Archaeologists employed in governmental positions often deal with issues that produce conflicts between their professional duties to their employer, their ethical responsibilities to the resource, and their obligations as established by legislation. The paper examines some of the conflicts imposed on governmental archaeologists by each of these systems but focuses on the conflicts imposed by federal legislation and regulations on governmental archaeologists, using “Kennewick Man” as an example.

Assumptions about what it is to be human are implicit in most philosophical reflections upon ethical and epistemological issues. Although such assumptions are not usually elaborated into a comprehensive theory of human nature, they are nonetheless influential in beliefs about what kinds of problem are worthy of consideration, and in judgments about the adequacy of proposed solutions. Claims to the effect that one should not be swayed by feelings and loyalties in the making of moral decisions, for example, presuppose that (...) human beings are creatures whose nature is amenable to guidance by reason rather than emotion and are creatures capable of living well when they act as impartially as possible. Analogously, claims to the effect that knowledge, to merit that title, should be acquired out of independent cognitive endeavour uncluttered by opinion and hearsay, suggest that human beings are creatures who can come to know their environment through their own unaided efforts. And claims to the effect that knowledge, once acquired, is timelessly and universally true depend upon assumptions about the constancy and uniformity of human nature across historical and cultural boundaries. Modern, science-centered naturalisms can be charged with a certain moral laxity, according to S. T. Coleridge. This fault reflectsnbsp; a devitalizing, materialistic metaphysics informed by a narrow and self-serving conception of reason. Thus seeking a remedy that can bring justice to the spiritual as well as the physical aspects of experience, Coleridge envisages a lsquo;true naturalismrsquo; that will not only address the question lsquo;What is Life?rsquo; but also frame a lsquo;true realismrsquo; that includes what might be called a lsquo;true moralismrsquo;. This calls, however, for a Heraclitean metaphysics capable of linking lsquo;goodnessrsquo; in both thinking and acting to a *Logos*mdash;that is, an essentially nonmodern theory of actuality that can do justice at once to the quicknesses and the uniformities of both Life and Thought. O’Donohue has identified 37 criticisms of the American Psychological Association’s Ethical Principles of Psychologists and Code of Conduct (Ethics Code), although many of his criticisms go far beyond what is found written in the APA Ethics Code, to include the process of adjudicating ethics complaints by the American Psychological Association Ethics Committee, and the process by which the Ethics Code was developed. The authors claim that a major shortcoming of O’Donohue’s article (...) is that he adopted an unrealistically expansive role for the Ethics Code that was not clearly linked to furthering the goals of the ethics code revision. It asserts that professionals are in a different situation to that of employees; and that with the latter ethical codes are used by management to ensure compliance and are devoid of ethical content. Within the professional practice of psychology the code of ethics characterizes what is morally right or wrong, by means of a set of principles, values, and standards of conduct. While there are numerous international mental health organizations that incorporate ethical guidelines such as the APA and EFPA; these codes still fall short in providing guidelines for psychologists working in non-western cultures, especially when there are no universally adopted and valid cross-cultural ethics codes. The resolution of ethical dilemmas often requires individuals to search for reasonable justifications to support their choices. Occasionally, such justifications must be made explicit to stakeholders inside or outside the organization. Other times, the justification for a decision will be known only by the decision-maker. Many Americans don't hold journalists in very high regard these days, and sports journalists are often viewed in the least favorable light. The general public does not perceive any visible, unified, and concerted effort among sportswriters to practice their craft in a consistently ethical manner. Efforts to upgrade the craft include the Associated Press Sports Editors ethical guidelines, which cover freebies, moonlighting, community involvement by sports journalists, and commercial sponsors of sporting events. This study examines the APSE code and (...) suggests additional, more specific, and enforceable guidelines in ten areas: freebies, moonlighting, newsgathering methods, news sources, direct quotes, privacy, gambling, special interests, self?interests, and involvements. Background: Ethical codes are guidelines that orient nurses and ensure that their decisions are in accordance with the values of the professional system. These codes show that there is a connection among values, patients’ rights, and nurses’ duties. Objectives: This study aimed to compare the viewpoints of patients, nurses, and nurse managers regarding the extent to which clinical ethical codes are observed. Research design: In this descriptive–comparative study, data were collected using three questionnaires based on Iranian nurses’ ethical codes with (...) a focus on clinical care. The reliability of the questionnaire was verified by test–retest method (r = 0.9). The patients were interviewed by the researcher, but nurses and managers completed the questionnaires themselves. After all, the data were analyzed using the SPSS statistical software (v 15). Participants and research context: In all, 100 patients, 100 nurses, and 30 managers from internal and surgical wards of two major hospitals in Shiraz, Iran, participated in 2014. Ethical considerations: This research was approved by the Ethics Committee of Shiraz University of Medical Sciences. All the participants signed written informed consents. Findings: According to the results, 70% of the patients, 86% of the nurses, and 53.3% of the nurse managers rated nurses’ adherence to ethical codes as satisfactory. The mean scores (standard deviation) of the level of adherence to ethical codes were 38.44 (6.91) in the patients, 41.08 (4.82) in the nurses, and 37.83 (6.98) in the nurse managers. The results of analysis of variance revealed a significant difference between the attitudes of the nurses and the other two groups (p = 0.001). Discussion: Nurses’ adherence to ethical codes was satisfactory in all three groups. Accordingly, our findings agree with the results of some national and international studies, although there are still controversies in this regard. Conclusion: Although the nurses rated their performance in certain fields more satisfactory compared to the patients and managers, all the three groups agreed that clinical ethical codes were properly observed in the internal and surgical wards. Nurses can improve the quality of care by considering the viewpoints of patients and managers about their ethical performance. (shrink)

All ethics codes serve an argumentativefunction to improve public opinion, avoid government regulation, and produce ethical behavior among members. The National Religious Broadcasters' increased eforts to enforce its code illustrates the potential for three dificnlties to surface when organizations use codes to justify their activities. Organizations tend to limit public discussions to the code 's existence, and shorthand descriptions of it, fail to address enforceability problems, and assume that the code will change corporate culture. Se realiza una revisión bibliográfica con el objetivo de analizar los diferentes códigos éticos y deontológicos internacionales, regionales y nacionales de los que se nutre la especialidad de psiquiatría. Se concluye que el comportamiento ético se basa en el sentido de la responsabilidad individual de cada psiquiatra hacia cada paciente y en la capacidad de ambos para determinar cuál es la conducta correcta y más apropiada. Las normas externas y las directrices, tales como los códigos de conducta profesional, las aportaciones (...) de la ética y de las normas legales, no garantizan por sí solas la práctica ética de la medicina, pero constituyen un importante marco referencial. A literature review was performed with the objective of analyzing the various international, regional and national ethical and deontological codes that the psychiatry specialty feeds on. It is concluded that ethical behavior is based on the sense of individual responsibility of each psychiatrist to each patient and the ability of both to determine what the correct and appropriate behavior is. External standards and guidelines, such as professional codes of conduct, the study of ethics and legal standards alone do not guarantee the ethical practice of medicine but are an important framework. Surprise – these much-publicized rules are not the least bit reassuring to people who specialize in the study of ethics. While attention to ethics is certainly welcome, these ethical codes provide a too-easy cop-out, a way to neatly dispose of attention to nagging and pervasive problems. The typical professional code is little more than a checklist of rules that enables professionals of any stripe to give lip service to ethical behavior without engaging in continuing dialogue on ethical (...) dilemmas. Neatly packaged commandments short-circuit development of the reasoning tools to work through ethical challenges meaningfully and with long-lasting impact on the actual behavior in any field. This study examines the way ethical decisions are made in controversial cases at The Courier-Journal in Louisville, Kentucky, to see if codes of ethics can be efective at a newspaper known for its commitment to ethics. The study concludes that a code is efective in that environment especially on conflict-of-interest questions. A critical factor in the code's efectiveness is an ethical culture in which editors support ethical standards vigorously and foster a process that encourages newsroom debate (...) over controversial cases. This paper examines the case of the internal auditor from a sociological and ethical perspective. Is it appropriate to extend the designation of professional to internal auditors? The discussion includes criteria from the sociology literature on professionalism. Further, professional ethical codes are compared. Internal auditors' code of ethics is found to have a strong moral approach, contrasting to the more instrumental approach of certified professional accountants. Today''s business students have grown up in a society where distinctions between right and wrong have become blurred and where unethical behavior is observed and even expected in high-profile leaders. Especially troubling is the impression educators have that many students no longer view cheating as morally wrong (Pavela and McCabe, 1993). By contrast, the general public is demanding higher ethics of businesspeople. In this environment, educators are challenged to instill ethical norms in business students, especially when recent research indicates (...) that students intending to enter business fields are more likely than any other group of students to engage in cheating and other forms of academic dishonesty (McCabe and Trevino, 1995). One of the major future roles of accounting students depends on their honesty, however. For audits to have economic value, the auditors must be perceived by the public as acting with independence, integrity, and objectivity. Public accountants have adopted a Code of Professional Conduct in order to protect the integrity of the profession. In an effort to teach accounting students the importance of ethical professional conduct, the author has developed a class project wherein groups of students write proposals for a student honor code at Niagara University. Background: The nature of children’s cancer comes with lots of ethical issues. Nurses are encouraged to adhere to ethical codes in their practice. Objectives: This study aimed to compare the perspectives of nurses and mothers of children with cancer regarding the adherence of nurses to ethical codes. Research design: In this descriptive-comparative study, a researcher-made questionnaire was used to assess the amount of adherence to Iranian nurses’ code of ethics in perspectives of pediatric oncology nurses and mothers. As (...) a convention, the total scores were categorized as optimal, average, and low adherence. Participants and context: A total of 200 mothers and 60 nurses in pediatric oncology wards of five major hospitals in Tehran, Iran, participated in 2016. Ethical considerations: Organizational approval by the university and informed consent were ensured before conducting the research. The principles of voluntariness, confidentiality, and anonymity were respected during the research process. Findings: Results showed the mean score of the adherence to ethical codes by nurses, as per the nurses is 86.71 (12.57) and as per the mothers is 78.67 (16.09). The highest frequency for “Low adherence” and “Optimal adherence” to code of ethics by nurses were “Respect for individual autonomy and decision-making” (mothers, 72% and nurses, 70%) and “Commitment to confidentiality” (mothers, 64% and nurses, 74%), respectively. This revealed a significant difference between the responses of the nurses and the mothers (p = 0.001). Discussion: The results support the other studies in Iran about the difference between the perspectives of patients and nurses about adherence of nurses to ethical codes. Conclusion: Integration of family-centered and conventional care in addition to more attention to the education of professional ethical principles could be helpful to improve the ethical performance of nurses in oncology pediatric wards. This paper reviews a publication entitled ‘Ethics Matters. Managing Ethical Issues in Higher Education’, which was distributed to all UK universities and equivalent in October 2005. The publication proposed that HEIs should put in place an institution‐wide ethical policy framework, well beyond the customary focus on research ethics, together with the mechanisms necessary to ensure its implementation. Having summarised the processes that led to the publication and the publication itself, the paper then considers whether following the now commonplace (...) corporate practice of implementing a code of ethics is appropriate for such institutions. Drawing on both the empirical evidence in relation to codes in the business ethics literature and a consideration of the nature of the university as an institution, the paper offers an alternative suggestion for how ethical issues in higher education might be managed. The international pharmaceutical industry has made significant efforts towards ensuring compliant and ethical communication and interaction with physicians and patients. This article presents the current status of the worldwide governance of communication practices by pharmaceutical companies, concentrating on prescription-only medicines. It analyzes legislative, regulatory, and code-based compliance control mechanisms and highlights significant developments, including the 2006 and 2012 revisions of the International Federation of Pharmaceutical Manufacturers and Associations (IFPMA) Code of Practice.

An honor code is certainly a good place to start teaching engineering students about ethics, but teaching students to live honorably requires far more effort than memorizing a code of ethics statement or applying it just to academic performance. In the School of Engineering at Grand Valley State University, we have followed the model provided by the United States Military Academy at West Point. For our students this involves an introduction to the Honor Code as (...) part of a larger Honor Concept at the very beginning of their studies and then making it an integral part of their preparation as engineers. The challenge is significant because the culture at large does not support living with an Honor Concept. This paper will begin with a discussion of the cultural context in which we must teach, because that context has changed significantly in the years since many faculty members were students themselves. The rest of the paper will detail the approach that we have taken to teach ethics as an engineer’s way of life. “The shortest and surest way to live with honor in the world is to be in reality what we would appear to be. Adobe masonry is part of the vernacular architecture of Cyprus. Thus, it is possible to use this technology in a meaningful way on the island. On the other hand, although adobe architecture is more sustainable in comparison to other building technologies, the use of it is diminishing in North Cyprus. The application of Turkish building code in the north of the island has created complications in respect of the use of adobe masonry, because this building code demands that (...) reinforced concrete vertical tie-beams are used together with adobe masonry. The use of reinforced concrete elements together with adobe masonry causes problems in relation to the climatic response of the building as well as causing other technical and aesthetic problems. This situation makes the design of adobe masonry complicated and various types of ethical problems also emerge. The objective of this article is to analyse the ethical problems which arise as a consequence of the restrictive character of the building code, by analysing two case studies and conducting an interview with an architect who was involved with the use of adobe masonry in North Cyprus. According to the results of this article there are ethical problems at various levels in the design of both case studies. These problems are connected to the responsibilities of architects in respect of the social benefit, material production, aesthetics and affordability of the architecture as well as presenting distrustful behaviour where the obligations of architects to their clients is concerned. When faced with an ambiguous ethical situation related to computer technology (CT), the individual's course of action is influenced by personal experiences and opinions, consideration of what co-workers would do in the same situation, and an expectation of what the organization might sanction. In this article, the judgement of over three-hundred Association of Information Technology Professionals (AITP) members concerning the actions taken in a series of CT ethical scenarios are examined. Respondents expressed their personal judgement, as well as their perception (...) of their co-workers' judgement, and their understanding of the organization's judgement of the actions described in the scenarios. The findings show that there are differences in respondents' judgements for self, co-workers, and organization. Definitive patterns were also found between groups with and without organizational codes related to CT. (shrink)

What does religion contribute to business ethics? Related to the practical, religion applies theological concepts to business situations; namely, vocation, stewardship, human dignity, co-creation, co-conservation, sharing in God's power, servant leadership, encounter with the Incarnation, sacramental sign and justice (divine and human). These concepts suggest the threefold component of religion: doctrine (creed), worship (cult) and values governing behavior (code). A principle taken from religious practice illustrates its unique contribution to business ethics. The principle of proportionality (or double (...) effect) exemplifies code in its balancing of good and evil outcomes. The more contemporary principle called the fundamental option identifies the role of vocation and calling in the notion of creed. We contend that many of the criticisms of the American Psychological Association’s current Ethics Code are based on faulty assumptions and insufficient information. While the APA Ethics Committee values commentary on perceived shortcomings of the current Ethics Code as an important aspect of the current revision process, O’Donohue’s article contains inaccuracies that should be addressed. We clarify the functioning of the Ethics Code and the APA adjudication system, including explaining changes made to adjudication (...) in light of the Commission on Ethics Processes. We also explain the transparent, open process the APA has already undertaken to create a revised Ethics Code that is visionary and transformational. (shrink)

From the Hippocratic Oath on, deontological codes and other professional self-regulation mechanisms have been used to legitimize and identify professional groups. New technological challenges and, above all, changes in the socioeconomic environment require adaptable codes which can respond to new demands.We assume that ethical codes for professionals should not simply focus on regulative functions, but must also consider ideological and educative functions. Any adaptations should take into account both contents (values, norms and recommendations) and the drafting process itself.In this article (...) we propose a process for developing a professional ethical code for an official professional association (Colegio Oficial de Ingenieros Industriales de Valencia (COIIV) starting from the philosophical assumptions of discursive ethics but adapting them to critical hermeneutics.Our proposal is based on the Integrity Approach rather than the Compliance Approach. A process aiming to achieve an effective ethical document that fulfils regulative and ideological functions requires a participative, dialogical and reflexive methodology. This process must respond to moral exigencies and demands for efficiency and professional effectiveness.In addition to the methodological proposal we present our experience of producing an ethical code for the industrial engineers’ association in Valencia (Spain) where this methodology was applied, and we evaluate the detected problems and future potential.
