For Leo Strauss, the superiority of classical political philosophy over modern social science (and political theory based on social science) lies in at least four principles. First, it treats political matters as they actually appear to man qua philosopher and, in a qualified way, to the good citizen. Because Strauss claims that social science (and much post-classical political philosophy) abstracts from his canon of intelligibility, he thinks that it cannot lead to a humane, rational politics. In the hierarchy, either the truly virtuous or gentlemen should rule, and those having a passive, obediential form of virtue should be the ruled. Fourth, this arrangement is rational and humane. For although the virtues of the ruler and the ruled are complementary in justice and necessary to it, still they are different and, in fact, require the stratification just mentioned. BOOK REVIEWS 527 Because of the controversial nature of these principles and Strauss's eminence in political philosophy, one welcomes the present collection of essays by his disciples. They believe that in liberal democracies people confuse liberty with the uses to which liberty can and ought to be put. Doing so, people undermine that regime's foundations. Strauss and his disciples believe that modern natural right makes the clash between liberty and natural right inevitable, because its principal founders, Thomas Hobbes and John Locke, conceived man as non-political. They conceived individuals as gaining certain advantages from governments hut as gaining no good in the exercise of politics itself. Classic natural right, by contrast, bases itself on the assumption that man is radically political. Moreover, it conceives politics as an arena for liberating, ennobling activities. Hobbes and Locke viewed the individual as independent of politics, which they placed at the low end of the range of human activity, along with everyday concerns and popular morality, rather than at the high end, as Strauss would. Thus for Strauss, liberal democracy is founded on modern principles, which are either apolitical and liberal (Locke) or apolitical and illiberal (Hobbes). Consequently, it cannot withstand the individualist and collectivist onslaughts that we have seen in this century. What, then, have Strauss's disciples to say about liberal democracy and the prospect of classic natural right in a Western world which is more or less permanently Hobbesian-Lockean? The author analyzes three waves of the crisis of democracy during the 20th and early 21st centuries. The first crisis of democracy in the early 20th century is caused by the emergence and development of public politics, which challenged the possibility to govern the masses having conflict potential, it balanced the power of the people and universal suffrage with the control of the media in order to maintain the stability of political system. The second wave of (...) the crisis of democracy (the last third of the 20th century) is associated with the destruction of the conventional world and the weakening of the nation-state; and its markers were: the imbalance between the branches of government, the domination of economics over politics, the predominance of equality over freedom, the problematic implementation of human rights, and, as a consequence, the inability to put into practice the national form of democracy. The third wave of crisis (early the 21st century) is accompanied by the transformation of democracy into post-democracy, in which the power of the people is replaced by the power of global capital, and the illusion of consent is reinforced by the prohibition of alternative points of view and the narrowing of the space of issues allowed for discussion in the name of public security. The crisis of the policy to achieve peace through the transformation of the balance of powers into a balance of interests called into question the principles of democracy. On the contrary, post-democracies justify the use of force to spread democracy around the world, and they take an active part in contemporary military conflicts, which can rightly be defined as hybrid proxy wars. Drawing on J. Habermas’s concept of communicative rationality, the author concludes that to overcome the crisis of democracy it is necessary to accept the very possibility of an alternative to this form of government and allow to discuss these previously marginalized issues as well as to maintain the return of the majority to genuine communication and politics, contribute to its enlightenment. Sheldon S. Wolin's theory of fugitive democracy has been both lauded and criticized for its radical departure from the mainstays of democratic theory: formal institutions, political offices and constitutional arrangements of power. For Wolin, democracy is correctly understood as an ephemeral event that appears unexpectedly when ordinary citizens, united by a shared grievance, collectively interrupt normal political proceedings and reject constitutionalism. This article critically analyzes Wolin's theory in light of a historical phenomenon in which citizens collectively interrupted politics: (...) frontier vigilantism in the American West from 1850 to 1900. Critical of Wolin's wholesale rejection of constitutionalism, the article reveals the potentially legalistic patterns of extra-legal collective action, and it argues for de-fetishizing democratic practice that occurs outside of institutional channels. The crisis of democracy unfolding in the United States was identified by John Paul II as due to misunderstanding the relationship of truth and freedom. This crisis has grown worse due to a libertinism that sees objective moral truths as impositions on both free choice and fulfilling relationships, that identifies self-fulfillment with a self-creation in which one creates one’s own values, that seeks to build democracies apart from moral objectivity, and that dismisses the relevance of God for (...) living well. I argue that democracy cannot survive these libertine errors and that they cannot be successfully countered by utilitarianism, Rawls’s political liberalism, or democratic proceduralism. Survival requires adopting the Thomistic personalism formulated by Aquinas and developed by Karol Wojtyła as indispensable for understanding those lived experiences through which one encounters the ethical moment of self-determination, achieves moral objectivity, avoids loneliness by loving truly, and seeks—via collaboration with women exercising their feminine genius for discerning the welfare of others—the common good, without which democracies collapse into atheistic tyranny. This essay reassesses the German-Jewish social and cultural critic, Walter Benjamin's famous, yet widely misunderstood thesis of the aestheticisation of politics with reference to the development of the mass media and the crisis of democracy. I argue that his thesis of the aestheticisation of politics represents the focal point of his account of both the crisis of liberal democracy as a deliberative and representative political system and the emergence of fascism as a form of direct political (...) communication between a political power and the public. My examination of Benjamin's analysis of the interplay between fascist politics and the mass media leads to a wider critical consideration of the function of political spectacle in the media age. Numerous U.S. cities suffered immense fiscal strain following the subprime mortgage crisis and financial crash of 2007–8. Diminished revenues, tightened credit, and speculative financing that went bad in the aftermath fueled widespread fiscal distress on the local scale. Although the current moment resembles fiscal crises that crested in cities in the 1970s–90s, two factors distinguish the current period. First, municipal affairs have become thoroughly financialized—dominated by speculative securities and volatile debt arrangements—such that local crisis can no longer be (...) understood apart from financial market instability. Second, local fiscal politics have become increasingly removed from democratic oversight and control. This de-democratization hinders the capacity of political communities to reregulate markets and rebuild urban communities. An analytic model derived from the work of Hyman Minsky and Karl Polanyi emphasizes how cities become ensnared in a “financial instability” cycle and how communities seek to protect themselves by way of the “double movement.”. This article proposes that autocratic democracy represents the natural political form of right-wing populism. It argues that while the emergence of autocratic democracy as a genuine political alternative to liberal democracy may be currently located primarily in states where liberal democratic norms were not well-consolidated, there are reasons to hold that structural features of contemporary politics in consolidated democracies relating to the decline of mass parties and the globalisation trilemma create the space for the right-wing mobilisation of (...) populism. For theorists in search of a political theology that is more responsive to the challenges now facing Western democracies, this book tenders a new political economy anchored in a theory of value. The political theology of the future, Carl Raschke argues, must draw on a powerful, hidden impetus--the "force of God"--to frame a new value economy. It must also embrace a radical, "faith-based" revolutionary style of theory that reconceives the power of the "theological" in political thought and action. Before launching into the précis of my book, let me first describe the state of democracy, as I see it, in order to discuss the motivations for writing a book about democracy across borders. It is the best of times and the worst of times. According to the current wisdom, we live in the golden age of democracy. In the absence of any viable alternative, liberal democracy is taken to be the only feasible formof democracy (...) and goes unchallenged. Democracy is now recognized in international documents as ‘the best means to realize human rights,’ so that some now argue that international law, formerly unconcerned with internal affairs of states, establishes a ‘democratic entitlement.’1 At the same time, it is often claimed that democracy has never been weaker. It is increasingly unable to solve many collective problems and to gain legitimacy, thus leading to economic crisis, to the declining legitimacy of states in ever more numerous demands for succession, and to greater internal conflicts and even civil wars. As a result, some electoral and representative democracies increasingly cede many areas of social policy to delegated and increasingly non-democratic forms of authority. Possible responses to these facts lie between two extremes of a continuum. On the one hand, liberal nationalists call for the renewal of social consensus through a democratic ethos, and some participatory democrats demand decentralization into smaller units. On the other hand, cosmopolitans argue that only supranational levels of governance can solve the many collective action and coordination problems ranging from global warming to sustainable growth to grave human rights abuses and genocide. The Occupy movements in 2011 – this essay focuses mainly on Spain and the United States – have been more than moments of grassroots or direct democracy: they have been collective political practices testing forms of non-representationist democracy in the Europe of representative democracy to an unusually great extent. The precarious subjects of post-Fordism rejected political representation, and at the same time they struggled for a ‘real’ democracy. This oxymoron between representation and democracy structures the (...) political philosophy of Jacques Rancière and corresponds with his well-known distinction between police and politics. This is one of the reasons why his thinking is helpful to understand them as decidedly political ones. However, the assembly as one of the central topoi of theories of democracy plays no prominent role in Rancière’s political philosophy. In contrast to this, I focus on the central practice of the assemblies in the Occupy movements and develop a concept of presentist democracy. (shrink)

Democratic Crisis and Global Constitutional Law explains the current weakness of democratic polities by examining antinomies in constitutional democracy and its theoretical foundations. This book argues that democracy is usually analysed in a theoretical lens that is not adequately sensitive to its historical origins. The author proposes a new sociological framework for understanding democracy and its constitutional preconditions, stressing the linkage between classical patterns of democratic citizenship and military processes and arguing that democratic stability at the (...) national level relies on the formation of robust normative systems at the international level. On this basis, he argues that democracy is frequently exposed to crisis because the normative terms in which it is promoted and justified tend to simplify its nature. Over the last several years, democratic citizens and theorists have been grappling with an upsurge in political commentary on the crisis and decline of democratic legitimacy around the world. Increasingly, theoretical attention is turning from the philosophical justification of ambitious moral ideals of democracy, to the interpretation of potentials within existing political practice for democratic renewal and repair. This review article examines three new books at the forefront of this theoretical turn towards engagement with the real-world political dynamics (...) of democratic crisis and revival: Open Democracy by Hélène Landemore; Hope for Democracy by John Gastil and Katherine Knobloch; and Mending Democracy by Carolyn Hendriks, Selen Ercan and John Boswell. It begins by surveying the new contributions of these books – highlighting the importance all attribute to creative political agency as a source of revival in democratic practice. It then discusses several questions left unresolved by these books – concerning the problem of democratic legitimacy, the normativity of democratic standards and the power dynamics undergirding democratic agency – which jointly mark out an important agenda for future theoretical work on pathways out of democratic crisis. A new emphasis on diversity and difference is displacing older myths of nation or community. A new attention to gender, race, language or religion is disrupting earlier preoccupations with class. But the welcome extended to heterogeneity can bring with it a disturbing fragmentation and closure. Can we develop a vision of democracy through difference: a politics that neither denies group identities nor capitulates to them? In this volume, Anne Phillips develops the feminist challenge to exclusionary versions of democracy, (...) citizenship and equality. Relating this to the crisis in socialist theory, the growing unease with the pretensions of Enlightenment rationality, and the recent recuperation of liberal democracy as the only viable politics, she builds on debates within feminism to address general questions of difference. When democracies try to wish away group difference and inequality, they fail to meet their egalitarian promise. When yearnings towards an undifferentiated unity become the basis for radical politics and change, too many groups drop out of the picture. Through her critical discussions of recent feminist and socialist theory Anne Phillips rejects this democracy of denial. She also warns, however, of the dangers on the other side. The simpler celebrations of diversity risk freezing group differences as they are, encouraging a patchwork of local identities from which people can speak only to themselves. Her arguments then combine in a powerful restatement of the case for a more active and participatory democracy. This essay explores the problem of legitimation crises in deliberative systems. For some time now, theorists of deliberative democracy have started to embrace a “systemic approach.” But if deliberative democracy is to be understood in the context of a system of multiple moving parts, then we must confront the possibility that that system’s dynamics may admit of breakdowns, contradictions, and tendencies toward crisis. Yet such crisis potentials remain largely unexplored in deliberative theory. The present article works (...) toward rectifying this lacuna, using the 2016 Brexit and Trump votes as examples of a particular kind of “legitimation crisis” that results in a sequence of failures in the deliberative system. This article takes stock of the project of ecological democracy, a project that has been central to debates in Environmental Values since the late 1990s. Whilst we can identify quite distinct articulations of eco-democratic thinking emerging out of the fields of green political theory, postcolonial/feminist political ecology and science studies/radical geography, it is argued that these discussions have reached something of an impasse of late following the rise of climate scepticism, authoritarian populisms and technocratic eco-modernisms. Resurgent eco-authoritarian impulses and (...) the hankering for a ‘green leviathan’, a climate Lenin or a ‘dictatorship of the sustainment’ to resolve our climate crisis make it more important than ever to affirm the need for just, rapid and democratic post-carbon transitions. The article goes on to outline how emerging discussions in radical design studies focused on redirective practice in conjunction with a revived eco-socialist focus on labour-focused political ecologies might open up different possibilities for a materialist re-grounding of ecodemocratic discussions. It is suggested that a political ecology of design embedded in public institutions, the workplace and civil society could possibleyreground a more substantive vision of ecological democracy but also allow us to think about the forms of creative labour that could drive the just transition. This paper looks at the current wave of protests and demonstrations and asks whether what we are witnessing is the emergence of a new movement against austerity and in favour of democracy, as many suggest. The wider context is the crisis of representative politics, which is in turn transforming the nature of mobilisation, contestation and politics more generally. In place of traditional organisational structures, we are seeing the emergence of cloud, swarm and connective initiatives with characteristics that challenge (...) and supplant traditional organisational politics. We are seeing the emergence of a politics that is resistant to ‘politicians’ of whatever ideology, seeking to recuperate power and agency from representatives. This creates an interesting tension at the heart of democracy: whether and to what extent democracy needs to ‘reboot’ or whether new political parties and movements can ally the connective to representational styles of politics to provide a way in which democracy can evolve.Este artículo examina la ola de protestas y manifestaciones, preguntándonos si, como muchos sugieren, lo que estamos presenciando es el surgimiento de un nuevo movimiento contra la austeridad y a favor de la democracia. El contexto político está marcado por una generalizada crisis de la política representativa, hecho que a su vez marca la transformación de la naturaleza de la movilización, de la contestación y de la política en general. This book discusses the relationship between democracy and the financial order from various legal perspectives. Each of the nine contributions adopts a unique perspective on the legal and political challenges brought to the fore by the Global Financial Crisis. This crisis and the ensuing sovereign debt crisis in Europe are only the latest in a long series of financial crises around the globe in recent decades. By their very existence, but also as a result of the (...) political turmoil they have created, these financial crises testify to the well-known tensions between democracy and a market-based economic and financial order. However, what is missing in this debate is an analysis of the role of law for reconciling democracy with a market-based financial order. To fill this lacuna, the book focuses on the controversy surrounding the concept of law, thereby adding another variable to the debate on the relation between democracy and capitalism. Patrick Deneen’s Why Liberalism Failed offers a compelling critique of liberalism that casts considerable light on many of our current discontents. Nevertheless, its argument is vitiated by certain shortcomings, namely, a failure to recognize the role of other traditions in inspiring and shaping liberal democracy, and to do justice to the achievements, history, and complexities of the liberal intellectual tradition. Likewise, its account of liberalism fails to address that tradition’s defining philosophical commitments, commitments that determine the limits and possibilities (...) of its political theorizing and explain its historical trajectory toward an ever-deeper individualism. It will not be possible to escape the intellectual prison of Enlightenment Liberalism’s moral emotivism and hyper-individualism until we have transcended the impoverished metaphysics from which they issue. The relationship between ecology and democracy has a complex history and an uncertain future. Ecological crises threaten all forms of life on earth, and democracy too is endangered, as popular discontent, elite malfeasance, and unresponsive institutions herald crisis if not collapse. It is clear that our present political concepts and institutions are inadequate for meeting the challenges of living in right relation with the more-than-human world and, moreover, that these inadequacies are themselves symptoms of a failing political-cultural (...) story and a lack of concrete practices of ecological renewal, a story that does not recognize that there is no "people" without the earth and that power is not held by humans alone but in common with the natural world--intensifying weather events effected by climate change are only the most obvious example. Earthborn Democracy upends conventional accounts, which view democracy as a modern invention, by probing deep histories of egalitarian political organization beyond the ancient Athenian efforts so feared by the American founders in the premodern Americas, Mesopotamia, and many other egalitarian cultures. Unlike the constitutional democracies in nation-states, which are in service to economic directives, the political practices and stories excavated in the book illustrate the interdependence necessary to inspire and orient the work of ecological and democratic renewal. Responses to climate catastrophe call for an understanding of how unconscious desire can be a resource for collective democratic action. Developing an embodied account of the unconscious in which a desire for pleasure is central, the authors examine the knowledge and living traditions of Indigenous communities; the incorporation of "pleasure activism" into contemporary social movements and antiracist struggles; and practices of cooperation-cross-species affinity and relational grassroots political organizing around the world. The resonances across these examples trace the possibility for renewal of individual and collective selves through the work of ecological attunement and restoration. Building from re-envisioned democratic histories and this radical rereading of the collective unconscious, they show how contemporary political experiments and practices might cultivate and channel desires for autochthonous-earthborn-democracy, as the Athenian mythos names it. The familiar problems of democratic capitalism have given way to a deep crisis challenging the basic forms of governance introduced around the late 18th century and then gradually expanded and developed until the late 20th century. Associative Democracy and the Crises of Representative Democracies argues that we are in urgent need of normative guidelines and a strong understanding of a broad range of institutional options and innovative experiments in associative democracy in order to address the structural problems (...) that existing institutional arrangements are confronted with whilst maintaining and strengthening democratic forms of government and governance. The argument is developed against the background of a thorough survey of empirical social scientific studies on the crises of capitalisms and representative democracies. This book focuses primarily on democratic alternatives, though it also works out principles and institutions of democratic socialism as alternatives to capitalism. After introducing the theoretical approach, the book illustrates the ways this framework of analysis can be of use, with particular focus on three issues that are highly topical when it comes to the challenges our institutions are confronted with: democratic governance in relation to ecological crises and uncertainty; the threats to democracy raised by the crisis of political parties and representative party-democracy, and the challenges related to privatization and marketization of public services, particularly in healthcare. The book concludes by exploring opportunities to democratize the economy, locating viable alternatives to capitalism in the tradition of democratic socialism. My main point is that the creation of a free public time implies the creation of a democratic collective inspired by the project of social ecology. The first and second parts of this article focus on the modern social phenomena correlated to the general crisis and the emergence of the Internet Age (Castells, 2012). The third and fourth parts focus on new significations that seem to inspire modern social movements and the challenges that modern democratic ecological collectivities face. I (...) use the term “social ecology” as defined by Murray Bookchin: “Social ecology is based on the conviction that nearly all of our present ecological problems originate in deep-seated social problems” (Bookchin, 2006, p. 19). And I use the term “democracy” exclusively in the original, true meaning, of direct democracy where society is self-governed by the equal participation of every individual to political decisions and functions, as opposed to a modern representative democracy or republic, where political decisions rest in the hands of an oligarchy. In this sense, a truly democratic political collectivity is a truly ecological collectivity and vice versa. (shrink)

The article discusses the political significance of the care crisis in its relation to the crisis of democracy. Firstly, based on the ethics of care and critical theory, care is characterized as a type of social and political practice. Then, it is examined the ethical and political problems which derive from a social organization of care according to market principles. Finally, the article addresses the question for a democratic solution to the current care crisis.

This paper presents the case of the post-crisis discursive defence of shadow banking in the Netherlands to argue, first, that there is a need to dust off older elite theories and adapt them to post-democratic conditions where there are no widely shared ‘political formulas’ to secure mass support for elite projects. Second, that temporality should be taken more seriously; it is when stories fail that elite storytelling can be observed in practice. As new ‘political formulas’ are minted and become (...) established, elites can again hope to withdraw from the political scene and leave policy-making to the self-evidence of output legitimacy and/or the perpetuum mobile of There-Is-No-Alternative (TINA). This suggests that elite theory should replace an epochal reading of post-democracy with a more conjunctural one. (shrink)

What is democracy really? What do we mean when we use the term? And can it ever truly exist? Astra Taylor, hailed as a "New Civil Rights Leader" (LA Times), provides surprising answers. There is no shortage of democracy, at least in name, and yet it is in crisis everywhere we look. From a cabal of thieving plutocrats in the White House to campaign finance and gerrymandering, it is clear that democracy--specifically the principle of government by (...) and for the people--is not living up to its promise. In Democracy Might Not Exist, Astra Taylor shows that real democracy--fully inclusive and completely egalitarian--has in fact never existed. In a tone that is both philosophical and anecdotal, weaving together history, theory, the stories of individuals, and interviews with such leading thinkers as Cornel West, Danielle Allen, and Slavoj Zizek, Taylor invites us to reexamine the term. Is democracy a means or an end, a process or a set of desired outcomes? What if the those outcomes, whatever they may be--peace, prosperity, equality, liberty, an engaged citizenry--can be achieved by non-democratic means? Or if an election leads to a terrible outcome? If democracy means rule by the people, what does it mean to rule and who counts as the people? The inherent paradoxes are unnamed and unrecognized. By teasing them, Democracy Might not Exist offers a better understanding of what is possible, what we want, and why democracy is so hard to realize. (shrink)

The growing appreciation of the global environmental crisis has generated what should have been a predictable response: those with power are using it to appropriate for themselves the world’s diminishing resources, augmenting their power to do so while further undermining the power of the weak to oppose them. In taking this path, they are at the same time blocking efforts to create forms of society that would be ecologically sustainable. If there is one word that could bring into focus (...) what is wrong with this response it is ‘democracy’. Democracy means power in the hands of the people, which, by definition, means opposition to the concentration of power. It is inconceivable that if we had genuine democracy, where people were fully informed of the issues, they would not choose to share the burdens of scarcity and organize to live in accordance with the limits of their environment. Yet the notion of democracy is problematic. Those striving to concentrate power are pursuing this in the name of democracy. They have identified democracy with the imposition of free markets and the freedom of people to use their wealth to dominate others. In this paper I will show how process philosophy provides the basis for justifying and further developing the traditional notion of democracy to counter this reformed notion, providing a vision of a democratic form of society that could address environmental problems. To achieve this, I will argue, it is necessary to reformulate the grand narrative of civilization on the basis of human ecology, a science which, construing humans as participants in a creative nature, can replace economics as the master science for formulating public policy. Political polarization is one of the most discussed challenges facing contemporary democracies and is often associated with a broader epistemic crisis. While inspiring a large literature in political science, polarization’s epistemic problems also have significance for normative democratic theory, and this study develops a new approach aimed at understanding them. In contrast to prominent accounts from political psychology—group polarization theory and cultural cognition theory—which argue that polarization leads individuals to form unreliable political beliefs, this study focuses on system-level diversity. It argues that polarization’s epistemic harms are best located in its tendency to reduce the diversity of perspectives utilized in a democratic system and in how this weakens the system’s ability to identify and address problems of public concern. Understanding such harms is also argued to require a greater consideration of the political dynamics of polarization and issues of elite discourse, alongside political psychology. (shrink)

Democracy is in serious difficulties. Three features of the crisis stand out. First is the dominant culture of disillusionment in democracy, which transpires as the mistrust in constitutionalist institutions and values. Second, political authority, both at domestic and international levels, is largely substituted by the rule of non-transparent and unpredictable social powers. Third, democratic states are deprived of much of their capacity to govern, but they retain a non-negligible capacity to coerce.The article is structured as follows. Section (...) Our democracies presently face a set of unique challenges. In this article we argue that the current crisis needs to be understood as resulting from the convergence of two historical transformations: the paradigm of boundlessness; and what we term “endividualismo”, a novel mutation of individualism in the context of the financial age. The result is a novel political reality where individual rights are ever-expanding and the opportunities for collective action have shrunk to the point of impossibility. Understanding the relationship between experts and laypeople is crucial for understanding today’s world of post-truth and the contemporary crisis of liberal democracy. The emergence of post-truth has been linked to various phenomena such as a flawed social and mass media ecosystem, poor citizen education, and the manipulation tactics of powerful interest groups. The paper argues that the problem is, however, more profound. The underlying issue is laypeople’s inevitable epistemic dependence on experts. The latter is part and parcel of (...) the “risk society” in which people question the scientific consensus and thus are able to manipulate the facts. It is a powerful weapon in the hands of illiberal democrats, though liberal democrats can make no use of it. The latter downplay the problem of citizens’ epistemic deficits and of the epistemic asymmetries between them. The third and fourth generations of deliberative democrats are a perfect example. The paper argues that the concepts of interactional expertise and epistemic dependence explain why understanding between experts and laypeople is impossible. The said phenomena undermine liberalism’s unrealistic assumptions concerning citizens’ decision-making competence. (shrink)

My starting point is a fundamental paradox that lies at the heart of the slow demise of the Roman Republic: why does the system collapse when, as many scholars have noted, there is nothing that suggests that there was ever an intention by anyone to overthrow the Republic? Understanding this paradox is key to identifying what Rome might have to say to us today. What changes in the final decades of the Roman Republic is a declining view of the ability (...) of political institutions to project the community into the future. This change is due to important alterations in the norms that provide the background context by which individuals working through institutions can get things done. The changes in these norms not only disable these institutions, making them seem less capable of projecting the community into the future, but also make possible alterations in the political framework that might have been inconceivable before. In particular, one sees the elevation of individuals who offer solutions by promising to bypass those ineffective and unresponsive institutions. (shrink)

Is it a requirement of justice to democratize private companies? This question has received renewed attention in the wake of the financial crisis, as part of a larger debate about the role of companies in society. In this article, we discuss three principled arguments for workplace democracy and show that these arguments fail to establish that all workplaces ought to be democratized. We do, however, argue that republican-minded workers must have a fair opportunity to work in a democratic (...) company. This work, in English "Struggle for power, organic crisis and judicial independence", has its origin in research academics of the IAEN carried out to provide expert advise to the Inter American Court of Human Rights in the case Quintana and others (Supreme Court of Justice) vs the State of Ecuador. The research is about the nature of the evolution of the ecuadorian state, the dynamics of its institutions, its players, parties, laws, its factors of instability, the way rights have (...) been deployed since the return to democracy in 1979, those who have benefited from neoliberal democracy and those who have paid the costs, and where in all this was the Supreme Court of Justice. The Introduction takes a look at this origin of the work and its intellectual import, provides a brief characterization of the Inter American Sistem of Human Rights Protection, how the Quintana Case fits within it, and an overview of the chapters and their logic. The first chapter analyzes the institutional and sociological factors that have contributed to Ecuador's historically unstable state, based primarily in an antagonistic struggle for power between the Executive and Legislative branches. The second chapter analyzes the economic and political factors that provoked an organic crisis, or crisis of hegemony, between 1997 and 2007 in Ecuador. The third chapter analyzes the evolution of the way in which judges are selected in Europe, the outcomes they have generated, and how they compare with the ecuadorian systems of judge selection in terms of securing judicial independence. The fourth chapter develops a theory of judicial independence in democracy and analyzes how Ecuador measures up to that standard, from when it became a neoliberal minimal democracy in 1981, to when it became a neoliberal false democracy as a consequence of instalation of a system evidently lacking in the people's support under the guise of the 1998 Constitution and its system of judge selection, and the new democratic horizons set by the 2008 Constitution, and the judicial system that springs from it. Democracy has come under pressure in many countries in recent years. Authoritarian tendencies, populism and the cult of leadership threaten pluralistic societies in Europe and other parts of the world. But democracy is more than just a method of finding a majority; it is inextricably linked to the fight against oppression and injustice in all contexts of life. Especially in times of democratic crisis, it is necessary to focus on its core aspects. The political thinking of French (...) philosopher and writer Albert Camus, who died in 1960, offers the basis for a redefinition of democracy that is linked to and dependent on rebellion. From his reflections, a radical theory of democracy can be derived that is based on the absurdity of the world, its incompleteness, revolt and resistance to authoritarianism, on doubt, dialogue and foreignness.
