La literatura jurídica está dedicando cada vez más atención a los estereotipos perjudiciales en los distintos momentos procesales, desde la fase de instrucción hasta que se dicta sentencia. En este trabajo la estereotipación judicial, como mala praxis de la argumentación judicial, se enfocará en la sentencia. Después de evidenciar el fundamental papel de la motivación como lugar donde poder ejercer un control de las decisiones judiciales (2), así como lugar donde detectar la estereotipación judicial (3), se propondrá reflexionar sobre dos (...) tipos de conocimiento que pueden vehicular los sesgos de una cultura discriminatoria: el sentido común (4) y la pseudo-ciencia (5). Si bien son dos tipos de conocimiento que se emplean en la motivación de la sentencia para alcanzar un mejor entendimiento de los hechos, se observa la necesidad de que el órgano judicial adopte una actitud crítica para detectar la subyacente práctica discriminatoria potencialmente presente en ambas formas de conocimiento. The paper describes the contents of the new legislation and introduces some of the challenges with proliferations of rights to health care. Background: Discussing direct-to-consumer advertising of prescription drugs during a visit could affect prescribing practices and provider–patient relationship. Research objectives: The study examines advanced practice nurse prescribers’ perceptions of direct-to-consumer advertising and its effects on nurse–patient relationship, prescriptive authority, and appropriateness of patient clinical requests. Research design: A cross-sectional survey design was implemented. Participants and research context: The random sample consisted of 316 nurses (27.17% response rate) in one of the Midwestern states in the United States. Pearson’s chi-square analysis and multiple/multinomial (...) logistic regression analyses were used. Ethical considerations: Permission to conduct the study was obtained from the university’s Institutional Review Board. Participation was voluntary, and measures were taken to protect the anonymity and confidentiality of consenting participants. Findings: Most nurses (69%) believed that patients were “poor or very poor” at assessing the relevance of drug advertisements, 61% reported that the increase in drugs advertisements directed at patient was “a bad or a very bad thing,” and only 16% thought the advertisements were accurate to “a very or to a great extent.” Improved nurse–patient relationship was associated with factors such as the patient not bringing printed material, seeking nurse’s opinion only, taking responsibility for their health, and not challenging nurse’s prescriptive authority. Discussion: Advertising discussion during a visit could improve as well as pose a challenge to a nurse–patient relationship and nurse’s prescriptive authority. Conclusion: The positives of discussing advertising information can be maximized and the negatives minimized through enhanced interpersonal nurse–patient communication. (shrink)

This essay deals with Simon Evnine’s amorphic hylomorphism, and the bearings that considerations about modality might have on it. It is suggested that the assumption of amorphic hylomorphism makes an account of modality extensionally incorrect in the domain of natural, non-organic objects. It is further argued that, in the case of NNOs, the existence of real forms should be accepted and this conclusion is claimed to be consistent with scientific knowledge, on the basis of substance gradualism.

In his ethical considerations famous Polish philosopher Henryk Elzenberg proposes an authentic cognition of moral values. He discerns a conflict between two ways of thinking, scientific and evaluating. According to Elzenberg the more often a statement is rational the less it grasps reality. Therefore he considers intuitive cognition of value as the most effective one. His attitude towards neopositivism and scientism is definitely negative. In his new epistemology of values attention should be paid primarily to a method of evaluation since (...) a cognitive effect is strictly dependent on this method. Elzenberg’s ascetics, approached as concentrating on higher aims, necessity of universal cognition of a subject of evaluation and confronting newly formulated judgments with the ones by competent people, can our imperfect intuitions of perfect values make trustworthy. Our image of the world defines the boundaries of our evaluations. Utilitarian values constitute just a prelude to entering the world of perfect values. (shrink)

El objetivo de este artículo es analizar y revisar las normas que filosóficamente asociamos al proceso de testimonio, inquiriendo hasta qué puntoson0 consistentes con los conocimientos empíricos de las ciencias cognitivas.Tradicionalmente, el problema del testimonio surgía cuando, desde una epistemología de corte individualista, se suponía, siguiendo el dictum ya marcado en la Modernidad tanto por racionalistas como por empiristas, de que el conocimiento debía ser testado personalmente. Sin embargo, disciplinas y enfoques recientes, como la Cognición Socialmente Distribuida y la Epistemología (...) Social ofrecen otra vía al considerar al grupo la unidad cognitiva realmente significativa e intentar solucionar el problema del testimonio desde esa perspectiva. Nuestro objetivo es analizar los motivos por los que la CSD es un buen modelo para explicar algunas de las paradojas y problemas epistemológicos cuando tenemos en cuenta el papel del testimonio en el desarrollo de la ciencia. The goal of this paper is to review and analyze norms philosophically associated with the process of testimony and to investigate to what extent they are consistent with empirical knowledge supplied by cognitive science. Traditionally, the problem of testimony used to arise when it was supposed, from the viewpoint of an individualistic epistemology, that followed the dictum stated by rationalists and empiricists in Modernity, that knowledge had to be tested personally. However, recent disciplines and approaches, like Socially Distributed Cognition and Social Epistemology, provide alternative ways of thinking. This is the case when we consider the group as the truly significant cognitive unit and from such perspective we try to solve the problem of testimony. Therefore, our aim is to examine the reasons why SDC offers a good model for explaining some of the paradoxes and epistemological problems that arise when we consider the issue of testimony in the development of science. Gender differences in allocation choices made by children aged 5 to 6 The main aim of this article is to supplement gaps in current knowledge concerning the development of competences related to goods allocation choices. We conducted a study in which 158 children aged 5 to 6 made choices concerning allocations of goods between themselves and the other, anonymous child. The crucial findings point to boys as more selfish in their choices than girls. Furthermore, we provide evidence for the claim (...) that young children are aware that their choices are egoistic. Since our study adopted a similar methodology to that of the recent Swiss study, we were able to conduct cross-cultural analysis. The comparison of children's choices in the Polish study and the Swiss one pictures Polish children as displaying a stronger egalitarian preferences and revealing egoistic preferences less frequently than the children from Switzerland. Predictiveness (or testability) can be ascribed to empirical hypotheses in different degrees. Seven reasons why predictiveness is gradable are outlined. They are reflected in seven ways in which hypotheses can be compared according to the degree of their predictiveness. Hence additional specifications are required to accept predictiveness as a criterion of whether given hypotheses are scientific. Generally speaking a new hypothesis has little, if any, predictive power. Its predictive power will increase as science progresses. In ordinary conversation, we describe all sorts of different things as vague: you can have vague plans, vague ideas and vague aches and pains. In philosophy of language, in contrast, it is parts of language – words, expressions and so on – that are said to be vague. One classic example of a vague term is the word ‘heap’. A single grain clearly does not make a heap, and a million grains does make a heap, but where exactly does the (...) boundary lie? How many grains do you need to make a heap? There seems to be no precise answer to this question, and because the term is imprecise in this way, we call it vague. Vague terms are extremely common in natural language. The term ‘bald’ is vague, because there is no precise number of hairs that mark the boundary between ‘bald’ and ‘not bald’; the term ‘hot’ is vague because there is no precise temperature that something must reach to count as hot – and so on. As we have seen, adjectives can be vague, but so can nouns, adverbs and perhaps all parts of language. To find terms which are precise rather than vague, we need to look to the languages of logic and mathematics. We can use vague terms to construct paradoxes known as sorites paradoxes. From an obviously true premise, such as that a collection of 1 million grains is a heap, together with the claim that ‘heap’ has no sharp boundary, we can derive the absurd conclusion that just 1 grain counts as a heap. Any theory of vagueness must offer some solution to this paradox. Some of the most popular theories of vagueness include supervaluationism, the degree theory of truth and the epistemic theory, and many of the available theories demand a radical rethink of classical accounts of logic and language. The article discusses the importance of practice for conducting research on digital culture. It poses questions about whether one should possess technical competences in the field of digital humanities and in what way they can facilitate research attempting to describe the contemporary world. This issue is analysed using the theory of the third culture developed by Charles Percy Snow. The argument also focuses on other researchers representing various strategies for combining practice with theory, such as: Lev Manovich, Alexander R. Galloway, (...) Jan Stasieńko and Mirosław Filiciak. The aim of the article is to describe the emerging, new image of a humanist studying digital culture, whose new competence may be seen as a remedy for the ongoing crisis of the humanities. (shrink)

Purpose: The purpose of this study is to better understand the characteristics of the language-related skills of bilingual children with specific learning disorders. The aim is achieved by analyzing language-related skills in a sample of bilingual and Italian monolingual children, with and without SLD.Patients and methods: A total of 72 minors aged between 9 and 11 were recruited and divided into four groups: 18 Italian monolingual children with SLD, 18 bilingual children with SLD, 18 Italian monolingual children without SLD, and (...) 18 bilingual children without SLD. Each child underwent tests to evaluate different aspects of language skills: lexical and grammar, metalanguage and executive functions.Results: With regard to lexical and grammatical skills, the conditions of SLD and bilingualism both impact naming in terms of total number of errors for words with low frequency of use, while the condition of SLD has an effect on semantic errors for words with low frequency of use. The condition of bilingualism impacts on the total errors for words with high frequency of use and on circumlocution-type errors for words with low frequency of use. There were significant effects of bilingualism and SLD on the metalinguistic test for understanding implicit meaning, and an impact of SLD on phonological awareness was also found.Conclusion: The results suggest that both SLD and bilingualism have an effect on some lexical skills, in particular for words with low frequency of use. Both conditions, bilingualism and SLD, seem to impact on metalinguistic abilities that depend on lexical knowledge. These findings reinforce the importance of improving understanding of the neuropsychological profile of bilingual children with SLD. (shrink)

Both scientists and representatives of industry claim that important advantages can be secured through advances in biotechnology. However, the European public views new developments with caution, in particular when the applications concern animals and food. These differences in attitude cannot be explained merely in terms of differences in knowledge but also seem to be the upshot of contrasting values. One way to understand moral opinions and values is to view them against the background of so-called ethical theories. In this paper (...) we seek to describe the theoretical foundations of different public concerns over animal biotechnology. We also discuss the extent to which the values adhered to by the public are compatible with the visions of scientists regarding applications of biotechnology and other practices involving animals. We conclude that, in general, public worries about animal biotechnology can be located in the different ethical theories with bearings on animals. However, in most cases where biotechnology is found problematic, corresponding problems can be found in other widespread uses of animals that do not involve modem biotechnology. In recognition of this, we argue that the critical analysis not only of new biotechnology but also of existing technologies, gives rise to a-serious discussion of the limits to what it is ethically acceptable to do to animals. The concept of enhypostaton was introduced into theological discourse during the sixth-century Christological debates, and aimed to elucidate the orthodox doctrine of the unity of two natures in the singular hypostasis of Christ. In spite of the fact that the conceptual content of the term is recognized by contemporary scholarship as pertaining to the core of Christology, the notion of enhypostaton is often described as obscure and not clearly defined. The coining of the term is often ascribed to Leontius of (...) Byzantium, whereas in fact he only followed and developed solutions already introduced into Christological discourse by John the Grammarian. The article aims to clarify the notion by offering a philosophical account of the meaning and theoretical origins of “enhypostaton,” as introduced by John the Grammarian in the context of his discussion of substance as en-hypostatical being. Enhypostaton emerges as the proper way of describing the ontological complements of a particular entity. This seems to be a significant development in the philosophical explanation of substance. Podejmując problem niejęzykowych myśli, Bermudez rozważa go przede wszystkim na dwóch płaszczyznach: epistemologicznej i eksplanacyjnej. Płaszczyzna epistemologiczna dotyczy tego, jak możliwe jest przypisywanie myśli do istot nieposługujących się językiem oraz czy możliwe jest poznanie treści niejęzykowych myśli. Do rozwiązania tego problemu Bermudez posłużył się koncepcją semantyki sukcesu, która umożliwia poznanie zawartości przekonań i pragnień oraz zastosowanie wyjaśniania psychologicznego. Płaszczyzna eksplanacyjna dotyczy natomiast takiej atrybucji myśli do NC, która odpowiednio wyjaśniałaby ich zachowanie. W tym celu Bermudez rozszerza pojęcie racjonalności do NC (...) przez wyróżnienie jej różnych poziomów. Ponadto wyodrębnia protologikę, ukazującą, jak praktyczne rozumowanie może być przypisywane do NC. Główne zarzuty w stosunku do jego stanowiska dotyczą m.in. relacji między myśleniem a wnioskowaniem, stosowanej metodologii oraz rozszerzonego pojęcia racjonalności. (shrink)

Previous studies have reported a significant positive association between ability emotional intelligence and attachment security. However, these studies may, to some extent, be misleading because they relied on self-report measures of attachment security. Furthermore, to our knowledge, no study has yet investigated the relationship between ability EI and mentalization, operazionalized as reflective functioning, although EI and RF were assumed to be “conceptual cousins.” In an attempt to overcome some of the limitations of the previous research, the current study investigated the (...) relationships between ability EI, attachment security, and mentalization measured via the Adult Attachment Interview. Ninety-three volunteer participants from an Italian community population, aged from 27 to 55 years, took part in the study. Significant positive correlations were found between ability EI, attachment security, and RF. The results shed some light on the relationship between different attachment strategies and ability EI. Hyperactivating attachment strategies correlated negatively with ability EI, while the correlation between ability EI and attachment deactivating strategies depend on which defensive strategy is used: avoiding the painful emotional contact with the memory of unpleasant childhood attachment experiences positively correlated with experiential EI, whilst the resort to derogation of the attachment needs correlated with impairment in EI. Findings from the current study suggest that future studies in developmental psychology are needed to investigate the development of the ability EI in relation to the quality of the attachment models more in-depth.
