In lieu of an abstract, here is a brief excerpt of the content:Holding Doctors Responsible at Guantánamo*Nancy Sherman (bio)I recently visited the Guantánamo Bay Detention Center with a small group of civilian psychiatrists, psychologists, top military doctors, and Department of Defense health affairs officials to discuss detainee medical and mental health care. The unspoken reason for the invitation to go on this unusual day trip was the bruising criticism the Bush administration has received for its use of psychiatrists and psychologists (...) in the interrogation of suspected terrorist detainees.1We disembarked from our Navy jet to find an island lush and green from recent storms. A small boat took us from the airfield to the naval hospital. From the boat there was no sign of Camp Delta, where the detainees are actually held. Nor was there a sign of prisons or barbed wire or the detention facility's 505 inmates.Our host was the commanding officer of Gitmo, Major General Jay W. Hood (an artillery officer by training), who had replaced Major General Geoffrey Miller, implicated in the "migration" of torture methods from Gitmo to Abu Ghraib. Dressed in fatigues, General Hood briefed us using PowerPoint. His intelligence director told us that interrogators have not used harsh "fear up" tactics—the ones designed to terrify—since 2003.We went by bus from the naval hospital to the 30-bed detainee hospital for quick briefings from a psychiatrist and a physician. Still, we were not permitted to see any detainees or hunger strikers, despite our requests. During our six hours on the ground, we had only a fleeting glimpse of a few detainees outside their cellblocks behind barbed wire and screened fences.Indeed, when I got home and saw the play "Guantánamo: Honor Bound to Defend Freedom," by Victoria Brittain and Gillian Slovo, I had the disquieting feeling that I had absorbed more about detainee life at the theater than I had from actually being at Gitmo. This only amplified my anxiety that what I had heard and seen during my VIP visit sidestepped the central moral issue of whether abuse is still occurring at Gitmo and whether health professionals are, or have been, a party to coercive interrogation. [End Page 199]The question that the Pentagon leadership has been focusing on, and which was a key subject of discussion during our day at Gitmo, is whether there is an ethical difference between using psychologists or psychiatrists on interrogation teams—what the Pentagon calls, "behavioral consultation teams," or BSCTs, pronounced "biscuit." Some in the Pentagon would like to have doctors and psychiatrists, who are bound by the Hippocratic teaching to "do no harm," be the clinicians treating detainees. Psychologists, who are not as bound by Hippocratic dicta, would consult with and advise interrogators. But this is a red herring. It is hair-splitting that detracts from the real issue of whether health professionals of any stripe can ethically be involved in interrogations that may involve coercive techniques or torture. The answer is clearly no. They should not be involved, directly or indirectly, in situations that may lead to the breach of confidential medical records; to torture or to cruel, inhumane, and degrading treatment; or to exploitation of fears or phobias. Mental health professionals simply should not be collaborating with interrogators in inflicting psychological torture.Hood said that "rapport building" was the preferred and an effective interrogation technique, but that is no guarantee that rougher tactics will not be used. The fact is that there is enormous pressure on the people at Guantánamo Bay to get good intelligence for the war on terror, and it is as easy for behavioral scientists as it is for interrogators to compromise their moral standards. Cunning and deception to extract information may be acceptable in some cases. But many people have been outraged to learn from media reports that methods developed by military psychologists to train our own troops to resist torture—the so-called "survival, evasion, resistance, and escape" methods taught at Ft. Bragg—have been "reverse engineered" at Guantánamo Bay to create coercive, psychologically manipulative interrogation techniques for use against detainees.Plato warned long ago that a doctor's skill, abstracted from good character and wisdom, is a neutral... Though the recent election of American President Barack Obama and his signing of the executive order to close the prison at Guantanamo Bay signals a considerable shift away from the policies of the Bush era, the lessons to be learned from the war on terror will remain relevant and necessary for many years to come. In the aftermath of 9/11, the United States government approved interrogation tactics for enemy combatant detainees that could be defined as torture, which (...) was outlawed in Europe in the eighteenth century as well as prohibited by the Geneva Conventions and the United Nations Convention Against Torture. In conjunction with these policies, the Bush administration vocally defended torture as a necessary tool in its war on terror. In _Torture and the War on Terror_,_ _Tzvetan_ _Todorov argues that the use of the terms “war” and “terror” dehumanize the enemy and permit treatment that would otherwise be impermissible. He examines the implications and corrupting impact of the attempt to impose “good” through violence and the attempt to spread democratic values by unethical means. Todorov asks: Can violence overcome violence? Does the need to protect one’s own country justify violating human rights? Invalidating one by one the political and ethical arguments in favor of torture, Todorov likens institutional torture to a cancer that is eroding our society and undermining the very fundamental democratic ideas of justice and right. __ _Torture and the War on Terror _is a significant work in ethics, human rights, and political and social history by one of the world’s leading intellectuals, and its arguments will be influential in shaping our policies to come. The low rates of regular exercise and overall physical activity (PA) in the general population represent a significant public health challenge. Previous research suggests that, for many people, exercise leads to a negative affective response and, in turn, reduced likelihood of future exercise. The purpose of this paper is to examine this exercise–affect–adherence relationship from an evolutionary perspective. Specifically, we argue that low rates of physical exercise in the general population are a function of the evolved human tendency to (...) avoid unnecessary physical exertion. This innate tendency evolved because it allowed our evolutionary ancestors to conserve energy for physical activities that had immediate adaptive utility such as pursuing prey, escaping predators, and engaging in social and reproductive behaviors. The commonly observed negative affective response to exercise is an evolved proximate psychological mechanism through which humans avoid unnecessary energy expenditure. The fact that the human tendencies toward negative affective response to and avoidance of unnecessary physical activities are innate does not mean that they are unchangeable. Indeed, it is only because of human-engineered changes in our environmental conditions (i.e., it is no longer necessary for us to work for our food) that our predisposition to avoid unnecessary physical exertion has become a liability. Thus, it is well within our capabilities to reengineer our environments to once again make PA necessary or, at least, to serve an immediate functional purpose. We propose a two-pronged approach to PA promotion based on this evolutionary functional perspective: first, to promote exercise and other physical activities that are perceived to have an immediate purpose, and second, to instill greater perceived purpose for a wider range of physical activities. We posit that these strategies are more likely to result in more positive (or less negative) affective responses to exercise, better adherence to exercise programs, and higher rates of overall PA. PETER Fuss University o/California,Riverside Jeremy Bentham: An Odyssey of Ideas. By Mary P. Mack. (New York: Columbia University Press, 1963. Pp. xiii + 482. $7.50.) Since this is only the first of two projected volumes about Bentham, only an interim report will be possible. The study extends from its subject's birth in 1748 to the death of his father in 1792, when the 44-year-old thinker, on the way to becoming a radical democrat at the height of the French Revolution, found himself endowed with half of the fortune which had supported his father's crusty Toryism. Consequently, it is a story of rebellion and partial escape from the ancestral world of law in the direction of the promises of the new science, culminating in a career devoted to an almost incredible variety of reforms. That Bentham deserves this "first full-scale study of his thought and times in over sixty years" can hardly be doubted in view of the many part-views and caricatures which he brought upon himself by his many elderly eccentricities. This biographer sees him frankly as "one of the most subtle and powerful analytic minds in the history of Western civilization... a great man who has often been misunderstood and therefore undervalued" (pp. xi, 5). She proposes to remedy the situation by the adoption of a fresh perspective that will enable the reader to "see him whole." That admirable resolution faces formidable obstacles, as every student of Bentham knows. It is about like attempting to map a vast, swampy wilderness from an airplane. For Bentham's "odyssey of ideas" was a true wandering among a profusion of them, beginning and abandoning one project after another in a troubled period of change. The dilemma faced by the author is a cruel one: to give an authentic account of Bentham historically she must reproduce the chaotic carelessness of much of his philosophizing ; while to seek to rear a consistent philosophical system from the sketches to be found in the great masses of his wordage, often mingled and mangled by the glosses of disciples, is to lose touch with the man. In Bentham we are dealing with a writer who was always communicating and frequently talking about communication without ever having mastered the art of cumulative philosophical argument. He was more intent upon being fertile than upon being consistent. His mind kept on growing for decades, which meant that he was constantly outgrowing his earlier interests and insights. His eager and all-devouring curiosity became a veritable seed-bed of suggestions from which sprouted an unmatched array of proposals of specific reforms. Yet the story of his many projects resembles that of another seminal contemporary, Henri de Saint-Simon. The perpetual mobility of intellect which marked them both is summed up in Mary Mack's reiterated comment: "Once again Bentham ran from a good thing to a better, and left only fragments behind him" (p. 417). The philosophical underpinning of his doctrines was never quite complete. As Benjamin Franklin once said of himself in the 118 HISTORY OF PHILOSOPHY role of scientist, Bentham was a good "starter of game" for the guns of others to bring down. As portrayed with accuracy in this study, Bentham became in time an intensely pragmatic thinker, passionately desirous not only of showing the directions which reforms ought to take but also of bringing them to pass. He searched incessantly for the right audience, that is, the one with the power to improve the world according to his enlightened ideas. He began by appealing to the elite, and then turned in disgust to the people. His score as a practical reformer amounted to one long series of rebuffs, transformed after his death into... (shrink)

On October 25, 1946, three weeks after the International Military Tribunal at Nuremberg entered its verdicts, the United States established Military Tribunal I for the trial of twenty-three Nazi physicians. The charges, delivered by Brigadier General Telford Taylor on December 9, 1946, form a seminal chapter in the history of medical ethics and, specifically, medical ethics in war. The list of noxious experiments conducted on civilians and prisons of war, and condemned by the Tribunal as war crimes and as crimes (...) against humanity, is by now more or less familiar. That list included: high-altitude experiments; freezing experiments; malaria experiments; sulfanilamide experiments; bone, muscle, and nerve regeneration and bone transplantation experiments; sea water experiments; jaundice and spotted fever experiments; sterilization experiments; experiments with poison and with incendiary bombs. What remains less familiar is the moral mindset of doctors and health care workers who plied their medical skill for morally questionable uses in war. In his 1981 work, The Nazi Doctors, Robert Jay Lifton took up that question, interviewing doctors, many of whom for forty years continued to distance themselves psychologically from their deeds. The questions about moral distancing Lifton raised have immediate urgency for us now. Military medical doctors, psychiatrists and psychologists serve in U.S. military prisons in Guantánamo, Abu Ghraib, Kandahar, and, until very recently, in undisclosed CIA operated facilities around the world where medical ethics are again at issue. Moreover, they serve in top positions in the Pentagon, as civilian and military heads of command, who pass orders and regulations to military doctors in the field, and who are in charge of the health of enemy combatants, as well as U.S. soldiers. Because we recently marked the sixtieth anniversary of the judgment at Nuremberg, I want to awaken our collective memory to the ways in which doctors in war, even in a war very different from the one the Nazis fought, can insulate themselves from their moral and professional consciences. Abstract: I argue that Orientalism continues to construct Arabs as subjects that cannot suffer violence, particularly the violence of torture. Beginning with Edward Said’s observation that Orientalists constructed ‘Arabs’ in the nineteenth -century as inorganic, metallic, and mineralized beings, I trace these themes through various sites in and around Guantanamo Bay. One finds the tropes of Orientalism in the Bybee memo as well as in the diary of Mohamedou Ould Slahi. Through these three distinct but related moments, one finds (...) that Orientalism continues to produce Arabs as inorganic entities beyond death and thereby immune to violence and specifically the violence of torture. Insofar as imperialism has co-opted the language of non-violence by constructing its enemies as inviolable, one must recognize the Orientalized Arab as a receptor of limitless ‘non - violent’ hostilities. Although knowledge of torture and physical and psychological abuse was widespread at both the Guantanamo Bay detention facility and Abu Ghraib prison in Iraq, and known to medical personnel, there was no official report before the January 2004 Army investigation of military health personnel reporting abuse, degradation, or signs of torture. Mounting information from many sources, including Pentagon documents, the International Committee of the Red Cross, Amnesty International, Human Rights Watch, etc., indicate that medical personnel failed to maintain (...) medical records, conduct routine medical examinations, provide proper care of disabled and injured detainees, accurately report illnesses and injuries, and falsified medical records and death certificates. Medical personnel and medical information was also used to design and implement psychologically and physically coercive interrogations. The United States military medical system failed to protect detainee's human rights, violated the basic principles of medical ethics and ignored the basic tenets of medical professionalism. (shrink)

The article critically considers the role of NGOs at the US naval base in Guantánamo Bay, Cuba. On the basis of observation of pre-trial hearings for the case against Khalid Sheik Mohammed et al.—those allegedly responsible for the September 11 attacks—the article analyses NGOs as trial monitors of the US military commissions set up to deal with ‘alien unprivileged enemy belligerents’. In spite of continued efforts by human rights NGOs and incremental improvements in the military commissions’ institutional arrangements and practice, (...) the article shows how NGOs have become so much a part of the everyday operation of justice at ‘Gitmo’ that they legitimate the military commissions’ claim to be delivering fair and transparent justice. The intention is to use the best thinking about the evolution of morality and the best available social science research to determine the possibilities for progressive change in human moralities by examining important morally progressive changes that have already occurred, in order to determine the social conditions that are conducive to moral progress.

The book uses evolutionary principles to explain tribalism, a way of thinking and acting that divides the world into Us versus Them and achieves cooperation within a group at the expense of erecting insuperable obstacles to cooperation among groups. Tribalism represents political controversies as supreme emergencies in which ordinary moral constraints do not apply and as zero-sum, winner take all contests. Tribalism not only undermines democracy by ruling out compromise, bargaining, and respect for the Other; it also reverses one of (...) the most important milestones of progress in how we understand morality: the insight that morality is not a list of commands to be unthinkingly followed, but rather that morality centrally involves the giving and taking of reasons among equals. History can be understood as involving a problematic interplay between the long-term legacy of human evolution, still tempered into the human body today, and the shorter-term heritage of civilization from its beginnings to the present. Each of us lives in a tension between our indigenous bodies and our civilized selves, between the philosophy of the earth and that which I characterize as “the philosophy of escape from the earth.” The standard story of civilization is one of linear (...) upward progress, a story that I contest with an alternative philosophy of history, picturing history instead as a set of concentric circles. I have devised a new philosophy of history with a three-part approach to understanding human development, taking civilization not as a linear advance of progress, but rather as a progress in precision, paradoxically counteracted by a regression in mind: history as a contraction of mind. I describe three stages in the contraction of mind: 1) animate mind as the evolved outlook of foraging life; 2) anthropocentric mind as representing the contracting transformation of consciousness produced by agriculturally-based civilization; 3) mechanico-centric mind as representing a further contraction from human-centered to a machine-centered consciousness, produced by the rise of modern civilization and the mechanical scientific worldview. Hence, this progressive contraction is marked by a turn from original practical and reverential attunement to the living earth in hunting and gathering societies, or animate mind, to a narrower focus of anthropocentric mind beginning with the development of early civilizations, where the human element became central and the wild devalued. And it moves to an even more narrow focus of mechanico-centric mind, expanding out of late medieval Europe and the development of modern science, where the machine became model of the ultimate, the objectivist filter through which the world is to be understood and made to fit. Far from controlling nature, humans have been consuming it in an unsustainable Malthusian-like trajectory whose limits are being reached in our time. (shrink)

Harold and the Purple Crayon is a testament to the power of children's imaginations, their ability to give reality to things we adults can only dream about. Disability rights advocates have traditionally denigrated charity as politically counterproductive and inherently demeaning. This article argues that this perspective mischaracterizes charity of a religious kind. Religious charity, I argue, must be understood immanently, through an exploration of the virtues cultivated in particular religious organizations. I consider two Catholic charities: L’Arche, a community for intellectually disabled people, and the end-of-life care facility Our Lady of Perpetual Help Home. At each organization, individual acts of charity are emblematic of an underlying virtue that (...) I call caritas or charity-love. This transforms them into gestures that advance goals that are consonant with those of the disability rights movement. In the case of Our Lady, this is even true of pity, perhaps the most despised emotion of the disability rights tradition. But while disability rights advocates have characterized pity as essentially devaluing disabled people, at Our Lady, it is an emotion that freely circulates, undoing hierarchical distinctions between ability and disability, and even human and divine. This redefined notion of pity—which I term misericordia—can, I conclude provide a new foundation for disability politics, one that radicalizes the goals of the disability rights movement, while also positing objectives that go beyond legal compliance. In this paper, I argue that what underlies internalism about justification is a rationalist conception of justification, not a deontological conception of justification, and I argue for the plausibility of this rationalist conception of justification. The rationalist conception of justification is the view that a justified belief is a belief that is held in a rational way; since we exercise our rationality through conscious deliberation, the rationalist conception holds that a belief is justified iff a relevant possible instance of conscious (...) deliberation would endorse the belief. The importance of conscious deliberation stems from its role in guiding us in acquiring true beliefs: whereas the externalist holds that if we wish to acquire true beliefs, we have to begin by assuming that some of our usual methods of belief formation generally provide us with true beliefs, the intemalist holds that if we form beliefs by conscious deliberation, we can be conscious of reasons for thinking that our beliefs are true. Conscious deliberation can make us conscious of reasons because it proceeds via rational intuitions. I argue that despite the fallibility of rational intuition, rational intuitions do enable us to become conscious of reasons for belief. (shrink)

The political history of the twentieth century can be viewed as the history of democracy’s struggle against its external enemies: fascism and communism. This struggle ended with the fall of the Berlin Wall and the collapse of the Soviet regime. Some people think that democracy now faces new enemies: Islamic fundamentalism, religious extremism and international terrorism and that this is the struggle that will define our times. Todorov disagrees: the biggest threat to democracy today is democracy itself. Its (...) enemies are within: what the ancient Greeks called 'hubris'. Todorov argues that certain democratic values have been distorted and pushed to an extreme that serves the interests of dominant states and powerful individuals. In the name of ‘democracy’ and ‘human rights’, the United States and some European countries have embarked on a crusade to enlighten some foreign populations through the use of force. Yet this mission to ‘help’ others has led to Abu Ghraib and Guantanamo, to large-scale destruction and loss of life and to a moral crisis of growing proportions. The defence of freedom, if unlimited, can lead to the tyranny of individuals. Drawing on recent history as well as his own experience of growing up in a totalitarian regime, Todorov returns to examples borrowed from the Western canon: from a dispute between Augustine and Pelagius to the fierce debates among Enlightenment thinkers to explore the origin of these perversions of democracy. He argues compellingly that the real democratic ideal is to be found in the delicate, ever-changing balance between competing principles, popular sovereignty, freedom and progress. When one of these elements breaks free and turns into an over-riding principle, it becomes dangerous: populism, ultra-liberalism and messianism, the inner enemies of democracy. (shrink)

We have a striking ability to alter our psychological access to past experiences. Consider the following case. Andrew “Nicky” Barr, OBE, MC, DFC, (1915 – 2006) was one of Australia’s most decorated World War II fighter pilots. He was the top ace of the Western Desert’s 3 Squadron, the pre-eminent fighter squadron in the Middle East, flying P-40 Kittyhawks over Africa. From October 1941, when Nicky Barr’s war began, he flew 22 missions and shot down eight enemy planes in (...) his first 35 operational hours. He was shot down three times, once 25 miles behind enemy lines while trying to rescue a downed pilot. He escaped from prisoner of war camps four times, once jumping out of a train as it travelled from Italy into Austria. His wife Dot, who he married only weeks before the war, waited for him at home. She was told on at least three occasions that he was missing in action or dead. For 50 years, Nicky Barr never spoke publicly, and rarely privately, of his war-time experiences. He was very much a forgotten and forgetting hero (for further details, see Dornan, 2002). From their conception to the present, the social sciences have invoked a kind of explanation that looks suspect by the standards of the natural sciences. They explain why social practices exist by reference to the purpose or needs they serve. Yet the purposes invoked are generally not the explicit purposes or needs of any individual but of society or social groups. For example, Durkheim claimed that the division of labor in society exists in order to promote social solidarity and (...) Marx thought that the state served to promote the interests of the ruling class. Social scientists have found these explanations as irresistible as their critics have found them mysterious. This chapter traces the controversies over these explanations — generally called functional explanations — and argues that they are widespread in some of our best current social science and that they can provide compelling information in some cases, despite the many doubts about them. General and comparative studies of empire – like those of revolution – often suffer from insufficient attention to chronology. Time expresses itself both in the form that empires occur, often in succession to each other – the Roman, the Holy Roman, the Spanish, etc. – and, equally, in an awareness that this succession links empires in a genealogical sense, as part of a family of empires. This article explores the implications of taking time seriously, so that empires are not (...) considered simply as like ‘cases’ of a general phenomenon of empire but are treated as both ‘the same and different’. Concentrating on the European empires since the time of Rome, the article shows the extent to which empires were conscious of each other, seeking both to imitate admired features as well as to escape from those thought less desirable. It also shows the difference between ancient and modern empires, considered not so much as different types as in the differences caused by their location in different points in historical time. Comparative studies of empire, the article concludes, must pay attention to both continuity and change, both similarity and difference. (shrink)

We examine the interplay between corporate social responsibility (CSR) and related party transactions (RPTs). As per our findings, aggregate RPTs is associated with higher CSR expenditure. The level of business RPTs positively correlates with CSR spending, whereas a negative association is witnessed in the case of tone RPTs. Further analysis reveals a greater propensity among firms with significant RPTs to expropriate resources through manipulative earnings management practices that could lower CSR spending. We also document that high ownership concentration reduces CSR (...) expenditure. While the results are robust to alternate variable and model specifications, concerns surrounding endogeneity and sample selection bias have been addressed through the use of two-step system generalized method of moments (GMM) estimations and the Heckman two-step selection models, respectively. The study extends the extant literature on the relationship between CSR and RPTs, with the potential moderating roles of earnings management and ownership concentration. From regulatory standpoint, the focus should be on the implementation of robust monitoring mechanism to curb misuse of RPTs as a tool for expropriating firms’ resources. Indian firms, on their part, should strengthen their internal corporate governance mechanisms to improve transparency in RPTs oversight, ensuring alignment with sustainability goals. (shrink)

In this presentation I will examine how Christian and Jewish leaders have responded to this phenomenon. Some have been quite suspicious of such interreligious and cross-cultural encounters, claiming that Buddhism is a great threat to their religions. However, others have argued that their encounters with Buddhism have led them to deeper insight into their own traditions and have helped them to become better human beings. Their practice of Buddhist meditation has been a way for them to develop sensitivity to God and greater commitment to their own traditions. Still others have converted to Buddhism; it is estimated that of the three million Buddhists in America, fully one million are converts from Christianity and Judaism.Because of the complexity and diversity within Judaism, Christianity, and Buddhism, I will focus on the responses of leading Orthodox Jews and Roman Catholic Christians to Theravada Buddhism and to the Zen school in Mahayana, the two forms of Buddhism to which many Americans are drawn and with which I have some personal experience. I will first examine how members of the Jewish and Christian traditions view other religions, because an individual’s perception of the encounter is shaped by how their religion views the Buddhist tradition. However, there is no question that members of Asian religions are practicing idolatrous worship, avodah zarah (“strange worship”). They are therefore in violation of the Noahide Law not to worship idols.With some exceptions, Orthodox rabbis in recent times agree with Rabbi Avigdor Miller (1908–2001) that “Buddhism, Shintoism, and all other religions of the Far East are forms of idol worship.”1 For Rabbi Miller the Torah contains all the knowledge that is necessary for Jews, and to even study another religious tradition is an affront to God. There are well-defined areas of "applied ethics" corresponding to nature, business, health care, war, punishment, animals, and more, but there is no recognized research program in "applied ethics of the arts" or "art ethics." Art often seems to belong to its own sphere of value, separate from morality. The first questions we ask about art are usually not about (...) its moral rightness or virtue, but about its beauty or originality. How can we acquire knowledge of metaphysical modality? How can someone come to know that he could have been elsewhere right now, or an accountant rather than a philosophy teacher, but could not have been a turnip? Jago proposes an account of a route to knowledge of the way things could have been and must be. He argues that we can move to knowledge of metaphysical modality from knowledge about essence. Curtis rejects Jago’s explanation. It cannot, he argues, explain (...) our knowledge of de re necessity. We agree. But there is more to be said. To give an account of our knowledge of metaphysical necessity is part of the task Jago set himself. But another part is to give an account of the knowledge of the possibilities accorded to particular objects. And prior to both what is needed, and something Jago attempts to supply, is an account of how ordinary knowers can come to have knowledge of an individual’s essential properties. We argue that Jago’s accounts of both these additional matters are also unsatisfactory. This is important because the thought that our knowledge of metaphysical modality has its source in our knowledge of essence is currently an attractive one and Jago has set out very clearly what must be done to justify the thought. Human opacity is the intrinsic quality of unknowabil- ity of human beings with respect to machines. The descriptive rela- tionship between humans and machines, which captures how much information one can gather about the other, can be explicated using an opacity-transparency relationship. This relationship allows us to describe and normatively evaluate a spectrum of opacity where humans and machines may be either opaque or transparent. In this paper, we argue that the advent of Affective Computing (AC) has begun to shift (...) the ideal position of humans on this spectrum towards greater transparency, while much of this technology is shifting towards opacity. We explore the implications of this shift with regard to the affective information of humans and how the threat to human opacity by AC systems has various adverse repercussions, such as infringement of one’s autonomy, deception, manipulation, and increased anxiety. There are also distributive consequences that expose vulnerable groups to unjustified burdens and reduce them to mere profiles. We further provide an assessment of current AC technology, which follows the descriptive relationship between humans and machines from the lens of opacity and transparency. Finally, we foresee and address three possible objections to our claims. These are the beneficence of AC systems, their relation to privacy, and their restrictive capacity to capture human affects. Through these arguments, the paper aims to bring attention to the ontological relationship between humans and machines from the perspective of opacity and transparency while emphasizing on the gravity of the ethical concerns raised by their threat to human opacity. LEE IT HAS BEEN ALMOST ONE HUNDRED YEARS since the publication of Peirce's article "How to Make Our Ideas Clear" in the Popular Science Monthly. There Peirce stated what came to be called The Pragmatic Maxim. 1 Since then pragmatism has been developed and expounded by many proponents. Some of the developments have differed markedly from others, and (...) some of these differences are not easily compatible.2 Opponents of pragmatism have differed in their interpretations in step with the proponents. As the century is rounded out, we should be able to review the scene and appraise the maneuvers and sorties. Just what is pragmatism? It has often been held that pragmatism is not the name of a philosophy but only of a loose collection of philosophies having at most a faint family resemblance. It must be admitted that this interpretation received some support from James's genial and hospitable personality. Nevertheless, I think it is incorrect. We can now discern a central, characterizing position which the early proponents of the new movement were setting forth and defending; and we can free it from misunderstandings that have historically beset it. It was apparent from the first that action and the consequences of action were to be regarded as fundamental to the new position, but this characterization is vague enough to cover many incompatible special developments. It can be sharpened now, after a century of discussion and debate, and we can identify the respects in which action is central, thus separating the general position from the special interests belonging to one or another of the individuals who were its early advocates. Such clarification will reveal a pragmatism that is highly relevant to contemporary philosophy. I. Peirce proposed his maxim as a theory of meaning: the clear apprehension of an idea is to be obtained by considering the effects or consequences on future possible action that follow from the idea. Meanings consist in the possible effects of present experience on future behavior. In accordance with the pragmatic maxim, I shall take the behavioral theory of meaning and the behavioral theory of knowledge that issues from it to be the central position of pragmatism. What is either incompatible or unnecessary to this behavioral core is expendable, and if it has contributed to the misunderstanding or misrepresentation of the core, it should be abandoned in the further development of pragmatism. The proposed solution is to investigate and develop an easy, fast, and multi-language support plagiarism detector with the easy of one click to detect the document plagiarism. This process will be done with the (...) support of intelligent system that can learn, change and adapt to the input document and make a cross-fast search for the content on the local repository and the online repository and link the content of the file with the matching content everywhere found. Furthermore, the supported document type that we will use is word, text and in some cases, the pdf files –where is the text can be extracting from them- and this made possible by using the DLL file from Word application that Microsoft provided on OS. The using of DLL will let us to not constrain on how to get the text from files; and will help us to apply the file on our Delphi project and walk throw our methodology and read the file word by word to grantee the best working scenarios for the calculation. In the result, this process will help in the uprising the documents quality and enhance the writer experience related to his work and will save the copyrights for the official writer of the documents by providing a new alternative tool for plagiarism detection problem for easy and fast use to the concerned Institutions for free. Our senses receive a manifold of sensory signals at any given moment in our daily lives. For a coherent and unified representation of information and precise motor control, our brain needs to temporally bind the signals emanating from a common causal event and segregate others. Traditionally, different mechanisms were proposed for the temporal binding phenomenon in multisensory and motor-sensory contexts. This paper reviews the literature on the temporal binding phenomenon in both multisensory and motor-sensory contexts and suggests future research (...) directions for advancing the field. Moreover, by critically evaluating the recent literature, this paper suggests that common computational principles are responsible for the temporal binding in multisensory and motor-sensory contexts. These computational principles are grounded in the Bayesian framework of uncertainty reduction rooted in the Helmholtzian idea of unconscious causal inference. (shrink)

Eric Olson has argued, startlingly, that no coherent account can be giv- en of the distinction made in the personal identity literature between ‘complex views’ and ‘simple views’. ‘We tell our students,’ he writes, ‘that accounts of personal identity over time fall into [these] two broad categories’. But ‘it is impossible to characterize this distinction in any satisfactory way. The debate has been systematically misdescribed’. I argue, first, that, for all Olson has said, a recent account by Noonan provides the (...) coherent characterization he claims impossible. If so we have not been wrong all along in the way he says in what we have been telling our students. I then give an account of the distinction between the reductionist and non-reductionist positions which makes it differ- ent from the complex/simple distinction. The aim is to make clear sense of the notion of a not simple but non-reductionist position — which seems an eminently reasonable possibility and something it may also be useful to tell our students about. Aesthetic internalism claims a link between judgement and motivation: aesthetic judgements bring with them motivations to act in characteristic ways. Critics object that there is a difference between merely liking something and judging it to be aesthetically good, and that it is our likings, not our aesthetic judgements, that motivate us. This paper develops a version of aesthetic internalism that can respond to this criticism. Wholehearted aesthetic judgements are characterized by stability, attention, and motivation. Making such judgements is an important (...) part of a good life, and so at least some aesthetic judgements are motivating. So we have reason to think that this version of aesthetic internalism is true. This paper defends wholehearted aesthetic internalism against objections, and assesses an argument from aesthetic internalism to aesthetic non-cognitivism. While wholehearted aesthetic internalism can only offer qualified support to non-cognitivism, it nonetheless offers a number of fruitful avenues for further work. (shrink)

The decree establishing an Athenian colony at Brea in the north Aegaean area was firmly placed by the editors ofThe Athenian Tribute Listsin 446 B.C.; they identified the troops mentioned in lines 26 ff. with the men then serving in Euboia. In 1952, however, Woodhead proposed redating the decree c. 439/8 B.C. and explained lines 26 ff. by reference to the Samian revolt. A decade later I put forward a more radical theory, which seems to have won no adherents. I (...) cannot really complain of this, since my arguments were inevitably far from cogent. For some Thucydides' silence alone will have been decisive. I would like to think that the issue has at least been clarified by now. TheA.T.L.dating appears rather less plausible. Demokleides' generalship in 439/8 B.C. would fit excellently with his role as founder of Brea. This strongly supports Woodhead. It is doubtful whether Demokleides was general as early as 446 B.C, though conceivable that he returned to the board as late as 426/5 B.C. Woodhead may well be right in locating Brea on the inner Thermaic Gulf and, if so, this too tells against theA.T.L.dating. We had an ideal of evidence-based, rational, ethical and equitable health care and set out to serve (...) rural and under-served communities which included displaced forest-based tribes. In the initial years, with the naivety of the inexperienced, we believed that by correcting the dehydration of the doe-eyed six-year-old Mare and giving her a free course of antibiotics, we had made health care accessible to her. Much to our dismay, within a month, Mare was back in the outpatient clinic, with diarrhea all over again and looking thinner than ever. We realized that it was a losing battle to keep her healthy as long as she continued to drink water from the same contaminated stream, live in unhygienic surroundings, and eat only the paltry meals that her family could barely afford. We gradually began to connect these living examples to what our preventive medicine text books had stressed all along—there are many social determinants of health which, if left unaddressed, do not permit realization of the vision of health for all.Such instances continually pulled us out of the hospital building and into the villages and tribal hamlets. We discovered that our textbook of Preventive and Social Medicine (Park, 1986) (P&SM as we used to call it), was our most valuable possession. We have sometimes been compelled to adopt health practices that were not really evidence-based, seemingly irrational, inequitable and even downright unethical. This narration describes only a few of our thousands of cases, and hopefully conveys our periods of self-doubt, despair and hope, as well as, the challenges we face to reconcile with the difficult choices we are forced to make every day.Unforeseen Challenges in Saving Mothers and ChildrenHigh maternal and child mortality rates have been one of the most disturbing aspects of the health care scenario in rural India. To ensure immunization of all children, health workers with vaccine carriers go from village to village and hamlet to hamlet to reach those infants that would have missed visits to the immunization clinics. Our grass-root workers facilitate these visits by identifying households with such children. Occasionally, they encounter families who spirit away the infant into the adjoining woods as soon as the health worker is seen approaching, and blandly proclaim that the child is not at home. Despite reassurance and counseling about the safety and necessity of the vaccine, their apprehensions and misconceptions are insurmountable. What is the extent of the responsibility of the health worker? Is it ethical to hunt down the child and force the administration of the vaccine in view of the public health gains, besides the child's welfare?A few months ago, a pre-term neonate was admitted to our hospital, but worsened and needed referral to a higher centre in the city. This study examines the influence of women’s board representation on the proportion of women senior managers in the United Kingdom (UK) from 1999 to 2019. We take a multi-theoretic approach, drawing on the trickle-down effect, critical mass theory, and agency theory, to explore several aspects of this topic. We find that more women on boards is associated with more women in senior management as suggested by the trickle-down perspective. We also find support for a critical mass effect; while one (...) or two women on a board is beneficial for advancing women into senior management, three or more women directors is more advantageous. Consistent with agency theory expectations, the relationship between women on boards and senior management gender diversity is driven almost entirely by women in non-executive, rather than executive, board positions, presumably as a result of the relative independence non-executive directors have compared to their executive director counterparts. Our study suggests that increasing women’s board appointments is a potential solution to the underrepresentation of women senior managers and may assist in building a pipeline for future CEO and board appointments. The word-soul or psyche is not contained within a linguistic body but hovers amorously over it, [End Page 257] fleeing any too crude (...) attempt at capture. The reader must trace out Mandelstam’s personal networks of association, both inside and outside the text, before a kernel of thought and emotion can be recognized (“only the moment of recognition is sweet to us,” goes a famous line from his “Tristia”). Although Clare Cavanagh’s book does not emphasize this theme, her tactics could hardly be better suited to Mandelstam’s peculiar poetic sensibility.Osip Mandelstam and the Modernist Creation of Tradition is an exhaustive exploration of historical and cultural context. It opposes itself explicitly to the traditional structuralist and semiotic approaches to Mandelstam, and takes his works in their “secular” rather than their “hermetic” aspect (to borrow terms from Robert Scholes). In that sense it seeks to recollect and bring to mind everything that might affect our understanding of Mandelstam’s oeuvre. This turns out to be a varied field: Pound and Eliot (coeval modernists whose ideas resonate significantly with his), François Villon, Byzantine and Gothic church architecture, the marginalized yet culturally dynamic position of the Russian Jew, Pindar (an exemplar of the social-economic relation of poet to state), Dante, the psychology of literary play, and even Charlie Chaplin. Although it does not use extensive biographical framing, the book proceeds through Mandelstam’s poetry and prose in chronological order, alternately pursuing aspects of context and concentrating on selected works by Mandelstam for sustained analysis.What results is perhaps the most serious comprehensive work on the poet produced so far. Cavanagh’s approach may appear diffuse at first, but it enables her to capture a great deal of this elusive genius without confining Mandelstam within a narrow critical purview. The book’s argument is that Mandelstam qualifies as a central modernist poet through his agonistic relation to an ideal of “world culture.” He attempts to recreate an authoritative literary and cultural tradition that his own innovative work would both continue and transform. And it is from this point of view that Mandelstam’s Jewishness appears so significant to Cavanagh (a chief issue in three out of eight chapters): it gives a precise formula for that position both inside and outside of the dominant culture. Cavanagh even contends quite suggestively that, for Mandelstam, both Dante and Chaplin function as avatars of Jewishness.All this is well-founded and important, but perhaps the best thing about her book is that its central argument doesn’t do justice to the richness of Cavanagh’s own materials. Her discussion does not weaken, for instance, as it leaves Mandelstam’s early period, when the notion of “world culture” was indeed an obsessive one for him. The book is equally effective on the brilliant late poems of the Voronezh cycle, by which time not only a place in world culture but even a secure place in human society seemed futile dreams to Mandelstam. Cavanagh’s readings of the prose and especially the poetry are flexible and sensitive; she gives beautiful accounts of the poetic wordplay and follows closely the ebb and flow of musicality in the verse from one period and [End Page 258] collection to another. Kant claims that the transcendental self can be represented as a “feeling of existence” (Gefühl eines Daseins). Some interpreters take this claim to be inconsistent with Kant’s larger theory of self-consciousness. I consider the extent to which two eighteenth-century philosophy texts that Kant knew well - Tetens’ Philosophische Versuche über die menschliche Natur und ihre Entwickelung and Feder’s Logik und Metaphysik - can contribute to our understanding of Gefühl eines Daseins. I point to some continuities between Kant’s characterization of “Gefühl” (...) in Gefühl eines Daseins, and Tetens’ and Feder’s conceptualizations of Selbstgefühl. I show that Gefühl eines Daseins is prima facie consistent with Feder’s clear “I” (or Selbstgefühl) and Tetens’ clear Selbstgefühl; and both Gefühl eines Daseins and clear Selbstgefühl relate to higher cognition. Finally, I discuss whether the notion of Selbstgefühl is compatible with key aspects of Kant’s conceptualization of the self - the transcendental-empirical distinction, and the atemporality of the self. Julius Tomin has recently questioned the new orthodoxy, stemming from Burnyeat's impressive article, that Socratic midwifery is not genuinely Socratic. I understand that many will feel the need to question Burnyeat's position, but I am unhappy that Aristophanes' comedy has once again been thought to give support to the view that Socrates had been known as an intellectual midwife. Thus my response will concentrate on our understanding of Clouds, and in particular on the key passage at 135ff.

Philosophical discussions of the phenomenon that has come to be known as ‘moral luck’ have either dismissed it as illusory or touted it as the evidence for doubting the probative value of our commitment to certain widely avowed views concerning interpersonal assessments of responsibility. In this discussion, we present a third, distinctive interpretation of the moral luck phenomenon. Drawing upon empirically robust results from psychological studies of judgment bias, we argue that the phenomenon of moral luck is demonstrably not (...) illusory. What we suggest, however, is that the phenomenon ought not to be taken to countenance doubts about the standards generally taken to be regulative of assessments of interpersonal responsibility. Rather, its significance lies in foregrounding certain generally unacknowledged obstacles we face in the process of conclusively applying general valid moral standards in making specific judgments of responsibility and desert.1. The essays included represent a rich variety of thought, ranging from finely nuanced philosophical and theological arguments to historical studies and cultural commentaries. Several explore the historical background of today's biotechnology: Timothy Casey traces such developments as the emergence of cybernetic humanity from Cartesian dualism, and Diane Paul presents the history of "positive" versus coerced eugenics. Jean Bethke Elshtain discusses cloning as a "messianic project" to perfect the body and exclude natural diversity -- giving as an example the elimination of Down Syndrome as an acceptable human type -- while Harold Baillie calls for an examination of the metaphysical roots of personhood. Robert Proctor finds no evidence in paleontology for any "essence of humanity," and Tom Shannon argues against materialist reductionism. Addressing social concerns, Lisa Sowle Cahill finds the possibility of a political solution to the problems raised by genetic engineering in Catholic teachings on social justice, and Langdon Winner looks critically at the "scientific enthusiasts of a posthuman future."
