This paper examines the perceptions of Russian executives toward the relationship between legal and ethical conduct. The focus is on questions of tax evasion attitudes and corporate illegal behavior. Forty Russian managers and entrepreneurs from a variety of organizations were interviewed. Their actions are aimed at gaining corporate income and profit from operations through hiding corporate activity from state and local authorities in a context where these authorities levy excessive taxes and other types of payment from businesses. Tax evasion methods (...) are presented and analyzed along with other varieties of illegal corporate behavior. The research results show that executives believe business could not perform in a completely legal way under Russia’s existing conditions. This article explores Gerardus van der Leeuw’s view of phenomenology of religion. The phenomenological method he defended is basically a hermeneutical approach in which an observer relates personally and even existentially to the “phenomena” (s)he studies in order to determine their essence (Wesensschau). In his anthropology (that reflects on the basic structure of human beings) a similar way of relating to the world is discussed: the “primitive mentality” that is characterized by the “need to participate” (besoin de participation). Both phenomenology (...) and mentalité primitive imply a critique of modern scholarship. This fundamental criticism of the prevailing (historical) approach in the humanities including religious studies explains the growing distance between van der Leeuw and the majority of scholars of religion in the decades after his death in 1950. Ariès traces Western man's attitudes toward mortality from the early medieval conception of death as the familiar collective destiny of the human race to the modern tendency, so pronounced in industrial societies, to hide death as if it were an embarrassing family secret.

This remarkable book--the fruit of almost two decades of study--traces in compelling fashion the changes in Western attitudes toward death and dying from the earliest Christian times to the present day. A truly landmark study, The Hour of Our Death reveals a pattern of gradually developing evolutionary stages in our perceptions of life in relation to death, each stage representing a virtual redefinition of human nature. Starting at the very foundations of Western culture, the eminent historian Phillipe Aries shows how, (...) from Graeco-Roman times through the first ten centuries of the Common Era, death was too common to be frightening; each life was quietly subordinated to the community, which paid its respects and then moved on. Aries identifies the first major shift in attitude with the turn of the eleventh century when a sense of individuality began to rise and with it, profound consequences: death no longer meant merely the weakening of community, but rather the destruction of self. Hence the growing fear of the afterlife, new conceptions of the Last Judgment, and the first attempts (by Masses and other rituals) to guarantee a better life in the next world. The notion of bilattice was introduced by Ginsberg, and further examined by Fitting, as a general framework for many applications. In the present paper we develop proof systems, which correspond to bilattices in an essential way. For this goal we introduce the notion of logical bilattices. We also show how they can be used for efficient inferences from possibly inconsistent data. For this we incorporate certain ideas of Kifer and Lozinskii, which happen to suit well the context of our work. (...) The outcome are paraconsistent logics with a lot of desirable properties.1. On November 14, 1996, an in-depth report on the recruiting and testing practices of Lilly Pharmaceuticals appeared in the Wall Street Journal. Laurie Cohen reported that most pharmaceutical companies had difficulty recruiting healthy subjects to participate in testing of “untried and potentially dangerous” drugs. These companies often had to pay subjects up to $250 a day to ensure adequate enrollment, and some even gave referral bonuses to doctors who sent potential subjects their way. Cohen then exposed how Lilly was able (...) to keep costs down: by recruiting homeless alcoholics to serve as research guinea pigs. “In many ways,” Cohen reported, “the practice is mutually beneficial. For Lilly, it is efficient and limits the risk that subjects will sue if harmed by an experiment or divulge particulars of a drug.” And the subjects “get several weeks or months of free room and board, and in interviews they express voluble gratitude for what they often call easy money.”. We introduce a general approach for representing and reasoning with argumentation-based systems. In our framework arguments are represented by Gentzen-style sequents, attacks between arguments are represented by sequent elimination rules, and deductions are made according to Dung-style skeptical or credulous semantics. This framework accommodates different languages and logics in which arguments may be represented, allows for a flexible and simple way of expressing and identifying arguments, supports a variety of attack relations, and is faithful to standard methods of drawing conclusions (...) by argumentation frameworks. Altogether, we show that argumentation theory may benefit from incorporating proof theoretical techniques and that different non-classical formalisms may be used for backing up intended argumentation semantics. Constructions of Intersubjectivity shows that the meaning of grammatical constructions often has more to do with the human cognitive capacity for taking other peoples' points of view than with describing the world. Treating pragmatics, semantics, and syntax in parallel and integrating insights from linguistics, psychology, and animal communication, Arie Verhagen develops a new understanding of linguistic communication. In doing so he shows the continuity between language and animal communication and reveals the nature of human linguistic specialization. Professor Verhagen uses (...) Dutch and English data from a wide variety of sources and considers the contributions of grammar to the coherence of discourse. He argues that important problems in semantics and syntax may be resolved if language is understood as an instrument for exerting influence and coordinating different perspectives. The aim of this paper is (i) to defend Frege's view that the referents of predicates are certain kinds of functions, or "concepts", i.e. incomplete entities, and not their extensions (i.e. sets of objects described by those predicates); and (ii) to justify, by a natural augmentation of Frege's semantic theory with modal ingredients, Frege's position that the sameness between concepts, or property-sharing, turns only on the sameness of extensions. Several problems with the doctrine that a predicate's extension is its referent (...) are presented, including the regress argument and an argument from the modern philosophy of language related to natural kind terms. The article conceptualizes the term Pedagogy of Fear as the master narrative of educational systems around the world. Pedagogy of Fear stunts the active and vital educational growth of the young person, making him/her passive and dependent upon external disciplinary sources. It is motivated by fear that prevents young students—as well as teachers—from dealing with the great existential questions that relate to the essence of human beings. One of the techniques of the Pedagogy of Fear is the internalization of the (...) view that without evaluation and assessment we cannot know a child’s level or “worth”—and therefore are unable to help him/her if he is “slow in learning.” In contrast, Philosophy for/with Children offers a space for addressing existential questions, some of which deal with urgent social issues. The willingness to make philosophy inquiry an alternative already from an early age seeks to allow the child to challenge him/herself with new and fresh questions. Philosophy for/with Children does not regard children as a “space of lack” (experience, knowledge, values, etc.) The new and fresh philosophical perspective of children demands the presence of a willingness to engage in dialogue and rejection of the fear of the innocent and deep questions of philosophy. Shaking free of the Pedagogy of Fear and restoring honor to children’s questions demands a fundamental conceptual change within education. The replacement of existential certainty as it is depicted by adults in the existing education system with an existential question is a heavy intellectual task that in most cases is viewed as subversive—primarily on the part of the adult. It demands a return to starting points and a willingness to allow children a free and safe educational space in which to ground preliminary and fertile questions about themselves, their lives, their environment, and, most of all, the changing world they discover with the form of originality that is right for them. This article calls into question the charge that frequentist testing is susceptible to the base-rate fallacy. It is argued that the apparent similarity between examples like the Harvard Medical School test and frequentist testing is highly misleading. A closer scrutiny reveals that such examples have none of the basic features of a proper frequentist test, such as legitimate data, hypotheses, test statistics, and sampling distributions. Indeed, the relevant error probabilities are replaced with the false positive/negative rates that constitute deductive calculations (...) based on known probabilities among events. The main aim of this paper is to revisit the curve fitting problem using the reliability of inductive inference as a primary criterion for the ‘fittest' curve. Viewed from this perspective, it is argued that a crucial concern with the current framework for addressing the curve fitting problem is, on the one hand, the undue influence of the mathematical approximation perspective, and on the other, the insufficient attention paid to the statistical modeling aspects of the problem. Using goodness-of-fit as the (...) primary criterion for ‘best', the mathematical approximation perspective undermines the reliability of inference objective by giving rise to selection rules which pay insufficient attention to ‘accounting for the regularities in the data'. A more appropriate framework is offered by the error-statistical approach, where (i) statistical adequacy provides the criterion for assessing when a curve captures the regularities in the data adequately, and (ii) the relevant error probabilities can be used to assess the reliability of inductive inference. Broadly speaking, the fittest curve (statistically adequate) is not determined by the smallness if its residuals, tempered by simplicity or other pragmatic criteria, but by the nonsystematic (e.g. white noise) nature of its residuals. All over the Internet, many websites operate dealing with collective and personal memory. The sites relevant to collective memory deal with structuring the memory of social groups and they comprise part of “civil religion”. The sites that deal with personal memory memorialize people who have died and whose family members or friends or other members of their community have an interest in preserving their memory. This article offers an analysis of an expanded philosophical discourse that took place over a two-year (...) period with three groups of young people who had experienced loss in their families or their communities and who were partners in writing texts on memorial sites or had established websites as part of coping with the loss. This article seeks to offer a narrative analysis of the philosophical discourse and to contribute to an expansion of the discussion regarding the connection between Philosophy with Children and its methods and the social networks where entire lives involving philosophical dimensions are conducted. BackgroundTo determine whether the public and scientists consider common arguments in support of animal research convincing.MethodsAfter validation, the survey was sent to samples of public, Amazon Mechanical Turk, a Canadian city festival and children’s hospital), medical students, and scientists. We presented questions about common arguments to justify the moral permissibility of AR. Responses were compared using Chi-square with Bonferonni correction.ResultsThere were 1220 public [SSI, n = 586; AMT, n = 439; Festival, n = 195; Hospital n = 107], 194/331 medical (...) student, and 19/319 scientist [too few to report] responses. Most public respondents were <45 years, had some College/University education, and had never done AR. Most public and medical student respondents considered ‘benefits arguments’ sufficient to justify AR; however, most acknowledged that counterarguments suggesting alternative research methods may be available, or that it is unclear why the same ‘benefits arguments’ do not apply to using humans in research, significantly weakened ‘benefits arguments’. Almost all were not convinced of the moral permissibility of AR by ‘characteristics of non-human-animals arguments’, including that non-human-animals are not sentient, or are property. Most were not convinced of the moral permissibility of AR by ‘human exceptionalism’ arguments, including that humans have more advanced mental abilities, are of a special ‘kind’, can enter social contracts, or face a ‘lifeboat situation’. Counterarguments explained much of this, including that not all humans have these more advanced abilities [‘argument from species overlap’], and that the notion of ‘kind’ is arbitrary [e.g., why are we not of the ‘kind’ ‘sentient-animal’ or ‘subject-of-a-life’?]. Medical students were more supportive of AR at the end of the survey.ConclusionsResponses suggest that support for AR may not be based on cogent philosophical rationales, and more open debate is warranted. A recent commentary defends 1) the concept of 'brain arrest' to explain what brain death is, and 2) the concept that death occurs at 2–5 minutes after absent circulation. I suggest that both these claims are flawed. Brain arrest is said to threaten life, and lead to death by causing a secondary respiratory then cardiac arrest. It is further claimed that ventilation only interrupts this way that brain arrest leads to death. These statements imply that brain arrest is not death (...) itself. Brain death is a devastating state that leads to death when intensive care, which replaces some of the brain's vital functions such as breathing, is withdrawn and circulation stops resulting in irreversible loss of integration of the organism. Circulatory death is said to occur at 2–5 minutes after absent circulation because, in the context of DCD, the intent is to not attempt reversal of the absent circulation. No defense of this weak construal of irreversible loss of circulation is given. This means that paents in identical physiologic states are dead (in the DCD context) or alive (in the resuscitation context); the current state of death (at 2–5 minutes) is contingent on a future event (whether there will be resuscitation) suggesting backward causation; and the commonly used meaning of irreversible as 'not capable of being reversed' is abandoned. The literature supporting the claim that autoresuscitation does not occur in the context of no cardiopulmonary resuscitation is shown to be very limited. Several cases of autoresuscitation are summarized, suggesting that the claim that these cases are not applicable to the current debate may be premature. I suggest that brain dead and DCD donors are not dead; whether organs can be harvested before death from these patients whose prognosis is death should be debated urgently. (shrink)

Brain death is accepted in most countries as death. The rationales to explain why brain death is death are surprisingly problematic. The standard rationale that in brain death there has been loss of integrative unity of the organism has been shown to be false, and a better rationale has not been clearly articulated. Recent expert defences of the brain death concept are examined in this paper, and are suggested to be inadequate. I argue that, ironically, these defences demonstrate the lack (...) of a defensible rationale for why brain death should be accepted as death itself. If brain death is death, a conceptual rationale for brain death being equivalent to death should be clarified, and this should be done urgently. (shrink)

We investigate the connection between ▵1 3-stability for random and Cohen forcing notions and the measurability and categoricity of the ▵1 3-sets. We show that Shelah's model for ▵1 3-measurability and categoricity satisfies ▵1 3-random-stability while it does not satisfy ▵1 3-Cohen-stability. This gives an example of measure-category asymmetry. We also present a result concerning finite support iterations of Suslin forcing.

Este artigo faz parte de uma investigação em andamento, na qual exploramos a leitura de arendtiana do Agostinho de Hipona, partindo da obra inicial, El concepto de amor en San Agustín (2001). Consideramos que a investigação da dissertação doutoral, obra tão pouco explorada pelos seus mais relevantes interpretes, pode brindarmos novas chaves de leitura da teoria política de Hannah Arendt, tornando mais complexo nossa abordagem na sua leitura heterodoxa da tradição do pensamento (...) filosófico. Segundo nossa hipótese é a tese doutoral de 1929, onde a dimensão política do problema num sentido amplo começa a emergir, a partir da questão do que é especificamente humano, sempre sujeito à constante tensão entre um “não mais” e um “ainda não” (Arendt, 2001: 311; Agustín, 2005: XI, 21,27). Somente em posteriores trabalhos a leitura da fonte agostiniana –focada cada vez mais nas Confesiones (2005) y na Ciudad de Dios (1958) fica articulada explicitamente com a elaboração da trama mais conhecida da fenomenologia da ação política; na qual numerosos e importantes interpretes tenham situado o giro embora da política da aluna do Heidegger e Jaspers (Young Bruehl, 2006; Canovan, 2002; Benhabib, 2000; Forti, 2001). Embora essas autoras reconheçam a formação inicial e sua influencia sobre a filósofa Arendt, em geral, todas elas acentuam a ruptura com todo o seu escopo de formação universitária em filosofia e teologia. A commentary on “A Rationale in Support of Uncontrolled Donation after Circulatory Determination of Death,” from the January‐February 2013 issue.

A classic example of the arbitrary relation between the way a word sounds and its meaning is that microorganism is a very long word that refers to a very small entity, whereas whale is a very short word that refers to something very big. This example, originally presented in Hockett's list of language's design features, has been often cited over the years, not only by those discussing the arbitrary nature of language, but also by researchers of sound symbolism. While the (...) two groups disagreed regarding the role of arbitrariness and sound symbolism in language, they both agreed there is a nonsound symbolic relation between word length and entity size in this case. This paper shows that the length of the words whale and microorganism in fact reflects a sound symbolic pattern. An analysis of >600 languages from >100 language families shows that languages use longer words to denote the concept small than they do to denote the concept big. The paper thus shows how explicit judgments might differ from implicit cognitive association and the problem of relying on these in sound symbolism research. (shrink)

According to the New Theory of Reference, proper names (and indexicals) and natural kind terms are semantically similar to each other but crucially different from definite descriptions and “ordinary” predicates, respectively. New Theorists say that a name, unlike a definite description, is a directly referential nondescriptional rigid designator, which refers “without a mediation of the content” and is not functional (i.e. lacks a Carnapian intension). Natural kind terms, such as ‘horse’ and ‘water’, are held to have similar distinctions, in contrast (...) to other predicates. However, the New Theory contains some problems related to reference, descriptionality, content and meaning. In view of these problems, it will be argued that the distinctive shared feature of proper names and natural kind terms, while technically corresponding to nonfunctionality, is to be explicated in terms of independence of possible worlds, rather than in terms of reference and content: natural kind terms are world-independent predicates, making “worldless” predications. Just as, say, ‘Elvis’ names Elvis even with respect to “Elvisless” worlds, or, rather, names Elvis independently of worlds, natural kind terms are in an important sense “worldless” as well: to talk about Elvis is to talk about him irrespective of moments of time and possible worlds, and is to talk about a human, also irrespective of moments and worlds, while it is not to talk about, say, a drug-addict irrespective of moments, nor about a singer irrespective of worlds. There is no genuinely timeless and worldless predication of the sort “Elvis is (was) bald”, but there is, it seems, such a predication “Elvis is (was) human”. This notion of independence of times and worlds is detached from those of descriptionality and content mediation. (shrink)

Even the critics of Dutch Reformed theologian, politician, and publicist Abraham Kuyper acknowledge his great power of oratory. This essay examines the nature of Kuyper's rhetoric in a mythopoetic perspective that sees its inspiration in a romantic understanding of artistic inspiration and vivid representations of reality. Long-term editor of De Standaard, Kuyper's stalwart defence of Calvinism against Modernism drew from the struggles of Dutch history and from his personal history to espouse strong views that are couched in military as well (...) as organic metaphors. His mastery of the psychology of mass communication enabled Kuyper to accomplish many, though not all, of his political goals. (shrink)

Conceiving the media as something massive, solid, rigid, unilateral, opposing agents and viewers, makes less and less sense in view of the development of the internet. However the analysis of the mechanism known as RSS Syndication shows that it is the very notion of the media which must be questioned. If it is better to “become” the media than to “hate” it, as the slogan for alternative practices invites us to do, we are clearly led to ask : what media (...) ? RSS Syndication allows us to transform information into practices of permanent production of subjectivity. Circulating automatically from blogs to blogs, from sites to sites, constantly renewed, archived, selected, personalized, enriched, information becomes the smooth fuel that feeds the individuals and the communities which use it. Statistical model specification and validation raise crucial foundational problems whose pertinent resolution holds the key to learning from data by securing the reliability of frequentist inference. The paper questions the judiciousness of several current practices, including the theory-driven approach, and the Akaike-type model selection procedures, arguing that they often lead to unreliable inferences. This is primarily due to the fact that goodness-of-fit/prediction measures and other substantive and pragmatic criteria are of questionable value when the estimated model is statistically misspecified. Foisting (...) one's favorite model on the data often yields estimated models which are both statistically and substantively misspecified, but one has no way to delineate between the two sources of error and apportion blame. The paper argues that the error statistical approach can address this Duhemian ambiguity by distinguishing between statistical and substantive premises and viewing empirical modeling in a piecemeal way with a view to delineate the various issues more effectively. It is also argued that Hendry's general to specific procedures does a much better job in model selection than the theory-driven and the Akaike-type procedures primary because of its error statistical underpinnings. In two days, the patient regained consciousness, but it was unclear whether he could communicate his preferences, whether due to injuries or difficulties with language. The staff did not think to contact the hospital’s largely inactive ethics consultation service for assistance, and instead looked to the patient’s living will for (...) guidance, even though the patient was not terminally ill, and his lack of capacity had not been determined. The Vatican recently published directives regarding “beginning of life” issues that explain the Catholic Church's position regarding new technologies in this area. We think that it is important to develop a response that presents the traditional Orthodox Jewish position on these same issues in order to present an alternative, parallel system. There are many points of commonality between the Vatican document and traditional Jewish thought as well as several important issues where there is a divergence of opinion. The latter include (...) the status of the zygote as produced during in vitro fertilization, the acceptable of procreation in a method other than through the conjugal act, and the permissibility of deriving benefit from the products of an illicit act. Rayleigh and Ramsay discovered the inert gas argon in the atmospheric air in 1895 using a carefully designed sequence of experiments guided by an informal statistical analysis of the resulting data. Many believe that the ethical problems of donation after cardiocirculatory death (DCD) have been "worked out" and that it is unclear why DCD should be resisted. In this paper we will argue that DCD donors may not yet be dead, and therefore that organ donation during DCD may violate the dead donor rule. We first present a description of the process of DCD and the standard ethical rationale for the practice. We then present our concerns with DCD, including the following: (...) irreversibility of absent circulation has not occurred and the many attempts to claim it has have all failed; conflicts of interest at all steps in the DCD process, including the decision to withdraw life support before DCD, are simply unavoidable; potentially harmful premortem interventions to preserve organ utility are not justifiable, even with the help of the principle of double effect; claims that DCD conforms with the intent of the law and current accepted medical standards are misleading and inaccurate; and consensus statements by respected medical groups do not change these arguments due to their low quality including being plagued by conflict of interest. Moreover, some arguments in favor of DCD, while likely true, are "straw-man arguments," such as the great benefit of organ donation. The truth is that honesty and trustworthiness require that we face these problems instead of avoiding them. We believe that DCD is not ethically allowable because it abandons the dead donor rule, has unavoidable conflicts of interests, and implements premortem interventions which can hasten death. These important points have not been, but need to be fully disclosed to the public and incorporated into fully informed consent. These are tall orders, and require open public debate. Until this debate occurs, we call for a moratorium on the practice of DCD. (shrink)

Understanding the patterns allows diagnosis and soft intervention, often linked to scenario exercises. The book collects six articles offering key examples of this perspective, addressing ongoing issues in the governance of science and technology, including nanotechnology and responsible research and innovation. And adds two more articles that address background philosophical issues.
