What is the wrong behind the widely criticized presentist bias of democracies? In this paper I argue that it is not that future generations are excluded from present-day democratic decision-making quite generally. Rather, I claim that due to the unique risks associated with representing future generations and the limitations on affecting future generations both institutionally and causally, the focus ought to be on including them on a more specific, narrower, set of issues, namely only those that threaten to lead to (...) their domination. I identify such issues as those that may end up being purpose-determining: that may subject future generations to previous generations’ will by forcing them to exert a substantial amount of their energies on dealing with problems caused by their predecessors. I conclude by reflecting on the extent to which political representation together with providing avenues of contestation can minimize the risk of intergenerational domination. (shrink)

Most commentators agree that Leibniz advocates some version of a doctrine of the ideality or reducibility of relations, but there is considerable disagreement about what exactly this doctrine means. I argue that Leibniz’s views on relations are more complex than has been previously appreciated, and that, despite some ‘reductionist’ strands in Leibniz’s position, it is seriously misleading to describe him as a reductionist about relations without adding some important qualifications. The complexity of Leibniz’s views on relations tends to be obscured (...) by the common assumption that they can be captured in one unified thesis, or a small number of closely related theses, and by the widespread neglect to take Leibniz’s division of reality into several ontological levels into consideration. I disentangle ten Leibnizian theses about relations, extrinsic denominations, and their relation to intrinsic denominations. Some of these theses express a kind of dependence of extrinsic denominations on intrinsic ones, and some of them can even be counted as articulations of a form of reductionism. But, overall, the general tenor of Leibniz’s position on extrinsic denominations remains non-reductionist. (shrink)

The influence of background music on cognitive functions is still a matter of debate. In this study, we investigated the influence of background music on executive functions (particularly on inhibitory functions). Participants completed a standardized cued Go/NoGo task during three different conditions while an EEG was recorded (1: with no background music, 2: with relaxing or 3: with exciting background music). In addition, we collected reaction times, omissions, and commissions in response to the Go and NoGo stimuli. From the EEG (...) data, event-related potentials (ERPs) were calculated for the Go and NoGo trials. From these ERPs, the N2 and P3 components were specifically analyzed since previous studies have shown that these components (and particularly the Go-NoGo difference waves) are strongly associated with inhibitory functions. The N2 and P3 components of the difference waves (N2d and P3d) were used for statistical analyses. The statistical analyses revealed no differences between the three conditions in terms of amplitudes and latencies of the N2d and P3d components. In addition, reaction times, omissions, and commissions were comparable across all conditions. Our results suggest that in the context of this paradigm, music as background acoustic stimulation has no detrimental effects on the performance of a Go/NoGo task and neural underpinnings. (shrink)

In highly structured organisational fields individual efforts to deal rationally with uncertainty and constraints tend to lead, in the aggregate, to greater homogeneity in structure, culture and output. Drawing on institutional theory, this paper develops research propositions regarding the nature and scope of corporate social responsibility (CSR) engagement at trade/industry association level. The cases of the water and sewerage and film industries are used in order to test these propositions. The findings suggest that (a) trade associations in more homogeneous industries (...) are more likely to engage with CSR‐related issues; (b) trade associations in industries that face greater external scrutiny and threats to legitimacy are more likely to engage with CSR‐related issues; and (c) trade associations are more likely to engage with those substantive CSR issues that are of greater concern to the industry's most salient stakeholders. The findings also suggest that trade associations may have a greater tendency to engage in symbolic legitimation efforts through CSR if faced with the task of repairing industry legitimacy. (shrink)

The World According to Kant offers an interpretation of Immanuel Kant’s critical idealism, as developed in the Critique of Pure Reason and associated texts. Critical idealism is understood as an ontological position, which comprises transcendental idealism, empirical realism, and a number of other basic ontological theses. According to Kant, the world, understood as the sum total of everything that has reality, comprises several levels of reality, most importantly, the transcendental level and the empirical level. The transcendental level is a mind-independent (...) level at which things in themselves exist. The empirical level is a fully mind-dependent level at which appearances exist, which are intentional objects of experience. Empirical objects and empirical minds are appearances, and empirical space and time are constituted by the spatial and temporal determinations of appearances. On the proposed interpretation, Kant is thus a genuine idealist about empirical objects, empirical minds, and space and time. But in contrast to other intentional objects, appearances genuinely exist, which is due both to the special character of experience compared to other kinds of representations such as illusions or dreams, and to the grounding of appearances in things themselves. This is why, on the proposed interpretation, Kant is also a genuine realist about empirical objects, empirical minds, and empirical space and time. This book develops the indicated interpretation, spells out Kant’s case for critical idealism thus understood, pinpoints the differences between critical idealism and ‘ordinary’ idealism, such as Berkley’s, and clarifies the relation between Kant’s conception of things in themselves and the conception of things in themselves by other philosophers, in particular, Kant’s Leibniz-Wolffian predecessors. -/- PS from the author: I maintain a list of errata plus corrections on my website (which can easily be found by googling my name). This paper investigates how a performative understanding of a woman’s right to care can become part of a feminist politics which is able to transcend the well-worn dichotomies we find both within and without feminist literature, such as difference versus equality, difference versus repronormativity, and rights as freedom versus rights as domination. Drawing on my own research, I argue that claiming the right to care does not simply push women more deeply into motherhood resulting in even more control and regulation (...) of their lives, but that claiming care rights enables women to speak for themselves. Following the work of Linda Zerilli this paper argues that claiming women’s rights should, above all, be viewed as performative activities which contribute to democratic practices. (shrink)

Toward concordia: Dialogue and Poetry. – The question whether the governance and autonomy of medieval and early modern cities and the participation of their citizens in communal affairs may gesture toward a form of communal self-governance or it is yet another form of the rule of the privileged has re-emerged with new answers in recent scholarship. It was also one of the topics of the lecture series, Urban Governance and Civic Participation in Words and Stone, as part of which Prof. (...) Ferenc Hörcher also gave a talk. Although the following interview is based primarily on Prof. Hörcher’s lecture, the discussion joyfully meandered through a number of other, fascinating topics, like the value of philosophical dialogue vis-a-vis debate, the literary figure of the flaneur, the political ideas of Dante and the philosophical potential of poetry. Naneslo je namreč, da sem po opoldanskem odhodu iz Padove vrata tvojega mesta dosegel, ko se je sonce že nagibalo k zahodu. Preudarjal sem, ali naj prenočim tam ali naj nadaljujem pot – kajti mudilo se mi je, hkrati pa mi je zaradi dolžine dneva ostal še dobršen del svetlih ur – in ko sem se tako obotavljal, – glej – kdo bi se mogel skriti pred prijatelji? (...) – si mi s svojim predragim prihodom v družbi imenitnih mož, kakršnih je to drobno mestece rodilo na pretek, odgnal vsak dvom. Kot bi mi z nitjo prijetno pestrega pogovora pričvrstil omahujočega duha, sem kljub misli na odhod ostal in šele ko se je spustila noč, sem zapazil, da je dan spolzel mimo. Kot že mnogokrat poprej sem tudi tistega dne spoznal, da nam nič drugega ne izmika časa tako neopazno kot prav pogovori s prijatelji. Prijatelji so spretni tatovi časa, čeprav nobenega časa – razen tistega, ki ga posvetimo Bogu – ne bi smeli šteti za manj ukradenega, za manj izgubljenega, kot tistega, ki ga preživimo s prijatelji. The problem at the center of this essay is how one can reconcile the continuity of space with a monadological theory of matter, according to which matter is ultimately composed of simple elements, a problem that greatly exercised Leibniz, the Wolffians, and Kant. The underlying purpose of this essay is to illustrate my reading of Kant’s philosophical development, and of his relation to the Wolffians and Leibniz, according to which, (a), this development was fueled by ‘home-grown’ problems that arose within (...) the framework of the Wolffian philosophy from which Kant started out, and, (b), on his journey to critical idealism, Kant gradually moved away from Wolffianism, but closer to Leibniz, which, however, he came to realize only some years after the publication of the Critique of Pure Reason. This reading is illustrated by showing that the problem of how to reconcile the continuity of space with a monadological theory of matter is a problem that Kant inherits from Leibniz and the Wolffians, in whose thinking it already plays an important role, that Leibniz’s mature solution to the problem differs markedly from the Wolffian solution, and that Kant’s early, pre-critical solution is largely Wolffian, while his later critical solution is largely Leibnizian, as he himself notes with gleeful satisfaction. The discussion also reveals that this problem is one of the key problems that fueled Kant’s philosophical development and, eventually, led him to the discovery of transcendental idealism. (shrink)

In his recent book, The Empirical Stance, Bas van Fraassen forcefully raises the question of what a philosophical position can or should be. He mainly discusses this question with regard to empiricism but his discussion makes it clear that he takes his proposed answer to be generalizable: not only empiricism but philosophical positions in general should be understood as stances rather than dogmata. The first part of this essay is devoted to an examination of van Fraassen’s critique of ‘naïve’ or (...) dogmatic empiricism, which represents an integral part of his argument for ‘stance’ empiricism. It will be argued that, contrary to van Fraassen’s view, not all versions of naïve empiricism run into the problems identified by him. In the second part of the paper the case will be made that, contrary to van Fraassen’s thesis, the stance empiricist is in at least as bad a position as the naïve empiricist with regard to the task of providing a radical critique of metaphysics, which van Fraassen takes to be an essential task that any empiricist should be able to accomplish. The third part of this essay concerns van Fraassen’s general proposal, and examines the question whether a philosophical position can possibly consist in a stance. It will be suggested that this is not the case. With regard to empiricism this has the implication that if one wants to be a philosopher and an empiricist at the same time one needs to subscribe to a form of naïve empiricism. Furthermore, it will be proposed that as a philosopher-empiricist one should want, or, at least, allow some form of metaphysical theorizing to be part of the philosophical enterprise after all. Contrary to popular belief, I argue that Leibniz is not hopelessly confused about motion: Leibniz is indeed both a relativist and an absolutist about motion, as suggested by the textual evidence, but, appearances to the contrary, this is not a problem; Leibniz’s infamous doctrine of the equivalence of hypotheses is well-supported and well-integrated within Leibniz’s physical theory; Leibniz’s assertion that the simplest hypothesis of several equivalent hypotheses can be held to be true can be explicated in such a way that (...) it makes good sense; the mere Galilean invariance of Leibniz’s conservation law does not compromise Leibniz’s relativism about motion; and Leibniz has a straightforward response to Newton’s challenge that the observable effects of the inertial forces of rotational motions empirically distinguish absolute from relative motions. Conrad Gessner was town physician and lecturer at the Zwinglian reformed lectorium in Zurich. His approach towards the world and mankind was centred on his preoccupation with the human soul, an object of study that had challenged classical writers such as Aristotle and Galen, and which remained as important in post-Reformation debate. Writing commentaries on Aristotles De Anima was part of early-modern natural philosophy education at university and formed the preparatory step for studying medicine. This article uses the case study (...) of Gessners commentary on De Anima to explore how Gessners readers prioritised De Animas information. Gessners intention was to provide the students of philosophy and medicine with the most current and comprehensive thinking. His readers responses raise questions about evolving discussions in natural philosophy and medicine that concerned the foundations of preventive healthcare on the one hand, and of anatomically specified pathological medicine on the other, and Gessners part in helping these develop. This paper presents a four layer model for working with legal knowledge in expert systems. It distinguishes five sources of knowledge. Four contain basic legal knowledge found in published and unpublished sources. The fifth consists of legal metaknowledge. In the model the four basic legal knowledge sources are placed at the lowest level. The metaknowledge is placed at levels above the other four knowledge sources. The assumption is that the knowledge is represented only once. The use of metaknowledge at various (...) levels should make it possible to use the appropriate knowledge for the problem presented to the system. The knowledge has to be represented as closely to the original format as possible for this purpose. Suitable representation formalisms for the various types of knowledge in the five knowledge sources are discussed. ABSTRACTWhen learning from text, it is important that learners not only comprehend the information provided but also accurately monitor and judge their comprehension, which is known as metacomprehension accuracy. To investigate the role of a learner’s affective state for text comprehension and metacomprehension accuracy, we conducted an experiment with N = 103 university students in whom we induced positive, negative, or neutral affect. Positive affect resulted in poorer text comprehension than neutral affect. Positive affect also led to overconfident predictions, whereas (...) negative and neutral affect were both associated with quite accurate predictions. Independent of affect, postdictions were rather underconfident. The results suggest that positive affect bears processing disadvantages for achieving deep comprehension and adequate prediction accuracy. Given that postdictions were more accurate, practice tests might represent an effective instructional method to help learners in a positive affective state... (shrink)

Den Hori­ zont dieser Perspektive bildet die Demokratie, dessen Unerreichbarkeit in der politischen Praxis der Demokratisierung affirmiert wird. Dekonstruktion und Demokratisierung stehen dabei weder in einem parallelen noch einem additiven Verhiiltnis, auch wenn die Konjunktion "und" dies suggerieren mag. Es (...) handelt sich um zwei offene, einander verschiebende Prozesse, deren Verschriinkung diese Studie darlegen mochte. Eine temporale Meta­ pher tragt dabei solange, wie sie nicht teleologisch miBverstanden wird: Die Demokratie ist die Zukunft der Dekonstruktion,2 wenn die Dekonstruktion die andere Gegenwart bleibt. Die Spur einer dekonstruktiven Bewegung hat sich lange schon, minde­ stens seit einem Jahrhundert, vergegenwartigt.3 An sie gekoppelt ist gleich­ wohl die Angst vor einem Nihilismus, der das emanzipatorische Verspre­ chen verneinen konnte. Wie denkt Johann Gottlieb Fichte ausgehend von Immanuel Kant die Einheit von theoretischer und praktischer Philosophie? Der junge Fichte baut auf die drei Kritiken Kants auf; aufgeworfene und sich als widerstreitend herausstellende Fragen nimmt er auf und entwickelt sie zu einem eigenen System weiter. Fichtes System der Freiheit lasst sich nur mittels einer selbststandig durchgefuhrten intellektuellen Anschauung bilden, es verbirgt sich in einem geistigen Bild. Ohne den eigenen Anteil hinzuzunehmen, bleiben dem Leser der Wissenschaftslehre anstelle des Geistes nichts als Buchstaben (...) derselben. Bei Fichte wird die Frage nach dem Ort der Freiheit radikal anders und neuartig gestellt, weil der damalige Zuhorer der Jenaer Vorlesungen und auch der heutige Leser aktiv und systematisch in die Beantwortung der Frage: Was ist Freiheit? einbezogen wird. Dem an der Frage Interessierten selbst wird ein gewichtiger Platz zuerkannt, das System der Freiheit von diesem und seiner Bereitschaft mitzudenken, mitzubilden und mitzuwirken abhangig gemacht. Anstelle eines wohl vermuteten und viel verlangten ausseren Systems handelt es sich um ein inneres und verborgenes System der Freiheit. Mittels einer sprachkritischen, sich auf zeitgenossische historische Worterbucher stutzenden Analyse wird diese Problematik aufgezeigt und ferner uber eine visuell tatige Bildfindung sichtbar gemacht. Over the last three decades, the art market has undergone a remarkable transformation. Before the 1990s, artworks were sold with hardly any concern about whether they had been stolen or looted, whereas now any reputable gallery or auction house checks the “provenance” of any substantial work before sale. This transformation reflects interlocking changes in law, norms, and institutions. New York’s and more broadly the United States’ assertion of jurisdiction and application of U.S. substantive law has destabilized title to stolen and (...) looted goods worldwide because American statutes of limitations generally provide weaker protection for those who possess stolen or looted goods even in good faith. Application of American law has had a profound effect, especially for the high end of the market, because European or Asian investors who purchase art outside of the U.S. may eventually want to sell or display their works in the U.S. Defective title under American law thus affects prices worldwide. The tightening and broader application of American law reflects both longstanding legal principles and changes in social norms towards the redress of historical wrongs, most notably prominent campaigns relating to art confiscated or sold under duress in Nazi Germany. New institutions, most importantly searchable databases recording stolen and looted art such as the Art Loss Register, are also changing perceptions about minimum standards for good faith purchase, which in turn affects both social norms and court cases. These new norms, induced by both legal changes and better information, have influenced the market even for less valuable art, for which sale or display in the U.S. is not a relevant consideration and for which the threat of costly legal action is not credible. The fact that social and institutionalized norms play an important role in protecting original owners is probably good, because norms and institutions can be effective even where law is not and often do so at lower cost. Ethical thought experiments such as the trolley dilemma have been investigated extensively in the past, showing that humans act in utilitarian ways, trying to cause as little overall damage as possible. These trolley dilemmas have gained renewed attention over the past few years, especially due to the necessity of implementing moral decisions in autonomous driving vehicles. We conducted a set of experiments in which participants experienced modified trolley dilemmas as drivers in virtual reality environments. Participants had to make decisions between (...) driving in one of two lanes where different obstacles came into view. Eventually, the participants had to decide which of the objects they would crash into. Obstacles included a variety of human-like avatars of different ages and group sizes. Furthermore, the influence of sidewalks as potential safe harbors and a condition implicating self-sacrifice were tested. Results showed that participants, in general, decided in a utilitarian manner, sparing the highest number of avatars possible with a limited influence by the other variables. Derived from these findings, which are in line with the utilitarian approach in moral decision making, it will be argued for an obligatory ethics setting implemented in ADVs. (shrink)

The focus of this article is on elderly patients’ and nursing staff perceptions of informed consent in the care of elderly patients/residents in five European countries. The results suggest that patients and nurses differ in their views on how informed consent is implemented. Among elderly patients the highest frequency for securing informed consent was reported in Finland; the lowest was in Germany. In contrast, among nurses, the highest frequency was reported in the UK (Scotland) and the lowest in Finland. In (...) a comparison of patients’ and nurses’ perceptions, nurses had more positive views than patients in all countries except Finland. Patients with less need for nursing interventions in Greece and Spain gave their consent less often. The German and Greek patients were older, and the results also point to an association between this and their lower frequency of giving consent. In Spain, patients who were married or who had a family member or friend to look after their personal affairs were more likely to be included in the group whose consent was sought less often. This is the fourth of a set of five articles published together in this issue of Nursing Ethics in which the results of this comparative research project are presented. (shrink)

The view that agents are not obliged to do more than their initial fair shares when their fellow duty bearers fail to comply has prominent defenders, including Liam Murphy and David Miller. While Murphy thinks that asking agents to take up other agents’ slack would be unfair, Miller claims that slack-taking cannot be required because primary responsibility does not migrate from noncompliers to compliers. This paper argues, by contrast, that there are a number of circumstances in which there is a (...) duty to take up the slack even though it is unfair and even though responsibility stays where it is. The central claim is that what agents owe to third parties is a separate issue from how they relate to fellow duty bearers. This proposal also runs counter to familiar defenses of slack-taking that weigh its unfairness against the moral importance of the interests at stake for third parties. (shrink)

Asthereisa permanent shortage of human organs for transplantation purposes new methods to provide organs are being developed. The author deals with these new developments as there are artificial organs, genetically engineered animal organs and therapeutical cloning or embryonie stem cells to cultivate human organs. The goal of the article is to give an overview on these approaches and to summarize ethical aspects related to research, development and application of these methods.

Pedagogy in general is not only ruled by planning, explicit normative framings, and governmental strategies, but its topics, such as the success or the failure of teaching or learning processes or learners’ precarious or promising personality development, are also decisively influenced by unspoken, silent, corporal, spatial, material, barred, or alienated dimensions of pedagogy. Gender as an analytical category encloses these dimensions, as well as being a social category. In this essay, three sets of arguments, referring to implicit or tacit knowing, (...) to bodiliness and corporeality, and to performativity and mimesis will be used to explain the tacit side of gender as a dimension of pedagogy. Abstract:The focus of this article is on the social and personal development of children. The essay's point of departure is a specific idea about holistic personal development in the classroom with reference to the philosopher Michel Serres. A historical perspective will be added by the concept of the bildungsreise (in French, Le Grand Tour; in English, educational or cultural journey). This perspective allows us to raise the question of how the idea of increasing self-awareness, coping with life challenges, and the (...) tuning of long-standing aspirations through an educational journey can be related to the concepts of bildung (German) and bildning (Swedish). To understand bildning, a girl's survival in a wide, mystical forest in Astrid Lindgren's novel Ronia, the Robber's Daughter will be sketched as an example of a bildningsresa. A bildningsresa differs somewhat from a bildungsreise. We subsume bildungsreise and bildningsresa under the concept of the educational journey, with the awareness that this term has its own history that we cannot thematize. Modelling the idea of bildung and bildning within the glocalized world, the idea of an educational journey will be connected to personality development in the classroom, seen in Serres's terms.
