Using a case-study involving bioethics and LGBTQ+ family-making, I demonstrate the appeal of a pragmatist ethics approach to bioethics. On the specific pragmatist view I offer, ethical progress is a matter of overcoming ethical problems. Ethical problems are here understood as conflicts that arise as we attempt to live out our values in the natural and social world and which prompt us to reflect upon and sometimes reinterpret or revise our values or practices. Pragmatism is inherently nonideal in its theoretical (...) approach, since it holds that the relevant conflicts that prompt moral inquiry are not conflicts among abstract ideals, but practical conflicts that arise from our interaction with the world. Ideals alone, then, cannot be a proper guide to bioethical progress. After laying out this approach to moral theorizing in more detail, I take up a case study, focusing on the value of genetic relations within families and the use of reproductive technologies to allow LGBTQ+ people to produce biologically related children. I use this case to show the value of nonideal approaches to bioethics. More specifically, I argue that pragmatism—as a nonideal theory—instructs us to evaluate these issues and family-making practices by considering the situatedness of LGBTQ+ people in a heteronormative society, and the ways in which that particular context produces practical conflicts as LGBTQ+ people and families attempt to live out their values in the social world. Scientific realism is the position that success of a scientific theory licenses an inference to its approximate truth. The argument from pessimistic meta-induction maintains that this inference is undermined due to the existence of theories from the history of science that were successful, but false. I aim to counter pessimistic meta-induction and defend scientific realism. To do this, I adopt a notion of success that admits of degrees, and show that our current best theories enjoy far higher degrees of (...) success than any of the successful, but refuted theories of the past. Proponents of causal decision theories argue that classical Bayesian decision theory (BDT) gives the wrong advice in certain types of cases, of which the clearest and commonest are the medical Newcomb problems. I defend BDT, invoking a familiar principle of statistical inference to show that in such cases a free agent cannot take the contemplated action to be probabilistically relevant to its causes (so that BDT gives the right answer). I argue that my defence does better than those of (...) Ellery Eells and Richard Jeffrey; and that it applies, where necessary, to other types of Newcomb problem. (shrink)

The traditional use of ergodic theory in the foundations of equilibrium statistical mechanics is that it provides a link between thermodynamic observables and microcanonical probabilities. First of all, the ergodic theorem demonstrates the equality of microcanonical phase averages and infinite time averages (albeit for a special class of systems, and up to a measure zero set of exceptions). Secondly, one argues that actual measurements of thermodynamic quantities yield time averaged quantities, since measurements take a long time. The combination of (...) these two points is held to be an explanation why calculating microcanonical phase averages is a successful algorithm for predicting the values of thermodynamic observables. It is also well-known that this account is problematic.

This survey intends to show that ergodic theory nevertheless may have important roles to play, and it explores three other uses of ergodic theory. Particular attention is paid, firstly, to the relevance of specific interpretations of probability, and secondly, to the way in which the concern with systems in thermal equilibrium is translated into probabilistic language. With respect to the latter point, it is argued that equilibrium should not be represented as a stationary probability distribution as is standardly done; instead, a weaker definition is presented. I argue that disputes within constitutional theory about whether recent supreme court decisions exceed the scope of legitimate judicial review and disputes within legal theory about the nature and determinacy of law are best seen and assessed as disputes over the nature of legal interpretation. I criticize the interpretive assumptions on which these disputes generally depend and defend a theory of interpretation which tends to vindicate the determinacy of law even in hard cases and the style of (...) recent court decisions which many critics find troublesome. Constructor theory seeks to express all fundamental scientific theories in terms of a dichotomy between possible and impossible physical transformations–those that can be caused to happen and those that cannot. This is a departure from the prevailing conception of fundamental physics which is to predict what will happen from initial conditions and laws of motion. Several converging motivations for expecting constructor theory to be a fundamental branch of physics are discussed. Some principles of the theory are suggested (...) and its potential for solving various problems and achieving various unifications is explored. These include providing a theory of information underlying classical and quantum information; generalising the theory of computation to include all physical transformations; unifying formal statements of conservation laws with the stronger operational ones (such as the ruling-out of perpetual motion machines); expressing the principles of testability and of the computability of nature (currently deemed methodological and metaphysical respectively) as laws of physics; allowing exact statements of emergent laws (such as the second law of thermodynamics); and expressing certain apparently anthropocentric attributes such as knowledge in physical terms. This paper develops a meta-theory of business based on virtue theory which links the concept of virtues, the common good, and the dynamic economy into a unifying and comprehensive theory of business. Traditional theories and models of business have outlived their usefulness as they are unable to adequately explain social reality. Virtue theory shows firms that pursue ethically-driven strategies can realise a greater profit potential than those firms who currently use profit-driven strategies. This book presents a new approach to semantics based on Kazimierz Ajdukiewicz’s Directival Theory of Meaning, which in effect reduces semantics of the analysed language to the combination of its syntax and pragmatics. The author argues that the DTM was forgotten because for many years philosophers didn’t have conceptual tools to appreciate its innovative nature, and that the theory was far ahead of its time. The book shows how a redesigned and modernised version of the DTM can deliver (...) a new solution to the problem of defining linguistic meaning and that the theory can be understood as a new type of functional role semantics. The defining feature of the DTM is that it presents meaning as a product of constraints on the usage of words. According to the DTM meaning is not use, but the avoidance of misuse. Readers will see how the DTM was shelved for reasons that we don’t find so dramatic anymore, and how it contains enough original ideas and solutions to warrant developing it into a full-blown contemporary account. It is shown how many of the underlying ideas of the theory have been embraced later by philosophers and treated simply as brute facts about natural languages or even as new philosophical discoveries. Scientific realists contend that theory-conjunction presents a problem for empiricist conceptions of scientific knowledge and practice. Van Fraassen (1980) has offered a competing account of theory-conjunction which I argue fails to capture the mercenary character of epistemic dependence in science. Representative cases of theory-conjunction developed in the present paper show that mercenary reliance implies a "principle of epistemic symmetry" which only a realist can consistently accommodate. Finally, because the practice in question involves the conjunction of theories, a (...) version of realism more robust than the "entity realism" of Cartwright (1983, 1989) and Hacking (1983) is required to explain the success of theory-conjunction. Quality-space theory (QST) explains the nature of the mental qualities distinctive of perceptual states by appeal to their role in perceiving. QST is typically described in terms of the mental qualities that pertain to color. Here we apply QST to the olfactory modalities. Olfaction is in various respects more complex than vision, and so provides a useful test case for QST. To determine whether QST can deal with the challenges olfaction presents, we show how a quality space (QS) could (...) be constructed relying on olfactory perceptible properties and the olfactory mental qualities then defined by appeal to that QS of olfactory perceptible properties. We also consider how to delimit the olfactory QS from other modalities. We further apply QST to the role that experience plays in refining our olfactory discriminative abilities and the occurrence of olfactory mental qualities in non-conscious olfactory states. QST is shown to be fully applicable to and useful for understanding the complex domain of olfaction. (shrink)

The theory of mind (ToM) deficit associated with autism has been a central topic in the debate about the modularity of the mind. Most involved in the debate about the explanation of the ToM deficit have failed to notice that autism’s status as a spectrum disorder has implications about which explanation is more plausible. In this paper, I argue that the shift from viewing autism as a unified syndrome to a spectrum disorder increases the plausibility of the explanation of (...) the ToM deficit that appeals to a domain-specific, higher-level ToM module. First, I discuss what it means to consider autism as a spectrum rather than as a unified disorder. Second, I argue for the plausibility of the modular explanation on the basis that autism is better considered as a spectrum disorder. Third, I respond to a potential challenge to my account from Philip Gerrans and Valerie Stone’s recent work (Gerrans, Biol Philos 17:305–321, 2002; Stone and Gerrans, Trends Cogn Sci 10:3–4, 2006a; Soc Neurosci 1:309–319, 2006b; Gerrans and Stone, Br J Philos Sci 59:121–141, 2008). Amartya Sen argues that for the advancement of justice identification of ‘perfect’ justice is neither necessary nor sufficient. He replaces ‘perfect’ justice with comparative justice. Comparative justice limits itself to comparing social states with respect to degrees of justice. Sen’s central thesis is that identifying ‘perfect’ justice and comparing imperfect social states are ‘analytically disjoined’. This essay refutes Sen’s thesis by demonstrating that to be able to make adequate comparisons we need to identify and integrate criteria of comparison. This is (...) precisely the aim of a theory of justice (such as John Rawls’s theory): identifying, integrating and ordering relevant principles of justice. The same integrated criteria that determine ‘perfect’ justice are needed to be able to adequately compare imperfect social states. Sen’s alternative approach, which is based on social choice theory, is incapable of avoiding contrary, indeterminate or incoherent directives where plural principles of justice conflict. (shrink)

As a post-Gricean pragmatic theory, Relevance Theory (RT) takes as its starting point the question of how hearers bridge the gap between sentence meaning and speaker meaning. That there is such a gap has been a given of linguistic philosophy since Grice’s (1967) Logic and Conversation. But the account that relevance theory offers of how this gap is bridged, although originating as a development of Grice’s co-operative principle and conversational maxims, differs from other broadly Gricean accounts in (...) certain fundamental respects, and leads to a stance on the nature of language, meaning and communication which is at odds, not only with the view of Grice himself, but also with the view common to most post-Fregean philosophy of language. In this paper I give a Bayesian criterion for when an experiment is a test of the theory of the apparatus, rather than a test of the theory of the phenomena, and describe strategies used to ensure that tests of the theory of the phenomena are possible. I extend this framework to low dose electron microscopy which has a stochastic instrument theory and which provides an exception to a thesis by Robert Ackermann on the independence between (...) theory and instrumentation. Physicists and philosophers argue whether quantum theory has spiritual implications. The vast majority of opinions are at two extremes: Some contend that quantum theory has absolutely no spiritual implications whatsoever, whereas others assert that it forms the very basis of a modern spirituality and can be directly applied to the human condition. It is this article's contention that neither extreme is correct. Quantum theory does have spiritual implications - a fact that its founders intuited and its enemies, (...) Einstein preeminent among them, considered prima facie evidence of its as yet undiscovered flaws. Quantum theory has proven itself against all challenges more successfully than any other scientific theory, but its spiritual implications are extremely subtle. It provides a boundary to the materialistic, deterministic worldview and shows that there must be more to reality than that, but is inherently incapable of providing evidence as to the nature of what lies beyond that boundary. According to Adorno, an evil star hangs over the theory of natural beauty. The essay examines the reasons for this neglect of the beautiful of nature by confronting Kant's account of natural beauty with Hegel's theory about the fundamental deficiencies of beauty in nature and locates them in the essential indeterminacy of everything that belongs (...) to nature. Inquiring into what Adorno seeks to achieve by playing Kant and Hegel off against one another, it is shown that this indeterminacy of nature is both an index of nature's interconnectedness with mythical violence and the promise of a freedom from myth. This article works across multiple disciplinary boundaries, especially queer theory, to examine critically the controversial, and often socially controlling, role of biomedical knowledge and interventions in the realm of human sexuality. It will attempt to situate scientific/medical discourses on sexuality historically, socially, and culturally in order to expose the ways in which “proper” sexual health in medical research and clinical practice has been conflated with prevailing social norms at particular historical junctures in the 20th and 21st centuries. How might (...) the relationship between clinical and cultural spheres be better engaged in biomedical knowledge and clinical practice in understanding sexual health, given the impact of homophobic and transphobic assumptions in the diagnostic histories of homosexuality and Gender Identity Disorder in Childhood, a new diagnostic category introduced into the DSM following the removal of homosexuality from the DSM-III? The article will argue further that biomedical knowledge is always already mediated through culture by analyzing normative racial, gender, class, and sexual ideologies that regulated early understandings of the epidemiology of the HIV/AIDS pandemic in the West and in the postcolonial world while informing global health policy on HIV/AIDS. The article concludes by examining the implications of medical education for both LGBTQI patients and medical professionals, for understanding gender and sexual rights as human rights, and for thinking about new kinds of interventions, contestations, and struggles to resist continued homophobic and transphobic assumptions in biomedical practice today and their ongoing effects in the everyday world. This edition provides the first complete English translation of Bernard Bolzano's four-volume Wissenschaftslehre or Theory of Science, a masterwork of theoretical philosophy. First published in 1837, the Wissenschaftslehre is a monumental, wholly original study in logic, epistemology, heuristics, and scientific methodology. Unlike most logical studies of the period, it is not concerned with the "psychological self-consciousness of the thinking mind." Instead, it develops logic as the science of "propositions in themselves" and their parts, especially the relations between these entities. (...) If it can be agreed that health care resources are finite, it follows that choices between competing needs must be made. Cost utility analysis is an application of decision theory which has been proposed as a strategy for making difficult social decisions about health resource allocations. This method is heavily dependent upon the measurement of social utilities for various health outcomes. Recent work in cognitive psychology suggests that there are important sources of distortion in such measurement. The Complete Theory of Everything (CTE) is based on certain axioms of indiscernibility. Such axioms of indiscernibility have been given a philosophical justification by Kit Fine. I want to report on an attempt to give strong indiscernibility axioms which might also be subject to such philosophical analysis, and which prove the consistency of set theory; i.e., ZFC or more. In this way, we might obtain a (new kind of) philosophical consistency proof for mathematics.

In an article previously published in this journal, Phillip Montague critically surveys and rejects a handful of contemporary attempts to explain why state punishment is morally justified. Among those targeted is one of my defences of the censure theory of punishment, according to which state punishment is justified because the political community has a duty to express disapproval of those guilty of injustice. My defence of censure theory supposes, per argumentum, that there is always some defeasible moral reason (...) for the state to proportionately punish the guilty, and then demonstrates that censure theory best entails and explains this intuition. Montague does not question the intuition, but instead argues that three rival theories of punishment, including his societal-defence view, account for it to no worse a degree than my censure theory. In this article I defend my initial argument, noting resources for its defence that Montague does not appreciate and that, I maintain, provide those who believe that there is always pro tanto injustice in the state failing to proportionately punish the guilty reason to adopt censure theory over all competitors, including Montague’s societal-defence theory.
