The first book length study of property-owning democracy, Republic of Equals argues that a society in which capital is universally accessible to all citizens is uniquely placed to meet the demands of justice. Arguing from a basis in liberal-republican principles, this expanded conception of the economic structure of society contextualizes the market to make its transactions fair. The author shows that a property-owning democracy structures economic incentives such that the domination of one agent by another in the market is structurally (...) impossible. The result is a renovated form of capitalism in which the free market is no longer a threat to social democratic values, but is potentially convergent with them. It is argued that a property-owning democracy has advantages that give it priority over rival forms of social organization such as welfare state capitalism and market socialist institutions. The book also addresses the currently high levels of inequality in the societies of the developed West to suggest a range of policies that target the "New Inequality" of our times. For this reason, the work engages not only with political philosophers such as John Rawls, Philip Pettit and John Tomasi, but also with the work of economists and historians such as Anthony B. Atkinson, François Bourguignon, Jacob S. Hacker, Lane Kenworthy, and Thomas Piketty. (shrink)

Sidgwick famously claimed that an argument in favour of utilitarianism might be provided by demonstrating that a set of defensible philosophical intuitions undergird it. This paper focuses on those philosophical intuitions. It aims to show which specific intuitions Sidgwick endorsed, and to shed light on their mutual connections. It argues against many rival interpretations that Sidgwick maintained that six philosophical intuitions constitute the self-evident grounds for utilitarianism, and that those intuitions appear to be specifications of a negative principle of universalization (...) (according to which differential treatments must be based on reasonable grounds alone). In addition, this paper attempts to show how the intuitions function in the overall argument for utilitarianism. The suggestion is that the intuitions are the main positive part of the argument for the view, which includes Sidgwick's rejection of common-sense morality and its philosophical counterpart, dogmatic intuitionism. The paper concludes by arguing that some of Sidgwick's intuitions fail to meet the conditions for self-evidence which Sidgwick himself established and applied to the rules of common-sense morality. Over the last three decades, social theory has become an increasingly important subdiscipline within sociology. Social theory has attempted to elucidate the philosophical basis of sociology by defining the nature of social reality. According to social theory, society consists of objective institutions, structure, on the one hand, and individuals, agency on the other, it promotes human social relations, insisting that in every instance social reality consists of these relations.

Merleau-Ponty’s writings on the philosophy of painting, though widely influential and much discussed, remain enigmatic. In this paper I compare his views on painting with those of his older contemporary, Jacques Maritain, who also holds that painting can give us a non-conceptual insight into deep truths about things that are inaccessible to discursive thought. I argue that some ideas that are obscure and undeveloped in Merleau-Ponty are developed more clearly and fully in Maritain. Even where there are significant differences between (...) them, these are not as great as it might at first seem. This comparison can help us to see the ways in which both philosophers’ theories of art are important for understanding their philosophies as a whole. Furthermore, the views they hold in common can continue to suggest a plausible and fruitful way to think about art today. (shrink)

The first in a new series with Australian Catholic University, this collection of essays deals with two important themes. 'Faith' and 'reason' are heavily weighted words. They point to elemental aspects of human existence. The papers and discussions presented strive to clarify and corelate these basic activities or dimensions of human beings. A personal view made in light of the recent news article regarding a husband wanting to sue Addenbrooke's hospital over a Do Not Attempt Resuscitation decision. This article aims to highlight how the rolling out of cross boundary palliative care registers may be more at risk of infringing human rights.

Although there are several provisions within the Nigerian legal framework that, however, address the issue of church attack, the state capacity to implement effective constitutional sanctioning on perpetrators of this heinous crime has always been found wanting or completely absent, leading to countless religious attacks on churches with seeming state consent. This study employs semi-structured interviews to draw data from affected families from Benue and Enugu States, Nigeria. The article explored their experiences. The study participants were recruited through snowball sampling (...) technique, and data were analysed thematically. The respondents stated that church killings or killing of Christians is rising because of the fact that perpetrators stand lower risk of detection and apprehension than other crimes. Also respondents interrogated that justification for the crime is land acquisition and religious intolerance. On the persistence of the challenge, all the 13 respondents stated that the crime seems to have state approval that has made it seemly impossible to tackle. The article calls for continuous inter-religious dialogue and intentional governmental responsibility in protecting lives of all persons living within the geographical enclave of Nigeria which is necessary for the common good. Closer understanding of other faiths and religions will help build bridges of peace and tolerance. The article also calls for the need to promote African traditional values, such as the value of sacredness of life, human respect and good neighbourliness. Contribution: This study initiated the discussions that will help the public understand the reason for continuous church attacks in Nigeria, what church crime connotes in the Nigerian context and its uniqueness from other crimes. These discussions sit quite well within the transdisciplinary religious perspective of this journal. (shrink)

Since its inception in the Middle Ages, the university classroom can be characterized by students gathered around a sage who imparts his or her knowledge. However, the effective classroom of today looks vastly different: First-year engineering students not only learn basic engineering principles, but are also guided to consider their own inner values and motivations as they design and build adaptive devices for people with disabilities; students in a large chemistry lecture work animatedly together in small groups on inquiry-based activities (...) while an instructor and teaching assistants circulate and guide their learning; students learning differential equations practice explicit metacognitive skills while problem-solving in class. Even though educational research, especially research that is targeted at STEM disciplines, demonstrates what most effectively engages students and supports their learning, many of today's classrooms look much like they did a century ago, with a professor delivering a primarily one-way lecture and students passively sitting in seats bolted to the floor. At this juncture in history, colleges and universities face a public call to engage a more diverse representation of students in effective learning, persistence, and degree attainment, and to do so economically and efficiently. It is essential that institutions draw upon methods demonstrated to effectively increase student learning and success. Educational researchers have thoroughly explored the "basic" science in this area, and a body of literature documents effective evidence-based instructional practices, hereafter referred to as EBIPs. Stanley Cavell has suggested that the deepest roots of skepticism lie in a sense of alienation between the subject and the world, and this has led him to reassess the philosophical importance of the Romantic project of “re-enchanting” the world. One way to pursue this project is by starting from Kant’s reflections on the sublime. I consider Julian Young’s recent discussion of this topic and the Heideggeran pantheism to which it leads him. I conclude that, while there is much insight (...) in Young’s reflections, there are crucial weaknesses in his position that point towards the plausibility of re-configuring it in more theistic and / or Platonic terms. _I am. We are. That is enough. Now we have to start._ These are the opening words of Ernst Bloch's first major work, _The Spirit of Utopia,_ written mostly in 1915-16, published in its first version just after the First World War, republished five years later, 1923, in the version here presented for the first time in English translation. _The Spirit of Utopia_ is one of the great historic books from the beginning of the century, but it is not an (...) obsolete one. In its style of thinking, a peculiar amalgam of biblical, Marxist, and Expressionist turns, in its analytical skills deeply informed by Simmel, taking its information from both Hegel and Schopenhauer for the groundwork of its metaphysics of music but consistently interpreting the cultural legacy in the light of a certain Marxism, Bloch's _Spirit of Utopia_ is a unique attempt to rethink the history of Western civilizations as a process of revolutionary disruptions and to reread the artworks, religions, and philosophies of this tradition as incentives to continue disrupting. The alliance between messianism and Marxism, which was proclaimed in this book for the first time with epic breadth, has met with more critique than acclaim. The expressive and baroque diction of the book was considered as offensive as its stubborn disregard for the limits of "disciplines." Yet there is hardly a "discipline" that didn't adopt, however unknowingly, some of Bloch's insights, and his provocative associations often proved more productive than the statistical account of social shifts. The first part of this philosophical meditation—which is also a narrative, an analysis, a rhapsody, and a manifesto—concerns a mode of "self-encounter" that presents itself in the history of music from Mozart through Mahler as an encounter with the problem of a community to come. This "we-problem" is worked out by Bloch in terms of a philosophy of the history of music. The "self-encounter," however, has to be conceived as "self-invention," as the active, affirmative fight for freedom and social justice, under the sign of Marx. The second part of the book is entitled "Karl Marx, Death and the Apocalypse." _I am. We are._ That's hardly anything. But enough _to start._. (shrink)

The “information age” is often thought in terms of the digital revolution that begins with Turing’s 1937 paper, “On computable numbers, with an application to the Entscheidungsproblem.” However, this can only be partially correct. There are two aspects to Turing’s work: one dealing with questions of computation that leads to computer science and another concerned with building computing machines that leads to computer engineering. Here, we emphasize the latter because it shows us a Turing connected with mechanisms of information flow (...) rather than solely with the mathematical and logical problems of computability for which he is better known. Our reasons for doing so will become clear in what follows. In fact, the 1937 paper just mentioned provides a general schematic for building a computing machine; this mechanical connection puts Turing on an historical continuum with others who discovered mechanisms to cope with information. Of those involved in this quest in the 19th Century, two people in particular, Edison and Bell, had explicit visions of an information age that would follow from their work. Because they were explicitly aware of what they were doing and partly brought it about long before 1937, they deserve substantial credit for the information age they set out to inaugurate. Regarding one purely mechanical and non-electronic technology, Edison noted ten uses for the phonograph, including not only the replication of sound, but also “connection with the telephone, so as to make that instrument an auxiliary in the transmission of permanent and invaluable records, instead of being the recipient of momentary and fleeting communication”. Even though the telephone was only two years old when Edison wrote of a network made up of mechanical hard storage systems and people connected by wire, the network vision was already clearly in his head. We spent a wonderful morning in the van Gogh gallery in Amsterdam. Of course we knew all the paintings, we had seen them all in reproduction, and the building was more like a bank vault than a setting for art. But what art! At first sight how small and uniform the paintings were in reality: yet every blade of grass, every flower in a field, every olive tree, every vibration in the sky, every patch of colour, every brush stroke, testified (...) to life and to a life vibrating beneath the surface form. In a true sense, an artist inspired, an artist breaking convention, artistic and social, but nevertheless an artist transforming life with a vision of the enhancement of life, a vision inviting each one of us to look again at the natural forms around us, to feel the spirit or the gods dwelling in them, a vision of enchantment and of humanity in a disenchanted world. Art—painting—can, then, be a source of spiritual nourishment as Kant and Schiller and Ruskin in their different ways thought it should be. (shrink)

Does the seller of a house have to tell the buyer that the water is turned off twelve hours a day? Does the buyer of a great quantity of tobacco have to inform the seller that the military blockade of the local port, which had depressed tobacco sales and lowered prices, is about to end? Courts say yes in the first case, no in the second. How can we understand the difference in judgments? And what does it say about whether (...) the psychiatrist should disclose to his patient's girlfriend that the patient wants to kill her? Kim Lane Scheppele answers the question, Which secrets are legal secrets and what makes them so? She challenges the economic theory of law, which argues that judges decide cases in ways that maximize efficiency, and she shows that judges use equality as an important principle in their decisions. In the course of thinking about secrets, Scheppele also explores broader questions about judicial reasoning--how judges find meaning in legal texts and how they infuse every fact summary with the values of their legal culture. Finally, the specific insights about secrecy are shown to be consistent with a general moral theory of law that indicates what the content of law should be if the law is to be legitimate, a theory that sees legal justification as the opportunity to attract consent. This is more than a book about secrets. It is also a book about the limits of an economic view of law. Ultimately, it is a work in constructive legal theory, one that draws on moral philosophy, sociology, economics, and political theory to develop a new view of legal interpretation and legal morality.
