Adrian Kuzminski argues that Pyrrhonism, an ancient Greek philosophy, can best be understood as a Western form of Buddhism. Not only is its founder, Pyrrho, reported to have traveled to India and been influenced by contacts with Indian sages, but a close comparison of ancient Buddhist and Pyrrhonian texts suggests a common philosophical practice, seeking liberation through suspension of judgment with regard to beliefs about non-evident things.

This is one of four interrelated action agenda papers resulting from the National Summit on Public Health Legal Preparedness convened in June 2007 by the Centers for Disease Control and Prevention and nineteen multi-disciplinary partner organizations. Each of the action agenda papers deals with one of the four core elements of public health legal preparedness: laws and legal authorities; competency in using those laws; coordination of law-based public health actions; and information. Slavoj Žižek is one of the most interesting and important philosophers working today, known chiefly for his theoretical explorations of popular culture and contemporary politics. This book focuses on the generally neglected and often overshadowed philosophical core of Žižek’s work—an essential component in any true appreciation of this unique thinker’s accomplishment. His central concern, Žižek has proclaimed, is to use psychoanalysis to redeploy the insights of late-modern German philosophy, in particular, the thought of Kant, Schelling, and Hegel. By taking this (...) avowal seriously, Adrian Johnston finally clarifies the philosophical project underlying Žižek’s efforts. His book charts the interlinked ontology and theory of subjectivity constructed by Žižek at the intersection of German idealism and Lacanian theory. Johnston also uses Žižek’s combination of philosophy and psychoanalysis to address two perennial philosophical problems: the relationship of mind and body, and the nature of human freedom. By bringing together the past two centuries of European philosophy, psychoanalytic metapsychology, and cutting-edge work in the natural sciences, Johnston develops a transcendental materialist theory of subjectivity—in short, an account of how more-than-material forms of subjectivity can emerge from a corporeal being. His work shows how an engagement with Žižek’s philosophy can produce compelling answers to today’s most vexing and urgent questions as inherited from the history of ideas. (shrink)

Small businesses in developing countries, as part of global supply chains, are sometimes assumed to respond in a straightforward manner to institutional demands for improved working conditions. This article problematizes this perspective. Drawing upon extensive qualitative data from Tirupur’s knitwear export industry in India, we highlight owner-managers’ agency in avoiding or circumventing these demands. The small businesses here actively engage in irresponsible business practices and “evasion” institutional work to disrupt institutional demands in three ways: undermining assumptions and values, dissociating consequences, (...) and accumulating autonomy and political strength. This “evasion” work is supported by three conditions: void, distance, and contradictions. Through detailed empirical findings, the article contributes to research on both small business social responsibility and institutional work. (shrink)

The aim of this thematic literature review is to explore nurses' perceptions of ethical issues in the care of older people. Electronic databases were searched from September 1997 to September 2007 using specific key words with tight inclusion criteria, which revealed 17 primary research reports. The data analysis involved repeated reading of the findings and sorting of those findings into four themes. These themes are: sources of ethical issues for nurses; differences in perceptions between nurses and patients/relatives; nurses' personal responses (...) to ethical issues; and the patient—nurse relationship. The findings reveal that ageism is one of the major sources of the ethical issues that arise for nurses caring for older people. Education and organizational change can combat ageist attitudes. Wider training is required in the care of older people, workplace skills, palliative care and pain management for older people. The demands of a changing global demography will necessitate further research in this field. (shrink)

In this essay I consider the argument that Bernard Williams advances in ‘The Makropolus Case’ for the meaninglessness of immortality. I also consider various counter-arguments. I suggest that the more clearly these counter-arguments are targeted at the spirit of Williams's argument, rather than at its letter, the less clearly they pose a threat to it. I then turn to Nietzsche, whose views about the eternal recurrence might appear to make him an opponent of Williams. I argue that, properly interpreted, these (...) views in fact make him an ally. Medical humanities purchases its presence on the medical side of university campuses by adopting as its own the ends of medicine and medical ethics. It even justifies its presence by asserting promotion of those ends as an ethical imperative, most of all to improve the caring in medical care. As unobjectionable, even praiseworthy, as this imperative appears, it actually constrains the possibilities for interpersonal relationship in the context of medical practice. Development of those possibilities requires openness of self to the (...) existentially challenging ethical imperative to care also literally for nothing at all. (shrink)

Information is the fourth core element of public health legal preparedness and of legal preparedness for public health emergencies specifically. Clearly, the creation, transmittal, and application of information are vital to all public health endeavors. The critical significance of information grows exponentially as the complexity and scale of public threats increase.Only a small body of organized information on public health law existed before the 21st century: a series of landmark books published beginning in 1926 by Tobey, Grad, and Wing ; (...) model public health laws published as early as 1907; systematic reviews of original research studies published in the 1990s; and a small but growing number of articles published in public health journals and law reviews.With the new century came new public health law programs and activities at the Centers for Disease Control and Prevention, in public health professional associations, and in numerous non-profit and academic organizations. Structural priming is a useful tool for investigating linguistics representations. We argue that structural priming can be extended to the investigation of pragmatic representations such as Gricean enrichments. That is not to say priming is without its limitations, however. Interpreting a failure to observe priming may not be as simple as Branigan & Pickering imply.

Many-minds arguments are flooding into legal theory. Such arguments claim that in some way or another, many heads are better than one; the genus includes many species, such as arguments about how legal and political institutions aggregate information, evolutionary analyses of those institutions, claims about the benefits of tradition as a source of law, and analyses of the virtues and vices of deliberation. This essay offers grounds for skepticism about many-minds arguments. I provide an intellectual zoology of such arguments and (...) suggest that they are of low utility for legal theory. Four general and recurring problems with many-minds arguments are as follows: (1) Whose minds?: The group or population whose minds are at issue is often equivocal or ill-defined. (2) Many minds, worse minds: The quality of minds is not independent of their number; rather, number endogenously influences quality, often for the worse. More minds can be systematically worse than fewer because of selection effects, incentives for epistemic free-riding, and emotional and social influences. (3) Epistemic bottlenecks: In the legal system, the epistemic benefits of many minds are often diluted or eliminated because the structure of institutions funnels decisions through an individual decisionmaker, or a small group of decisionmakers, who occupy a kind of epistemic bottleneck or chokepoint. (4) Many minds vs. many minds: The insight that many heads can be better than one gets little purchase on the institutional comparisons that pervade legal theory, which are typically many-to-many comparisons rather than one-to-many. The attempt to develop a systematic approach to the study of consciousness begins with René Descartes (1596–1650) and his ideas still have a major influence today. He is best known for the sharp distinction he made between the physical and the mental (Cartesian dualism). According to Descartes, the body is one sort of substance and the mind another because each can be conceived in terms of totally distinct attributes. The body (matter) is characterized by spatial extension and motion, while the (...) mind is characterized by thought. This characterization of the mind also renders it private, a precursor of the distinction between the first‐person and the third‐person perspectives. Today, most scientists do not accept dualism, instead believing that mind somehow emerges from the physical properties of the brain. However, the distinction between mind and matter is still perceived as being so clear‐cut that explaining how mind can emerge from matter, and reconciling the first‐person and third‐person perspectives, remain the hardest problems facing the student of consciousness. This article argues that current programmes in the human sciences which adopt a multi-disciplinary approach to history need to be wary of treating the knowledge of the natural sciences as being independent of social influence. Such efforts to do ‘Big History’, ‘Deep History’ or co-evolutionary history themselves have a past, and this article suggests that potential practitioners could benefit from considering that historical context. To that end, it explores the career of Herbert John Fleure, a scholar whose career defied disciplinary (...) classification, but who was concerned to understand how the human past and present could be understood as they combined in the physical and social context of their production, and what they implied for the possibility of a human future. It concludes by arguing that Fleure’s major lesson for modern researchers is his confrontation of the contingent nature and political consequences of his conclusions. (shrink)

Jürgen Habermas’ discourse theory of morality should be understood, in metaethical terms, as a constructivist theory. All constructivist theories face a Euthyphro-like dilemma arising from how they classify the constraints on their metaethical construction procedures: are they moral or non-moral? Many varieties of Kantian constructivism, such as Christine Korsgaard’s, classify the constraints as moral, albeit constitutive of human reason and agency in general. However, this constitutivist strategy is vulnerable to David Enoch’s ‘shmagency’ objection. The discourse theory of morality, by classifying (...) the constraints on the metaethical construction procedure (principles (D) and (U)) as non-moral, can avoid this problem. (shrink)

This article critically examines the ways in which primatologists account for their research. Based on a series of unstructured interviews, it argues that the location of primates at the boundary between Western conceptions of nature and culture or human and animal has materially affected how primatologists talk about their research, what they find possible to write about in their research, and where they choose to publish their research. Through the discussion of a number of related topics, it outlines the reflexive (...) nature of primatologists’ response to the cultural positioning of their research subjects. (shrink)

We will focus on the theory of complete concept in the philosophy of Leib-niz. We will not emphasise the epistemological aspects, but rather will concentrate on the metaphysical implications of this theory. Some questions requiring an answer will be: are there two individual substances of the same kind? What is the nature of a substance that is only possible? What kind of notion has the unactualised possible? What is the nature of the relationship between individual substance and the complete no-tion? (...) In order to answer these questions, we will present in the first part of the paper the concept of individual substance, in the second part, we will focus on the problem whether the possible objects have or have not a complete concept, and in the third part we will give some additional arguments to support our answer. In theological discourse of sexuality, queer theory has often been regarded as an extension of the project of gay and lesbian liberation, when it actually challenges an organizing value of the entire discourse, because it challenges any ascription of ultimate value to "sex," an imaginative formation of power relations. Rather than appeal to God to authorize the privileged status of sex, queer commentary suggests that theological writers should refuse assertions of the absolute importance of any particular formation of human imagination (...) as a basis of relation between self and God. The goal is to recognize the violence—symbolized and real—that enforces the worth of certain imaginations of intelligibly sexed personal identity and stunts the formation of alternative imaginations of intelligible personal identity. Critical account of this violence as sentimental-homicidal-suicidal opens space to confess a theological discourse of personal identities that is entirely beyond sex. (shrink)

Rapid technological advances have produced a variety of novel techniques that allow a comprehensive assessment of brain function to be combined with detailed information about brain structure and connectivity. Any assessment that is based on exhibited behavior after brain injury will be prone to error for a number of reasons. These questions are explored in the context of recent studies in both healthy populations and brain injured patients that have sought to investigate covert awareness through the use of functional neuroimaging. Those circumstances in which functional magnetic resonance imaging data can be used to infer awareness in the absence of a behavioral response are contrasted with those circumstances in which it cannot. This distinction is fundamental for understanding and interpreting patterns of brain activity following acute brain injury and has implications for clinical care, diagnosis, prognosis, and medicolegal decision-making after serious brain injury. Superficially, citizenship appears relatively simple: a legal status denoting political membership. However, critical citizenship studies scholars suggest that citizenship is first and foremost a political practice. When non-citizens, such as irregularised migrants, constitute themselves as citizens through their actions, irrespective of legal status, these practices of citizenship have transformational potential because they are extra-legal. Yet, there is an ambivalence here: rights-claiming migrants tend to frame their key demands within the terms of the law often by calling for the regularisation of (...) their status. This article addresses this ambivalence by adopting a ‘deconstructive method’ to investigate the legal dimensions of citizenship as sites of theoretical and political intervention. It is argued that practices of rights-claiming by irregularised migrants are important to grasp because they mobilise the paradoxes inherent to the fact that universal rights are enshrined in the constitutional texts of modern citizenship in order to generate new legal meanings and horizons of justice. This hypothesis is explored through a series of illustrative examples of rights-claiming taking place within and beyond the formal confines of legal orders. In so doing, the article sets out a novel conceptual framework for analysing how migrants’ claims to justice strategically negotiate citizenship in its legal form. (shrink)

What are the leading forces and ideas that are shaping our age? In the West, a decade of financial disruption, austerity, and stagnant wages has produced a popular rejection of market fundamentalism that prevailed for over forty years. Mass immigration and multiculturalism have contributed to rapid changes in both family and community life that leave many people feeling dispossessed or even humiliated. Unresponsive government is exacerbating people’s sense of powerlessness and anger. The revolt against the status quo is fuelling a (...) political insurgency against the establishment that replaces the old opposition of left versus right with a similarly simplistic dichotomy pitting the people against the elites. We are witnessing the failure of dualistic thinking and this will not be resolved by substituting one binary for another. Our contemporary conjuncture is such a period of interregnum and a war of position between the hitherto hegemonic ideology of liberalism and its populist rivals. The popular revolt against liberalism, which is driving the political insurgency across the West, highlights the collapse of the authority of the professional political class dominated by liberals. In what follows I shall argue that the emergent ideologies which are vying for hegemony are hyper-liberalism, nationalist traditionalism, and tech utopianism. All of them are variously anti-humanist, to which one can oppose updated versions of one-nation conservatism and ethical socialism. Before setting out the unfolding ‘war of position,’ I will first explore the new anti-humanism that underpins the main ideological movements. (shrink)
