Critical examination of Alchourrón and Bulygin’s set-theoretic definition of normative system shows that deductive closure is not an inevitable property. Following von Wright’s conjecture that axioms of standard deontic logic describe perfection-properties of a norm-set, a translation algorithm from the modal to the set-theoretic language is introduced. The translations reveal that the plausibility of metanormative principles rests on different grounds. Using a methodological approach that distinguishes the actor roles in a norm governed interaction, it has been shown that (...) metanormative principles are directed second-order obligations and, in particular, that the requirement related to deductive closure is directed to the norm-applier role rather than to the norm-giver role. The approach has been applied to the case of pure derogation yielding a new result, namely, that an independence property is a perfection-property of a norm-set in view of possible derogation. This paper in a polemical way touches upon several points raised by Kristan in his recent paper. (shrink)

How should you decide what to do when you’re uncertain about basic normative principles? A natural suggestion is to follow some "second-order:" norm: e.g., obey the most probable norm or maximize expected choiceworthiness. But what if you’re uncertain about second-order norms too—must you then invoke some third-order norm? If so, any norm-guided response to normative uncertainty appears doomed to a vicious regress. This paper aims to rescue second-order norms from the threat of regress. I first elaborate and defend the (...) claim some philosophers have made that the regress problem forces us to accept normative externalism, the view that at least one norm is incumbent on all agents regardless of their normative beliefs. But, I then argue, we need not accept externalism about first-order norms, thus closing off any question of how agents should respond to normative uncertainty. Rather, we can head off the threat of regress by ascribing external force to a single second-order norm: the enkratic principle. (shrink)

Peter Stemmer advocates a new foundation of morality. He claims that any moral principle is justified only if every person to whom the principle applies consents to it on the basis of his or her own interests. But how can this ‘metanorm’ of unanimous consent be justified? Since Stemmer decisively rejects all objectivist foundations of morality, the only justification for his ‘metanorm’ can again be nothing but a unanimous consent. Through numerous examples I hope to have shown in my article (...) that the alleged connexion of all our moral demands with a general, unanimous consent is not realistic – no matter whether these demands are based on our spontaneous or on our well considered attitudes. And this holds no less for legal norms with their hard sanctions than for moral principles. (shrink)

First-order normative theories concerning what’s right and wrong, good and bad, etc. and metanormative theories concerning the nature of first-order normative thought and talk are widely regarded as independent theoretical enterprises. This paper argues that several debates in metanormative theory involve views that have first-order normative implications, even as the implications in question may not be immediately recognizable as normative. I first make my claim more precise by outlining a general recipe for generating this result. I then apply (...) this recipe to three debates in metaethics: the modal status of basic normative principles, normative vagueness and indeterminacy, and the determination of reference for normative predicates. In each case I argue that certain views on each issue carry first-order normative commitments, in accordance with my recipe. (shrink)

Contemporary political philosophy - especially in the works of Martha Nussbaum, John Rawls and Amartya Sen - has assumed that it can separate itself off from other philosophical positions and frameworks. In this book, Den Uyl and Rasmussen challenge this trend by moving from the liberalism they advocate in their earlier work to what they call 'individualistic perfectionism' in ethics. They continue to challenge the assumption that a neo-Aristotelian ethical framework cannot support a liberal, non-perfectionist political theory by filling in (...) the nature of the perfectionist ethical approach utilised in their previous political theorising. By developing the central features and principles of individualistic perfectionism they show that it is a major and powerful alternative to much contemporary ethical thinking - particularly to constructivism - and that it is capable of overcoming standard objections to perfectionism. How can we establish a political/legal order that in principle does not require the human flourishing of any person or group to be given structured preference over that of any other? Addressing this question as the central problem of political philosophy,_ Norms of Liberty_ offers a new conceptual foundation for political liberalism that takes protecting liberty, understood in terms of individual negative rights, as the primary aim of the political/legal order. Rasmussen and Den Uyl argue for construing individual rights as (...) metanormative principles, directly tied to politics, that are used to establish the political/ legal conditions under which full moral conduct can take place. These they distinguish from normative principles, used to provide guidance for moral conduct within the ambit of normative ethics. This crucial distinction allows them to develop liberalism as a metanormative theory, not a guide for moral conduct. The moral universe need not be minimized or morality grounded in sentiment or contracts to support liberalism, they show. Rather, liberalism can be supported, and many of its internal tensions avoided, with an ethical framework of Aristotelian inspiration—one that understands human flourishing to be an objective, inclusive, individualized, agent-relative, social, and self-directed activity. Proposed solutions to the problems of this country's health care system range along a spectrum from central planning to free market. Central planners and free market advocates provide various ethical justifications for the policies they propose. The crucial flaw in the philosophical rationale of central planning is failure to distinguish between normative and metanormative principles, which leads to mistaken understanding of the nature of rights. Natural rights, based on the principle of noninterference, provide the link between individual morality (...) and social order. Free markets, the practical expression of natural rights, are uniquely capable of achieving the goals that central planners seek but find beyond their grasp. The history of this country's health care system and the experiences of other nations provide evidence of the superiority of free markets in reaching for the goals of universal access, control of costs, and sustaining the quality of health care. Bastiat claims that the individual rights to life, liberty, and property are natural rights. Further, he claims that these natural rights are a matter of natural law and are not mere conventions. However, he never offers a detailed account of the connection between natural law and natural rights. By outlining a neo-Aristotelian theory of natural law that consists of two poles—an individualized vision of human flourishing and a conception of individual rights as metanormative principles—it is argued that Bastiat’s (...) core insight is correct. Individual rights are the proper political expression of a natural law approach to ethics. They determine the ultimate purpose of human law.Bastiat affirme que les droits individuels à la vie, à la liberté et à la propriété sont des droits naturels. De plus, il envisage ces droits naturels comme relevant du Droit Naturel plutôt qu’étant de simples conventions. In the paper I discuss the theory developed by Douglas D. Rasmussen and Douglas J. Den Uyl, who try to find new grounds for defending rights. Drawing upon Aristotle and his virtue ethics, they do not, however, employ the Aristotelian point of view, but present the neo-Aristotelian approach. They claim that rights should be conceived of not as normative but as metanormative principles. Rasmussen and Den Uyl argue that the fundamental right to liberty should be protected by the (...) state. The only role of the state is to be limited to the protection of right to liberty and in turn to the protection of self-directness. The authors defend the right to liberty on moral grounds. It seems, however, that the minimal state approach and moralistic defense of self-directness cannot be combined. (shrink)

This paper explores the idea that it is instrumentally valuable to learn normative truths. We consider an argument for "normative hedging" based on this principle, and examine the structure of decision-making under moral uncertainty that arises from it. But it also turns out that the value of normative information is inconsistent with the principle that learning *empirical* truths is instrumentally valuable. We conclude with a brief comment on "metanormative regress.".

Obituary for Berislav Žarnić, an outstanding, internationally influential, Croatian logician and philosopher. His main contributions are in logic of practical inference, logic of imperatives, logic of norms and philosophy of education.

Kritičko čitanje Alchourrónove i Bulyginove skupovnoteorijske defnicije normativnoga sustava pokazuje da njegova deduktivna zatvorenost nije neizbježno svojstvo. Slijedeći von Wrightovu pretpostavku da aksiomi standardne deontične logike opisuju svojstva savršenoga normativnog sustava, uvodi se algoritam za prevođenje iz modalnoga u skupovnoteorijski jezik. Prijevod nam otkriva da plauzibilnost pojedinih metanormativnih načela leži na različitim osnovama. Koristeći se metodološkim pristupom koji prepoznaje različite aktere u normama upravljanome međudjelovanju, pokazuje se da su metanormativna načela obveze drugoga reda upućene različitim ulogama. Poseban slučaj jest zahtjev (...) koji se odnosi na deduktivnu zatvorenost jer se pokazuje da je upućen ulozi koja primjenjuje, a ne onoj koja izdaje norme. Pristup je primijenjen i na slučaj čiste derogacije, što dovodi do novoga rezultata; svojstvo neovisnosti biva svojstvom savršenoga normativnog sustava u odnosu na moguću derogaciju. The essay analyses the hermeneutics of civilizational dialogue and identifies four basic principles, or requirements: recognition of the equality of the “lifeworlds;” awareness of the “dialectics” of cultural self-comprehension; acknowledgement of formal “metanorms” such as the principle of mutuality; and transcending the circle of “civilizational self-affirmation.” On the basis of these criteria, the essay investigates how politics will have to be reshaped – domestically, regionally and globally – to enable a genuine dialogue of cultures and civilizations that can also (...) serve as a cornerstone of peaceful coexistence among states. Addressing today’s multicultural reality and its impact on the traditional nation-state, the essay underlines the importance of intercultural openness and “civilizational curiosity” – instead of “civilizational nostalgia” – and suggests a redefinition of “co-existence” in the sense of active mutual engagement. The paper further undertakes a critical assessment of the role of “dialogue” as a fashionable decorum of international politics and questions the instrumentalization of the civilizational paradigm in the context of international politics. According to constitutivism, the objective authority of practical reason is to be grounded in the constitutive features of agency. In this paper, I offer a brief survey of the basic structure of constitutive argument about objectivity and consider how constitutivism might dispel the worry that it can only ground a conditional kind of authority. I then consider David Enoch’s original shmagency challenge and the response in terms of the inescapability of agency. In particular, I revisit the appeal to inescapability in (...) light of Enoch’s restatement of the challenge in 'Shmagency Revisited'. I argue that the revised challenge still fails but that it helps clarify: first, the distinction between external and internal challenges to constitutivism, and, second, the existence of at least different kinds of inescapability of agency (metaphysical, psychological, and dialectical). I argue that only dialectical inescapability is helpful to show that constitutivism is a viable metanormative theory. I conclude by claiming that an internal challenge to constitutivism is still possible in principle but that the burden of proof has shifted once again to the critics of constitutivism. (shrink)

Je soutiens, d'abord, que des méta-normes différentes sont justifiées par des principes différents. La méta-norme « devoir » implique « pouvoir » est justifiée par un principe d'humanité qui nous demande d'exclure les normes trop exigeantes. La métanorme selon laquelle ce serait une sottise d'ordonner à quelqu'un ce qu'il veut inévitablement de lui-même est justifiée par un principe (...) de parcimonie qui nous demande d'exclure les normes trop peu exigeantes. Je soutiens ensuite que ces deux principes peuvent entrer en conflit. Ce qui m'amène à la conclusion que toute théorie normative qui s'efforce de respecter ces deux principes risque d'être instable.The present paper adresses some problems related to the justification of meta-norms such as “ought” implies “can”. First, I argue that different meta-norms are justified by different principles. The meta-norm “ought” implies “can” is justified by a principle of humanity ruling out norms that are too demanding. The meta-norm according to which it would be foolish to command of someone what he unavoidably wants already is justified by a principle of parsimony ruling out norms that are not demanding enough. I argue, then, that these two principles may conflict. This leads me to the conclusion that any normative theory trying to respect both principles may be unstable. (shrink)

In this paper, the set-theoretic approach in the logical theory of normative systems is extended using Broome’s definition of the normative code function. The syntax and semantics for first order metanormative language is defined, and metanormative language is applied in the formalization of the basic principles in Broome’s approach and in the construction of a logical typology of normative systems. Special attention is given to the types of normative systems which are not definable in terms of the (...) properties of singular sets of requirements (e.g. the realization equivalence of codes, the social compatibility of codes, and the compatibility of codes issued by different normative sources). Examples are given of the application of the typology in the interpretation of philosophical texts. Von Wright’s hypothesis on the connection of logical properties of normative systems, conceived set-theoretically, with standard deontic logic is proved by introducing the translation function between the metanormative language and the restricted language of standard deontic logic. The translation reveals that von Wright’s hypothesis must be appended. The problems of narrow and wide scope readings of the deontic conditionals and of the meaning of iterated deontic operators are addressed using the distinction between relative and absolute normative codes. The theorem on the existence of a realization equivalent absolute code for any relative code is proved. (shrink)

According to the paradigm view in linguistics and philosophical semantics, it is lexical semantics plus the principle of compositionality that allows us to compute the meaning of an arbitrary sentence. The job of LS is to assign meaning to individual expressions, whereas PC says how to combine these individual meanings into larger ones. In this paper I argue that the pair LS + PC fails to account for the discourse-relevant meaning of normative ‘ought’. If my hypothesis is tenable, then the (...) failure of LS + CS extends to normative language in general. The reason I offer that this is so is that semantics for normative language is, in an important respect, a substantive semantics. The ‘substantive’ in question means that the meaning of normative vocabulary in use is driven by metanormative views associated with a particular normative concept. SS rejects the model LS + CS and replaces it with a discourse-relevant semantics built around an interactional principle that ascribes to a particular surface syntactical form of ‘ought’ sentences a logical form that represents its discourse-salient normative content. In the paper I shall sketch how SS works and why it is worth serious consideration. (shrink)

The essays in this volume clarify the notion of political identity by focusing on the metaphysics of polities. By analysing the notion of political identity, they provide the conceptual resources for a deeper understanding of the theoretical and practical debates on populism, on the crisis of sovereignty, on the feasibility of a world government, and on ethical, religious, and cultural pluralism. What is a political community? Any answer to this question lies at the intersection between three fields: metaphysics, philosophy of (...) action, and political philosophy. The question concerns how and why a plurality of individuals becomes a political unity, what principles or forces keep that unity together, and what threats that unity can encounter. In this volume, the contributors investigate how different metanormative views affect the possible answers to this metaphysical question. They explore the role that the individual identities of agents play in grounding common practices that underpin political life. They investigate the individual identities of agents as the result of the interplay between natural and cultural factors. Finally, they observe the ways in which a political community, as a collection of individuals who hang together in the attempt to reach common purposes, demonstrate a certain metaphysical solidity. I present and defend (1) an account of ethical judgments as judgments about our reasons to feel specific motivationally laden attitudes, (2) an account of what an agent should do in terms of what would achieve ends that she has reason to be motivated to pursue, and (3) an account of an agent’s reasons for motivation (and thus action) in terms of the prescriptions of the most fundamental principles that guide her deliberations. Using these accounts, I explain the connection (...) between ethics and reasons for action, how ethical judgments are both descriptive and intrinsically motivating, and how ethical facts arise from facts about agents’ deliberations. We offer a new argument in favour of metanormative contextualism, the thesis that the semantic value of a normative ‘ought’ claim of the form ‘ S ought to Φ’ depends on the value of one or more parameters whose values vary in a way that is determined by the context of utterance. The debate over this contextualist thesis has centred on cases that involve ‘ought’ claims made in the face of uncertainty regarding certain descriptive facts. Contextualists, relativists, and invariantists (...) all have plausible ways of explaining these cases, and one could reasonably judge the debate between these views to be a stalemate. We argue that this stalemate can be broken by shifting focus to a case that involves normative uncertainty rather than descriptive uncertainty. While relativist and invariantist rivals of contextualism can give plausible accounts of the descriptive uncertainty cases, only contextualism can provide a plausible account of the normative uncertainty case. Philosophical debate about the meaning of normative terms has long been pulled in two directions by the apparently competing ideas: (i) ‘ought’s do not describe what is actually the case but rather prescribe possible action, thought, or feeling, (ii) all declarative sentences deserve the same general semantic treatment, e.g. in terms of compositionally specified truth conditions. In this paper, I pursue resolution of this tension by rehearsing the case for a relatively standard truth-conditionalist semantics for ‘ought’ conceived as a necessity (...) modal and proposing a revision to it motivated by the distinctively prescriptive character of some deontic modals. In my view, this puts pressure on a popular conception of one of the core debates of metanormative theory between realists and antirealists. To make good on this claim, I go on to explore two very general ways we might interpret the results of compositional semantics—“representationalism” and “inferentialism”—in order to argue that, contrary to what is generally assumed, both can capture the special prescriptivity of ‘ought’ and both can countenance compositionally specified and informative truth-conditions for ought-sentences. Hence, my main thesis is that the deciding factor between them should not be which of ideas (i) and (ii) we are more impressed by but rather what we think of the relative merits of how representationalism and inferentialism respect these ideas. I’m inclined to favor an antirealist form of inferentialism, but the task I’ve set myself here is mainly to articulate the view in the context of metanormative theory and the semantics of deontic modals rather than try to defend it fully. To this purpose, towards the end I also briefly compare and contrast inferentialism with a third “ideationalist” metasemantic view, which may be an attractive home for some sophisticated versions of metanormative expressivism. Depending on how expressivism is worked out, it may be completely compatible with and so perhaps usefully combined with inferentialism or it may offer a competing way to respect ideas (i) and (ii). Metaethical—or, more generally, metanormative— realism faces a serious epistemological challenge. Realists owe us—very roughly speaking—an account of how it is that we can have epistemic access to the normative truths about which they are realists. This much is, it seems, uncontroversial among metaethicists, myself included. But this is as far as the agreement goes, for it is not clear—nor uncontroversial—how best to understand the challenge, what the best realist way of coping with it is, and how successful this attempt (...) is. In this paper I try, first, to present the challenge in its strongest version, and second, to show how realists—indeed, robust realists—can cope with it. The strongest version of the challenge is, I argue, that of explaining the correlation between our normative beliefs and the independent normative truths. And I suggest an evolutionary explanation as a way of solving it. (shrink)

One notable line of argument for epistemic relativism appeals to considerations to do with non-neutrality: in certain dialectical contexts—take for instance the famous dispute between Galileo and Cardinal Bellarmine concerning geocentrism—it seems as though a lack of suitably neutral epistemic standards that either side could appeal to in order to resolve their first-order dispute is itself—as Rorty influentially thought—evidence for epistemic relativism. In this essay, my aim is first to present a more charitable reformulation of this line of reasoning, one (...) that is framed not merely in terms of the availability of epistemic norms that are suitably neutral between interlocutors, but in terms of the availability of what I call Archimedean metanorms. Once this more charitable line of argument is developed, I show how, even though it avoids problems that face ‘non-neutrality’ versions of the argument, it nonetheless runs into various other problems that appear ultimately intractable and, further, that the strategy in question gives us no decisive reason to draw the relativist’s conclusion rather than the Pyrrhonian sceptic’s. We can distinguish between ambitious metanormative constructivism and a variety of other constructivist projects in ethics and metaethics. Ambitious metanormative constructivism is the project of either developing a type of new metanormative theory, worthy of the label “constructivism”, that is distinct from the existing types of metaethical, or metanormative, theories already on the table—various realisms, non-cognitivisms, error-theories and so on—or showing that the questions that lead to these existing types of theories are somehow fundamentally confused. Natural (...) ways of pursuing the project of ambitious metanormative constructivism lead to certain obvious, and related, worries about whether the ambitions are really being achieved—that is whether we really are being given a distinctive theory. I will argue that responding to these initial worries pushes ambitious metanormative constructivism towards adopting a kind of position that I will call “constructivism all the way down”. Such a position does see off most of the above initial worries. Drawing on the work of Ralph Walker and Crispin Wright, I argue, however, that it faces a distinct objection that is a descendent of Bertrand Russell’s Bishop Stubbs objection against coherentist theories of truth. I grant that the constructivist need not be a coherentist about truth. I argue, however, that despite this the constructivist cannot escape my version of the objection. I also distinguish between this objection and various traditional charges of circularity, regress, relativism, or psychologistic reductionism. (shrink)

Political realists have argued that ‘the political’ is an autonomous domain with its own distinctive concepts, distinctive methodology, and distinctive ‘source of normativity’. I here explore the metanormative commitments of realism (of the radical realist branch, in particular) and question the viability of exploring the ontology of the normative altogether. I argue that the escape into the metanormative realm was something of a wrong turn within the realism debates – an intellectual error. My central argument, building on recent (...) metatheoretical work on normativity, is meant to discredit the sheer possibility of metanormative distinctness. If realists can neither prove metanormative, nor traditional, nor methodological distinctness, there is a valid question as to its standing. I speculate, perhaps realism is little more than a new semantic label for ‘continental’ practices of social analysis as they leak into the analytic tradition. But then again it can be argued that most contemporary continental thought, and certainly much of what passes as critical theory these days, is thoroughly moralist, anti-positivist, and postmodern, and those sentiments are not shared by radical realists, who are, or so I’ll argue, far more faithful to the modernist tradition of social theory. Also included is an introduction (...) by one of the volume editors together with a bibliography listing 243 entries. If there is something (P) that every possible agent is committed to value, and certain actions or attitudes either enhance or diminish P, then normative claims about a range of intentional actions can be objectively and non-trivially evaluated. I argue that the degree of existence as an agent depends on the consistency of reflexive-relating with other individuals of the agent-kind: the ontological thesis. I then show that in intending to act on a reason, every agent is rationally committed to value (...) ‘above all else’ being an agent, what consists in exercising the capacity to act and having the freedom to discriminate between more or less valuable actions: the transcendental thesis. Since the degree of possession of this personal but non-contingent good depends on relating to other agents in a special way, certain actions and attitudes may be objectively right or wrong for all agents. Debates in metaethics about metanormative realism, quasi-realism, anti-realism, and nihilism mostly focus on epistemic reasons for beliefs about values. Very little has been said about our practical reasons for metaethical beliefs, and even less is said about practical reasons for other attitudes we might take toward metaethical views. This paper shows why a recent argument bucking that trend fails to show that we have practical reasons to believe realism over nihilism, but that for many of us, we do have (...) practical reason to hope that what I call Optimistic Realism is true. The past few decades have witnessed an extraordinary revival of interest in metanormative non-naturalism. Despite this interest, it is still unclear how to understand the distinctive metaphysical commitments of this view. We illustrate the relevant difficulties by examining what is arguably the most prominent class of contemporary attempts to formulate non-naturalism’s metaphysical commitments. This class of proposals, exemplified in work by Gideon Rosen and Stephanie Leary, characterizes the distinctive metaphysical commitments of non-naturalism in terms of metaphysical grounding and essence. We argue that these proposals overgeneralize: they either misclassify intuitively naturalistic hypotheses about the metaphysics of normativity as “non-naturalist”, or misclassify hypotheses in other areas of metaphysics. We argue that this problem stems from features of grounding itself. We suggest a more promising alternative for formulating non-naturalism, which revolves around the notion of objective similarity between classes of properties. We conclude by drawing some general lessons for inquiry about the metaphysics of normativity, and about metaphysics in general. (shrink)

George Berkeley's arguments have attracted a good deal of attention, but the account of abstraction has been often treated as if it were an entirely independent piece of writing. Berkeley links Locke's use of abstract general ideas to a belief in the possibility of an idea of existence abstracted from perception, that is, to the central issue of the Principles of Human Knowledge. The mistake Berkeley has been pointing to, the reliance on abstract general ideas, is a philosophical mistake, (...) but here it is clear Berkeley takes this mistake to have far‐reaching consequences, diverting the search for knowledge from what would be useful to know into trivial byways. Having identified the consequences of a mistaken belief in abstract ideas, Berkeley returns to his earlier claim, that it is language that leads us into this error. (shrink)

Behind the pendulum-like regulatory swings between interventionism and laissezpasser that are nothing but the results of changing contexts are the legal principles as their denominators and connectors. Legal principles guide explanations and give paths that a decision maker must not circumvent. This chapter focuses on the “America” part of Captain America's name and explores the more political aspects of his life and character. It looks at patriotism in general and how to characterize Captain America's brand of it; Cap's uneasy relationship with politics and the United States government; and how Cap puts principles above politics, even if it means defying his own government and giving up the shield and the title. The chapter explains that Cap's devotion to his country is (...) based on the principles and ideals upon which it was founded, and he regularly holds his government accountable to those same standards, which he interprets as inclusive and cosmopolitan, applying to the world outside America as well as everybody within it. It dispels any illusions that Captain America is a jingoist flag‐waver, and explains instead that he embodies an inclusive and cosmopolitan patriotism that balances idealism with clear‐eyed pragmatism. The principles of classical physics, including deterministic dynamics and observability of physical states, are incompatible with the existence of unobservable conscious minds that possess free will. Attempts to directly accommodate consciousness in a classical world lead to philosophical paradoxes such as causally ineffective consciousness and possibility of alternate worlds in which functional brain isomorphs behave identically but lack conscious experiences. Here, we show that because Chalmers’ principle of organizational invariance is based on a deficient nineteenth century classical physics, it (...) is inherently flawed and implies evolutionary inexplicable epiphenomenal consciousness. Consequently, if consciousness is a fundamental ingredient of physical reality, no psychophysical laws such as Chalmers’ principle of organizational invariance are needed to establish correspondence between conscious experiences and brain function. Quantum mechanics is the most successful and only modern physical theory capable of naturally accommodating consciousness without violation of physical laws. (shrink)

The principle of relevance of Sperber and Wilson (1995) underestimates the role of cooperation, and the theory’s inclination toward an individual intentionality is problematic. These are two of the critical observations that this paper introduces and discusses. Through a constant counterpoint with the aforementioned authors, the core arguments of their theory are analyzed in each section of this paper. The discussion will allow us to observe why it is necessary to include the notions of cooperation and collective intention in the (...) explanation of the relevance theory and, at the same time, the concept of trust . The status of constructivism as a metaethical or metanormative theory is unclear partly due to the lack of a clear semantics for central normative terms such as ‘reason’ and ‘ought’. In a series of recent papers, Sharon Street has attempted to clarify the central commitments of constructivism by focusing on the idea of a practical point of view and what follows from it. We improve upon the informal understanding provided by Street and attempt to provide a semantics for ‘ought’. (...) Our semantics respects the core intuition of the constructivist that normative claims are made true because of our practical commitments as agents and also reflects the constructivist’s commitment to the centrality of practical deliberation to normative truth. On our view, a normative claim of the form ⌜S ought to ϕ⌝ is true if ϕ is entailed from S’s set of evaluative attitudes. We argue that a virtue of our definition is that it allows us to see precisely what is distinctive about constructivism as opposed to realism and expressivism. (shrink)

The Principle of Unrest explores the contemporary implications of an activist philosophy, pivoting on the issue of movement. Movement is understood not simply in spatial terms but as qualitative transformation: becoming, emergence, event. Neoliberal capitalism's special relation to movement is of central concern.

Guiding principles are central to theory development in physics, especially when there is only limited empirical input available. Here I propose an approach to such principles looking at their heuristic role. I suggest a distinction between two modes of employing scientific principles. Principles of nature make descriptive claims about objects of inquiry, and principles of epistemic action give directives for further research. If a principle is employed as a guiding principle, then its use integrates both (...) modes of employment: guiding principles imply descriptive claims, and they provide directives for further research. By discussing the correspondence principle and the naturalness principle as examples, I explore the consequences for understanding and evaluating current guiding principles in physics. Like principles of nature, guiding principles are evaluated regarding their descriptive implications about the research object. Like principles of epistemic action, guiding principles are evaluated regarding their ability to respond to context-specific needs of the epistemic agent. (shrink)

In this essay, I defend a view I call “Robust Realism” about normativity. According to this view, there are irreducibly, perfectly objective, normative truths, that when successful in our normative inquiries we discover rather than create or construct. My argument in support of Robust Realism is modeled after arguments from explanatory indispensability common in the philosophy of science and the philosophy of mathematics. I argue that irreducibly normative truths, though not explanatorily indispensable, are nevertheless deliberatively indispensable, and that this kind (...) of indispensability is just as respectable as the more familiar explanatory kind. Deliberative indispensability, I argue, justifies belief in normative facts, just like the explanatory indispensability of, say, theoretical entities like electrons justifies belief in electrons. In the introduction I characterize the view I will be arguing for and sketch the main argument of this essay. In chapter 1 I draw the analogy between explanatory and deliberative indispensability, and argue that there is no non-question-begging reason to take the former but not the latter seriously. Here I also present the master-argument of the thesis, and clarify the argumentative work that needs to be done by each of the following chapters. In chapter 2 I address the worries of the antirealist who is willing to reject arguments from explanatory indispensability as well. In other words, in this chapter I try to justify the move from indispensability (of whatever kind) to belief. In chapter 3 I develop an account of deliberation that supports the premises about deliberation needed for my master-argument to go through. In chapter 4 I reject some alternative views, showing that none of them can allow for sincere deliberation. In this chapter, in other words, I support the indispensability premise: I argue that it really is impossible to deliberate sincerely without believing in irreducibly normative truths.. (shrink)

Norms provide a valuable mechanism for establishing coherent cooperative behaviour in decentralised systems in which there is no central authority. One of the most influential formulations of norm emergence was proposed by Axelrod :1095–1111, 1986). This paper provides an empirical analysis of aspects of Axelrod’s approach, by exploring some of the key assumptions made in previous evaluations of the model. We explore the dynamics of norm emergence and the occurrence of norm collapse when applying the model over extended durations. It (...) is this phenomenon of norm collapse that can motivate the emergence of a central authority to enforce laws and so preserve the norms, rather than relying on individuals to punish defection. Our findings identify characteristics that significantly influence norm establishment using Axelrod’s formulation, but are likely to be of importance for norm establishment more generally. Moreover, Axelrod’s model suffers from significant limitations in assuming that private strategies of individuals are available to others, and that agents are omniscient in being aware of all norm violations and punishments. Because this is an unreasonable expectation, the approach does not lend itself to modelling real-world systems such as online networks or electronic markets. In response, the paper proposes alternatives to Axelrod’s model, by replacing the evolutionary approach, enabling agents to learn, and by restricting the metapunishment of agents to cases where the original defection is observed, in order to be able to apply the model to real-world domains. This work can also help explain the formation of a “social contract” to legitimate enforcement by a central authority. (shrink)

The free-energy principle states that all systems that minimize their free energy resist a tendency to physical disintegration. Originally proposed to account for perception, learning, and action, the free-energy principle has been applied to the evolution, development, morphology, anatomy and function of the brain, and has been called a postulate, an unfalsifiable principle, a natural law, and an imperative. While it might afford a theoretical foundation for understanding the relationship between environment, life, and mind, its epistemic status is unclear. Also (...) unclear is how the free-energy principle relates to prominent theoretical approaches to life science phenomena, such as organicism and mechanism. This paper clarifies both issues, and identifies limits and prospects for the free-energy principle as a first principle in the life sciences. (shrink)

Preparatory Principles is not a linear text in the conventional sense, but consists of a series of short passages on a variety of topics, whose themes are summarised in marginal headings. The material constitutes a philosophical commonplace book, compiled by Bentham in the mid-1770s, in which he worked out the foundational ideas for his new science of legislation. He then drew on this material when composing such works as A Fragment on Government and An Introduction to the Principles (...) of Morals and Legislation. Inspired by such figures as John Locke and Claude Adrien Helvetius, Bentham developed an original ontological and epistemological basis for legal terminology, with the aim of replacing the traditional terminology of English law with that of universal jurisprudence. The work that dominates the text, in that Bentham returns to it time and time again in order to offer criticism of it, is William Blackstone's Commentaries on the Laws of England. While unorganized and fragmentary, the material in Preparatory Principles constitutes a remarkable record of the evolving ideas of a major legal philosopher at a formative stage of his career.
