Focus of this article is Bernard's definitions and ideas surrounding power (potestas). The first section will outline terminology drawing a distinction between Bernard's use of the terms potestas and auctoritas. Auctoritas is used less frequently by Bernard and is limited to descriptions of ecclesiastical matters; it is not predicated to the functions of a secular ruler whether king or emperor. Conversely, potestas has a wide variety of uses and applications including descriptions of the power of God, the secular power and (...) the ecclesiastical power which is defined as potestas ligandi et solvendi. Given its range of meanings and uses, potestas is not a technical term for Bernard. Rather, potestas is a biblical term of which the frequency and prevalence in the text of the Vulgate certainly influenced Bernard. Since Bernard uses potestas in both ecclesiastical and secular descriptions, other terms are helpful in drawing distinctions between the two spheres, e. g. ministerium and dominium, which as contrasting terms provide a point of entry into this discussion. /// Objectivo do presente artigo é estudar as definições de Bernardo de Claraval bem como as suas ideias a propósito da noção de poder (potestas). Na primeira secção do artigo, a autora clarifica a terminologia estabelecendo uma distinção entre o uso que Bernardo faz dos termos potestas e auctoritas. O termo auctoritas é usado por Bernardo menos frequentemente e aparece limitado a descrições relativas a assuntos eclesiásticos; o termo não se aplica às funções de um governante secular, seja ele rei ou imperador. Por outro lado, potestas possui uma ampla variedade de usos e aplicações incluindo descrições do poder de Deus, do poder secular e do poder eclesiástico o qual é definido como potestas ligandi et solvendi. This chapter considers some of the philosophical writings of Alice Ambrose (1906–2001) and Margaret MacDonald (1903–1956), particularly in relation to their responses to Russell’s work. It argues that both need to be recovered and reconsidered as significant philosophers in their own right, who have important contributions to make to the familiar problems posed by ordinary language in relation to philosophy. Ambrose worked mainly in mathematics and symbolic logic and her earliest publications drew a critical response from Russell himself. Responding (...) in turn to the work of Russell, among others, she went on to bring clarity to the various ways in which ordinary language featured in contemporary philosophical discussion, and identified the centrality of ‘linguistic innovation’ to much philosophical practice. MacDonald found much to agree with in Russell’s work on analysis, but she, too, was troubled by his dismissive attitude to ordinary language. She argued that many philosophical problems can be solved by understanding how language is ordinarily used, and published her case before more celebrated ‘ordinary language philosophers’, most notably J. L. Austin. She also set out ideas and terminology which were later to be associated with Austin’s speech act theory in her contributions to ethics and aesthetics. Both Ambrose and MacDonald contributed to and extended the application of the study of ordinary language in analytic philosophy in ways which deserve to be recovered and to be subjected to further philosophical scrutiny. While discussions of the imagination have been limited in philosophy of science, this is beginning to change. In recent years, a vast literature on imagination in science has emerged. This paper surveys the current field, including the changing attitudes towards the scientific imagination, the fiction view of models, how the imagination can lead to knowledge and understanding, and the value of different types of imagination. In The Atrocity Paradigm, Claudia Card suggests we forgiveness as a potentially valuable exercise of a victim's moral powers. Yet Card never makes explicit just what 'moral powers' are, or how to understand their grounding or scope. I draw out unacknowledged implications of her framework: namely, that others than the primary victim may forgive, and -- conversely -- that some victims may find themselves morally dis-empowered. Furthermore, talk of "moral powers" allows us to appropriately acknowledge the value of refusals to (...) forgive and the issue of "forgivable" evils, in ways that talk of forgiveness as a duty or virtue cannot. Philosophy has a language problem. A recent study by Schwitzgebel, Huang, Higgins and Gonzalez-Cabrera (2018) found that, in a sample of papers published in elite journals, 97% of citations were to work originally written in English. 73% of this same sample didn’t cite any paper that had been originally written in a language other than English. Finally, a staggering 96% of elite journal editorial boards are primarily affiliated with an Anglophone university. This is consistent with earlier data suggesting that journal (...) submissions from countries that are outside the Anglophone world and Europe have disturbingly low chances of being accepted. The route forward is not entirely clear. What is clear, however, is that this structural disadvantage deserves closer philosophical and empirical attention. We owe this to current and future members of our philosophical community who speak English non-natively. We also need this if we want to make sure philosophy is enriched by a diverse group of thinkers who have a grasp of different languages, and of the cultures strongly associated with them. (shrink)

The paper explores whether the method of reflective equilibrium (RE) in ethics and political philosophy should be individual or public in character. I defend a modestly public conception of RE, in which public opinion is used specifically as a source of considered judgments about cases. Public opinion is superior to philosophical opinion in delivering judgments that are untainted by principled commitments. A case-based approach also mitigates the methodological problems that commonly confront efforts to integrate philosophy with the investigation of popular (...) attitudes. This conception of RE is situated in relation to alternative accounts, including those of Daniels, Rawls, and Wolff and de-Shalit. (shrink)

Policy‐makers, bioethicists, and patient advocates have been engaged in a fierce battle about the merits and potential harms of a federal right‐to‐try law. This debate about access to investigational medical products has raised profound questions about the limits of patient autonomy, appropriate government regulation, medical paternalism, and political rhetoric. For example, do patients have a right to access investigational therapies, as the right‐to‐try movement asserts? What is government’s proper role in regulating and facilitating access to drugs that are still in (...) development? In this review, we analyze the history of the right‐to‐try movement, review the arguments put forth by supporters and opponents of the legislation, and consider the movement’s consequences. Two possible scenarios may emerge. One is that the right‐to‐try pathway may fail to meaningfully increase patient access to investigational products. Alternatively, certain companies may attempt to rely on the federal right‐to‐try legislation to sell investigational products, taking advantage of the provision that allows for direct costs, as there is currently no clear mechanism for enforcement or monitoring of cost calculations. In lieu of an abstract, here is a brief excerpt of the content:On Women Englishing Homer RICHARD HUGHES GIBSON Seven kingdoms strove in which should swell the womb / That bore great Homer; whom Fame freed from tomb,” so begins the fourth of “Certain ancient Greek Epigrams ” that George Chapman placed at the head of his Odyssey at its debut in 1615.1 The epigram was no mere antiquarian dressing for the text. It suggests a historical parallel with the (...) translator’s own feat—for this Odyssey appeared on the heels of Chapman’s 1611 Iliad, the first complete English translation of Homer directly from the Greek. Indeed, the title page of that Iliad boasted, “Never before in any language truly translated” (italics mine). In “Englishing ” Homer (as he put it), Chapman had vanquished not only local rivals but also the whole international field.2 Through Chapman, England bore Homer anew. Yet within a few decades challengers appeared. An octogenarian Thomas Hobbes published an Odyssey translation in 1675 and an Iliad the following year. Alexander Pope’s versions (Iliad, 1715–1720; Odyssey, 1726) were bestsellers in the next century, yet others soon enough sought to better them, including the poet William Cowper (Iliad, 1791; Odyssey, 1809). The rate of Homeric production then intensified in the nineteenth century, becoming in Edith Hall’s apt phrase a “national pastime” in Victorian Britain—and, I would add, in the United States too.3 In the 1860s, a new English Iliad or Odyssey debuted nearly every year, making Matthew Arnold, then Professor of Poetry at Oxford, seem prescient in selecting “On Translating Homer” as the topic for his 1860 lecture series. Anglo-American output of new English Homers has been steady ever since. The opening decades arion 26.3 winter 2019 of our century have been especially high-yielding—more than ten new Iliads and eight new Odysseys have appeared in print alongside fresh editions of twentieth-century favorites. Digital versions now circulate, too. To Chapman we might thus reply: Once seven Greek cities strove to be Homer’s nurse; now seventy tomes vie to be his English verse. Run down the complete bibliography, and a pattern already hinted in my list of notables becomes pronounced: name after name after name belongs to a man. Flip around a bit, and one can often find traces of women in these volumes. Hobbes, for example, argued in the preface to his translations that women have as “just” a “pretence” (in the sense of “claim”) as men to the moral education afforded by heroic poems, though one might cynically read this as a marketing strategy.4 Pope readily acknowledged his debt to the scholarship of Anne Le Fèvre Dacier, Homer’s first French female translator, and listed prominent female supporters in the subscription lists at the front of his editions.5 Women thus long factored into the business of “Englishing” classical texts, though almost exclusively as paying audience members. For more than four centuries, Homer’s English audience listened to a boys’ choir. That tune has only just begun to change thanks to the efforts of three women: the classicist and nonfiction writer Caroline Alexander, who became the first woman to publish a complete English Iliad in 2015; Emily Wilson, Professor of Classical Studies at the University of Pennsylvania, who published the first English Odyssey by a female translator in 2017; and the poet Alice Oswald, whose selective translation of the Iliad, Memorial, appeared in 2011.6 By virtue of their appearance in such short order, these books have been, and surely will be henceforth, grouped together. And rightly so: ending the male monopoly on the English channel to Homer is a major development. The Homeric epics have not only shaped Western culture; they enjoy enduring prestige. You still need to know Homer to fancy yourself “well-read.” These three books are thus 36 on women englishing homer potent symbols. Dementia is more than a disease. What dementia is, how it is understood, and how it is experienced is influenced by multiple factors including our societal preoccupation with individual identity. This essay introduces empirical and theoretical evidence of alternative ways of understanding dementia that act as a challenge to common assumptions. It proposes that dementia be understood as an experience of systems, particularly networks of people affected by the diagnosis. Taking this step reveals much about the dementia experience, and about (...) what can be learned from persons with dementia and their networks of family, friends, and carers. It also suggests that dementia may be best thought of as an ecology that arises from the interaction between neuropathological change, people, language, and meaning. While challenging, this perspective may provide new ways of responding to dementia and caring for those affected by it. (shrink)

This paper tests Harry Arthur's theory that there is an “ethical economy“ of lawyer regulation in Canada, in which Canadian law societies use their regulatory powers only in high reward/low risk cases - ie, where the practitioner is less likely to resist their authority and the offence is morally unambiguous. Analysing reported cases from 2009 in British Columbia, Alberta, Saskatchewan, Manitoba and Nova Scotia the paper concludes that Arthurs' description still accurately characterises the regulation of lawyers by Canadian law societies. The paper then conducts a case study of law society and court cases related to one Canadian lawyer, Anthony Merchant, to assess whether the ethical economy is inevitable, or whether a different approach to lawyer regulation can and should be undertaken. As the first large online event of the American Society for Cybernetics, the ASC2020 Global Conversation offered an opportunity to develop new online types of cybernetic conversations on cybernetics, in cybernetic formats. This article discusses the design decisions that led to a particular organizational structure of the event, and observations on how the event unfolded from this organizational structure. Based on observations made throughout the event as well as its preparation stage, the article maps seven different types of conversations taking (...) place before and during the event and discusses opportunities and constraints encountered in relation to each identified type. As online conferences have proliferated exponentially due to the impact of COVID-19, this article aims to contribute a cybernetic perspective to the broader discourse on scholarly international exchange in online media, and offers a new perspective on how such conversations might be designed in a cybernetic manner. This doctoral thesis analyzes the systematic role of Kant’s conception of happiness in his moral, legal and political theory. Although many of his conclusions and arguments are directly or indirectly influenced by his conception of human happiness, Kant’s underlying assumptions are rarely overtly discussed or given much detail in his works. Kant also provides different and apparently incompatible definitions of happiness. This research explores the domains of Kant’s practical philosophy in which his conception of happiness plays a systematic role: the (...) relation between the natural need of human beings to pursue happiness and the ends-oriented structure of the human will; Kant’s anti-eudaimonism in ethical theory; Kant’s claim that we have an indirect duty to promote our own happiness and the problem that under certain circumstances, the indeterminacy of happiness makes it not irrational to choose short term satisfaction at the costs of one’s overall, long term happiness, given Kant’s conception of non-moral choice as expectation of pleasure; Kant’s justification of the duty to adopt the happiness of others as our ends and the latitude and eventual demandingness of this duty; finally, since Kant also subsumes subsistence needs and welfare under the concept of happiness of individuals, I also engage with the question of state provision for the poor in the Kantian Rechtsstaat and explore Kant’s conception of equity or fairness as an alternative to the traditional minimalist and the welfare interpretations of the Kantian state. The essence of Baars’ paper is to propose nine functions for consciousness. By way of introducing these functions we are presented with a metaphor of a theatre, in which players act, operators set contexts behind the scenes, an unconscious audience provides specialised capabilities, and, of course, a bright spotlight of attention illuminates whatever is available to consciousness. The value of this metaphor is not entirely clear, with the separate ‘roles’ of the audience and of the operators behind the scenes being (...) particularly difficult to identify. Additionally, there may be a problem with idea that there is some kind of competition between actors who are seeking the spotlight of attention, for this suggests that the components of thought have volitions of their own. These would, indeed, be dangerous thoughts. Rather than attempting an analysis of the metaphor and its potential usefulness, this commentary will consider the nine functions of consciousness that have been proposed. (shrink)

Individuals’ coping strategies have a profound effect on how well they respond to negative life events. Despite this, most coping strategies instruments that are available currently have been developed exclusively in Western contexts. In the present study, a Coping Strategies Scale for use with Chinese participants was developed and validated based on responses from 734 Chinese university students. Results supported a seven-factor structure for the CSS, which included the dimensions of Withdrawal, Positive Adaptation, Problem-solving, Disengagement, Prosocial Focus, Seeking Emotional Support, (...) and Self-regulation. The results supported the validity of the seven-factor CSS in terms of its content, associated response processes, internal structure, and relationships with other variables. Based on these results, the CSS provides a psychometrically sound instrument for assessing the coping strategies used by Chinese adults in confronting potentially adverse psychological events. Pragmatics and Literature is an important collection of new work by leading practitioners working at the interface between pragmatic theory and literary analysis. The individual studies collected here draw on a variety of theoretical approaches and are concerned with a range of literary genres. All have a shared focus on applying ideas from specific pragmatic frameworks to understanding the production, interpretation and evaluation of literary texts. A full-length introductory chapter highlights distinctions and contrasts between pragmatic theories, but also brings out (...) complementarities, shared aims and assumptions, and ways in which different pragmatic theories can make different contributions to our understanding of literary texts. The book as a whole encourages a sense of coherence for the field and presents insights from various approaches for systematic comparison. Building on previous work by the editors, the contributors and others, it makes a significant contribution to the growing field of pragmatic literary stylistics. (shrink)

But in this thoughtful, wide-ranging discussion of Daniel Groll's book Conceiving (...) People: Genetic Knowledge and the Ethics of Sperm and Egg Donation (2021), the ethical terrain is revealed to be far richer and more intricate. As contributor Camisha Russell puts it, the book attends to "the types of relationships that foster the emotional health of families" while remaining grounded in "the experiences and desires articulated by donor-conceived people themselves" as well as those who contribute to their creation and to their family. As a result, the pieces in this symposium not only take up crucial questions of genetics, identity, and bionormativity, they also ask what it means to frame family relationships as a philosophical problem—conceptual, ethical, and, ultimately, political.Groll's central claim is that those who intend to create a child using donated gametes should choose a donor whose identity will be available to the resulting child. This is not because, as David Velleman (2005) and others have argued, knowledge of one's genetic parentage is fundamentally important in some objective sense. Rather, Groll argues that whether such knowledge is actually important, donor-conceived children are likely to come to view it as crucial—developing what Groll calls a "significant interest" in knowing their donor's identity. Further, parents ought to help satisfy their children's significant interest assuming it is not morally problematic. This line of argument places Groll squarely in the realm of what feminists and anti-racist philosophers describe as "theorizing the non-ideal" (Tessman 2009); that is, making philosophical arguments that take as their starting point the world as it is, including the realities of social injustice. Following Charlotte Witt, Sally Haslanger, and other feminists, Groll acknowledges the dominance of the "bionormative conception of the family" (Witt 2014). He considers whether interest in knowing one's genetic parentage might express bionormative prejudice but concludes that, even if it does, [End Page 163] "interest in genetic knowledge can—in our world—be rationally grounded apart from the oppressive schema it is embedded in" (Groll 2021, 149). He further concludes that given a prospective child's likely significant interest in their genetic parentage, would-be parents ought to use an open (i.e., non-anonymous) donor. At the same time, he argues that there are good reasons to disrupt the bionormative schema on both a personal and policy level that may lead to a child's significant interest in the first place.If Groll walks the middle ground in this debate, his critics in this symposium are happy to turn his stroll into a balancing act. Both Reuven Brandt and Amanda Roth challenge Groll's significant interest approach. Brandt questions the extent to which parents owe children a truthful, detailed accounting of their origin, making the case for parental privacy. Roth questions whether the interest in genetic knowledge is rationally grounded beyond bionormative prejudice, offering as a counterexample the offspring of same-sex parents, raised in queer communities of largely nontraditional family configurations. Bradford Skow pushes from the opposite direction, challenging both the claim that bionormative prejudice is at work in the interest in genetic knowledge and, more broadly, that the so-called bionormative conception of the family has the prestige that Groll and others attribute to it in the first place.Also, Amanda Roth and Camisha Russell pressure Groll to go further in considering the nonideal circumstances in which families are formed and theorized. They specify that questions of family configuration and validity are not only conceptual and ethical, they are political. Roth challenges Groll to further consider the example of same-sex and other LGBTQ+ families as disruptive exemplars and recognize that there may be reasons to choose anonymous donation that he has not considered. Neste âmbito, propõe discutir a variedade dos conceitos de juventude, principalmente relacionados ao limite cronológico e a algumas ideias relacionadas, entre as quais, ocupação do tempo, pobreza e risco social associados ao indivíduo considerado jovem pela Sociologia. O objetivo principal é levantar e resumir dados importantes sobre algumas políticas nacionais para a juventude, refletindo sobre a escola, principalmente a (...) instituição pública, como espaço para a diminuição da vulnerabilidade social, propondo reflexões sobre o papel do administrador escolar e do orientador educacional na viabilização do acesso a direitos para a população jovem.
