Previous research has demonstrated that judicial instructions are not well understood by jurors tasked with returning informative verdicts, and explanatory strategies can facilitate juror’s comprehension of law-related contents. Unlike a great deal of research on legal-lay interactions in a jury trial, most of which is based on English-language materials, the present article uncovers how Russian judges communicate law-related information to the jury. The study was motivated by the lack of guidance on interactions with the jury and the challenges faced by (...) the latter in attempting to understand technical concepts. Through quantitative and qualitative analyses of 18 jury instructions, the paper demonstrates that Russian judges work toward the achievement of a goal of recontextualizing law-related information and making legal concepts comprehensible to a lay audience using a wide repertoire of popularization tools, including definitions, descriptions, illustrations, paraphrases and metaphors. ABSTRACT: Stream of Consciousness is a detailed and insightful analysis of the nature of phenomenal consciousness, especially its unity at a time and continuity over stretches of time. I find Dainton's approach to phenomenal consciousness in many ways sound but I also point out one major source of disgreement between us. Dainton believes that to explain phenomenal unity and continuity, no reference to anything outside (...) experience is required. Thus, he postulates a fundamental experiential relation called co-consciousness which is supposed to do all the explanatory work. On the contrary, I hold that to truly explain features of consciousness such as phenomenal unity and continuity, reference to mechanisms outside the phenomenal realm are necessary. (shrink)

Quantitative losses of memory content imply replicative processing; correspondence losses imply reconstructive processing. Research should focus on the relationship between these processes by obtaining accuracy- and quantity-based indicators of memory within the same framework. This approach will also yield information about the effects of task and individual-difference variables on loss and distortion, as well as the time course of each process.

In the first section of this paper I draw, on a purely conceptual level, a distinction between two kinds of reasons: content-related and attitude-related reasons. The established view is that, in the case of the attitude of believing something, there are no attitude-related reasons. I look at some arguments intended to establish this claim in the second section with an eye to whether these argument could be generalized to cover the case of preferences as well. In the third section (...) I argue against such generalizations and present a case in favour of accepting attitude-related reasons for preferences. In the fourth section I present an objection to which I react in the fifth section where I try to strengthen my case for attitude-related reasons for preferences. Daydreaming appears to have a complex relationship with life satisfaction and happiness. Here we demonstrate that the facets of daydreaming that predict life satisfaction differ between men and women , that the content of daydreams tends to be social others , and that who we daydream about influences the relation between daydreaming and happiness variables like life satisfaction, loneliness, and perceived social support . Specifically, daydreaming about people not close to us predicts more loneliness and less perceived social support, (...) whereas daydreaming about close others predicts greater life satisfaction. Importantly, these patterns hold even when actual social network depth and breadth are statistically controlled, although these associations tend to be small in magnitude. Individual differences and the content of daydreams are thus important to consider when examining how happiness relates to spontaneous thoughts. (shrink)

This paper has two interrelated aims. The primary aim is to specify the character of philosophical theories of mental content that are usually classified as ‘Causal Theories of Intentionality’, ‘Causal Theories of Representation’, or ‘Causal Theories of Mental Content’ (CTs). More specifically, the aim is to characterize the role and place of causation in philosophical reflections on the nature of mental content, as suggested by theories of this kind. Elucidation of the role of the concept of causation (...) in CTs requires examining the philosophical background against which versions of CTs are proposed; therefore the second aim of this paper is to clarify the link between CTs and the two philosophical theories that accompany it: the doctrine of philosophical naturalism (PN) and the representational theory of mind (RTM). Clarification of the relationship between the three theories is not only necessary for an adequate specification of the causal component that plays a central role in CTs, and so for a better understanding of CTs themselves; it also shows how the role that causation plays in CTs implies a genuinely relational conception of intentionality. I introduce a 'thin' or ‘live’ notion of the subject according to which a subject of experience cannot exist unless there is an experience for it to be the subject of. I then argue, first, that in the case of a particular (...) experience E, its content C, and its (thin) subject S, [C ↔ E ↔ S]; and, second, that the metaphysical fact that underlies this (strong modal) equivalence is in fact identity: [E = S = C]. I suggest that the effort of thought required to grasp this is deeply revealing of the nature of reality. It is widely believed that what distinguishes between a justifiable and a justified belief is the obtaining of an epistemic relation, the basing relation, whose nature and character has long been a controversial issue in epistemology. There are currently two major approaches to the problem of the basing relation, namely, the causal and doxastic theories. In this paper, after a brief survey of the field, I examine Alston's recent account of the basing relation, as input to psychologically realized functions, arguing (...) that his way of identifying the functions in question presupposes what it seeks to establish as it merely replaces one kind of indeterminacy with another . It is argued that the relation between ‘occurrents’ as characterized by Honderich and familiar ‘contentful’ mental states like beliefs and thoughts is a very murky one. Occurrents are distinct when and only when they can be distinguished by consciousness. By contrast, the criteria of individuation for contentful mental states invoke factors that are not distinguishable by consciousness. It is also suggested that Honderich's strategy for individuating occurrents may sometimes be difficult to apply.

Following the global financial crisis, banks have become more regulated to advance ethical sales cultures throughout the sector. Based on case studies of three retail banks, we find that they construct the ‘appropriate advisor’ in different ways. Inspired by Bakhtin’s work on ethics, we propose a vocabulary of relational ethics centered on the ‘answerable self.’ We argue that this vocabulary is apt for studying and discussing how organizations advance ethical sales cultures in ways that instead of encouraging value congruence (...) and alignment allow for ethical openness. In such cultures, employees—as moral agents—are morally questioning, critically self-reflexive, and answerable for their own actions toward others in their social relationships. Our paper makes three theoretical contributions, namely, problematizing the idea of cultural alignment and value congruence, demonstrating that identity regulation can both comprise and support the ‘answerable self,’ and advancing our understanding of the interdependence of ethical openness and ethical closure in fostering ethical sales cultures. SummaryThe salience of mediated scandals today is deeply linked with the formation of norms and values in our society. This is a particular challenge for the field of sport as the compliance with norms and values is of particular relevance in this social area. The paper shows the extent of scandalization in sport reporting and discusses possible implications for sport. Therefore, it offers a definition and typology for sport scandals. It indicates why sport scandals might have a fundamental share of (...) overall scandal reporting today in comparison to other fields of society. The paper further emphasizes content-related aspects such as celebrity status, sport discipline and type of sport scandal. In the empirical portion, a quantitative content analysis of all reported scandals in three German newspapers over a period of one year is provided. My aim is to defend a peculiar epistemic version of the particularity thesis, which results from a sui generis combination of what I call the ‘singular relational view’ and what I call the ‘relativistic content view.’ Particulars are not represented as part of putative singular content. Instead, we are perceptually acquainted with them in the relevant sense that experience puts us in direct perceptual contact with them. I defend this thesis by developing a view of perceptual content that avoids their objections. I will argue that on a relational understanding of perceptual content, the fundamental insights of austere relationalism do not compete with perceptual experience being representational. As it will show that most objections to the thesis that experience has (...) class='Hi'>content apply only to accounts of perceptual content on which perceptual relations to the world play no explanatory role. With austere relationalists, I will argue that perceptual experience is fundamentally relational. : The present work analyses Content Moderation, focusing on ethical concerns and cognitive effects. Starting from a general description and history of the moderation process, it stresses some ethical problems: quality of moderation, transparency, and the working conditions of human moderators. Using some of Facebook leaked slides offering examples of moderation, we define some controversial rules and principles for Commercial Content Moderation. These examples highlight a general lack of coherency and transparency, which has the potential to affect users’ (...) cognitive attitudes, their perception of reality, and their freedom of speech. Such effects are studied in comparison to other well-known online cognitive phenomena and in relation to the most recent dedicated legislation in EU countries. The current Content Moderation scheme leaves users at risk of specific cognitive distortions, highlighting the urgent need for greater transparency throughout the moderation process and better working conditions for moderators. Ne emerge una generale mancanza di coerenza organizzativa e di trasparenza nel processo, che mostra potenziali effetti dannosi sulle attitudini degli utenti, sulla loro percezione della realtà e la loro libertà di parola. Tali effetti saranno studiati in confronto con i più conosciuti effetti cognitivi del mondo dei social ed in relazione alle più recenti disposizioni di leggi europee in merito. Gli schemi attualmente in uso producono degli specifici effetti di distorsione cognitiva e conseguentemente mostrano l’importanza di una maggiore attenzione alla trasparenza del processo e alle condizioni di lavoro dei moderatori. 본 연구는 어린이 불교교육의 가능성을 모색하기 위하여 초등학교 도덕과 교육과정에 나타난 불교 관련 내용을 분석하고 초등학교 불교교육의 방향을 제시한 것이다. 불교는 붓다가 깨달음을 얻은 후 이루어진 사상이자 종교로, 핵심 이론은 연기법과 사성제이다. 무상(無常)·공(空)을 본질로 하는 불교는 기성세대들에게는 설득력이 있지만, 어린이들에게 불교의 거대한 세계관과 인간 실상을 설명하기는 쉽지 않다. 어린이 철학교육은 학문 중 가장 심오하다고 여겨지는 철학에 대해 내용·결과보다 사유 과정과 활동에 초점을 두어 접근한다. 이를 염두에 두고 어린이 불교교육도 어려운 사상보다 정신과 문화에 대해 다각적으로 접근한다면 그 가능성을 찾을 수 있을 (...) 것이다. 도덕과의 제3차·제4차 교육과정 체계는 현재와 비교하면 부족한 점이 많지만, 의인화를 통해 생명존중과 생명평등의식, 도덕적 감수성과 상상력을 고취시켜주었다. 제5차·제6차 교육과정에서는 ‘사랑과 자비’ 내용을 구체적으로 다루었는데, 제7차에서 사라졌다가 2007 개정에서 다시 등장하였고, 2015 개정 교육과정에서는 다시 사라졌다. 과거 교육과정에서 전반적으로 인물과 삽화는 유교관련 내용은 많지만 불교와 관련된 것은 거의 없었다. 어린이 불교교육의 원리와 방향을 기신론의 체상용(體相用) 삼대(三大)에 기초하여 살펴보면, 본질인 체(體)의 관점에서 불교정신과 불교문화에 대한 이해에 초점을 두고, 상(相)의 관점에서 생애나 자타카 등 스토리텔링으로 접근하며, 용(用)의 관점에서 명상과 수행방법을 활용하여 교육에 적용하는 것이다. 예측이 쉽지 않지만 미래사회에서는 인공지능 등 기계와 공존하는 삶의 특성상 인간 본질에 대한 철학적 물음이 중요해질 것이라고 한다. 최근 서양윤리 중심의 도덕교육 분위기에서 불교를 비롯한 동양윤리내용을 보완함으로써 삶의 의미와 본질에 대한 통찰을 통해 교육적 의미를 찾기를 기대해본다. In the third Logical Investigation Husserl presents an integrated theory of wholes and parts based on the notions of dependency, foundation ( Fundierung ), and aprioricity. Careful examination of the literature reveals misconceptions regarding the meaning and scope of the central axis of this theory, especially with respect to its proper context within the development of Husserl's thought. The present paper will establish this context and in the process correct a number of these misconceptions. The presentation of mereology in the (...) Logical Investigations will be shown to originate largely from Husserl's implicit self-criticism of his prior views on the unity of a whole presented in his first work, Philosophy of Arithmetic. The development of artificial intelligence necessarily implies the anthropological question of the difference between human and artificial intelligence for two reasons: on the one hand artificial intelligence tends to be conceived on the model of human intelligence, on the other hand, a large part of types of artificial intelligence are designed in order to exhibit at least some features of what is conceived as being human intelligence. In this article I address this anthropological question in two parts. First I bring (...) into review and classify some of the main answers that have been proposed until now to this question. I argue that these variety of answers can be broadly classified in three categories, namely a (1) behaviorist, (2) a representational, and (3) a holistic understanding of human intelligence. In a second moment I propose an alternative way of understanding the difference between human and artificial intelligence, which is not essentialist but contextualist and content-related. Contrary to possible answers that I analyse in the first section, this alternative model does not aim at grasping the essence of human intelligence, which could or could not be reproduced in principle by artificial intelligence. It situates rather the fundamental differences between human and artificial intelligence in the context of human existence and the conceptual content of human intelligence, following the phenomenological description of one of its most fundamental features, namely its life-world. Grounding on this approach, it is possible to argue that human and artificial intelligence could be distinct, even if one could prove that they are eidetically, i.e. by their essence, identical. This chapter begins with an empirical analysis of attitudes towards the law, which inspires a philosophical re-examination of the moral status of the rule of law. The chapter analyses survey data from the US about law-related attitudes and legal compliance. Consistently with prior studies, it finds that people’s ascriptions of legitimacy to the legal system are predicted strongly by their perceptions of the procedural justice and lawfulness of police and court officials’ action. Two factors emerge as significant predictors of people’s (...) compliance with the law: (i) their belief that they have a (content-independent, moral) duty to obey the law (which is one element of legitimacy, as defined in the chapter); and (ii) their moral assessment of the content of specific legal requirements (referred to in the chapter as ‘perceived moral content of laws’). The chapter also observes an interactive relationship between these two factors. The authors then identify a parallel (similarly interactive) modality in the way that form and content mutually affect the value of the rule of law. They argue that Lon Fuller’s precepts of legality possess an expressive moral quality, but that the extent to which their expressive effect materialises is sensitive to the moral quality of the law’s content. Can dreams reveal insight into our cognitive abilities and aptitudes (i.e., “human intelligence”)? The relationship between dream production and trait-like cognitive abilities is the foundation of several long-standing theories on the neurocognitive and cognitive-psychological basis of dreaming. However, direct experimental evidence is sparse and remains contentious. On the other hand, recent research has provided compelling evidence demonstrating a link between dream content and new learning, suggesting that dreams reflect memory processing during sleep. It remains to be investigated whether the (...) extent of learning-related dream incorporation (i.e., the semantic similarity between waking experiences and dream content) is related to inter-individual differences in cognitive abilities. The relationship between pre–post sleep memory performance improvements and learning-related dream incorporation was investigated ( N = 24) to determine if this relationship could be explained by inter-individual differences in intellectual abilities (e.g., reasoning, short term memory (STM), and verbal abilities). The extent of dream incorporation using a novel and objective method of dream content analysis, employed a computational linguistic approach to measure the semantic relatedness between verbal reports describing the experience on a spatial (e.g., maze navigation) or a motor memory task (e.g., tennis simulator) with subsequent hypnagogic reverie dream reports and waking “daydream” reports, obtained during a daytime nap opportunity. Consistent with previous studies, the extent to which something new was learned was related ( r = 0.47) to how richly these novel experiences were incorporated into the content of dreams. This was significant for early (the first 4 dream reports) but not late dreams (the last 4 dream reports). Notably, here, we show for the first time that the extent of this incorporation for early dreams was related ( r = 0.41) to inter-individual differences in reasoning abilities. On the other hand, late dream incorporation was related ( r = 0.46) to inter-individual differences in verbal abilities. There was no relationship between performance improvements and intellectual abilities, and thus, inter-individual differences in cognitive abilities did not mediate the relationship between performance improvements and dream incorporation; suggesting a direct relationship between reasoning abilities and dream incorporation. This study provides the first evidence that learning-related dream production is related to inter-individual differences in cognitive abilities. (shrink)

This volume advances discussions between critics and defenders of the force-content distinction and opens new ways of thinking about force and speech acts in relation to the unity problem. -/- The force-content dichotomy has shaped the philosophy of language and mind since the time of Frege and Russell. Isn’t it obvious that, for example, the clauses of a conditional are not asserted and must therefore be propositions and propositions the forceless contents of forceful acts? But, others have recently (...) asked in response, how can a proposition be a truth value bearer if it is not unified through the forceful act of a subject that takes a position regarding how things are? Can we not instead think of propositions as being inherently forceful, but of force as being cancelled in certain contexts? The search for a nomological account of what determines the content of concepts as they are represented in cognitive systems, is an important part of the general project of explaining intentional phenomena in naturalistic terms. I examine Fodor's (1990a) "Theory of Content" and criticize his strategy of combining constraints in nomological terms with contraints in terms of actual causal relations. The paper focuses on the problem of the indeterminacy of the content of natural kind concepts. A concept (...) like water can pick out either a phenomenological property or a scientific one. Moreover, even on the assumption that the latter is shown to be most adequate, a given sample will still come out as falling into different natural kinds, according to the taxomomy of each particular science of which it constitutes an object. Both chemistry and physics contain concepts which are scientific counterparts of the common sense concept water, yet their extensions differ. As a criterion for determining the most relevant science for a given concept, I suggest to ask which science is most specific for the typical interactions of the subject possessing the concept, with her environment. The use of this criterion also permits one to show that a nomological theory is not necessarily verificationist, contrary to what has been claimed by Fodor and Boghossian (1991). (shrink)

This paper reports an analysis of the content of the codes of ethics of 15 professional business organizations in the United States, representing the broad range of disciplines found in business. The analysis was conducted to identify common ethical issues faced by business professionals. It was also structured to highlight ethical issues that are either unique to or of particular importance for business professionals. No attempt is made to make value judgments about either the codes of ethics studied or (...) of their content. General ethical values identified include honesty and integrity, general legal compliance, discreditable or harmful acts, and obligations related to social values. More business-specific issues include confidentiality, responsibilities to employers/clients, obligations to the profession, independence and objectivity, and business-specific legal and technical compliance issues. Propositional representations are units of information with a relational content. Their relational nature allows for the six distinctive properties of language-of-thought representations. Putting relating at the core of language-of-thought also fits well with the idea that thinking and reasoning are instances of relational behavior. These propositional and behavioral perspectives can be combined within a functional-cognitive framework.

Can there be 'narrow' mental content, that is entirely determined by the goings-on inside the head of the thinker? This book argues not, and defends instead a thoroughgoing externalism: the entanglement of our minds with the external world runs so deep that no internal component of mentality can easily be cordoned off.

Many of our thoughts are about particular individuals (persons, things, places, etc.). For example, one can spot a certain Ferrari and think that it is red. What enables this thought to latch onto that particular object? It cannot be how the Ferrari looks, for this could not distinguish one Ferrari from another just like it. In general, how a thought represents something cannot determine which thing it represents. What a singular thought latches onto seems to depend also on features of (...) the context in which the thought occurs. This suggests that its content is essentially indexical, contextually variable much as the content of an utterance like 'I am hungry' depends on who utters it and when (see DEMONSTRATIVES AND INDEXICALS). The indexical model of singular thought is not limited to thoughts about individuals one perceives, like the Ferrari driving by, but applies also to thoughts about individuals one remembers or has been informed of, like an old bicycle or Christopher Columbus. In each case, a certain contextual relation, based on perception, memory, or communication, connects thought to object. (shrink)

Criticisms and rejections of representationalism are increasingly popular in 4E cognitive science, and especially in radical enactivism. But by overfocusing our attention on the debate between radical enactivism and classical representationalism, we might miss the woods for the trees, in at least two respects: first, by neglecting the relevance of other theoretical alternatives about representationalism in cognitive science; and second by not seeing how much REC and classical representationalism are in agreement concerning basic and problematic issues dealing with mental (...) class='Hi'>content and intentionality. In order to expand and exemplify these ideas, this paper presents two heterodox positions on intentionality and on the relations between content and representation. Special attention is paid to the way REC is rejecting these positions: I argue that this rejection reveals common assumptions with classical representationalism, but also undermines the coherence of REC’s conception of intentionality. This book provides a formal ontology of senses and the belief-relation that grounds the distinction between de dicto, de re, and de se beliefs as well as the opacity of belief reports. According to this ontology, the relata of the belief-relation are an agent and a special sort of object-dependent sense (a "thought-content"), the latter being an "abstract" property encoding various syntactic and semantic constraints on sentences of a language of thought. One bears the belief-relation to a thought-content (...) T just in case one (is disposed as one who) inwardly affirms a certain sentence S of one’s language of thought that satisfies what T encodes, which in turn requires that S’s non-logical parts stand in appropriate semantical relations to items specified by T. Since these items may include other senses as well as ordinary objects, beliefs of arbitrary complexity are automatically accommodated. Within the framework of the formal ontology, a context-dependent compositional semantics is then provided for a fragment of regimented English capable of formulating ascriptions of belief—a semantics that treats substitutional opacity as a genuine semantic datum. Finally, the resulting picture of belief and its attribution is defended by showing how it solves standard puzzles, avoids objections to rival accounts, and satisfies certain adequacy conditions not fulfilled by traditional theories. Along the way, clarification and defense is offered for the ingredient conception of object-dependent senses, and it is shown how adoption of the language of thought hypothesis permits Bertrand Russell’s obscure doctrine of logical forms to be understood in a way that not only vindicates his Multiple Relation theory of de re belief but also reveals the connection between these logical forms and thought-contents. Causal theories of mental content (CTs) ground certain aspects of a concept's meaning in the causal relations a concept bears to what it represents. Section 1 explains the problems CTs are meant to solve and introduces terminology commonly used to discuss these problems. Section 2 specifies criteria that any acceptable CT must satisfy. Sections 3, 4, and 5 critically survey various CTs, including those proposed by Fred Dretske, Jerry Fodor, Ruth Garrett Millikan, David Papineau, Dennis Stampe, Dan Ryder, and (...) the author himself. A possible way out to Kripke’s Puzzle About Belief could start from the rejection of the notion of epistemic transparency. Epistemic transparency seems, indeed, irremediably incompatible with an externalist conception of mental content. However, Brandom’s inferentialism could be considered a version of externalism that allows, at least in some cases, to save the principle of transparency. Appealing to a normative account of the content of our beliefs, from the inferentialist’s standpoint, it is possible to state that a (...) class='Hi'>content is transparent when name-components of that content are a priori associated with some application conditions and, at the same time, reflection alone provides an a priori access to those application conditions, with no need of any empirical investigation. Nevertheless, such requirements are only met in trivial cases. The aim of this paper is to argue that some application conditions of that sort, albeit trivial, can be ontologically ampliative. As a result, the related contents can be regarded as transparent in a substantial and rich way. (shrink)
