Medical councils increasingly require graduates to understand law and to practise medicine mindful of the legal rules. In the UK a revised curriculum for medical law and ethics has been published. However, coverage of law in medical education remains variable and doubts exist about how far students acquire legal knowledge and skills in its implementation. This survey of students in two UK medical schools measured their law learning and their confidence in using this knowledge. Concept maps and a self-audit questionnaire (...) were used to capture students' understanding and perceptions of this knowledge domain and self-assessments of their legal knowledge and skills. A large sample was achieved across first, second and final year students. Students agree that a sound understanding of law is essential to being a good doctor. Their perceptions of law are generally positive but the interface between the legal rules and codes of medical ethics creates difficulty. In some areas students offer relatively confident self-assessments of their legal knowledge and skills for practising law. However, levels of confidence in other areas of their law learning raise doubts about the degree to which they can advocate for and protect their patients. Conclusions are drawn about the effectiveness of students' law learning and recommendations made for further research. (shrink)

A common argument against prostitution states that selling sex is harmful because it involves selling something deeply personal and emotional. More and more of us, however, believe that sexual encounters need not be deeply personal and emotional in order to be acceptable—we believe in the acceptability of casual sex. In this paper I argue that if casual sex is acceptable, then we have few or no reasons to reject prostitution. I do so by first examining nine influential arguments to the (...) contrary. These arguments purport to pin down the alleged additional harm brought about by prostitution by appealing to various aspects of its practice, such as its psychology, physiology, economics and social meaning. For each argument I explain why it is unconvincing. I then weight the costs against the benefits of prostitution, and argue that, in sum, prostitution is no more harmful than a long line of occupations that we commonly accept without hesitation. This research presents findings from a study of gender-based differences in an ethical decision situation. The study focuses on gender as it relates to situational factors and accounting experience. The primary element of interest is how the gender of the actor (the person described in each vignette) influences the evaluation/assessment of the ethical/unethical decisions. While previous research has provided evidence of ethical differences relating to the gender of the responding subjects, limited evidence has been presented relating to situational issues that (...) may influence assessments of ethical decisions.This research uses four accounting environment vignettes to survey the responses of accountants and accounting students to the ethical/unethical nature of the actions that are taken. In addition, how likely the accountants believe they are to take the same actions is also surveyed. The subjects are a representative sample of practicing accountants in the U.S. and senior/graduate accounting majors at a state university in the southwestern United States. (shrink)

This article offers the first edition and translation of two heretofore unpublished pharmacological treatises by Abū Bakr al-Rāzī, namely Fī ittikhādh māʾ al-jubn and Fī manāfiʿ māʾ al-jubn, which seem to have formed part of a lost volume on dairy products. As it demonstrates, al-Rāzī’s examination of whey is connected to his philosophical interest in the complex nature of simple substances such as milk. What was once the factory is now the university. As deindustrialization spreads and the working class is decentralized, new means of social resistance and political activism need to be sought in what may be the last places where they are possible: the university and the art world. Gerald Raunig's new book analyzes the potential that cognitive and creative labor has in these two arenas to resist the new regimes of domination imposed by cognitive capitalism. Drawing on Gilles Deleuze's concept of (...) "modulation" as the market-driven imperative for the constant transformation and reinvention of subjectivity, in Factories of Knowledge, Industries of Creativity, Raunig charts alternative horizons for resistance. Looking at recent social struggles including the university strikes in Europe, the Spanish ¡Democracia real YA! organization, the Arab revolts, and the Occupy movement, Raunig argues for a reassessment of the importance of cultural and knowledge production. The relationship between firm financial performance and sustainability reporting (SR) has been extensively researched previously, but with inconsistent results. By incorporating the coercive isomorphism of the institutional theory, this study examines if the relationship is moderated by the ownership of institutional investors. Using data from a sample of 270 Malaysian public listed firms, the study tested two ordinary least square (OLS) regression models. The results show that firm performance and institutional ownership have a positive link to SR. Further examination however (...) discloses a negative moderation of institutional ownership on the relationship between firm performance and SR, thus fail to support the indication that institutional investors coerce the investee firms to utilise their firm performance for sustainability activities. This study adds to SR-related literature by providing reliable and objective findings and directions for future studies in this context. (shrink)

The majoritarian conception of democracy implies that counter-majoritarian institutions such as federalism—and even representative institutions—are derogations from democracy. The majoritarian conception is mistaken for two reasons. First, it is incoherent: majoritarianism ultimately stands against one of democracy’s core normative commitments—namely, political equality. Second, majoritarianism is premised on a mistaken view of power, which fails to account for the power of numbers and thereby fails to explain the inequality faced by members of persistent minorities. Although strict majority rule serves the democratic (...) values of political agency and equality as interpreted by a set of formal conditions, an adequate conception of power shows why in real-world conditions formal-procedural inequalities, instantiated by counter-majoritarian institutions such as federalism, are sometimes required to serve democratic equality. Background Families whose child has unexplained intellectual or developmental differences often hope that a genetic diagnosis will lower barriers to community-based therapeutic and support services. However, there is little known about efforts to mobilize genetic information outside the clinic or how socioeconomic disadvantage shapes and constrains outcomes.Methods We conducted an ethnographic study with predominantly socioeconomically disadvantaged families enrolled in a multi-year genomics research study, including clinic observations and in-depth interviews in English and Spanish at multiple time points. Coding and (...) thematic development were used to collaboratively interpret fieldnotes and transcripts.Results Thirty-two families participated. Themes included familial expectations that a genetic diagnosis could be translated into information, understanding, and assistance to improve the quality of a child’s day-to-day life. After sequencing, however, genetic information was not readily converted into improved access to services beyond the clinic, with families often struggling to use a genetic diagnosis to advocate for their child.Conclusion Families’ ability to use a genetic diagnosis as an effective advocacy tool beyond the clinic was limited by the knowledge and resources available to them, and by the eligibility criteria used by therapeutic service providers’ – which focused on clinical diagnosis and functional criteria more than etiologic information. All families undertaking genomic testing, particularly those who are disadvantaged, need additional support to understand the limits and potential benefits of genetic information beyond the clinic. Conan, el niño del futuro (1978) es un dibujo animado oriental que plasma a una sociedad futurista que ha sobrevivido a la Tercera Guerra Mundial. El personaje principal, un niño de 10 años, aparece en la historia para impedir que el grupo hegemónico continúe con su pretensión de dominar el mundo, sin importar la tiranía que ejercen contra los ciudadanos. Para lograr ese vil propósito, las autoridades de Isla Industria han incurrido en escenarios en los que se observa la esclavitud, (...) la dificultad para expresarse con libertad y el sometimiento obligatorio a las decisiones del sistema. Esas actitudes no solo revelan un contexto recreado en un mundo ficcional, sino que es latente al apreciar las revueltas sociales de la actualidad. A ese tipo de manifestación por los derechos, se le agrega otra modalidad correlativa: la censura. Esta se concreta de forma implícita y sutil, con el objetivo de que las víctimas desacrediten sus derechos y no reclamen ante los abusos frecuentes de un gobierno que los sanciona, los encarcela o los exilia con injusticia. Su condición de peligro para la hegemonía es esencial, porque puede acarrear una toma de conciencia para los demás pobladores y una posible rebelión. Para finalizar, esta investigación se valdrá de las teorías poscoloniales e interculturales para evidenciar cómo un proyecto político se instaura en un anime japonés y, en especial, en el protagonista que desea reorientar a toda una sociedad, junto con ese sistema represivo inherente. The ‘universal cell reaction’ (UCR), a coordinated biphasic response to external (noxious and other) stimuli observed in all living cells, was described by Nasonov and his colleagues in the mid‐20th century. This work has received no attention from cell biologists in the West, but the UCR merits serious consideration. Although it is non‐specific, it is likely to be underpinned by precise mechanisms and, if these mechanisms were characterized and their relationship to the UCR elucidated, then our understanding of the integration (...) of cellular function could be improved. As a step towards identifying such mechanisms, I review some recent advances in understanding cell mechanics and the stress response and I suggest potentially testable hypotheses. There is a particular need for time‐course studies of cellular responses to different stimulus doses or intensities. I also suggest a correspondence with hormesis; re‐investigation of the UCR using modern biophysical and molecular‐biological techniques might throw light on this much‐discussed phenomenon. Para explicar esa adopción identitaria, retomo la taxonomía elaborada por Donald Shaw con respecto al contexto influyente del boom latinoamericano (que repercute negativamente en la psicología social) y la epistemología psicoanalítica de Jacques (...) Lacan al hacer referencia a nociones afines que configuran al protagonista como una entidad desligada del mundo real y que cuenta con un potencial saber infundado hacia la destrucción del ser. La producción alemana Heimat (1984) del director Edgar Reitz consta de 11 largometrajes que abordan, principalmente, la Primera Guerra Mundial y la Segunda Guerra Mundial; además de las repercusiones psicológicas, sociales y económicas que generan en los pobladores estos eventos históricos. Este conjunto de filmes se enfoca en un espacio rural denominado Schabbach. En ese lugar, se aprecia el desarrollo y la evolución de una genealogía que se supedita a la relación de María y Paul Simon, pero desde una perspectiva (...) disociada. Prevalecerán situaciones individualistas como alejarse del núcleo familiar para ser partidario de la guerra, migrar a otras localidades, buscar superarse, evitar a los congéneres o vivir en el recuerdo. En ese sentido, esta investigación se basará en esas motivaciones de los personajes y se recurrirá al análisis interdisciplinario, epistemología propia de los Estudios Culturales, para confrontar y explicar esa realidad social frente a la guerra. Este artículo sistematiza las temáticas abordadas desde la novela policial peruana en el período de los años 1990 hasta el 2013, siendo la violencia social la que más destaca. Para fundamentar esa recurrencia, el autor se basa en fuentes afines que distinguen el corpus según su clasificación. Sociológicamente, se hallan los postulados teóricos como el de posmodernidad de Fredric Jameson y Mario Vargas Llosa, junto con el de criminalidad de Luis Rodríguez Manzanera. En el Perú no se evidencia una taxonomía (...) hegemónica que se tome como referente de la misma. Una de las causas es la escasa documentación acerca de temas policiales, judiciales, históricos y culturales que maneja el propio autor sobre sus obras. Esto se demuestra en el transcurso de este trabajo a través de la recepción crítica, que comprende tres tópicos insoslayables: la demanda del lector con respecto a este género literario, las limitaciones que conllevan el rechazo inconsciente a todo producto valorativo y la implicancia del mercado de la cultura de masas. 악의 보편성과 선택의지의 자유라는 양립 불가능한 개념을 동시에 담고 있는 칸트의 근본악 논증은 발간 당시부터 이러한 모순성을 포함하여 다양한 측면에서 비판의 대상이 되어 왔다. 심지어는 일종의 학문적 실패로 취급됐다. 하지만 연구자는 칸트가 악 이론과 관련해서 두 가지 개념을 모두 가져올 수밖에 없었다고 생각하며, 본 논문에서 두 개념이 양립 가능하다고 주장하고자 한다. 본 작업을 위해 연구자는 먼저 칸트가 근본악 논증에서 밝히고자 하는 진정한 목적이 무엇인지 확인하는 데 지면을 할애할 것이다. 짤막하게 그 목적을 밝힌다면 칸트는 현대적 시각에서 봤을 때 외적으로 악한 행위나 (...) 그러한 행위자에게는 무관심하다. 연구자는 칸트가 겉으로는 선한 것처럼 보이는 행위의 이면을 분석함으로써 도덕적으로 선한 행위를 엄격하게 구분하는 데 집중했다고 본다. 칸트에 따르면 이 교묘한 악, 즉 외면적으로만 선하고 의도 면에서는 악한 행위야말로 모든 인간이 피해 갈 수 없는 근본적인 악성인 것이다. 교묘한 악성을 파헤치는 것을 목적으로 하고 있는 칸트의 근본악 이론은 결과적으로 이러한 악한 성향을 모든 인간이 자유롭게 선택했다고 주장한다. 그럼에도 불구하고 이 자유로운 악성을 끌어안고 고민하거나 투쟁하며 살아간다는 측면에서 ‘도덕적’이라고 결론지을 것이다. 이 주장은 모든 인간이 도덕적으로 선하다는 게 아니라 도덕에서 벗어날 수 없음을, 모든 행위마다 도덕성을 고민할 수밖에 없음을 함의한다. 본 논문은 이 주장이 어떻게 가능한지 밝히는 데 집중한다. Se ha planteado una propuesta pedagógica para educar la amistad en la familia y en la escuela basadas en la ética aristotélica, teniendo en cuenta las tres condiciones de la amistad perfecta: benevolencia, reciprocidad y compartir. Se propone recuperar la amistad en la tarea educativa porque es la principal virtud de la voluntad, la que perfecciona más a la naturaleza humana, según la antropología de Polo. Argumentamos la pertinencia de centrar la educación moral, que mejore a la persona, en fomentar (...) encuentros amistosos para facilitar que los amigos practiquen el bien entre sí, sin quedarse en el deseo de benevolencia. This research analyses Moo in the colloquial Iraqi Language discourse marker. Marker co-occurrences are noteworthy features. This focuses on the study of the emotive and textual functions of Moo’s co-occurrences. It has been found that there are seven functions co-occurring with Moo’s that always appear in conjunction with different grammatical structures syntax on the different speech situations. The co-occurrences were used in emotional functions to show denial, causes, inhibition, rebuke, circumstantial, exemplary and questioning. Within one utterance, these markers can (...) occur together, triggering senses that are more complex. Many statements with Moo appear frequently in the form of questions. It seems that the speakers feel more curious about Moo’s questions and ask for more responses. Speakers use coexistence in the context of textual functions to raise the issue, stress, demand answers and negotiate. It was also used when the speakers had just learned to put something to the interlocutors’ attention. (shrink)

The coronavirus disease 2019 pandemic has affected most countries of the world. The detection of Covid-19 positive cases is an important step to fight the pandemic and save human lives. The polymerase chain reaction test is the most used method to detect Covid-19 positive cases. Various molecular methods and serological methods have also been explored to detect Covid-19 positive cases. Machine learning algorithms have been applied to various kinds of datasets to predict Covid-19 positive cases. The machine learning algorithms were (...) applied on a Covid-19 dataset based on commonly taken laboratory tests to predict Covid-19 positive cases. These types of datasets are easy to collect. The paper investigates the application of decision tree ensembles which are accurate and robust to the selection of parameters. As there is an imbalance between the number of positive cases and the number of negative cases, decision tree ensembles developed for imbalanced datasets are applied. F-measure, precision, recall, area under the precision-recall curve, and area under the receiver operating characteristic curve are used to compare different decision tree ensembles. Different performance measures suggest that decision tree ensembles developed for imbalanced datasets perform better. Results also suggest that including age as a variable can improve the performance of various ensembles of decision trees. (shrink)

Dobbs v. Jackson Women’s Health continues a trajectory of U.S. Supreme Court jurisprudence that undermines the normative foundation of public health — the idea that the state is obligated to provide a robust set of supports for healthcare services and the underlying social determinants of health. Dobbs furthers a longstanding ideology of individual responsibility in public health, neglecting collective responsibility for better health outcomes. Such an ideology on individual responsibility not only enables a shrinking of public health infrastructure for reproductive (...) health, it facilitates the rise of reproductive coercion and a criminal legal response to pregnancy and abortion. This commentary situates Dobbs in the context of a long historical shift in public health that increasingly places burdens on individuals for their own reproductive health care, moving away from the possibility of a robust state public health infrastructure. 아리스토텔레스의 실천적 지혜(phronēsis)는 인간다운 좋은 행동을 이성으로 잘 선택하는 탁월한 능력이다. 이것은 자신이나 공동체를 위해서 주된 덕(arete, 탁월성)이다. 그래서 그는 ‘성격의 덕은 목적을 올바르게 만들어 주고 실천적 지혜는 목표에 도달하는 수단을 결정한다’고 반복해서 주장할 만큼 강조한다. 그의 주장은 일견 이해하기 어려울 수 있다. 왜냐하면 목적 파악은 지성의 소관임에도 불구하고 성격의 덕도 목적과 관련되는 것으로 읽힐 수 있기 때문이다. 그리고 실천적 지혜가 숙고하고 선택하는 대상이 모호할 수 있다는 점도 문제이다. 실천적 추론에서 실천적 지혜는 보편명제뿐만 아니라 개별명제의 전제들까지도 아는 능력이라고 언급되기 때문이다. The purpose of this article is to investigate about the differences and, if any, the similarities among the modern State and the mafia criminal organizations. In particular, starting from their definitions, I will try to find the differences between State and mafia, to then focus on the operational aspects of the functioning of these two organizations, with specific reference to the effect/impact that both these human constructs have on citizens’ existences, and especially on citizen’s economic lives. All this in order (...) to understand whether it is possible to identify an objective difference – beside morals – between taxation by the modern State and extortion by criminal organizations. With this of course I do not want to argue that the mafia is in any way justifiable or absolvable, nor that it is better than the State. However, I want to investigate whether there is a real, logical reason why the State should be considered by the citizens more desirable than the criminal organizations oppressing Southern Italy, from a strictly logical point of view and not from the point of view of ethics and morality. Born into a poor, Muslim family at the end of the 19th century, Gama became World Champion wrestler by defeating the reigning Polish champion in London in 1910. By focusing on the life of Gama, the heroic representations of Gama that appear in the Hindi language literature, and the transformations in wrestling regimens that have occurred over the past several centuries, I locate the discourse and practice of wrestling within a context of intersecting concerns with nationalism, class identity and embodied (...) consciousness. To articulate the way in which subaltern identity is embodied in relation to nationalist ideas about masculine fitness, and in relation to the state as a political institution, I provide an analytic interpretation of the heroic body that focuses on themes of nervousness and obsession. Objetivamos, neste texto, estabelecer uma aproximação entre ética e educação, a partir do pensamento de Levinas. Apresentaremos uma (re) avaliação crítica da pedagogia da Totalidade, fundada no saber técnico-instrumental, ensinada pela maestria do Mesmo. Demonstraremos que Levinas não é só um crítico da filosofia e pedagogia tradicional, mas que sua reflexão abre vias para se pensar os desafios da educação contemporânea, recolocando a urgência do resgate de um outro-modo-de-ser pedagógico, fundamentalmente, Ético. Defenderemos que a grande contribuição de Levinas para a (...) educação, consiste na (re)significação de um outro modo de Ensino, agora fecundamente baseado e fundado no ensinamento proveniente do Outro, enquanto condição ético-crítica de todo o saber. The classical Greeks give us a substance ontology grounded in ‘being qua being’ or ‘being per se’ (to on he on) that guarantees a permanent and unchanging subject as the substratum for the human experience. With the combination of eidos and telos as the formal and final cause of independent things such as persons, this ‘substance’ necessarily persists through change. This substratum or essence includes its purpose for being, and is defining of the ‘what-it-means-to-be-a-thing-of-this-kind’ of any particular thing in setting (...) a closed, exclusive boundary and the strict identity necessary for it to be this, and not that.In the Yijing 易經 or Book of Changes we find a vocabulary that makes explicit cosmological assumptions that are a stark alternative to this substance ontology, and provides the interpretive context for the Confucian canons by locating them within a holistic, organic, and ecological worldview. To provide a meaningful contrast with this fundamental assumption of on or ‘being’ we might borrow the Greek notion of zoe or ‘life’ and create the neologism ‘zoe-tology’ as ‘the art of living’. This cosmology begins from ‘living’ (sheng 生) itself as the motive force behind change, and gives us a world of boundless ‘becomings’: not ‘things’ that are, but ‘events’ that are happening, a contrast between an ontological conception of the human ‘being’ and a process conception of what I will call human ‘becomings’. According to the Principle of Sufficient Reason (‘PSR’), every fact has an explanation for why it obtains. If the PSR is true, there must be a sufficient reason for why God chose to create our world. But a sufficient reason for God’s choice plausibly necessitates that choice. It thus seems that God could not have done otherwise, and that our world exists necessarily. We therefore appear forced to pick between the PSR, and the contingency of creation and divine choice. I (...) show that a third option remains open, and thus that it is possible to preserve the contingency of creation and divine choice even while endorsing the PSR. My solution depends on the coherence of a restricted modal realism. On this modal realism, there is more than one possible morally optimal created world, and for each such world there is an existing possibility in which God creates that world. (shrink)

Technopoiesis was previously identified as the juvenile phase of expression of a technique that spontaneously evolves towards technopraxis as soon as the perspectives of practical use of the end-products overcome the cosmological resonance of the process itself. This view is re-examined considering the data and analyses exposed in “Refining technopoiesis: Measures and Measuring Thinking in Ancient China,” in which a coexistence of the technopoiesis and technopraxis approaches of technics is suggested.

The transparency of visual experience is a widely held and important thesis in the philosophy of perception. Critical discussion of transparency has focused on visual experiences, such as the experience of visual blur that are taken to be counter examples to transparency. Here, I consider a novel objection to transparency that does not depend on intuitions about examples. The objection is that if transparency is true then we cannot explain our ability to think about our visual experiences as such. Trolley dilemmas have been used to justify the intuitive appeal of the doctrine of double effect. According to this doctrine, if a good action has a harmful side effect, it is morally acceptable to do it, provided the harmful effect is not intended. However, in some variants of the dilemma, most people are willing to forego this doctrine, thus making responses inconsistent. In this study, 404 university students from the United Arab Emirates (UAE) were presented with 4 versions of the (...) trolley dilemma. Results came out showing that higher levels of depressive symptoms predict greater consistency in adherence (or rejection) to the doctrine of double effect. Likewise, higher levels of depressive symptom predict utilitarian responses to trolley dilemmas. Anxiety symptoms had similar effects, but more moderate. Demographic variables (age, gender) were also assessed as predictors of responses and consistency to trolley scenarios, but no significant effects were found. (shrink)

Bertrand Russell’s trip to China (1920–21) led him to write numerous articles about China culminating in _The Problem of China_. This paper reconsiders _The Problem of China_ using Edward Said’s discussion of Orientalism and contextualizes it with Russell’s other published and unpublished writings on China and the reactions of his Chinese contemporaries. I argue that Russell’s views reflect his prior philosophy and Western influences more than an analysis of his trip and reveal that this was what his Western readers wanted. (...) Moreover, his reliance on the research of other scholars and popular writers was unusual, even at the time. He was an intellectually honest but relatively unqualified and imprecise interpreter, not a Said-style Orientalist. He recognized Orientalism, but was unable to avoid reproducing Orientalist stereotypes. These findings help us understand both how Russell processed foreign phenomena and the origins of Western perceptions of China in the 1920s. (shrink)

Parvalbumins (PVs) are acidic, intracellular Ca2+‐binding proteins of low molecular weight. They are associated with several Ca2+‐mediated cellular activities and physiological processes. It has been suggested that PV might function as a “Ca2+ shuttle” transporting Ca2+ from troponin‐C (TnC) to the sarcoplasmic reticulum (SR) Ca2+ pump during muscle relaxation. Thus, PV may contribute to the performance of rapid, phasic movements by accelerating the contraction–relaxation cycle of fast‐twitch muscle fibers. Interestingly, PVs promote the generation of power stroke in fish by speeding (...) up the rate of relaxation and thus provide impetus to attain maximal sustainable speeds. However, immunological monitoring of diverse tissues demonstrated that PVs are also present in non‐muscle cells. The axoplasmic transport and various intracellular secretory mechanisms including the endocrine secretions seem to be controlled by the Ca2+ regulation machinery. Any defect in the Ca2+ handling apparatus may cause several clinical problems; for instance, PV deficiency alters the neuronal activity, a key mechanism leading to epileptic seizures. Moreover, atypical relaxation of the heart results in diastolic dysfunction, which is a major cause of heart failure predominantly among the aged people. PV may offer a unique potential to correct defective relaxation in energetically compromised failing hearts through PV gene transfer. Consequently, PV gene transfer may present a new therapeutic approach to correct cellular disturbances in Ca2+ signaling pathways of diseased organs. Hence, PVs appear to be amazingly useful candidate proteins regulating a variety of cellular functions through action on Ca2+ flux management. (shrink)

The history of British political thought has been one of the most fertile fields of Anglo-American historical writing in the last half-century. This paper contrasts the morally suspect elements in Marx's comments on relations between men and women in the 1844 Manuscripts with the more sensible and liberal tone of Marx's remarks on the same topic in post-1844 writings. The contrast is used to illustrate the claim that an important moral shift occurs in Marx's thought around 1844, a shift away from the early concern to overcome bourgeois egoism and with it the antagonism between state and civil society, and toward the mature (...) concern to eliminate what are perceived to be unfair inequalities of power among economic agents in a capitalist economy.The concept of alienation articulated in the Manuscripts attempts to combine these disparate concerns, and in consequence Marx's discussion there founders interestingly. Este trabajo es continuador de la línea de investigación sobre la filosofía del derecho alemana contemporánea llevada a cabo por el autor, a través del análisis de cuestiones clásicas de la filosofía del derecho. Para ello, se aborda la concepción de la pena de muerte en el pensamiento jurídico-filosófico de Arthur Kaufmann, el cual abordó esta problemática en relación con el contenido esencial del derecho a la vida y el debate doctrinal de posguerra. El artículo está dividido en las siguientes (...) partes: en primer lugar, se analiza, desde un punto de vista jurídico-filosófico, la evolución histórica de la pena de muerte a la centrando la atención en los fundamentos para su abolición y las posiciones a favor de su mantenimiento. En segundo lugar, se establecen similitudes y diferencias, en el entendimiento de la pena capital, entre la teología moral contemporánea, el pensamiento de Aquino y la obra de Arthur Kaufmann. A continuación, en base a una visión comparativa, se expone cómo el autor alemán, a la vez que mantiene una concepción católica ante la pena de muerte y la culpa sin pena, sigue la senda dejada por su maestro Radbruch, siendo en este tema no necesariamente incoherente.
