Dopo un’introduzione sui protagonisti della questione, ci si concentrerà su un caso esemplare, corredato di apparato critico, tratto dal De Aucupio, e sulle possibili fonti impiegate dal Bargeo.

This book addresses two related questions that have first arisen in Toulmin’s seminal book on the uses of argument. The first question is the one of the relationship between the semantic analysis of modality and the structure of arguments. The second question is the one of the distinctive place, or role, of modality in the fundamental structure of arguments. These two questions concern how modality, as a semantic category, relates to the fundamental structure of arguments. The book addresses modality and (...) argumentation also according to another perspective by looking at how different linguistic modal expressions may be taken as argumentative indicators. It explores the role of modal expressions as argumentative indicators by using the Italian modal system as a case study. The present essay provides a new metaphysical interpretation of Relational Quantum Mechanics (RQM) in terms of mereological bundle theory. The essential idea is to claim that a physical system in RQM can be defined as a mereological fusion of properties whose values may vary for different observers. Abandoning the Aristotelian tradition centered on the notion of substance, I claim that RQM embraces an ontology of properties that finds its roots in the heritage of David Hume. To this regard, defining what (...) kind of concrete physical objects populate the world according to RQM, I argue that this theoretical framework can be made compatible with (i) a property-oriented ontology, in which the notion of object can be easily defined, and (ii) moderate structural realism, a philosophical position where relations and relata are both fundamental. Finally, I conclude that under this reading relational quantum mechanics should be included among the full-fledged realist interpretations of quantum theory. (shrink)

By virtue of what do alarm calls and facial expressions carry natural information? The answer I defend in this paper is that they carry natural information by virtue of changing the probabilities of various states of affairs, relative to background data. The Probabilistic Difference Maker Theory of natural information that I introduce here is inspired by Dretske's [1981] seminal analysis of natural information, but parts ways with it by eschewing the requirements that information transmission must be nomically underwritten, mind-independent, and (...) knowledge-yielding. PDMT includes both a qualitative account of information transmission and a measure of natural information in keeping with the basic principles of Shannon's communication theory and Bayesian confirmation theory. It also includes a new account of the informational content of a signal, understood as the combination of the incremental and overall support that the signal provides for all states of affairs at the source. Artificial intelligence (AI) systems are quickly gaining ground in healthcare and clinical decision-making. However, it is still unclear in what way AI can or should support decision-making that is based on incapacitated patients’ values and goals of care, which often requires input from clinicians and loved ones. Although the use of algorithms to predict patients’ most likely preferred treatment has been discussed in the medical ethics literature, no example has been realised in clinical practice. This is due, arguably, to the (...) lack of a structured approach to the epistemological, ethical and pragmatic challenges arising from the design and use of such algorithms. The present paper offers a new perspective on the problem by suggesting that preference predicting AIs be viewed as sociotechnical systems with distinctive life-cycles. We explore how both known and novel challenges map onto the different stages of development, highlighting interdisciplinary strategies for their resolution. (shrink)

Phenomenology has been defined by Husserl as “theory of the essences of pure phenomena,” yet the ontological status of essences in Husserlian phenomenology is far from a settled issue. The late Husserlian emphasis on genetic constitution and the historicity of the lifeworld is not immediately reconcilablewith the ‘unchangeable’ nature that is prima facie attributed to essences. However, the problem of the nature of ideality cannot be dropped from phenomenological accounts without jeopardizing the phenomenological enterprise as such. Through an immanent analysis (...) of Husserl’s meditation on essences a positive account of their ontological status is provided. Essences are interpreted as ontological thresholds, primordially rooted in our motivated confrontation with sensuous transcendence. Essences appear as emergent ontological features, which are not reducible to their particular realizations and which exhibit a fundamental continuity between consciousness and being. They manifest themselves as prospectively a priori (a precondition for further experiences), but retrospectively a posteriori (they are founded in experience). Finally, essences manifest the ‘co-essential’ nature of consciousness and sensuous transcendence: they are the way in which we are motivated and constitutively bound to articulate being, which in turn is apt to be thus articulated. A thriving literature has developed over logical and mathematical pluralism – i.e. the views that several rival logical and mathematical theories can be equally correct. These have unfortunately grown separate; instead, they both could gain a great deal by a closer interaction. Our aim is thus to present some novel forms of abstractionist mathematical pluralism which can be modeled on parallel ways of substantiating logical pluralism (also in connection with logical anti-exceptionalism). To do this, we start by discussing the Good (...) Company Problem for neo-logicists recently raised by Paolo Mancosu (2016), concerning the existence of rival abstractive definitions of cardinal number which are nonetheless equally able to reconstruct Peano Arithmetic. We survey Mancosu’s envisaged possible replies to this predicament, and suggest as a further path the adoption of some form of mathematical pluralism concerning abstraction principles. We then explore three possible ways of substantiating such pluralism—Conceptual Pluralism,Domain Pluralism,Pluralism about Criteria—showing how each of them can be related to analogous proposals in the philosophy of logic. We conclude by considering advantages, concerns, and theoretical ramifications for these varieties of mathematical pluralism. (shrink)

Gestational surrogacy is ethically complex, generating very different responses in law and policy worldwide. This paper argues that contemporary surrogacy law and policy, across many jurisdictions, fail to give sufficient attention to the significance of the relationship between the child and the gestational surrogate. This failure risks repeating the mistakes of historical, discredited approaches to adoption and donor‐assisted conception. This paper argues that proper recognition of the significance of gestation must be an organising principle in surrogacy law and policy. The (...) paper begins by pointing to examples of surrogacy law and practice where the role of the gestator is unacceptably minimised, most notably the framing of the surrogate as a mere ‘carrier’. It goes on to examine the nature of gestation, including consideration of contemporary scholarship on the metaphysics of pregnancy and emerging work in epigenetics, and argues that current evidence supports the view that the gestational relationship must be taken more seriously than it currently is. The paper then draws analogies with parenthood in donor‐assisted conception and adoption to argue that approaches to parental status in novel family formations that fail to promote transparency and seek to deny the truth of familial relationships are doomed to fail. The paper concludes by suggesting some implications for law and policy that flow from placing sufficient emphasis on the gestational role. The overarching thesis of this paper is that gestational surrogacy is ethically permissible when these fundamental requirements are adhered to, and that surrogacy law should proceed on this basis. Current debates on human rationality are divided between what Matthew Boyle calls the additive and transformative approaches. My concern is not with the current debate, but with Boyle’s alignment of Descartes and Aristotle with the modern approaches, directing his criticisms against the former, and his defence in support of the latter. What motivates my enquiry is whether Boyle’s use of the two philosophers’ theses stands up to scrutiny and consequently whether his alignments are cogent. In this paper I begin to fashion a theory of musical form that I call historical formalism. Historical formalism posits that our perception of the formal properties of a musical work is informed by considerations not only of artistic categories but also of the historical, sociopolitical, and cultural circumstances within which that work was composed.

: This paper combines Simondon’s philosophy of individuation with some aspects of post-humanist and‘new materialist’ thought, while, at the same time, remaining within the ambit of a more classically ‘historical’characterisation of materialism. Two keywords drawn from Karen Barad and Simondon respectively – ‘ontoepistemology’and ‘axiontology’ – represent the red thread of a narrative that connects the early modern invention of civil science to Wiener’s cybernetic theory ofsociety. The political stakes common to these forms of what I call ‘banal’ materialism, Simondon attacked (...) ontologically,epistemologically and politically. The conceptual tools Simondon’s philosophy of individuation elaborates prove tosupport a ‘non-banal’ materialist critique of the alleged ‘unsocial sociability’ of human nature theorised in modernpolitical theory. Anecdotal evidence has long lamented the status of social studies in elementary classrooms as observed by preservice teachers. As standardized testing has risen for mathematics and language arts, social studies has been pushed aside. In the aftermath of accountability legislation such as No Child Left Behind, research indicates that social studies is less visible in elementary classrooms due to an instructional focus on tested content areas (e.g. math, language arts, reading). In this study, approximately 90 elementary preservice teachers enrolled in (...) a social studies methods course responded to a survey and indicated the frequency and quality of lessons they observed over the course of a single semester. Findings report that preservice elementary teachers witnessed few, if any, lessons in social studies in the elementary classroom. Implications for teacher education are discussed. (shrink)

Perceptions of a firm’s stance on corporate social responsibility (CSR) are influenced by its corporate marketing efforts including branding, reputation building, and communications. The current research examines CSR from the consumer’s perspective, focusing on antecedents and consequences of perceived CSR. The findings strongly support the fact that particular cues, namely perceived financial performance and perceived quality of ethics statements, influence perceived CSR which in turn impacts perceptions of corporate reputation, consumer trust, and loyalty. Both consumer trust and loyalty were also (...) found to reduce the perceived risk that consumers experience in buying and using products. From these significant findings, we draw several conclusions and implications, including the importance of enhancing firm focus toward its ethical commitment and long-term reputation. (shrink)

Human genetic research databases cast a new light on the controversial issue of which uses of the human body are morally permissible. More specifically, banking human tissue raises issues relating to the ownership of the samples that the participants have donated, to the ownership of the data that are derived through processing the donated samples, and to the management arrangements that better balance the interest of genetic research with the protection of participants' rights. Winickoff & Winickoff suggest that the charitable-trust (...) model is a superior legal arrangement for biobanking compared with private biobanking. This paper critically assesses Winickoff & Winickoff's claim by highlighting some areas of implementation where such a model could be problematic. The charitable trust is certainly an advantageous arrangement because (1) it favors the separation between control and use of the samples, (2) it provides a procedural mechanism that facilitates the participation donor groups in the biobank management and (3) it mediates the different interests that are affected. On the other hand, the charitable-trust model leaves unresolved several issues--among them the ownership of the sample, the right of withdrawal, access and funding mechanism. I conclude that further theoretical and empirical analysis is required in the area. (shrink)

COVID-related racial disparities represent a spectrum of injustices and inequalities. Focusing on food oppression, this essay argues that racism infuses food law and policy in ways that contribute to racially disparate COVID deaths and severe illnesses. USDA nutrition program participants were at a nutritional disadvantage when COVID hit. Yet, government responses focused on food insecurity, not nutritional quality. Racism against a predominantly Black and brown labor force of essential food workers — from fields to meat plants to grocery stores — (...) created tolerance for the administration’s failure to protect or compensate some of the country’s most vulnerable workers. When COVID-driven supply issues threatened to narrow white people’s activities and choices, the favored response was to keep their options open by sacrificing Black and brown workers. A food oppression lens — understanding how corporate interests drive food policy — is necessary to achieve food equality in this pandemic and beyond. (shrink)

The present article is an analysis of Heidegger's notorious Rectoral Address in terms of its attempt to bring together philosophy and politics in a way that would revitalise both. Through the repossession and reconfiguration of common words and concepts, Heidegger hoped to provide the intellectual impetus for a radical, invigorating cultural revolution in Germany. Given this apparently laudable aim, one is faced with the pressing question concerning the tension between his philosophical insight, on the one hand, and his inexplicable political (...) blindness on the other. Hence the paper focuses, firstly, on the radical nature of Heidegger's transformation of traditional conceptions of philosophy (science), and secondly, on his failure to separate the originality and significance of this philosophy from a catastrophic ideological attachment to the idea of German spiritual unity and destiny. The reform process of the CAP is increasingly open to actors that apply different frames. Recent research reveals the consistent use of five frames during CAP reform processes: the policy mechanism frame, the farmers’ economic frame, the societal concerns frame, the budgetary frame, and the foreign trade frame. Our qualitative content analysis of 1,155 newspaper articles from Austria’s largest agricultural newspaper published between 01/10/2010 and 31/01/2015 confirms that these five frames are also used in national CAP reporting and consist of (...) subframes. The European Commission (EC), the European Parliament, and the Council of the European Union, which are involved in the CAP legislative process, mainly use the policy mechanism frame. The farmers’ economic frame and the policy mechanism frame are applied throughout the reform process. The societal concerns frame is gradually used over time, while the foreign trade frame is limited to specific events. The budgetary frame increasingly refers to public money for public goods, which indicates that the EC and other actors put efforts into legitimising the CAP. The results emphasise that both, agricultural and environmental actors use agricultural media to generate support for or condemnation of agricultural policy and thereby affect political agenda-setting. This English translation of the author's original work has been thoroughly revised, expanded and updated. The book covers logical systems known as type-free or self-referential . These traditionally arise from any discussion on logical and semantical paradoxes. This particular volume, however, is not concerned with paradoxes but with the investigation of type-free sytems to show that: (i) there are rich theories of self-application, involving both operations and truth which can serve as foundations for property theory and formal semantics; (ii) these (...) theories provide a new outlook on classical topics, such as inductive definitions and predicative mathematics; (iii) they are particularly promising with regard to applications. Research arising from paradoxes has moved progressively closer to the mainstream of mathematical logic and has become much more prominent in the last twenty years. A number of significant developments, techniques and results have been discovered. Academics, students and researchers will find that the book contains a thorough overview of all relevant research in this field. (shrink)

I defend the claim that life-suspending technologies can constitute a catastrophic and existential security factor for risks structurally similar to those related to climate change. The gist of the argument is that, under certain conditions, life-suspending technologies such as cryonics can provide self-interested actors with incentives to efficiently tackle such risks—in particular, they provide reasons to overcome certain manifestations of generational egoism, a risk factor of several catastrophic and existential risks. Provided we have reasons to decrease catastrophic and existential risks (...) such as climate change, we also have a (defeasible) reason for investing in developing and making life-suspending technologies (more) widespread. This volume offers a new framework for understanding expertise. It proposes a reconceptualization of the traditional notion of expertise and calls for the development of a new contextual and action-oriented notion of expertise, which is attentive to axiological values, intellectual virtues, and moral qualities. -/- Experts are usually called upon, especially during times of emergency, either as decision-makers or as advisors in formulating policies that often have a significant impact on society. And yet, for certain types of choices, there is (...) a growing tension between experts’ recommendations and alternative views. The chapters in this volume critically assess the idea of whether possessing epistemic authority can automatically make someone’s assertions necessarily more grounded than others. They not only evaluate the epistemological implications of this idea but also reflect on its ethical, socio-cultural, and political consequences. The interdisciplinary framework advanced across the chapters seeks to overcome certain limitations that underlie current models of expertise by adopting more inclusive and representative decisions that can improve the perceived neutrality of experts’ decisions. Increasing neutrality means reducing cases in which an unidentified bias – be it a scientific one or not – puts any of the individuals involved in a specific public choice at a systematic disadvantage. -/- Philosophy, Expertise, and the Myth of Neutrality will appeal to scholars and advanced students working in epistemology, philosophy of science, philosophy of the social sciences, public policy, and sociology. Engelhardt’s critiques of “generic chaplaincy” rely on the argument that chaplains are secular; however, professionally certified chaplains must maintain ordination with an ecclesial body. Engelhardt’s concerns are better directed at the academic subfield that supports and trains chaplains: pastoral theology. That field is somewhat guilty of forced ecumenism because it attempts a universal theology rooted in experience and the social sciences rather than the authority of creeds, ecclesial bodies, or traditions. Pastoral theology makes too many sacrifices to the authority of (...) the behavioral sciences without sufficient appreciation for sacramental theology and the spiritual bonds that rituals effect in communities of shared belief. In this model, ritual is reduced to its instrumental value in addressing the emotional needs of patients rather than viewed as efficacious spiritual care. Chaplains should take a holistic approach to theology so that they can better identify the duties and scope of interfaith spiritual care. (shrink)

A Partial Combinatory Algebra is completable if it can be extended to a total one. In [1] it is asked (question 11, posed by D. Scott, H. Barendregt, and G. Mitschke) if every PCA can be completed. A negative answer to this question was given by Klop in [12, 11]; moreover he provided a sufficient condition for completability of a PCA (M, ·, K, S) in the form of ten axioms (inequalities) on terms of M. We prove that just one (...) of these axiom (the so called Barendregt's axiom) is sufficient to guarantee (a slightly weaker notion of) completability. (shrink)

Tomasello argues in the target article that, in generalizing the concrete obligations originating from interdependent collaboration to one's entire cultural group, humans become “ultra-cooperators.” But are all human populations cooperative in similar ways? Based on cross-cultural studies and my own fieldwork in Polynesia, I argue that cooperation varies along several dimensions, and that the underlying sense of obligation is culturally modulated.
