Purpose – This paper aims to examine the primary fundamental rights concerns related to biometrics and their use in automated border controls, as well as how these issues converge in the European Commission’s Smart Borders proposal. Design/methodology/approach – This paper draws on extensive background research and qualitative in-depth interviews conducted in 2013 for the European Union FP-7 project “FastPass – A harmonized, modular reference system for all European automatic border crossing points”. Findings – The Smart Borders proposal not only compounds (...) the individual concerns related to the use of biometrics in border controls and automatisation thereof, but also has serious issues of its own, premier among which is the imposition of a two-tier border control system. Social implications – The paper is a catalyst for open debate on the fundamental questions of how we got to this point and where do we want to go. It questions the process by which the increased use of IT in border controls has become the norm and policy trend in Europe, and discusses where the limits could be drawn from a fundamental rights perspective. In particular, it warns against the institutionalisation of a two-tier border control system among third-country nationals. Originality/value – Little attention is given to the fundamental rights concerns raised for EU and non-EU citizens as related to biometrics and their use in ABCs, and how these issues are reproduced in the Smart Borders proposal. The paper fills this gap by taking a bottom-up approach: examining the implications of individual elements of the proposal to see their impact on the broader policy. (shrink)

How can we solve the paradox of false-belief understanding: if infants pass the implicit false belief task by nonverbal behavioural responses why do they nonetheless typically fail the explicit FBT till they are 4 years old? Starting with the divide between situational and cognitive accounts of the development of false-belief understanding, we argue that we need to consider both situational and internal cognitive factors together and describe their interaction to adequately explain the development of children’s Theory of Mind ability. We (...) then argue that a further challenge is raised for existing accounts by helping behaviour versions of the FBT. We argue that the common two-stage accounts are inadequate: we need to allow for three central stages in a continuous development. Furthermore, drawing on Perner et al.’s and Perner and Leahy’s : 491–508, 2016) recent mental files account, we provide a new account of the development of these three stages of ToM ability by describing the changes of the structure and organisation of mental files including the systematic triggering role of types of situations. Thereby we aim to establish a situational mental file account as a new and adequate solution to the paradox of false-belief understanding. (shrink)

This essay asks if there is a role for an active public in ratcheting down the harsh politics of crime control in the United States and the United Kingdom that has led to increased use of the criminal law and greater severity in punishment. It considers two opposing answers offered by political and legal theorists and then begins to develop a participatory democratic framework for institutional reform.

This paper compares the ethical standards reported by consumers and managers with different attachment styles (secure, preoccupied, fearful, or dismissing). We conducted two studies of consumer ethical beliefs and a third managerial survey. In Study 1, we used a questionnaire that we constructed, and in Study 2, we used the Muncy–Vitell Consumer Ethics Scale. The results in both the studies were consistent and showed that men reported a greater indifference to ethical transgressions than women. Based on the two studies, the (...) results indicate that␣among male consumers, the dismissing participants reported the greatest overall indifference to ethical transgressions and the secure participants expressed the most ethical beliefs. The two intermediate groups did not differ significantly from each other. In Study 1, none of the women consumers reported a dismissing attachment style. Women with a secure style reported more ethical beliefs than those in the other two groups. However, the sample in Study 2 included dismissing women. The dismissing women reported the greatest overall indifference to ethical transgressions and the secure women expressed the most ethical beliefs. The illegal profit subscale described the most severe ethical transgressions, and for both men and women, the secure participants were less apt than the other participants to report a willingness to transgress. In Study 3, the Newstrom and Ruch (1975, MSU Business Topics, Winter, 31) Questionnaire was administered to 227 managers. All four attachment patterns were represented among the participants of both genders. In all cases, the participants with a dismissing attachment style showed the greatest readiness to transgress. This paper is concerned with the logical structure of arithmetical theories. We survey results concerning logics and admissible rules of constructive arithmetical theories. We prove a new theorem: the admissible propositional rules of Heyting Arithmetic are the same as the admissible propositional rules of Intuitionistic Propositional Logic. We provide some further insights concerning predicate logical admissible rules for arithmetical theories.

In this paper, we show how to construct for a given consistent theory U a $$\varSigma ^0_1$$ Σ 1 0 -predicate that both satisfies the Löb Conditions and the Kreisel Condition—even if U is unsound. We do this in such a way that U itself can verify satisfaction of an internal version of the Kreisel Condition.

The theology of John Calvin has deeply affected the American mentality through two streams of thought, Puritanism and Jansenism. These traditions formulate moral problems in terms of absolute, clear principles and avoid casuistic analysis of moral problems. This approach is designated American moralism. This article suggests that the bioethics movement in the United States was stimulated by the moralistic mentality but that the work of the bioethics has departed from this viewpoint. The aim of this article is to consider the possibility of a new analytical methodology that could include multidisciplinary approaches into the study of religious ideologies and practices, taking benefit from historical and ethnographic interpretations, but also from linguistic and philological, psychoanalytical, philosophical, sociological, and anthropological considerations. If one tries to study the role or function played by religion in society, considering human beings as builders of symbolic worlds, one should set out to analyze, if not rules, at least general (...) processes of the religious readjustment with respect to the rest of social life, whenever the gap is much too wide, or the religious transfer from one realm to another entirely different. This paper contrasts biomedical and epidemiological approaches to the diagnosis and treatment of disease, and uses Collingwoods principle of the relativity of causes to show how different approaches focus on different causal factors reflecting different interests. By distinguishing between the etiology of a disease and an epidemic, the paper argues that, from an epidemiological perspective, poverty is an important causal factor in the African AIDS epidemic and that emphasizing this should not be considered incompatible with recognizing the causal necessity of (...) The theory of language that underlies Plotinus’ Enneads is considered in relation to his broader metaphysical vision. For Plotinus, language is neither univocal nor equivocal, but is something in-between, incapable of precisely describing reality, but nonetheless not completely useless. Propositional knowledge expressed discursively represents an imperfect shadow of reality which is defective in relation to the pure apprehension of Intellect. Passages in Plotinus which relate language to the sensible world are examined and it is argued that, although it plays a (...) useful role in relating the sensible world to Intellect, discursive reason is nonetheless intrinsically inferior to both as a mode of representation. Plotinus holds that the inadequacy of language is “global” in character; language cannot describe any aspect of reality precisely, from the mundane to the transcendent. Language as a whole is an inferior image or imitation of the world as a whole. Therefore, the flaws in our linguistic representations cannot all be untangled or conceptually unpacked by means of language. There are passages in the Enneads which hint at an underlying semantic holism. Plotinus’ theory implies that apparent verbal contradictions which occur in different contexts might nonetheless still represent the optimal linguistic description of a reality that strictly speaking is ineffable. Therefore, discursive logical deduction is not always reliable, and needs to be subordinated to a vision of Intellect. True philosophical reasoning (dialectic) represents ostension towards the transcendent. Those who are sufficiently liberated to attain to an apprehension of the Forms, thereby come to inhabit the same “higher world”, involving a shared mystical intersubjectivity, which can be expressed linguistically, but only in an approximate manner. Plotinus’ theory presents a potential way out of the nihilistic impasse into which contemporary philosophy has arguably become enmeshed. (shrink)

For all its celebrity, Thucydides' Funeral Speech remains an enigma. ‘Unquantifiably authentic’ is how one scholar describes it, and the description betrays a measure of despair. We feel that the speech is authentic in some sense of the word. To some degree it corresponds to what Pericles actually said in the winter of 431/30 BC, but the degree of correspondence is a mystery. All agree that Thucydides framed the speech in his own words and integrated it with his historical narrative, (...) so as to recall and answer Archidamus' encomium of Sparta in Book I. It also anticipates the forthcoming description of the plague with mordant, subtle allusions. (shrink)

Many years ago, the esteemed patriarch of bioethics, Joseph Fletcher, spoke loud and clear in favor of rationality in reproduction. By rationality, he meant not merely limiting population growth, which he certainly favored, but bringing to bear human analytic and creative intelligence on the random and instinctive activities of sexual intercourse and procreation that we share with all mammals. In his 1974 book, The Ethics of Genetic Control: Ending Reproductive Roulette, he foresaw most of the issues that we are facing (...) today. He reflected on artificial insemination, prenatal diagnosis, cloning, eugenics, ectogenesis, ovum transfers, and genetic engineering. He examined these innovations to the extent that he felt that each of them represents a way of exercising rational and responsible control over life and reproduction. The subtitle of his book, “Ending Reproductive Roulette,” proclaims his faith. Dr. Fletcher's dedication to rationality led him to make the astonishing statement, “Man is a maker and the more rationally contrived and deliberate anything is, the more human it is. Therefore, laboratory reproduction is radically human compared to conception by ordinary heterosexual intercourse.”. (shrink)

Con una metodología que deconstruye algunas consideraciones filosóficas sobre la pandemia, se alcanza el resultado de que es preciso estimular valores y actitudes que lleven hacia la cooperación y el reconocimiento si se quiere lograr una significativa humanización de las personas, sociedades y culturas. Así, se concluye que urge una revolución humana de la mano de la filosofía, con la que (...) se revalorice el diálogo, la racionalidad comunicativa, la intersubjetividad y lo colectivo, junto con la sencillez y la cotidianidad. Plasma protein therapies are a group of essential medicines extracted from human plasma through processes of industrial scale fractionation. They are used primarily to treat a number of rare, chronic disorders ensuing from inherited or acquired deficiencies of a number of physiologically essential proteins. These disorders include hemophilia A and B, different immunodeficiencies and alpha 1-antitrypsin deficiency. In addition, acute blood loss, burns and sepsis are treated by PPTs. Hence, a population of vulnerable and very sick individuals is dependent on (...) these products. In addition, the continued well-being of large sections of the community, including pregnant women and their children, travelers and workers exposed to infectious risk is also subject to the availability of these therapies. Their manufacture to adequate amounts requires large volumes of human plasma as the starting material of a complex purification process. Mainstream blood transfusion services run primarily by the not-for-profit sector have attempted to provide this plasma through the separation of blood donations, but have failed to provide sufficient amounts to meet the clinical demand. The collection of plasma from donors willing to commit to the process of plasmapheresis, which is not only time consuming but requires a long term, continuing commitment, generates much higher amounts of plasma and has been an activity historically separate from the blood transfusion sector and run by commercial companies. These companies now supply two-thirds of the growing global need for these therapies, while the mainstream government-run blood sector continues to supply a shrinking proportion. The private sector plasmapheresis activity which provides the bulk of treatment products has been compensating the donors in order to recognize the time and effort required. Recent activities have reignited the debate regarding the ethical and medical aspects of such compensation. In this work, we review the landscape; assess the contributions made by the compensated and non-compensated sectors and synthesize the outcomes on the relevant patient communities of perturbing the current paradigm of compensated plasma donation. We conclude that the current era of “Patient Centeredness” in health care demands the continuation and extension of paid plasma donation. (shrink)

The frequency theory of probability on its own is irrelevant in the single case. However, Howson and Urbach argue that Bayesianism can solve the frequentist's problem: frequentist-probability information is relevant to Bayesians.
