En sentido general, el hombre es una sustantividad o un sistema de notas que debido a su unidad posicionalmente interdependiente en forma de clausura posee suficiencia constitucional. Pero la conceptuación de esta suficiencia puede resultar problemática en función de cómo se articule la psique dentro de la sustantividad humana.

The subject of ethics has already been studied by scholars who have focused on the work of the philosopher Xavier Zubiri. Nevertheless, within the framework of what we might call ‘Zubiri’s ethics’ (Aranguren, Ellacuria, D. Gracia, etc.), not all the presuppositions of a postmetaphysical Zubirian ethics have yet been analyzed. By Zubirian ‘post-metaphysical ethics’ we understand that which derives from noology or the theory of sentient intelligence. As this theory affects both the affecting feeling and the tending will according to (...) what Zubiri called ‘intellectionism’, the aim of the present work is the study of ethics from the perspective of the third vector, the tending will, following what Zubiri called ‘possessional intelligence’. The result is that the description of the moral fact allows us to approach the concepts of ‘power’ and ‘duty’ from new viewpoints, highly fruitful in present-day ethics. (shrink)

The paper is devoted to the subject status of the discipline “Philosophy of Sociology”. Philosophy of sociology is an interdisciplinary direction focusing on the main preconditions of sociological knowledge development as well as cognitive value of sociological facts, theories and conceptions. Its subject can be divided into “philosophical foundations of sociology” and “philosophical problems of sociology”. “Sociologism” as the concept of substitution of social philosophy by sociology as a science which is better empirically oriented and is able to give more (...) exact and proved picture of social reality also poses danger to social philosophy. “Sociologism” presents a positivist attack on social philosophy. Indeed, sociology is no less speculative science than social philosophy is, which is well illustrated by a lot of divergences among its theoretical constructions and empirical data. The main functions of philosophy of sociology in the world of contemporary social-humanitarian knowledge are critical function, integrative function and axiological function. (shrink)

I personally ascribe tremendous importance to the problem of socialization and education: I know of no more important problem. The training of personnel equipped with a high level of specialized qualifications, a scientific worldview, and firm Communist convictions is one of the most important questions of our development. No amount of time is too much to give to its discussion, solution, and philosophical analysis. The convening of this kind of round table, at which representatives of various spheres of scholarship and (...) practice have assembled and at which it is possible to compare and harmonize the most diverse approaches to this interdisciplinary problem, is a very good undertaking. It would seem that this is the essential point of departure for discussing unsolved questions of education and socialization. But it is necessary to look ahead. One would wish to have something like a permanent conference of this kind, regularly functioning and planning its work. (shrink)

Tim van Gelder, following Brandom, Collins and others, uses the so‐called wide content of capacities which support social, norm governed activities, such as language, to argue for their anti‐natural, abstract, but socially instituted nature and thence for the failure of the entire traditional mind‐body discussion as ill‐posed. We argue that his former conclusion is wrong, that such properties are naturalisable, complicated organisational properties of the complexly organised, non‐linearly interactive systems that human beings are. This analysis also provides principled support, but (...) on other grounds, for van Gelder’s latter conclusion. Mental health practitioners often come across a number of challenges in their clinical practice. One such challenge that posed a management dilemma presented with the history of reincarnation. This subject has been discussed in non-scientific literature at length but there is an absolute paucity in scientific literature. This paper describes a case where a boy presented with memories of previous life that started haunting him and caused significant anxiety. It is time to pose directly and seriously the question of the fate of Marxist philosophical theory at the end of the twentieth century. And not only the question of Marxism in general, but more specifically the question of Leninism, of the essence of the "Leninist stage in the development of the philosophy of Marxism," of Lenin the philosopher. It is Lenin's theoretical legacy that calls for an especially careful investigation today, because it above all is what has undergone (...) canonization and distortion for over half a century. The time has finally come, it seems, for an assiduous analysis of the set of ideas dubbed "Lenin's creative contribution to the philosophy of Marxism" and even the "Leninist stage in the history of Marxist philosophy." Of course, renunciation of a cultist, essentially religious relation to Leninism is bound to be painful and is bound to affect the interests of those for whom it is easier to believe than to know…. But there is simply no other way to a genuine, noniconographic Lenin than a scholarly study of his activity and the ideas he developed. (shrink)

As we know, Merleau-Ponty was struggling with a dynamic shift in his thinking at the premature end of his life. In those last notes he raises the question of how to elaborate a phenomenology of “’the other world’, as the limit of a phenomenology of the imaginary and the ‘hidden’”—a phenomenology that would open onto an invisible life, community, other and culture. In her essay on “Eye and Mind”, “To Paint the Invisible”, Luce Irigaray argues that Merleau-Ponty was not yet (...) ready to address this question, of the limits posed to his vision by the presence of an other. The artworks of abstract expressionist artist Joan Mitchell are considered in the ways that they open up a different time-space suggesting an other world with which we intertwine without appropriation. Her works, I argue, defy reduction to essences, but also do not rely merely on sensation—for this reason they point in the direction of how to think phenomenology anew. For I do think Merleau-Ponty would be open to these conversations, to these other worlds and other visions. (shrink)

Hayden White wants history to serve life by having it inspire an ethical consciousness, by which he means that in facing the existential questions of life, death, trauma, and suffering posed by human history, people are moved to formulate answers to them rather than to feel that they have no power to choose how they live. The ethical historian should craft narratives that inspire people to live meaningfully rather than try to provide explanations or reconstructions of past events that make (...) them feel as if they cannot control their destiny. This Nietzschean-inspired vision of history is inadequate because it cannot gainsay that a genocidal vision of history is immoral. White may be right that cultural relativism results in cultural pluralism and toleration, but what if most people are not cultural relativists, and believe fervently in their right to specific lands at the expense of other peoples? White does not think historiography or perhaps any moral system can provide an answer. Is he right? This rejoinder argues that the communicative rationality implicit in the human sciences does provide norms about the moral use of history because it institutionalizes an intersubjectivity in which the use of the past is governed by norms of impartiality and fair-mindedness, and protocols of evidence based on honest research. Max Weber, equally influenced by Nietzsche, developed an alternative vision of teaching and research that is still relevant today. (shrink)

The realism/antirealism controversy has gone on for centuries, and gives every indication that it will continue to go on for centuries. Dismayed, I take a closer look at it. I find that the question it poses--very roughly, whether scientific knowledge is true (approximately true, put forward as true, etc.) or only useful (empirically adequate, a convenient method of representation, etc.)--actually suppresses socially critical thought and discussion about science (e.g., concerning whether scientific knowledge is sexist or racist or socially harmful in (...) other ways, or whether scientific knowledge is useful for achieving the goals we have or the goals we ought to have). I find, as well, that two of the most important responses to the realism/antirealism controversy--that which construes it as concerned with science's aims and that which construes it as concerned with science's results--fail to make sufficient empirical or normative contact with science. As a consequence, they provide representations of science that either do not help scientists (or nonscientists) make informed decisions about science, or actually hinder these individuals from doing so. I conclude that we should either stop engaging in the realism/antirealism controversy entirely, or else engage in it in a more socially responsible way--by gathering the right kinds of empirical and normative data, and framing more helpful versions of the questions we want to ask. I end by responding to the strong objections sure to be voiced by my colleagues in philosophy of science. (shrink)

This study clearly reveals that the benefits ascribed to strategic planning typically are achieved through a variety of means. A formal process that seeks to plan in a comprehensive, linear fashion is likely to be too complicated, politically divisive, expensive and inflexible, and to ignore how decisions are made in a complex, highly decentralised university. While many approaches to planning are used, universities must ensure they provide periodically opportunities for university staff—freed from daily responsibilities—to consider strategic concerns. Accurate and relevant (...) information must be available to all who make and carry out decisions. Planning should be viewed as a learning process rather than a document producing exercise. Extensive communication among university staff and faculty is needed to ensure informed debate and substantial acceptance of decisions—otherwise they are unlikely to be implemented. Perhaps most important is not the process employed but the decision-maker's breadth of perspective and sophistication. No process will overcome lack of competent leadership. The importance of daily decision-making in various councils and committees on issues such as cost containment and budgetary priorities is underestimated in the literature on planning.Critics have doubted whether universities' structures and processes permit them, or their leaders have the resolve, to confront the emerging issues. However, in many respects, the universities' decentralised, multiple decision-making practices may suit them well. They face the same challenging societal changes as other sectors of society. Their staff include some of the most capable individuals in the United States, and in the past they have been highly adaptable during periods of profound social change.Universities do not appear to be less aware of the need to adapt, nor more constrained in adapting to new conditions, than other sectors of society. In fact, university research and scholarship will be highly important in pointing the way for the whole of society to meet this era's challenges. If pessimistic predictions about current trends turn out to be accurate, universities no doubt will adapt at least as well as other kinds of institutions. The travails of business in this environment are daily news! There will be occasional casualties among the universities, as frequently occurs during major social transitions, but institutions that have grown in importance for over 1,000 years, will doubtless emerge from this period perhaps somewhat changed but still performing their historic social functions. Largely due to the popular allegation that contemporary science has uncovered indeterminism in the deepest known levels of physical reality, the debate as to whether humans have moral freedom, the sort of freedom on which moral responsibility depends, has put aside to some extent the traditional worry over whether determinism is true. As I argue in this paper, however, there are powerful proofs for both chronological determinism and necessitarianism, forms of determinism that pose the most penetrative threat to human (...) moral freedom. My ultimate hope is to show that, despite the robust case against human moral freedom that can be made without even relying on them, chronological determinism and necessitarianism should be regarded with renewed urgency. The work of Hegenberg is more than a simple translation into Portuguese of major parts of the body of current work in the philosophy of science. Behind his thorough work of research and compilation, behind the remarkable clarity and succinctness in the exposition of vast amounts of material, lies an expert organization of theories and problems that promises original contributions by the author in some of the areas here surveyed. After a philosophical preamble on belief, science, and philosophy, Hegenberg advances (...) a general analysis of scientific explanation embracing both deductive and probabilistic explanations. In an extensive third part he deals with the attitudes toward determinism in contemporary science, and with particular kinds of explanation such as teleological, psychological, sociological, and historical explanatory structures. Without abandoning the basic thesis of the unity of science, the author shows in this last part a great awareness of the distinct problems posed by explanation in every one of those fields. The bibliographical references after each chapter are rather complete, though references are missing concerning the most recent work in structural linguistics, economics, and anthropology.--A. M. Against Merleau-Ponty’s assertion that the artist has no other task than to bring to appearance the world in the way he corporeally encounters it employing no “other technique than what his eyes and hands discover in seeing and painting”, Irigaray argues that the painter as phenomenologist then appropriates what is other to his vision without reflecting upon a limit to vision, as well as the limit provided by the invisible of an other, an other world. This is not to say that there are no intertwinings with this other, for there are other metabolisms with which we engage the world. Moreover, the sharing of vision with an other can alter the ways I see, challenging cultural complicity, rather than providing evidence that we share the same world. Irigaray is of course not the first to challenge a phenomenological approach to art and to vision—and here I turn specifically to Gilles Deleuze—who is critical of the phenomenological tendency to take on a world given to us by others. His artist, Francis Bacon, focuses on the sensation, which remains unmediated by narration or the feelings of others. Prabhpal Singh has defended a relational account of the difference in moral status between fetuses and newborns. Newborns stand in the parent-child relation while fetuses do not, and standing in the parent-child relationship brings with it higher moral status for newborns. Orphans pose a problem for this account because they do not stand in a parent-child relationship. I argue that Singh has not satisfactorily responded to the problem.

Stassen begins by considering what those who have stood (...) the test of history, such as Dietrich Bonhoeffer, Karth Barth, Martin Luther King, and Dorothy Day, among others, have in common. He effectively argues that the common thread among these great leaders of resistance is a “thick” exegetical understanding of Jesus Christ that is implemented in daily life through incarnational discipleship. Such a “thick” interpretation of Jesus of Nazareth is rooted in Christian realism rather than Platonic idealism, meaning that incarnational discipleship does not attempt to apply lofty ideals to reality but is deeply involved, following Jesus of Nazareth, in historical struggles. Stassen then argues that this type of ethic can address all of the problems posed to ethics and faith in “a secular age” outlined by Charles Taylor’s book of the same title.Stassen’s framework of incarnational discipleship in a secular age addresses each of Taylor’s seven problems through a tapestry of argumentation that includes history, biblical exegesis, the tradition of Christian ethics, science, and politics. The work is critically engaged with historical figures in Christian ethics and current voices in the field. Stassen contributes a unique voice to the conversation by drawing upon his experiences with science as a trained physicist and with politics through his father’s gubernatorial career. Where many chose critical engagement with the natural and social sciences or with theological and biblical interpretation, Stassen does both. He approaches physics, politics, and economics with theological rigor, drawing upon traditional theological claims and offering his own critique and adaptation. Stassen, in his typical style, draws extensively on the Christian Scriptures. However, he does not simply reference numerous verses but further enhances the complexity of his argumentation through careful exegesis of the Sermon on the Mount, which he is known for, and of the Gospel of Mark.Stassen’s careful examination of the Sermon on the Mount and Mark offers the reader a picture of the particular understanding of Jesus that Stassen argues needs to be “thickly” interpreted; nonetheless, the book does not address [End Page 200] the consequences of other interpretations of Jesus being made “thicker” and the ethical dilemmas of such interpretations. To his credit, Stassen draws on several womanist interpretations of the cross as suffering in solidarity with the oppressed. But what about womanists who claim that any value placed on the suffering of the cross might lead to the excuse that the suffering of the oppressed is, in fact, redemptive suffering? Does a “thicker” interpretation of the cross necessarily address this problem?Overall, Stassen’s contribution to the field cannot be understated. He insists on addressing social problems on their own terms in the language of history, politics, economics, and science; he also rigorously engages theological and biblical ethics when such things have gone out of fashion in social ethics. Catholic theology’s traditional understanding of the spiritual nature of the human person begins with the idea of a rational soul and human mind that is made manifest in free will—the spiritual experience of the act of consciousness and cause of all human arts. The rationale for this religion-based idea of personhood is key to understanding ethical dilemmas posed by modern research that applies a more empirical methodology in its interpretations about the cause of human consciousness. Applications of these beliefs about (...) the body/soul composite to the theory of evolution and to discoveries in neuroscience, paleoanthropology, as well as to recent animal intelligence studies, can be interpreted from this religious and philosophical perspective, which argues for the human soul as the unifying cause of the person’s unique abilities. Free will and consciousness are at the nexus of the mutual influence of body and soul upon one another in the traditional Catholic view, that argues for a spiritual dimension to personality that is on a par with the physical metabolic processes at play. Therapies that affect consciousness are ethically problematic, because of their implications for free will and human dignity. Studies of resilience, as an example, argue for the greater, albeit limited, role of the soul’s conscious choices in healing as opposed to metabolic or physical changes to the brain alone. (shrink)

The ethics of managing obstetric patients in medical disasters poses ethical challenges that are unique in comparison to other disaster patients, because the medical needs of two patients—the pregnant patient and the fetal patient—must be considered. We provide an ethical framework for doing so. We base the framework on the justice-based prevention of exploitation of populations of patients, both obstetric and non-obstetric, in medical disasters. We use the concept of exploitation to identify a spectrum from ethically acceptable, to ethically challenging, (...) to ethically unacceptable, management of obstetric patients in medical disasters. We also address the ethics of the care of obstetric and neonatal patients when the resources of a hospital are completely overwhelmed in a large-scale medical disaster. (shrink)

This critical examination of STEM discourses highlights the imperative to think about educational reforms within the diverse cultural contexts of ongoing environmental and technologically driven changes. Chet Bowers illuminates how the dominant myths of Western science promote false promises of what science can achieve. Examples demonstrate how the various science disciplines and their shared ideology largely fail to address the ways metaphorically layered language influences taken-for-granted patterns of thinking and the role this plays in colonizing other cultures, thus maintaining the (...) myth that scientific inquiry is objective and free of cultural influences. Guidelines and questions are included to engage STEM students in becoming explicitly aware of these issues and the challenges they pose. (shrink)

Over the past decade, scores of articles have been published debating whether and when it is ethical for physicians to refuse requests from patients for legal, professionally permitted interventions. Numerous voices have condemned "conscientious refusals" for obstructing patients' access to needed and "standard" health-care services, for imposing physicians' personal ideologies on patients, and for contradicting physicians' professional ethical obligations. Jonathan Schaffer has provided three putative counterexamples to the transitivity of grounding, and has argued that a contrastive treatment of grounding is able to provide a resolution to them, which in turn provides some motivation for accepting such a treatment. In this article, I argue that one of these cases can easily be turned into a putative counterexample to a principle which Schaffer calls differential transitivity. Since Schaffer's proposed resolution rests on this principle, this presents a dilemma for the contrastivist: (...) either he dismisses the third case, which weakens the motivation for accepting his treatment of grounding, or else he accepts it, in which case he is faced with a counterexample to a principle that his proposed resolution to the original cases depends on. In the remainder of the article, I argue that the prima facie most promising strategy the contrastivist could take, which is to place some restriction on which contrastive facts are admissible so as to rule out the purported counterexample to differential transitivity, faces some important difficulties. Background The opioid epidemic has enabled rapid and unsurpassed use of big data on people with opioid use disorder to design initiatives to battle the public health crisis, generally without adequate input from impacted communities. Efforts informed by big data are saving lives, yielding significant benefits. Uses of big data may also undermine public trust in government and cause other unintended harms. Objectives We aimed to identify concerns and recommendations regarding how to use big data on opioid use in ethical (...) ways. Methods We conducted focus groups and interviews in 2019 with 39 big data stakeholders who had interest in or knowledge of the Public Health Data Warehouse maintained by the Massachusetts Department of Public Health. Results Concerns regarding big data on opioid use are rooted in potential privacy infringements due to linkage of previously distinct data systems, increased profiling and surveillance capabilities, limitless lifespan, and lack of explicit informed consent. Also problematic is the inability of affected groups to control how big data are used, the potential of big data to increase stigmatization and discrimination of those affected despite data anonymization, and uses that ignore or perpetuate biases. Participants support big data processes that protect and respect patients and society, ensure justice, and foster patient and public trust in public institutions. Recommendations for ethical big data governance offer ways to narrow the big data divide, enact shared data governance, cultivate public trust and earn social license for big data uses, and refocus ethical approaches. Conclusions Using big data to address the opioid epidemic poses ethical concerns which, if unaddressed, may undermine its benefits. Findings can inform guidelines on how to conduct ethical big data governance and in ways that protect and respect patients and society, ensure justice, and foster patient and public trust in public institutions. Reading is delusion. In order to read, we have to suspend certain standards of reality and accept others; we have to offer ourselves to deceit, even if it is an act of deception of which we are acutely aware. One way of considering this paradoxical duality in the act of reading is more or less consciously to posit multiple levels of reading, whereby the deceived reader is watched by an aware reader, who is in turn watched by a super-reader; and (...) so it continues. The ancient art critics, obsessed as they were with deceptive realism, provide in anecdotal form a good example of such multiplicity of perception when they tell stories of birds trying to peck at painted grapes, horses trying to mate with painted horses, even humans deceived by the lifelikeness of works of art. Such stories act as easy but potent signifiers of ‘realism’ in ancient art criticism, by showing the reactions of a ‘naive reader’ whose deception the aware reader can enter into but also see exposed. In verbal or visual art parading itself as realistic, the artistic pretence of a pose of reality is, at some level, intended to be seen as deceptive; when it is non-realistic, or anti-realistic, or even stubbornly abstract , art still demands that the reader suspend ordinary perception. But deception alone is not enough: ‘deceit’ only becomes artistic when a viewer sees through it, for a work of art which is so lifelike that no-one realizes it is not real has not entered the realm of art. The appreciation of deception happens at the moment when the deception is undone, or by the imaginative creation of a less sophisticated reader who has not seen through the deceit. That is what happens in comedy, more overtly than in other artforms, but in the same way. (shrink)

With populations aging worldwide, the need for appropriate and just public policy related to old age is critical. Elder law scholars can support the creation of such policy by advancing the theoretical understanding of the relationship between law and aging — understanding that can help policymakers identify and prioritize goals, and evaluate potential interventions. This Article aims to provide a framework for this work by distilling the core theoretical questions at the intersection of law and aging. It also challenges common (...) assumptions that could pose a barrier to developing a more robust theory of law and aging. Specifically, it argues that scholarship in this area will be most fruitful if it recognizes that the study and practice of “elder law” are intertwined but not a single unified field, that “preferential” treatment of older adults can be a form of discrimination, and that old age is not a universal human experience. Are social science, cross-border research projects, where recruitment and data collection are carried out remotely, required to follow similar ethical and data-sharing procedures as ‘on-the-ground’ studies that use traditional means of recruitment and participant engagement? This article reflects on our experience of dealing with this question when we had to switch to online data collection due to the restrictions posed by the COVID-19 pandemic, such as the inability to travel or (...) work in person with local communities and collaborators. Using social media platforms and online data collection when conducting research brings many advantages, such as being able to communicate remotely but directly with gatekeepers and collaborators, and in reaching potential participants on a global scale. However, neither the guidelines and advice for conducting ethically sound internet-based research, nor the academic literature focussed on building equitable research partnerships between the Global North and the Global South, offer much information regarding the ethical concerns, or address the grey areas, posed by this type of digital and distanced transnational research. In our experience, conducting research remotely made negotiations of access very challenging due to the politics of positionality between Global North and South researchers, lack of clarity on ethical processes and perceptions of gatekeepers who we could not meet in person. We hope the reflections on, and discussion of, our experience encourage deliberation on the present ethical challenges posed by online and social-media-disseminated data collection, particularly in cross-border circumstances. Indeed, many of the faculty have equally judgmental and pejorative views, which are neither systematized nor subject to systematic analysis.By clarifying the importance of the issue of the vice–mental disorder relationship (VMDR) to psychiatry, Sadler may move this topic to one that receives Socratic discourse in our training programs and serious consideration in the training of psychiatrists rather than an idiosyncratic lumping of these patients into the broad category of “patients I don’t like.”Sadler asks for comments in several categories: historical intractability, goals of psychiatry, taxonomy, implications for the criminal justice system, implications for the law, and ethical/political implications.Issues of historical intractability are long standing. In the nineteenth and early twentieth centuries, there was great debate about the inclusion of Pritchard’s “moral insanity”—now sanitized into “personality disorders”—into the psychiatric domain, and Kraepelin referred to this group as “enemies of society.”Sadler next asks us to consider the goals of psychiatry in regard to “a proper VMDR.” He wonders [End Page 43] whether a strict medicalization account can be defended. I think it is clear from a large literature and from clinical experience that it cannot be defended —now. But it may become defensible in this century, which will pose enormous challenges to psychiatry, lawmakers, and the courts (vide infra). A strict moralization model is defended by many in society, including some psychiatrists, but has severe limitations and seems illogical. The Dahmer case is especially instructive. The inauguration of Michigan’s BioTrust for Health, a research biobank for leftover neonatal blood spots, posed several novel questions for the state’s Department of Community Health institutional review board. The IRB’s response to these questions affirmed that respect for persons requires consent from donors for tissue donation to a public health biorepository with a research mission. It also acknowledged that the existence of potential risks and benefits to groups as well as to individuals necessitated new institutional collaborations between the IRB (...) and the appointed community oversight board for the BioTrust to foster consideration of the impacts on all stakeholders. Background: Patients in a vegetative state pose problems in diagnosis, prognosis and treatment. Currently, no prognostic markers predict the chance of recovery, which has serious consequences, especially in end-of-life decision-making. Objective: We aimed to assess an objective measurement of prognosis using advanced electroencephalography (EEG). Methods: EEG data (19 channels) were collected in 14 patients who were diagnosed to be persistently vegetative based on repeated clinical evaluations at 3 months following brain damage. EEG structure parameters (amplitude, duration and variability within (...) quasi-stationary segments, as well as the spatial synchrony between such segments and the strength of this synchrony) were used to predict recovery of consciousness 3 months later. Results: The number and strength of cortical functional connections between EEG segments were higher in patients who recovered consciousness (P < .05 – P < .001) compared with those who did not recover. Linear regression analysis confirms that EEG structure parameters are capable of predicting (P = .0025) recovery of consciousness 6 months post-injury, whereas the same analysis failed to significantly predict patient outcome based on aspects of their clinical history alone (P = .629) or conventional EEG spectrum power (P = .473). Conclusions: The result of this preliminary study demonstrates that structural strategy of EEG analysis is better suited for providing prognosis of consciousness recovery than existing methods of clinical assessment and of conventional EEG. Our results may be a starting point for developing reliable prognosticators in patients who are in vegetative state, with the potential to improve their day-to-day management, quality of life, and access to early interventions. Many people who have reached the age of majority still qualify as financial dependents of their parents, and may be registered as dependents on their parents’ medical schemes. This poses a practical conundrum, because major persons enjoy complete autonomy over their bodies to choose healthcare services as they please, including informational determination. However, their sensitive health information may end up being disclosed in the accounts rendered to their parents, as main members of medical schemes, thereby breaching their informational privacy, medical (...) confidentiality and possibly also damaging personal relationships. On the other hand, medical schemes must ensure that they strictly manage the business of their hospitalisation to ensure that they can adhere to their contractual and legal medical insurance obligations. Both major but financially dependent patients and medical schemes have good legal grounds to defend their respective positions. In this article, we will analyse and clarify the applicable legal and ethical grounds by considering medical confidentiality, the Protection of Personal Information Act, the Consumer Protection Act and the Medical Schemes Act and rules. We shall conclude with recommendations to accommodate the interests of both parties. (shrink)

Many searches are needle-in-the-haystack problems, looking for small targets in large spaces. In such cases, blind search stands no hope of success. Success, instead, requires an assisted search. But whence the assistance required for a search to be successful? To pose the question this way suggests that successful searches do not emerge spontaneously but need themselves to be discovered via a search. The question then naturally arises whether such a higher-level “search for a search” is any easier than the (...) original search. We prove two results: (1) The Horizontal No Free Lunch Theorem, which shows that average relative performance of searches never exceeds unassisted or blind searches. (2) The Vertical No Free Lunch Theorem, which shows that the difficulty of searching for a successful search increases exponentially compared to the difficulty of the original search. (shrink)

There has been much debate recently as to whether the notion of truth, as applied to one's home language, is metaphysically neutral, the interesting metaphysical questions arising elsewhere (in relation to such notions as mind-independence or objectivity or existence). ' On one side, the minimalists, as they have come to be known, favour deflationary accounts of truth such as the redundancy or disquotational theories and conclude that the notion of truth is applicable to declarative sentences in general - at least (...) where there are fairly definite standards of appropriateness for the assertion or denial of such sentences - irrespective of the metaphysical commitments of the propositions the sentences express. Opponents have criticized the minimalist account of truth or denied that it follows from this account that truth is metaphysically neutral. My sympathies in this debate lie with the minimalist but I wish to focus on a serious problem for the minimalist - that posed by the Liar paradox. This problem has featured very little in the recent debate but seems to me to yield the strongest objection to minimalism. I develop the objection in the next section, in §2 sketching what I feel to be the minimalist's best response, namely developing the position not in terms of Tarskian classical biconditionals but rather in terms of the naive rules for truth. It emerges, then, that the minimalist will be forced to repudiate classical logic. The last section, §3, deals with objections to the strategy of §2. (shrink)

In lieu of an abstract, here is a brief excerpt of the content:39 HUME'S JUSTICE AS A COLLECTIVE GOOD David Hume would probably regard his 'system of morals' as the most important part of his treatise of human nature. Yet his moral theory, particularly his theory of justice, continues to baffle commentators. Many have found it difficult to follow his line of reasoning to the conclusions that it is an artificial virtue to obey the rules of justice, and that such (...) rules command our respect even though we do not have any natural tendencies to respect them. The most troubling claim seems to be the claim that justice is ultimately based on self-interest, the motive that, on the surface at least, tends to induce people to ignore justice, particularly justice of the kind Hume is talking about. Jonathan Harrison, for instance, goes through a series of examples in an attempt to get close to Hume's meaning. In this paper I wish to argue that by justice Hume has in mind something very much like what modern economists call collective good. In the economic theory of public finance, which was born in the late Fifties, a distinction is made between collective goods and private goods. I wish to argue that this distinction can be employed to elucidate the nature of Hume's concept of justice, as well as to pinpoint the source of the moral force making justice a virtue rather than just a matter of prudence. I Most goods (and services) bought and sold in any economy have the following characteristics. First, as one person purchases (and consumes) a quantity of a particular good, there is less of it available for others to consume (that is, before more is produced). If the market is cleared (i.e. all that is produced is bought and sold), the total production or supply (X_, say) is the sum of individual purchases (X =X +X + etc.). 40 Second, the benefit of consumption is confined largely to the person who consumes the good. The overall benefit is said to be divisible among consumers. Third, the cost of production is also divisible and can be calculated for each unit of the good (which is not to say that such calculation can be easily or accurately carried out). Goods such as bread and butter, shoes and ships and sealing wax, cabbages, and so on, are of this nature. There are also certain goods and services which do not have these characteristics. John Stuart Mill was actually the first to notice the fact that a good such as a lighthouse, once provided, confers benefits equally on all "consumers" (i.e. ships that navigate by it). Unlike the goods in the class above, the amount of service generated by a lighthouse does not diminish as more of it is "consumed." The total X available is actually what is available for each and every consumer, so that X =X =X = etc. Once available, the benefit is not confined to any one user: to make it available to one user is to make it available to other users. The overall benefit is not divisible among consumers. Finally, it is often meaningless to speak of units of the good, hence meaningless to speak of cost per unit. Costs are also not divisible. In this class of goods we can include, in addition to the lighthouse, national defense, clean air, pleasant surroundings, etc. In the economic literature of public finance, these goods are referred to as 2 collective goods (and those above, private goods). The nature of collective goods poses a number of problems. One is that it is difficult to extract payments from consumers, once the good has been provided. Since it is difficult, if not impossible, to exclude those who refuse to pay from consuming the good or service, it is unrealistic to expect any payments, or full payments. This being so, no private entrepreneur would be willing to produce collective goods. Generally, 41 they will not be provided unless there is some collective effort, hence the name collective goods. This communication sought to redress the loss of the skill of making marks while reading by reporting a consolidated and reflective summation that drew on over four decades' worth of experience with approximately 500 undergraduate and 200 graduate students of Production Engineering at the Federal University of Rio de Janeiro. It identified the fundamentals and rationale of making marginalia while reading, with particular attention to their role in the preservation of insights and in furthering discovery, pointing to the need to (...) develop emotional as well as intellectual signifiers to allow readers to capture and recall their understanding of the texts they read and the significance of their marks. This supported the framing of relevant issues in the passage from reading and marking on paper to digital books, pointing towards approaches that would allow better understanding of the shortcomings of this medium for making marks while reading. A necessary condition for the development of a philosophical culture is the possession of a history of philosophy that conserves the experience of posing and discussing philosophical problems. Apologetics, dogmatism, a rigid devotion to the class approach, and ignoring universal human values for a long time dominated our social science and substantially deformed the way the history of philosophy was taught, giving rise to a number of stereotypes that hinder the revival of the skills of a culture of professional philosophizing. Patients in a vegetative state/ unresponsive wakefulness syndrome (VS/UWS) pose ethical dilemmas to those involved. Many conflicts occur between professionals and families of these patients. In the Netherlands physicians are supposed to withdraw life sustaining treatment once recovery is not to be expected. Yet these patients have shown to survive sometimes for decades. The role of the families is thought to be important. The aim of this study was to make an inventory of the professional perspective on conflicts in (...) long-term care of patients in VS/UWS. A qualitative study of transcripts on 2 Moral Deliberations (MD’s) in 2 cases of patients in VS/UWS in long-term care facilities. Six themes emerged: 1) Vision on VS/UWS; 2) Treatment and care plan; 3) Impact on relationships; 4) Feelings/attitude; 5) Communication; 6) Organizational aspects. These themes are related to professionals and to what families had expressed to the professionals. We found conflicts as well as contradictory feelings and thoughts to be a general feature in 4 of these themes, both in professionals and families. Conflicts were found in several actors: within families concerning all 6 themes, in nurse teams concerning the theme treatment and care plan, and between physicians concerning all 6 themes. Different visions, different expectations and hope on recovery, deviating goals and contradictory feelings/thoughts in families and professionals can lead to conflicts over a patient with VS/UWS. Key factors to prevent or solve such conflicts are a carefully established diagnosis, clarity upon visions, uniformity in treatment goals and plans, an open and empathic communication, expertise and understanding the importance of contradictory feelings/thoughts. Management should bridge conflicts and support their staff, by developing expertise, by creating stability and by facilitating medical ethical discourses. Shared compassion for the patient might be a key to gain trust and bridge the differences from non-shared to shared decision making. (shrink)

I would like to stress Vadim Mikhailovich's [Mezhuev's] position and clarify our conversation about culturology. It is constantly repeated that culturology is a science. It is my profound conviction that culturology is not a science. Culturology is a distinctive phenomenon of Russian culture and represents a certain intellectual movement. If one briefly surveys the history of its emergence, its philosophical origin becomes obvious. This intellectual movement consists of three levels, if one takes into account the "-logy" ending. First, the philosophical (...) level, from which in the 1970s culture began to be conceived as a special field of knowledge in our country. Then, humanistic knowledge: a great many representatives of the humanities in Russia-historians, art specialists, art critics, essayists-studied culture. Finally, there is the socioscientific tendency, which is just beginning to form in Russia and carries the internationally accepted name of social and cultural anthropology. All of us are synergistically attracted to these three tendencies, which comprise what is called culturology. The question of how these three tendencies of knowledge are correlated in the framework of the given intellectual movement is, in my view, extremely important. For quite some time now, there has been no reflection in Russia on the foundations of scientific and philosophical knowledge, but such reflection is necessary. To advance along the road of rational knowledge it is important to reflect in what cognitive space we find ourselves, what we are doing within its boundaries, and for what reason. From this point of view, neither philosophers nor representatives of the humanities or the social sciences will renounce their positions of observer. Moreover, I agree with Mezhuev that there is no single philosophy, humanistic conception, or theory of culture. Anyone who is engaged professionally in the study of cultural phenomena can choose his initial foundations. As Vadim Mezhuev correctly notes, the significance of philosophy for other types of knowledge lies in the fact that there are borderline areas of man's existence in the world. However, they are identified in different ways by different philosophies: positivism, phenomenology, classical Platonism, Aristotelianism, Kantianism, and so forth. Representatives of humanistic and socioscientific knowledge are free to choose any metaphysics. Philosophers will continue to attend to their business in their subject area, and scientists in theirs. But it is important periodically to determine rationally when there must be close and complementary relations between the three components of this intellectual movement and when they must exist in parallel. Then questions such as who has priority and who is the guardian of truth will not arise. If the tendencies have diverged in parallel, then the representatives of each of them are occupied within their domains with questions which are irrelevant in other fields of knowledge or for other theoretical models. At the end of the twentieth century, to pose the question of scientism or antiscientism is senseless because today we know that there are different forms of rationality and that science is not the only, and is quite a narrow, form of rationality. Myth too is rational. It is expressed in categories and has a particular inner logic. We recognize myth as a rational cultural entity, because it is represented in symbolic form as an ordered sequence of judgments, as an artifact. But it differs from scientific theory. That is why it is fruitful to reflect on what forms of rationality are relevant to what levels of knowledge. I agree with Ogurtsov, who says that these forms penetrate in one way or another into every culturally institutionalized form of knowledge. Indeed, in philosophical knowledge there are elements of everyday, mythological, and scientific knowledge, but this does not negate the distinctive nature of the philosophical form of knowledge. In science there are elements of metaphysics, mythology, and everyday knowledge, but this does not cancel the particularities of the scientific form of knowledge. The same is true of the humanistic form, which is in principle irremovable from the framework of institutionalized knowledge, at least for now. I do not agree with Ogurtsov that I give the humanistic form of knowledge a negative evaluation. Humanistic knowledge begins to be significant in a period of a cognitive paradigm shift. This, we can say, is apparent today, at a time of transition from the grand style of modernism in its postmodern mode to the building of the foundations for a new whole. The point is that the humanistic form of knowledge enables us to isolate at the outset those areas of the unknown at which we arrive because of the limitations inherent in other forms of rationality. It is closest to everyday and empirical categories of knowledge and forms of ideas; hence, particularism, image syncretism, and mobility are its distinctive features. But without this humanistic level no further step is possible in either scientific or philosophical knowledge. The breakdown into these forms of knowledge- philosophical, humanistic, and scientific-may be primitive, but we have to start our reflection on the foundations of our cognitive relationship to our surroundings somewhere. The identification of the forms of knowledge makes it possible to draw the conclusion that, unlike philosophical and humanistic knowledge, socioscientific knowledge is modeled on the natural sciences. From this it becomes obvious that the distinctive features of the object of social sciences determine also the special nature of the categorial apparatus, operationalization, selection method, and information analysis. I do not insist that the model I suggest must be accepted. Other models can be constructed. But let us start with a simpler comparison of types of knowledge and later we shall differentiate them. I started from this level because in our culture such a division is apparent and generally accepted. There are the philosophical, humanistic, and scientific forms of knowledge. They are irreducible to one another, they perform entirely different functions in the knowledge of man's relationship to the environment, and express different views about how man lives in culture. I agree that philosophy is exactly existence in culture with a singling out of the limits of this existence. But representatives of humanistic and socioscientific knowledge also deal with existence in culture. What is important for the philosopher is the direction of knowledge from within to the outside; for the representative of humanistic knowledge it is the description of how he exists among a multitude of seemingly diverse and divergent artifacts and processes; and for the scientist it is the order of the philosophically and humanistically defined reality in order to control it the better. Broad genome‐wide testing is increasingly finding its way to the public through the online direct‐to‐consumer marketing of so‐called personal genome tests. Personal genome tests estimate genetic susceptibilities to multiple diseases and other phenotypic traits simultaneously. Providers commonly make use of Terms of Service agreements rather than informed consent procedures. However, to protect consumers from the potential physical, psychological and social harms associated with personal genome testing and to promote autonomous decision‐making with regard to the testing offer, we argue that current (...) practices of information provision are insufficient and that there is a place – and a need – for informed consent in personal genome testing, also when it is offered commercially. The increasing quantity, complexity and diversity of most testing offers, however, pose challenges for information provision and informed consent. Both specific and generic models for informed consent fail to meet its moral aims when applied to personal genome testing. Consumers should be enabled to know the limitations, risks and implications of personal genome testing and should be given control over the genetic information they do or do not wish to obtain. We present the outline of a new model for informed consent which can meet both the norm of providing sufficient information and the norm of providing understandable information. The model can be used for personal genome testing, but will also be applicable to other, future forms of broad genetic testing or screening in commercial and clinical settings. (shrink)

Students at Newcastle are exposed to patients during their first week at medical school and attached to a family within the first month. The object is to sensitise them to patients as people rather than vehicles of disease. Medical ethics is introduced as part of the multidisciplinary Human Development, Behaviour and Ageing Course by a lecturer who shows a film which poses an ethical problem. At subsequent tutorials led by the Department of Family and Community Medicine's general practitioner lecturers the (...) subject is discussed as ethical issues arise in the course of their work.
