This paper deals with the phenomenon of retroactive continuity, or retcon for short, in which the truth-value of a proposition in an established fictional work is changed later. The primary aim of this paper is to provide the most compelling explanation for retroactive continuity. I first defend the metaphysical view about fiction, according to which when retconning occurs, a fictional work changes its property of containing a proposition while preserving its identity. I then argue that this view is theoretically preferable (...) to all other competing approaches. (shrink)

The paper offers a reconstruction of the logics of jazz improvisation that is drawing on Žižek’s Work on Hegel. A basic concept of Žižek’s reading of Hegel consists in the concept of Retroactivity as the temporality that is characteristic of what Hegel understands as the development of history. The logic of retroactivity cannot be understood in terms of a classical teleological account but rather draws upon the idea of incommensurable events: Each historical situation is presupposing its own preconditions (...) in a way that the contingent is transformed into necessity. The paper discusses the structure of the temporality of jazz in such a way that it can be informed by Žižek’s thoughts on the temporal logic of history. (shrink)

The topic of instrumentalism has engaged many scholars of contemporary educational thought. One can distinguish the positions of anti-instrumentalism from those that stress noninstrumental values of education, both conceived in the context of neoliberal/neoconservative and consumption-driven reality. In this text, Maria Mendel enters into this engagement from the perspective of the current political consumption of memory. While taking up the problem of the role public pedagogy plays in contemporary nation-states — especially in the current turn toward the past — Mendel (...) focuses on both educational and sociopolitical issues in the context of what she calls “retroactive instrumentalism.” When return to the past is the “principle of the contemporary,” she argues, instrumentalism does not necessarily result from intentional planning ex ante. If education is broadly understood as a practice of public space formation, it may be composed of experiences that do not have to be “traditionally” purposeful and oriented toward the future. They may gain their instrumental character ex post. To illustrate this possibility, Mendel analyzes snippets of Polish reality concerning the construction of “the good nation.” Many of the elements of public pedagogy in this case contain unifications that pertain directly to the instrumental character of the learning experiences employed by a society as it transforms into a nation. The instrumentalism of those elements is discovered post factum. In its ontological dimension, then, education may gain or solidify its instrumental character ex post. Based on the analysis proposed in this text, one could say that when instrumentality is retroactive, it becomes displaced intentionality — that is, it provides an instrumental story that disguises the intentions of the one writing the narrative. Mendel concludes by using the Aristotelian notion of phantasia, which regards “being without a matter,” to encourage productive thought about how to create public narratives that are free of instrumentalism. This grounds a version of public pedagogy that is oriented toward the animation of people's active imagining and thus becoming public. By epistemologically shifting learning into a public space, such public pedagogy serves to recultivate society and humanity as plurality, diversity, and coproduction of the public. (shrink)

The underlying theme of this article is how a successor state should deal with its past. It considers whether a state that is committed to the rule of law may depart from it in order to deal with problems left to it by its predecessor regime. Specifically, may it use retroactive legislation to punish informers who collaborated with a predecessor police state? Lon Fuller's formulation of the canons of the rule of law as an internal morality of law is expounded (...) as well as his notion of legal pathology as symptomatic of departure from the canons' requirements. Various problems inherent to the implementation of the rule of law are examined, such as the effect of the passage of time on reasonable expectations. While legal pathology is always a matter of degree, police states are shown to suffer seriously from it. Among the examples discussed are Nazi Germany and Communist East Germany, though it is granted that there are moral differences between them. In the course of the discussion, a response is made to some contemporary critiques of the rule of law. Although it would be difficult to formulate a retroactive law for punishing informers, it is argued that such a law may be the best way for a successor state to express a moral judgment on its past. Diesem Artikel liegt die Frage zugrunde, in welcher Weise ein Nachfolge-Staat mit seiner Vergangenheit umgehen sollte. Es wird untersucht, ob ein Staat, der sich der Idee des Rechtsstaats verpflichtet fühlt, von dieser Idee abrücken darf, um mit den Problemen umzugehen, die ihm von seinem Vorgänger-Staat hinterlassen worden sind. Insbesondere wird gefragt, ob ein solcher Staat zu dem Mittel rückwirkender Gesetzgebung greifen darf, um Denunzianten zu bestrafen, die mit einem vorangehenden Polizeistaat kollaboriert haben. Lon Fullers Formulierung der Prinzipien eines Rechtsstaats im Sinne einer internen Moralität des Rechts wird ebenso erläutert wie sein Begriff von rechtlicher Pathologie als Symptom für ein Abgehen von den Anforderungen der genannten Prinzipien. Verschiedene Schwierigkeiten, die mit der Verwirklichung des Rechtsstaats entstehen, werden näher untersucht, so etwa die Auswirkungen des Zeitablaufs hinsichtlich vernünftiger Erwartungen . Wenngleich rechtliche Pathologie immer eine Frage des Grades ist, kann doch gezeigt werden, daß Polizeistaaten ernstlich an ihr leiden. Unter den diskutierten Beispielen sind Nazi-Deutschland und das kommunistische Ostdeutschland, obwohl zugegeben werden muß, daß es zwischen diesen moralische Unterschiede gibt. Im Verlauf der Untersuchung wird zudem auf einige gegenwärtige kritische Stellungnahmen zum Rechtsstaat erwidert. Obwohl es schwierig wäre, ein rückwirkendes Gesetz zur Bestrafung von Denunzianten zu formulieren, wird doch die These vertreten, daß ein derartiges Gesetz der beste Weg für einen Nachfolge-Staat sein könnte, ein moralisches Urteil über seine Vergangenheit zum Ausdruck zu bringen. Sensation elicited by a skin stimulus was subjectively reported to feel stronger when followed by a stimulus to somatosensory cerebral cortex , even when C was delayed by up to 400 ms or more. This expands the potentiality for retroactive effects beyond that previously known as backward masking. It also demonstrates that the content of a sensory experience can be altered by another cerebral input introduced after the sensory signal arrives at the cortex. The long effective S-C intervals support the (...) thesis that a duration of cortical activity of up to 0.5 s is required before awareness of a sensory stimulus is developed. (shrink)

This chapter examines the concept of the so-called retroactive harms and wrongs related to death, explaining the principle of the immunity thesis which holds that nothing that happens after we are dead harms or benefits us. It presents a case against the existence of proactively harmful postmortem events and argues that an action taken after people die may wrong them retroactively by harming them or by interfering with their desires while they are alive.

This article discusses three recent philosophers who speak in different ways about the retroactive construction of reality by human knowledge. Bruno Latour unapologetically claims that the Egyptian Pharaoh Ramses II could not have died of tuberculosis, as determined by a team of French doctors in 1976, since this disease was not discovered until three thousand years after his death. Slavoj Žižek often makes comparable arguments, though his version of retroactivity draws on both psychoanalysis and dialectics in a way that (...) is never the case for Latour. Yet in his 2012 book Less Than Nothing, Žižek takes the more prudent, realist-sounding line that changes in scientific theories do not change nature itself. The real novelty in retroactive theories is provided by Thomas Kuhn, who draws our attention to a grey temporal zone in scientific discovery in which it is impossible to pinpoint the exact date of any breakthrough. For Kuhn, this stems from a dualism found in reality itself: one between the fact “that” a thing exists and the determination of “what” its properties are. The tension between these two moments is responsible for much of the vagueness and drama surrounding any paradigm shift in the sciences and is closely related to at least one plausible theory of metaphor. In closing, three Hollywood films are cited as helpful examples for understanding the different ways in which a paradigm shift works its retroactive magic. (shrink)

We consider several thought and practical experiments, and variations thereof, from which the existence can be inferred of retroactive effects on the assumptions of conservation of linear and angular momentum and of realism defined in a wide sense. Such conclusion is made less counterintuitive by research into the proper physical background of the relativistic length contraction of a moving arrow, viz. the fact that the universe is four-dimensional indeed. In one of the experiments considered, the evidence of retroactivity is (...) more striking and can more easily be actually demonstrated than was the case in earlier proofs. (shrink)

In the transition from a repressive to a democratic society, the successor government faces the problem of how to deal with grave human rights violations such as killings and torture committed under its predecessor. This paper analyzes the dilemma a new government may encounter when it attempts to prosecute and punish those found responsible. On one hand, trials of chargeable officers may be able to prevent human rights abuses in the future and to facilitate instituting or restoring democracy. On the (...) other, in the case that there were no legal rules definitively prohibiting the abuses committed by these officers, the trials require ex post facto laws, which breach the principle of nulla poena sine lege, and more generally violate the rule of law. These retroactive laws not only break legal predictability but treat individuals unfairly. After identifying both the need for, and the legal and political losses incurred by such criminal trials, the author examines the claims that international law resolves the dilemma of retroactive justice or that prosecution is justified as a fulfillment of international obligation. Then the author refers to this dilemma as “dirty hands” to characterize a circumstance in which one cannot avoid using the wrong means to obtain the best ends. Such characterization has normative implications for three aspects of trials: the process of enacting retroactive laws and the process of conducting the trials; the choice of other possible legal remedies; and the principles related to reactions in the international community. This article affords particular attention to the relationship between memory, the narrativization of news and its linear construction, conceived as journalism’s ‘memory- work’. In elaborating upon this ‘work’, it is proposed that the Hegelian notion of retroactive causation (as used by Slavoj Žižek) can examine how analyses of news journalists ‘retroactively’ employ the past in the temporal construction of news. In fact, such retroactive (re)ordering directs attention to the ways in which journalists contingently select ‘a past’ to confer meaning on (...) the present. With regard to current literature, it is noted that a retroactive analysis can highlight two important dialectics within the practice of news journalism: 1) the relation between contingency and necessity; and, 2) the relation between content and form. Indeed, it is argued that this theoretical account offers a novel approach to examining the significance of memory in news journalism as well as the inconsistencies which underscore journalism’s memory-work. It is in accordance with such inconsistency that broader reflections on time, temporality and our relations to the past can be made. (shrink)

Shifts of attention within working memory based on retroactive (retro-) cues were shown to facilitate performance in working memory tasks. Although posterior asymmetries in the EEG, such as the contralateral delay activity (CDA), have been used to study the active storage of lateralized working memory representations, results on the relation of such asymmetric effects to retro-cue benefits remain inconclusive. We recorded EEG in a retro-cue working memory task with lateralized items and a continuous performance response. Following either a selective or (...) neutral retro-cue, participants adjusted the orientation of a central memory probe to the cued item. Selective retro-cues elicited an early posterior contralateral negativity (PCN), anterior directing attention negativity (ADAN) and a later modulation of CDA indicating that active storage was concentrated on the cued information. By dividing all trials into three within-condition performance quantiles, we could further show that high working memory accuracy was associated with a sustained increase of the CDA effect following the retro-cue. These results suggest that focusing resources on the active storage of relevant representations is an important factor regarding retro-cue benefits in working memory tasks. (shrink)

This chapter discusses the retroactivity problem and how it arises when the idea that events occurring after a person’s life can harm that person is pursued. The common objection to this dilemma is the “no subject” type of response. The retroactivity problem is the result of making several assumptions jointly, many of which are initially plausible but none of which are actually defended. The first of these assumptions is referred to as Worse-Off, which states that an event harms (...) a person only if it makes him worse off than he would have been if the event had not occurred. The second assumption, implied by the first, is referred to as Welfare, which states that an event harms a person only if it makes it the case that his welfare is lower than it would have been if the event had not occurred. If a statue and lump of clay have the same life-histories, are they numerically identical?

Quantum theory predicts that, e.g., in a Stern-Gerlach experiment with electrons the measured spin component $S_Z = \pm \frac{1}{2}$ does not come about by an adjustment at the last moment, a forced “flipping” or “tilting” of the spin (vector), which would imply z-angular momentum exchange between particle and instrument, but will afterward appear to have had the value $\frac{1}{2} or - \frac{1}{2}$ already before the measurement. Because an electron spin cannot have components $ \pm \frac{1}{2}$ in all directions at the (...) same time, the measuring direction has a “privileged” status before the measurement, however we choose that direction, which implies a retroactive effect. A second proof of retroactivity is derived from a special case of the paradox of Einstein, Podolsky, and Rosen. It is strongly suggested by our result that, in essential respects, both Bohr and Einstein were right in their famous controversy about determinism and considering microprocesses “as a whole.”.
