This book provides an original and provocative combination of ethnomethodological analysis and the concepts of linguistic philosophy with a breadth and clarity unusual in this field of writing. Analogies between the human and the cosmos run throughout Plato’s Timaeus. Timaeus claims that the cosmos came to be as mind’s “persuasion of necessity.” This paper argues that an anthropological equivalent to this “persuasion” can be found in Timaeus’ suggestive account of the human liver. Mediating between intellect and desire, the organ shows the problem of mind and necessity reflected in the human soul.

Is health care “special”? That is, do we have moral reason to treat health care differently from how we treat other sorts of social goods? Intuitively, perhaps, we might think the proper response is “yes.” However, to date, philosophers have often struggled to justify this idea—known as the “specialness thesis about health care” or STHC. In this article, I offer a new justification of STHC, one I take to be immune from objections that have undercut other defenses. Notably, unlike previous (...) utility- and opportunity-based theories, I argue that we can find normative justification for STHC in what I term our special duty to assist those unable to help themselves. It is this duty, I argue, that ultimately gives us reason to treat health care differently from other sorts of goods and to distribute it independently of individuals’ ability to pay. (shrink)

In recent years, various attempts have been made to advance a project sometimes characterized as "discursive psychology". Grounded in what its proponents term "social constructionism", the discursive approach to the elucidation of 'mental' phenomena is here contrasted to an ethnomethodological position informed by the later work of Wittgenstein. In particular, it is argued that discursive psychology still contains Cartesian residua, notwithstanding its professed objective of expurgating Cartesian thought from the behavioral sciences. One principal issue has been the confusion of "conceptual (...) analysis" with the empirical study of speech practices. If these distinct enterprises are conflated, the critical achievements of conceptual analysis are obscured or even misconstrued. A different picture of how best to analyze human conduct and mentality emerges if the lessons of Wittgensteinian grammatical analysis are preserved and extended, one more compatible with several themes in ethnomethodology. A range of arguments are presented to demonstrate that (1) human visual orientations are conceptually constituted (concept?bound); (2) the concept?boundedness of visual orientations does not require a cognitivist account according to which a mental process of ?inference? or of ?interpretation? must be postulated to accompany a purely ?optical? registration of ?wavelengths of light?, ?photons?, or contentless ?information'; (3) concept?bound visual orientations are not all instances of ?seeing as?, contrary to some currently prominent cognitivist accounts; (4) the dispute between cognitivist and (...) realist accounts about the phenomenon of ?seeing as? is spurious, and is based upon a confusion about the fundamental analytical distinction made by Wittgenstein between ?seeing? and ?seeing as'; (5) ?perceiving?, ?seeing?, and ?seeing as? are but three of a large array of verbs of human visual orientation, and are not ?master categories? under which one can subsume these other modalities; (6) one cannot deduce a continuity of human visual orientation from a continuity of photon?photoreceptor interaction, a point we characterize as the ?staggered character? of human visual orientations; (7) detailed attention to the grammars of the diverse verbs of human visual orientation can open up a domain of study which we here refer to as a ?praxiology of perception'; (8) the nature of such an inquiry can be illustrated with exemplary reference to the analysis of the properties of ?noticing? as embedded in courses of practical action; and (9) such arguments, which claim that existing perceptual theories overly homogenize what is involved in visual orientations to the world, parallel those of Stroll, who proposes that standard accounts of ?what is perceived? overly homogenize the perceptible environment. For all their various disagreements, one point upon which rights theorists often agree is that it is simply part of the nature of rights that they tend to override, outweigh or exclude competing considerations in moral reasoning, that they have ‘peremptory force’, making ‘powerful demands’ that can only be overridden in ‘exceptional circumstances’, Philosophical Foundations of Human Rights, Oxford University Press, Oxford, 2016, p. 240). In this article I challenge this thought. My aim here is not to prove that the (...) traditional view of rights’ stringency is necessarily false, nor even that we have no good reason to believe it is true. Rather, my aim is only to show that we have good reason to think that the foundation of the traditional position is less stable than we might have otherwise supposed and that an alternative conception of rights—one which takes the stringency of any given right as particular to the kind of right it is—is both viable and attractive. In short, to begin to move us towards a more ‘particularist’ conception of rights’ standing in moral reasoning and judgement. (shrink)

This article looks at how the category of female fighters in the Sierra Leone civil war (1991–2002) was interpreted by the local population and by the international humanitarian community. The category of the female fighter both challenges and confuses the gendered stereotypes of ‘woman the victim’ and ‘man the perpetrator’ on multiple levels. Most research on ‘women and war’ focuses on women either as inherently more peaceful or merely as victims, and often unwittingly reproduces in ‘war-affected women’ a corresponding lack (...) of ‘agency’. In this article, I criticize such theorizing by demonstrating the diversity and specificity of Sierra Leonean women's war experiences, while also examining how the notion of and discourse about war itself is gendered. While it has become necessary to expand the inquiries into what women do in war and to critically analyse women's roles as perpetuators and perpetrators of war and conflict, this article maintains that in situations where one can talk about the violence of women, as in the example of female combatants, one often finds violence against women as well. This article asks about the conditions of a sociological operationalization of the capability approach developed by Amartya Sen and Martha Nussbaum. Raising the question of freedom and social opportunities, the capability approach has so far mainly been discussed by economists and philosophers. In order to adopt this approach for a sociological and pragmatist perspective, it engages with methodological and theoretical issues. Whereas capabilities have until now mainly been studied within quantitative frameworks, the author opts for a qualitative method of inquiry (...) that draws on a pragmatist and configurational approach. Such a shift towards qualitative inquiry is a key condition for a better sociological understanding of notions like freedom and opportunities that stand at the core of the capability approach. To say health is 'special' is to say that it has a moral significance that differentiates it from other goods (cars, say or radios) and, as a matter of justice, warrants distributing it separately. In this essay, I critique a new justification for the specialness thesis about healthcare (STHC) recently put forth by Engster. I argue that, regrettably, Engster's justification of STHC ultimately fails and fails on much the same grounds as have previous justifications of STHC. However, I also argue (...) that Engster's argument still adds something valuable to the debate around STHC insofar as it reminds us that the moral significance of healthcare may be wider than simply its effect on the incidence of disability and disease: one further reason we may think healthcare is morally significant is because it concerns the treatment and care of those who are already unwell. Are the words in our natural language which we use to speak about natural and social phenomena actually laden with preexisting (and hence corrigible) theoretical commitments, full-blown "ontologies," or even metaphysics? Or can we appeal to rules for their use in adjudicating the sense (or otherwise) of any scientific or philosophical innovation? These questions arise most commonly in the context of claims about scientific "transformations," especially "scientific revolutions." Cognitive science, for example, announces such a "revolution" in its conceptualizations of the (...) true nature of the "mind," "thought," "intelligence," "understanding," and so on. In this paper I shall argue that Wittgenstein's reflections on "grammar" enable us to dissolve many of the perplexities that confront us when we invoke Kuhnian "incommensurability" in distinguishing between genuine scientific revolutions and pseudo-revolutions. Indeed, the Kuhnian thesis itself is seen to depend on a range of contestable claims about "words" and "meanings.". (shrink)

This book provides a sustained and penetrating critique of a wide range of views in modern cognitive science and philosophy of the mind, from Turing's famous test for intelligence in machines to recent work in computational linguistic theory.
