Pang Laikwan Identity Politics and Democracy in Hong Kong’s Social Unrest Hong Kong’s anti-Extradition Law Amendment Bill (anti-ELAB) movement began with legislation proposed in February 2019 to allow the transfer of fugitives to jurisdictions with which the city lacks formal extradition treaties. The law quickly attracted a tremendous amount of criticism and generated enormous anxiety because mainland (...) China was one of those jurisdictions.1 In fact, many believe that this bill was proposed to allow the government of the People’s Republic of China (PRC) to transfer wanted persons of any nationality from Hong Kong to China, subject to a legal process that many view as highly dubious. A large-scale anti-government movement exploded in June 2019 when pro-establishment legislators in Hong Kong insisted on passing it, and millions of people took to the streets. The government waited three months to withdraw the bill, only doing so after some of the most violent confrontations between civilians and the police in Hong Kong’s history. With Beijing’s 1. The law was originally proposed after a Hong Kong man, who killed his pregnant girlfriend in Taiwan, could not be extradited back to Taiwan to stand trial for the murder due to the lack of formal extradition laws. The proposed law, which would be applied to Hong Kong citizens, foreign residents, and even people passing through on business or as tourists, is being opposed due to the fear that it would be used to extradite Hong Kong political/civil rights activists and dissidents to China, where they would be harshly punished. As people have become completely disillusioned with the government and their own futures, tensions have increased. Collapsing many of the city’s socioeconomic problems into one cause, the anti-ELAB movement is primarily an anti-authoritarian impulse motivated by the unifying power of the term “Hongkongers.” As the movement unfolds, one of the most popular slogans, “Add Oil, Hongkongers!” (meaning “Keep going, Hongkongers!”) gradually transformed into “Rebel, Hongkongers!” and “Revenge, Hongkongers!” showing the protestors ’ anger about unrestrained police violence and the Beijing regime behind it. The militarization associated with these protests is both worrisome and symptomatic. This short essay analyzes this movement and uses it as a vehicle to disentangle social and political identity. My concern is about how a large-scale political movement can realign identities to generate power from the bottom. I use an Arendtian approach to ground my theoretical orientation, asking: How can political actions be understood as the pursuit of freedom to transcend one’s biological and social identity? From an intersectional feminist angle, if we are aware that social discrimination operates within a complex network of simultaneous discriminations, real social change can only be envisioned using a broad political canvas. Hong Kong’s anti-Extradition Law Amendment Bill movement provides such a setting. Division and Inclusion “The people” might be the emptiest, but also the most powerful, phrase in the modern political lexicon. It can be used by politicians to justify groundless proposals or criticisms, but it is also the foundation and source of legitimacy for all modern political institutions. Indeed, the most basic meaning of democracy is “rule of the people,” which is impossible to avoid in any democratic imagination. As has been widely seen throughout the world, however, “the people” is often attached to various degrees of xenophobia—hatred of outsiders in the name of in-group solidarity. The new frontiers in the philosophy of intellectual property lie squarely in territories belonging to moral and political philosophy, as well as legal philosophy and philosophy of economics – or so this collection suggests. Those who wish to understand the nature and justification of intellectual property may now find themselves immersed in philosophical debates on the structure and relative merits of consequentialist and deontological moral theories, or disputes about the nature and value of privacy, or the relationship between national (...) and global justice. Conversely, the theoretical and practical problems posed by intellectual property are increasingly relevant to bioethics and philosophy and public policy, as well as to more established areas of moral and political philosophy. In the intellectual confusion prevailing since the demise of Marxism and “marxism”, the attempt is made to define democracy as a matter of pure procedure, explicitly avoiding and condemning any reference to substantive objectives. It can easily be shown, however, that the idea of a purely procedural “democracy” is incoherent and self-contradictory. No legal system whatsoever and no government can exist in the absence of substantive conditions which cannot be left to chance or to the workings of the “market” but (...) must be posited as objectives of political activity. The confusion results from a deficient understanding of what makes a society and an empty idea of “freedom”. The objective of politics is not happiness, an affair to be left to the individuals, but it certainly is liberty understood as participation in the governance of the polity; it is also the pursuit of the common good, defined as the sum of the prerequisites and facilitations of individual autonomy depending on collective action, and as the realization of commonly agreed collective goals. What does a global morality look like? Lee argues that King’s metaphor of a great world house provides a structure on which to frame the content of a healthy global morality in a shrinking world. The metaphor indicates a collective understanding of all humanity as a global community (ix). The notion of a single world house moves people groups beyond rival communities with well-defined in-group and out-group barriers into what Lee describes as a global civil society where we are all seen as members of a collective in-group (13). The concept of a collective in-group helps illustrate what Lee understands to be King’s argument for a global morality; “King’s idea of a great world house redefines what the boundaries and membership of a moral community are: the great world house constitutes a single inclusive ethical community for humanity because it identifies the world as a single unified community” (53). [End Page 234]But as laudable as King’s great world house metaphor is, we are still burdened with the task of imagining a universal moral language in practice. Efforts toward the formation of universal truths have historically been death-dealing for people groups caught on the wrong side of the color line. A one-size-fits-all morality has been a procrustean bed for people who have been racialized and subordinated to white European males. Yet Lee interprets King’s method of universal engagement to begin with convictions shared at home within the particularity of his African American Christian worldview before it moves outward toward a shared vision of a global civil society. The movement from particular to universal for a public morality is unlike the historically harmful practice of universal morality. King’s universal method includes attention to four components: vision, norms, virtues, and political practices. These four components belong to what Lee depicts as a careful and intricate dialectic between what is local and what is universal in a political dialogue that seeks the end of a global civil society with shared conceptions of community and human rights.Ironically, with regard to the conversation about human rights, Lee claims that King’s formative African American interpretation of human rights was primarily informed by the Enlightenment and then blended with an African American experience: “Mostly appropriated from Christianity and the Western Enlightenment tradition, these norms [justice, freedom, and equality] obtained a new significance for African Americans in the context of the sizzling cauldron of slavery and segregation” (55). Yet one would be hard pressed to identify the presence of modern Enlightenment intellectuals within the formative theological worldview of the African American Christianity that Lee identifies. Of necessity, African American Christianity, the Christian worldview that birthed Martin Luther King Jr., was formed to deflect the white Christian worldview that was shaped by the intersection of race, religion, and empire in modernity. This book critically investigates the notion of democracy without demos by unravelling the link that modern history has established between the concepts of democracy and the sovereignty of the people. This task is imposed on us by globalization. The individualization of the subject of rights is the result of the destruction of regimes of special rights of ancient societies by the centralizing action of a territorial power. This individualization, because it implies equality, has created a new form of political (...) subjectivity that has been the driving force of the democratization of democracies during the 19th and 20th centuries. Democracy and subjective rights discusses how asserting itself as the only guarantor of rights, the modern state has also nationalized citizenship. However, the author argues, the legal and judicial monopoly of the nation-state is weakened today by the multiplication and heterogeneity of the powers on which the rights of individuals depend. In the volatile conflicts that inaugurated the twenty-first century, secularism, democracy, and freedom were identified by Western nation-states as symbolizing their civilizational values, in contrast to the fanaticism, misogyny, and homophobia they attributed to “Islam.” The figure of the Muslim was thus transformed into an existential threat. This paper analyzes an exchange among scholars—Is Critique Secular? Blasphemy, Injury, and Free Speech—that engages these highly contested issues. As such, the text provides a rare opportunity to study how particular significations of (...) the West, its epistemological tradition, and its relation with Islam are contested and negotiated in a critically engaged site during a moment of global crisis. My reading of the text leads me to argue that the stabilization of the epistemic power of the West is presently reliant on a new iteration of its foundational philosophical concepts to suppress counter-hegemonic narratives that foreground its forms of violence. Further, the terrain for this reshaping of the dominance of this tradition is gender/sexuality, such that queer politics are located at the forefront of the Western politico-philosophical project. In this article the author examines the first domestic philosophical debate between the two authors who perform within liberal positions. It is a debate between Leon Kojen and Aleksandar Pavkovic, conducted during 1985 in the pages of several national magazines. The main subject of controversy is the question of establishment of liberalism. Kojen is committed to seeing that liberalism is based on the equal rights, equal rights to freedom. ArgumentUp until the French Revolution, European mathematics was an “aristocratic” activity, the intellectual pastime of a small circle of men who were convinced they were collaborating on a universal undertaking free of all space-time constraints, as they believed they were ideally in dialogue with the Greek founders and with mathematicians of all languages and eras. The nineteenth century saw its transformation into a “democratic” but also “patriotic” activity: the dominant tendency, as shown by recent research to analyze this transformation, seems (...) to be the national one, albeit accompanied by numerous analogies from the point of view of the processes of national evolution, possibly staggered in time. Nevertheless, the very homogeneity of the individual national processes leads us to view mathematics in the context of the national-universal tension that the spread of liberal democracy was subjected to over the past two centuries. In order to analyze national-universal tension in mathematics, viewed as an intellectual undertaking and a profession of the new bourgeois society, it is necessary to investigate whether the network of international communication survived the political, social, and cultural upheavals of the French Revolution and the European wars waged in the early nineteenth century, whether national passions have transformed this network, and if so, in what way. Luigi Cremona's international correspondence indicates that relationships among individuals have been restructured by the force of national membership, but that the universal nature of mathematics has actually been boosted by a vision shared by mathematicians from all countries concerning the role of their discipline in democratic and liberal society as the basis of scientific culture and technological innovation, as well as a basic component of public education. Gamwell offers a defense of transcendental metaphysics, especially in its neoclassical form, and builds a case for its importance as a tool for addressing abiding problems in morality and philosophical theology-including talk about God, human fault, moral decision, and the relationship of politics and religious freedom. In Part I, Gamwell argues against Kant and a wide range of contemporary philosophers, for the validity of transcendental metaphysics designated in the strict sense, i.e., as an (...) explication of the possible as such or existence as such, as the most general features or conditions all possible things have in common. He engages with Aquinas, Schleiermacher, Augustine, and Niebuhr to argue that neoclassical metaphysics, for which the divine whole is itself temporal or forever self-surpassing, provides a more coherent account of God than does classical metaphysics, for which the divine whole is completely eternal. In particular, I read Du Bois’s “afterthought” in Souls of Black (...) Folk as a form of critique that is expressly pedagogical, in that it prepares black individuals to play their destined role in this new era of history, and it calls for a continuous rethinking of the politics of higher education. While describing his early academic, political, and intellectual journey, Du Bois alludes to his initial and persistent concern with the impact of education on the formation of black men’s civil subjectivity. Through suspicion, a different possibility appears for thinking black individuals’ relationship with the world. Liberal democracy suffers from an internal contradiction stemming from its ideological roots and rending it from within. On the one hand its goal is to generate a system of laws and rules that maximize individual rights and liberties; on the other hand, some of its fundamental assumptions pertaining to the Subject restrict the political and social agent's existential experience to a limited threshold of speech and action. The central assumption of this article is that the main meeting point of (...) the critics of modernity, Apel and Habermas primarily, and the post-structuralists, Foucault and Deleuze, in regard to the Subject, rehabilitates liberal discourse and creates an opening for a political theory that maximizes the freedom of the individual as a structured, anti-essentialist Subject. I will show that the expansion of the concept of the self in the two streams sheds new light on the concepts of political control and liberty, and in this way extends the normative discussion of all aspects of the political agent's status in a modern democracy. This paper subjects to critical analysis four common arguments in the sociopolitical theory literature supporting the cultural nationalist thesis that liberal democracy is viable only against the background of a single national public culture: the arguments that (1) social integration in a liberal democracy requires shared norms and beliefs (Schnapper); (2) the levels of trust that democratic politics requires can be attained only among conationals (Miller); (3) democratic deliberation requires communicational transparency, possible in turn only within a shared national public (...) culture (Miller, Barry); and (4) the economic viability of specifically industrialized liberal democracies requires a single national culture (Gellner). I argue that all four arguments fail: At best, a shared cultural nation may reduce some of the costs liberal democratic societies must incur; at worst, cultural nationalist policies ironically undermine social integration. The failure of these cultural nationalist arguments clears the way for a normative theory of liberal democracy in multinational and postnational contexts. (shrink)

A new history of liberalism which argues that liberalism has been predicated on definite morality and should be viewed as an attempt to encompass both fear and hope. Liberalism, argues Alan Kahan, is the search for a society in which people need not be afraid. Freedom from fear is the most basic freedom. If we are afraid, we are not free. These insights, found in Montesquieu and Judith Shklar, are the foundation of liberalism. What liberals fear has changed over time (...) (revolution, reaction, totalitarianism, religious fanaticism, poverty, and now populism) but the great majority of liberal thinkers have relied on three pillars to ward off their fears and to limit the concentrated power that causes fear: freedom, markets, and morals, or, to put it another way, politics, economics, and religion or morality. Most liberal thinkers emphasize one or two pillars more than another, but it is typical of liberalism down to the Second World War to rely on all three, although there were always minority voices who preferred to stand on only one leg. After WWII, "thin" procedural/market liberals, who wanted to strip any moral or religious basis or purpose from liberalism, dominated "thick" liberal moralists, who thought liberalism needed a moral basis and/or goal. It is the political contention of this book that liberalism is most convincing as program, language, and social analysis when it relies on all three pillars, and that the relative weakness of liberalism at the end of the twentieth century had much to do with neglect of the moral pillar of liberalism. Its historical contention is that for much of the past two centuries it did rely on all three pillars. But Kahan also argues that liberalism is not only a party of fear. It is also a party of hope, or the party of progress. Many of the contradictions typical of liberalism derive from the seemingly contradictory effort to encompass both hope and fear. If in case of conflict fear often trumps hope for liberals (loss aversion applies in politics as much as in economics), and utopia is subject to indefinite postponement, progress in personal autonomy and development has always been at the heart of liberalism. Liberals typically support their hopes on the same three pillars of freedom, markets, and morals which they use to ward off their fears. Nevertheless, in one respect those historians and political theorists who identify liberalism with laissez-faire economics are not wrong. It is characteristic of liberalism then that it bases its hopes not on the state but on civil society, which for liberals is the common source of a free politics, a free market, and of morals. As with terms such as “human rights”, “democracy”, and “equality”, the notion of “freedom” has an emblematic character with highly normative overtones. After the declaration of universal human rights, one might argue that freedom is – at least formally – a universal entitlement belonging to every human being. However, this universalist structure is built upon a conflictual foundation, as the juridico-political meaning of freedom is determined by the boundaries of national citizenship, statehood, and territorial sovereignty. This chapter examines refugeehood (...) as a normal by-product of the post-colonial world order, embodying the counter-history of nation-states whose internal borders, walls, and external fortifications are growingly being militarised and reinforced. Refugeehood represents an anomalous juridico-political condition that cannot be elucidated by colonial-racial binaries such as inclusion versus exclusion or rightlessness versus national citizenship. The central idea of this chapter is that, for refugees, the meaning of freedom and unfreedom are intertwined and should be approached as a dynamic relationship characterising the state of (non)-subjectivity. As political (non)-subjects, refugees call structural determinations of unfreedom into question. Refugees’ freedom is expressed in the act of flight and border crossing, irregular migratory movement, language games of resistance, and other emancipatory signifying practices by which they claim a place of refuge in the world. In the past few years, several democratic governments have published their National AI Strategies (NASs). These documents outline how AI technology should be implemented in the public sector and explain the policies that will ensure the ethical use of personal data. In this article, I examine these documents as political texts and reconstruct the political imaginary that underlies them. I argue that these documents intervene in contemporary democratic politics by suggesting that AI can help democracies overcome some of (...) the challenges they are facing. To achieve this, NASs use different kinds of imaginaries—democratic, sociotechnical and data—that help citizens envision how a future AI democracy might look like. As part of this collective effort, a new kind of relationship between citizens and governments is formed. Citizens are seen as autonomous data subjects, but at the same time, they are expected to share their personal data for the common good. As a result, I argue, a new kind of political imaginary is developed in these documents. One that maintains a human-centric approach while championing a vision of collective sovereignty over data. This kind of political imaginary can become useful in understanding the roles of citizens and governments in this technological age. (shrink)

Frederick Douglass (1817?–1875) is a monumental American figure. As a runaway slave and leading black thinker, speaker, and writer in the abolitionist movement and during Reconstruction and its tragic collapse, his legacy in American history is singular. His ideals and scorching criticisms have marked American political thought about democracy, religion, race, racism, liberty, and equality. American political parties claim him, especially the Republican Party, with which he has an early connection and which has used his figure as cover (...) for their less than egalitarian projects, as do different ideological camps. One can find accounts of Douglass as an existentialist, revolutionary, proto-libertarian, liberal, civic republican thinker. His North Star continues to guide those who welcome its light, although it may lead them down different political-ideological paths.In all of this, one can imagine that those not familiar with the details of Douglass’s narratives and deeds might, in the context of all of that national hagiography, lose track of the fact that he was a black man. Frederick Douglass was a black man born into slavery, survived that brutal regime for twenty-one years, and then escaped and became a principal leader of the American abolition movement and leading black political thinker. Shortly after escaping slavery, he wrote his first famous autobiography, The Narrative of the Life of Frederick Douglass, and subsequently two more, in addition to volumes of speeches, articles, and a novel. It is as if his monumentality, like marble, alabaster, or bronze—the stuff of civic memorials—would obscure that irreducible fact in its grand monotones.Nick Brommell’s The Powers of Dignity: The Black Political Philosophy of Frederick Douglass reminds readers that that irreducible fact is a nontrivial, essential element of Douglass’s life and work. Bromell argues that this includes the political theory, a product of Douglass’s black political philosophy that runs through it all. He contends that Douglass argued for an inclusive conception of personhood and active citizenship, which America’s founding public philosophy, distorted by white supremacy, purposefully did not. Its elements include a defense of the moral personhood of blacks and their full and equal citizenship and a view of political community enlivened by group solidarities and active citizenship in defense of justice.In the course of his analysis, Bromell, a literary theorist, draws on an assortment of contemporary philosophical, rhetorical, and political theories, all of which have a critical theoretical bent, to explicate Douglass’s ideas. This method bears fruit in an instructive analysis of the rhetorical structure of Douglass’ his arguments. Brommell’s analysis of Douglass’s My Bondage and My Freedom usefully explains how it stands out, not only in terms of updated autobiographical details, but also style and analytical and argumentative intent. This is a reading that other scholars have pioneered, but his rhetorical analysis fleshes out, for example, the role of moral sentiments, care, and intimate and social relations in Douglass’s narrative.A central feature of Bromell’s analysis is that Douglass employs what he and others call a “fugitive rhetoric” that comprises an emphasis on the perspective of his and other black Americans’ standpoints, the holding of opposite ideas in tension, and the use of the rhetorical technique “chiasmus,” where a statement is repeated in reverse order in successive phrases or clauses. It is an illuminating analysis, but Bromell goes further by claiming that Douglass was committed to the tenets of contemporary standpoint epistemology. Douglass certainly referenced and employed his experience and viewpoint as a black man and former slave in his work, just as he directly addressed the viewpoints and interests of black Americans. However, whether this means that Douglass was committed to the set of ideas that we now call standpoint epistemology is another matter. This concern applies to Bromell’s reading of Douglass’s method of holding seemingly contrasting ideas in tension and his use of chiasmus. Contemporary philosophical theories of chiasmus carry particular metaphysical and epistemological implications, and those theories might shed light on Douglass’s political projects. However, their incidental utility does not mean they definitively describe Douglass’s intent or public philosophy. This is a specifically important point because those theories lead to subjective conceptions of truth, especially relating to ethics and politics, while Douglass, as Bromell recognizes, repeatedly and emphatically endorsed what he took to be universal normative truths.In the same vein, Bromell makes several additional claims regarding the conceptual distinctiveness of Douglass’s view of power, dignity, rights, and citizenship. Douglass employed conceptions of each and other important ideas specific to his style, approach, and ends. As other black political thinkers did before him, he used these concepts to condemn slavery, racism, and the hypocrisy of American Republicanism and Christianity to assert the equal moral personhood and dignity of blacks and demand equal rights and citizenship. Bromell rightly emphasizes the role of “power,“ as an individual capability, in Douglass’s view of natural rights, moral dignity, and citizenship. It is an emphasis that is in keeping with both Douglass’s personal narrative and his national political projects. Douglass did not think that Americans—that Black Americans or abolitionists—should passively wait for deliverance from either God or national political leadership. Likewise, Bromell is correct to push back on reductions of Douglass’s views to Lockean, Rousseauian, or Kantian interpretations. Douglass is more than an incarnation of standard deontological, liberal, or civic republican philosophy. As a nineteenth-century black radical thinker, he stood in relation and contributed to those moral and political philosophical traditions. However, Bromell’s claim that Douglass’s conceptions of power, natural rights, and citizenship are conceptually distinct from the large host of major philosophical, theological, and political theoretical accounts that preceded him and influenced those ideas in his time is suggestive but not decisive.Like other writers and theorists before him, Bromell offers us another Douglass—as a black critical political theorist. This is a testament to the fecundity of Douglass’s black political-philosophical legacy. It is a legacy that leads to competing interpretations of him; all the same and for all their differences, his scorching prophetic vision of liberty, equality, citizenship, and progress unites them all. Notions of democracy and nationhood constitute the pivotal legacy of the American Revolution, but to understand their development one must move beyond a purely American context. Citizens of a Common Intellectual Homeland explores the simultaneous emergence of modern concepts of democracy and the nation on both sides of the Atlantic during the age of revolutions. Armin Mattes argues that in their origin the two concepts were indistinguishable because they arose from a common revolutionary impulse directed against the prevailing hierarchical (...) political and social order. The author shows how the reconceptualization of democracy and the nation, which resulted from this revolutionary impulse, received its decisive form from the French Revolution. Although the French Revolution was instrumental in redefining the two terms, however, neither were these changes confined to France, nor did the new meanings merely radiate from France to other countries. To illustrate the transatlantic emergence of these ideas, Mattes considers the works of pairs of prominent intellectual contemporaries--one in America and the other in Europe--each writing on a common topic. The thinkers and topics include Thomas Paine and Edmund Burke on the transatlantic revolutions, John Adams and Friedrich von Gentz on the mixed constitution, James Madison and Immanuel Kant on perpetual peace, and Thomas Jefferson and Destutt de Tracy on the nation. Mattes's approach highlights the significant impact that the French Revolution had on the evolution of thought in the period, demonstrating that the emergence and early development of modern concepts of democracy and the nation in America were intimately tied to revolutionary events and processes in the larger Atlantic world. Alessandro Ferrara’s argument in Sovereignty Across Generations takes shape within a broadly Rawlsian ‘political liberal’ framework of thought about moral underpinnings for a constitutional-democratic practice of politics. Where, exactly (I ask here), is the place within that thought for concern about occurrences in a country’s past of popular constituent power? If the country’s currently established constitutional regime is fully democratic (and is otherwise morally in order) by whatever operational measures you and I might think to apply, why should we (...) or anyone care about how or by whose authority the regime got set up and running in the first place? By Ferrara’s Rawls-inspired teaching in Sovereignty Across Generations, the answer to that question will come from a certain conception of political legitimacy. But then a potent objection comes from those who press the question of how to reconcile a democratic conception of legitimacy with a subjection of current (say) deliberative-majoritarian rule to antecedently imposed terms of constraint. Under Rawlsian and Ferrarian stimulus, I look into the possible relevance here of H.L.A. Hart’s proposition of a complementarity or fusion, in our concept of law, of an ‘internal’ with an ‘external’ perspective that those involved may adopt toward the coercive social practice in question. Underlying the Rawlsian constitutional proposition on legitimacy, I end by suggesting, is the thought that, in order for a person to live in freedom under law, that person will have to sustain simultaneously an internal attitude of bonding to their society’s own ongoing project of legality and an external attitude of critical judgemental of that project as reasonably and rationally acceptable to free and equal citizens in conditions of reasonable pluralism. Conventional narratives hold that parties are “the orphans of political philosophy” and that systematic normative justifications of parties and partisanship have emerged only in recent years in the West. This article aims to show that when antiparty sentiments were prevalent in late nineteenth- and early twentieth-century Western societies, a systematic justification of party politics existed in China. Western antipartyism in that time shifted from an older accusation that parties were divisive and subversive to a “progressive antipartyism” that portrayed parties (...) as elitist and antidemocratic “machines.” In China, however, although proparty intellectuals faced the first type of antipartyism, the “progressive” type was relatively absent, as there weren’t any mature party machines in the first place. Far from being a hindrance to democracy, parties comprised of public-spirited elites were justified as an instrument for political founding: transforming passive subjects under an imperial despotism into modern active citizens in a constitutional democracy. The aim of this article is to investigate the Habermasian way of problematizing the European political situation through consideration of the conceptual framework within which he develops his proposal. I begin by clarifying various conceptual difficulties that emerge when thinking about politics within the European Union. I then focus on the concept of popular sovereignty as procedure, which Habermas develops in Between Facts and Norms against the historical backdrop of the nation state. In the debate regarding European constitutionalization, (...) the concept of popular sovereignty as procedure first assumes a critical function against proponents of the no demos thesis. More recently, Habermas has advanced a concept of shared/divided sovereignty, which becomes indispensable when we consider Europe as a democratic federation. The conclusions hereby drawn disclose two problematic aspects of Habermas’s recent proposal. Respectively, these concern the viability of his approach and the questionable plausibility of this proposed federation’s ability to uphold democracy in terms of self-determination. (shrink)

Democratic politics is always identity politics and there are some varieties of identity politics without which full and genuine democratic cooperation would not be possible. Indeed, the very existence of a democratic people involves mobilization of political concern and action around a democratic national identity. But a genuinely democratic national identity must be an open identity that can accommodate internal complexity and acknowledge external responsibilities. Moreover, in democracies characterized by a history of discrimination and oppression, there must also be (...) political space for a revitalizing identity politics that initially mobilizes political concern and action around the identities of those groups that have been subject to discrimination and oppression. Yet a revitalizing identity politics is likely to go awry if it is hostile to the possibility of reconciliation between the oppressed and former oppressors, or intrinsically resistant to political collaborations that might transcend the boundaries of familiar social groups. ‘The one who peers into the perfect law of freedom and perseveres, and is not a hearer who forgets but a doer who acts, such a one shall be blessed in what he does’ (James 1:25). Freedom, in one sense of the word or another, is a central theme of the bible, the Old Testament as well as the New. During the Middle Ages, Christian theologians developed this theme into a doctrine of the natural right of freedom of the individual (...) or natural person and made it into a moral and intellectual bulwark against the encroachments of the modern state. The classical liberal or libertarian tradition in Western political thought, from John Locke to the American Founding Fathers to Friedrich Hayek and Murray Rothbard, owes an immense debt to the likes of Thomas Aquinas, Jean Gerson, Francisco de Vitoria, Juan de Mariana and Batholomé de las Casas. Not coincidentally Christianity and classical liberalism together went into rapid decline towards the end of the nineteenth century and especially in the globalisation of European wars in the twentieth century. At that time, mass democracy and national expediency became the pretexts of choice to subvert constitutional limitations on the use of political power. The decline was not halted —was perhaps even accelerated—when Christians and liberals alike began to adopt ‘social doctrines’ and the advocacy of social policies that only confirmed the impression that there is no salvation outside the state. However, I do not intend to describe the historical linkages between classical liberalism and Christianity. Instead I shall try to explicate their relevant common concept of personal freedom and trace its role in some of the central stories of the bible, those that purport to be direct reports of the actions and words of God or Jesus Christ. I am not concerned here with the stories about the Jews or with the reports of what prophets and apostles said about the meaning and relevance of the divine words and actions. Important as they are for understanding the Jewish and the Christian traditions, they already are historical expressions and applications of religious beliefs rather than expositions of the story to which those beliefs refer.. Any liberal democratic state must honour religious and cultural pluralism in its educational policies. To fail to honour them would betray ideals of freedom and toleration fundamental to liberal democracy. Yet if such ideals are to flourish from one generation to the next, allegiance to the distinctive values of liberal democracy is a necessary educational end, whose pursuit will constrain pluralism. PHILOSOPHY OF HUMAN RIGHTS: HUMAN RIGHTS IN LIGHT OF THEIR INTERNATIONAL PROTECTION Summary The book consists of two main parts: in the first, on the basis of an analysis of international law, elements of the contemporary conception of human rights and its positive legal protection are identified; in the second - in light of the first part -a philosophical theory of law based on the tradition leading from Plato, Aristotle, and St. Thomas Aquinas is constructed. The conclusion contains an application (...) of the results of the analysis conducted in the second part. The first part comprises four chapters. The first aims at revealing characteristics of human rights on the basis of an analysis of historical conditioning of the inter-national law of human rights and its development. The historical context displays the practical, vindicative, and critical character of the positive legal protection of human rights. Moreover, the process of change of positive human rights law is distinguished from the process of change of human rights as such. In the second chapter the content of human rights - a topic which is only auxiliary to the conducted analysis - is discussed. Basic typology and catalogues of rights proclaimed in the Universal Declaration of Human Rights and protected in the International Covenants of Human Rights are presented. The review of the content of rights aims at a more precise limitation of the field of research. The examination shows a diversity of rights which poses a serious challenge to the coherence of every philosophical theory of human rights. In the third chapter, central in the first part, international law is analyzed with regard to the characteristics of rights and the foundations of them. The analysis of documents shows a number of solutions referring to the anthropological foundations of rights. The inherent dignity of the human person is the source of all human rights. Each human being is recognized as free, and endowed with both reason and conscience. In the propounded conception of man individuals are not rivals but create a community which is a condition for their development. International law characterizes the rights as universal, inherent, inalienable and inviolable. The reconstructed conception also comprises the following basic elements: on the level of the structure of rights, a recognition of their equality, interdependence, and comprehensiveness; in the grounding of these rights, a recognition of the anthropological foundations of law; in the conception of positive law, a recognition of the secondariness of the positive law of human rights to human rights themselves, and a recognition of human rights and justice as the basis for legal order; in the conception of state, a recognition of the well-being of the individual as the fundamental aim of actions undertaken by political institutions, and recogni¬tion of rights which form an impassable boundary to the power of the state, includ¬ing its legislative actions. The characterization of the international legal paradigm serving for the under¬standing of human rights is supplemented by analyses of the structure of their posi¬tive legal protection. Various meanings of the terms "right" and "freedom" are distinguished. Subjective right, as basic structure of the positive legal protection of human rights, is understood as a complex relation formed by various legal situations of the subject of a right which create a functional whole in respect of the subordi-nation of human person to its good. Subordinating person to a good proper for it, expressed usually in a proclamatory norm, is the central element of particular rights around which further elements aiming at the realization of this good are built. In the second part of the book a philosophical theory is developed which allows for the location of a coherent foundation for the presented characterization of human rights and their positive legal protection. This part consists of two chapters. The first includes a review of some - not entirely satisfactory - means of founding of human rights; the second presents philosophical conceptions of law and man which may form a basis for the constructed theory. The review of arguments contained in the first chapter does not aim at a detailed analysis of various specific ways of argumentation encountered in works on this subject but rather at a concise presentation of the main possible lines of argumentation. These analyses also serve to emphasize the positive solutions which are pro¬posed later and to underscore the explanatory power of the elaborated theory. This theory, retaining accurate intuitions contained in the presented types of argumenta¬tion, helps in avoiding their consequences which are difficult to reconcile with the reconstructed paradigm of human rights. Efforts to base human rights on the norms of international law rightly take into account the necessity of determining the content of the rights and their positive legal protection as a means for the realization of man's good. These attempts, how¬ever, do not properly take into account the inherent character of human rights, which are independent of positive law and provide grounds for applying specific legislative measures and not others. Founding human rights on freedom accurately points at the freedom of an indi¬vidual as a constitutive element of some rights; however, absolutization of freedom leads, to a loss of an important element of the contemporary paradigm of under¬standing human rights. This foundation undermines recognition of the fact that human rights may set limits to both the freedom of others and the freedom of the subject of rights itself. Additionally, attempts at the so-called axiological justification of human rights are discussed. This type of justification has a few variants depending on the as¬sumed conception of value. Subjectivistic conceptions have similar advantages and disadvantages to the conceptions basing human rights on freedom; objectivistic conceptions while providing for the universality of human rights place, the fundamental aim of human rights protection beyond the individual human being - in the idealistically existing world of values; finally, conceptions rooting values and human rights in culture, while accurately noting that human rights are learned through the medium of culture, place the source of human rights beyond a concrete individual - in culture and processes which take place in it - which leads to difficulties in finding a basis for the universality of rights. Furthermore, attempts to ground human rights in specific characteristics of the human being are presented. This type of approach points to an important problem of dependence of the content of rights on what man is. However, recognition of specific characteristics of a human being as an ontic foundation of the existence of rights poses a danger to their universality since one has to accept that it is not enough to be a man to be a subject of rights, but a man possessing specific charac¬teristics. The second chapter aims at outlining solutions worked out by Saint Thomas Aquinas. For a fuller understanding of his propositions selected elements of Plato's and Aristotle's philosophy are presented. It was them who formulated the founda¬tions for reflection on law and justice in the ontological context. A qualification is made that Stoicism is not be analysed in depth. Although Thomas' concept of law was undoubtedly developed under the influence of the Stoic doctrine as well, it is not in this that one should look for the tools to understand the ontic foundations of human rights and law in general since the Stoic moral philosophy and philosophy of law were developed in the context of a theory of being which assumed monistic and pantheistic premises as foundations, leading to the recognition of a total subor¬dination of the human individual to a larger unity of which man is only a part. The analysis of Plato's and Aristotle's texts concentrates on problems of justice. Plato seems to be the first philosopher who reflected on the formula basic in the history of European thought: to render to each his due. It appears that justice as both a characteristic of man and his acts is understood in the perspective of that which is just, that which is a good for another man - the recipient of the act. The basis for determining what is just is the relation of correspondence between some¬one and something. While in the case of Plato this relation is based on something beyond its terms, namely on ideas, in the case of Aristotle the relation occurs on account of the elements of the relation itself. Something is just when it contributes to the develop¬ment of the recipient of an act realizing that which is just. At the same time, the realization of that which is just is a good for the agent. In the analysis of the just two types of relation are revealed: the relation of due-to-recipient occurring on account of the compatibility of that which is due, with the recipient of the act; and - a "superstructure" - a relation of obligation-of-subject occurring on account of the compatibility of the acting subject with the thing which should be done. The basis for being that which is due is formed by various potentialities of development of man - the recipient of agency; the basis of being that which is an obligation is the possibility of development of the subject of action. Aristotle distinguishes various types of freedom and points to the necessity of taking them into account in the discussion of justice. Among other things, as the core of man's freedom, he considers life for its own sake, which can be seen as his expression of the basic indices of the autotelic character of man - which is funda¬mental for later conceptions of dignity. The freedom which is described by him is not, however, inherent and inalienable; being free is conditioned by a factual possi¬bility of undertaking actions, which are not solely means to the realization of aims set by others. Thomas Aquinas takes over the Aristotelian research perspective both in his conception of man and of law. At the same time, however, he significantly enriches it. In anthropology he develops a conception of personal being. Drawing upon his distinction between existence ("that something is") and essence ("what something is"), he sees the basis for being a person in the dignity of personal being which is a certain way of existence of a rational being more perfect than that of non-personal beings. The person is a being which, by virtue of its act of existence, is individual¬ized in a specific way. It is an aim in itself. Expressing it in a negative way, one may say that it does not exist as a means for the realization of the aims of others and, in this sense, that it is free. As distinct from Aristotelian conclusions, being a person is not conditioned by the specific actions of a being. Dignity is inherent, based on that which is the foundation of the factual existence of every rational being. Although freedom requires that a being is rational, dignity still encompasses all being, all its properties and potentialities. Thus an act conforming with dignity has to take into account a whole human being. Among different types of that which is just, ius, the first place, from the point of view of understanding law, falls to "the just thing itself ("ipsa res justa"), which is right in the full meaning of the word. On the one hand, it is that which is due; on the other hand, it determines the way of acting in the utmost degree, since the course of every act is determined in the fullest extent by its aim. The content of ius may be determined both by elements independent of free decisions - ius naturale - and by free decisions taking into account the state of things - ius positivum. Recognition of the objective structure of being as the basis of law does not entail that it is possible or desirable to determine unequivocally "the only right" patterns of conduct. This concept is very well justified within the system proposed by Saint Thomas. Individualization of being is a significant element of the develop¬ment of a person as a person. It is attained by the realization of individual aims which are not unequivocally determined by circumstances and the nature common to all people. By virtue of free choices made in the sphere of that which is not by its nature unjust, the object of action becomes ius. Since in the realization of the person the individualization of human being is central, Aquinas clearly sees the need for the protection of the sphere of "dominion of will". This sphere itself constitutes ius naturale, something which is due to man independently of the acts of will. Therefore "law should forbid nothing which is not unjust" ("nihil debet lege prohiberi quod licite fieri potest", In 3 Sent., dist. 40, q. I, a. 1, 3). Besides the relation of due-to-recipient, ius also includes the relation of obligation-of-subject which is superimposed on the relation of due-to-recipient. As far as the ontic foundations of obligation are concerned, in explaining why man is subordinated to realization of the good of others, Aquinas generally follows Aristotle in accepting that this basis is the subordination to moral good - to actions conforming with the learned truth about reality. Aquinas' systemic solutions allow, however, to reach deeper and understand why moral development is also a development of the whole human being. This was difficult within Aristotle's system, since he was reluc¬tant to decide whether precedence should be given to intellectual or moral develop¬ment. The inclination to realise good of another appears to be a transcendental characteristic of being, based on its very existence. Morality understood as rational and free subordination to realize the good of another is a specifically personal way of the realization of this inclination. Thus just actions contribute to the actualization of being in the aspect of its existence and therefore to the actualization of being as a whole. Thomas' conception of natural law (lex naturalis) as participation in eternal law (lex aeterna), offers possibilities for grasping that which is just as something which is basically accessible cognition, independently of Revelation and independently of faith in God, and at the same time as something based in eternal law, understood as a design of God's wisdom. Eternal law, embracing all particular actions, is not, from the human perspective, accessible cognition directly. It is enacted in the struc-ture of the created being and - in case of human beings - in free choices taking this structure into account. In the concluding remarks, the results obtained earlier are applied directly to the contemporary conception of human rights. Human rights are understood in the first place as "just things" - concrete goods of man; as that which is due because of subordination, based on dignity, to the personal development of man. That which is just is understood as a relational - actual or potential - state of things, which exists by virtue of existing relations. Evaluations referring to that which is right are true when respective relations of due-to-recipient take place; norms of conduct are true when respective relations of obligation-of-subject take place. Examples of the application of the sketched theory outside the field of human rights are also presented. Procedural consequences of the developed theory are shown, such as the discrimination of two types of legislative procedures which differ significantly in the structure of argumentation: the first aims at recognition of that which is just independently of the will of the legislator, and the second, at making individual or collective "projects" of development compatible. Finally the possibilities of applying the theory to the increasingly important problems of the protection of the environment and the "rights" of animals are mentioned. The central issue is a philosophical conception of man and his freedom and a conception of law. It is also indispensable to turn to a general theory of being. The search for a comprehensive theory of human rights requires attention to the Abso¬lute Being - God - as well. This is important for at least two reasons. First, a conception of the Absolute Being is integral to philosophy of the systemic type -of which the present book is a piece. A conception of the Absolute Being is signifi¬cant for understanding all being, including, first of all, man as a personal being. Second, every theory of human rights which does not comprise the problem of the Absolute may be questioned as to whether solutions adopted in it do not lead, in consequence, to eliminating God from the perspective of the understanding of law. It is desirable that a philosophical theory should deal with this problem directly. A theory which eliminates God from the perspective of the understanding of rights will be unacceptable for all those who, for philosophical reasons or relying on faith, consider God as the author of inherent rights. Nevertheless, a theoretical approach to rights from the perspective of the Absolute Being should only be a possible extension of a philosophical approach which bases rights on something which is cognizable independently of the acceptance of the existence of God so that the theory is also acceptable for those who reject the existence of God or suspend their judgment on this subject. The pursued theory should therefore contain, on the one hand, reference to natural, faith-independent foundations of human rights, but on the other hand, point to a possible extension accounting for the Absolute Being. The analyses contained in this chapter have undoubtedly some historical value since they are based on source texts. Nevertheless, the use of these texts and not critical works was dictated, first of all, by a conviction that analyses embrace a given theory in the aspect selected by the interests of the researcher. Therefore to find out what past thinkers say on the subject characterized in the first part it is simpler to reach to the sources than to adopt the existing critical works. The pre¬sented reconstruction of Aquinas' views on philosophy of law incorporates proposi¬tions of supplementing and developing some of the ideas undertaken by him. Obligation to act in this and not an other way arises because human actions are subordinated to the conformity, on the one hand, of aims realized by these actions and, on the one hand, the order of being determining that which is favourable to man or destroys him. The content of the order of being is, on the one hand, determined by the structure of being independent from man's will and, on the other, by free decisions of man. (shrink)

Most people do not want to think very hard, and some lack the capacity to do so. Many make decisions on the basis of (...) narrow self-interest, and most lack vision. Given that this is so, it is not surprising that Athenian democracy has come in for a good deal of criticism. What is striking about this criticism, however, is its origins in the writings of Athens' own intellectuals. In this carefully argued and beautifully written book Josiah Ober explores in depth the critiques of democracy in several texts of the fifth and fourth centuries. His theses are several and extend from the centrality of the democracy debate in Athenian intellectual life to the interactive relationship between Greek history and contemporary political writing: the obvious contrast between the bloodthirstiness of the Thirty and the restraint shown by the restored democracy, he contends, mandated that analysis of democracy and its flaws become increasingly sophisticated and in some cases downright labyrinthine. The core of the book, however, is not what Ober sees as sociological analyses of Athenian democracy--the early work of the so-called Old Oligarch and the late work of Aristotle--but rather those critiques that focused, he suggests, on the Athenians' preoccupation with words, and on their efficacy as Austinian "speech acts." It is the middle chapters, tied together by the thread of this preoccupation, that are the most ingenious.Since the logos/ergon relationship is, I would suggest, more nuanced in Thucydides' work than in that of the other authors Ober examines, I leave discussion of it for last and begin with the chapter on Aristophanes' Ecclesiazusae. This chapter offers an exciting reading of the play, one in which the potentially trendy Austinian speech-act theory proves an excellent tool of analysis. Like most readers of the play, Ober sees Aristophanes raising the question whether "the attributes essential for the exercise of citizenship" were "unique to Athenian biological males" (135); what is distinctive about his approach is the emphasis on questions that the playwright raises about the relationship of speech to reality. Can words create equality? This is the question, Ober argues, to which Aristophanes is directing his democratic audience's attention. Are there limits to the sociopolitical realities that the Assembly can enact? Does saying make it so? To what extent are notions of male and female fixed by nonverbal physis, and to what degree are they social constructions made by spoken (and [End Page 479] then written) psephismata? Could a decree of the Assembly create female participatory citizens in the way it could create a state of war? (Questions, of course, do not presuppose answers, and in this respect Aristophanes remains maddening to classicists trying to reconstruct the political views of this important thinker on the Athenian scene.)Moving ahead to Plato, Ober explores the word/fact nexus in the Apology, Crito, Gorgias, and the Republic. Gorgias, of course, is the locus classicus for Plato's attack on democracy and rhetoric, which the philosopher represents as a package deal. It is there that Socrates gets Gorgias to concede that rhetoric works its magic on the ignorant more easily than on those who know, and that on the subject of medicine, for example, the most persuasive orator will be he who has studied not medicine but the art of speaking, and similarly with the other arts: there is no need to know pragmata as long as one has discovered a mechane for persuasion (i.e., appearance can substitute for reality). Socrates thus forces Gorgias into a position which we the readers recognize as untenable but poor Gorgias does not. When Socrates concludes that rhetoric must then consist of the blind leading the blind, Gorgias rejoices in the ease and efficiency of it all: how pleasant to skip all the drudgery of learning one art after another, when all one really needs to know is the art of persuasion! This article attempts to understand the relationship between politicity, ideology, and freedom of speech in the ontological state of the modern global world. Freedom of expression is recognised as a fundamental human right in the United Nations. On the other hand, it is inseparable from duties and responsibilities to both the other person and society. Democracy appeals to universal human rights, including freedom of expression. Democratic freedoms, on the other hand, result in a post-truth situation in which fundamental human rights (...) or freedoms no longer exist and are replaced by a variety of views, including aggressive and manipulative ones. When diagnosing the current ontological state of the world, an attempt is made to look for perspectives for overcoming the problems. (shrink)

The article is devoted to clarifying the significance of a political performance, which acts as a theatrical communication action designed to draw society’s attention to the important problems of certain social or political groups. The purpose of the research is to establish the peculiarities of the interpretation of political performance in the paradigmatic and methodological dimensions of modern discursive democracy. The development of political performance under the conditions of the modern Russian-Ukrainian war is characterized. It was (...) found that an important task of modern political science should be considered the identification of paradigmatic dimensions (or “poles”) of analytical judgments regarding the assessment of the significance of political performances. It was emphasized that political performance acts as a postmodern alternative to the realization of the unfinished project of political modernity. The importance of political performance for the discussion of society’s problems at the political level and its dependence on a specific topic and the subjects of its application are analyzed. The importance of public discussion and manifestation as signs of broad involvement of citizens in democratic political activity is revealed. It was found that the ability to express political meaning in a theatrical form is beyond the limits of rational planning and organization. It is revealed that the functionality of political performance stems from its connection with specific social groups. It has been proven that political performances are a form that contradicts the formal procedure of expressing the will and approving the results of the discussion. It has been established that, subject to regulatory support from the state, discussions require voluntary participation and a significant level of competence. It is assumed that political performance can provide certain advantages in political competition due to the imagery and emotionality of the political message. The limited suitability of performance for promoting the values of deliberative democracy has been established, since many cases of the use of performances in the modern period are related to the defense of the right to freedom of speech. It was concluded that in the conditions of political discussions, the importance of political performance consists in creating preliminary conditions for political dialogue. (shrink)

The illiberals uphold democracy as a political form devoid of liberal values. The “illiberal democracy” repositions liberalism in the past, and by doing so it also frequently uses a language indistinguishable from that of the left critique of “global neoliberalism.” European leaders of this stripe were staunch supporters of Donald Trump. One of their intellectual figureheads is the French philosopher and journalist, often identified as fascist, Alain de Benoist, who, in his latest book, _Contre le libéralisme_, mobilizes Marx next (...) to the likes of Julius Evola and Alexandr Dugin in virtue of a takedown of global (neo)liberalism. It is never an easy task to paint this entire picture, in its rich complexity, to my leftwing North American friends and colleagues because they too have long despised “liberalism,” a supposed ethos rather than a political doctrine itself. Certainly, liberal political theories have been subject to their critique as well; however, in such discussions too, I have noticed, the target is essentially the presumed ethos rather than the argument of liberalism. The ethos is habitually identified in rhetorical tropes that betray a bourgeois reason – spontaneously equated with liberal – whereas the “academic discussion” comes down to some references to the famous critiques from the 1990s of Kant’s autonomous reason and also to economic reductionism. I am speaking of personal exchanges here and cannot quote, but I mention them to illustrate conversations that might be familiar to the reader as well. (shrink)

The article’s intellectual core resides in the examination of social phenomena through the lenses of ambivalence and ambitemptiness. Democracy is conceived through the cultivation of the ideal of national solidarity within the framework of the “indivisible and unified nation” and revolution — values which, according to B. Anderson, individuals do not choose of their own volition. Nevertheless, it functions by virtue of structures that are freely chosen by individuals, specifically political parties and civil society organisations, among which trade (...) unions assume a paramount role in ensuring social solidarity. The author posits that a functioning political democracy, viewed as a historically ambi temptuous phenomenon, necessitates the reanimation of sustained equilibrium between the for ces of social hegemony and counter-hegemony. This revival hinges on transformative shifts in the structure of civil society, particularly reinstatement of pivotal social functions to trade unions. The article underscores the phenomenon of unprecedented demonstrative solidarity exhibited by the Democratic Party of the USA towards the strike movement. The author emphasises that a fully-fledged European liberal democracy was established during its golden age, preceding financial globalisation, as a social democracy. Within its framework, competitive and pluralist elections were complemented by the possibility of nationwide strikes facilitated by trade unions capable of social mobilisation. Proposing the term “political society” to denote the phenomenon encompassing political parties and movements, the article argues that their viability depends on their connection with civil society structures. It is asserted that neither right-wing nor left-wing populism possesses the capacity to fully neutralise “democratic fatigue”. (shrink)

In recent years much has been written about the contemporary revolutionary democracy of Afro-Asian countries, particularly in connection with the new experience of noncapitalist development or socialist orientation. Serious study of the revolutionary process in former colonial and semicolonial countries would be inconceivable without the formulation of this problem. Under the conditions of the general crisis of capitalism and the growing influence of scientific socialism, conceptions of the departure from capitalism, of the adoption of a non-capitalist path of development and (...) of a socialist orientation in domestic and foreign policy, are developing and maturing in various Eastern countries as a result of the evolution of the ideas of national liberation and social justice and the fact that the leading champions of independence and progress are beginning to embrace scientific socialism. Study of the experience of the movement of Asian and African countries along the noncapitalist path shows that they have made major socioeconomic progress, but also reveals significant objective and subjective difficulties in the policies of the revolutionary democratic forces. Unlike science fiction, which assumes a baseline of ordinary experience and sense of the nature of reality that are marked white, Black speculative literature's baseline is a parallel tradition responding to Black origins in slavery, racism, and colonialism; it imagines a future that critiques and is not bound up with science fiction's white origins in the onset of modernity. Its cosmologies and anthropologies are completely different. The Dark Delight of Being Strange is a work of but not about Black speculative (...) fiction. It explores the inherent meaning of speculative production for thinking, writing, living, and enacting concepts of Black freedom and why it is so critical for understanding Black sociality and politics. It combines memoir, storytelling, and philosophical prose with the Black imaginary to capture the idea that Black life is surreal, extraordinary--but not (or not only) in the sense of speculative fiction. It leaves us squarely in our world and time to reveal these aspects within the mundane or everyday. James Haile challenges us to rethink contemporary and historical Black life and approaches to freedom outside of Euromodernity in order to demonstrate the avant-garde aesthetic expressions critical to Black political thinking. It offers a rereading of enslavement through an innovative account of Henry Box Brown's famed escape, posits a parallel Black lifeworld as the destination of H. G. Wells' Journey to the Center of the Earth, thematizes time in Henry Dumas as an embodied phenomenological reality, imagines the survival skills of the octopus as an emblem for how to negotiate Black existence, theorizes memory as subject to metaphysical and ontological lack as a result of social alienation, questions whether there can be an outside--a place where Black people can be free--given the condition of death we call democracy as related in James Baldwin's letter to his nephew, and concludes by depicting Frederick Douglass as exemplar of the aesthetic, political, and philosophical Blackness that can be free. Each narrative is accompanied by a critical introduction and endnotes that provide philosophical context; together they argue that Blackness is a fundamental entanglement and not a limit--of the human or of freedom--rather somewhere beyond. Americans have long prided themselves on living in a country that serves as a beacon of democracy to the world, but from the time of the founding they have also engaged in debates over what the criteria for democracy are as they seek to validate their faith in the United States as a democratic regime. In this book John Gunnell shows how the academic discipline of political science has contributed in a major way to this ongoing dialogue, thereby playing (...) a significant role in political education and the formulation of popular conceptions of American democracy. Using the distinctive “internalist” approach he has developed for writing intellectual history, Gunnell traces the dynamics of conceptual change and continuity as American political science evolved from a focus in the nineteenth century on the idea of the state, through the emergence of a pluralist theory of democracy in the 1920s and its transfiguration into liberalism in the mid-1930s, up to the rearticulation of pluralist theory in the 1950s and its resurgence, yet again, in the 1990s. Along the way he explores how political scientists have grappled with a fundamental question about popular sovereignty: Does democracy require a people and a national democratic community, or can the requisites of democracy be achieved through fortuitous social configurations coupled with the design of certain institutional mechanisms? Should refugees receive political rights in liberal democracies? I argue that they should. Refugees are special – at least when it comes to claims towards democratic inclusion. They lack exit options and are significantly impacted by decisions made in liberal democracies. Enfranchisement is a matter of urgency to them and should occur on a national level. But what justifies the democratic inclusion of refugees? I draw on the all-subjected principle in arguing that all those subjected to rule in a (...) political unit should have a say in such rule. I show that refugees cannot be denied democratic inclusion based on the argument that transients should be excluded from participation. Refugees are not transients. Finally, I show that naturalization is not a prerequisite for enfranchisement. Political rights and citizenship can be had independently of each other. Refugees, then, should be nationally enfranchised as soon as they receive refugee status. (shrink)
