small grouping of photographs that result an isthmus stretching between two disparate bodies of mind? The first being the body of the lecture as spelled out in the title of each work – the experience of the event in all its constituent parts. The second is the body of the recipient, the listener, in this case an artist, who plays a minimal role just beyond the prescripted behavior of sitting and listening. He uses a gesture of documentation to draw a line between himself and the event, creating an artwork. Františka + Tim Gilman: As we mentioned before, the theme of the magazine for this issue is "isthmus." It seems like a very good way into your work, and it leads us to ask what connection you see between your photographs of the lecture and the lecture itself? Rainer Ganahl: The relationship is of course a concrete, pictorial one, or if you want a mimetic one but also an abstract one because the photographs carry the title of the lecture, the names of the lecturers, the site, the institution and the time of the lecture. Photos are fixed moments of time and can reproduce images displayed and reproduce visuals presented at a moment but they don’t come with time based recordings that video or sound takes are offering. What remains of a lecture is usually just the memory, some notes and all the announcements of it. In my case I end up with a visual product I declare as my artwork. It might not differ from any snapshot taken by any other student or member of the audience but I do this in a semi-systematic way with certain rules and procedures I have set up. While I am at a lecture I am mainly focusing on the lecture itself. Last night I went to one of Slavoj Žižek which demanded quite some concentration. I even was asking him a question at the end. I took photos as well but still didn’t lose track of the lecture. I didn’t walk around, I was not preoccupied by where I was sitting and what light I was having like some of the other photographing and filming people in the room who came and left, moved around and tried to capture him from this and that angle, from close and far. I just sat there and concentrated on the lecture and yet managed to take about 30 or so images of him, the public around me and of the film clips he presented. Once the lecture is over the story changes: it all becomes a question of the images, their selection, their visual qualities, their labeling and archiving. The function of the images also change: not only do they stand for an intellectual event in a row of lectures that become part of my intellectual history within many possible such histories but they also have to function as art, something not everybody else with images of lecturers demands of their images. This is my specific claim as an artist to impose them as artworks. And as with all artistic propositions the offer can be accepted or rejected. I basically spend my life trying to do exactly that: making what I declare as art, offering something to anybody interested in it as my art, an offer that is not and will never be accepted as such by all people. F+T: What are your criteria for selection, i.e. how do you choose which lectures to photograph, by lecturer, by topic, or do you photograph any and every lecture you can? RG: As everything in my life, I go by my interest which is the result of many factors. If I am aware of a lecturer, read his books or appreciate his works my interest of attending his much higher than if I am not aware of it. I usually don’t go to lecturers simply based on their subjects—something that can happen of course, if the subject, the title of the lecture is promising or at the heart of my interest. Sometimes I also wait for years to get a change to photograph certain people but I do that in a very low-level “keep your ears up” mentality and not in a systematic scanning of all channels and possibilities. I do not go into philosophy departments and photograph everybody teaching there. I go with the flow—and unfortunately a great deal of great talks I also miss because I hear too late of them. Often, I also stumble into them by traveling, by getting emails from friends and by simply being in the right spot at the right time. Somehow you could look at my lecture par cours as some kind of loose intellectual flâneurism . If you know of interesting lectures and events, please, let me know. F+T: Is your selection of images more of a production or post-production method? That is, do you take a lot of photos and select only a few images from each lecture, or do you take them very selectively? Do you have a particular methodology for the selection of images? RG: This all changed a bit with the arrival of digital photography. In the beginning I had to pay a lot of money for film developing. Hence, I was taking either one role - 36 images - or half a role - 13 images - depending on who talked and whether they projected images. With the unlimited capacity of digital imaging I easily end up between 30 and 150 images of one event still depending of whether images are presented or not. In the first years of that project when I wasn’t fully aware yet of what I was doing, I printed at least 2 images of any lecture and sometimes three or even four, a choice that was also constrained by costs. But again, since I have a web site and since images can easily be selected and presented on my web site without generating remarkable costs I have now more and more pain to reduce them to less than ten or eight images for an event. Now, before I have them printed which really is expensive, I can present them already as artwork on my web site without any immediate costs. Thus the economic factor is at the end of the chain which enables me to be more ‘generous’ and include more images. Over the last years I have been mostly selecting at least four photographs for a lecture unit but recently also as many as ten. But so far only one set above four images has been actually printed and sold. What might sound even more shocking is the likely fact that if a curator or a collector demands me to reduce the number of images due to costs, I might compromise at this current stage if the images have not been yet printed or published outside my own web site. This means that to a certain degree any selection that has only seen publication on my web site and not yet been produced runs the risk to change in numbers of images included. Needless to say, I am the last one that finally makes a decision and I do honor all given earlier decision if those were final. F+T: How do you feel the act of photographing the lecture affects your reception of the contents of the lecture? And your recollection afterwards, do you remember the lecture more having photographed it, or just having sat and listened? RG: As mentioned above, I get very little distraction from photographing since I can multitask well and do not obsess about the quality of the image: I photograph from where I am and listen with my ears and not my eyes. I am not sure whether the images serve as a mnemonic devise to the content of the lecture if there are no images involved but they at least remind me that the lecture existed, the title of the lecture and the name of the people and institutions involved. The titles of the hundreds of lectures I took during the past 15 years can also be read as an essay of theoretical life in that period. This will be come more and more visible as time passes by. These images age much better than I do. F+T: You mentioned at the outset of our discussions that you started this practice some time ago and have seen the practice of photographing lecturers become more commonplace. Why do you think that this shift has taken place? RG: The answer is very simple. Photographing is now free of any charge and hence omnipresent. You buy a phone or any other personal digital assistant and it has a camera integrated in it whether you want it or not. There is no need to develop images and there is no hassle to keep images, to distribute images, to organize images and save them. It is all virtual, not creating any costs and doesn’t require any efforts. You don’t spend twenty dollars for photo-developing anymore, you don’t need to walk anymore to your pharmacy or your photo shop to drop off and return to pick up and pay. You don’t need to go to the post office to send somebody a picture. You have a program like Photoshop already built into your camera. Photographing is now a thing for everybody—with functioning cameras made for two year olds. It is technically now nearly impossible to make bad images. The image quality is virtually guaranteed by cheap, high performing, mini-computers packed into miniscule cameras. With all these technological changes, we are undergoing now a cultural paradigm shift that includes permanent recording (not only still image taking) of everything. I wonder even whether babies are just born to be photographed—at least a process where the first photograph is right there. What is interesting now, is how the law is trying to catch up. I am experiencing and expecting more restrictions on photographing and recording—something already in place in many museums and in certain galleries—as the recording devices become more and more invisible and undetectable. It is an interesting cat and mouse play and will end up with some of us that are photographing the world around us in court. The world has become very transparent and everybody is contributing to it with social networking technologies—like twitter and Facebook—that are designed to monitor and communicate every step we make in our lives. F+T: Why did you start the practice? As a way to remember, or to capture the experience of the lecture and the environment there? RG: A couple of years earlier I started to photograph my own reading seminars as part of my art work with results that surprised me positively. I really liked these images of students and people discussing heavy non-fiction with me. The reading seminars justified this kind of pictorialism. Then in 1995 I had the chance to attend an entire seminar by Edward Said entitled “The Representation of Intellectuals at Columbia University,” which really gave me the idea to start this series. Why not also photograph these lectures I visit all the time since this really is a way of representing intellectuals? F+T: The constellation of images and the title seem like a kind of portrait, do you agree? If so, is it a portrait of the speaker, of yourself, or of the event? RG: Well, to follow up on the previous question the lectures are more than just portraits of lecturers since I include not only the speakers but also the audience, an audience that is not named or specifically highlighted as is the speaker. So if we stick with the metaphor of the portrait we would have to extend it also to the environment, the class room, the lecture hall, the arrangements of seats or benches, tables, lecture stands and other stuff typically seen on my images. Often the walls are decorated or even tagged with graffiti or posters and other stuff. There is a big difference between a small seminar room at the English Department of Columbia University, full with books and cabinets and a lecture room at a Paris or Frankfurt university that accommodates 50 to 150 people. We should, maybe, also distinguish between lectures that are one time events—mostly open to the public, free of charge or paid—and events that are weekly, closed to the public and held mostly in universities that can cost fortunes or be paid by the State as it is still predominantly the case in continental Europe. All this, of course, is not necessarily announced in the title of the lecture and is subject to information that isn’t visible on the images. To a certain degree we see also portraits of a general privilege when it comes to the public of certain institutions that are highly selective and extremely costly without forgetting that most of the lectures are dealing with theory, art, philosophy and other highbrow subjects. In general, I would say we see very little if we don’t know already what’s going on, who the lecturer, the institutions, the context are in which we subsequently can zoom into variants like sexual, racial, or age-related make-up without ignoring clothing fashions, hair styling, body mannerisms, gadgets and stuff. F+T: Do you see a relation between this body of work and your other work, for example your language studies? RG: Everything I do is “unfortunately” related. I say unfortunately because this makes my work not so easy to grasp. The relationship to the language studies is relatively clear since both are originally grounded in the domain of education and knowledge production. Nearly all my work comes across that nexus where knowledge and power are addressed. I was at one point wondering what the relationship was to some of my earlier indexical work where I was happy alone with footnotes from books painted on the walls: I came to understand that both are just different manifestations of knowledge and information. F+T: Do you foresee continuing the series indefinitely, or is there an end to it? RG: I think that I will continue this series indefinitely or to be more precise, as long as I go listen to lectures and want to learn something which brings me to your previous question: What do the reading seminars, language studies, historical research and lecture hopping have in common: I learn something. istovremeno otkriva Božje tragove. Štoviše, po njemu je upravo pomoću prirodnih znanosti moguće uhvatiti i shvatiti Božju za-misao. Ovakvo gledanje na prirodu u XVIII. stoljeću je sačinjavalo sukus »prirodne teologije«. No, Einsteinov život i djelo se smještaju cijela dva stoljeća kasnije. Stoga je sasvim na mjestu istraživanje nekih teoloških implikacija Einsteinove fizikalne slike svijeta. Jer upravo je Einstein svojim najvažnijim prirodoznanstvenim otkrićima, točnije specijalnom teorijom relativnosti i općom teorijom relativnosti istovremeno »pokopao« dva i pol stoljeća dugu vladavinu newtonovske slike svemira, (...) bazirane na fizikalnim postulatima klasične mehanike, i postavio solidne temelje za uspostavu nove slike svemira, bazirane na fizikalnim postulatima kvantne mehanike i na načelu neodređenosti. Tom je epohalnom obratu, u smislu znanstvene revolucije i smjene paradigme , kumovao Einstein, koji je doslovno potkopao tradicionalne temelje poimanja stvarnosti, svodeći takoreći sav problem na jednu konstataciju: »Jedina stvar koja je neshvatljiva o svijetu jest ta da je on shvatljiv« . A ta je činjenica uvjetovala burnu filozofsku i teološku raspravu koja traje do danas. No, na pitanje canterburyjskog nadbiskupa R. Th. Davidsona: »Kakav bi učinak relativnost mogla imati na religiju?«, Einstein je bez oklijevanja odgovorio: »Nikakav. Relativnost je čisto znanstvena stvar i nema ništa s religijom.« Istina, direktno ne baš, ali indirektno veoma kompleksan i izazovan učinak. Stoga su u istraživanjima teoloških implikacija Einsteinove fizikalne slike svijeta dva teološka pitanjaneizbježna. Prvo, što točno znači riječ ‘Bog’ za Einsteina? Drugo, koje implikacije ima priziv na Boga za Einsteinovu matematiku i fiziku? Budući da, nasuprot uvjerenju mnogih u Einsteinov ateizam, postoji također uvjerenje mnogih u njegovo duboko religiozno iskustvo koje se temeljilo na štovanju »misterija« svemira, nameće se i treće, najzahtjevnije teološko pitanje, čiji odgovor doduše ne ovisi o odgovorima na prethodna dva pitanja, ali itekako može baciti dragocjeno svjetlo na njihov smisao i značenje. Naime, i židovska i kršćanska i islamska teologija polaze od vjere u jednoga Boga kao Stvoritelja svijeta. Svijet je, stoga, eminentno stvorenje, tj. učinak Božje stvarateljske volje, dakako, misleći pritom pod pojmomsvijeta cjelokupnu materijalnu stvarnost, a ne samo ljudski svijet. Teologija, dakle, govori o svijetu kao stvorenju, dok prirodne znanosti govore o svijetu kao prirodi, tj. govore o prirodnom svijetu. To je razlog zašto kršćanska teologija ne može ostati postrance glede načina prirodoznanstvenog opisivanja svijeta, budući da je u samu narav teologije upisan zahtjev za neprestanim preispitivanjem uvjeta i mogućnosti usklađivanja tih opisivanja s pretpostavljenomvjerom u Bog kao Stvoritelja svijeta. Židovska i kršćanska vjera u stvaranje svijeta potvrđuje da ama baš ništa ne postoji što ne bi bilo stvoreno od Boga, pa tako ni materija. Dakle, treće teološko pitanje možemo formulirati ovako: Kakav je odnos realno moguć između Boga i njegova stvorenja u kontekstu nove – prirodoznanstvene – slike svijeta?The research of religious experience of great minds since ever represents demanded, but yetprovocative and controversial enterprise. And when that research is focused on one of the mostrenowned physicists of the twentieth century, which could also mean of all times, Albert Einstein, than the subject obtains in weight, but no doubt also in attractiveness. Thisfactis due to the pureevidence of Einstein’svery often mentions of religionand God in hisscientificand popular writings. Maybe often mentions of Einstein’spersonal views of religionandGod arefar moresignificant in his private letters and various public meetings with people.For example, Max Jammer,a philosopher,physicist, and former Rector of the Bar-IlanUniversityof Jerusalem in Israel, illuminating meticulously Einstein’sintimate, e.g. personal,andprofessional,e.g. scientific, relationto religion,affirms that his physical cognitions andhis understanding of religion are profoundly bound. For Einstein, in such supposed complex ofrelations, the cognition of nature simultaneously reveals Divine traces. Moreover, according tohim precisely by means of natural sciences becomes possible to capture and comprehend Divinethought. Indeed, such view of nature in eighteenth century formed a core of natural theology.However, Einstein’s life and work find place two and a half centuries later. Therefore it is aright place to research some theological implications of Einstein’s physical, e.g. scientific, viewof world, because just Einstein by his most important scientific discoveries, more exactly byspecial and general theory of relativity, simultaneously “buried” two anda half centuries dominated Newtonean mechanistic worldview, based on physical postulates ofclassical mechanics, and placed solid foundations for later establishing a new worldview, basedon physical postulates of quantum mechanics and the uncertainty principle. Behind this epochmakingturn, in terms of scientific revolutionand paradigm shift , was Einstein wholiterallyundermined the traditional foundations of comprehensionsof reality,reducing,so tospeak,a whole issue at one sentence: “The only thing that is incomprehensibleabout the worldisthat it is comprehensible”. This whole story has stipulated tempestuous philosophicaland theological debates, and these debates aregoing on up to nowadays. On the quest ofRandallThomas Davidson, the Archbishopof Canterbury: “What effect relativitywould haveonreligion?”Einstein without hesitation replied:“None. Relativity is a purelyscientific matterandhas nothing to do with religion”.Is this true? Indeed, none could be true for directeffects,butthose indirectprovokedvery complex and defiant challenges for theological explanations ofthecreatedreality.Thereforetwo theological questions seem to be unavoidable within researchoftheological implications of Einstein’sworldview.First, what exactly means a word‘God’forEinstein?Second, what implications have an appeal to God for Einstein’smathematics andphysics?Since vis-à-vis conviction of many in Einstein’satheism, thereis also conviction ofmanyin his deep religiousexperience originally based on devotion of “mystery” of the universe,than raises the thirdand the most demanded theological question, whose answer to be suredoesn’tdepend upon answers on previoustwo, but can cast some light on their true meaning.Namely,Jewish, Christian, and Islamic theology is presupposinga faith in one God as Creatorofthe world. Thereforethe world is eminently creationor directeffect of the agency of Divinecreativewill. The word‘world’embraces herean entirematerial reality,and not only the worldofman. Consequently,theology speaks about world as creation,while natural sciences speakaboutworld as naturethat is as natural world. This is the motive why Christian theology cannotremainat a distance fromfashion of natural-scientific description of the world, since it is inscribedin the same coreof theology a demand for continuous reexaminationof conditions andpossibilitiesfor harmonizing of those descriptions with supposed faith in one God as Creatorofthe world. Jewish and Christian faith in the creationof the world confirms that just nothingexists,neither matter as well, without Divine creativewill. Now the thirdtheological questionsoundslike this: What a relationis reallypossible between God and His creationin the contextofa new – natural-scientific – worldview? (shrink)

Personal data protection is an ethical issue. In this study we analyzed how research ethics committees (RECs) and data protection officers (DPOs) handle personal data protection issues in research protocols. We conducted a mixed-methods study. We included heads (or delegated representatives) of RECs and DPOs from universities and public research institutes in Croatia. The participants provided information about data protection issues in research and their mutual collaboration on those issues through structured interviews that contained closed and open-ended questions. (...) Qualitative description was used to analyze open-ended questions. The results showed that 55% of the REC representatives were not aware who was DPO in their institution. Among RECs, 65% never contacted the DPO. There were 61% of RECs who reported that they received no training from the organization on personal data protection. When asked about barriers to personal data protection in their institutions, 26% of REC members highlighted the lack of a clear protocol for assessing personal data protection issues, while 30% of DPOs mentioned lack of knowledge among researchers about personal data. In conclusion, we found that when it came to protecting personal data in research protocols, RECs and DPOs hardly ever worked together. When developing future personal data protection policies for academic and scientific research institutions, it is essential that RECs and DPOs should collaborate and both continue to expand/update their knowledge on personal data protection procedures.
