In der Tugendlehre Kants findet die allgemeine ethische Orientierung, wie sie der Kategorische Imperativ ausdrückt, Anwendung auf die Bedingungen der menschlichen Existenz. Die vorliegende Untersuchung rekonstruiert den Kantischen Ansatz vor dem Hintergrund der gegenwärtigen, vor allem aristotelischen Tugendethik und löst dabei den Kantischen Tugendbegriff kritisch von seinen zeitbedingten Prägungen. Auf so erneuerter Grundlage wird eine transzendentalphilosophische Ethikkonzeption entfaltet, die den methodischen und inhaltlichen Einsichten der jüngeren Theorieentwicklung Rechnung trägt. Phenomenology has been defined by Husserl as “theory of the essences of pure phenomena,” yet the ontological status of essences in Husserlian phenomenology is far from a settled issue. The late Husserlian emphasis on genetic constitution and the historicity of the lifeworld is not immediately reconcilablewith the ‘unchangeable’ nature that is prima facie attributed to essences. However, the problem of the nature of ideality cannot be dropped from phenomenological accounts without jeopardizing the phenomenological enterprise as such. Through an immanent analysis (...) of Husserl’s meditation on essences a positive account of their ontological status is provided. Essences are interpreted as ontological thresholds, primordially rooted in our motivated confrontation with sensuous transcendence. Essences appear as emergent ontological features, which are not reducible to their particular realizations and which exhibit a fundamental continuity between consciousness and being. They manifest themselves as prospectively a priori (a precondition for further experiences), but retrospectively a posteriori (they are founded in experience). Finally, essences manifest the ‘co-essential’ nature of consciousness and sensuous transcendence: they are the way in which we are motivated and constitutively bound to articulate being, which in turn is apt to be thus articulated. Citizen science models of public participation in scientific research represent a growing area of opportunity for health and biomedical research, as well as new impetus for more collaborative forms of engagement in large-scale research. However, this also surfaces a variety of ethical issues that both fall outside of and build upon the standard human subjects concerns in bioethics. This article provides background on citizen science, examples of current projects in the field, and discussion of established and emerging ethical issues for (...) citizen science in health and biomedical research. Kant’s conception of the relation between knowledge and doubt stands opposed to much of contemporary epistemology. For Kant denies that it is possible for one to have knowledge of how things are without having a ground for one’s judgment that guarantees its truth. Knowledge, according to him, is judgment that is based on a ground that the judger recognizes to guarantee the truth of her judgment. A judgment that is based on such a ground, trivially, excludes any doubt the judger (...) might have had with respect to it. Therefore knowledge implies certainty. Much of contemporary epistemology has no room for the idea of a truth-guaranteeing ground. By contrast, Kant thinks that the rejection of the idea of a truth-guaranteeing ground has a devastating effect. It does not only render unintelligible the idea of knowledge, but, because of that, the very idea of a subject that is able to be ignorant about things, to have doubts about them or even to err about them. The paper defends the Kantian account of knowledge with the aim to show that ignorance, doubt and error can only characterize, and hence trouble, a subject that knows herself to have a capacity that enables her to overcome any possible doubt and error. The concept of functional beauty is analysed in terms of the role played by beliefs, in particular expectations, in our perceptions. After finding various theories of functional beauty unsatisfying, I introduce a novel approach which explains how aesthetic judgements on a variety of different kinds of functional objects (chairs, buildings, cars, etc.) can be grounded in perceptions influenced by beliefs.

In this paper I develop a conception of joint practical deliberation as a special type of shared cooperative activity, through which co-deliberators jointly accept reasons as applying to them as a pair or group. I argue, moreover, that the aspiration to deliberative “pairhood” is distinguished by a special concern for mutuality that guides each deliberator’s readiness to accept a given consideration as a reason-for-us. It matters to each of us, as joint deliberators, that each party’s (individual) reasons for accepting something (...) as a reason-for-us support a conception of our relationship as one characterized by mutual, non-instrumental concern for one another. Some works of architecture have remarkable aesthetic value. According to certain philosophers, part of this value derives from the appearance of such constructions to fulfil the function for which they were built. I argue that one way of understanding the connection between function and aesthetic value resides in the concept of functional beauty. I analyse a number of recent accounts of this notion, then offer a better way of understanding it. I then focus my attention on the relation between aesthetic (...) and moral values and claim that, if the notion of functional beauty makes any sense at all, then we have a pro tanto case for holding that moral defects in works of architecture can have aesthetic merits. This study assessed the attitudes and needs of physicians and health professional staff at a tertiary care hospital in Canada regarding the introduction of physician assisted dying (PAD) during 2015–16. This research aimed to develop an understanding of the wishes, concerns and hopes of stakeholders related to handling requests for PAD; to determine what supports/structures/resources health care professionals (HCP) require in order to ensure high quality and compassionate care for patients requesting PAD, and a supportive environment for all healthcare providers (...) across the moral spectrum. This study constituted a mixed methods design with a qualitative descriptive approach for the study’s qualitative component. A total of 303 HCPs working in a tertiary care hospital completed an online survey and 64 HCPs working in hospital units with high mortality rates participated in 8 focus group discussions. Both focus group and survey data coalesced around several themes to support the implementation of PAD following the decriminalization of this practice: the importance of high quality care; honoring moral diversity; supporting values (such as autonomy, privacy, beneficence); and developing resources, including collaboration with palliative care, education, policies and a specialized team. This study provided the foundational evidence to support the development of the PAD program described in other papers in this collection, and can be a model for gathering evidence from stakeholders to inform the implementation of PAD in any healthcare organization. I argue that Machery stacks the deck against hybrid theories of concepts by relying on an unduly restrictive understanding of coordination between concept parts. Once a less restrictive notion of coordination is introduced, the empirical case for hybrid theories of concepts becomes stronger, and the appeal of concept eliminativism weaker.

This paper reports on the findings of a qualitative study to understand how active adherence to the Christian faith influences the way SME owner-managers conceptualise their business practices. The study was based on in-depth interviews with 21 Christian SME owner-managers in Germany and the UK. Using a socio-psychological approach, the data analysis yielded a range of linguistic and conceptual resources that are peculiar to Christian discourse and that have the potential to influence business activity in rather distinctive ways. This paper (...) particularly focuses on those Christian concepts that could be regarded as distinct 'frames' for action. It outlines what effect these concepts had on the respondents and how they were related to business practices. The paper also discusses how this study could inform further research into the influence of other socio-cultural forms of identity on economic actors' conceptualisations of their own practice. Critical algorithm scholarship has demonstrated the difficulties of attributing accountability for the actions and effects of algorithmic systems. In this commentary, we argue that we cannot stop at denouncing the lack of accountability for algorithms and their effects but must engage the broader systems and distributed agencies that algorithmic systems exist within; including standards, regulations, technologies, and social relations. To this end, we explore accountability in “the Generated Detective,” an algorithmically generated comic. Taking up the mantle of detectives ourselves, we (...) investigate accountability in relation to this piece of experimental fiction. We problematize efforts to effect accountability through transparency by undertaking a simple operation: asking for permission to re-publish a set of the algorithmically selected and modified words and images which make the frames of the comic. Recounting this process, we demonstrate slippage between the “complication” of the algorithm and the obscurity of the legal and institutional structures in which it exists. (shrink)

This paper claims that there is a plausible sense in which validity is a matter of truth preservation relative to interpretations of the sentences that occur in an argument, although it is not the sense one might have in mind. §1 outlines three independent problems: the first is the paradox of the sorites, the second concerns the fallacy of equivocation, and the third arises in connection with the standard treatment of indexicals. §2 elucidates the claim about validity, while §§3-5 show (...) how the three problems outlined can be handled in accordance with it. §6 explains how the claim squares with the traditional idea that validity is related to formality, and in particular with a broadly accepted definition based on that idea, the model-theoretic definition of logical consequence. Unlike other works on the subject, this paper does not focus on necessity. It is not its intention to provide a characterization of necessity that conforms to some ideal of rigour or to some pre-theoretical understanding of validity. This paper reviews the uneven history of the relationship between Anthropology and Cognitive Science over the past 30 years, from its promising beginnings, followed by a period of disaffection, on up to the current context, which may lay the groundwork for reconsidering what Anthropology and (the rest of) Cognitive Science have to offer each other. We think that this history has important lessons to teach and has implications for contemporary efforts to restore Anthropology to its proper place within Cognitive Science. (...) Most contemporary chemists consider quantum mechanics to be the foundational theory of their discipline, although few of the calculations that a strict reduction would seem to require have ever been produced. In this essay I discuss contemporary algebraic and diagrammatic representations of molecular systems derived from quantum mechanical models, specifically configuration interaction wavefunctions for ab initio calculations and molecular orbital energy diagrams. My aim is to suggest that recent dissatisfaction with reductive accounts of chemical theory may stem from both the (...) inability of standard accounts of reduction to incorporate the diverse forms of representation found in chemical practice and our philosophical predilection to analyze all connections between theories in terms of logical reduction. Collective impact cases are situations where people collectively bring about a morally significant outcome by each acting in a certain way, and yet each individual action seems to make no, or almost no difference to the outcome. Intuitively, the beneficial or harmful outcomes give individuals moral reason to act (or refrain from acting) in collective impact situations. However, if the individual action does not make a difference to the outcome, it is not clear what those moral reasons are. The problem (...) of collective impact is the challenge of identifying such moral reasons. Julia Nefsky has presented an account of how an individual action can help without making a difference – call it the Helping Account – that claims to provide a general solution to the problem of collective impact while avoiding problems faced by previously suggested solutions. I present an internal critique of Nefsky’s work. First, I argue that, based on the problems that Nefsky has raised against previously suggested solutions, three success conditions for a general solution to the problem of collective impact can be formulated: The Weightiness condition, the Generalizability condition, and the Connectedness condition. Second, I argue that the Helping Account fails to satisfy the three success conditions, thereby failing, by Nefsky’s own standards, to provide a general solution to the problem. (shrink)

The Quarrel over Swammerdam’s Posthumous Works reconstructs the vicissitudes of Johannes Swammerdam’s Biblia naturae, a pivotal collection of writings in the history of science. Bequeathed to the polymath Melchisédech Thévenot, the manuscripts and drawings of the treatises constituting this collection were instead kept by the editor Hermann Wingendorp after Swammerdam’s death (1680), triggering a quarrel over their publication. By analysing Swammerdam’s scientific legacy and by offering an edition of the correspondence testifying to the efforts towards such publication, this book sheds (...) light on the editorial history and intellectual context of Swammerdam’s Biblia. This reveals not only an intricate plot of authorized and unauthorized attempts to publish it, but also an exchange of scientific texts and instruments in the late seventeenth century. (shrink)

Masked priming experiments occasionally revealed surprising effects: Participants responded slower for congruent compared to incongruent primes. This negative congruency effect was ascribed to inhibition of prime-induced activation [Eimer, M., & Schlaghecken, F. . Response faciliation and inhibition in subliminal priming. Biological Psychology, 64, 7–26.] that sets in if the prime activation is sufficiently strong. The current study tests this assumption by implementing manipulations designed to vary the amount of prime-induced activation in three experiments. Thus, the amount of prime activation did not predict whether or not NCEs occurred. Modeling law search and retrieval as prediction problems has recently emerged as a predominant approach in law intelligence. Focusing on the law article retrieval task, we present a deep learning framework named LamBERTa, which is designed for civil-law codes, and specifically trained on the Italian civil code. To our knowledge, this is the first study proposing an advanced approach to law article prediction for the Italian legal system based on a BERT (Bidirectional Encoder Representations from Transformers) learning framework, which has (...) recently attracted increased attention among deep learning approaches, showing outstanding effectiveness in several natural language processing and learning tasks. We define LamBERTa models by fine-tuning an Italian pre-trained BERT on the Italian civil code or its portions, for law article retrieval as a classification task. One key aspect of our LamBERTa framework is that we conceived it to address an extreme classification scenario, which is characterized by a high number of classes, the few-shot learning problem, and the lack of test query benchmarks for Italian legal prediction tasks. To solve such issues, we define different methods for the unsupervised labeling of the law articles, which can in principle be applied to any law article code system. We provide insights into the explainability and interpretability of our LamBERTa models, and we present an extensive experimental analysis over query sets of different type, for single-label as well as multi-label evaluation tasks. Empirical evidence has shown the effectiveness of LamBERTa, and also its superiority against widely used deep-learning text classifiers and a few-shot learner conceived for an attribute-aware prediction task. The demand for social justice, especially in the context of the welfare state, is often framed as a demand of solidarity. But it is not clear why: in what sense, if any, is social justice best understood as a demand of solidarity? This article explores that question. There are two reasons to do so. First, very little has been written on the concept of solidarity, and almost nothing on why and how solidarity can both give rise to and be the (...) target of a moral obligation. The first aim of the article is to fill this gap. The second aim of the article is to explore the normative implications of this account of solidarity for the commitment to social justice at the heart of the welfare state, and in so doing, to put into question the idea that shared experience or shared identity are either necessary or sufficient bases for social justice qua solidarity. Philosophical cognitivists have argued for more than four decades that emotions are special types of judgments. Anti-cognitivists have provided a series of counterexamples aiming to show that identifying emotions with judgments overintellectualizes the emotions. I provide a novel counterexample that makes the overintellectualization charge especially vivid. I discuss neurophysiological evidence to the effect that the fear system can be activated by stimuli the subject is unaware of seeing. To emphasize the analogy with blind sight , I call this phenomenon blind (...) fright . Cognitivists may reply that blindfright is nothing but an unconscious judgment subcortically elicited. This reply is in line with the strategy commonly employed by cognitivists against their critics. I call it the Elastic Strategy, because it consists of ‘stretching’ the notion of judgment in order to accommodate counterexamples. This strategy, I argue, turns cognitivism into a theory that is at worst unfalsifiable and at best trivially true. The final portion of my article aims to rescue cognitivism from the damage done by the Elastic Strategy. I distinguish three varieties of cognitivism, one concerned with what emotions essentially are (Constitutive Cognitivism), one concerned with what causes emotions (Etiological Cognitivism) and one concerned with what emotions represent (Representational Cognitivism). I conclude that what cognitivism has to offer to emotion theory are primarily insights concerning the causes and representational content of emotions. The constitutive identification of emotions with judgments, on the other hand, does more harm than good. (shrink)

Andrea Sangiacomo offers a new understanding of Spinoza's moral philosophy, how his views significantly evolved over time, and how he himself struggled during his career to develop a theory that could speak to human beings as they actually are--imperfect, passionate, and often not very rational.

In his interesting commentary, Joshua Shepherd raises two points—one related to epistemology, the other to ethics—about our article on human cerebral organoids.1 2 From the epistemological standpoint, he calls into question the need for a theory of consciousness. A theory of consciousness, for him, is not necessary because of the lack of consensus about the very nature of consciousness. Shepherd suggests that ‘given widespread disagreement, applying a theory of consciousness may not be helpful when attempting to diagnose the presence of (...) consciousness in cerebral organoids’. In Shepherd’s view, it would be better to transfer ‘concepts already under development in work on the presence and structure of consciousness in difficult marginal cases involving traumatic brain injury’.2 We could not agree more on this last point; detecting a minimal capacity for consciousness in the brain of comatose patients is a very similar challenge to inferring the presence of consciousness in cerebral organoids. Every day, as a by-product of saving many lives, intensive care medicine artificially produces thousands of brains that may remain isolated, split or fragmented; in the worst case, cortical islands, or an archipelago of islands, may survive while being disconnected from the outside world. Can these islands host some form of consciousness? That is, does it feel like anything to be a large piece of human cortex? Addressing this difficult question requires the development of general, objective brain-based indices of consciousness that are independent of sensory processing, executive functions and motor outputs.3 Consider, for example, a patient showing reflexive spontaneous behaviour, no response to command and no ability to communicate. In her brain, afferent pathways are damaged, thereby impairing the recruitment of cortical areas in response to sensory stimulation; basal ganglia, as well as other frontal structures supporting executive functions, are impaired. The concept of autonomy was and still is one of the central notions of practical philosophy. The current discussion often identifies autonomy with free or rational self-determination of a person. But a person must always be seen as being integrated in social and institutional contexts. Therefore the concept of autonomy has to be developed from an integrative perspective which includes both perspectives: the individual and the institutional one. Moreover, this integration cannot be constituted by shared affects and feeling of individuals, (...) but has to refer to the idea of “lawfulness” and guiding norms and orientations. This essay tries to show that Hermann Cohen′s understanding of “autonomy as a task” is a theory worthy of being followed, as it develops the principles as well as the concrete conditions of an integrative concept of autonomy on the basis of a “hypothetical” method which is both: critical and dynamical. In this paper I argue that the primacy of the present in Husserl’s philosophy is not an unquestioned ballast inherited from the tradition of metaphysics but rather a genuinely phenomenological discovery. First, I explore the present of things and argue that the phenomenological primacy of the present in this domain should be understood in terms of what Husserl calls “affection.” Strictly speaking originary affection and associative syntheses (as the most basic phenomena for the givenness of things) can only take place (...) in the present or starting from the present. Second, I consider the present in the egological sphere and analyze its primacy for both the transcendental and the personal ego. Finally, I move to the experience of the other and argue that only the perception of the other’s body in the present gives rise to an authentic empathic experience as the experience of the other’s governing in his own body. This study investigates the extent to which there is individuality in how structural variation is conditioned over time. Earlier research already classified the diachronically unstable gerund variation as involving a high fraction of mixed-usage speakers throughout the change, whereby the proportion of the conservative variant versus the progressive variant as observable in the linguistic output of individual language users superficially resembles the mean proportion as observable at the population level. However, this study sets out to show that there can still (...) be heterogeneity within such a centralized population in terms of how each individual conditions the observed variation. A random forest and conditional inference tree analysis of over 14,000 gerunds uttered by nineteen seventeenth-century authors is presented to show that, while the most important language-internal factors conditioning the gerund variation are adopted by (and shared between) all authors, we can still attest inter-individual variation (i) at lower levels of variable importance, and (ii) in the breadth of the range of contexts individual authors employ to condition the attested variation. It is commonly assumed that the scientific study of emotions should focus on discrete categories such as fear, anger, sadness, joy, disgust, shame, guilt, and so on. This view has recently been questioned by the emergence of the “core affect movement,” according to which discrete emotions are not natural kinds. Affective science, it is argued, should focus on core affect, a blend of hedonic and arousal values. Here, I argue that the empirical evidence does not support the thesis that core (...) affect is a more “natural” category than discrete emotions. Andrea Falcon's work is guided by the exegetical ideal of recreating the mind of Aristotle and his distinctive conception of the theoretical enterprise. In this concise exploration of the significance of the celestial world for Aristotle's science of nature, Falcon investigates the source of discontinuity between celestial and sublunary natures and argues that the conviction that the natural world exhibits unity without uniformity is the ultimate reason for Aristotle's claim that the heavens are made of a special body, unique (...) to them. This book presents Aristotle as a totally engaged, systematic investigator whose ultimate concern was to integrate his distinct investigations into a coherent interpretation of the world we live in, all the while mindful of human limitations to what can be known.
