The article aims to analyze the semantic fields of two Korean terms in the field of a specialized judicial terminology, i.e. court and tribunal, which are usually reflected in English by one hypernym term court. This analysis, although carried out on limited Korean data, is intended to indicate the differences between the use of these two different Korean terms and to indicate the reasons why court is currently the most common English equivalent. At the same time, the author, (...) by pointing to the historical and cultural background, explains the reasons why the term court is not always correct. The methods used in compiling the data are to highlight differences in the semantics of Korean terms covered by an English hypernym court. (shrink)

Indexical reference is personal, ephemeral, confrontational, and executive. Hence it is not reducible to nonindexical reference to what is not confronted. Conversely, nonindexical reference is not reducible to indexical reference. (Castañeda 1989, p. 70).

The paper develops the idea that institutions are enablers. However, they do not only enable individuals and collectives to achieve their goals; first and foremost, they enable individuals and collectives to have a goal, to select and recognize certain possible states of affairs as targets of action, and as a result, to have a demand – especially a demand for further institutions. I make the case that properly functioning institutions are dedicated to making these states of affairs epistemically acquaintable. What (...) I will stress in particular is that acquaintance is first realized in the form of questions, which are linguistic expressions of acts of problematization. However, I will discuss less what an individual subject questions, but rather what the social dynamic of questioning is. This dynamic will be conceptualized in terms of epistemic dependence, and it will be singled out as the dynamic that gives rise to institutions. (shrink)

Th e present paper examines three kinds of theories concerning the rigidity of general terms—extensionalist, essentialist and intensionalist theories. It is argued that both essentialist and intensionalist theories cannot deal successfully with a number of problems and that the notions of rigidity they propose for general terms lack suffi cient explanatory power. A version of the extensionalist theory, supplemented with a hierarchy of intensions, is defended. Th e theory has surprising consequences, e.g., that ‘tiger’ and some other natural (...) kind terms are, contrary to the widespread opinion, non-rigid. (shrink)

Recent experimental studies have claimed to find evidence for the view that natural kind terms such as “water” are ambiguous: that they have two extensions, one determined by superficial properties, the other by underlying essence. In an online experiment, we presented to 600 participants scenarios describing discoveries of novel samples that differ in deep structure from samples of a familiar kind but are superficially identical, such as a water-like substance that is not composed of H2O. We used three different (...) types of question sets to probe whether the participants considered the sample as a member of the kind or not. Our results did not confirm the predictions of the ambiguity view. They were, rather, consistent with views that take underlying essences to be the sole criterion for membership in a natural kind. Saul Kripke in his revolutionary and influential series of lectures from the early 1970s (later published as the book Naming and Necessity) famously resurrected John Stuart Mill's theory of proper names. Kripke at the same time rejected Mill's theory of general terms. According to Kripke, many natural kind terms do not fit Mill's account of general terms and are closer to proper names. Unfortunately, Kripke and his followers ignored key passages in Mill's A System of Logic in (...) which Mill enunciates a sophisticated and detailed theory of natural kind terms that anticipates and is in some ways superior to Kripke's. Ethicists are typically willing to grant that thick terms (e.g. ‘courageous’ and ‘murder’) are somehow associated with evaluations. But they tend to disagree about what exactly this relationship is. Does a thick term’s evaluation come by way of its semantic content? Or is the evaluation pragmatically associated with the thick term (e.g. via conversational implicature)? In this paper, I argue that thick terms are semantically associated with evaluations. In particular, I argue that many thick concepts (if not all) (...) conceptually entail evaluative contents. The Semantic View has a number of outspoken critics, but I shall limit discussion to the most recent--Pekka Väyrynen--who believes that objectionable thick concepts present a problem for the Semantic View. After advancing my positive argument in favor of the Semantic View (section II), I argue that Väyrynen’s attack is unsuccessful (section III). One reason ethicists cite for not focusing on thick concepts is that such concepts are supposedly not semantically evaluative whereas traditional thin concepts (e.g. good and wrong) are. But if my view is correct, then this reason must be rejected. (shrink)

Terms of service of on-line platforms too often contain clauses that are potentially unfair to the consumer. We present an experimental study where machine learning is employed to automatically detect such potentially unfair clauses. Results show that the proposed system could provide a valuable tool for lawyers and consumers alike.

In this work we study, design, and evaluate computational methods to support interpretation of statutory terms. We propose a novel task of discovering sentences for argumentation about the meaning of statutory terms. The task models the analysis of past treatment of statutory terms, an exercise lawyers routinely perform using a combination of manual and computational approaches. We treat the discovery of sentences as a special case of ad hoc document retrieval. The specifics include retrieval of short texts, (...) specialized document types, and, above all, the unique definition of document relevance provided in detailed annotation guidelines. To support our experiments we assembled a data set comprising 42 queries which we plan to release to the public in the near future in order to support further research. Most importantly, we investigate the feasibility of developing a system that responds to a query with a list of sentences that mention the term in a way that is useful for understanding and elaborating its meaning. This is accomplished by a systematic assessment of different features that model the sentences’ usefulness for interpretation. We combine features into a compound measure that accounts for multiple aspects. The definition of the task, the assembly of the data set, and the detailed task analysis provide a solid foundation for employing a learning-to-rank approach. (shrink)

This paper introduces a new method of interpreting complex relation terms in a second-order quantified modal language. We develop a completely general second-order modal language with two kinds of complex terms: one kind for denoting individuals and one kind for denoting n-place relations. Several issues arise in connection with previous, algebraic methods for interpreting the relation terms. The new method of interpreting these terms described here addresses those issues while establishing an interesting connection between λ and (...) ε calculi. The resulting semantics provides a precise understanding of the theory of relations. (shrink)

Following the influential thought experiments by Hilary Putnam and others, philosophers of language have for the most part adopted semantic externalism concerning natural kind terms. In this article, we present results from three experiments on the reference of natural kind terms. Our results confirm some standard externalist assumptions, but are in conflict with others: Ordinary speakers take both appearance and underlying nature to be central in their categorization judgments. Moreover, our results indicate that speakers’ categorization judgments are gradual, (...) and proportional to the degree of similarity between new samples and familiar, “standard” samples. These findings pose problems for traditional theories, both externalist and internalist. (shrink)

According to republican theory, we are free persons to the extent that we are protected and secured in the same fundamental choices, on the same public basis, as one another. But there is no public protection or security without a coercive state. Does this mean that any freedom we enjoy is a superficial good that presupposes a deeper, political form of subjection? Philip Pettit addresses this crucial question in On the People's Terms. He argues that state coercion will not (...) involve individual subjection or domination insofar as we enjoy an equally shared form of control over those in power. This claim may seem utopian but it is supported by a realistic model of the institutions that might establish such democratic control. This article considers the application of sexual selection theory to the study of religion by discussing the basic concepts and theories in sexual selection and then outlines possibilities of its application to the study of the evolution of religion. The first section outlines basic principles in the sexual selection account, including the evolution of human mating strategies based on dimorphism, gender differences in human mating strategies, and the role of different cultural activities in mating dynamics. Such an overview may be (...) useful for the readers who are less familiar with the basic assumptions of the sexual selection theory. The remaining sections demonstrate how religion may function as a signal for mating qualities associated with a long-term mating strategy and how different facets of religiosity may help to support long-term mating strategies. The key idea of the article is that there are good reasons to try to explain the evolution of at least some of the components of religion in terms of sexual selection. (shrink)

The aim of this paper is to understand why empiricist philosophers of language did not try to refute the Leibniz-Beauzée argument, which questioned the genetical priority of proper names. It is shown that, within the semantic theory which underlies the empiricist doctrine, one may assume that all general terms derive from particular names, while conceding that every proper name can be etymologically traced back to the ancestor of a common noun.

The is an old question over whether there is a substantial disagreement between advocates of different logics, as they simply attach different meanings to the crucial logical terminology. The purpose of this article is to revisit this old question in light a pluralism/relativism that regards the various logics as equally legitimate, in their own contexts. We thereby address the vexed notion of translation, as it occurs between mathematical theories. We articulate and defend a thesis that the notion of “same meaning” (...) is itself context-sensitive, depending on the purposes of a given conversation. (shrink)

In this article we discuss the problem of finding an interpretation of quantum mechanics which provides an objective account of physical reality. In the first place we discuss the problem of interpretation and analyze the importance of such an objective account in physics. In this context we present the problems which arise when interpreting the quantum wave function within the orthodox formulation of quantum mechanics. In connection to this critic, we expose the concept of ‘entity’ as an epistemological obstruction. In (...) the second part of this paper we discuss the relation between actuality and potentiality in classical and quantum physics, and continue to present the concept of ontological potentiality which is distinguished from the generic Aristotelian notion of potentiality in terms of ‘becoming actual’. In this paper our main aim is to provide an objective interpretation of quantum mechanics which allows us to discuss the meaning of physical reality according to the theory. For this specific propose we present the concept of faculty in place of the concept of ‘entity’. Within our theory of faculties, we continue to discuss and interpret two paradigmatic experiments of quantum mechanics such as the double-slit and Schrodinger’s cat. (shrink)
