The article aims at organizing multifaceted discourse on the concept of nondirectiveness in the practice of genetic counseling. The analysis of areas where nondirectiveness was invoked and discussed reveals the problematic confusion of different meanings of the term that often leads to false conclusions about the relations between the professional standards and the practice of genetic counseling. The article offers clear and comprehensive description of different approaches to nondirectiveness and various ideas associated with the term. Normative consequences of (...) various meanings attributed to nondirectiveness are explored. The article concludes by presenting important but unsolved problems regarding both theory (the meaning of nondirectiveness and its operational definition) and practice of genetic counseling (the scope and content of the norm of nondirective counseling). The concepts and powerful mathematical tools of Dynamical Systems Theory (DST) yield illuminating methods of studying cognitive processes, and are even claimed by some to enable us to bridge the notorious explanatory gap separating mind and matter. This article includes an analysis of some of the conceptual and empirical progress Dynamical Systems Theory is claimed to accomodate. While sympathetic to the dynamicist program in principle, this article will attempt to formulate a series of problems the proponents of the (...) approach in question will need to face if they wish to prolong their optimism. The main points to be addressed involve the reductive tendencies inherent in Dynamical Systems Theory, its somewhat muddled position relative to connectionism, the metaphorical nature DST-C exhibits which hinders its explanatory potential, and DST-C's problematic account of causality. Brief discussions of the mathematical and philosophical backgrounds of DST, seminal experimental work and possible adaptations of the theory or alternative suggestions (dynamicist connectionism, neurophenomenology, R&D theory) are included. The French molecular biologist François Jacob outlined a theory of evolution as tinkering. From a methodological point of view, his approach can be seen as a biologic specification of the relation between laws, describing coherently the dynamics of a system, and contingent boundary conditions on this dynamics. From a semiotic perspective, tinkering is a pragmatic concept well-known from the information-theoretic anthropology of Claude Lévi-Strauss. In idealized contrast to an engineer, the tinkerer has to accept the concrete restrictions on (...) his material resources as only gradually changeable constraints on his projects. Jacobian biopragmatics examines evolution as a biologic analogue to human tinkering devoid of any projecting subjectivity. To validate this analogy, four basic principles concerning main formal aspects of evolutionary objects, agents, histories, and consistency criteria are proposed. (shrink)

The general topic of this book is the theory of categories, its sources, meaning and development. The inquiry can be seen to proceed on two levels. On one, the history of the theory is traced from its alleged genesis in Aristotle, through its main subsequent stages of Kant and Hegel, up to a kind of consummation in two of its prominent twentieth century adherents, Alfred North White head and Nicolai Hartmann. Special attention has been paid to that aspect (...) of the Hegelian conception of the categorial analysis from which the principle of coherence emerged. On the second, deeper level, however, everything starts with Whitehead's metaphysical system, the central part of which con sists of a fascinating, though highly intricate, web of categorial notions and propositions. The historical perspective becomes a means for untangling that web. I am indebted to a number of people for advice, comment and criticism of various parts of this book. Quantum technologies can be presented to the public with or without introducing a strange trait of quantum theory responsible for their non-classical efficiency. Traditionally the message was centered on the superposition principle, while entanglement and properties such as contextuality have been gaining ground recently. A less theoretical approach is focused on simple protocols that enable technological applications. It results in a pragmatic narrative built with the help of the resource paradigm and principle-based reconstructions. I discuss the advantages and weaknesses (...) of these methods. To illustrate the importance of new metaphors beyond the Schrödinger cat, I briefly describe a non-mathematical narrative about entanglement that conveys an idea of some of its unusual properties. If quantum technologists are to succeed in building trust in their work, they ought to provoke an aesthetic perception in the public commensurable with the mathematical beauty of quantum theory experienced by the physicist. The problem of person’s social formation becomes especialy actual in all its aspects during the periods of social historical transformations. The guiding lines of individual’s development accepted by society (socialization norms) are either lacking or being overthrown. Such situation demands from the researchers to switch their attention from the mechanisms of sociality reproduction to the mechanisms responsible for the sociality formation. The last ones become the main subject of the self-organization theory (synergetics). According to it, socialization can be represented (...) as the self-organizing system-process. The principle of causality has traditionally been formulated in terms of the dynamic equations of classical physics. It has been believed that only stable (conservative) systems can be meaningfully studied in this way. The evolutionary systems studied by social scientists and biologists are non-conservative, and so are excluded from the traditional formulation of causality. The author argues that causal laws for non-conservative systems can be meaningfully formulated. An example based on Malthus'' population theory is given.

Any part of the world can be viewed and modelled in terms of its chosen qualitative and/or quantitative properties, OR its structure. The former approach has been used by nearly the whole of ‘human intellectual endeavor’, i.e conventional science of physics, the arts etc. Development of the latter or the ‘systemic view’ is the subject matter of the current work. The Purpose of Change is Problem Solving suggests that the ‘structural view’ is empirical, pervasive throughout experience and as such results (...) in a single domain as opposed to conventional science which consists of many domains like mechanics, electricity etc. Thus, a unique approach is required which is based on ‘general principles of systems’ translated into operational form by the symbolism of processed natural language called ‘linguistic modelling of scenarios’ which can carry mathematics and uncertainties. To model scenarios with complex structure, a description or story in natural language is expressed in terms of homogenous language of one – and two – place sentences, the ‘elementary constituents’ of which complex structures can be constructed [like a variety of buildings from bricks]. To correspond to the single domain, based on the logic of causation, a single scheme of ‘Management/producers – Product – User/consumer’ is proposed which is immediately applicable to structuring scenarios and guides their detailed linguistic modelling or design. The approach, subject to debate, can have significant impact on society and education, especially that of engineering which lacks a ‘comprehensive theory of structure’ of problematic scenarios. We presented a contextual statistical model of the probabilistic description of physical reality. Here contexts (complexes of physical conditions) are considered as basic elements of reality. There is discussed the relation with QM. We propose a realistic analogue of Bohr’s principle of complementarity. In the opposite to the Bohr’s principle, our principle has no direct relation with mutual exclusivity for observables. To distinguish our principle from the Bohr’s principle and to give better characterization, we change the terminology and speak about (...) supplementarity, instead of complementarity. Supplementarity is based on the interference of probabilities. It has quantitative expression trough a coefficient which can be easily calculated from experimental statistical data. We need not appeal to the Hilbert space formalism and noncommutativity of operators representing observables. Moreover, in our model there exists pairs of supplementary observables which cannot be represented in the complex Hilbert space. There are discussed applications of the principle of supplementarity outside quantum physics. (shrink)

The art of memory started with Aristotle’s questions on memory. During its long evolution, it had important contributions from alchemists, was transformed by Ramon Llull and apparently ended with Giordano Bruno, who was considered the best known representative of this art. This tradition did not disappear, but lives in the formulations of our modern scientific theories. From its initial form as a method of keeping information via associations, it became a principle of classification and structuring of knowledge. This principle, which (...) we here name differentiation with stratification, is a structural design behind classical mechanics. Integrating two different traditions of science in one structure, this physical theory became the modern paradigm of science. In this paper, we show that this principle can also be formulated as a set of questions. This is done via an analysis of theories, based on the epistemology of observational realism. A combination of Rudolph Carnap’s concept of theory as a system of observational and theoretical languages, with a criterion for separating observational languages, based on analytical psychology, shapes this epistemology. The ‘nuclear’ role of the observational laws and the differentiations from these nucleus, reproducing the general cases of phenomena, reveals the memory art’s heritage in the theories. Here in this paper we argue that this design is also present in special relativity and in quantum mechanics. (shrink)

This paper investigates the semantic bases of class membership in the noun class system of Gújjolaay Eegimaa (Eegimaa henceforth), a Niger-Congo and Atlantic language of the BAK group spoken in Southern Senegal. The question of whether semantic principles underlie the overt classification of nouns in Niger-Congo languages is a controversial one. There is a common perception of Niger-Congo noun class systems as being mainly semantically arbitrary. The goal of the present paper is to show that physical properties and (...) culture-specific factors are central principles of semantic categorisation in the Eegimaa noun class system. I argue that the Eegimaa overt grammatical classification of nouns into classes is a semantic categorisation system whereby categories are structured according to prototypicality, family resemblance, metaphorical and metonymic extensions and chaining processes, as argued within the framework of Cognitive Linguistics. I show that the categorisation of entities in the Eegimaa nominal classification system productively makes use of physical properties such as shape as well as using culture-specific, less productive parameters for the semantic categorisation of entities denoted by nouns. The analysis proposed here also shows that the cases of multiple morphosyntactic classifications of nouns reflect multiple conceptual categorisation strategies. A detailed examination of the formal and semantic instances of multiple classification reveals the existence of conceptual correlations between the physical properties and the culture-specific semantic parameters of categorisation used in the Eegimaa noun class system. This paper examines John Rawls' renowned theory of justice, which outlines two principles of justice and their respective significance. It explores how Rawls' notion of equality aligns with the philosophical concept of equity, emphasizing that his call for citizen equality inherently incorporates fairness. Additionally, the paper discusses the application of Rawls' "Difference Principle" to India's reservation policy. Rawls' principles, which aim to support the worst-off in society, are reflected in India's system of reservations for marginalized groups, (...) including backward classes and differently-abled individuals, to promote equitable opportunities. However, the paper cautions that excessive reservations could limit opportunities for more privileged groups. Ultimately, it is argued that Rawls' concept of social justice has contributed to the promotion of social justice in India. (shrink)

The article introduces recursive ontology, a general ontology which aims to describe how being is organized and what are the processes that drive it. In order to answer those questions, I use a multidisciplinary approach that combines the theory of levels, philosophy and systems theory. The main claim of recursive ontology is that being is the product of a single recursive process of generation that builds up all of reality in a hierarchical fashion from fundamental physical particles to (...) human societies. To support this assumption, I provide the general laws and the basic principles of recursive ontology as well as a semi-formalised model of the theory based on a recursive generative grammar. Recursive ontology not only actively promotes a multidisciplinary investigation of reality, but also can be used as a general framework to develop future domain-specific theories. (shrink)

The purpose of the article is to clarify the structure of the principles of legal responsibility in Ukraine. The leading methodological approach of the research is the structural-functional approach, which allows to consider the principles of legal responsibility as elements of the normative part of the legal system, which have their own functional (...) purpose. The article defines the structure of the principles of legal responsibility; it was established that certain legal responsibility principles were considered as essential elements of the system of legal responsibility principles; the basic requirements for the structure of the legal responsibility principles, which make up its content, are revealed. The concept of truth is now a major research subject in analytic philosophy. At the same time, working in different areas, mathematical logicians have developed sophisticated theories of truth and its formal paradoxes. Recent developments of semantical paradoxes in logical theories are highly relevant for philosophical research on the notion of truth. And conversely, philosophical guidance is necessary for the development of logical theories of truth and the paradoxes. From this perspective, this volume intends to reflect and promote deeper interaction (...) and collaboration between philosophers and logicians investigating the concept of truth than has existed so far. In addition to an extended introductory overview of recent work in the theory of truth, the volume includes articles by leading philosophers and logicians on subjects and debates that interface logical and philosophical theories of truth. The volume is intended for graduate students in philosophy and in logic who want an introduction to contemporary research in this area, as well as for professional philosophers and logicians. The core principles of 7th century Korean Buddhist thinker and practitioner Wŏnhyo’s harmonization in non-obstruction thought and Wilberian Integral Theory may help us to understand ourselves and the world better and thus act and live well together accordingly in this contemporary world facing global crises. Whatare particularly noteworthy in Wŏnhyo’s thought and life is that as much as reality is unobstructed (無礙) in its profound calm so can our mode of being and relationships be awakened to its natural (...) harmony free of conflicts (和諍會通). This ideal can be optimally pursued by coming back to the source of One Mind (一心) while extensively benefiting sentient beings. Wŏnhyo consistently pursued and realized this soteriological project through his practice, works, and expediently dedicated life. The most recent version of Wilber’ Integral Theory consists of Integral Approach, Integral Methodological Pluralism, and Integral Post-Metaphysics. Their core principles consist of the AQAL (all quadrants, all levels, all lines, all states, and all types) and holons with their twenty tenets (holonic laws). Extensively utilizing scientific achievements Wilber attempted to map the whole developmental territory of occasions ranging from matter to Spirit or Emptiness and to formulate the Theory of Everything and then apply it to various fields including business, spirituality, and ecology. Within this framework, however, MarkEdwards tried to add an integral epistemology with its interpretive part and to complement Wilber’s more evolutionary ranking ascent with involutionary egalitarian descent. By also critiquing representational—and thus somewhat reifying—tendency of the AQAL framework and proposing to read it as an interpretive lens hesaves Integral Theory from internal conflicts and rendered it more consistent. Being based on experience and vast scholarship both Wŏnhyo’s and Wilberian visions have an integral nature. Whereas Wŏnhyo’s Enlightenment-anchored high vision-logic enabled him to actualize harmonization unobstructedly, backed by scientific achievements as well as his practice Wilber pioneered the AQAL Integral Theory, and then by adding an interpretive dimension Wilber has made it more balanced and consistent system. Now facing the human-caused threats of various global crises as well as the usual complexities of our ordinary life, we need to draw on mankind’s cultural resources including these two spectacular achievements. We may then further develop these soteriological visions in such a way as to satisfy hopefully all justifiable needs of men as well as the world in a futuristic perspective. (shrink)

니클라스 루만의 방대한 이론적 작업은 ‘체계이론’과 ‘사회이론’으로 요약될 수 있다. 이 논문은 이 두 이론들 중 내가 루만에게 더 중요한 이론이었다고 판단하는 사회이론의 연구계획이 어떻게 수립되었고 어떤 변경 과정을 거쳤는지 살펴본다. 특히 연구 초기인 1975년에 작성된 원고로 2017년에야 출간된 『사회의 체계이론』과 1997년에 출간된 사회이론의 최종 저작 『사회의 사회』를 비교하는 국내 최초의 작업을 수행하였다. 초기에 루만은 자신의 사회이론 연구계획을 주로 일반 체계이론의 수용을 통해 달성하고자 하였다. 즉 ‘사회의 체계 이론’을 정립하려 하였다. 하지만 그 진행 과정에서 매체이론과 진화이론 등 다른 일반 이론들의 (...) 비중이 커지면서 체계이론은 다소 상대화되었고, 그것은 사회이론 저서의 제목이 ‘사회의 사회’로 변경되는 데 영향을 미쳤다. 그리고 이제 만약 우리가 사회 개념을 체계이론 중심으로 사고하지 않는다면, 그러한 상대화는 더 진척될 수 있다. 이 논문의 마지막 부분에서 나는 이러한 체계이론의 상대화를 다소 급진적으로 밀어붙이면서 사회를 체계로 간주하지 않는 사회이론의 가능성을 검토하였다. This paper aims to introduce, in the context of Latin America, the theoretical epistemic discussion regarding the theme of the ‘common’ as a political principle which substantiates instituting and autonomous processes of government, control and community regulation. The work seeks to relate a democratic scenario of the ‘common’ with the discourses of pluralist and decolonial normativity, in a way that would guarantee not only horizontal communal self-management, but also a legitimate ordering of forms of life, founded on common interest, social (...) relations and interconnected structures. For this purpose the instrument of critical-socio-legal analysis is applied at the intersections with the ‘participative-communitary’ type of legal pluralism. Our proposal is to combine the contemporary meaning of the ‘common’, its relation to the Latin American principles of ‘buen vivir’ (living well) and ‘interculturalidade’ (interculturality), as well as the instituting practice of the ‘common’, that engenders a normativity built ‘from below’, which is in opposition to the traditional positivist and state legal system imposed through colonization in Latin America. Such achievements that, although formalized, are not being successful against institutional ruptures, have ‘cloistered’ the practices of the ‘common’ and made the existence of legal pluralism invisible. This paper analyses the structure of evolutionary theory as a quasi-Newtonian theory and the need to establish a Zero-Cause Law. Several authors have postulated that the special character of drift is because it is the default behaviour or Zero-Cause Law of evolutionary systems, where change and not stasis is the normal state of them. For these authors, drift would be a Zero-Cause Law, the default behaviour and therefore a constituent assumption impossible to change without changing the system. (...) I defend that drift's causal and explanatory power prevents it from being considered as a Zero-Cause Law. Instead, I propose that the default behaviour of evolutionary systems is what I call the Principle of Stasis, which posits that an evolutionary system where there is no selection, drift, mutation, migration, etc., and therefore no difference-maker, will not undergo any change (it will remain in stasis). We discuss several axiomatizations of set theory in first order predicate calculus with epsilon and a constant symbol W, starting with the simple system K(W) which has a strong equivalence with ZF without Foundation. The other systems correspond to various extensions of ZF by certain large cardinal hypotheses. These axiomatizations are unusually simple and uncluttered, and are highly suggestive of underlying philosophical principles that generate higher set theory.

Nancy Cartwright believes that we live in a Dappled World– a world in which theories, principles, and methods applicable in one domain may be inapplicable in others; in which there are no universal principles. One of the targets of Cartwright’s arguments for this conclusion is the Causal Markov condition, a condition which has been proposed as a universal condition on causal structures.1 The Causal Markov condition, Cartwright argues, is applicable only in a limited domain of special cases, and (...) thus cannot be used as a universal principle in causal discovery. I have no dispute with any of these claims here. Rather, I wish to argue for a very limited thesis: that the Causal Markov condition is applicable in the specific domain of microscopic quantum mechanical systems; further, that the condition can fruitfully be applied to the much discussed EPR setup. This is perhaps a surprising conclusion, for it is precisely in this domain that Cartwright’s arguments against the Causal Markov condition have been considered to be the most successful. (shrink)

Those who endorse the free energy principle as a theory of cognition are committed to three propositions that are jointly incompatible but which will cohere if one of them is denied. The first of these is that the free energy principle gives us a self-sufficient explanation of what all cognitive systems consist in: a specific computational architecture. The second is that all adaptive behavior is driven by the free energy principle and the process of model-based inference it entails. The (...) third is that cognition is not ubiquitous. These three incompatible propositions together comprise a problem of scope for the free energy principle as a theory of cognition. The prospects for rejecting each of these propositions are considered. To drop either the first or the second would limit the explanatory success of the principle. In summary, the question of how to construe the procedure called reversibility cannot be given an absolute answer. No one moral interpretation of the principle is universally applicable, that is, applicable to all moral issues. The decision concerning which to apply cannot be made a priori, but only in context - that is, only when we are faced with a particular moral problem. Moreover, there appears to be no rule which would enable us to choose which version is correct in (...) a particular case. It is a matter of judgment.That the various versions represent a moral progression from lower to higher constructions is debatable. We have seen that the altruism of reversibility3 - the ethic of care - may recommend itself in some personal relations to the point of making either version of reversibility4 irrelevant. Similarly, it is not clear that reversibility3 is always higher than reversibility2. For example, parents in trying to decide what is morally best for a young child should often - in the spirit of the second construction - substitute the judgment of their mature selves for the judgment of the immature self of the child. Moreover, this substitution may not be justifiable in terms of either utility or autonomy.If I seem to have ignored reversibility1 in this discussion that is because I consider it outside morality: it is, if anything, a principle of self-interested calculation. If Baier is correct in holding that we teach children to think morally when we get them to take the standpoint of others, that requires, I believe, getting them beyond the stage of crude reciprocity. If Piaget and Kohlberg are correct in their developmental claims, we cannot immediately teach children reversibility4 but must help them progress through the other two versions. There is some basis for thinking that children can transcend egoism and sympathize with others much earlier than Kohlberg allows - an important consideration in the development of a system of moral education. That point has been pursued by Michael Pritchard in his critique of Kohlberg. Pritchard, p 44. My point is a different one: even granting Kohlberg's theory of development (which asserts, for example, that a particular cognitive ability is required to think like a Kantian), it does not follow that the moral thinking which accompanies the highest cognitive stage is morally superior to the moral thinking which accompanies the lesser cognitive stages. That it is cognitively easier to master reversibility3 than reversibility4 does not settle the question of which is morally superior. Rather than arguing about which moral version of reversibility is morally best- a pointless debate if the desirability of a version is understood as contingent upon appropriateness with respect to context - we should instead celebrate the richness of the concept of reversibility. In teaching students the moral point of view by getting them to put themselves in another's place, we would not be asking them to master a rigid formula, but rather to be sensitive to the decisional context and to make a thoughtful judgment about which version of reversibility is most appropriate to that context. We would not be teaching them either moral relativism or moral absolutism, but the complexity of trying to make a moral decision by applying an ancient and philosophically rich ethical principle. By exercising their (imperfect) capacity to discriminate, people try to recognize and to understand some important differences between things that make them prefer some things to other. In this article I will use my ability to discriminate between people and societies according to a principle which plays the role of attractor, both at individual and societal levels, namely the principle of peaceable conduct. This principle allows us to discriminate at the civic level between the people who have a civilized conduct (...) and those who manifest an aggressive conduct. The category of civilized people includes individuals who (a) respect the life and bodily integrity of their fellows, (b) practice self-control, not control over others and (c) do not claim, through coercive means, the goods that their fellows have obtained by making free and peaceful use of their own faculties and capabilities. The category of aggressive people reunites (a) murderers (those who endanger the lives of their fellow), (b) tyrants (those who beslave their fellows by taking control of some of their faculties) and (c) thieves (those who claim the goods of their fellows without their consent). The civilized conduct requires high standards of action of the people who embrace it and, implicitly, considerable physical and psychical costs. The primary impulses originating in our lower Self blatantly contradict the respect for life, liberty and property of our fellows, so that it seems impossible for them to be controlled only by personal effort. Therefore, it is vital that the energy allotted to peaceable conduct by our higher Self be superior to the energy which it spontaneously mobilizes in support of the primary impulses of our lower Self. This can be achieved by feeding the people with the social energy of certain social emotions in the process of internalizing the norms of peaceable conduct. Among these emotions, contempt and shame, respectively anger and guilt stand out through the predominance of the moral dimension and force of shaping human conduct. They underlie two different moral systems – “shame morality”, and “guilt morality” respectively – that support our peaceable conduct and, ipso facto, our civilized life. (shrink)

The article deals with the problem of moral justification of humanitarian intervention by modern just war theorists. At the beginning of the article, we discuss the evolution of the dominant paradigms of the moral justification of war and explain why the theory and practice of humanitarian intervention appears only at the present stage of the development of ethics and the law of war. It is noted that theorization of humanitarian intervention began in the last decades of the 20thcentury. This (...) is due to a significant transformation, a retreat in the legal and ethical studies of war from the position of radical condemnation of aggressive actions and the recognition of the political subjectivity of non-state groups. Thus, there is a rethinking of the long tradition, the Westphalian system of international relations, according to which the state was recognized as the main participant of big politics, and its sovereign right to conduct domestic policy was considered indisputable. Further, we take the works of Michael Walzer as the main source of modern conceptualization of the ethics of humanitarian interventionism, since Walzer repeatedly addressed this topic and formulated a position on this issue that is representative of the entire modern Just War Theory. The arguments of Walzer and his supporters in favor of the moral justification of humanitarian intervention are considered. Among them are the following. First, the argument about the state as an organization which goal is to protect the rights of its own citizens. If this goal is not not achieved, the state shall loose its power over these people and in this territory. Second, Walzer calls for identifying governments and armed forces involved in mass murders as criminal and, therefore, deserving of punishment. Finally, there is, perhaps the most important, demonstrative argument: an appeal to the self-evident impossibility to stand aside in cases of mass violence in any state. This is followed by a critique of these arguments, as well as a demonstration of how the modern Just War Theory can respond to these criticisms. (shrink)

Every scientific or intellectual movement is founded upon basic assumptions and hypotheses that shape its specifically formulated philosophy. This study seeks to explore and explicate the basic philosophical underpinnings of grey systems theory, as well as the paradigm governing its postulates. The study, more specifically, scrutinizes the underlying principles of GST from the perspective of postmodern philosophy. To accomplish this, the epistemology, ontology, human nature, and methodology of GST are substantially investigated in the light of postmodern philosophy. The (...) study draws on Burrell and Morgan’s framework to reveal the paradigm underlying the philosophy of GST. Results demonstrate that GST is an anti-realistic, anti-positivistic, and non-deterministic theory which is inherently pluralistic and ideographic. Based on the principles of GST, change is an indispensable dimension of human speculation about the world and systems, and knowledge is ceaselessly reproduced as new information is collected. As a result, knowledge, narratives, theories and scientific laws are dynamically changed. GST, then, is remarkably compatible with the foundations of postmodern thought and it could be regarded as a postmodern theory governed by a humanistic paradigm. (shrink)

Research has revealed how inherent self-organizing tendencies in athletes and sports teams can be exploited to facilitate emergence of dynamical patterns in synergy formation in sports teams. Here, we discuss how game models, and associated tactical principles of play, may be implemented to constrain co-existing global-to-local and local-to-global self-organization tendencies in team sports players during training and performance. Understanding how to harness the continuous interplay between these co-existing, bi-directional, and coordination tendencies is key to shaping system behaviors in (...) sports training. Training programs are traditionally dominated by designs, which shape the self-organizing tendencies of players and teams at a global-to-local scale by coaches imposing a tactical/strategical plan with associated tactical principles of play. Nevertheless, recent research suggests that performers also need to be provided with opportunities to explore self-organizing tendencies that emerge at the local-to-global scale in training. This directional tendency in synergy formation can be facilitated by players being given opportunities to actively explore different adaptive and innovative performance solutions, coherent with principles of play circumscribed in an overarching game model. Developing methods (coaching sessions rooted on principles of dynamical systems theory that foment the development of such local-to-global relations) to exploit the continuous interplay between these co-existing tendencies within sports teams may promote more effective and efficient athlete skill training programs, in addition to enhancing performance. Behavioural variant frontotemporal dementia (bvFTD) is characterized by an absence of obvious cognitive impairment and presence of symptoms such as disinhibition, social inappropriateness, personality changes, hyper-sexuality, and hyper-orality. Affected individuals do not feel concerned enough about their actions to be deterred from violating social norms, and their antisocial behaviours are most likely caused by the neurodegenerative processes in the frontal and anterior temporal lobes. BvFTD patients present a challenge for the traditional notion of autonomy and the medical and criminal justice (...) systems. Antisocial behaviour is often the earliest recognized manifestation of bvFTD. Given that the symptoms are not specific and that atrophy of the frontal lobes is only observable with structural neuroimaging in the later stages of the disease, it is hard to ascertain their autonomy. Recently proposed re-conceptualizations of autonomy (Dworkin’s, Jaworska’s, and Dubljević’s) can, however, be sufficiently redefined to provide explicit rules and offer nuanced guidance in such cases. A combination of notions of autonomy gives the most nuanced guidance with three modifications: 1) including socio-moral judgement in the notion of “normal cognitive competence,” 2) excluding in-principle un-endorsable ideals from the notion of “capacity to value,” and 3) redefining ideal-typical degrees of compulsion (mild, severe, and total). This article analyzes the implications of a particular conception of social justice in education for the policies that have led to significant political controversies in contemporary communities in the United States. Many of these controversies have arisen from the collision between the increasingly multicultural reality in those communities and the accountability system that has during the past decade or so been imposed on the schools by standards-based reformers in the federal and state governments. For this task, the article considers (...) the schools in a hypothetical community in which significant immigration of Latino citizens has occurred. It proposes a theory of social justice in education that uses John Rawls's ideas about political liberalism and an overlapping political consensus in a pluralistic society as a basis for analyzing the normative and factual disagreements in that community. Employing the principles of that theory, the article considers whether the system of accountability that has led to the disagreements is normatively justified and concludes in particular that that system violates both the principles of personal liberty and of equality of educational opportunity in education. It also concludes that a dramatically different system of accountability is required, one in which central political authorities have a responsibility to hold localities accountable for the social justice purposes of education and in which local authorities have a responsibility to design the school curriculum to be genuinely responsive to the diverse cultural interests that children have in their local communities. This thesis demonstrates that by redefining the notion of nationhood and by treating nations and national minorities equally with respect to self-determination, it is possible to formulate basic principles of the international legal system, which would promote territorial integrity and stability of multinational states better than the existing system. I demonstrate that theories dealing with self-determination based solely on human rights or cases of secession address the problem with inadequate tools. I also show that minority-rights approaches do (...) not accommodate self-determination claims of national groups properly. ;I offer a new idea of nationhood as a political culture of self-determination with which people self-identify. It includes beliefs about co-nationals' mutual membership in a political community, which is perceived by them as having a self-determining power. Definitions of nationhood which use the notion of culture, but not political culture, are both too inclusive---they fail to distinguish between national and ethnic groups, and too exclusive---they overlook multicultural nations. ;Contested secession has received much attention in recent scholarship. Since, however, contested secession is based upon the disagreement of two or more national groups concerning their self-determination within particular boundaries, I consider secession within the scope of a systematic approach to the regulation of relations among national groups. I propose that international legal principles should be based upon the recognition of states and national groups as the two basic elements of the international system, and the equal recognition of nations as political cultures of self-determination. I interpret self-determination as a claim to equality within the boundaries a multinational state, and formulate a criterion of minimal justice for states. It requires that states respect equality of self-determination of national groups on their territory. National groups can secede from multinational states either by mutual agreement, or if their they are persistently denied a status with respect to self-determination equal to that of other national groups. Es así que se presenta a la Teoría Neoconstitucional como una nueva teoría del derecho que permite integrar los derechos con (...) sus respectivas garantías, y que se ocupa tanto de las normas como de los principios y los valores de Derechos Humanos y de su internalización en los ordenamientos de los Estados, es decir, se ocupa del fenómeno de mundialización de estos derechos. Dentro de los derechos fundamentales encontramos los que poseen las mujeres en lo que concierne a vivir una vida libre de toda violencia en la que se respete su dignidad y autonomía de la voluntad, amén de que los índices de violencia contra ellas aumentan día a día en todos los países del mundo. De este modo los Estados deberán cumplimentar con las medidas de acciones positivas tendientes a garantizar el efectivo goce de los derechos reconocidos por los Pactos internacionales de Derechos Humanos.ABSTRACT: The changes in the new conception of the Democratic State of Law that arise from the awareness of the existence of certain rights that are considered fundamental by the international community, have a direct influence on the design of public policies, the creation of legal norms and how to solve judicial cases. Within the fundamental rights we find those that women possess in what concerns to live a life free of all violence in which their dignity and autonomy of the will is respected, in addition to that the indices of violence against them increase every day in all the countries of the world. Background Respect for human rights and bioethical principles in prisons is a crucial aspect of society and is proportional to the well-being of the general population. To date, these ethical principles have been lacking in prisons and prisoners are victims of abuse with strong repercussions on their physical and mental health. Methods A systematic review was performed, through a MESH of the following words (bioethics) AND (prison), (ethics) AND (prison), (bioethics) AND (jail), (ethics) AND (jail), (bioethics) AND (penitentiary), (...) (ethics) AND (penitentiary), (prison) AND (human rights). Inclusion and exclusion criteria were defined and after PRISMA, 17 articles were included in the systematic review. Results Of the 17 articles, most were prevalence studies (n.5) or surveys (n.4), followed by cross-sectional studies (n.3), qualitative studies (n.1), retrospective (n.1) and an explanatory sequential mixed-methods study design (n.1). In most cases, the studies associated bioethics with prisoners’ access to treatment for various pathologies such as vaccinations, tuberculosis, hepatitis, HIV, it was also found that bioethics in prisons was related to the mental health of prisoners, disability, ageing, the condition of women, the risk of suicide or with the request for end-of-life by prisoners. The results showed shortcomings in the system of maintaining bioethical principles and respect for human rights. Conclusions Prisoners, in fact, find it difficult to access care, and have an increased risk of suicide and disability. Furthermore, they are often used as improper organ donors and have constrained autonomy that also compromises their willingness to have end-of-life treatments. In conclusion, prison staff (doctors, nurses, warders, managers) must undergo continuous refresher courses to ensure compliance with ethical principles and human rights in prisons. (shrink)

This paper traces the history of remoteness in contract law, namely the legal formants (in Rodolfo Sacco’s terms) constraining the availability of contract damages in various legal systems. Our journey takes us through different times, continents and cultures, from the eighteenth century to the twenty–first century, across the law of France, United States, England and Wales, India and Australia, among other jurisdictions. While it might seem that civilian and common law traditions have very different morphological legal forms, once a closer (...) historical, cultural, and anthropological gaze is turned upon the legal formants involved, it can be seen that remoteness discloses a shared concern which may be common to many human societies and cultures. In other words, as a matter of social experience, humans who enter into transactions generally realise that it is impossible to know the future, or to know what all outcomes of the transaction will be. Consequently, it is recognised that it would be unfair and unjust to hold a defendant liable for all outcomes, and as our journey will show, legal systems seek guidance from other legal systems in their efforts to deal with this problem. Priority setting in health care means making distributional decisions, which inherently involves limiting access to some health services. Public health ethics involves many ethical principles like efficiency, equity and individual choice, which are frequently appealed to but rarely analysed. How these concepts are understood and applied impacts on healthcare planning and delivery policies. This article discusses findings of a research study undertaken in the context of the Iranian health system in which two main ethical values appear to be (...) operating: equity and personal choice. It asserts that the pro-market perspective, driven by individual choice appears to be dominant as it is influenced by the powerful medical profession. This is despite egalitarian intentions proclaimed in the Constitution and the majority of national laws. The study argues that the market influence in healthcare priority setting is unlikely to diminish because of weak implementation of existing laws. In conclusion, the article suggests that the private health sector could help to achieve the state’s proclaimed egalitarian goals only if new regulatory systems and new systems of governance are implemented. Such measures should be aimed at monitoring and controlling the performance of the private sector, to better manage and harness its capacities. (shrink)

From the 5th edition of Beauchamp and Childress' Principles of Biomedical Ethics, the problem of common morality has been given a more prominent role and emphasis. With the publication of the 6th and latest edition, the authors not only attempt to ground their theory in common morality, but there is also an increased tendency to identify the former with the latter. While this stratagem may give the impression of a more robust, and hence stable, foundation for their theoretical (...) construct, we fear that it comes with a cost, namely the need to keep any theory in medical ethics open to, and thereby aware of, the challenges arising from biomedical research and clinical practice, as well as healthcare systems. By too readily identifying the moral life of common morality with rule-following behaviour, Beauchamp and Childress may even be wrong about the nature of common morality as such, thereby founding their, by now, classic theory on quicksand instead of solid rock. In the traditional scientific research and production activities, due to the lack of sufficient communication and communication between researchers, the phenomenon of waste of scientific research resources occurs from time to time, which hinders the efficiency of scientific research output. Based on the design principle of the semantic knowledge framework, this paper puts forward the definition of ontology and semantic relationship of the collaborative system of scientific researchers. In this paper, a framework of collaborative semantic knowledge among researchers is (...) established through decentralized semantic information exchange architecture. In this article, the simulation is verified by experiments and compared with other exchange architectures. The results of the experiment confirmed the semantic information exchange architecture based on semantic knowledge proposed in this paper is 10.39% faster than the traditional centralized method in terms of data volume; the construction speed under the data node perspective is 12.84% higher than that of the traditional centralized construction method; the subject query speed is 36.84% higher than that of the traditional centralization method; the predicate query speed is 31.58% higher than that of the traditional centralization method. The experimental results confirm that the semantic information exchange architecture based on the semantic knowledge framework is feasible, and it has excellent performance in terms of construction speed and query speed. Under the background that researchers rely more and more on collaborative technology to interact with other members, this paper has a certain reference value and exploration value and proposes a new idea of group collaboration system under the framework of semantic knowledge. In their correspondence in 1902 and 1903, after discussing the Russell paradox, Russell and Frege discussed the paradox of propositions considered informally in Appendix B of Russell’s Principles of Mathematics. It seems that the proposition, p, stating the logical product of the class w, namely, the class of all propositions stating the logical product of a class they are not in, is in w if and only if it is not. Frege believed that this paradox was avoided within his (...) philosophy due to his distinction between sense (Sinn) and reference (Bedeutung). However, I show that while the paradox as Russell formulates it is ill-formed with Frege’s extant logical system, if Frege’s system is expanded to contain the commitments of his philosophy of language, an analogue of this paradox is formulable. This and other concerns in Fregean intensional logic are discussed, and it is discovered that Frege’s logical system, even without its naive class theory embodied in its infamous Basic Law V, leads to inconsistencies when the theory of sense and reference is axiomatized therein. D’Arcy Thompson’sOn Growth and Formis one of the key works at the intersection of science and the imagination. This introductory essay explores the book and its context, drawing on archival sources to provide a unique perspective. It looks at Thompson’s own life and career, his experiences at University College, Dundee, and how he came to write the book. It describes the contents of the 1917 first edition (as many today are familiar only with the 1961 abridgement of the 1942 second (...) edition). It looks at the book’s initial reception, exploring the context of biological ideas of the time, particularly in regard to Thompson’s perceived opposition to Darwinian theory and the debate between vitalism and mechanism. It explores the early influence of the book on ecologists and systems theorists and other early attempts at mathematical biology, as well as its significant influence on artists and architects. It then describes the development of the second edition of the book and the subsequent increase of interest in his work from both artists and scientists. It concludes by summarizing recent initiatives in the D’Arcy Thompson Zoology Museum. (shrink)

The paper reconstructs Luhmann’s conception of legal argumentation and justice especially focussing on the aspects of contingency and self-referring operative closure. The aim of his conception is to describe/explain in a disenchanted way—from an external, of “second order” point of view—the work on adjudication, which, rather idealistically, lawyers and judges present as being a matter of reason. As a consequence of some surface similarities with Derrida’s deconstructive philosophy of justice, Teubner proposes integrating the supposed reductive image of formal justice described (...) by Luhmann with the ideal conception of justice presented by Derrida. Here this kind of attempt is rejected as epistemologically wrong. In addition, Luhmann’s theory is argued to have other shortcomings, namely: the failure to understand the pragmatic function of principles, and the incapacity to describe the current legal questions linked with cultures and legal pluralism, which characterise our society. Climate change involves changes in the climate system caused by polluting human activities and the social and natural effects of these changes. The historical and anthropogenic grounds of climate change play an important role in climate justice claims. Many climate justice scholars believe that principles of climate justice should account for the historical and anthropogenic sources of climate change. Two main backward-looking principles have been proposed: the polluter pays principle (PPP) and the beneficiary pays principle (BPP). The (...) BPP emerged in the literature on climate justice in response to certain objections raised against the PPP. In this paper, I focus on two of these objections: the causation objection and the excusable ignorance objection. Defenders of the BPP have traditionally assumed that this principle is not vulnerable to those objections, which renders the BPP superior to the PPP. In this paper, I challenge this underlying assumption. My argument here is simple: moving from the PPP to the BPP in response to any of these objections might be unjustified because the BPP is affected by at least some of the considerations giving rise to these objections. Bertrand Russell presented three systems of propositional logic, one first in Principles of Mathematics, University Press, Cambridge, 1903 then in “The Theory of Implication”, Routledge, New York, London, pp. 14–61, 1906) and culminating with Principia Mathematica, Cambridge University Press, Cambridge, 1910. They are each based on different primitive connectives and axioms. This paper follows “Peirce’s Law” through those systems with the aim of understanding some of the notorious peculiarities of the 1910 system and so revealing some of (...) the early history of classical propositional logic. “Peirce’s Law” is a valid formula of elementary propositional logic: [ ⊃ p] ⊃ p This sentence is not even a theorem in the 1910 system although it is one of the axioms in 1903 and is proved as a theorem in 1906. Although it is not proved in 1910, the two lemmas from the proof in 1906 occur as theorems, and Peirce’s Law could have been derived from them in a two step proof. The history of Peirce’s Law in Russell’s systems helps to reconstruct some of the history of axiomatic systems of classical propositional logic. (shrink)

Probabilistic theories are a natural framework to investigate the foundations of quantum theory and possible alternative or deeper theories. In a generic probabilistic theory, states of a physical system are represented as vectors of outcomes probabilities and state spaces are convex cones. In this picture the physics of a given theory is related to the geometric shape of the cone of states. In quantum theory, for instance, the shape of the cone of states corresponds to (...) a projective space over complex numbers. In this paper we investigate geometric constraints on the state space of a generic theory imposed by the following information theoretic requirements: every non completely mixed state of a system is perfectly distinguishable from some other state in a single shot measurement; information capacity of physical systems is conserved under making mixtures of states. These assumptions guarantee that a generic physical system satisfies a natural principle asserting that the more a state of the system is mixed the less information can be stored in the system using that state as logical value. We show that all theories satisfying the above assumptions are such that the shape of their cones of states is that of a projective space over a generic field of numbers. Remarkably, these theories constitute generalizations of quantum theory where superposition principle holds with coefficients pertaining to a generic field of numbers in place of complex numbers. If the field of numbers is trivial and contains only one element we obtain classical theory. This result tells that superposition principle is quite common among probabilistic theories while its absence gives evidence of either classical theory or an implausible theory. (shrink)

The philosophy of physics literature contains conflicting claims on the heuristic significance of general covariance. Some authors maintain that Einstein's general relativity distinguishes itself from other theories in that it must be generally covariant, for example, while others argue that general covariance is a physically vacuous and trivial requirement applicable to virtually any theory. Moreover, when general covariance is invested with heuristic significance, that significance as a rule is assigned to so-called “active” general covariance, underwritten by the principle of (...) background independence, rather than to general covriance as Einstein understood it. While agreeing with the latter group of commentators that general covariance indeed carries heuristic significance, I argue that a background independent theory need not be generally covariant and that instead the Principle of Equivalence as Einstein understood it provides the key to understanding the heuristic power of general covariance as a “mathematical sieve” for determining the gravitational field law. However, heuristic significance accrues to general covariance only indirectly, by its encompassing the relativity of frames underwritten by Einstein's principle of equivalence. (shrink)
