La literatura jurídica está dedicando cada vez más atención a los estereotipos perjudiciales en los distintos momentos procesales, desde la fase de instrucción hasta que se dicta sentencia. En este trabajo la estereotipación judicial, como mala praxis de la argumentación judicial, se enfocará en la sentencia. Después de evidenciar el fundamental papel de la motivación como lugar donde poder ejercer un control de las decisiones judiciales (2), así como lugar donde detectar la estereotipación judicial (3), se propondrá reflexionar sobre dos (...) tipos de conocimiento que pueden vehicular los sesgos de una cultura discriminatoria: el sentido común (4) y la pseudo-ciencia (5). Si bien son dos tipos de conocimiento que se emplean en la motivación de la sentencia para alcanzar un mejor entendimiento de los hechos, se observa la necesidad de que el órgano judicial adopte una actitud crítica para detectar la subyacente práctica discriminatoria potencialmente presente en ambas formas de conocimiento. This paper presents a qualitative study investigating the application of physiotherapists’ professional ethics in practice with respect to touch, intimacy, and corporeality during therapy, based on the experiences of elderly patients. As the relationship in a physiotherapy session is multidimensional, the study considered three levels: physical contact, verbal contact, and the conditions in which the therapy took place. The aim of this study was to find out what values are of importance to older people during a physiotherapy session, with emphasis (...) on the categories of touch, corporeality, and intimacy. The studied group consisted of sixteen male and female physiotherapy patients aged between sixty-six and ninety-two years. The study was conducted according to the grounded theory methodology. The research material consisted of transcriptions of free targeted interviews, which were subjected to a process of coding and analysis. As a result of data analyses, three superior categories have been identified—safety, anxiety, interpersonal relationship—and three a priori categories stemming from the characteristic features of the study area—touch, corporeality, and intimacy. The a priori categories did not appear independently in statements made by the respondents, but instead seemed to be components of superior categories. The most important values indicated by the respondents concerned the interpersonal relationship with their physiotherapist and the feeling of safety and care. In terms of touch, corporeality, and intimacy, the respondents indicated, among others, the importance of predictability, a sense of security, privacy, and acceptance of the body. (shrink)

Open theists argue that God's relationship to time, as conceived in classical theism, is erroneous. They explain that it is contradictory for an atemporal being to act in a temporal universe, including experiencing its temporal successions. Contrary to the atemporalists, redemptive history has shown that God interacts with humans in time. This relational nature of God nullifies the classical notion of God as timelessly eternal. Therefore, it lacks a philosophical and theological basis. Because God is in time, He does not (...) know all future contingencies and, therefore, changes. This study examines open theism's appropriation of the A and B theories of time to the divine-human relationship. The study argues that divine temporality does not solve the tension of divine-human relationships, especially in relation to the future. Further, historical divine temporality does not negate the fact of divine atemporality. It mainly stems from God's choice to create temporal creatures and His relationship with them. Furthermore, if it is not logically and metaphysically contradictory for an omnipresent being to act in space, then it follows that an atemporal being can act in time. Whether time is understood from the metric or psychological point of view, it does not transcend God, and therefore, the limitation it places on human creatures with respect to the future does not apply to God. Lastly, although a few philosophers reject the notion of eternity as timelessly eternal, the doctrine has a philosophical and theological basis in the Scripture. (shrink)

This article sets out the key findings from the seminar series ‘Transplantation and organ deficit in the UK: Pragmatic solutions to ethical controversy’ which ran from November 2006 to March 2008, and was sponsored by the Economic and Social Research Council. A broad range of issues were examined in the seminars, including religious and cultural attitudes affecting organ donation, the role of health-care professionals and what could be learned from the experiences of other countries, particularly in the European context. Core (...) participants in the series came from a range of academic and practitioner backgrounds and had different ethical perspectives on issues affecting organ donation and transplantation. Notwithstanding such diversity, the findings set out in the article reflect the fact that core participants were focused on developing a principled, yet pragmatic approach to dealing with the urgent problem of organ shortage in the UK. Le nom de Dominique Kahang'a Rukonkish a marqué plus d'un intellectuel à Kalonda, Kinshasa et au-delà, par l'arc-en-ciel thématique qu'il avait peint dans ses réflexions, spécialement autour de deux thèmes : la philosophie et la tradition sapientielle africaine. Ces thèmes sont au coeur des différents textes qui composent ce livre dont le point commun est que, comme peut-être aucune autre science, la philosophie vit de la réflexion des penseurs sur ce qui donne à penser et de la discussion avec d'autres (...) penseurs. C'est ici que se situe l'étude de sa propre tradition, comme l'a montré Dominique Kahang'a Rukonkish. Ceci est particulièrement nécessaire dans des situations de crise comme celle que traverse l'Afrique contemporaine. Ce qui importe dans ce cas est de questionner le passé à partir du contexte actuel en vue de ses potentialités à venir, tout en l'ouvrant à la possibilité d'une rencontre avec les autres traditions. Les auteurs des contributions réunies dans ce livre remercient Dominique Kahang'a Rukonkish pour ce qu'ils sont devenus grâce à lui. C'est pour eux un devoir de mémoire auquel ils se plient. The failure of medical codes to provide adequate guidance for physicians' moral dilemmas points to the fact that some rules of analysis, informed by moral theory, are needed to assist in resolving perplexing ethical problems occurring with increasing frequency as medical technology advances. Initially, deontological and teleological theories appear more helpful, but critcisms can be lodged against both, and neither proves to be sufficient in itself. This paper suggests that to elude the limitations of previous approaches, a method of moral (...) decision making must be developed incorporating both coherence methodology and some independently supported theoretical foundations. Wide Reflective Equilibrium is offered, and its process described along with a theory of the person which is used to animate the process. Steps are outlined to be used in the process, leading to the application of the method to an actual case. (shrink)

In this fascinating and inventive work, A. David Napier argues that the central assumption of immunology—that we survive through the recognition and elimination of non-self—has become a defining concept of the modern age. Tracing this immunological understanding of self and other through an incredibly diverse array of venues, from medical research to legal and military strategies and the electronic revolution, Napier shows how this defensive way of looking at the world not only destroys diversity but also eliminates the possibility of (...) truly engaging difference, thereby impoverishing our culture and foreclosing tremendous opportunities for personal growth. To illustrate these destructive consequences, Napier likens the current craze for embracing diversity and the use of politically correct speech to a cultural potluck to which we each bring different dishes, but at which no one can eat unless they abide by the same rules. Similarly, loaning money to developing nations serves as a tool both to make the peoples in those nations more like us and to maintain them in the nonthreatening status of distant dependents. To break free of the resulting downward spiral of homogenization and self-focus, Napier suggests that we instead adopt a new defining concept based on embryology, in which development and self-growth take place through a process of incorporation and transformation. In this effort he suggests that we have much to learn from non-Western peoples, such as the Balinese, whose ritual practices require them to take on the considerable risk of injecting into their selves the potential dangers of otherness—and in so doing ultimately strengthen themselves as well as their society. _The Age of Immunology,_ with its combination of philosophy, history, and cultural inquiry, will be seen as a manifesto for a new age and a new way of thinking about the world and our place in it.
