This article brings together two debates in contemporary political philosophy: on the one hand, the dispute between the distributive and relational approaches to equality and, on the other hand, the field of intergenerational equality. I offer an original contribution to the second domain and by doing so, I inform the first. The aim of this article is thus twofold: (1) shedding some light on an under-researched and yet crucial question – ‘which inequalities between generations matter?’ and (2) contributing to a (...) far-reaching debate that touches upon the nature of egalitarianism. After showing that there are two key problems that fall within the scope of intergenerational equality – questions of justice between age groups and questions of equality between birth cohorts – I argue that, contrary to what the default distributive view (complete lives egalitarianism) states, some inequalities between age groups matter independently of their diachronic impact, and so partly for relational reasons. I argue that, even if we are distributive egalitarians, we must endorse the relational egalitarian conception to successfully make sense of some inequalities between age groups. I infer from this both that the putative view that the ‘relational’ conception of equality can be redescribed as distributive must be rejected and that the distributive view requires supplementation (but not necessarily displacement) by the relational view. Business Ethics: A European Review, EarlyView.

The issue of the ordering of the ten trichotomies is one among the many questions still open regarding Peirce’s extended theory of signs. A proper decision regarding the order of the ten trichotomies demands a discussion of the entire semiotic process. The aim of this paper is to discuss the order of the trichotomies related to the mode of being of the immediate and dynamical objects. Therefore, it addresses only one part of this process, which concerns the relationship between the (...) sign and its objects. When subdividing the object, Peirce begins to consider the immediate and the dynamic objects as trichotomies, that is, aspects to be considered in the definition of the classes of signs. The introduction of these two trichotomies brings in a problem: how to order them in the system of ten trichotomies. Diverging opinions regarding this ordering are found in Peirce’s texts, and in his commentators. We will investigate this problem by seeking a sort of pragmatic clarification of the matter, presenting a reflection about the philosophical and semiotic consequences of the different proposals for the ordering of these trichotomies. Placing the dynamic object after the sign may even help to explain the functioning of fictional signs, but is this coherent with Peirce’s philosophy? On the other hand, would it be possible to talk about lying signs if every object was determined by its own sign? (shrink)

Research on unethical leadership has predominantly focused on interpersonal and high-intensity forms of harmful leader behavior such as abusive supervision. Other forms of harmful leader behavior such as excessively pressuring subordinates or acting in self-centered ways have received less attention, despite being harmful and potentially occurring more frequently. We propose a model of four types of harmful leader behavior varying in intensity and orientation : Intimidation, Lack of Care, Self-Centeredness, and Excessive Pressure for Results. We map out how these relate (...) to other constructs in the unethical leader behavior field in order to integrate the existing work on how leaders can cause harm to followers. Next, in five studies, we develop and test a new survey instrument measuring the four proposed types of perceived HLB. We provide initial validity evidence for this new measure, establish its psychometric properties, and examine its nomological network by linking the four types of HLB to related leadership constructs and soft and hard outcome correlates at the individual and team level. We find that HLB is negatively related to constructive forms of leadership and positively to unethical ones. HLB is also related in the expected direction to job satisfaction, engagement, psychological safety, knowledge sharing, knowledge hiding, deviance, and objectively recorded team-level stress-related absenteeism. In Soulmates: Resurrecting Eve, Juliana Geran Pilon argues for a return to an egalitarian view of men and women, found in the original Genesis narrative, as reflected through Judaism, Christianity, and Islam. In each of these Abrahamic traditions, it was understood that man and woman were created to be soulmates in God's image—equal despite their different functions within society. Pilon writes that this original message has gradually been distorted, with disastrous effect. Any hope for an ennobling human community begins (...) by resurrecting Eve as an equal partner to Adam. The work examines the Biblical creation narrative, comparing it to Greek and other ancient mythologies. Pilon explains how the disturbing association of woman with sin and death led to Eve's demise as Adam's equal. The final section of the work deals with the Goddess myth, love and marriage in early religious narratives, and modern man's search for his soul no less than for a soulmate. The book, at its core, is a meditation on the relationship between men and women but also among human beings. The resurrection of Eve is indispensable to attaining a true appreciation of love and faith. Pilon uses religious texts, expert commentary, and various works of fiction, poetry, and psychology to make her argument come alive. The work is strengthened by the writing style, alternately poetic and humorous, and a clear and illuminating progression of ideas. Its emphasis on reconciliation and understanding, and its post-feminist outlook will find a receptive audience. (shrink)

ABSTRACT Are indexical beliefs necessary to explain intentional bodily actions? De se believers argue that we cannot explain intentional bodily actions unless we appeal to indexical beliefs. De se sceptics disagree. Joining the sceptics, Cappelen and Dever have recently advanced a counterexample to de se believers's claim: a case of intentional bodily action that can be explained by their proposed indexical-free Action Inventory Model. In this paper, I argue that the de se sceptics's counterexample ultimately does not work. My argument (...) suggests that AIM cannot explain any intentional bodily action, including the alleged counterexample, because it violates two principles of action-explanation. These principles suggest that an identificational element found only in indexical beliefs is necessary to motivate intentional action. (shrink)

In 1956, as a young art critic, the Mexican philosopher Juliana González first encountered the paintings of the Spanish surrealist Remedios Varo at the artist’s breakthrough solo exhibition in Mexico City’s Galería Diana. González, greatly impressed, soon befriended the much older Varo and became a regular visitor to her studio, where they talked about her paintings and their shared intellectual interests in literature, psychoanalysis, and philosophy, a conversation that ended with Varo’s untimely death in 1963 at age 54. A (...) few years later, González contributed this essay-homage to the 1966 catalog Remedios Varo. She opens with an evocation of Varo’s masterpiece, the triptych To the Tower, Embroidering the Earth’s Mantle and The Escape —a magnet for viewers at the recent “Surrealism Beyond Borders” exhibition in New York and London—and finds in it keys to the artist’s life and to her attempts through art “to flee this inexorable order toward another reality.” González’s close examination of the contradictions and ambiguities in Varo’s artistry, of “her wise, poetic humor,” and of her quest “to comprehend the universe” remains an essential read almost 60 years later. The catalog in which it first appeared is long out of print, and, to the best of my knowledge, González’s essay has never been republished in Spanish, making the text that follows as much an act of recovery as it is a translation. Histories of psychoanalysis largely respect the boundaries drawn by the psychoanalytic profession, suggesting that the development of psychoanalytic theories and techniques has been the exclusive remit of professionally trained analysts. In this article, I offer an historical example that poses a challenge to this orthodoxy. Based on extensive archival material, I show how British psychiatric social workers, a little-studied group of specialist mental hygiene workers, advanced key organisational, observational, and theoretical insights that shaped mid-century British psychoanalysis. In their daily work (...) compiling patient histories, conducting home visits, and interviewing the parents of ‘maladjusted’ children, psychiatric social workers were uniquely positioned to expose the importance of family relationships in the development of childhood neuroses. As this article details, their analytic attention to these dynamics not only influenced, but fundamentally constituted the innovative research on maternal-child relationships and family therapy pioneered by eminent psychoanalyst John Bowlby. In addition, psychiatric social workers produced and published independent psychoanalytic research, and fiercely debated the limitations of analytic concepts such as transference. In presenting the relationship between British psychiatric social work and psychoanalysis, this article suggests a new way of telling the history of both. (shrink)

During the second half of the 19th century, in the field of physiological optics, there was a strong controversy between Hermann von Helmholtz and Ewald Hering. This controversy has been usually characterized as “empiricism” vs. “nativism”. In the field of physiology of visual perception, several subjects demanded attention, among them, color vision. Helmholtz and Hering suggested different theories for the physiological correlate of color sensation and different color spaces to give an account of the relationships between colors. In this article, (...) I will argue that the controversy between the two authors could be understood as differences between styles of reasoning, and these different styles express different presuppositions. More specifically, I want to suggest that the disagreements could be linked to the discussions on how vital phenomena should be studied. (shrink)

In this paper I identify two different lockean concepts of justice - "proprietary justice" and "justice as fairness" - and examine the relationship between each of them and charity in John Locke´s theory of property. As I try to show, in both cases Locke considers that charity may have priority over justice. This undermines the classical interpretation of Locke as a defender of unlimited capitalistic appropriation and provides additional evidence supporting Locke´s acceptation of a minimal redistributive system which should guarantee (...) the material welfare of non-appropriators. We suggest in this paper that the practice of philosophy with children can be fruitfully understood as an example of a transindividual system. The adoption of the term ‘transindividuality’ serves two main purposes: it allows us to focus on individuation as a process and at the same time to problematise some of the classical antinomies of Western philosophy that continue to inform our understanding of the relation between individuality and community. Sexual violence against women is an issue of urgency that arises in all cultures locally, nationally, globally and transnationally. This problem has broad dimensions in both the public and private domains, both cases that are reported or not reported to law enforcement. Factually, the trend of this problem has been identified as increasing every year in Maluku, Indonesia. Therefore, the church requires serious attention to prevention and systematic treatment to overcome it. This sensitivity and awareness are a manifestation of the (...) church’s sense of calling and responsibility for the restoration of human dignity. The pastoral sermon service model is the church’s strategic approach to handling this problem. This research aimed to develop a model of pastoral sermons for victims of sexual violence against women in Maluku. This research focused on identifying and exploring the tragic experiences and impacts of sexual violence against women. Furthermore, a cross-cultural pastoral model was created for victims of violence.Contribution: This article provided a new perspective from the post-modern homiletics to approach social issues. This new homiletical approach to dealing with the problem of women’s sexual violence is one of the main focuses of ‘Women’s Theological Studies’ in HTS. (shrink)

Doctoral students are a group that is prone to experiencing mental health problems during their study period which provides an overview of their psychological well-being. Generally, the psychological problems that arise in this group are anxiety, depression, and some physical problems. This study basically aims to understand the psychological well-being of doctoral students through an analysis of the concepts related to psychological well-being, how it is measured, and what factors are often connected and influence it. The method used is scoping (...) review with PRISMA-Scr 2020. Articles were obtained from 4 databases namely Scopus, EBSCO, Web of Science, and ScienceDirect. There were 9 articles that were filtered based on certain inclusion and exclusion criteria. The results of this study found that the most frequently used concept to describe the psychological well-being of doctoral students is the subjective well-being of Diener (1984) and Ryff (1989). In addition, the presence/absence of psychological problems is also used as a basis for describing their psychological well-being. Psychological health measurement usually uses SWLS and SPANE from Diener and a psychological health questionnaire from Ryff. Some of the factors identified as related to psychological well-being are relationships with supervisors, research self-efficacy, perfectionism, achievement orientation, and family support. In addition, impostor syndrome and psychology capital (PsyCap) function as mediator variables. (shrink)

Despite the various perceptual-motor deficits documented in strabismus, there is a paucity of studies evaluating visual illusions in patients with strabismus. The aim of this study was to examine how the illusionary perception occurs in children/adolescents with strabismus with referral for surgery to correct ocular deviations. A controlled cross-sectional study was carried out in which 45 participants with strabismus and 62 healthy volunteers aged 10–15 years were evaluated. The behavioral response to three geometric illusions [Vertical-Horizontal illusion, Müller-Lyer illusion and Ponzo (...) illusion] and respective neutral stimuli regarding the estimation of image size and response time were measured using the Method of Adjustment. To analyze the influence of secondary factors: type of ocular deviation ; amount of eye deviation; presence of amblyopia and stereopsis, a one-way ANOVA was performed. Among the tested illusions, children with strabismus showed greater susceptibility and response time to Ponzo’s illusory images. Children with strabismus and preserved stereopsis, on the other hand, showed similar susceptibility and response time to control group patients to the Ponzo illusion. Patients with amblyopia showed overcorrection in the estimate of non-illusory Ponzo images. Children with horizontal ocular deviation associated with vertical deviation showed higher susceptibility to vertical adjustment images for the Müller-Lyer illusion. Individuals with strabismus tended to overcorrect the length of the straight-line segment adjusted for non-illusory images when testing non-illusory images in the Müller-Lyer test, as well as for the neutral images in the Vertical-Horizontal test. The findings indicated impairment in the perception of geometric illusions and neutral figures, especially for the Ponzo illusion test by children with strabismus. As the behavioral response to illusory images may indirectly reflect the visual and morphofunctional alterations present in these individuals, we suggest that the investigation of visual illusory perception can be used as a new research strategy in the field of investigating the visual function in strabismus. Background: This study developed a photo and video database of 4-to-6-year-olds expressing the seven induced and posed universal emotions and a neutral expression. Children participated in photo and video sessions designed to elicit the emotions, and the resulting images were further assessed by independent judges in two rounds. Methods: In the first round, two independent judges, experts in the Facial Action Coding System, firstly analysed 3,668 emotions facial expressions stimuli from 132 children. Both judges reached 100% agreement regarding 1,985 stimuli, (...) which were then selected for a second round of analysis between judges 3 and 4. Results: The result was 1,985 stimuli were produced from 124 participants. A Kappa index of 0.70 and an accuracy of 73% between experts were observed. Lower accuracy was found for emotional expression by 4-year-olds than 6-year-olds. Happiness, disgust and contempt had the highest agreement. After a sub-analysis evaluation of all four judges, 100% agreement was reached for 1,381 stimuli which compound the ChildEFES database with 124 participants and 51% induced photographs. The number of stimuli of each emotion were: 87 for neutrality, 363 for happiness, 170 for disgust, 104 for surprise, 152 for fear, 144 for sadness, 157 for anger 157, and 183 for contempt. Conclusions: The findings show that this photo and video database can facilitate research on the mechanisms involved in early childhood recognition of facial emotions in children, contributing to the understanding of facial emotion recognition deficits which characterise several neurodevelopmental and psychiatric disorders. This paper investigates a reference to the voice of the legendary musician Orpheus in Plato’s Protagoras. I propose that the Orpheus image does serious philosophical work in the text. Understanding the mythic and religious elements of the Orpheus tradition can help us conceptualize the harms of sophistry from a Platonic viewpoint. In the light of the image, the sophist emerges as a quasi-magical manipulator of rhetorical beauty who charms his students into subrational creatures. Furthermore, the image provides insight into Plato’s (...) conception of the difference between sophistic and Socratic education. Playing on the tradition of Orpheus as (failed) psychopomp, I suggest that the sophist employs a descent-style education which holds students captive in an underworld of glamorous but empty sensibles. In sharp contrast, Socratic ascent-style education pulls students upwards to active contemplation of ultimate reality. (shrink)

Resumo: Este estudo objetiva identificar a natureza de verdade por Agostinho de Hipona (354-430), segundo as reflexões contidas no VII Livro da obra Confissões (397) que trata da Busca da Verdade. Para isso, é necessário reconhecer quais percursos o bispo de Hipona percorreu em sua vida terrena, bem como sua vivência filosófica. Nesse itinerário em busca da verdade se envolveu com o maniqueísmo, que em certa medida apresentava uma verdade racional e material, perspectiva que se aproximava do pensamento de Agostinho (...) na sua fase de juventude. Conforme foi amadurecendo intelectualmente e buscando compreensões das questões que permeiam a vida humana pode-se depreender o seu projeto de formação cristã, uma vez que, ao criticar o modo como conduzia sua vida pregressa (anterior à conversão) e evidenciar as mudanças em seus atos cotidianos para se adequar à forma de vida de um bom cristão, o autor explicita um projeto de educação e de sociedade que conduza aos bens eternos e imutáveis. The itinerary of Augustine of Hippo in search of the truth and its Christian formation project Abstract: This study aims to identify the nature of truth by Augustine of Hippo (354-430), according to the reflections contained in the VII Book of the work Confessions (397) which deals with the Search for Truth. For this, it is necessary to recognize which paths the Bishop of Hippo took in his earthly life, as well as his philosophical experience. In this itinerary in search of the truth, he became involved with Manichaeism, which, to a certain extent, presented a rational and material truth, a perspective that was close to the thought of Augustine in his youth. As he matured intellectually and sought understanding of the issues that permeate human life, his project of Christian formation can be inferred, since, by criticizing the way he led his former life (prior to conversion) and highlighting the changes in his acts to adapt to the way of life of a good Christian, the author explains a project of education and society that leads to eternal and immutable goods. Para ello, es necesario reconocer qué caminos tomó el obispo de Hipona en su vida terrena, así como su experiencia filosófica. En este itinerario en busca de la verdad, se involucra con el maniqueísmo, que, en cierta medida, presenta una verdad racional y material, perspectiva cercana al pensamiento de Agustín en su juventud. Uma das abordagens que estuda o construto da motivação é a teoria da autodeterminação, que discrimina diferentes estilos motivacionais: desmotivação, motivação extrínseca e motivação intrínseca. Este estudoobjetivou identificar motivações de acadêmicos de um curso de Educação Física do estado São Paulo, Brasil, para participarem de uma capacitação em natação para pessoas com deficiência físicas, bem como a motivação para atuação como tutores desse mesmo grupo. Trata-se de um estudo qualitativo realizado por meio de entrevistas semiestruturadas. Participaram 20 acadêmicos do curso (...) de Educação Física,divididos em: capacitação teórica – CT e capacitação teórica associada a tutoria em natação adaptada-CTP. Após análise, as seguintes categorias e subcategorias foram estabelecidas: motivação extrínseca (objetivos ou ganhos futuros; decorrente de fatores externos e vinculada à recompensa ou punição) e desmotivação (sentimentos e percepções). Conclui-se que os principais fatores que motivaram os acadêmicos estiveram vinculados à motivação extrínseca. (shrink)

Este breve texto esboça algumas ideias básicas da Filosofia Ecológica, enfatizando a importância e o valor de tais idéias para o estudo da mente e da consciência. Estas considerações levam à formação de uma abordagem ecológica, e o que, aqui, denomino Filosofia Ecológica. Em particular, a Filosofia Ecológica oferece uma saída às confusões e contradições que são comuns ao pensamento acadêmico dominante no que se refere à mente e à consciência.

Purpose: The main aim of this study was to examine the influence of organizational culture on strategy implementation in Kenya Government Tourism Agencies. Materials and Methods: The study used a positivist approach research philosophy. The research designs employed in this study were explanatory and descriptive research designs. The study population comprised of the tourism industry. The study included the ministry of tourism itself since it is the parent ministry that regulates and oversees the operations of the tourism agencies to give (...) a total of 10 areas of study. A sample of 327 was achieved based on the following formula. This study used primary data. The study used questionnaires and interview guides to collect both qualitative and quantitative data. Quantitative data was analyzed through scientific methods using the statistical package for social sciences (SPSS version 22) while qualitative data was analyzed thematically. The descriptive statistics was first used to analyze the demographic factors of the respondents using frequencies and charts. Inferential statistics such as correlation and multiple linear regression analysis were used to test the relationship among the variables as per the study hypothesis. Findings: The culture of an organization was found to play a critical role in implementation of strategies and consequently realizations of set objectives and profits in organizations. Organizational norms, ethics, employee training and organizational climate are very key in achieving success while implementing strategies. Implications to Theory, Practice and Policy: It is recommended that organizations (tourism industry) create strategy implementation promoting culture, culture of timeliness, innovative culture, ethics and one which promotes team spirit. These aspects of culture need to be reinforced and strengthened to ensure implementation of strategies is smooth and quick enough. This study thus bridges the gap between theory and practice, offering a nuanced understanding of the interplay between organizational culture and strategy implementation in a critical sector for Kenya's economy. O presente artigo busca problematizar as questões acerca da produção de uma Base Nacional Comum para a Formação Inicial de Professores da Educação Básica, BNC-Formação, (BRASIL, 2019) que ancora a formação docente no Brasil em uma concepção de resolução de problemas e voltada apenas para a aplicabilidade de um currículo como previsto na BNCC. Na perspectiva brasileira de inacabamento do sujeito proposto por Paulo Freire (1992, 2009,2010) e compondo uma compreensão de formação permanente descrita por Gaston Pineau (1985, 2003) buscamos (...) refletir como esse modelo descola à docência para uma posição de subalternidade, no qual as trajetórias dos profissionais são inviabilizadas e padronizadas. Neste sentido, fundamentado no pressuposto do ciclo de políticas de Stephen Ball (2011), buscamos compreender os pareceres números um e dois publicados em 2019 como um modelo prescritivo de formação de professores, como previsto por Ivor Goodson (1995, 2004), ainda que focando apenas nos dois primeiros momentos de ciclo de políticas do autor: os contextos de influência e de produção do texto, pois trata-se um movimento recente, uma vez que sua concretização vislumbra sua finalização dos currículos no ano corrente. O que observamos com a análise apresentada é uma proposta de formação que remonta os modos de um caminho prescritivo da docência pelo qual a formação docente está deslocada da vida e da proposição da formação permanente que tem o indivíduo como um sujeito formado pela (auto)formação – (hetero)formação – (eco)formação em diálogo com a sua história de vida. In this article; I put forward an instrumental justification for the introduction of youth quotas in parliaments on grounds of justice between coexisting generations. I provide a two-fold argument drawing on the distinction between “substantive representation” and “symbolic representation”. I argue that these jointly provide a good basis for a “politics of youth presence” in parliaments. In the first section; I evaluate the impact that youth quotas can have on enhancing the chances of fair youth policies. In the second section; (...) The difficulties faced in the recruitment and retention of nursing staff in nursing homes for older people are an international challenge. It is therefore essential that the causes of nurses’ reluctance to work in these settings are determined. This paper considers the influence that multiple‐source care funding issues have on nursing home nurses’ experiences and views regarding the practice and appeal of the role. The methodology for this study was hermeneutic phenomenology. Thirteen nurses from seven nursing homes in the North (...) East of England were interviewed in a sequence of up to five interviews and data were analysed using a literary analysis method. Findings indicate that participants are uncomfortable with the business aspects that funding issues bring to their role. The primary difficulties faced are: tensions between care issues and funding issues; challenges associated with ‘selling beds’; and coping with self‐funding residents’ changing expectations of care. The findings of the study suggest that multiple‐source care funding systems that operate in nursing homes for older people pose challenges to nursing home nurses. Este artigo objetiva descrever e analisar as legislações urbanísticas brasileiras ao longo dos séculos XX e XXI, com foco nas leis que regulamentam o parcelamento e o uso do solo. Reconhecemos a origem dessas leis que têm orientado e normatizado o espaço urbano nas últimas décadas, principalmente no que diz respeito aos parâmetros urbanísticos estabelecidos para o desenvolvimento das cidades. Assim, o artigo é apoiado em uma abordagem dialética e qualitativa, este estudo busca realizar uma análise dos referenciais teóricos, além (...) de dados obtidos por meio de pesquisa documental. Neste artigo analiso a interpretação de Aron Gurwitsch sobre a noção de noema, a qual se mostra como um dos mais complexos e controversos conceitos na teoria husserliana da intencionalidade. Tal leitura, que ficou conhecida como interpretação neo-fenomenalista, apresenta uma tentativa de afastar a fenomenologia dos modos tradicionais de idealismo. Demonstro, no entanto, que apesar da originalidade e dos diversos aspectos interessantes da análise de Gurwitsch – tal como a inserção de elementos da Gestalt –, sua interpretação falha em compreender (...) de modo adequado o pensamento de Husserl, acabando por afastar o filósofo lituano da fenomenologia transcendental. O objetivo geral deste artigo é fomentar reflexões filosóficas acerca da presença e dos sentidos da virilidade na sociedade capitalista, especialmente no momento atual em que figuras autoritárias revelam-se fortemente presentes no cenário político do Brasil. Para tanto, este trabalho toma como pano de fundo a filosofia existencialista de Simone de Beauvoir e sua proposta de uma moral da ambiguidade fundamentada na ação pela qual o indivíduo assume-se como sujeito e objeto em seu desvelamento do mundo e na relação com (...) o outro. Os tipos identificados por Beauvoir em atitudes inautênticas que derivam do medo de assumir essa ambiguidade bem como a própria liberdade, e as noções de reciprocidade e generosidade são elementos fundamentais para o desenvolvimento deste trabalho. No que concerne à virilidade, a proposta de fomento da reflexão é desdobrada também com a sugestão de diálogo entre Beauvoir e os autores Max Horkheimer e Herbert Marcuse e a autora Claudine Haroche. Desenhada a noção de virilidade e sua relação com a lógica agressiva do sistema capitalista e com a construção das categorias de Homem e Mulher respectivamente enquanto Um e Outro, por fim, apontamos, pela discussão acadêmica no campo da filosofia e também por uma construção poética da letra de música, que foge ao nosso rigor da pesquisa, imagens que, pelo erotismo e por aspectos positivos de um contrauniverso, oposto ao masculino, revelem possibilidades de abalarmos as engrenagens da virilidade e as estruturas que esta sustenta. El artículo aborda el antagonismo jurídico entre la acción de lesividad y su procedencia frente a actos administrativos regulares e irregulares en Ecuador, enfocándose en la tensión entre las resoluciones de la Corte Constitucional y la Corte Nacional. El problema radica en la aplicación de la acción de lesividad, especialmente en casos donde los actos administrativos presentan vicios de legalidad como fue el caso de la sentencia No. 030-18-SEP-CC. El objetivo es analizar las discrepancias jurisprudenciales y sus implicaciones en la (...) seguridad jurídica a través del principio de legalidad. El método utilizado es no experimental y explicativo, con un enfoque cualitativo basado en análisis documental y bibliográfico. Se examina la validez de los actos administrativos, los fundamentos doctrinales e históricos de la acción de lesividad, y la legislación comparada. Los hallazgos indican una falta de consenso entre las Cortes sobre la aplicabilidad de la acción de lesividad en actos administrativos irregulares. Mientras la Corte Constitucional favorece la seguridad jurídica del administrado, al permitir la acción de lesividad incluso en actos irregulares, la Corte Nacional sostiene que solo debe aplicarse en actos regulares o con vicios convalidables. Las conclusiones destacan la importancia de una interpretación coherente y uniforme de la ley para garantizar la seguridad jurídica. Esta investigación contribuye al entendimiento del derecho administrativo en Ecuador, ofreciendo una perspectiva crítica sobre la coexistencia de reglas jurisprudenciales y la práctica administrativa. Preliminary approximations between the singular–particular–universal dialectics and the historical-critical pedagogical theory are elaborated in this paper, based on the exposition of the categories of singularity, universality and particularity articulated to the demands that the materialistic historical-dialectical method places as a condition for the production of knowledge capable of apprehending reality in its concreteness. It is argued that historical-critical pedagogy carries in its formulation the movement of these categories, formulating notes related to the concept of educational work, the problem of the (...) curriculum and the subject towards which is directed the pedagogical act. Demonstrating that the categories of singular, particular and universal enable multiple analytical movements in the field of school education is one of the purposes of the analysis that is developed along the paper. Em 1646, o médico inglês Thomas Browne (1605-1682) publicou a obra enciclopédica, de inspiração baconiana, Pseudodoxia Epidemica, também conhecida como Vulgar Errors. Browne Nela abordou o que seriam erros disseminados sobre vários temas, incluindo concepções sobre os animais. Ele explicou a origem de cada concepção. Discutiu ideias e observações de outros autores e, em muitos casos, apresentou seus experimentos e observações. Tomou como decisivo o testemunho ocular. Apresentamos uma tradução contextualizada e comentada do Capítulo 1 do Livro III do Pseudodoxia.

El objetivo de este texto es analizar cómo la obra de Iris Murdoch dialoga con la de Martha Nussbaum en cuanto a la relación entre las artes narrativas y la moralidad. En particular, investiga la importancia de la experiencia artística e imaginativa en la constitución de la moralidad. Para llevar a cabo este análisis, la presentación sigue tres pasos principales: en primer lugar, una breve investigación de las consideraciones de Murdoch sobre la relación entre la moral y las artes narrativas; (...) a continuación, se presenta el mismo tema en la obra de Nussbaum y, por último, se examinan algunos acuerdos y desacuerdos entre las filósofas, buscando problematizar cuestiones más generales sobre las diferencias entre las concepciones de la filosofía moral presentes en sus obras. O texto consiste em uma tradução do artigo Penser l’après : Sciences, pouvoir et opinions dans l’après Covid-19 escrito pela professora e filósofa de ciências Bernadette Bensaude-Vincent. A tradução foi autorizada pela autora e sua eventual publicação deve seguir as diretrizes do jornal The Conversation, no qual o artigo foi originalmente publicado. A partir das medidas implementadas mundialmente para o combate ao coronavírus, a autora analisa o vínculo entre as comunidades científicas e o governo. A gestão da crise sanitária, segundo (...) Bensaude-Vincent, baseia-se não só em dispositivos atuais, mas recorre a um modelo bastante arcaico: o confinamento generalizado. A diferença, segundo a filósofa, estaria no fato de hoje tal medida visar a salvar, sobretudo, o sistema hospitalar. Tal contexto nos remete a imagens de um passado que se considerava superado, lançando, assim, uma dúvida sobre o vínculo entre ciências e poder das últimas décadas. Os interesses locais, políticos, econômicos, religiosos e mesmo os interesses e valores dos próprios pesquisadores mostram-se, por vezes, incompatíveis com o “dever do ceticismo organizado que resta como um dos grandes princípios do éthos científico”. Daí a desconfiança do público que, por sua vez, é reduzido ao silêncio por pertencer ao inferior âmbito da doxa. A ideia de uma hierarquia na ordem do conhecimento que estabelece a opinião como um saber inferior não é nova, no entanto, segundo a autora, para os antigos isso não implicaria, como atualmente, uma hierarquia política. Bensaude-Vincent convoca, assim, a reabilitação dos "saberes de campo não científico como fontes de invenção e de soluções" em regime, como o nosso, de incerteza. (shrink)
