Quite different from translation for general purposes, transplanted legal discourse is often unmatchable to the target discourse community. In reality, exact equivalence could not be found in terms of translation in legal transplant, which means the major task of translation in legal transplant is to solve lacunae, discursive gaps between the source text and the target text. In legal translation, a lacuna seems to constitute a factor of untranslatability. This paper, based on a study of four cases, argues that equivalence (...) can be achieved within the proposed Translational Triangle. The aim of this article is to tackle the sociosemiotic strategies through which the relation between power and visibility is articulated in today’s metropolitan São Paulo. Drawing on the theoretical-methodological framework of Greimasian and post-Greimasian semiotics, the following hypotheses are put forth: (1) contemporary São Paulo is characterized by a true visual hypertrophy, which manifests itself, all at once, in both its architectural and mediatic landscapes; (2) in São Paulo, power is hypervisible and apparently transparent; (3) the excess of (...) images, gazes, and perspectives produces, in São Paulo, dense and wide areas of topological, mediatic, and social invisibility; (4) the predominant visibility in São Paulo can be qualified as a “populist” visibility. Based on these assumptions, this article intends to contribute to the consolidation of a critical debate on the visual matrices of power and on social processes of exclusion and inclusion currently in place in global metropolises. Likewise, it is intended to contribute to the elaboration of a theoretical-methodological framework capable of understanding and addressing the complexity of the phenomena that characterize such debate. God is dead, but, contrary to Nietzsche’s diagnosis, ‘we’ didn’t kill him; he died of cancer. This perhaps crudely cold and off-putting opening does not refer to a naively metaphorically constituted transcendental abstraction, but to a spatio-temporally situated rock legend, Ronnie James Dio. This study aims at contributing to the burgeoning research field of memory and collective identity by providing a sociosemiotic account of the formation of collective narrative identity. By drawing on the three major categories whereby collective memory (...) is formed, that is artifacts, processes, places, as well as on the three key sociosemiotic metafunctions which are responsible for shaping a cultural event as sign system, the pursued interpretive route seeks to effectively contextualize how collective memory is fleshed out situationally in the context of Dio’s memorial. At the same time, by expanding the interpretive canvass to incorporate phenomenological perspectives on the mode of formation of collective memory, the offered analytic is intent on tracing invisible structures that point to operative mechanisms beyond the formal constraints of a sociosemiotic reading. Both phenomenological and sociosemiotic approaches are reinscribed within an overarching narrativity paradigm, wherein their relative merits in addressing the scrutinized phenomenon are discussed in an attempt to formulate a hybrid sociosemiotic phenomenological perspective of memorial events. While a much investigated concept because of its importance in shaping human discourse, modality has still not been given an agreed understanding. Using authentic Chinese court judgments in Hong Kong, this paper aims to unravel the complexity of modality as exemplified in its usage in the legal domain. It examines formal, semantic, and functional approaches to modality, showing their weaknesses in identifying and explaining modality in legal discourse. Among the categories of the telecom and internet frauds, the online romance scam is of particular concern for its sharp rise of victim numbers and the huge amount of cost. A social semiotic approach could be used to investigate the victim identity of the online romance scam from the aspects of the (re)construction and interpretation of discursive practices. As Hong Kong is the only common law jurisdiction operating in Chinese, alongside English, writing a common law judgment in Chinese is like exploring an uncharted domain in legal discourse. Apart from those judgments originally written in Chinese, Chinese judgments have also been prepared by way of translation from English. Besides, there are also English translations of Chinese judgments of jurisprudential value. Judgments in Hong Kong therefore present an interesting case for study both from a legal point of view and (...) from the perspective of discourse analysis. As Chinese judgments in Hong Kong to a large extent mirror images of their English counterparts, they provide us with insights into how judicial thinking embodied in one language is carried over to another. As the translation of court judgments can serve as a clue to the understanding of how judicial thinking is transferred and reflected in another language, this study looks into some of the fundamental problems of legal translation in general and translation of court judgments in particular, showing how the sociosemiotic approach can shed light on those problems. From that time on, we have been increasingly realizing that semiotic systems are for the most part established just on some type of similarity. But the more we see the sphere of analogical signification expanding its realm, themore we become aware of how inadequate is the notion of a simple relationship connecting locally a physical object with a second object, or with a (...) mental entity.There is, on the other hand, the more refined theory of sign conceived by Ferdinand de Saussure, but this theory, by its very definition, addresses a restricted domain, and definitely does not include the field of those signs which rest on analogical associations.The main purpose of this article is then to show how the more polished Saussurean model can act as a starting point for a general restatement, primarily intended to embrace the signs that rest on an analogical basis. We may so speak of a “neoclassical”, innovative semiotic theory, able to join the latest “sociosemiotic” approach with the most precious foundations of our discipline. (shrink)

Since the bilateral commerce between the USA and China changes greatly and Chinese government continues to reform and delegate power in the economic field, it is of importance to study the Uniform Commercial Code of the USA. The study specifically studies the features of modal verbs in the UCC through the comparison with the United States Code and Frown. With the help of Antconc, the distribution of modal verbs, the modal value of the three sets of corpora are examined and (...) analyzed based on the theory of Halliday’s systemic-functional grammar. The results show that there are significant differences between the three sets of corpora and the three main features of modal verbs in the UCC are: the high frequency use of may, the relatively lower frequency use of legal modal verb shall, and the much higher frequency of must and may not. The seemingly contrary usages within the UCC are discussed and explained with the background of the legislation and the legal thoughts of the major legislator in a sociosemiotic approach. With both the quantitative and qualitative analysis combining the examples, the study hopes to shed light on the related legal translation and further enhance the understanding of the modal verbs in the UCC as well as legal discourse in a more general context. The practice of parkour in urban spaces by young people, especially those who call themselves traceurs, illustrates how identities are formed in an ephemeral way by reinterpreting spaces in the city – briefly and without leaving a trace. However, in a sort of paradox, these interventions are registered in the socio-digital spectrum, tokenistically anchoring and incorporating them into conversations and social interactions. This work aims to explain the practice of the sport called parkour as a socio-semiotic phenomenon. We have used (...) some zones of Mexico City as a specific case for our approach. The foregoing leads to the conclusion that the meaning of parkour goes beyond its recreational role and places it as a relevant piece of identity for excluded urban social groups – even though these practices have been appropriated by marketing strategies. Our approach will use a cultural semiotics perspective, as well as direct observations and interviews as research techniques. (shrink)

The functional approach to scientific progress has been mainly developed by Kuhn, Lakatos, Popper, Laudan, and more recently by Shan. The basic idea is that science progresses if key functions of science are fulfilled in a better way. This chapter defends the function approach. It begins with an overview of the two old versions of the functional approach by examining the work of Kuhn, Laudan, Popper, and Lakatos. I shall argue that the prominent realist methodological approach that is adopted by majority of analytic theologians is inconsistent with the Islamic tradition. I will propose that the realist outlook is constituted of two essential components – metaphysical theological realism and epistemic theological realism – both of which fail to be amenable with the Islamic tradition. The prime reason for this, as I shall demonstrate, is that both metaphysical theological realism and epistemic theological realism divest the Islamic God of (...) absolute transcendence in different ways, impinging on the religion in a manner which ironically defies the purpose of analytic theology. In conclusion, this would establish that the prominent realist position adopted by majority of analytic theologians is inconsistent with the Islamic tradition. (shrink)

Although the connectionist approach has lead to elegant solutions to a number of problems in cognitive science and artificial intelligence, its suitability for dealing with problems in knowledge representation and inference has often been questioned. This paper partly answers this criticism by demonstrating that effective solutions to certain problems in knowledge representation and limited inference can be found by adopting a connectionist approach. The paper presents a connectionist realization of semantic networks, that is, it describes how knowledge about (...) concepts, their properties, and the hierarchical relationship between them may be encoded as an interpreter‐free massively parallel network of simple processing elements that can solve an interesting class of inheritance and recognition problems extremely fast—in time proportional to the depth of the conceptual hierarchy. The connectionist realization is based on an evidential formulation that leads to principled solutions to the problems of exceptions and conflicting multiple inheritance situations during inheritance, and the best‐match or partial‐match computation during recognition. The paper also identifies constraints that must be satisfied by the conceptual structure in order to arrive at an efficient parallel realization. (shrink)

Many Sides is the first full-length study of Protagorean antilogic, an argumentative practice with deep roots in rhetorical history and renewed relevance for contemporary culture. Founded on the philosophical relativism of Protagoras, antilogic is a dynamic rather than a formal approach to argument, focused principally on the dialogical interaction of opposing positions (anti-logoi) in controversy. In ancient Athens, antilogic was the cardinal feature of Sophistic rhetoric. In Rome, Cicero redefined Sophistic argument in a concrete set of dialogical procedures. In (...) turn, Quintilian inherited this dialogical tradition and made it the centrepiece of his own rhetorical practice and pedagogy. Many Sides explores the history, theory, and pedagogy of this neglected rhetorical tradition and, by appeal to recent rhetorical and philosophical theory, reconceives the enduring features of antilogical practice in a dialogical approach to argumentation especially suited to the pluralism of our own age and the diversity of modern classrooms. Recent anthropological studies consider the corporal experience as an indispensable attribute of a person’s life world. They declare to go beyond the dichotomy of body and mind and present a modern person as a complex integrity of all systems and characteristics of a living organism. Body and mind are a union of vitality with different forms of their manifestation. The corporal is not regarded as an essential complement to the mental, the corporal is the mental, just in a different form (...) of its manifestation. The implementation of a methodological turn from a rationalcognitive approach to a holistic understanding of human nature and the peculiarities of cognitive processes outlines the problem of education transformation in both theoretical and practical terms. Taking into account the complexity and multiplicity of tasks in solving this problem, the guideline in defining conceptual ideas is the understanding of a person as a multi-temporal being who lives simultaneously in multiple hierarchical levels, ontological time and the scale of processes. It is a question of necessity to construct educational activity in semantic planes: mindbody- culture, mind-body-activity, body-consciousness-reaction and others. (shrink)

Here I investigate the possibility of a phenomenological approach to Christianity, with the understanding that this would not be a matter of proposing an interpretation, but that such an “approach” would be able to lead directly to the heart of Christianity. I will say immediately that a phenomenology that would be able to undertake such a task is not the historical phenomenology that was born with Husserl. Becker has shown that an economic approach can provide a unified framework for understanding all human behavior. Despite the existence of biblical laws pertaining to women, Cheryl Anderson, in her work Ancient Laws and Contemporary Controversies, observes that these same laws do not take into account the perspectives of women. Instead, they are formed from a “male perspective” with which female readers learn to identify through “immasculation.” Anderson proposes an alternative, liberationist, and inclusive approach, in which the realities of the marginalized serve as the point of departure, and suggests that one way to perform this task (...) entails observing innerbiblical development between texts, drawing on the work of Terence Fretheim. Similar innertextual changes are also observable between interpretations of scriptural law, in the Dead Sea Scrolls. This essay therefore expands on the work of Anderson to compare certain biblical laws concerning women with examples of rewriting within the Scrolls. The relevance of the study is that specific individual linguistic customs and traditions are characteristic of each nation. The objective of the study is to examine the key aspects of anthroponyms and the methodology of their development in Turkish and Kazakh languages. In conducting the research, general scientific and special methods were used to achieve its goals and objectives. Its main results can be defined as follows. It was argued that the lexical-semantic approach to word formation is one of (...) the most widespread approaches to the creation of meaningful anthroponyms, reflecting the features and characteristics of the named person. According to the results of the conducted research, the necessity of studying anthroponyms and word formations was revealed and substantiated. The reason for this is that they have an important social and cultural significance in the process of interaction between the peoples of the world, as well as the study of their cultural heritage. The latter is directly related to the fact that personal names express moral and philosophical values of a certain ethos, fix in themselves the history, traditions, and beliefs of a particular society or community. As a result of the research, it was concluded that anthroponyms in the onomastic field of any language of the world are nuclear constituents. At the same time, the whole set of anthroponyms contained in it will be unique, as the factors influencing the speakers of the language will differ. (shrink)

This paper examines the ethical implications of healthcare resource allocation during the first wave of COVID-19 in Italy, from 21 February to 31 May 2020, with a focus on the utilitarian principles that prioritized age-based resource allocation. By comparing this approach to an ontological personalist bioethics framework, the study aims to offer a more equitable strategy for healthcare allocation applicable to any pandemic. Data from governmental reports, healthcare policies, and ethical guidelines were analyzed, revealing that Italy’s utilitarian method led (...) to significant ethical concerns, particularly regarding age discrimination. In contrast, the ontological personalist approach emphasizes the dignity and intrinsic worth of each individual, irrespective of age or health condition. The findings demonstrate that this personalist framework fosters a more balanced and fair allocation of resources, respecting human dignity and offering a universally applicable alternative to age-based prioritization. Ultimately, the study suggests that integrating ontological personalist principles into healthcare policies could enhance ethical decision-making in future pandemics, ensuring that resource allocation practices align more closely with human rights and individual dignity. The United Nations (UN), facing increasingly intense challenges in the fulfillment of its mission, also harbors the potential for enhanced effectiveness, relevance, and legitimacy in the form of the human rights-based approach. The human rights-based approach (HRBA) is one model for translating the organization’s values into a more adaptive, inclusive, dynamic, and responsive system of processes and outcomes. In the arena of politics, its meeting with a meaningful degree of receptiveness could signal a growing acceptance of the validity (...) of structural approaches to development and other issues despite traditional defensive positions on human rights. Application of the HRBA in programming is leading to greater appreciation for addressing core disparities and promoting empowerment for sustainable outcomes. It is also cultivating new qualities in development practitioners, advancing creativity, openness and responsiveness in organizational culture. In feeding its evolution in this way, the UN as a system has the potential for deeper, longer-term mission fulfillment and thus ensuring its viability. (shrink)

This book is a major contribution to the philosophical literature on the nature of the self, personal identity and survival. Its distinctive methodology is one that is phenomenologically descriptive rather than metaphysical and normative. On the basis of this approach Raymond Martin shows that the distinction between self and other is not nearly as fundamental a feature of our so-called egoistic values as has been traditionally thought. He explains how the belief in a self as a fixed, continuous point (...) of observation enters into our experience of ourselves and the world. He also reveals the explosive implications this thesis has for recent debates over personal identity and what matters in survival. This is the first book of analytic philosophy directly on the phenomenology of identity and survival. While in the movies or reading a novel, how can we feel terrified by monsters, ghosts, and fictional serial killers? And how can we feel sad or outraged by depictions of cruelty? After all, we know that the imagined threats that we fear do not exist and, therefore, pose no real threat to us; and we know that the instances of cruelty that bring tears to our eyes have not happened. And yet, the fear, the sadness, or the outrage experienced (...) in our imaginations feels very real. This is the so-called paradox of "fictional emotions." This and related paradoxes have become recalcitrant problems for a purely representational approach to the imagination that tries to accommodate the imagination in a belief-desire psychology, explaining our imaginings as mental states that are similar to beliefs or desires in some ways but not others—as "quasi-beliefs" or "quasi-desires." This representational approach can be seen, for example, in Kendall Walton's influential account of the imagination as "make-believe," or in Shaun Nichols and Stephen Stich's boxological account of the imagination as a "pretend box," which is in close interaction with the suspiciously similar "belief box". 오늘을 살아가는 현대인들에게 있어 노동(일)은 생계를 유지하기 위한 수단의 측면을 넘어 사회, 정치적으로 자신의 지위와 역할을 나타내는 상징적인 기능을 수행한다. 이것은 현대인들에게 있어 노동의 의미가 사회적으로 중요한 역할과 기능을 한다는 것을 말해준다. 하지만 사회·정치적인 측면에서 강화된 노동의 형식과 내용은 자본을 중심으로 하는 신자유주의 시장경제체제 속에서 인간 존재를 노동을 위한 수단으로 전락하게 만드는 위험성을 노정하고 있다. 그러므로 우리는 인간의 삶과 노동에 대한 인식을 사회적이고 정치적인 측면에서 살펴볼 수 있는 개연성을 갖게 된다. 더욱이 인간의 삶을 위한 수단의 측면인 노동이 사회와 정치, 그리고 (...) 경제체제 속에서 역전된 현상, 즉 노동으로부터 소외된 현대인의 삶의 모습을 통해 우리는 노동의 의미를 되새겨 볼 필요가 있다. 이 점에서 본고는 현대사회에 만연하고 있는 노동으로부터 소외된 인간 삶의 문제를 해결하고 극복할 수 있는 방안을 동양의 철학사상을 통해 모색하여 본다. 사물은 존재론적 국면에서 자기 기제를 갖고 있다고 할 수 있다. 거기에는 스스로 어떻게 할 수 없는 내재적 욕망, 또는 운동성도 있다. 이 자기운동성은 바깥으로 확대되어 대상과 더불어 장소를 공유하는 원인이 된다. 장소를 공유하는 과정에서 자칫 타율에 의해 자기 기제는 말살되기도 한다. 그런 나머지 자기 고유성이나 가치의 표출에 장애를 맞는다. 일차적으로 ‘각자(各自)’가 있으니, 그들 ‘각자’를 공간적으로 수용하여 각자 주체적으로 자신의 영토를 꾸릴 수 있어야 함에도 불구하고 외부 환경이 이를 막은 것이다. 이 같은 문제의식에서 이 논문은 『장자』의 ‘스스로’ 또는 ‘자연적’이라는 의미에 주목한다. Multivariate pattern analysis can reveal new information from neuroimaging data to illuminate human cognition and its disturbances. Here, we develop a methodological approach, based on multivariate statistical/machine learning and time series analysis, to discern cognitive processing stages from functional magnetic resonance imaging (fMRI) blood oxygenation level dependent (BOLD) time series. We apply this method to data recorded from a group of healthy adults whilst performing a virtual reality version of the delayed win-shift radial arm maze (RAM) task. This task (...) has been frequently used to study working memory and decision making in rodents. Using linear classifiers and multivariate test statistics in conjunction with time series bootstraps, we show that different cognitive stages of the task, as defined by the experimenter, namely, the encoding/retrieval, choice, reward and delay stages, can be statistically discriminated from the BOLD time series in brain areas relevant for decision making and working memory. Discrimination of these task stages was significantly reduced during poor behavioral performance in dorsolateral prefrontal cortex (DLPFC), but not in the primary visual cortex (V1). Experimenter-defined dissection of time series into class labels based on task structure was confirmed by an unsupervised, bottom-up approach based on Hidden Markov Models. Furthermore, we show that different groupings of recorded time points into cognitive event classes can be used to test hypotheses about the specific cognitive role of a given brain region during task execution. We found that whilst the DLPFC strongly differentiated between task stages associated with different memory loads, but not between different visual-spatial aspects, the reverse was true for V1. Our methodology illustrates how different aspects of cognitive information processing during one and the same task can be separated and attributed to specific brain regions based on information contained in multivariate patterns of voxel activity. We compared the processing of natural language quantifiers in a group of patients with schizophrenia and a healthy control group. In both groups, the difficulty of the quantifiers was consistent with computational predictions, and patients with schizophrenia took more time to solve the problems. However, they were significantly less accurate only with proportional quantifiers, like more than half. This can be explained by noting that, according to the complexity perspective, only proportional quantifiers require working memory engagement.

Drawing its strength from the UN Charter and UDHR, human rights ethics is a beacon of hope and a promise that requires continuous reaffirmation during these turbulent times. These two documents, with their unwavering faith in ‘fundamental human rights, in the dignity and worth of the human person, in the equal rights of men and women and of nations large and small,’ have shaped our understanding of human rights as global and universal ethics. However, this faith is now being severely (...) tested by four countercurrents: extremism, exclusionism, selectivism, and populism. These countercurrents pose significant and urgent human rights threats that activists, academics, and policymakers must confront by reasserting the basic core values of the UN Charter and UDHR. BackgroundOur human societies and certainly also (bio) medicine are more and more permeated with technology. There seems to be an increasing awareness among bioethicists that an effective and comprehensive approach to ethically guide these emerging biomedical innovations into society is needed. Such an approach has not been spelled out yet for bioethics, while there are frequent calls for ethical guidance of biomedical innovation, also by biomedical researchers themselves. New and emerging biotechnologies require anticipation of possible effects and implications, (...) meaning the scope is not evaluative after a technology has been fully developed or about hypothetical technologies, but real-time for a real biotechnology.Main textIn this paper we aim to substantiate and discuss six ingredients that we increasingly see adopted by ethicists and that together constitute “ethics parallel research”. This approach allows to fulfil two aims: guiding the development process of technologies in biomedicine and providing input for the normative evaluation of such technologies. The six ingredients of ethics parallel research are: (1) disentangling wicked problems, (2) upstream or midstream ethical analysis, (3) ethics from within, (4) inclusion of empirical research, (5) public participation and (6) mapping societal impacts, including hard and soft impacts. We will draw on gene editing, organoid technology and artificial intelligence as examples to illustrate these six ingredients.ConclusionEthics parallel research brings together these ingredients to ethically analyse and proactively or parallel guide technological development. It widens the roles and judgements from the ethicist to a more anticipatory and constructively guiding role. Ethics parallel research is characterised by a constructive, rather than a purely critical perspective, it focusses on developing best-practices rather than outlining worst practice, and draws on insights from social sciences and philosophy of technology. As the usual regulatory framework did not fit well during the last Ebola outbreak, innovative thinking still needed. In the absence of an outbreak, randomised controlled trials of clinical efficacy in humans cannot be done, while during an outbreak such trials will continue to face significant practical, philosophical, and ethical challenges. This article argues that researchers should also test the safety and effectiveness of novel vaccines in wild apes by employing a pluralistic approach to evidence. There are three reasons (...) to test vaccines in wild populations of apes: i) protect apes; ii) reduce Ebola transmission from wild animals to humans; and iii) accelerate vaccine development and licensing for humans. Data obtained from studies of vaccines among wild apes and chimpanzees may even be considered sufficient for licensing new vaccines for humans. This strategy will serve to benefit both wild apes and humans. (shrink)

In the not-too-distant past, the activity approach was quite popular in Russian philosophy and in many human sciences, including psychology. Recently it has come under criticism, even from some of its former proponents. This issue begins a series of articles devoted to assessing the results of research that has been conducted in Russia along the lines of this approach. The authors of the articles are philosophers, psychologists, and educational theoreticians and practitioners.

The Journal of Mind and Behavior, Winter 2003, Volume 24, Number 1, Pages 91–118, ISSN 0271–0137 This paper focuses on a logical systems flow-down of a set of consciousness requirements, which together with biological quantification of human brain anatomy sets limits on the neurological network in the cerebrum in order to produce the mind. It employs data to validate inferences, or when data do not exist, proposes methods for acquiring valid evidence. Many of these systems requirements will be imposed after (...) some fundamental assumptions are made. These assumptions are not new to theories on consciousness. However, their application as fundamentals may actually represent a new approach. Concurrent with these fundamentals, explicit periods of awareness while conscious are employed. Justification for their use is found in a theoretical process described as cerebral fusion. Additionally, storage of memory elements is postulated within local glia sites, proximal to synaptic nodes, and conductive transport through the astrocytes responsible for recall of data. The model permits variations in neural–glial interface physics and allows forecasts of mind/brain dysfunctions to be inferred. One key result from the model is hypothesized and expanded upon, and may have impact in certain types of dementia, such as Alzheimer’s disease. (shrink)

It is well known that the computational complexity of propositional knowledge base revision is at the second level of polynomial hierarchy. A way to solve this kind of problems is to introduce approximate algorithms. In this paper, an approximate approach is introduced for belief change. Operators, which satisfy the AGM rational postulates, are defined to change belief sets or belief bases. Furthermore, approximate algorithms to implement the revision of finite belief bases are presented. The time complexities of the approximate (...) algorithms shown in this paper are at lower level than the time complexities of the existed approaches in literatures, although they may not generate the optimal solution, and this is meaningful from the theoretical point of view. The productivity of researchers and the impact of the work they do are a preoccupation of universities, research funding agencies, and sometimes even researchers themselves. The h-index is the most popular of different metrics to measure these activities. This research deals with presenting a practical approach to model the h-index based on the total number of citations and the duration from the publishing of the first article. To determine the effect of every factor on h, we applied a set (...) of simple nonlinear regression. The results indicated that both NC and D1 had a significant effect on h. The determination of coefficient for these equations to estimate the h-index was 93.4% and 39.8%, respectively, which verified that the model based on NC had a better fit. Then, to record the simultaneous effects of NC and D1 on h, multiple nonlinear regression was applied. The results indicated that NC and D1 had a significant effect on h. Also, the determination of coefficient for this equation to estimate h was 93.6%. Finally, to model and estimate the h-index, as a function of NC and D1, multiple nonlinear quartile regression was used. The goodness of the fitted model was also assessed. (shrink)
