Objective: Cognitive impairment is a common neurological complication in patients with end-stage renal disease undergoing maintenance hemodialysis. Brain network analysis based on graph theory is a promising tool for studying CI. Therefore, the purpose of this study was to analyze the changes of functional brain networks in patients on MHD with and without CI by using graph theory and further explore the underlying neuropathological mechanism of CI in these patients.Methods: A total of 39 patients on MHD and 25 healthy controls (...) matched for age, sex, and years of education were enrolled in the study. Resting-state functional magnetic resonance imaging and T1-weighted high-resolution anatomical data were obtained, and functional brain networks for each subject were constructed. The brain network parameters at the global and regional levels were calculated, and a one-way analysis of covariance was used to compare the differences across the three groups. The associations between the changed graph-theory parameters and cognitive function scores in patients on MHD were evaluated using Spearman correlation analysis.Results: Compared with HCs, the global parameters [sigma, gamma, and local efficiency ] in both patient groups decreased significantly. The clustering coefficient in patients with CI was significantly lower than that in the other two groups. The regional parameters were significantly lower in the right superior frontal gyrus, dorsolateral and gyrus rectus of patients with CI than those of patients without CI; however the nodal local efficiency in the left amygdala was significantly increased. The global Cp and regional parameters in the three brain regions were significantly correlated with the cognitive function scores.Conclusion: This study confirmed that the topology of the functional brain network was disrupted in patients on MHD with and without CI and the disruption of brain network was more severe in patients with CI. The abnormal brain network parameters are closely related to cognitive function in patients on MHD. (shrink)

In this brief paper, a case is made for the moral permissibility of assisted dying. The paper proceeds by highlighting a common critique from within disability rights scholarship and advocacy that emphasizes the vulnerability of people with disabilities and the risks associated with permitting assisted dying. The paper suggests that because medicine necessarily involves risk, primarily through the high likelihood of medical error, that the risk and harm being utilized as a justification to prohibit assisted dying by disability rights scholars (...) is in fact, not conceptually or morally unique. Finally, it is argued that because all medicine involves a risk of harm, and assisted dying is not unique in this respect, that one cannot effectively launch a critique of assisted dying on this basis. Assisted dying is a divisive and controversial topic and it is therefore desirable that a broad range of interests inform any proposed policy changes. The purpose of this study is to collect and synthesize the views of an important stakeholder group—namely people with disabilities —as expressed by disability rights organisations in Great Britain. Parliamentary consultations were reviewed, together with an examination of the contemporary positions of a wide range of DROs. Our analysis revealed that the vast majority do not have (...) a clear public stance; those that do exhibit a significant diversity of opinion. DROs opposing legislation on assisted dying have argued that it would be premature, misguided, inequitable and culturally undesirable. Some specify conditions that would have to be satisfied before they could support legalisation, such as radical improvements in health and social care services and the elimination of discrimination against PwD. DROs supporting assisted dying maintain that a change in the law would promote autonomy, end intense suffering, can be delivered safely and is supported by the DRO’s membership. The discussion considers the reasons why several DROs adopt a neutral stance and the argument is made that, whatever their overarching stance on the issue, DROs need to be involved in the policy debate so that the crucial perspectives of PwD are heard and addressed. This is an important message for countries around the world that permit, or are considering legalising, assisted dying. (shrink)

That Kant’s moral thought is invoked by both advocates and opponents of a right to assisted dying attests to both the allure and and the elusiveness of Kant’s moral thought. In particular, the theses that individuals have a right to a ‘death with dignity’ and that assisting someone to die contravenes her dignity appear to gesture at one of Kant’s signature moral notions, dignity. The purposes of this article are to outline Kant’s understanding of dignity and its implications (...) for the ethics of assisted dying. According to Kant, that which has dignity must be treated as an end in itself and may not permissibly be exchanged for that which merely has price. Kant’s reasoning thus seems to preclude acts of self-killing, including voluntary assisted dying, that rest on individual self-interest, since a person’s interests merely have price. However, a recognizably Kantian view of dignity can permit assisted dying under two sets of circumstances: First, it can be permissible for agents who anticipate a degradation of their rational agency due to conditions such as dementia to direct others to end their lives once sufficiently demented. In so doing, such agents in effect exercise a right to impose obligations on others regarding how their bodies, which will at some future point no longer be the vessels of their rational agency, are to be disposed of. Second, Kant errs in supposing that our dignity can stem solely from our moral personality, i.e., from our capacity to abide by universalizable moral principles. Rather, complete dignity also requires the capacity for setting discretionary ends and the means to those ends, i.e., the dignity of humanity. Individuals with prolonged and intense depression, in severe pain, or with serious disability may lack humanity while retaining their moral personality. In such cases, I propose that their opting to end their lives, with or without the assistance of others, does not amount to exchanging their dignified selves for something which merely has price and is therefore not objectionable on Kantian grounds. This article explores at least two dominant critiques of assisted dying from a disability rights perspective. In spite of these critiques, I conclude that assisted dying ought to be permissible. I arrive at the conclusion that if we respect and value people with disabilities, we ought to permit assisted dying. I do so in the following manner. First, I examine recent changes in legislation that have occurred since the Royal Society of Canada Expert Panel on End-of-Life Decision-Making report, published in (...) this journal. I suggest that these changes are likely to only strengthen opposition to assisted dying from disability rights activists and people with disabilities. Second, I focus on respect for people with disabilities and in particular, respect for their autonomy and decision-making abilities. Third, I explore the opposition to assisted dying that focuses on risk and the vulnerability of people with disabilities. Here I suggest that this risk ought not to be of special concern. Ultimately, I conclude that upholding respect for the disabled requires the legalization of assisted dying, rather than the denial of access in a misguided effort to protect people with disabilities. Incidentally, the influence Junger's thinking exerted on the late Martin Heidegger's philosophy of technology is not to be underestimated. Ecology and environmental protection became "left-wing" topics in the 1970s, and though Junger's book still acted on its readers, it gradually fell out of favor with a broader public. The perfection of technology today awaits its rediscovery, which would always be rewarding. Junger's thoughts on Nietzsche run against the grain of what we take for granted in current Nietzsche studies. In this paper I attempt to analyze the basic tension in Kant's philosophy of right, i.e. within the conceptual framework of his Transcendental Idealism. Right as the embodiment of laws of freedom applicable to mortal-rational agents bridges the gap between their noumenal character and empirical-natural existence. How can this gap be bridged? A priori juridical laws are not sufficient to provide a complete classification for the empirical realm, exhausting all possible positive rights. Furthermore, according to Kant, Right (...) must be basically justifiable by reason. Yet this justification is merely a necessary condition for obligation. In order to develop any real obligation, it must be complemented by a non-deducible, empirical-positive aspect . Hence only as a result of actually exercising individual freedom does the mutual necessitation to recognize individual freedom for all arise. The historical-factual formation of civil social orders, though subject to a priori foundation, is thus unavoidably marked by contingency. Nonetheless, because of its a priori character, the idea of a society of free individuals becomes the standard of critique for every empirical instantiation of a civil social order. Recht als Inbegriff der Gesetze der Freiheit endlich-vernünftiger Subjekte leistet eine Vermittlung zwischen dem noumenalen Wesen und der emprisch-naturalen Existenz dieser Subjekte. However, as Michele F. Sciacca (...) (another commentator on Gentile) notes in the Preface, the Gentilian system of "actual idealism" should get a better hearing in France from now on, because the widespread interest in Hegel there since 1925 has prepared the ground for its proper reception. The Bibliography, for which Sciacca himself is responsible, includes a section on Gentile's own writings "concerning the national and political formation of Italy" (p. 14); but, significantly enough, those dealing directly with Fascism are all omitted. This omission seems a deliberate attempt to separate Gentile the philosopher from Gentile the Fascist. No matter how understandable psychologically and politically may be the motive here--to have French readers forget that Gentile was the philosopher of Fascism--the attempt itself at bibliographical expurgation, ironically, runs completely counter to the very accent of the Gentilian theory of "pure act" on the unity of thought and action in human experience and history. Rightly or wrongly, Gentile (in sharp contrast to Croce) saw in Fascism the political expression of that unity. As to the secondary sources, the Bibliography again is unnecessarily incomplete, citing as it does only one work in English on Gentile. The anthology closes with a critical note on Gentile's transcendental conception of immortality by the translator (Joseph Moreau), who argues that the "actualistic" philosophy, despite its "religious tone," defeats itself by ending up with an "Epicurean attitude" (p. 324) toward death and the afterlife. Miss Isadora Bauer's book lends a salutory touch to contemporary philosophical literature, so much of which is abstract and removed from experience. Her treatise, on the other hand, has for its subject matter the human condition, its finitude, and its inescapable tragedy. Georg Simmel, an early twentieth-century philosopher, is less known in this country than he deserves to be. His "Lebensphilosophie," as Miss Bauer points out, although it was influenced by Schopenhauer and Nietzsche, found an original expression through him and foreshadowed in many ways the work of Husserl and the contemporary existential thinkers. Miss Bauer's presentation of Simmel's concept of the tragic is lucid and thorough and manages in a wonderful way to let us see through this one aspect the broad outlines of Simmel 's philosophy as a whole. In Simmel's formulation, life itself, unfolding in tragic antinomy of flux and form, of becoming and being, is the ultimate ground of all tragic conflict. The dynamic life process brings forth all forms and also endangers and destroys them over and over again. The human being encounters these opposites in all aspects of his experience: his existence is tragic at its core. "Moira," the ancient goddess who confronted the Greek hero as an alien power, is in Simmel's modern view of tragedy within man himself. She is the opposition between continuity and discontinuity, the mere stream of events and their form or meaning broken in tragic conflict. At this point, Simmel's dialectics leads to a "third realm," a "more BOOK REVIEWS 285 than" which is both immanent and transcendent, a kind of "coincidentia oppositorum" beyond logic and definition. It is the realm of the "person" within which, although the tragic conflict is not resolved, there arises the free self from whose non-dual perspective the unity and eternity of life are seen. Within this realm the individual gains an illumination the result of which is "amor fad," his free decision to affirm his being. In this act of decision lies the "meaning" and "value" of life. The substance and point of Miss Bauer's book is to show the connection between the metaphysical ground of Simmel... (shrink)

Disconnecting a patient from artificial life support, on their request, is often if not always a matter of letting them die, not killing them—and sometimes, permissibly doing so. Stopping a patient’s heart on request, by contrast, is a kind of killing, and rarely if ever a permissible one. The difference seems to be that procedures of the first kind remove an unwanted external support for bodily functioning, rather than intervening in the body itself. What should we say, however, about cases (...) at the boundary—procedures involving items that seem bodily in some respects, but not others? When, for instance, does deactivating an implanted device like a pacemaker count as killing, and when as letting die? Contra existing proposals, I argue that the boundaries of the body for this purpose are not drawn at the boundaries of the self, or (if this is different) the human organism. Nor should we determine when we are killing and when we are letting die by deferring to existing practices for distinguishing ongoing from completed treatment. Rather, I argue that whether something (organic or inorganic) counts as body part for purposes of this distinction depends on the results of a normative analysis of the particular character of our rights in it—particularly, whether and in what way these rights ought to be alienable. I conclude by arguing that there are likely good reasons to recognize distinctively “bodily” rights and restrictions in at least some implantable devices. (shrink)

In scientific theories, mainly in the theories of probability, is shown that the different meanings of freedom finally are founded in the anthropological forces of the mind. Whilst free will is only (...) one form of realizing freedom in mind and action by the individual, it is also interpersonal constituted on the idea of liberty which following John Stuart Mill Freedom, thus thought in public opinion and in religious worship by the Churches, is dependent on the human rights, which must be observed to preserve general welfare. The Animal Rights Thesis (ART) entails that nonhuman animals like pigs and cows have moral rights, including rights not to be unjustly harmed. If ART is true, it appears to imply the permissibility of killing ranchers, farmers, and zookeepers in defense of animals who will otherwise be unjustly killed. This is the Militancy Objection (MO) to ART. I consider four replies to MO and reject three of them. First, MO fails because animals lack rights, or lack rights of sufficient strength (...) to justify other-defensive killing. Second, MO fails because those who unjustly threaten animals aren't liable or, if they are liable, their liability is outweighed by other considerations (e.g., a strong presumption against vigilante killing). I then argue both of these fail. Third, MO succeeds because animal militancy is permissible. Fourth, MO fails because there aren't liability justifications for defensive killing in general (i.e., pacifism is true). I argue that there's thoroughgoing epistemic parity between the Militancy View (MV) and the Pacifist View (PV), and that two considerations favor PV over MV. First, because under conditions of uncertainty, we should believe rights-bearers retain rather than lose their rights, which PV affirms and MV denies. Second, because PV is intrinsically likelier than MV to be true since PV at worst affirms wrongful letting die and MV at worst affirms wrongful killing, the latter of which is intrinsically harder to justify than the former. (Bonn: Bouvier, 1974. Pp. 220) Michael Heinen's book draws attention to Dilthey's interest in the original dimension of art experience. That interest has been the traditional stock in the trade of philosophers since the ancient Greeks, and most crucially since the subjectivization of the aesthetic sphere in the speculative thought of Kant and German idealism. But the point is that there is a gap between those philosophers who speculated about perception, aesthetic pleasure, and the enjoyment of the senses, and who tried to justify those speculations through wide-ranging inquiries into the order of the world and its understanding through our ego and its potentialities--betweenthem and Dilthey, who knows that this age-old enthusiasm for metaphysical and epistemological inquiries has become obsolete. The earlier display of erudition may be vast and awe inspiring. But in Dilthey's mind an interest in those inquiries is no longer foremost. Commendable as all of them may be, they approach the world of the work of art and its experience from the outside, in an independent, self-sufficient, and almost autonomous manner, without facing up to the horizon of the world in which an artistic work is rooted. This horizon of the world emerges as the leitmotif of Heinen's book. Heinen reminds the reader that those who create are immersed in this horizon. The conditions under which they work, the tools they have, the methods they use, the materials that are available to them, the ideas they have in mind--all this can be traced back to the world which surrounds them. Moreover, they belong to an historical world. They are oriented toward a past they remember, a future they anticipate; and all they think, or feel, or will, stands in an historical context, long before they are conscious of themselves in this respect. Heinen rightly points out that this creates a problem not only for the analysis of the artistic expression but for the field of hermeneutics, for the method of understanding this expression. It is not so much something that is understood in its meaning by referring to an ego, or a system of cognitive faculties. It emerges from the socio-historical world; and we must place it back in the same horizon from which it emerges. Heinen agrees with Dilthey that we always find ourselves within the whole of life; and when understanding something--a work of art or any other historical object--we have to do it within the full context of life to which we belong. It is an objectification of life that we have to understand from life itself. This may help to explain why a work of art is more than an object created by an artist through his inspiration and the unconscious production of his genius. From his Hegelian perspective Heinen tells us that whenever an artist is involved in the creation of something he is dependent upon the world in which he lives and upon a dialectic between himself and the horizon of life. Heinen expressly defends the probability of this dialectic in a chapter on the presuppositions of Dilthey's aesthetics (pp. 134-162). He studies Dilthey's attempt to discover a methodological basis for the human sciences. He calls attention to the remarkable sequence of sketches in which Dilthey distinguishes between Geisteswissenschaften and Naturwissenschaften, between human sciences that, in one way or another, deal with historical and other manifestations of 488 HISTORY OF PHILOSOPHY life and inner experience, and natural sciences that deal with phenomena, with objects of nature. He addresses the voice of a dead poet, an absent voice that can only speak through a peculiar form of writing that spells out letters one by one through the tappings of a table. It is a voice that writes since it can no longer speak, having lost its head to the guillotine during the French Revolution. During the séances, Hugo asks Chénier to recount the experience of his death. Is it because Chénier is in the unusual position of speaking from beyond the grave that Hugo expects him to do the impossible, to go beyond the silenced voice of the condemned man, that is, beyond the reach of fiction? How are we to read this writing of the Tables, and what does it have to do with "literature"?The transcript dramatizes fundamental notions concerning writing, death, and relations between the two that Blanchot will theorize a century later in his critical writings. This paper explores the nature of rights, and their implications for the ethics of nursing. A right is seen as an entitlement which is justified on moral and/or legal grounds, and which may take the form of a right of action or a right of recipience, or both; in either case, correlative duties are generally imposed on others. Some of the conflicts which can occur among two or more conflicting rights are examined through three hypothetical scenarios, and (...) approaches to their resolution are suggested. The question of whether nurses, as nurses, possess rights is then considered, and it is suggested that they do not. In conclusion, it is argued that, if rights are to be a helpful concept, they must be carefully defined and analysed, and their relationship to one another, and to duties, must be clarified. Background: Frailty is a common syndrome among older adults and patients with several comorbidities. Grip strength is a representative parameter of frailty because it is a valid indicator of current and long-term physical conditions in the general population and patients with severe mental illnesses. Physical and cognitive capacities of people with SMIs are usually impaired; however, their relationship with frailty or social functioning have not been studied to date. The current study aimed to determine if GS is a valid predictor (...) of changes in cognitive performance and social functioning in patients with type-2 diabetes mellitus and SMIs. Methods: Assessments of social functioning, cognitive performance, and GS were conducted in 30 outpatients with type 2 diabetes mellitus, 35 with major depressive disorder, 42 with bipolar disorder, 30 with schizophrenia, and 28 healthy controls, twice during 1-year, follow-up period. Descriptive analyses were conducted using a one-way analysis of variance for continuous variables and the chi-squared test for categorical variables. Differences between groups for the motor, cognitive, and social variables at T1 and T2 were assessed using a one-way analysis of covariance, with sex and age as co-variates. To test the predictive capacity of GS at baseline to explain the variance in cognitive performance and social functioning at T2, a linear regression analysis was performed. Results: Predictive relationships were found among GS when implicated with clinical, cognitive, and social variables. These relationships explained changes in cognitive performance after one year of follow-up; the variability percentage was 67.7%, in patients with type-2 diabetes mellitus and 89.1% in patients with schizophrenia. Baseline GS along with other variables, also predicted changes in social functioning in major depressive disorder, bipolar disorder, and schizophrenia, with variability percentages of 67.3, 36, and 59%, respectively. Conclusion: GS combined with other variables significantly predicted changes in cognitive performance and social functioning in people with SMIs or type-2 diabetes mellitus. Interventions aimed to improve the overall physical conditions of patients who have poor GS could be a therapeutic option that confers positive effects on cognitive performance and social functioning. Despite its draft character, the Marburg lecture from the summer semester of 1926 can rightly be regarded as Heidegger's version of a philosophizing passage through the history of Greek philosophy up to Aristotle, which was attempted in the thinking phase of Being and Time. Entirely in line with the historical understanding of being and time, these interpretations aim to repeat the crucial beginning of Western philosophy as an ever richer and more differentiated process of discovering being from beings, because only (...) in this way can contemporary philosophy adequately explore its possibilities for questioning can acquire.In contrast to the later understanding, which interprets the history of Greek philosophy as a movement of disintegration of an original affirmation of being, Heidegger sees in the present lecture an ascending movement of the self-development of the idea of ​​being towards the climax in Aristotelian philosophy. In Sweden, palliative care has, over the past decades, been object to policies and guidelines with focus on how to achieve “good palliative care”. The aim of this study has been to analyse how experts make sense of the development and the current state of palliative care. Departing from this aim, focus has been on identifying how personal experiences of ‘the self’ are intertwined with culturally available meta-level concepts and how experts contribute to construct new scripts on palliative care. Twelve (...) qualitative interviews were conducted. Four scripts were identified after analysing the empirical material: 1. script of paths towards working within palliative care; 2. script of desirable and deterrent reference points; 3. script of tensions between improvement and bureaucracy; and 4. script of low status and uncertain definitions. The findings of this study illustrate how experts in complex ways intertwine experiences of ‘the self’ with meta-levels concepts in order to make sense of the field of palliative care. The participants did not endorse one “right way” of “good” deaths. Instead, palliative care was considered to be located in a complex state where the historical development, consisting of both desirable ideals, death denials and lack of guidelines, and more recent developments of strives towards universal concepts, “improvement” and increased bureaucracy altogether played a significant role for how palliative care has developed and is organised and conducted today. This article demonstrates the ways in which Adorno’s and Horkheimer’s reflections on the dialectic of the domination of nature shed new light on recent discussions about the concept of the Anthropocene. A central motif is the fear of nature, which, according to Adorno, prevailed at the beginning of its mastery by humans in prehistoric times. Harnessing external nature enabled the stabilisation of internal nature and social relations. This link between nature’s relative stability and social relations was characteristic of the Holocene. (...) In the Anthropocene, capitalist domination destabilises nature, which in turn destabilises social life. The natural terror of nature returns in the face of the socially produced climate catastrophe, adding a new aspect to Adorno’s and Horkheimer’s diagnosis of the domination of nature. The article concludes by suggesting a changed relationship to nature, which no longer would understand it as a mere object, but as a “subject in its own right”. (shrink)

In this article, Herbert Marcuse’s nature-ethical considerations, which have to date been scarcely received, are used to develop perspectives on how the nature-ethical gap in contemporary Critical Theory could be closed. The central idea is that nature is tobe recognized as a subject in its own right without needing to anthropomorphize it in the process. The advocatory ethics of nature, which is outlined here, differs from current sustainability and environmental ethics primarily in that it maintains the tension between an (...) anthropocentric and an ecocentric approach and does not resolve it in one direction. Marcuse’s so-called “liberation of nature” is understood as a means for the “liberation of humans”, but the latter can only succeed if the former is also carried out. (shrink)

Hegel’s political philosophy regards the “corporation” as both a civil society association and an institution guaranteed under the constitution. The present article focuses on the concept of corporation as an institution of the ‘internal constitution’ by analysing some of the writings which go back to Hegel’s Heidelberg and Berlin phases, namely the Heidelberg review of the Proceedings of the Estates Assembly of the Kingdom of Württemberg, 1815–1816, his first lectures on the Philosophy of Rights, and the Elements of the Philosophy (...) of Rights. Notwithstanding the analysis shows that Hegel’s sophisticated constitutional culture is informed directly by, and developed along with, his involvement in the Württemberg’s political debates, yet his idea of State administration is far more elaborate than the constitutions of nineteenth-century German States which it does not, in fact, intend to merely reproduce. I shall argue that Hegel’s account of corporation is based on his specific understanding of European history and the related conceptualization of institution as a guarantee of freedom. Both history and theory are necessary tools to frame and comprehend the philosopher’s discussion of corporation, whose civil and institutional nature is essential to conceive the connection established between the government of civil society and legislative power. I contend that the role that Hegel attributes to corporations cannot be interpreted as an idea reflecting or inherited from the history of the German states, and that rather it represents the key to understanding his concept of patriotism and model of political representation via the assemblies of estates. From this perspective, it appears clear that the Hegelian theory of corporation is at the center of the philosopher’s diagnosis on the crisis and evolution of the modern State. (shrink)

Human dignity is a stubborn concept, at least for jurists and philosophers. After World War II it found its way immediately into the opening articles of the UN Charta, the Universal Declaration of Human Rights, and the German Grundgesetz, apparently out of the blue, i. e. almost without any precedent in earlier juridical docu- ments. Consequently, scholars of law still have difficulties to formulate an adequate understanding of human dignity. And although the concept has a certain tradition in philosophy, if (...) we search for an independent ethi- cally attractive understanding of human dignity, it turns out that going back to Cicero, Kant or the Christian heritage is of little help, too. Much more promising, though, is a look at the long-standing usage of the expression ‘human dignity’ and its German counterpart Würde des Menschen where something like a universal right not to be humiliated is expressed. Given this understanding, we can read the commandment to respect human dignity as the basic obligation to treat other people in a way that allows them to keep their personal, individual dignities—or at least minimally decent ones. To be sure, this formulation is just a very first, tentative step on the way to a philosophically satisfying conception of human dignity, but in the author’s opinion it is definitely a promising start for a research group. One of Max Charlesworth’s most important contributions has been to the development of contemporary bioethical thinking. In Bioethics in a Liberal Society, Charlesworth explores the consequences of the liberal commitment to the core value of autonomy across a range of areas beginning with the end of life. Focusing on just this latter issue, this contribution explores the question whether the principle of autonomy is indeed adequate to be the primary principle on the basis of which to address the issues surrounding (...) the end of life. This study defends the legitimacy of the Enlightenment project by way of its different realizations in the philosophies of Immanuel Kant and Friedrich Heinrich Jacobi. Today, Enlightenment as a cosmopolitan project with a global claim is often considered synonymous with Western chauvinism. The assertion of a universally binding reason is all too obviously inconsistent with the much-cited recognition of cultural differences. In contrast, it is the conviction brought forward in this book that an adequately understood Enlightenment is an unconditional (...) class='Hi'>right of every person taking an active interest in a self-determined way of life. Only the realization of this conception of Enlightenment can provide the required space for the reciprocal recognition of human differences to freely unfold. (shrink)

This essay on “The Status of Health in Plato’s Theory of Goods” discusses how health figures as a “good” in the framework of Plato’s general theory of human goods. It starts with meta-ethical distinctions regarding how things can be classified as “good,” including the conceptual distinctions between intrinsic, final, and constitutive goods. I then discuss passages in Plato that shed light on the function of health as an “instrumental good” that contributes to an undisturbed mode of existence free to pursue (...) truly valuable goals. Against Stoicising interpretations, I show that Plato maintains that health, as an instrumental good, makes a difference with respect to the quality of a virtuous person’s life. I then turn to the famous classification of goods introduced at the beginning of Republic II. The main concern there is the controversial status of justice as a good, but the division also mentions health as a good worthy to be pursued in its own right and not just on account of its causal consequences. Since this classification and how it is used create serious problems for the interpretation, I first try to work out a solution, focusing on the status of justice as an intrinsic, final and constitutive good. In my concluding segment, I then explain on what basis Plato can classify health as not only an instrumental, but also a (weak) constitutive good. This requires a discussion of how Plato views the relation of the body to the human ‘self.’ My answer credits him with a more differentiated understanding of this relation than is usually assumed. The article argues that the doctrine of Gorgias of Leontinoi, as expressed in his "Encomion of Helen", is not a rhetorical technique but a practice of moral education. The medium of this "ethical speech practice" is perceptual forms, its basic mode being the practice of showing or epideictic speech. The crucial standard of this practice is "epideictic rightness", which is identical to Gorgias’ conception of "truth.". According to this conception, speech is true if it exemplifies morally right conduct and (...) moral beauty. True speech in this sense must also be effective speech, since it will promote right behaviour in the future. (shrink)

This essay argues that realism in ethics and in politics is best understood as a discipline of mind directed against wishful thinking. Reading Geuss in this context, against the background of the work of Bernard Williams, allows us to specify what is of value in his work as well as to illustrate the limitations – of argument and of tone – of that work. More specifically, it is argued that while the fairly catholic character of Geuss′s realism is a strength, (...) his critical considerations of theorists such as Rawls and Nozick and concepts such as human rights not only show little intellectual grasp of these positions, but also typically fail to respect his own criteria for understanding and evaluating political theories. Rabble, it is commonly argued, indicates one of the very few places in Hegel's system where he produced an inevitable contradiction that he was, however, unable to “sublate.” In this paper, I purport to prove this narrative wrong. Relying on a close reading of Hegel's reasoning in his book and his lectures on the philosophy of right, I first attempt to determine what the problem of rabble consists in: I demonstrate that Hegel was perfectly aware of the mechanism of (...) necessary impoverishment in (unrestricted) civil society, and that in his view the poor were actually justified in developing a rabble mentality. I then show, on the one hand, that civil society was from the very beginning conceived as self-sublating, and on the other, that Hegel was, at least in principle, able to find a solution for the rabble: the state. An overall view of the 50 year’s issues of the ›Zeitschrift für Evangelische Ethik‹ tries to get on the track of the main discussions by often prominent authors. In the fifties and sixties of the 20th century the periodical offered the rare case of intellectual and ethical alternatives to preceding theologies which were in an affinity to antidemocratic traditions. The tradition of the ›kingdom of God‹ was rehabilitated to overcome a theology of divine orders, but the interpretation oscillated. Perspectives of (...) universalization and the sense of democracy and human rights were developed. A simple proposition of divine commandments was overcome by differentiated models of ethical judgment. Fundamental assumptions, however, were pluralistic. For more than twenty years the periodical was ahead of continental practical philosophy which was revived in the last quarter of the century. (shrink)

Coleman's Foundations of Social Theory is based on a theory of rational action in the specific version of utility maximization embedded in a macro-micro-macro-framework. This approach is logically and empirically deficient in the following aspects: The social constitution of the situation and the actor himself is excluded from the theoretical consideration (macro to micro transition). Limitations to rationality remain implicit and are not integrated into an empirically founded theory of bounded rationality (microtheory). The dynamics of non-equilibrium systems are outside the (...) realm of the theory (micro to macro transition). Central concepts of social theory, as for instance rights and norms, are reduced to a power based balance of interests. It is assumed a) that the statement that a human right exists means that a state which does not grant it is not legitimate, and b) that the legitimacy of power can, in modern times, be justified only by showing that it is in the equal interest of everybody. Mere democracy is insufficient to legitimate political power. Freedom for every individual must be guaranteed. So much is common ground in the controversy on human rights, but to interpret these freedom (...) as a negative freedom, as the classical conception of human rights has done, is insufficient and therefore illegitimate, because it is not in the equal interest of everybody. To add a positive concept of freedom is correct but not enough, because it still neglects those who even if they are given the facilities do not have the capacity. Since the handicapped, the old and the young cannot even enter a contract and the disposessed cannot enter a fair contract, the contractarian foundation of human rights must be discarded. (shrink)

Zusammenfassung Commentaries on Plato’s and Aristotle’s works were central to the Neoplatonic school’s curriculum. In a fixed order, established since Jamblichus, the Aristotelian writings were first read, then the Platonic ones. At the beginning, the logical writings of Aristotle and particularly his Categories were examined. But like any other work, the Categories were construed from the perspective of Neoplatonic anagogy. In addition, the commentator was obliged to work out the commonalities between the two philosophical teachings. That anagogical and harmonising approach (...) culminates in the commentaries on the Categories with the integration of the Aristotelian concept of substance into the Platonic concept of ideas. While Dexippus is primarily engaged in the right modes of predication corresponding to the sensible and the intelligible realm respectively, Simplicius focuses on the description of a continuous connection of being. Controversies arise over abortion, assisted dying and conscientious objection in healthcare. The purpose of the study was to examine the relationship between attitudes towards these bioethical dilemmas, and secularity and religiosity. Data were drawn from a 2017 web-based survey of a representative sample of 1615 Norwegian adults. Latent moderated structural equations modelling was used to develop a model of the relationship between attitudes. The resulting model indicates that support for abortion rights is associated with pro-secular attitudes and is a main (...) “driver” for support for assisted dying and opposition to conscientious objection. This finding should be regarded as a hypothesis which ought to be tested in other populations. If the relationship is robust and reproduced elsewhere, there are important consequences for CO advocates who would then have an interest in disentangling the debate about CO from abortion; and for health systems who ought to consider carefully how a sound policy on CO can safeguard both patient trust in the services and the moral integrity of professionals. It is suggested that if religiosity wanes and pro-secular and pro-abortion attitudes become more widespread, support for CO might decline, putting into question whether present policies of toleration of conscientious refusals will remain acceptable to the majority. In several US states, the legalisation of euthanasia has become a question for voters to decide in public referenda. This democratic approach in politics is consistent with notions of personal autonomy in medicine, but the right of choice does not mean all choices are morally equal. A presumption against the taking of human life is embedded in the formative moral traditions of society; human life does not have absolute value, but we do and should impose a strict burden of (...) justification for exceptions to the presumption, as exemplified by the moral criteria invoked to justify self-defence, capital punishment, or just war. These criteria can illuminate whether another exception should be carved out for doctor-assisted suicide or active euthanasia. It does not seem, in the United States at any rate, that all possible alternatives to affirm the control and dignity of the dying patient and to relieve pain and suffering, short of taking life, have been exhausted. Moreover, the procedural safeguards built into many proposals for legalised euthanasia would likely be undone by the sorry state of the US health care system, with its lack of universal access to care, chronic cost-containment ills, a litigious climate, and socioeconomic barriers to care. There remains, however, common ground in the quest for humane care of the dying. (shrink)

I argue that despite criticism from some disability rights organizations, aid in dying is morally permissible. First, I suggest that disability-related concerns can be classified as emerging from one of two kinds of harm: person affecting, and personhood affecting. Second, I examine whether person affecting harm has occurred within those jurisdictions that have legalized aid in dying. I conclude that despite suggestions to the contrary, there is no evidence to demonstrate that people with disabilities have been adversely impacted by legalized (...) medical aid in dying. Third, I entertain these same arguments as a matter of principle and conclude the principled objections should not give us reason for concern. Fourth, I explore whether we have evidence to suggest the presence of increased personhood affecting harm where aid in dying is permissible. I suggest, through a focus on disability support services, that no evidence of social attitudes that diminish the moral worth of disabled people is present. Fifth, I examine whether we ought to have a principled concern with personhood affecting harm emerging from medical aid in dying. I conclude that to the contrary, to deny people with disabilities access to aid in dying constitutes a morally egregious form of personhood affecting harm. (shrink)

The paper discuses topics related to individuality, human corporeality and gender in Foundations of Natural Right (1796) within a systematic point of view. According to Fichte, the notion of human corporeality is crucial to achieving the foundations of right. In this context Fichte applies a gender-neutral notion of the human body: all individuals are equal despite their gender differences, because reason is neither masculine nor feminine. Besides the male/female binary, Fichte does not discuss issues of sexual identity or (...) orientation. Furthermore, it seems no longer plausible nowadays to defend his position on the social role of women. Nevertheless, Fichte’s conception provides fruitful hints for the analysis of relevant issues in current debates on human corporeality and gender. Das Spezifikum des Ansatzes Fichtes besteht dort erstens darin, die Relevanz der Körperlichkeit für die Grundlegung des Rechts zu zeigen und zweitens, die Auffassung dieser im Sinne der Geschlechtsneutralität zu bestimmen. Fichte argumentiert im Sinne der Gleichberechtigung aller Individuen innerhalb der Rechtsgemeinschaft. Die Kraft seiner Position liegt in der Formulierung eines konsistenten Körperbegriffs, der erreicht wird, ohne auf anthropologische Bestimmungen rekurrieren zu müssen. This book is the first installment of an extraordinarily ambitious project. The plan is to investigate the reception of Aristotle's conception of the intellect, set out in De Anima 3.4-5, in (...) the subsequent history of philosophy, from Theophrastus to the present.The current volume deals with the natural starting-point for this project, philosophy in the early Hellenistic period, centering on Theophrastus and his tenure as head of the Peripatos, the school that Aristotle founded.Kamp begins with an engaging, somewhat lengthy introduction, which remains curiously remote from what one might expect it to concentrate on, namely Aristotle's conception of the intellect. Apart from presenting an outline of the reception of Aristotle's philosophical work in general from Theophrastus to Sigmund Freud, the introduction includes only one short paragraph specifically on the topic of the intellect (12). This paragraph, which comes closest to revealing Kamp's reason for focusing, of all things, on Aristotle's discussion of the intellect in De Anima3.4-5, simply makes two unsubstantiated claims. First, Kamp claims that the conception of the intellect, as presented in those chapters, is at the center of the Aristotelian system; and secondly, that this is, of all Aristotelian and perhaps all philosophical theories, the one that received the highest level of attention in the subsequent history of philosophy. The reader might be content to wait and let the second claim be borne out, in the present volume and beyond; but the first claim—concerning the centrality of the intellect, and of De Anima3.4-5, to Aristotle's thought—should at least have received some specification and illustration.The central part of the book, and philosophically by far the most interesting, concerns Theophrastus. Kamp begins with an extensive discussion of the political, social, and economic circumstances of Theophrastus's biography and of the history of the Peripatos. He then offers a reconstruction of Theophrastus's remarks on the nature of the intellect in the fifth book of his Physics. This reconstructive effort is based on a number of fragments [End Page 122] preserved in Themistius's De Anima paraphrase (written at about 350ad) and in Priscianus Lydus's Metaphrasis in Theophrastum (about 530ad). Kamp's discussion of these fragments is well informed, judicious, and illuminating throughout.It may be in order, though, to indicate one misgiving. One of the problems that Theophrastus addresses is that it might appear as if thinking were a matter of the intellect being changed by intelligibles, much as perceiving is, or may appear to be, a matter of sense being changed by sensibles. (If so, the question arises as to what the principle of thought is, the intellect itself or the intelligibles.) Kamp reconstructs the train of thought as follows (124-5).(1) The intellect stands to intelligibles the way sense stands to sensibles (intellect-sense analogy).(2) Sense is changed by sensibles.Therefore, the intellect is changed by intelligibles.Kamp proceeds to suggest (126) that Theophrastus attempted to avoid the conclusion by denying the first premise. According to Kamp, Theophrastus rejected the intellect-sense analogy by drawing attention to significant differences between (the activity of) the intellect and sense perception, one of these being that the intellect (in thinking) is changed only in a special sense, namely inasmuch as it undergoes a transition to activity, energeia. Kamp is right that the notion of a special kind of change that consists in a transition to activity is Aristotelian; it is presented in considerable detail in De Anima2.5 (417b2-16). Downie and Schuklenk1 provide a clear narrative of the development of Canadian policy on medically assisted dying. This is very helpful for considering specific aspects of the continuing deliberations in Canada. This commentary presents an alternative perspective on the authors’ argument that narrow eligibility criteria for medical assistance in dying are discriminatory and unjustified. I argue that disability or mental illness as sole reason for accessing MAiD removes protections for all people who have times in their life when they have (...) mental illness or disability combined with intolerable suffering. I claim that individuals do not make their best, self-actualising decisions at those times and the supposed protections of vague terms such as incurable, advanced and decline are not clinically useful for evaluating eligibility for individuals with chronic health conditions. Within discussion of the impact of social determinants of health on access to MAiD, the authors present the argument that decisionally capable people with mental illness or disabilities as their sole underlying condition should be allowed to access MAiD. The authors state that opposing this access sacrifices patient rights and strips people of their agency. Der vorliegende Beitrag argumentiert auf der Basis einer Rekonstruktion der Entwicklung der Zentralvermarktung der Fußball-Bundesliga, dass dem deutschen Profifußball diese Option versperrt ist, da die politischen Anspruchsgruppen des Fußballs die Bewahrung des europäischen Sportmodells einfordern. Zugleich hat das Zusammenspiel von politischen Regulierungsbemühungen und Medienentwicklung zur Einführung eines höchst problematischen Wettbewerbsdesigns im europäischen Profifußball geführt, das aber schwer veränderbar (...) erscheint.
