This essay asks if there is a role for an active public in ratcheting down the harsh politics of crime control in the United States and the United Kingdom that has led to increased use of the criminal law and greater severity in punishment. It considers two opposing answers offered by political and legal theorists and then begins to develop a participatory democratic framework for institutional reform.

The Internet has become a field of dragon teeth for a person’s identity. It has made it possible for your identity to be mistaken by a credit agency, spied on by the government, foolishly exposed by yourself, pilloried by an enemy, pounded by a bully, or stolen by a criminal. These harms to one’s integrity could be inflicted in the past, but information technology has multiplied and aggravated such injuries. They have not gone unnoticed and are widely bemoaned and discussed. (...) The government and private watchdogs are working to protect the identity of citizens though at least in the United States both the government and individuals all too often side with prosperity when it conflicts with privacy. Still, these information-technological threats to identity have been recognized and can be reasonably met through legislation, regulation, and discretion. There is another kind of danger to our identity that is more difficult to define and to meet, for it has no familiar predecessors, has no criminal aspects, and exhibits no sharp moral or cultural contours. Still that threat to our identity haunts us constantly and surfaces occasionally in conversations and the media. It makes us feel displaced, distracted, and fragmented at the very times when to all appearances we seem to be connected, busy, and energetic. At the same time, the culture of technology, and of information technology particularly, has opened up fields of diversity and contingency that invite us to comprehend our identities in newly responsible, intricate, and open-minded ways. This paper compares the ethical standards reported by consumers and managers with different attachment styles (secure, preoccupied, fearful, or dismissing). We conducted two studies of consumer ethical beliefs and a third managerial survey. In Study 1, we used a questionnaire that we constructed, and in Study 2, we used the Muncy–Vitell Consumer Ethics Scale. The results in both the studies were consistent and showed that men reported a greater indifference to ethical transgressions than women. Based on the two studies, the (...) results indicate that␣among male consumers, the dismissing participants reported the greatest overall indifference to ethical transgressions and the secure participants expressed the most ethical beliefs. The two intermediate groups did not differ significantly from each other. In Study 1, none of the women consumers reported a dismissing attachment style. Women with a secure style reported more ethical beliefs than those in the other two groups. However, the sample in Study 2 included dismissing women. The dismissing women reported the greatest overall indifference to ethical transgressions and the secure women expressed the most ethical beliefs. The illegal profit subscale described the most severe ethical transgressions, and for both men and women, the secure participants were less apt than the other participants to report a willingness to transgress. In Study 3, the Newstrom and Ruch (1975, MSU Business Topics, Winter, 31) Questionnaire was administered to 227 managers. All four attachment patterns were represented among the participants of both genders. In all cases, the participants with a dismissing attachment style showed the greatest readiness to transgress. The theology of John Calvin has deeply affected the American mentality through two streams of thought, Puritanism and Jansenism. These traditions formulate moral problems in terms of absolute, clear principles and avoid casuistic analysis of moral problems. This approach is designated American moralism. This article suggests that the bioethics movement in the United States was stimulated by the moralistic mentality but that the work of the bioethics has departed from this viewpoint. Bei einer groben Betrachtungsweise wird meist nur zwischen dem frühen und dem späten Wittgenstein unterschieden, dem Verfasser des Tractatus logico-philosophicus von 1918 und dem Verfasser der 1953 posthum veröffentlichten Philosophischen Untersuchungen. Die Fülle der nachgelassenen Schriften erlaubt es uns jedoch, ein klares Bild der Entwicklung seines Denkens zu zeichnen. Im Zentrum des Aufsatzes steht die Diskussion des Farbenausschlusses, wobei dieser besagt, daß zwei Farben nicht zur selben Zeit am selben Ort gegeben sein können. Zunächst wird geklärt, wie sich die Sprachphilosophie (...) Wittgensteins durch die Thesen zum Farbenausschluß in dem Aufsatz „Some Remarks on Logical Form" im Vergleich zu seiner Position im TLP geändert hat. Die Thesen in SR bilden eine Übergangsposition vom TLP hin zu einer Kalkültheorie der Bedeutung, die sich 1931/32 ausbildete. Alle diese Positionen bewegen sich noch im Rahmen einer allgemein verstandenen Bildtheorie, die durch die Veränderungen stetig unterhöhlt und erst 1932/33 von einer Gebrauchstheorie der Bedeutung abgelöst wird. Das Modell von der Entwicklung der Sprachphilosophie Wittgensteins kann als Bild der insgesamt umfassenden, aber stufenweise erfolgenden Änderung der Theorie der sprachlichen Bedeutung charakterisiert werden. For all its celebrity, Thucydides' Funeral Speech remains an enigma. ‘Unquantifiably authentic’ is how one scholar describes it, and the description betrays a measure of despair. We feel that the speech is authentic in some sense of the word. To some degree it corresponds to what Pericles actually said in the winter of 431/30 BC, but the degree of correspondence is a mystery. All agree that Thucydides framed the speech in his own words and integrated it with his historical narrative, (...) so as to recall and answer Archidamus' encomium of Sparta in Book I. It also anticipates the forthcoming description of the plague with mordant, subtle allusions. (shrink)

The aim of this article is to consider the possibility of a new analytical methodology that could include multidisciplinary approaches into the study of religious ideologies and practices, taking benefit from historical and ethnographic interpretations, but also from linguistic and philological, psychoanalytical, philosophical, sociological, and anthropological considerations. If one tries to study the role or function played by religion in society, considering human beings as builders of symbolic worlds, one should set out to analyze, if not rules, at least general (...) processes of the religious readjustment with respect to the rest of social life, whenever the gap is much too wide, or the religious transfer from one realm to another entirely different. El objetivo de este trabajo es fomentar el cultivo de una nueva humanidad tras la dramática vivencia de la Covid-19. Con una metodología que deconstruye algunas consideraciones filosóficas sobre la pandemia, se alcanza el resultado de que es preciso estimular valores y actitudes que lleven hacia la cooperación y el reconocimiento si se quiere lograr una significativa humanización de las personas, sociedades y culturas. Así, se concluye que urge una revolución humana de la mano de la filosofía, con la que (...) se revalorice el diálogo, la racionalidad comunicativa, la intersubjetividad y lo colectivo, junto con la sencillez y la cotidianidad. The theory of language that underlies Plotinus’ Enneads is considered in relation to his broader metaphysical vision. For Plotinus, language is neither univocal nor equivocal, but is something in-between, incapable of precisely describing reality, but nonetheless not completely useless. Propositional knowledge expressed discursively represents an imperfect shadow of reality which is defective in relation to the pure apprehension of Intellect. Passages in Plotinus which relate language to the sensible world are examined and it is argued that, although it plays a (...) useful role in relating the sensible world to Intellect, discursive reason is nonetheless intrinsically inferior to both as a mode of representation. Plotinus holds that the inadequacy of language is “global” in character; language cannot describe any aspect of reality precisely, from the mundane to the transcendent. Language as a whole is an inferior image or imitation of the world as a whole. Therefore, the flaws in our linguistic representations cannot all be untangled or conceptually unpacked by means of language. There are passages in the Enneads which hint at an underlying semantic holism. Plotinus’ theory implies that apparent verbal contradictions which occur in different contexts might nonetheless still represent the optimal linguistic description of a reality that strictly speaking is ineffable. Therefore, discursive logical deduction is not always reliable, and needs to be subordinated to a vision of Intellect. True philosophical reasoning (dialectic) represents ostension towards the transcendent. Those who are sufficiently liberated to attain to an apprehension of the Forms, thereby come to inhabit the same “higher world”, involving a shared mystical intersubjectivity, which can be expressed linguistically, but only in an approximate manner. Plotinus’ theory presents a potential way out of the nihilistic impasse into which contemporary philosophy has arguably become enmeshed. (shrink)
