In recent years, counterfeiting has grown exponentially and has now become a grave economic problem. The acquisition of counterfeits poses an ethical dilemma as it benefits the buyer and illegal seller at the cost of the legitimate producer and with fewer taxes being paid throughout the supply chain. Previous research reveals inconsistent and sometimes inconclusive findings regarding whether materialism is associated, positively or negatively, with intentions to purchase counterfeits. The current research seeks to resolve these inconsistencies by investigating previously ignored (...) interactions between three variables: risk of embarrassment, counterfeit detectability and product conspicuousness. First, risk of embarrassment mediates the relationship between materialism and counterfeit purchase intentions. Specifically, materialism negatively predicts counterfeit purchase intentions as mediated by risk of embarrassment. Second, this relationship only holds when the counterfeit can be easily detected. When it is not easily detected, materialism instead leads to positive purchase intentions. Third, these positive effects can be offset when the product is not highly visible. This research has important implications for marketers, manufacturers and academics and contributes to better understanding the antecedents of counterfeit purchases. (shrink)

To understand the future of informed consent, we should pay attention to two ethical-legal sources in addition to the revised Common Rule. Physicians acting as investigators and patients serving as research subjects bring to that relationship a long history regarding consent to treatment, and everyone dealing with research ethics needs to be aware of the Nuremberg Code and other human-rights documents. These three streams make separate and distinctly different contributions to informed consent doctrine.

This article focuses on the question of whether the doctrine of the real presence of Christ's body and blood, and likewise the doctrine of the real absence of bread and wine, can be defended philosophically. It argues for an affirmative answer, and does so by considering a variety of metaphysical models, including that of Aquinas. It will appear, thus, that transubstantiation is a philosophical possibility. If it is possible for two substances to be in the same place at the same (...) time, consubstantiation will be a philosophical possibility as well. Evolutionary game theoretic accounts of justice attempt to explain our willingness to follow certain principles of justice by appealing to robustness properties possessed by those principles. Skyrms (1996) offers one sketch of how such an account might go for divide-the-dollar, the simplest version of the Nash bargaining game, using the replicator dynamics of Taylor and Jonker (1978). In a recent article, D'Arms et al. (1998) criticize his account and describe a model which, they allege, undermines his theory. I sketch a (...) theory of evolutionary explanations of justice which avoids their methodological criticisms, and develop a spatial model of divide-the-dollar with more robust convergence properties than the models of Skyrms (1996) and D'Arms et al. Recent research suggests that processing of irrelevant information can be modulated in a rapid online fashion by contextual information in the task environment depending on the usefulness of that information in different contexts. Congruency effects evoked by irrelevant stimulus attributes are smaller in contexts with high proportions of incongruent trials and larger in contexts with high proportions of congruent trials . The present study investigates these context-adaptation effects in a masked-priming paradigm. Context-specific adaptation effects transfer to stimulus identities that are (...) equiprobale in all contexts – an observation that renders explanations in terms of event-learning processes unlikely. Yet, context-specific effects vanished when the irrelevant information remained unconscious. The results suggest that context-specific adaptation of congruency effects reflect cognitive control operations that alter the processing of irrelevant information depending on the experienced utility of that information for action control. Intellectual property law operates with the ontological assumption that immaterial goods such as works, inventions, and designs exist, and that these abstract types can be owned like a piece of land. Alexander Peukert provides a comprehensive critique of this paradigm, showing that the abstract IP object is a speech-based construct, which first crystalised in the eighteenth century. He highlights the theoretical flaws of metaphysical object ontology and introduces John Searle's social ontology as a more plausible approach to the subject (...) matter of IP. On this basis, he proposes an IP theory under which IP rights provide their holders with an exclusive privilege to use reproducible 'Master Artefacts.' Such a legal-realist IP theory, Peukert argues, is both descriptively and prescriptively superior to the prevailing paradigm of the abstract IP object. Natural selection of specific protobiomonomers during abiogenic development of the prototype genetic code is hindered by the diversity of structural, spatial, and rotational isomers that have identical elemental composition and molecular mass (M), but can vary significantly in their physicochemical characteristics, such as the melting temperature Tm, the Tm:M ratio, and the solubility in water, due to different positions of atoms in the molecule. These parameters differ between cis- and trans-isomers of dicarboxylic acids, spatial monosaccharide isomers, and structural isomers of (...) α-, β-, and γ-amino acids. The stable planar heterocyclic molecules of the major nucleobases comprise four (C, H, N, O) or three (C, H, N) elements and contain a single –C=C bond and two nitrogen atoms in each heterocycle involved in C–N and C=N bonds. They exist as isomeric resonance hybrids of single and double bonds and as a mixture of tautomer forms due to the presence of –C=O and/or –NH2 side groups. They are thermostable, insoluble in water, and exhibit solid-state stability, which is of central importance for DNA molecules as carriers of genetic information. In M–Tm diagrams, proteinogenic amino acids and the corresponding codons are distributed fairly regularly relative to the distinct clusters of purine and pyrimidine bases, reflecting the correspondence between codons and amino acids that was established in different periods of genetic code development. The body of data on the evolution of the genetic code system indicates that the elemental composition and molecular structure of protobiomonomers, and their M, Tm, photostability, and aqueous solubility determined their selection in the emergence of the standard genetic code. This essay aims to articulate why the Orthodox have historically, and to the present, opposed cremation. Its primary line of argument is that inhumation is a site of “theophanic encounter”: a manifestation of the Glory of God. This theophanic quality is borne out in the scriptures and the Church’s liturgical experience. In particular, the connections between the funeral service and the entombed Christ on Holy Friday and Saturday properly situate the meaning of the post-mortem body. This intimate connection between the (...) deceased and their body is clear in Orthodoxy’s “hylomorphism,” the soul-body unity, which champions the eschatology of resurrection. Finally, all of the above is concretely experienced in the cult of the saints and their relics, which become vehicles for the divine energies: a theophany of Christ’s ongoing conquest of sin and death. Thus, cremation can only be viewed as a tragic misunderstanding of the dual meaning of “doxa” in Orthodoxy: right-belief and right-glory. (shrink)

A common and driving assumption in agricultural research is that the introduction of research trials, new practices and innovative technologies will result in technology adoption, and will subsequently generate benefits for farmers and other stakeholders. In Lao PDR, the potential benefits of introduced technologies have not been fully realised by beneficiaries. We report on an analysis of a survey of 735 smallholder farmers in Southern Lao PDR who were questioned about factors that influenced their decisions to adopt new technologies. In (...) this study, we have constructed measures or states of adoption which identify key elements of an adoption decision-making nexus. Analysis was conducted to statistically group explanatory factors of adoption. The key explanatory factors represented attributes of the farmer, the factors considered when undertaking production decisions and elements of the agricultural value chain that present as opportunities or constraints. We describe the combination of farmer’s personal attributes, perceptions of the value chain, and the introduction of new technologies by external actors as an “agricultural research value chain”, where agricultural research activities intervene to derive greater benefits for local farmers. A generalised linear model, via Poisson regression analysis on the identified explanatory factors, was applied to explore how they influence adoption measures and we found several significant relationships. The goal of this thesis is to provide an account of phenomenal unity, the togetherness felt between our conscious experiences. I begin in the first chapter by spelling out the target phenomenon in more detail. I organize the discussion around the analysis question—what does phenomenal unity consist in or reduce to?—and clarify the desiderata we want an answer to the analysis question to meet. In the second and third chapter, I look at answers to the analysis question, organized under two (...) broad headings. In the second chapter, I examine a slate of monistic theories, which argue that phenomenal unity consists in a single relation which holds between phenomenal experiences. In the third chapter, I examine pluralistic theories, which argue that phenomenal unity consists in a plurality of relations between phenomenal experiences. My overall aim is twofold: 1) argue for a pluralistic approach to the analysis question, and 2) argue for a specific pluralistic account, the many relations account. Once I have argued for my specific pluralistic account, I apply it to other questions surrounding phenomenal unity in chapter 4. (shrink)

Coall & Hertwig (C&H) give an ambitious review about the broad range of grandparenting literature from the perspective of different disciplines. They aim to show, how evolutionary theory, sociology, and economics can mutually enrich each other. However, the differences between the evolutionary and the socio-economic perspective should be more clearly pointed out, because they usually deal with different research questions. Grandparents' well-being could be divided into its underlying components.

The A-theory of time states that there is an absolute fact of the matter about what events are, respectively, in the past, present and future. The B-theory says that all there is to temporality are the relations of earlier-than, later-than and simultaneous-with, and the past, present and future are merely relative.

As Mark Murphy has recently shown, standard justifications of universal divine authority are insufficient. [1] By “divine authority” I shall mean the doctrine that obedience is morally owed to God by all. God would not give us a command that we did not have a reason to act in accordance with, Murphy argues, but it does not follow that we would be obliged, much less morally obliged, to have the fact of God’s having commanded the action be among our practical (...) reasons for the action. We might, for instance, think that what God has commanded us is prudentially the best policy for us or that it is the best possible evidence for what is on independent grounds morally obligatory. In The LEGO Movie, Vitruvius's notion of the "The Special" introduces what will be a central motif for the film. As it turns out, the one who finds this "Piece of Resistance" is not quite the hero he was expected to be. Emmet Brickowoski, a construction worker, will find this "Piece of Resistance". Throughout the film, others suggest to Emmet both implicitly and explicitly that he brings nothing of value to any particular individual or to society, and that consequently he (...) himself has no value. If one interpret The LEGO Movie as being driven by Emmet's quest for discovering his value, the real philosophical turning point in the film is not when Emmet's double‐decker couch permits the Master Builders to escape from the sinking submarine and they realize that Emmet's ideas actually are useful. Rather, it is when Emmet realizes their approval is irrelevant to his value. (shrink)

There is much in Weinstein’s article to contemplate, but I shall limit myself to making the following four main points. First, I believe that debates concerning the normative standing of hate speech law are always improved by heeding the internal variety of such law, and although I can see something of that same care in Weinstein’s article, such as when he distinguishes between different forms of hate speech law based on relative detriment to the legitimacy of so-called downstream laws, in (...) some instances this care is lacking. Second, Weinstein plays up the importance of collective authorization or democratic legitimacy of downstream laws vis-à-vis “(a) the obligation of those restrained by the speech restriction to obey a downstream antidiscrimination law; and (b) the morality of enforcing the downstream measure against those whose participatory rights have been impaired by the upstream speech restriction.” These may be important aspects of what it means to detract from the legitimacy of downstream laws, but they do not exhaust the relevant aspects. Third, I think that Weinstein’s article ignores some important nuances in what I have argued about hate speech laws and political legitimacy, and ignores something that might be true of the relationship between political and democratic legitimacy, namely, it might be that political legitimacy takes lexical priority over and, therefore, cannot be traded off against, the collective authorization or democratic legitimacy of downstream laws. Finally, I believe that in describing my use of the precautionary principle as “plainly indefensible” Weinstein has done justice neither to the raw plausibility of that principle nor to how I applied it to the special silencing effects of hate speech. The article discusses Ilyenkov's conception of the ideal, which has its roots in Marx's concept of human as a sociohistorical being, yet goes beyond Marx by developing a concrete understanding of human social activity. Defined dialectically as a form of the subjective activity of social man that has objective meaning and significance, the ideal in Ilyenkov is not simply a form of "social representation" , but it rather exists as man's ideal activity toward realization of his own goals, and as (...) such it guides creative activity in the world, opening up new horizons for human development. The ‘Platonic Ideas’ in Schopenhauer’s metaphysics are appearances. On the other hand, as the immediate objecthood of the will, they are the essences of species and the only object of true aesthetic cognition, which leads beyond mere appearance. To explain this apparent incongruence, I offer an analysis of Schopenhauer’s early metaphysics, and its transformation into the metaphysics of will, fleshing out the several and divergent concepts of ‘idea’. Specifically, first, as part of his religious and neo-Platonic early philosophy; second, in (...) the context of his ‘true criticism’ in the spirit of Kantian transcendental philosophy; third, as identical to the thing in itself as part of the metaphysics of will, heavily influenced by Kant’s notion of ideas from CR and CJ. Explaining Schopenhauer’s mature notion of Platonic Ideas genetically as a set of homonymic notions helps us better explain its divergent meanings in WWR. (shrink)
