In his classic paper, The Serpent Beguiled Me And I Did Eat, Gerald Dworkin makes the case that, without probable cause, the useof Proactive Law Enforcement Techniques (PALETs) is morally impermissible. Call this prohibition Dworkin’s Rule (DR). Here we argue that there are two reasonable exceptions to DR—the use of PALETs, without probable cause, is justifi ed when employed against High Level Government Officials (HLGOs) and High Level Business Officials (HLBOs). Moreover, these exceptions are consistent with Dworkin’s notion of Ideal (...) Criminal Sanctioning. Finally, if society were to endorse the use of PALETs on HLBOs, we might be able to dispose of the current bane of American business, the Sarbanes-Oxley Act of 2002, and let business get back to the business of business. The aggregation of consistent individual judgments on logically interconnected propositions into a collective judgment on the same propositions has recently drawn much attention. Seemingly reasonable aggregation procedures, such as propositionwise majority voting, cannot ensure an equally consistent collective conclusion. The literature on judgment aggregation refers to such a problem as the \textit{discursive dilemma}. In this paper we assume that the decision which the group is trying to reach is factually right or wrong. Hence, we address the question of how good (...) the various approaches are at selecting the right conclusion. We focus on two approaches: distance-based procedures and a Bayesian analysis. They correspond to group-internal and group-external decision-making, respectively. We compare those methods in a probabilistic model, demonstrate the robustness of our results over various generalizations and discuss their applicability in different situations. The findings vindicate (i) that in judgment aggregation problems, reasons should carry higher weight than conclusions and (ii) that considering members of an advisory board to be highly competent is a better strategy than to underestimate their advice.". concepts like numbers or time are thought to be represented in the more concrete domain of space and the sensorimotor system. For example, thinking of past or future events has a physical manifestation in backward or forward body sway, respectively. In the present study, we investigated the reverse effect: can passive whole-body motion influence the processing of temporal information? Participants were asked to categorize verbal stimuli to the concepts future or past while they were displaced forward and backward , or (...) upward and downward . The results showed that future related verbal stimuli were categorized faster during forward as compared to backward motion. This finding supports the view that temporal events are represented along a mental time line and that the sensorimotor system is linked to that representation. We showed that body motion is not just an epiphenomenon of temporal thoughts. Passive whole-body motion can influence higher-order temporal cognition. (shrink)

THIS PAPER is not a piece of "research"; it simply offers a series of reflections on the transcendental method. It is occasioned by the realization that, while this method is interesting and important in the opinion of some, it can count on little familiarity in the United States. And where philosophers and students of philosophy make the effort, they have great difficulty appreciating transcendental philosophy or understanding its proposals. This difficulty is, as I say, largely circumstantial and due to a (...) lack of familiarity with the relevant works, but, viewed less superficially, it is motivated by a positive affiliation to another philosophical tradition. In fact, the positions of this other tradition are, if largely in a modern guise, the very ones against which transcendental philosophy reacted. This historical relationship has also systematic relevance. In many ways, pre-transcendental positions seem to have priority: we need only think of formal logic, certain basic stances in empiricist epistemology, common sense. Accordingly, the subjective difficulty of philosophers and students of such persuasions can be treated "objectively," as the difficulty of ever establishing arguments for the transcendental turn or for what Kant calls the "Copernican revolution." Transcendental philosophy must provide arguments, so it seems, on the pre-transcendental level to establish the transcendental position. Further, supposing this problem can be overcome, there is the genuine difficulty of understanding what the transcendental theory actually says and in what way it does its job. And lastly, supposing we find that it lives up to its program, there may still be difficulty with certain implications such that philosophers and students take refuge in non-transcendental positions rather than calling for improvements of transcendental philosophy. In this paper we cannot, of course, fully discuss to what extent the transcendental position can take care of its critics. The paper is mainly concerned with the difficulty of access or introductory argument to transcendental philosophy. (shrink)

Models are a principle instrument of modern science. They are built, applied, tested, compared, revised and interpreted in an expansive scientific literature. Throughout this paper, I will argue that models are also a valuable tool for the philosopher of science. In particular, I will discuss how the methodology of Bayesian Networks can elucidate two central problems in the philosophy of science. The first thesis I will explore is the variety-of-evidence thesis, which argues that the more varied the supporting evidence, the (...) greater the degree of confirmation for a given hypothesis. However, when investigated using Bayesian methodology, this thesis turns out not to be sacrosanct. In fact, under certain conditions, a hypothesis receives more confirmation from evidence that is obtained from one rather than more instruments, and from evidence that confirms one rather than more testable consequences of the hypothesis. The second challenge that I will investigate is scientific theory change. This application highlights a different virtue of modeling methodology. In particular, I will argue that Bayesian modeling illustrates how two seemingly unrelated aspects of theory change, namely the (Kuhnian) stability of (normal) science and the ability of anomalies to over turn that stability and lead to theory change, are in fact united by a single underlying principle, in this case, coherence. In the end, I will argue that these two examples bring out some metatheoretical reflections regarding the following questions: What are the differences between modeling in science and modeling in philosophy? What is the scope of the modeling method in philosophy? And what does this imply for our understanding of Bayesianism? (shrink)

This paper discusses recent interpretations of Jean-Paul Sartre's early theory of emotions, in particular his Sketch for a Theory of the Emotions. Despite the great interest that Sartre's approach has generated, most interpretations assume that his approach fails because it appears to be focussed on ‘malformed’, ‘irrational’ or ‘distorted’ emotions. I argue that these criticisms adopt a rationalistic or epistemically biassed perspective on emotions that is wrongly applied to Sartre's text. In my defence of Sartre I show that the directional (...) fit of emotions is not towards an evaluatively loaded world which is independently given and, at best, represented by emotions, but towards a world shaped through the impact of emotions themselves. Sartre's idea of emotions ‘magically transforming’ reality for the subject so that the latter is better able to cope with problematic aspects of practically relevant situations encapsulates the world-shaping capacities of emotions, which are thus not reserved for a restricted class of emotions. Recognition of the transformative powers of emotions will also direct attention away from their seemingly representative elements to their normative and practical aspects and offer a new basis for delineating the criteria for judging them. The plausibility of this position is discussed with reference to some of Sartre's examples, such as fear, sadness and horror, but also with reference to Joan Didion's account of grief in The Year of Magical Thinking. This response to Robert Knox’s very kind and constructive review1 of my 2008 book The Degradation of the International Legal Order: The Rehabilitation of Law and the Possibility of Politics gives me the opportunity not only to answer some of his criticisms, but also, on the basis of my own reflections since 2008, to fill in some gaps. Indeed, to revise a number of my arguments. First, I restate my attempt at a materialist account of human rights. Next I explain (...) why, for me, the right of peoples to self-determination is absolutely central to a materialist understanding of human rights; and also fill a serious gap in my own account in the book. This leads me not only to a reply to Robert Knox on the question of ‘indeterminacy’ in international law, but also to a disagreement with him on the use or misuse of the language of self-determination. My fourth section returns to our very different evaluations of the significance and meaning of the work of Yevgeny Pashukanis, and what, for me, is Pashukanis’s misunderstanding, for reasons consistent with his general theoretical trajectory, of Marx and Lenin on the Irish question. Finally, I present an outline of a re-evaluation of Marx’s principled position on self-determination. (shrink)

We study the fluted fragment, a decidable fragment of first-order logic with an unbounded number of variables, motivated by the work of W. V. Quine. We show that the satisfiability problem for this fragment has nonelementary complexity, thus refuting an earlier published claim by W. C. Purdy that it is in NExpTime. More precisely, we consider ${\cal F}{{\cal L}^m}$, the intersection of the fluted fragment and the m-variable fragment of first-order logic, for all $m \ge 1$. We show that, for (...) $m \ge 2$, this subfragment forces $\left\lfloor {m/2} \right\rfloor$-tuply exponentially large models, and that its satisfiability problem is $\left\lfloor {m/2} \right\rfloor$-NExpTime-hard. We further establish that, for $m \ge 3$, any satisfiable ${\cal F}{{\cal L}^m}$-formula has a model of at most -tuply exponential size, whence the satisfiability problem for this fragment is in -NExpTime. Together with other, known, complexity results, this provides tight complexity bounds for ${\cal F}{{\cal L}^m}$ for all $m \le 4$. (shrink)

Die primäre Aufgabe des Artikels ist es, die Eckpfeiler einer methodisch-kulturalistischen Handlungstheorie einzuschlagen. Zunächst soll die kategoriale Unterscheidung von Handeln und Verhalten und die Notwendigkeit einer philosophischen Handlungstheorie motiviert werden. Darüber hinaus liefert der Aufsatz die terminologischen Grundlagen einer entsprechenden Handlungstheorie und es wird aufgezeigt, wie diese in eine Theorie des Sprechhandelns und eine Theorie der Handlungsdeutung erweitert werden kann.

In dem Aufsatz wird eine kulturalistische Relevanzlogik im Rahmen des Methodischen Kulturalismus zu entwickeln versucht. Hierfür werden sowohl die Probleme, die in den Logikbegründungsversuchen des Methodischen Konstruktivismus auftraten, besprochen, als auch Probleme der Klassischen und der Intuitionistischen Logik sowie der Minimal- und Relevanzlogik als solcher. Neben der Kulturalistischen Relevanzlogik im engeren Sinne werden durch zusätzliche Anforderungen an die Prämissenmengen weitere Logiken begründet – beschränkt man sich auf konsistente Prämissenmengen, erhält man die kulturalistische Variante der Intuitionistischen Relevanzlogik, beschränkt man sich auf (...) entscheidbare Diskursbereiche, erhält man eine Klassische Relevanzlogik und bei Beschränkung auf konsistente und entscheidbare Diskursbereiche eine Starke Klassische Relevanzlogik. Die in dem Beitrag versuchte Logikbegründung ist vom Autor inzwischen widerrufen und durch den in "On Inferring" dargestellten Ansatz ersetzt worden. (shrink)

The three-dimensional “AIM model” proposed by Hobson et al. is imaginative. However, many kinds of data suggest that the “dimensions” are not orthogonal, but closely correlated. An alternative view is presented in which mental functioning is considered as a continuum, or a group of closely linked continua, running from focused waking activity at one end, to dreaming at the other. The effect of emotional state is increasingly evident towards the dreaming end of the continuum. [Hobson et al.; Nielsen; Solms].
