Es ist bekannt, daß Husserl Fichtes theoretischer Philosophie keine gute Seite abgewinnen konnte. In den 1917 vor Kriegsheimkehrern gehaltenen und 1918 wiederholten Vorträgen über Fichte spricht Husserl von »abstrusen Konstruktionen«, die in der Wissenschaftslehre Fichtes zu finden seien. Nichtsdestotrotz kann man sehen, daß beide Ansätze mehr als bloße Strukturanalogien aufweisen. Es wurde - wenn auch nicht häufig - darauf hingewiesen, daß sachliche Verweise beider Ansätze aufeinander möglich sind. Die Berührungspunkte in der praktischen Philosophie dagegen fallen eher ins Auge. In seinen (...) Vorträgen orientiert sich Husserl insbesondere an Fichtes populären und religionsphilosophischen Schriften und es ist inzwischen bekannt, daß sich Husserl in den 20er Jahren vermehrt der praktischen Philosophie im Sinne Fichtes zuwendet, über deren Verhältnis zu der seinen er in einem Brief an Adolf Grimme meint, »daß die religions-philosophischen Perspektiven, die mir die Phänomenologie eröffnete, überraschend nahe Beziehung zu Fichtes späterer Gotteslehre zeigen«. Ich möchte mich an dieser Stelle auf den theoretischen Zugang konzentrieren und dabei speziell den Begriff der Affektion bei Fichte und Husserl näher untersuchen. (shrink)

Disciple de Husserl, Reinach propose une interpretation du monde social qui engage la phenomenologie sur le terrain des actes sociaux et des experiences individuelles qui les accompagnent, afin d'isoler les structures a priori qui sont au principe meme du droit positif. Le travail de Reinach s'inscrit egalement dans un champ d'analyse philosophique et linguistique centre sur les enonces dits performatifs, baptises (...) tels par Austin quelques decennies plustard. Among philosophers of science there seems to be a general consensus that understanding represents a species of knowledge, but virtually every major epistemologist who has thought seriously about understanding has come to deny this claim. Against this prevailing tide in epistemology, I argue that understanding is, in fact, a species of knowledge: just like knowledge, for example, understanding is not transparent and can be Gettiered. I then consider how the psychological act of "grasping" that seems to be characteristic of understanding (...) differs from the sort of psychological act that often characterizes knowledge. This entry offers a critical overview of the contemporary literature on understanding, especially in epistemology and the philosophy of science.

Explanatory inquiry characteristically begins with a certain puzzlement about the world. But why do certain situations elicit our puzzlement while others leave us, in some epistemically relevant sense, cold? Moreover, what exactly is involved in the move from a state of puzzlement to a state where one's puzzlement is satisfied? In this paper I try to answer both of these questions. I also suggest ways in which our account of scientific rationality might benefit from having a better sense of the (...) kind of epistemic goal we are trying to realize, when we engage in our explanatory inquiries. I explore the extent to which the epistemic state of understanding is transparent to the one who understands. Against several contemporary epistemologists, I argue that it is not transparent in the way that many have claimed, drawing on results from developmental psychology, animal cognition, and other fields.

What is it that makes someone wise, or one person wiser than another? I argue that wisdom consists in knowledge of how to live well, and that this knowledge of how to live well is constituted by various further kinds of knowledge. One concern for this view is that knowledge is not needed for wisdom but rather some state short of knowledge, such as having rational or justified beliefs about various topics. Another concern is that the emphasis on knowing how (...) to live well fails to do justice to the ancient tradition of ‘theoretical wisdom’. In this article, from the 2009 Oxford University Press collection Epistemic Value, I criticize existing accounts of epistemic normativity by Alston, Goldman, and Sosa, and then offer a new view.

According to ‘orthodox’ epistemology, it has recently been said, whether or not a true belief amounts to knowledge depends exclusively on truth-related factors: for example, on whether the true belief was formed in a reliable way, or was supported by good evidence, and so on. Jason Stanley refers to this as the ‘intellectualist’ component of orthodox epistemology, and Jeremy Fantl and Matthew McGrath describe it as orthodox epistemology’s commitment to a ‘purely epistemic’ account of knowledge — that is, an account (...) of knowledge where only truth-related factors figure in whether or not a person knows. In the first part of this paper I try to clarify the intellectualist thesis and to distinguish what I take to be its two main strains. In the remainder of the paper I then take a more critical turn and argue that even if, as a matter of fact, traditional epistemology has endorsed intellectualism in both of its strains, this is a mistake on the part of the tradition. At least one way of understanding intellectualism should be rejected and its practicalist counterpart should be accepted instead. (shrink)

The effectiveness of multi-stakeholder initiatives (MSIs) in tackling grand social and environmental challenges depends on productive dialogue among diverse parties. Facilitating such dialogue in turn entails building common ground in form of joint knowledge, beliefs, and suppositions. To explore how such common ground can be built, we study the role of different facilitators and their strategies for bridging the perspectives of competing stakeholder groups in two contrasting MSIs. The German Partnership for Sustainable Textiles was launched in an initially hostile communicative (...) environment, whereas the Fossil Free Sweden Initiative proceeded in a fertile communicative environment. We trace how the facilitators in these initiatives achieved common ground through three bridging strategies—communicative integration, temporal calibration, and process alignment—adapted to the communicative environments of these MSIs. In hostile communicative environments, facilitators achieve common ground by steering diverging stakeholder groups towards ‘reconciling’ their different language registers, knowledge bases, and meaning systems to ‘meet in the middle’ on points of agreement and shared interests. In fertile communicative environments characterised by greater mutual trust, facilitators can steer interactants to ‘strategically appropriate’ to the language, knowledge, and meaning system of a particular stakeholder group to win this group’s support. Our analysis contributes to a better understanding of how productive multi-stakeholder dialogue can be facilitated. (shrink)

Defenders of pragmatic encroachment in epistemology (or what I call practicalism) need to address two main problems. First, the view seems to imply, absurdly, that knowledge can come and go quite easily—in particular, that it might come and go along with our variable practical interests. We can call this the stability problem. Second, there seems to be no fully satisfying way of explaining whose practical interests matter. We can call this the “whose stakes?” problem. I argue that both problems can (...) be addressed in roughly the same terms. More exactly, I argue that by first clarifying the whose stakes? problem an answer to the stability problem naturally falls out. (shrink)

In comparing it with the mechanistic and vitalistic views, the author seeks to make clear the nature of holistic causality, referring toDonnan's equations as an example.Holistic causality is essentially dimensional simplification. A complex system which forms a whole must be described in the first instance autonomo-phenomenologically, and if possible mathematically. Thereafter it is simplified into other wholes of less dimensionality, through progressive elimination of its higher dimensions, and so on until there remain over constituents no longer showing „wholeness”. These are (...) called „atoms” in the general sense. In holistic thought we do not begin with the atom; it is found at the end of the process of simplification.All unitary systems which lie between the atoms — the ultimate terms of holistic simplification, no longer showing wholeness — and the highest world-whole which we call the universe, are relative wholes. Each of these unitary systems is a complete whole only with respect to those systems of lower dimension into which it can itself be simplified. On the other hand it is itself a partial whole in relation to the wholes of higher dimension to which it is subordinated. This essay describes the ambitious claim of modern constitutionalism and distinguishes it from mere juridification of public power. It shows the challenges of constitutionalism that follow from the loss of identity between state power and public power. The essay asserts that the necessity to regulate public power persists, regardless of whether it is exercised by state authorities or international organizations. However, it raises doubts that the fragmented public power on the international level can be regulated in a way that would (...) satisfy the demands of constitutionalism. What can be observed is an ongoing juridification which, however, lacks basic features of constitutionalism. How a full compensation could look like is an open question. Der Begriff ›Tierversuch‹ kann in einem engen und in einem weiten Sinne verwendet werden. Im weiten Sinne kann man unter ›Tierversuch‹ jede wissenschaftliche oder experimentelle Verwendung von Tieren verstehen. Im engeren Sinn, der auch dem Tierversuchsrecht der Europäischen Union oder dem deutschen Tierschutz-Gesetz zugrunde liegt, bezeichnet der Begriff ›Tierversuch‹ solche wissenschaftlichen Verfahren mit lebenden Tieren, die mit Schmerzen, Belastungen oder Schäden der Tiere verbunden sein können. Artikel 3 der einschlägigen Richtlinie 2010/63/EU beispielsweise definiert den Tierversuch als »jede invasive oder nicht (...) invasive Verwendung eines Tieres zu Versuchszwecken oder anderen wissenschaftlichen Zwecken mit bekanntem oder unbekanntem Ausgang, oder zu Ausbildungszwecken, die bei dem Tier Schmerzen, Leiden, Ängste oder dauerhafte Schäden in einem Ausmaß verursachen kann, das dem eines Kanüleneinstichs gemäß guter tierärztlicher Praxis gleichkommt oder darüber hinaus geht«. Der Geltungsbereich der Richtlinie umfasst neben lebenden, nichtmenschlichen Wirbeltieren auch selbständig Nahrung aufnehmende Larven, Säugetierföten ab dem letzten Drittel ihrer normalen Entwicklung und lebende Kopffüßer. This book analyzes the implementation of CSR reporting and codes of business conduct and ethics in the legal systems of the USA, Austria and China and their enforcement in international supply chain arbitrations. The book demonstrates that long-term profit maximization is increasingly intertwined with corporate ethics and CSR policies. In order to prevent window-dressing and greenwashing, certain control mechanisms and legal standards are required along the entire supply chain. This book introduces an ethics and CSR system recommending a reward-based whistleblowing (...) mechanism, internal oversight by a CSR and Ethics Committee comprised of independent board members and at least one sustainability expert, and an external, independent and comprehensive assurance of CSR reports provided by auditing firms or newly formed governmental agencies consisting of certified CSR experts. The author emphasizes the significance for supply chain leaders to ensure contractual enforcement of their codes of business ethics and conduct along the supply chain. Against this background, the author created a comprehensive fictitious case scenario covering a supply chain dispute arising from the breach of the supply chain leader’s code of business conduct and ethics by a lower-tier supply chain member. The author acknowledges the fact that in most of the cases the governing law of international supply chain contracts is English law or law based on English law. Thus, the author discusses potential contractual claims for damages arising from a loss of profits caused by a loss of reputation resulting from violations of core provisions of the chain leader’s supplier code of conduct pursuant to English law. As international supply chain disputes usually involve more than two parties, and international arbitration is the ideal means for the resolution of these disputes, the book compares the arbitration rules for consolidations and joinders of some of the most significant international arbitration institutions: SIAC, ICC, AIAC, ICDR, VIAC, CIETAC and HKIAC. The book is directed at legal practitioners, legislators of various jurisdictions, board members of corporations, ethics and compliance officers, academics, researchers and students. It is the author’s main goal that the book serves as an inspirational source for the establishment or the improvement of a corporate ethics and CSR system preventing window-dressing and greenwashing and covering the entire supply chain. Phenomenologists were concerned with showing that essential structures of being, knowable by rational insight, are found more abundantly than commonly thought. Reinach shows that in the civil law there are essential structures, such as the structure of promising or of owning. These pre-positive structures provide the civil law with a foundation that can be known by philosophical insight. Though the enactments of the civil law are changeable, essential foundations are not. Of particular significance is Reinach's concept of a social act, (...) that is, of an act that addresses another and has to be heard by the other in order to be complete. Reinach shows that the essence of legally relevant acts, such as promising, comes to evidence when they are understood as social acts. (shrink)
