Key accomplishments of political corporate social responsibility scholarship have been the identification of global governance gaps and a proposal how to tackle them. Political CSR scholarship assumes that the traditional roles of state and business have eroded, with states losing power and business gaining power in a globalized world. Consequently, the future of CSR lies in political CSR with new global governance forms which are organized by mainly non-state actors. The objective of the paper is to (...) deepen our understanding of political CSR and reintegrate notions of state power into political CSR scholarship by highlighting how states set the context within which business takes place, regulate offshore business practices, and play pivotal roles in new global governance mechanisms. As an intellectual, economic, political and legal project, neoliberalism is not directed towards the rolling back of the state as an aim in itself. While its deregulatory tendencies, its commodification of public services and the undermining of systems of social welfare superficially suggest a generalised reduction in state power, it has been clear from the early 1980s that one of neoliberalism’s primary concerns has been the authoritarian reshaping of state power to engineer particular social outcomes, (...) whether in criminal justice, the disciplining of organised labour, the militarisation of national territory and migration, or the extension and deepening of regimes of austerity. This article introduces the recent work of Maurizio Lazzarato, who has argued that the asymmetrical creditor-debtor relationship is now the archetype of contemporary, neoliberal social relations. Ultimately, Lazzarato’s perspective tends to exaggerate the totalising powers of finance capital and leads him to endorse a form of political voluntarism, which fails to address the role of the neoliberal state as a site for forms of authoritarianism which are not solely generated by the debt relation. As a response, it will be suggested that aspects of Nicos Poulantzas’s concept of ‘authoritarian statism’ can be used to both strengthen our understanding of the authoritarian characteristics of the neoliberal state, and to imagine possibilities for resisting its expressions of power. When engaging in a philosophical analysis of body and corporeality in a political context, it is essential to ask to what extent, under what circumstances, and in accordance with what moral norms the state performs actions that have the bodies and lives of citizens as their object. This issue was already discussed in ancient philosophy, examples of which can be found in the writings of Plato and Aristotle, but also in ancient jurisprudence, especially in the law and the legal (...) doctrine of ancient Rome. Aware of such a previous history of studies on this topic, this analysis will discuss the three main ways in which state power over the life and health of citizens is manifested. Namely: (i) capital punishment (ii) policing and (iii) warfare. In addition, it will be indicated, based on Thomistic philosophy, what moral norms govern these state actions. The fundamental differences between the three main state powers — judicial, police, and military — will also be shown in the context of lethal actions undertaken on their basis. (shrink)

This collection seeks to excavate the tradition of radical liberal class analysis, which predated and inspired Marx's reflections on class. Liberal class theory is distinctive because it regards relationship with the state as constitutive rather than just indicative of social class membership. Along with an introduction that frames the discussion historically and conceptually, Social Class and State Power provides readers with easy access to provocative texts from the early modern period to the present.

State-sponsored breastfeeding promotion campaigns have become increasingly common in developed countries. In this article, by using the tools of liberal political theory, as well as public health and health promotion ethics, we argue that such campaigns are not justified. They ignore important costs for women, including undermining autonomy, fail to distribute burdens fairly, cannot be justified neutrally and fail a basic efficacy test. Moreover, our argument demonstrates that breastfeeding campaigns are a rare case that bridges the fields of public (...) health ethics and the ethics of health promotion campaigns. This demonstrates the need to consider the ethics of state promotion of both voluntary and coercive behavioural change that benefits third parties. (shrink)

Persons infected with the Human Immunodeficiency Virus often experience intermittent life-threatening infections, a progressive decrease in cognitive abilities, and a loss of capacity to communicate their wishes to their family and medical care providers. Accordingly, AIDS patients are among those most likely to benefit from the increased availability of legally recognized forms of advance care planning. Although the three countries examined in this article differ greatly in the prevalence of HIV infection, the legal status of advance directives, and in the (...) attitudes toward their use, a collection of case studies is used to demonstrate that an ability to address the specific needs, values and goals of individual patients is promoted by the availability of a variety of options for implementing advance directives or health care proxies. The conclusion of the analysis is that the best option in a specific context will depend upon differences in individual values and medical objectives of the sort discussed in the case studies. Das mit der HIV-Infektion verbundene Krankheitsbild ist durch wechselnde lebensbedrohliche Infektionen und den fortschreitenden Verfall kognitiver Fähigkeiten gekennzeichnet. Es führt zudem häufig zum Verlust der Möglichkeit, Behandlungswünsche gegenüber Ärzten und Angehörigen zu äußern. Deshalb gehören besonders AIDS-Patienten zu denjenigen, die von rechtlich anerkannten vorsorglichen Patientenverfügungen profitieren werden.In diesem Artikel werden drei Länder betrachtet, die sich hinsichtlich der Häufigkeit des Auftretens der HIV-Infektion sowie des rechtlichen Status von und der Einstellung zu Patientenverfügungen erheblich unterscheiden. Fallstudien belegen allerdings, daß nicht allein die kulturellen und sozialen Bedingungen für die jeweils beste Form der Patientenverfügung ausschlaggebend sind. Voraussetzung für die Möglichkeit, den Bedingungen, Wert- und Zielvorstellungen des individuellen Patienten zu entsprechen, ist auf jeden Fall die Verfügbarkeit unterschiedlicher Formen von Patienten- und Betreuungsverfügungen. Auch innerhalb eines Kulturkreises müssen daher verschiedene Formen vorsorglicher Willensäußerungen des Patienten rechtlich anerkannt werden. Welche Art von Verfügung jeweils die beste Option darstellt, ist dabei abhängig von medizinischen Bedingungen und persönlichen Wertvorstellungen, wie sie in den Fallstudien diskutiert werden. Within the field of education management studies, recent reforms promoting devolution and choice are often seen to provide exciting new opportunities. It is claimed that the 'new' education management, with its emphasis on site-based decision-making and consumer accountability, will enable headteachers and principals to 'take control' of their schools and make them more productive environments in which to work and study. However, our review of research findings from five different countries that are putting in place devolution and choice policies suggests (...) that these new opportunities are more illusory than real. Positioned between the competing demands of the state and the market, school managers are becoming increasingly isolated from colleagues and classrooms - leading to a growing divergence between the managers and the managed. The paper considers the implication of recent developments for managers in general and for women managers in particular and concludes by discussing the relationship between the personalisation of responsibility and the legitimation of crises within the state and public education. 정치영역은 국가의 권력과 국민의 권리 사이에 긴장과 담론이 끊이지 않는 공론의 광장이다. 국가의 주권은 국민에게 있고 모든 권력은 국민으로부터 나온다는 헌법조항은 실질적으로 국가의 권력이 어떤 방식으로 행사되어야 하는지에 대한 방향성을 뚜렷하게 제시하고 있다. 국가권력에 대한 이러한 법적 규정은 국민의 동의와 국가권력의 관계를 말해준다. 일반시민들은 대의민주주의제도를 뒷받침하는 정기적인 선거를 통해 그 정당성을 절차적으로 부여한다. 그러나 동시에 이러한 정치적 행위는 한 국가의 국민으로서 국가에 의해 규정되는 의무와 행위에 따르겠다는 권리의 이행과정이며 실제로 국민은 정치적으로 결정되는 많은 사회제도와 법 규정들에 따라야 한다. 그러나 때때로 (...) 우리는 국가가 우리의 삶에 영향을 미치거나 반하는 결정을 내릴 때, 반대의 여론을 형성하고 민주적 시위로써 연대해 간다. 하지만 언제나 이런 정치행위가 국가권력의 결정이나 집행을 제지하거나 재고하도록 만드는 것은 아니다. 국가권력이 국민의 뜻에 반하는 정책을 시행하거나 결정한다면 그 권력은 형식에 있어서 절차적 정당성을 득할 수 있을지는 몰라도 실질적인 정치적 이상으로서 헌법이 나타내는 정당성은 결여하고 있는 것이다. 이런 사태는 국가권력의 정당성이 어떤 방식으로 주어지고 실행가능하게 된 것인지에 대한 정치철학적 고찰을 요청한다. 따라서 본 고에서는 홉스와 로크의 사회계약론적 관점을 통해 국가의 권위와 권력의 정당성에 대한 개념을 살펴보고자 한다. 물론 그 기초적인 가정과 신념들이 우리의 정치적 삶을 규정하는 데 있어 충분하지 않을 수도 있다. 그러나 오늘날 민주화 이후의 민주주의를 고민하는 이 시점에서, 우리는 국가권력에 대한 이해를 정립하고 확장시킬 수 있는 가능한 해석들로서 그것을 비판적으로 수용할 수 있을 것이다. Can computer systems ever be considered moral agents? This paper considers two factors that are explored in the recent philosophical literature. First, there are the important domains in which computers are allowed to act, made possible by their greater functional capacities. Second, there is the claim that these functional capacities appear to embody relevant human abilities, such as autonomy and responsibility. I argue that neither the first (Domain-Function) factor nor the second (Simulacrum) factor gets at the central issue in the (...) case for computer moral agency: whether they can have the kinds of intentional states that cause their decisions and actions. I give an account that builds on traditional action theory and allows us to conceive of computers as genuine moral agents in virtue of their own causally efficacious intentional states. These states can cause harm or benefit to moral patients, but do not depend on computer consciousness or intelligence. (shrink)

Review of Cynthia Daniels, 'At Women's Expense: State Power and the Politics of Fetal Rights'.

This paper has arisen from a concern that much recent policy-related research on markets displays misogynistic tendencies. In both the media and academic accounts it would appear as though the blame for social and educational inequalities can now be laid at the door of women - particularly middle-class mothers. Through examining competing perspectives on how we might understand this attribution of blame, this paper argues that their guilt is best explained not through changes in behaviour but through the conjuncture of (...) shifts in education policy and related research. These shifts have turned the attention of research away from the public domain of the state and the organisational and cultural attributes of schools to focus on the private domain of domestic decision-making. But the representations of these public and private domains are underpinned by unexamined gendered and ideological subtexts which have limited our powers of description and explanation. The paper concludes by suggesting strategies through which we might both address the tacit misogyny in research on markets and develop more sophisticated accounts of contemporary changes. (shrink)

The first part of this evolutionary study of the persistence of the autocratic/oligarchic variety of personal rule in Russia provides a historical overview, followed by two theories explaining why it persisted, interrupted by brief “times of troubles,” for over 500 years. Edward Keenan, on the one hand, hypothesizes successful long-term adaptation to a demanding environment. Richard Hellie, on the other hand, develops a theory of service-class revolutions and a cyclical pattern based on the methods of Russian elites for overcoming relative (...) backwardness. Neither theory takes a neo-Darwinian approach.The second part examines neo-Darwinian evolutionary approaches. In the cosmic perspective of Big History, the human species in its relatively brief existence has had an accelerating impact on other species and the earth’s environment. Biologists modeling complex systems come to a similar conclusion. Agent-driven history, as modeled by demographer Noël Bonneuil, raises questions about the adequacy of the historian’s traditional single-trajectory narrative approach to “the time of human history” and also critiques the biases built into the mathematical models of many evolutionary thinkers. An evolutionary approach to human history does not restrict itself to organic replication, but takes into account populations of evolving human skills and also group projects that act as evolutionary forces as well as units of selection, and outlive generations of organic populations.The third part applies this approach to the Russian tradition of state power by showing how group projects operate as evolutionary forces in a variety of modern power systems. The “parable of the tribes” avers that the aggressive agent in any given power system—ideological, economic, social, military, or political—dictates the dynamics of the system. The “braided stream” approach shows, however sketchily here, how agent-driven modern power systems interact, coevolve, and produce hybrid forms. The article explores Chinese rural migrants’ perspective on work and their relations with each other and with the Chinese state by drawing upon the ethnographical study of a group of rural home renovators in Beijing in the 1990s. The rural renovators were dubbed “guerrilla” workers because of their physical mobility, irregular employment, and unregistered status. After considering the novelty of guerrilla workfare in China, the article demonstrates the bifurcation of migrants’ social networks along the lines of work and everyday (...) association, locates the politics of worker-state interaction at the place of their everyday living, and explores their understanding of work that is remarkably devoid of nostalgia for state socialism. This paper takes as its starting point the problem of characterizing, in a precise way, situations in which two people collaborate to achieve a common goal. It is suggested that collaboration is normally based on an apparently paradoxical state of mind which I call “mutual intention”. Mutual intention is a concept belonging to the same family as Lewis's and Schiffer's “mutual knowledge”. These concepts have the paradoxical feature that they require, for their definition, an infinite series of propositions of (...) the form X knows p, where X is a single agent and p is a proposition. The source of these infinite series is traced, and it is shown that they can be represented in a plausible and enlightening way by means of a recursive notation. Finally, three applications of the concept of “mutual intention” are given: in the semantic analysis of certain sentences with plural subjects; in the analysis of agreement and related speech acts; and in the clarification of the phenomenon of “implicit agreement”. Jerry Fodor has long championed the view, recently dubbed “scientific intentional realism” (Loewer and Ray, 1991, p. xiv), that “a scientifically adequate psychology will contain laws that quantify over intentional phenomena in intentional terms.” On such a view our belief/desire psychology will be “vindicated” through empirical investigation; that is, it will be shown to denote the explanatory (or causally salient) states or events in the production of thought and behavior. That intentional properties, states, or events have causal efficacy---are not mere (...) epiphenomena---is necessary for any such vindication. This paper investigates whether intentional properties can if fact ground or sustain the causal relations empirical psychology aims to reveal. I conclude that intentional properties are not amenable to such an explanatory role, and that, therefore, a different vindication of intentional description is required of the realist. (shrink)

This article examines the relationship between feminism, queer theory and the rise of popular debate over maternity and anti-maternity that has arisen in recent years in France. Through the image of ‘queer maternity’, that is to say, of women who question motherhood from the position of already having had children, the article tries to rethink the way in which feminism, queer theory and motherhood could be placed in relation to one another such that by questioning maternity, the symbolic order that (...) places motherhood on the side of the state and futurity can itself be questioned as a whole. This has particular resonances in the French context where a discourse of ‘natural’ motherhood has come to dominate: the ‘queer’ mother who questions her maternal status is thus argued to represent a threat to the futurity of the family, the social contract and the existing order. Evil remains a primary source of inquiry in contemporary literature of French expression, even among its most secular writers. In considering French-speaking authors from France, Belgium, the United States, the Maghreb, and Sub-Saharan Africa, this collection delineates a rich international perspective on some of the most disturbing events of our time. Each essay testifies to the urgency expressed in works of fiction to give an account of human catastrophes, from the Shoah and the Rwandan genocide to the terrorist attacks of (...) September 11, and the ongoing oppression of women in Islamic nations. Themes underlying this volume include an investigation into the origins of evil, its representations in writing, and the ethical responsibilities of authors who write on human suffering. Contemporary fiction on evil confronts us with fundamental questions: Can evil be attributed to intentionality, is evil "subconscious," or is it the result of impersonal forces? Which styles of writing are ethically appropriate or effective for depicting evil? Can we speak of a veritable "poetics of evil" shared by contemporary authors? When does a literary text on evil become "evil"? In providing informed and nuanced answers to these important questions, the scholars engage in crucial theories of psychoanalysis, post-structuralism, and post-modernism, address a number of issues raised by trauma and genocide studies, and draw from critical frameworks in literary theory on testimony, the limits of representing the extreme, and "transgressive" writing. ObjectiveTo examine how physical and psychological childbirth experiences affect maternal perceptions and experiences of early infant behavioural style.BackgroundUnnecessary interventions may disturb the normal progression of physiological childbirth and instinctive neonatal behaviours that facilitate mother–infant bonding and breastfeeding. While little is known about how a medicalised birth may influence developing infant temperament, high impact interventions which affect neonatal crying and cortisol levels could have longer term consequences for infant behaviour and functioning.MethodsA retrospective Internet survey was designed to fully explore maternal experiences (...) of childbirth and her postnatal perceptions of infant behaviour. Data collected from 999 mother–infant dyads were analysed using Pearson’s correlations and multiple analyses of covariance, employing the Bonferroni method of correction to establish initially significant variables. Multiple linear regressions were conducted to determine major perinatal contributors to perceived early infant temperament.ResultsMultiple regression analyses on each of the eight Mother and Baby Scales outcome variables indicated that early infant behavioural style was largely predicted by subjective maternal states during and post-childbirth, postnatal depression scores, maternal personality traits and infant age. For example, infant age was the most significant predictor of Alert-Responsive infant behaviour, followed by maternal Postnatal Positive experience. In contrast, depression scores were the most significant predictor of Unsettled-Irregular infant behaviour, followed by Anxious-Afraid Birth Emotions and infant age. Mothers also perceived their infants as more Alert-Responsive and Easier overall after a Supported birth experience.ConclusionMaternal and infant outcomes were influenced by multiple physical and psychological perinatal variables. The mother’s subjective experience appeared to be of equal significance to more objective factors. Social support enhanced the mother’s childbirth experience, benefitting her perceptions of her baby’s early temperament. These findings provide further support for current World Health Organisation intrapartum guidelines on the importance of making childbirth a ‘positive experience’ for women. (shrink)

This Article explores the rule of law aspects of the intersection between intellectual property and antitrust law. Contemporary discussions and debates on intellectual property, antitrust, and the intersection between them are typically framed in economically oriented terms. This Article, however, shows that there is more law in law than just economics. It demonstrates how the rule of law has influenced the development of several IP doctrines, and the interface between IP and antitrust, in important, albeit not always acknowledged, ways. In (...) particular, it argues that some limitations on IP rights, such as exhaustion and limitations on tying arrangements, are grounded in rule of law principles restricting the arbitrary exercise of legal power, rather than solely in considerations of economic efficiency. The historical development of IP law has reflected several tensions, both economic and political, that lie at the heart of the constitutional order of the modern state: the tension between the benefits of free competition and the recognition that some restraints on competition may be beneficial and justified; the concern that power, even when conferred in the public interest, can often be abused and arbitrarily. The pursuit of happiness is a long-enshrined tradition that has recently become the cornerstone of the American Positive Psychology movement. However, “happiness” is an over-worked and ambiguous word, which, it is argued, should be restricted and only used as the label for a brief emotional state that typically lasts a few seconds or minutes. The corollary proposal for positive psychology is that optimism is a preferable stance over pessimism or realism. Examples are presented both from psychology and economics that (...) illustrate the dangers of optimism, and in which better outcomes can occur with a pessimistic stance. A more sophisticated approach is then presented in which, in relation to well-being and quality of life, neither optimism nor pessimism is seen as inherently better than the other, but, rather, in which psychological flexibility may contribute optimally to health and well-being. In this article, we address the relevance of J.S. Mill’s political philosophy for a framework of public health ethics. In contrast to some readings of Mill, we reject the view that in the formulation of public policies liberties of all kinds enjoy an equal presumption in their favor. We argue that Mill also rejects this view and discuss the distinction that Mill makes between three kinds of liberty interests: interests that are immune from state interference; interests that enjoy a (...) presumption in favor of liberty; and interests that enjoy no such presumption. We argue that what is of focal importance for Mill in protecting liberty is captured by the essential role that the value of self-determination plays in human well-being. Finally, we make the case for the plausibility of a more complex and nuanced Millian framework for public health ethics that would modify how the balancing of some liberty and public health interests should proceed by taking the thumb off the liberty end of the scale. Mill’s arguments and the legacy of liberalism support certain forms of state interference with marketplace liberties for the sake of public health objectives without any presumption in favor of liberty. Whether in characterizing Catharine MacKinnon's theory of gender as itself pornographic or in identifying liberalism as unable to make good on its promises, Wendy Brown pursues a central question: how does a sense of woundedness become the basis for a sense of identity? Brown argues that efforts to outlaw hate speech and pornography powerfully legitimize the state: such apparently well-intentioned attempts harm victims further by portraying them as so helpless as to be in continuing need of governmental protection. "Whether (...) one is dealing with the state, the Mafia, parents, pimps, police, or husbands," writes Brown, "the heavy price of institutionalized protection is always a measure of dependence and agreement to abide by the protector's rules." True democracy, she insists, requires sharing power, not regulation by it; freedom, not protection.Refusing any facile identification with one political position or another, Brown applies her argument to a panoply of topics, from the basis of litigiousness in political life to the appearance on the academic Left of themes of revenge and a thwarted will to power. How can a just peace be built in sites of genocide, massive civil war, dictatorship, terrorism, and poverty? In Strategies of Peace, the first volume in the Studies in Strategic Peacebuilding series, fifteen leading scholars propose an imaginative and provocative approach to peacebuilding. Today the dominant thinking is the "liberal peace," which stresses cease fires, elections, and short run peace operations carried out by international institutions, western states, and local political elites. As the post-COVID world order necessitates a radical overhaul of the ways in which we understand the very notions of “health”, “care” and “security”, one must revisit Michel Foucault and his works in these shifting times to rethink biopolitics as a category viz-a-viz contemporary globalectics. Ronald Dworkin claims in Life's Dominion that our tradition of religious toleration shields decisions to abort a pregnancy and to end one's life with the assistance of others because they pivot on judgements about the value of human life that are essentially spiritual. He further maintains that the state may regulate these decisions to ensure that they honour appropriately life's sacred or intrinsic value. This article disputes the first of Dworkin's claims. Tolerating other people's religious practices does not entail (...) acquiescing in conduct that is not religiously motivated but springs instead from normal moral judgements. This article also questions whether governments justifiably may protect entities or processes simply because some citizens deem them intrinsically valuable. If, despite these doubts, one concludes that the state may assume this protective role, I argue that it probably can enact tighter constraints on abortion and assisted suicide than Dworkin thinks permissible.
