This thesis demonstrates that by redefining the notion of nationhood and by treating nations and national minorities equally with respect to self-determination, it is possible to formulate basic principles of the international legal system, which would promote territorial integrity and stability of multinational states better than the existing system. I demonstrate that theories dealing with self-determination based solely on human rights or cases of secession address the problem with inadequate tools. I also show that minority-rights approaches (...) do not accommodate self-determination claims of national groups properly. ;I offer a new idea of nationhood as a political culture of self-determination with which people self-identify. It includes beliefs about co-nationals' mutual membership in a political community, which is perceived by them as having a self-determining power. Definitions of nationhood which use the notion of culture, but not political culture, are both too inclusive---they fail to distinguish between national and ethnic groups, and too exclusive---they overlook multicultural nations. ;Contested secession has received much attention in recent scholarship. Since, however, contested secession is based upon the disagreement of two or more national groups concerning their self-determination within particular boundaries, I consider secession within the scope of a systematic approach to the regulation of relations among national groups. I propose that international legal principles should be based upon the recognition of states and national groups as the two basic elements of the international system, and the equal recognition of nations as political cultures of self-determination. I interpret self-determination as a claim to equality within the boundaries a multinational state, and formulate a criterion of minimal justice for states. It requires that states respect equality of self-determination of national groups on their territory. National groups can secede from multinational states either by mutual agreement, or if their they are persistently denied a status with respect to self-determination equal to that of other national groups. Self-control is considered broadly important for many domains of life. One of its unfortunate features, however, is that it tends to wane over time, with little agreement about why this is the case. Recently, there has been a push to address this problem by looking to the literature in exercise physiology, specifically the work on the central governor model of physical fatigue. Trying to explain how and why mental performance wanes over time, the central governor model suggests that exertion (...) is throttled by some central nervous system mechanism that receives information about energetic bodily needs and motivational drives to regulate exertion and, ultimately, to prevent homeostatic breakdown, chiefly energy depletion. While we admire the spirit of integration and the attempt to shed light on an important topic in psychology, our concern is that the central governor model is very controversial in exercise physiology, with increasing calls to abandon it altogether, making it a poor fit for psychology. Our concerns are threefold. First, while we agree that preservation of bodily homeostasis makes for an elegant ultimate account, the fact that such important homeostatic concerns can be regularly overturned with even slight incentives (e.g., a smile) renders the ultimate account impotent and points to other ultimate functions for fatigue. Second, despite the central governor being thought to take as input information about the metabolic needs of the body, there is no credible evidence that mental effort actually consumes inordinate amounts of energy that are not already circulating in the brain. Third, recent modifications of the model make the central governor appear like an all-knowing homunculus and unfalsifiable in principle, thus contributing very little to our understanding of why people tend to disengage from effortful tasks over time. We note that the latest models in exercise physiology have actually borrowed concepts and models from psychology to understand physical performance. (shrink)

This Article is a socio-legal analysis of the California State Bar lawyer discipline system. The article draws on legal professions theory, legal ethics, legal history, and cultural analysis, and it is based on archival data, interviews with State Bar actors, and empirical data on the Bar's disciplinary system. The article examines the historical and cultural context of a perceived crisis in California State Bar lawyer discipline in the 1980s and 1990s and concludes that, while the crisis stemmed from (...) demonstrable organizational ineffectiveness in the lawyer discipline system of the State Bar, it also needs to be understood as part of a larger--and recurring--crisis of professionalism in the legal profession.The article also examines the Bar's response to the discipline crisis and argues that, contrary to the bar's harshest critics (and critical professions theory), the reforms initiated by the Bar and imposed by the state legislature improved the lawyer disciplinary system in California. Nevertheless, the article concludes that organizational and structural factors identified in this study limit the effectiveness of any system of lawyer self-regulation. (shrink)

Be for "Beauty, Beneficience, Bread, Bleeding, Blemishes."1 By associating the first letter with the initial vowel of a word, generations of eighteenth-century readers, students, and observers diligently regulated access to information they (...) reputed worth retaining. Following this rule, they organized the notes they took on a certain subject, the thoughts and observations they believed were worth remembering, and the exemplary words of their favorite authors. The rule was devised by John Locke for his "new method of making commonplace-books," a method characterized by a particular system for indexing the entries of a notebook that became popular in the eighteenth century. Before Locke developed his new method readers had already familiarized themselves with the practice of keeping an account of their readings, excerpting passages of texts, and copying them in their notebooks under a relevant heading. Throughout the early modern period commonplace books provided repositories for arranging notes, excerpts, drawings, and objects.2 Regarded as aids to memory and storehouses of knowledge, they were part of a pedagogic tradition related to rhetoric and the art of memory that dated back to the classical period. Reducing vast amounts of knowledge to a [End Page 603] manageable form, they instantiated a special relationship between the accumulation of knowledge and the organization of space. At the turn of the eighteenth century Locke's new method promised to facilitate compilers' task by providing a new way of accumulating multum in parvo at a time of increasing concern for the uncontrollable growth of the "Stock of Knowledge."3 It did so by seeking to increase the amount of information one could annotate in the notebook, while also speeding up its retrieval. Many eighteenth-century compilers relied on it in order to reduce the volume of their notebooks and save time. Some were lured by the promise that this technique could also help them to order their minds and thus turn them into better people.Although commonplace books have dropped out of usage today, they were still mentioned in nineteenth-century educational manuals. The structure of everyday language implies that knowledge is an object. Like an object, it can be acquired, lost, stored, retrieved, and used. Anything that might be done to an external object could also be done to knowledge. Using concepts from the emerging field of biofunctional cognition, this paper discusses an alternative to the everyday-language framework of knowledge. The central idea is that the biological subsystems that comprise the physical nervous system have the capacity to create in us a (...) live, as opposed to pre-recorded, experience that might be described as intuitive self-awareness. In its various manifestations, this ongoing intuitive self-awareness is what we recognize as the knowledge inside us. There is no storage of knowledge of any kind. Intuitive self-awareness is in a perpetual state of re-creation and change. It serves as a private language with which the individual interacts directly with the subsystems of his/her own nervous system. This is the primary function of intuitive self-awareness &emdash; serving as the vehicle for the private communication between the individual and the individual's nervous system. Intuitive self-awareness has also come to serve, through evolutionary symbolic adaptation, as the foundation for the public language that the individual uses to communicate with other individuals. This is the secondary function of the intuitive self-awareness &emdash; to serve as the vehicle for public communication within social groups in which the individual lives. In this function, intuitive self-awareness externalizes to manifest itself in the form of an indirect code system for public communication. There is quite a bit of disagreement in cognitive science regarding the role that consciousness and control play in explanations of how people do what they do. The purpose of the present paper is to do the following: (1) examine the theoretical choice points that have lead theorists to conflicting positions, (2) examine the philosophical and empirical problems different theories encounter as they address the issue of conscious agency, and (3) provide an integrative framework (Wild Systems Theory) that addresses these (...) problems and potentially naturalizes conscious agency. It does so by grounding conscious and control in the notion of self-sustaining energy-transformation systems (i.e., living systems), versus computational or self- organizing systems, as is the case in information processing theory and dynamical systems theory, respectively. Given its assertion that content (and consciousness) emerges in self-sustaining systems, Wild Systems Theory may also provide a sound theoretical basis for a science of consciousness in general. This paper applies crip theory (McRuer, 2006, 2018) as well as other key conceptual tools from disabled childhood studies (Runswick-Cole et al., 2018) and disability studies in education (Cousik & Maconochie, 2017) as a tactic intended to question and resist the story of overcoming as it manifests itself within the discourses and practices of self-regulation in early learning classrooms. This paper offers a brief overview of the range of self-regulation strategies enacted within educational settings in Ontario, (...) Canada, that purport to support young children in overcoming themselves on their way to normalcy. This paper also engages in crip theory as a strategy to both question and disrupt the taken for granted assumption that self-regulation entails a return towards or a sustaining of the efficient and productive neoliberal individual in school systems. Finally, this paper considers how we might not only invite but embrace the disruptions that occur when embodied differences refuse to be overcome by demands to self-regulate. Ultimately, a key aim of this paper is to resist how discourses and practices of self-regulation in Early Childhood Education and Care (ECEC) establish the overcoming narrative as a means to cure, fix or exclude embodied differences while contemplating the vibrant possibilities embedded within learning with and from disabled childhoods. Purpose This paper reviews the origins of the Ethics Council of the Federation of Social Communication Media of Chile and looks into the historical circumstances surrounding its creation, the concept of self-regulation as understood by its founders, and the criteria that initially ruled its operation. Design/methodology/approach A qualitative survey of nine contemporary witnesses and the confrontation with the scientific literature. Findings The results reveal a significant coincidence with the academic literature both in the description of the concept of (...) self-regulation and in the origin of the ethics councils and of the system under which they operate. However, a series of nuances not usually considered in the concept of self-regulation are described. Originality/value This study will help assess the national and international possibilities of self-regulation and the significance of the Chilean ethics council. (shrink)

With the Freudian system these factors vaguely appear, but their form is badlydefined and their delineation incomplete. The criticism of the three systems may be summarised as follows:—that of James is lacking in content, i.e. of the sentiments, while that of McDougall is more (...) in line with a simple self concept than that of a complete personality system and hence is lacking in organisation. That of Freud, while possessing some features in common with that of McDougall appears naive and undeveloped. By combining the systems of the first-mentioned pair, a final system may be obtained, whichmore completely explains personality than any one of them. (2)According to this final system the main features of personality consist of:— (a)A basic system of instincts which tends to operate independently as personality phases; among these first fear, and later, submission and self assertion act as regulative factors. The former of this pair is inhibitive in its general effect on conduct, the latter accentuating it. (b)From a combination of instinctive tendencies focussed upon mental objects the sentiments develop. Like sentiments are grouped into a more or less defined entity styled a social self,this self being a product primarily of a particular environment. More than one social self tends to exist side by side in the same personality, each self retaining a specific set of moral sanctions of its own. Social selves may be independent and contradictory in their “mores” if there exist no overlap of common factors in apperception systems, sentiments and will attitudes. (c)At adolescence a rational process begins. Abstract sentiments and ideal personalities develope, and in place of social authority there is substituted the approbation or disfavour of anideal community existent in the mind of the subject; this forms the background of the promptings of conscience. An ethical code finally emerges whichis more or less universal in its applications. This development may be designated a rational, spiritual, or ethical self, and it acts as a unifying influence upon the social selves by legislating for opposed sanctions, and thus affording a final court of appeal in the case of conflict. Hence it becomes the crowning development of a unified personality. A clarification of the terms “self” and “personality” is thus afforded, whereby the term “self” is regarded as a phase of the latter. (shrink)

Flow is a state of full task engagement that is accompanied with low-levels of self-referential thinking. Flow is considered highly relevant for human performance and well-being and has, therefore, been studied extensively. Yet, the neurocognitive processes of flow remain largely unclear. In the present mini-review we focus on how the brain's locus coeruleus-norepinephrine (LC-NE) system may be involved in a range of behavioral and subjective manifestations of flow. The LC-NE system regulates decisions regarding task engagement vs. disengagement. (...) This is doneviadifferent modes of baseline and stimulus-evoked norepinephrine release. We emphasize the theoretical and empirical overlap between the LC-NE system and flow. For both, a match between a person's skill and task challenge is important in order to induce high levels task-related attention. Moreover, psychophysiological indicators of LC-NE system activity, such as eye pupil diameter and arousal are also sensitive to flow states. Flow is related to arousal in an inverted U-shape. Similarly, in theories on the LC-NE system, task engagement is highest with intermediate levels of arousal. We argue that knowledge about the role of the LC-NE system in establishing the flow experience may help to gain fundamental knowledge of flow and can contribute to unifying various empirical findings on this topic. Self-regulated learning is critical for learning across tasks, domains, and contexts. Despite its importance, research shows that not all learners are equally skilled at accurately and dynamically monitoring and regulating their self-regulatory processes. Therefore, learning technologies, such as intelligent tutoring systems, have been designed to measure and foster SRL. This paper presents an overview of over 10 years of research on SRL with MetaTutor, a hypermedia-based ITS designed to scaffold college students’ SRL while they learn about the human (...) circulatory system. MetaTutor’s architecture and instructional features are designed based on models of SRL, empirical evidence on human and computerized tutoring principles of multimedia learning, Artificial Intelligence in educational systems for metacognition and SRL, and research on SRL from our team and that of other researchers. We present MetaTutor followed by a synthesis of key research findings on the effectiveness of various versions of the system on learning outcomes. First, we focus on findings from self-reports, learning outcomes, and multimodal data and their contributions to our understanding of SRL with an ITS. Second, we elaborate on the role of embedded pedagogical agents as external regulators designed to scaffold learners’ cognitive and metacognitive SRL strategy use. Third, we highlight and elaborate on the contributions of multimodal data in measuring and understanding the role of cognitive, affective, metacognitive, and motivational processes. Additionally, we unpack some of the challenges these data pose for designing real-time instructional interventions that scaffold SRL. Fourth, we present existing theoretical, methodological, and analytical challenges and briefly discuss lessons learned and open challenges. (shrink)

The governance of nanotechnology seeks to limit its risks, without constraining opportunities. The literature on the effectiveness of approaches to governance has neglected approaches that impact directly on the behavior of a researcher. We analyze the effectiveness of legal regulations versus regulation via self-commitment. Then, we refine this model by analyzing competition and autonomy as key contingency factors. In the first step, qualitative interviews with nanotechnology researchers are conducted to reflect this model. In the second step, its empirical (...) relevance is tested using a survey of 90 nanotech researchers. The results indicate that legal regulations, as well as self-commitment to an informal CoC reduce the scope of behavior. Finally, that competition and autonomy affect the relative strength of these governance factors. (shrink)

The latest academic discussion has focused on the potential and risks associated with technological systems. In this perspective, defining a set of legal rules could be the priority but this action appears extremely difficult at the European level and, therefore, in the last years, a set of ethical principles contained in many different documents has been published. The need to develop trustworthy and human-centric AI technologies is accomplished by creating these two types of rule sets: legal and ethical. The paper (...) aims to critically analyse and compare these rule sets in order to understand their possible relationships in the regulation of legal problems, not only theoretically but also, where present, in some practical applications of AI, such as self-driving cars, smart toys, smart contracts and legal design. Indeed, the purpose is to identify how legal rules and ethical principles can interact for adequate regulation of AI, with particular regard to the fields of application that will be analysed. The research analyzes the process of formation of the ethics committee as a new institution in the system of regulation of genetic research. The external factors of this process are the increasing digitalization of medical and research practices, as well as the special situation that is developing in the field of genomic research and the use of genetic technologies, where issues of philosophy, jurisprudence and administration have generated many fundamentally new, and sometimes unexpected contexts. The author shows the (...) similarity and difference of approaches to the inclusion of the ethics committee in the national regulatory systems of different countries and determines the prospects for further integration of the new institution into normative and administrative-regulatory and law enforcement practices. The research applies all the main methods of system analysis and structural and functional analysis, as well as the comparative legal method. At the stage of generalization of empirical material, the author turns to the means and methods of philosophical phenomenology and phenomenological sociology. The study revealed that the ethics committee may have different institutional and regulatory functions in a variety of management and legal systems. Being hybrid in nature, the ethics committee performs various functions, and in various state legal systems and traditions it can combine elements of legislative, executive and judicial power. At times, the ethics committee may go beyond the scope of both a purely administrative and exclusively legal regulator. All this indicates that the integration of this institution into the legal system and into a variety of social practices is far from being completed. (shrink)

This article analyzes some aspects of the modern Ukrainian values, including religion and religiosity in the system of values and priorities in life. It describes the relationship between religious self-identification and some of their values and philosophical positions. It is concluded that the primary value in contemporary Ukrainian society, regardless of religious self-identify, is a family. Having faith is a kind of internal moral and ethical code. According to empirical indicators of people who consider themselves believers, they (...) are more responsible towards institute of family. Individuals with certain religious beliefs, compared to non-believers are more negative towards social issues such as bribery, using office, prostitution, homosexuality, drug addiction and have higher moral expectation for their own behavior. A previous speaker has compared man's earth with communal quarters. The comparison makes its point but is probably not quite exact. If one were to look for a more accurate simile of the same nature, one might say that mankind is now living in a bus following an exponential highway. In front of it looms either an insurmountable hill or a chasm, and the passengers on the bus see the future through the prism of their emotional mood. Some insist that (...) it stop and that they move into caves, while others urge ascent into outer space or placing hopes on the "perhaps" of self-regulation. These extreme points of view have in common the fact that they are based on a feeling of hopeless helplessness. Terrestrial caves are not much better than those in outer space, while existence on other cosmic bodies requires not only the creation of an earthly environment in the ordinary meaning of the word but of artificial gravitation as well, or else the weakened muscles would be unable to support the mortal bodies of the "lunatics" and "martians." To stop dead or slow things down with a yellow light is also impossible. To stop is the equivalent of death or vegetating anabiotically, since natural systems cannot function under conditions approximating idling speed. (shrink)

An increasing amount of very diverse scholarship self-identifies as belonging to the field of neuroethics, illuminating a need to provide some reference points for what that field actually entails. We argue that neuroethics is a single field with distinct perspectives, roles, and subspecialties. We propose that—in addition to the three traditional perspectives delineated by Eric Racine—a fourth, socio-political perspective, must be recognized in neuroethics. The socio-political perspective in neuroethics focuses on the interplay between the behavioral as well as the (...) brain sciences and the socio-political system; this interplay includes social regulation in addition to all other realistic elements of social and political neurodiscourses. Thus, defining what—if any—roles the socio-political perspective in neuroethics might have is a pressing issue. Doing so could provide guidance for defining the criteria for prospective ethical evaluations in neuroethics. A promising approach to doing this could be by describing the roles of neuroethics in terms of the more concrete examples of the roles of political philosophy in general, as in the tradition of John Rawls. We take klotho, the supposed “longevity protein,” as a modern neuroethics case to exemplify the obstacles faced in securing neuroethics’ legitimacy and how the Rawlsian framework we propose may be applied to handle cases such as this. Ultimately, the socio-political perspective in neuroethics should not be swayed by the media hype and ought to offer useful ethical guidance and articulation of genuine ethical concerns to policy makers and the public alike. Living systems employ several mechanisms and behaviors to achieve robustness and maintain themselves under changing internal and external conditions. Regulation stands out from them as a specific form of higher-order control, exerted over the basic regime responsible for the production and maintenance of the organism, and provides the system with the capacity to act on its own constitutive dynamics. It consists in the capability to selectively shift between different available regimes of self-production and self-maintenance in response (...) to specific signals and perturbations, due to the action of a dedicated subsystem which is operationally distinct from the regulated ones. The role of regulation, however, is not exhausted by its contribution to maintain a living system’s viability. While enhancing robustness, regulatory mechanisms play a fundamental role in the realization of an autonomous biological organization. Specifically, they are at the basis of the remarkable integration of biological systems, insofar as they coordinate and modulate the activity of distinct functional subsystems. Moreover, by implementing complex and hierarchically organized control architectures, they allow for an increase in structural and organizational complexity while minimizing fragility. Finally, they endow living systems, from their most basic unicellular instances, with the capability to control their own internal dynamics to adaptively respond to specific features of their interaction with the environment, thus providing the basis for the emergence of minimal forms of cognition. This article explores the cooperation of government and the private sector to tackle the ethical dimension of artificial intelligence. The argument draws on the institutionalist approach in philosophy and business ethics defending a ‘division of moral labor’ between governments and the private sector. The goal and main contribution of this article is to explain how this approach can provide ethical guidelines to the AI industry and to highlight the limits of self-regulation. In what follows, I discuss three institutionalist (...) claims. First, principles of AI ethics should be validated through legitimate democratic processes. Second, compliance with these principles should be secured in a stable way. Third, their implementation in practice should be as efficient as possible. If we accept these claims, there are good reasons to conclude that, in many cases, governments implementing hard regulation are in principle the best instruments to secure an ethical development of AI systems. Where adequate regulation exists, firms should respect the law. But when regulation does not yet exist, helping governments build adequate regulation should be businesses’ ethical priority, not self-regulation. (shrink)

The globalization movement in recent decades has meant rapid growth in trade, financial transactions, and cross-country ownership of economic assets. In this article, we examine how the globalization of national business systems has influenced the framing of corporate social responsibility (CSR). This is done using text analysis of CEO letters appearing in the annual reports of 15 major corporations in Sweden during a period of transformational change. The results show that the discourse about CSR in the annual reports has changed (...) from a national and communitarian view of social responsibility (cf. a negotiated view of CSR) toward an international and individualistic view of social responsibility (cf. a self-regulating view of CSR). The article contributes theoretically (1) by adding a national–global dimension to previous conceptualizations of CSR and (2) by showing that the rise of CSR discourse and activities in the last 10 years does not have to imply an increased commitment and interest in corporate responsibility per se, only that there are increased societal expectations that corporations should develop the capability to act more independently as moral agents. Passionate human behavior should be regulated by moral instructions, teaching and practices. For explaining the issue, Rene Descartes in The Passions of the Soul and the Hindu traditions of Sāṁkhya are here considered. These two systems provide fourdimensional physical, mental/moral and spiritual descriptions of human nature and a mechanism of regulating passions. The first two parts of the paper are focused on the nature of human beings, its holistic and integrative character, and on understanding emotional behavior. The next two parts (...) describe moral ways used to regulate passions on the basis of Samkhya’s eight steps, i.e., reasoning, hearing, studying, Pramod, Mudita̅and Modma̅n, respect and gratitude. Descartes’ concept of generosity as a basis of the inculcation of virtues like self-esteem, veneration, hope, courage and bravery, selfsatisfaction, is also analyzed. In conclusion, the relevance of the aforementioned mechanismis presented at the individual and social levels. (shrink)

Much has been written about the self, yet its evolution and functioning are matters of controversy in evolutionary psychology. The article argues that it is an evolved capacity, essential for co-evolutionary processes, including cultural development, to occur. A model of self-regulation is offered to explain its adaptive functioning, elaborating William James’ I-me distinction, and drawing upon contemporary analyses in social psychology and neuroscience. The model is used to illustrate how adaptive behavior is facilitated by the exercise of (...) self-control, to defer and re-order goals, revise perceptions of the world, modify conceptions of the self, and alter repertoires of learned action sequences, heuristics, and habits. It also identifies potential areas of dysfunction, mediated by self-deception and misperception. Through this lens one can see how leadership is a historically co-evolving function of social systems, changing to meet altered circumstances. The recursive relationship involves interaction between changing leader–follower relationships, within which leaders’ self-regulation is a central process. Individual differences in leaders as agents are thus also critical. The article concludes by considering the need for insight in order to steer these co-evolving functions in directions that help us as a species to master the global challenges and threats we face in our times. The relationship between brain and mind has been extensively explored through the developments within neuroscience over the last decade. However, the ontological status of mind has remained fairly problematic due to the inability to explain all features of the mind through the brain. This inability has been considered largely due to partial knowledge of the brain. It is claimed that once we gain complete knowledge of the brain, all features of the mind would be explained adequately. However, a challenge to (...) such a position is downward causation: How do we explain the causal power that mental states exert over brain activities? If we agree that downward causation occurs, then to what extent could a sole explanation of brain activities account for our behaviour? (For they would in themselves be conditioned by the mental states which are left unexplained). This dissertation is an attempt to understand relation between brain and mind through the concept of emergence, placed in the context of complex systems approach. This will create a space to account for the causal power of mental states. The complex systems approach says that as the complexity of a system increases, we witness the emergence of novel qualities and after a certain threshold (of complexity), the emergence of a novel structure. When the body (and correspondingly, brain) reaches a certain level of complexity, the mind emerges. The brain is a complex system from which the mind emerges. The brain, consisting of billions of neurons interacting with each other, regulates the body placed in the environment. The interaction of neurons (local interactions involving self-organization) result in dynamical brain signatures (global synergy). Such signatures are correlative to mental states. Mind is the process of a living organism embodying an intentional stance. This object could be the subject itself or another distinct from the subject. With the emergence of mind, the causal powers of brain are conditioned by the mind. Such a conditioning is evident through the causal efficacy of mental states. While the brain is minimal condition for the mind to emerge, the mind in itself is embedded (showcased/explicated/manifested) throughout the body. The mind is a process that belongs to body-as-a-whole with the novel quality of intentionality. A preliminary to understanding this relation is its metaphysical inclination. A large portion of the history of philosophy of mind has advocated a metaphysics of entities where the mind and body have been seen as two entities with distinct essences. However, such attribution of entity-ship does not take into account the processual nature of these existents (that they are essentially dependent on their environment for their existence and sustenance). Thus, the category of processual unity has been introduced which sought to account for existent as emergent wholes that move towards a stable equilibrium through self-organization. By considering existents to be processual unities, we can account for their identity as a whole-in-itself (what has been called organizational closure) and also for their processual nature. The brain is a component of the body which is a complex system and is representative of the body’s stance in the world. The brain, consisting of billions of neurons interacting with each other, regulates the body placed in the environment. The interaction of neurons (local interactions involving self-organization) result in dynamical brain signatures (global synergy). Such signatures are correlative to mental states. These mental states in turn condition the brain patterns, that allows the embodying of mental states. Thus, the three-way process of the representation of body in the world by the brain, the emergence of mental state through dynamic brain patterns and the reciprocal causal power on the brain patterns by the mental states marks embodiment. The relation between brain, body and mind can be outlined as follows: A. There are complex interactions in the brain. These interactions are representative of the body’s stance in the world and are present in form of dynamical brain signatures. B. The dynamical brain signatures lead to emergence of mind as a process. The mental state has causal power which conditions the brain. C. The brain conditioned by causal power of the mind carries out embodiment of the mind throughout the body. In the dissertation, an exposition on relation between brain and mind through complex system approach is followed by a brief on relation between body and mind. The radical embodiment approach adopts the nonlinear dynamic systems theory to understand relation of brain, body and mind. It states a shift from mapping of cognitive states onto Neural Correlates of Consciousness to their mapping through dynamic brain signatures. Every mental state is embedded throughout the body. The dissertation explores the three features of consciousness, intentionality and qualia. These have previously formed a challenge within a dualistic framework and the dissertation intends to show a direction in which they can be accounted for, within the complex systems approach and radical embodiment viewpoint. After a certain threshold of the rate of production of cell assemblies is bypassed, we become conscious of the representation itself. This leads to emergence of phenomenal states. Qualia is the qualitative character of such states, which belong to the body-as-a-whole and for this reason, cannot be reduced to properties of any of the components from which it emerges (the dynamic brain signatures) or in which it is embodied (the body and its individual parts) alone. Intentionality is the novel property of mind of moving towards a certain set of attractors where attractors refer to the states that the system prefers (which would positively contribute to its fitness). The scope of this dissertation is to delineate the relation of brain to the mind and unravel some persistent troubles of philosophy of mind within such delineation. The types of components and their relation within the mind preceded by a thorough study of how the mind is embodied is an area yet to be extensively explored in the coming works. (shrink)

Self-regulation, or the ability to effectively manage emotions and behavior, is a critical skill to develop in early childhood. Children living in a context of economic hardship are at an increased risk for developing self-regulation difficulties. However, few studies have comprehensively examined how multiple aspects of the caregiving environment, including fathers’ parenting and coparenting quality, may contribute to child self-regulation. Thus, this study applied a family systems perspective to examine whether coparenting and resident and (...) non-resident fathers’ reports of parenting quantity and quality were associated with observations of children’s self-regulation. Participants were drawn from the Embedded Developmental Study of the Three-City Study, a longitudinal study of children and families facing economic hardship. At Wave 1, when children were 2–4 years old, reports of parenting and coparenting were obtained. At Wave 2, when children were 3–6 years old, children participated in a snack delay and gift wrap task, which assessed their self-regulation. Multi-group path analyses indicated that resident fathers’ harsh parenting at Wave 1 predicted decreased levels of self-regulation at Wave 2. Non-resident fathers’ reported hours of involvement at Wave 1 predicted greater levels of self-regulation at Wave 2. Additionally, supportive coparenting among families with a non-resident father predicted greater self-regulation. Supportive coparenting was not associated with child self-regulation in families with a resident father. The implications for research focused on facilitating positive father–child relationships in diverse family contexts are discussed. (shrink)

Philosophers routinely invoke self‐control in their theorizing, but major questions remain about what exactly self‐control is. I propose a componential account in which an exercise of self‐control is built out of something more fundamental: basic intrapsychic actions called cognitive control actions. Cognitive control regulates simple, brief states called response pulses that operate across diverse psychological systems (think of one's attention being grabbed by a salient object or one's mind being pulled to think about a certain topic). (...) class='Hi'>Self‐control ostensibly seems quite different because it regulates complex, temporally extended states such as emotions and cravings. But critically, these complex states also exhibit important componential structure: They rely on response pulses as a key means by which they bring about action. The overall picture is that self‐control consists of skilled sequences of cognitive control directed against extended streams of response pulses that arise from states such as emotions and cravings, thus preventing these states from being effective in action. The account clarifies the “atoms” of self‐control—the elemental units that get combined in complex ways to produce different kinds of self‐control actions. Surprisingly, the account, which is derived from research in cognitive science, aligns nicely with the commonsense conception of self‐control. (shrink)

After presenting Apostel’s views on scientific realism, I present definitions of the concepts of ontology and metaphysics. I then proceed to develop Apostel’s basic ontology and his metaphysics. Apostel proposed a particular understanding of existence based on his views on causation. He also developed a view of the universe as a causal self-explaining system. I discuss and illustrate three kinds of what he calls “metaphysical deductions” that aim to deliver such a view of the universe. The monograph presents the ideas about the main changes that occurred in the development of technologies from the emergence of Homo sapiens till present time and outlines the prospects of their development in the next 30–60 years and in some respect until the end of the twenty-first century. What determines the transition of a society from one level of development to another? One of the most fundamental causes is the global technological transformations. Among all major technological breakthroughs in history the (...) most important are three production revolutions: 1) the Agrarian Revolution; 2) the Industrial Revolution; and 3) the Cybernetic one. The book introduces the theory of production revolutions which is a new valuable explanatory paradigm that analyzes causes and trends of dramatic shifts in historical process. The authors describe the course of technological transformations in history and demonstrate a possible application of the theory to explain the present and forthcoming technological changes. They analyze the technological shifts which took place in the second half of the twentieth and early twenty-first centuries and forecast the main shifts in the next half a century. On this basis the authors present a detailed analysis of the latest production revolution which is denoted as ‘Сybernetic’. They make some predictions about its development in the nearest five decades and up to the end of the twenty-first century and show that the development of various self-regulating systems will be the main trend of this revolution. The authors argue that the transition to the starting final phase of the Cybernetic Revolution (in the 2030–2040s) will first occur in the field of medicine (in some its innovative branches). In future we will deal with the started convergence of innovative technologies which will form the system of MANBRIC-technologies (i.e. the technological paradigm based on medicine, additive, nano- and bio- technologies, robotics, IT and cognitive technologies). Living systems employ several mechanisms and behaviors to achieve robustness and maintain themselves under changing internal and external conditions. Regulation stands out from them as a specific form of higher-order control, exerted over the basic regime responsible for the production and maintenance of the organism, and provides the system with the capacity to act on its own constitutive dynamics. It consists in the capability to selectively shift between different available regimes of self-production and self-maintenance in response (...) to specific signals and perturbations, due to the action of a dedicated subsystem which is operationally distinct from the regulated ones. The role of regulation, however, is not exhausted by its contribution to maintain a living system’s viability. While enhancing robustness, regulatory mechanisms play a fundamental role in the realization of an autonomous biological organization. Specifically, they are at the basis of the remarkable integration of biological systems, insofar as they coordinate and modulate the activity of distinct functional subsystems. Moreover, by implementing complex and hierarchically organized control architectures, they allow for an increase in structural and organizational complexity while minimizing fragility. Finally, they endow living systems, from their most basic unicellular instances, with the capability to control their own internal dynamics to adaptively respond to specific features of their interaction with the environment, thus providing the basis for the emergence of minimal forms of cognition. The article is devoted to the study of the development patterns of the local government system in the Russian Federation. The submission to the State Duma of the Russian Federation of the draft Federal Law «On the general principles of the organization of local self-government in the unified system of public authority» in December 2021 means the preparation of a new stage of municipal reform and makes it relevant to study long-term changes in the institutional organization of (...) local self-government. The purpose of the study is to analyze changes in the structure of local self-government bodies and the rules of their formation at each stage of the development of this institution, as well as to identify the main patterns of this process. The analysis of the legislative base regulating the structure and rules of formation of local self-government bodies has been carried out. The data related to the development of the local government system provided by the Ministry of Justice of the Russian Federation were analyzed. It is shown that the structure of local self-government bodies has not undergone significant changes. However, there have been changes in the ways of forming local self-government bodies, which reflect the trend towards their loss of institutional independence and integration into a single system of public power. This trend appeared at the stage of implementation of the Federal Law on Local Self-Government in 2003 and was consolidated in the new Draft law on Local self-government submitted to the State Duma of the Russian Federation in 2021. It is concluded that there is a tendency to increase the dependence on federal and regional legislators of local self-government bodies. For the institute of heads of municipalities, the loss of institutional independence was clearly manifested by the introduction of the procedure for electing heads by competition, displacing both election at municipal elections and election from the Council of Deputies. The formation of representative bodies, having passed the stage of delegating deputies to higher levels, returns to the model of direct elections. However, this happens in the context of the rejection of a two-tier system of local self-government. (shrink)

_The Children of Light and the Children of Darkness_, first published in 1944, is considered one of the most profound and relevant works by the influential theologian Reinhold Niebuhr, and certainly the fullest statement of his political philosophy. Written and first read during the prolonged, tragic world war between totalitarian and democratic forces, Niebuhr’s book took up the timely question of how democracy as a political system could best be defended. Most proponents of democracy, Niebuhr claimed, were “children of (...) light,” who had optimistic but naïve ideas about how society could be rid of evil and governed by enlightened reason. They needed, he believed, to absorb some of the wisdom and strength of the “children of darkness,” whose ruthless cynicism and corrupt, anti-democratic politics should otherwise be repudiated. He argued for a prudent, liberal understanding of human society that took the measure of every group’s self-interest and was chastened by a realistic understanding of the limits of power. It is in the foreword to this book that he wrote, “Man’s capacity for justice makes democracy possible; but man’s inclination to injustice makes democracy necessary.” This edition includes a new introduction by the theologian and Niebuhr scholar Gary Dorrien in which he elucidates the work’s significance and places it firmly into the arc of Niebuhr’s career. The principal focus of this paper is to consider the implications of head and neck transplantation surgery on the issue of personal identity. To this end, it is noted that the immune system has not only been established to impose a level of self-identity on bodily cells, it has also been implicated in mental development and the regulation of mental state. In this it serves as a paradigm for the mind as the product of cephalic and extracephalic (...) systems. The importance of bodily systems in identity is then discussed in relation to phantom tissue syndrome. The data strongly indicate that, even if surgically successful, head and neck transplantation will result in the loss of the continuity of personal identity. (shrink)

In 1986, President Reagan created the Packard Commission, a blue-ribbon commission to investigate defense contracting procurement fraud. The Packard Commission''s major recommendation was for defense contractors to adopt ethics programs. Out of this recommendation emerged the Defense Industry Initiative (DII). This paper examines this Initiative and focuses on the DII''s six principles. In particular, this paper explores the implications the DII has had with respect to (1) pursuing intra-industry cooperation and setting industry-wide standards; (2) monitoring compliance; (3) the paradox inherent (...) to the DII as a facilitator for industry self-regulation; and, (4) why companies have enthusiastically adopted the directive. This paper concludes that the DII falls short of being an effective method of self-regulation because: (1) it does not achieve complete industry-wide cooperation; (2) it does not establish uniform standards of ethical conduct within the industry; (3) it does not hold the signatory companies accountable for creating a strong system of ethical conduct; and, (4) it does not relieve the organizational and market pressures to be unethical. The paper focuses on concerns and legal challenges brought on by the use of algorithms. A particular class of algorithms that augment or replace analysis and decision-making by humans, i.e. data analytics and machine learning, is under scrutiny. Taking into account Balkin’s work on “the laws of an algorithmic society”, attention is drawn to obligations of transparency, matters of due process, and accountability. This US-centric analysis on drawbacks and loopholes of current legal systems is complemented with the analysis of norms (...) and principles of the EU data protection law, or “GDPR”. The aim is twofold. On the one hand, the intent is to shed light on some crucial differences between the US and EU law on the regulation of algorithmic operators, both public and private. Whereas, in the USA, scholars debate whether and to what extent new duties and responsibilities of algorithmic operators, e.g. information fiduciaries, have to amend the current framework of self-regulation and light government—as shown by the White House’s Office of Science and Technology Policy report from November 2016—in EU law much of the new duties and responsibilities of algorithmic operators have been passed upon them as data controllers. Whether such approaches will successfully tackle the normative challenges of the algorithmic society is, on the other hand, an open issue that will likely represent the main topic of debate over the next years. Disagreement may concern: the terms framing the legal question in e.g. statistical purposes of the data processing; how such terms are related to each other in legal reasoning ; and legal hard cases that will increasingly have to do with the principles that are at stake also but not only in data protection. By entrusting such legal hard cases to algorithms, or some sort of smart artificial agent, humans still bear full responsibility for the judgment of what is socially, ethically, and legally “plain” and “hard” in social affairs. The balance between delegation of decisions to algorithms and non-delegation will be the leitmotiv of the algorithmic society. The article brings to light the use of recommender systems as technologies of the self, complementing the observations in current literature regarding their employment as technologies of ‘soft’ power. User practices on the music recommendation website last.fm reveal that many users do not only utilize the website to receive guidance about music products but also to examine and transform an aspect of their self, i.e. their ‘music taste’. The capacity of assisting users in self-cultivation practices, however, is (...) not unique to last.fm but stem from certain properties shared by all recommendation systems. Furthermore, unlike other oft-studied digital/web technologies of the self which facilitate ‘self-publishing’ vis-à-vis virtual companions in social media, recommender algorithms themselves can act as ‘intimate experts’, accompanying users in their self-care practices. Thus, recommendation systems can facilitate both algorithmic control and creative self-transformation, which calls for a theorization of this new cultural medium as a space of tension. (shrink)

Much of the legal literature discusses regulation and regulatory forms with a seemingly implicit assumption that "those to be influenced" are inherently self-interested and thus motivated to comply with legal structures only when there are sufficient external incentives to do so. This view of the person is inconsistent with recent perspectives in the field of psychology. A law and morality perspective, coupled with insights from the field of psychology, asserts that influence, compliance, and motivation are far more complex (...) than this legal literature would suggest. In this Article, we map the varying influence structures, motives, psychological needs, emotional mechanisms, and levels of moral reasoning that various forms of regulation, from hard law to soft law, might appeal to. We provide examples from global banking and one soft law initiative, the Equator Principles, to illustrate reasons psychology would suggest why soft law may be more effective in some circumstances in influencing behavior within the firm than hard law, while recognizing important limits to such influence. Modes of rationality in nursing documentation: biology, biography, and the ‘voice of nursing’ This article is based on a discourse analysis of the complete nursing records of 45 patients, and concerns the modes of rationality that mediated text‐based accounts relating to patient care that nurses recorded. The analysis draws on the work of the critical theorist, Jürgen Habermas, who conceptualised rationality in the context of modernity according to two types: purposive rationality based on an instrumental logic, and value rationality based (...) on ethical considerations and moral reasoning. Our analysis revealed that purposive rationality dominated the content of nursing documentation, as evidenced by a particularly bio‐centric and modernist construction of the workings of the body within the texts. There was little reference in the documentation to central themes of contemporary nursing discourses, such as notions of partnership, autonomy, and self‐determination, which are associated with value rationality. Drawing on Habermas, we argue that this nursing documentation depicted the colonisation of the sociocultural lifeworld by the bio‐technocratic system. Where nurses recorded disagreements that patients had with medical regimes, the central struggle inherent in the project of modernity became transparent — the tension between the rational and instrumental control of people through scientific regulation and the autonomy of the subject. This work identifies the influence of chaos theory on fractional calculus by providing a theorem for the existence and stability of solution in fractional-order gyrostat model with the help of a fixed-point theorem. We modified an integer order gyrostat model consisting of three rotors into fractional order by attaching rotatory fuel-filled tank and provided an iterative scheme for our proposed model as a working rule of obtained analytical results. Moreover, this iterative scheme is injected into algorithms for a system (...) of integer order dynamical systems to observe Lyapunov exponents and a bifurcation diagram for our proposed fractional-order dynamical model. Furthermore, we obtained five equilibrium points, including four unstable spirals and one saddle node, using local dynamical analysis which acted as self-exciting attractors and a separatrix in a global domain. The ‘virtue as skill’ thesis is gaining traction lately both in virtue ethics and virtue epistemology, and a significant part of that is due to Julia Annas’s work in reviving this thesis from the ancient Greeks.2 As Annas has argued, “[t]he intuitive appeal of the ancient skill analogy for virtue rests on the idea that one practical activity – acting well – is like another prominent practical activity, working well.”3 I will be adding to the development of the ‘virtue as (...) skill’ thesis, by grounding an account of skill within the larger framework of the psychological research on self-regulation, as skill acquisition is essentially a sophisticated form of self-regulation. The present article reviews modern research on the psychology of emotion regulation. Emotion regulation determines the offset of emotional responding and is thus distinct from emotional sensitivity, which determines the onset of emotional responding. Among the most viable categories for classifying emotion-regulation strategies are the targets and functions of emotion regulation. The emotion-generating systems that are targeted in emotion regulation include attention, knowledge, and bodily responses. The functions of emotion regulation include satisfying hedonic needs, (...) supporting specific goal pursuits, and facilitating the global personality system. Emotion-regulation strategies are classified in terms of their targets and functions and relevant empirical work is reviewed. Throughout this review, emotion regulation emerges as one of the most far-ranging and influential processes at the interface of cognition and emotion. (shrink)

The perception of behavior as a moral or conventional concern can be influenced by contextual variables, including status and power differences. We propose that social processes and in particular social role enactment through the exercise of power will psychologically motivate moralization. Punishing or rewarding others creates a moral dilemma that can be resolved by externalizing causation to incontrovertible moral rules. Legitimate power related to structure and position can carry moral weight but may not influence the power holder’s perceptions of rules (...) and general norms of behavior. Social identity theory suggests moralization could be promoted by a concern for shared, defining values. However, the tendency to moralize another’s behavior can be injurious to shared identity. We explored white-collar employees’ perceptions of several categories of noxious or deviant workplace behaviors and regressed these perceptions on the tendency to use legitimate, referent, or reward and punish power; social identity; and the interaction of social identity and power, in particular legitimate power. Only the tendency to influence others through punishment or reward predicted moralization. Alternative causal explanations for the findings were addressed through the absence of any relationships between punishment and reward power and perceptions of deviant behaviors as wrong, upsetting, or requiring punishment. We discuss these results in the context of self and social processes, the social construction of morals and power, and the impact of managers’ behavior on group or organizational ethics. (shrink)

The article substantiates that science, thanks to the latest media in the dissemination of scientific communication (especially computer word processing, big data accumulation, mega-science installations, the latest international networking platforms and collaborations), has gone beyond all institutional, organizational, regional, national and partly disciplinary borders. Science as a supranational communication system has reached a complexity that is incompatible with the standards for evaluating scientific work and scientific achievements, which are traditionally carried out in the form of scientific committees, individual examinations (...) and other collegial forms of scientific communication. The collegiality of making the most important decisions regarding the examination of the scientific product itself, the thematic agenda, professional competencies and the resulting distribution of remuneration, reputation, ranks, degrees, grants has exhausted its capabilities to a certain extent. As a result, science turns out to be opaque both for the regulator, who is trying to exercise control over scientific institutions, and for science itself, which in the form of scientific self-government and philosophical reflection of science carries out the function of self-observation and self-description. A working hypothesis is proposed, which states that in response to this crisis of collegiality, reflection and control, new media of communicative success and new organizational forms of scientific communication crystallize in science, which can restore the ability of a scientific system to process its internal and external complexity. These media are represented by a new, social-networked form of scientific expertise and partly scientific work, which will be able to compensate for the lack of self-reflection, both at the organizational level of research institutes and at the level of global control over science as a whole. Dorpat personalism school starts its metaphysical inquary with the question of existence and analyzes the concept of subject through immediate self-consciousness as the basis of existence. As representatives of a school of critically-oriented thinkers, personalists develop new insights based on critical evaluation of preceding philosophical systems, emphasizing the importance of the history of philosophy. Therefore, to determine what is understood by the immediate self-consciousness as the basis of personality in metaphysics of personalism, this paper will describe personalist criticism (...) of Leibniz’s doctrine of monads. In the introduction, I briefly outline personalism tendencies in philosophy and describe the Dorpat personalism school. The first part of the paper describes personalism philosophy and Leibniz’s metaphysics, emphasizing the importance of immediate self-consciousness. The second part describes the distinction of the types of existence in personalism and consistency that follows, relating them to immediate self-consciousness. This paper proposes an account of the self as a multilevel system consisting of social, individual, neural, and molecular mechanisms. It argues that the functioning of the self depends on causal relations between mechanisms operating at different levels. In place of reductionist and holistic approaches to cognitive science, I advocate a method of multilevel interacting mechanisms. This method is illustrated by showing how self-concepts operate at several different levels.

This paper discusses the development of self-consciousness in the history of philosophy of the 20th century compared with the same development in the natural sciences. The author characterizes this stage of philosophical historiography as the “revolution of relativity.” This movement of self-consciousness was apparent in not only the humanities but also the natural sciences at the turn of the 19th and 20th centuries. Awareness of probability is a fundamental achievement of non-classic physics, which has since reversed its paradigm. (...) In contrast to the Newtonian scheme, quantum theory introduces the category of probability and insists that we can talk about certain physical phenomena only in a probabilistic mode and that the method of observation affects the phenomena observed. Consequently, any “object-subject” and “subject-subject” interaction involves the experience of the researcher, which thereby affects the results. The same model of interpretation lies at the basis of the turn toward self-consciousness in the history of philosophy of the 20th century. The classical history of philosophy is built on idealization and gives an objective description of the philosophical process. Following the other sciences, the philosophy of the 20th century understood that historical and philosophical reality largely depends on the historians of philosophy; that such reality is constructed by certain means; that there is a certain kind of historical and philosophical work; and that, with different strategies, methods and approaches, we obtain different results that are complementary to each other. The 20th century was a time of competing interpretations rather than gradually progressing historical and philosophical systems. This stimulated the search for own ideal of objectivity. For philosophical historiography, this is the hermeneutic ideal of the structural analysis of text or architectonic reconstruction. The historicalphilosophical revolution of relativity promotes the development of critical historiography and revises the foundations of its classical tradition. (shrink)

The paper examines the issue of corporate social responsibility against the backdrop of its self-regulatory posture. Using the African experience as a case study, the paper observes that the activities of multinationals show very clearly that they are grossly irresponsible despite their professed self-regulation. Instead, the multinationals have created an image of terror due to their deep-rooted involvements in human rights abuses, environmental degradation, tax evasion, bribery, market manipulation, and other forms of unethical practices, notwithstanding their so-called (...) self-regulation. The paper concludes by advocating the establishment of a broad-based United Nations Global Business Regulatory Agency to fully take charge of corporate regulation in the global business terrain. Cognitive models of depression posit that persistent negative self-referent thinking (PNSRT) is an important vulnerability factor for depressive symptoms. The mechanisms involved are still understudied, especially in adolescence. PNSRT has been assessed by a behavioural decision-making task, namely the emotional reversal learning task (ERLT). Within the ERLT, PNSRT is operationalised as the learning rate for negative self-reference. The first aim of the current study is to examine the association between PNSRT and depressive symptoms at baseline and follow-up. Second, (...) the current study investigated associations of PNSRT with temperamental and emotion regulation variables. We found no significant effect between PNSRT and baseline depressive symptoms, although the small effect size pointed in the expected direction. No significant prospective effect was found. Additionally, adolescents with greater capacity for response inhibition and better attentional control exhibited less PNSRT. No other significant associations were found with other temperamental dimensions or emotion regulation variables. In conclusion, while the small effect size of the cross-sectional association between PNSRT and depressive symptoms points in the expected direction, no significant evidence was found that PNSRT acts as either a concomitant or precursor to depressive symptomatology. However, the current study did find a relation between low effortful control and PNSRT. (shrink)

There is in Hegel’s Phenomenology of Spirit a relatively brief passage at the beginning of Chapter IV, “Self-Consciousness,” which may well be one of the most difficult passages in the whole Hegelian corpus, but which is also of supreme importance for coming to grips with the movement of Hegel’s thought, not only in the Phenomenology but in the entire “system.” It is precisely the difficulty of the passage, it would seem, that explains why it has not been given (...) by commentators an attention proportionate to its significance. So much attention has been focused on the “independence of self-consciousness,” expressed in the sections on “Lordship and Bondage,” “Stoicism and Skepticism” and “The Unhappy Consciousness” — which are, it is true, important and which lend themselves most readily to extended interpretation — that not enough attention has been given to the introductory section, entitled “The Truth of the Certainty of Self,” in which are enunciated the principles which regulate the whole movement of Hegel’s thought. The section might be described as the indispensable transition from those forms of consciousness, which are merely “objective” yet try to give themselves off as authentic knowing, to what Hegel considers to be the only possible way of authenticating the objectivity of human consciousness, i.e., the self, which claims to know, progressively coming to know itself, a self-knowing which will be knowing at all only if it culminates in “absolute knowing.” Only in the light of this section will the preface be intelligible; only in its light will the whole of the Phenomenology hang together. Both law and medicine rely on self-regulation and codes of professionalism to ensure duties are performed in a competent, ethical manner. Unlike physicians, however, judges are lawyers themselves, so judicial oversight is also self-regulation. As previous literature has highlighted, the hesitation to report a cognitively-compromised judge has resulted in an “opensecret” amongst lawyers who face numerous conflicts of interest.Through a case study involving a senior judge with severe cognitive impairment, this article considers the unique ethical dilemmas (...) that cognitive specialists may encounter when navigating duties to patient, society, and the medical profession, without clear legal guidance.Systemic self-regulatory inadequacies in the legal profession are addressed, as well as challenges that arise when trying to preserve the trust and dignity of an incapacitated patient who must fulfill special duties to society.Ultimately, because of their unique neurological expertise and impartial assessments, we submit that allowing cognitive specialists to submit their assessments to an internal judiciary board may act as an additional check and balance to ensure the fair and competent administration of justice. The introductory personal remarks refer to my motivations for choosing research projects, and for moving from physics to molecular biology and then to development, with Hydra as a model system. Historically, Trembley’s discovery of Hydra regeneration in 1744 was the begin¬ning of developmental biology as we understand it, with passionate debates about preformation versus de novo generation, mechanisms versus organisms. In fact, seemingly conflicting bottom-up and top-down concepts are both required in combination to understand development. In modern terms, this (...) means analysing the molecules involved, as well as searching for physical principles underlying development within systems of molecules, cells and tissues. During the last decade, molecular biology has provided surprising and impressive evidence that the same types of mol¬ecules and molecular systems are involved in pattern formation in a wide range of organisms, including coelenterates like Hydra, and thus appear to have been “invented” early in evolution. Likewise, the features of certain systems, especially those of developmental regulation, are found in many different organisms. This includes the generation of spatial structures by the interplay of self-enhancing activation and “lateral” inhibitory effects of wider range, which is a main topic of my essay. Hydra regeneration is a particularly clear model for the formation of defined patterns within initially near-uniform tissues. In conclusion, this essay emphasizes the analysis of development in terms of physical laws, including the application of mathematics, and insists that Hydra was, and will continue to be, a rewarding model for understanding general features of embryogenesis and regeneration. -/- -/- .
