The Catholic Monarchy is the short-lived dynastic union (1580-1640) between the kingdoms of Spain and Portugal. By returning on the legal, political and pragmatic foundations of this empire which cannot be called Empire (because this name belongs to the Holy Roman Empire of the cousins of Vienna), the article tries to seize better the internal functioning of this heterogeneous political set, by adopting two points of view: that of America (how the notion of Catholic Monarchy is understood in the reynos, (...) far from Madrid and Lisbon) and that of Rome (how Holy See reaches - or not - to exist in the heart of this space). It emerges from it that the pope and the Catholic King are natural allies (around the Roman Christianity) but not objectives (their purposes do not match), and that Rome and Mexico as well picture themselves not as margins of the Catholic Monarchy, but as real centers. The theory of beauty has always rested on the representation of the infinite, understood in its finite expression and perceptible through the senses. The relationship of beauty to truth, of art to science, is inevitably modified with the new way of treating the infinite in the modern conception of the world. Non-classical science works with the notions of “infinitely large” and “infinitely small,” modifying their meanings in terms of experimental observations. We put these words in quotation marks because the Whole (...) may be considered as finite or infinite according to the angle from which it is viewed: the “infinitely small” only becomes so in determined circumstances, for example, when we consider the extended and discrete elements of space and time in a macroscopic approximation, as infinitely small elements of perpetual motion. Modern science studies these two poles of being—the Whole and its parts—in their interaction, admitting the dependence of macroscopic and even cosmic processes with regard to the processes being created in infinitely small spheres (or, according to another interpretation, finite but extremely small). However, as characteristic of our time as these concepts are—most often hypothetical—they nonetheless express a very old historical tradition that contemporary retrospection, turned toward classical science and the past of science in general, allows us to discern very clearly. All the culture of the past was dominated by the principle of the authority of the Whole over its parts. In peripatetic cosmology and physics, individual processes depended on the cosmic harmony of the center and frontiers of the universe, on the spheres and places toward which bodies tend. This authority of the general law, of universal harmony, of the system hinging on individual processes, is confirmed in Aristotle's Physics, but not only there: we find it in almost all the thinkers of antiquity. On the plane of general logic, it received expression in the Hegelian concept of the true infinite, a concept constituting to a high degree the philosophical equivalent of classical science. In Hegel's time, this last was already drawing away somewhat from the idea of an absolute and strict subordination of elementary processes to integrating systems and general laws, laws being realized through the probability of microprocesses, thus statistical laws, and whose exact application ignored individual acts, for example, the mechanism of molecules in thermodynamics. The statistical theory of heat has rendered continual a discrete microcosm—for the movement of individual molecules it substituted the average speed of the molecules—and continual laws became supreme points determining macroscopic processes. These laws had a differential nature. In other words, they prescribed the defined relationships between the infinitely small increases in size. Also, the schema of the classic law consisted in defining infinitely small processes by an infinitely large integral legality because of the number of processes. The infinitely true of Hegel is the actual infinite being realized in each of its finite elements; it is the subjection of the finite element to the infinite. (shrink)

A major objection to epistemic infinitism is that it seems to make justification impossible. For if there is an infinite chain of reasons, each receiving its justification from its neighbour, then there is no justification to inherit in the first place. Some have argued that the objection arises from misunderstanding the character of justification. Justification is not something that one reason inherits from another; rather it gradually emerges from the chain as a whole. Nowhere however is it made clear what (...) exactly is meant by emergence. The aim of this paper is to fill that lacuna: we describe a detailed procedure for the emergence of justification that enables us to see exactly how justification surfaces from a chain of reasons. This paper argues that the personal interview method is particularly appropriate for the kind of exploratory and complicated theory-building research that ethical decision-making, as a topic, represents at present. In doing so, it examines the key tasks of the ethics researcher, the suitability of interviews for obtaining the kind of data needed to accomplish these tasks, and the ensuing problems faced by the interview methodologist. It concludes with suggestions for enhancing the validity and reliability of interview-based ethics research.

(wife of patient) and Jeanne KerwinMy husband suffered from sudden onset of heart failure with a very low ejection fraction and was on IV Milrinone at the age of 47. One of the most powerful things he told me was that he was not afraid to die and therefore did not want to move forward with Milrinone. He eventually “did it for the kids.” After (...) the Milrinone drip was no longer working, he was offered an LVAD (left ventricular assist device) to keep him alive. He refused, but the doctor again convinced him to “do it for your kids” and said, “we put these devices in 80-year-olds.” He did not have time to explore any other options and reluctantly accepted the LVAD. It was implanted in May of 2014 in a very long and complicated surgery with a long and difficult recovery. He was in the hospital for a long time, and then he refused to go to rehab upon discharge, making it difficult for our family to manage, as he was extremely weak and needed care of his wound dressing. He worried about the financial [End Page 7] impact of a heart transplant and the medications required, as we were already struggling with the medical bills. He refused to have more surgery with the potential complications and never agreed to get on the transplant waiting list.After the implanted LVAD, my husband was not able to do most of what he loved in life. He couldn’t work (he was a truck driver), he couldn’t go fishing or swimming in the ocean, he couldn’t go hunting and fishing, and his overall physical condition was so poor that he couldn’t cook, garden and, most aggravating to him, he could not take a regular hot shower. The LVAD had to be covered with plastic in order to avoid getting the drive-line area wet, so bathing was a complicated process. He had trouble with stairs, had neuropathic pain in his legs from diabetes, and because of the pain medications, he felt cloudy and dizzy and slept most of the day in his recliner. I took care of him, even after I had to go back to work, and at the same time, I managed our two children (ages 9 and 12 at the time of LVAD).After almost two years of living with the LVAD, multiple hospitalizations for GI bleeds then seizures, more medications, and weekly blood draws for INR1, my husband requested that the LVAD be de-activated and that he be allowed to die of his heart failure. He described his life as “miserable.” He watched as his misery impacted his children and me. He suffered daily and had none of the joys that made life worth living for him. When we approached the cardiac team that implanted and monitored his LVAD with his request, they said “no.” They would not de-activate the LVAD because it was working. It was keeping him alive and he had no other terminal illness. His palliative doctor, who was treating his pain, also heard his request and told us to call for an “ethics consult” to determine if he would be “allowed” to have the LVAD de-activated. We got the number and called on March 31, 2016.At the time of the call to Ethics, we had no idea what “Ethics” was, other than a general definition of the word ethics as in professional behaviors and such. We did not know what to expect but we called. We would never have known to call “Ethics” if the palliative doctor had not advised us to do so, and my husband might have suffered a longer, more painful life both mentally and physically prolonged by the LVAD.We explained the request to the ethics consultant. She listened to my husband describe his daily living and his dissatisfaction with the quality of his life, his physical and emotional suffering, and his wish to rid himself of the LVAD and allow nature to take its course. According to the aspect theory of instantiation, a particular A instantiates a universal B if and only if an aspect of A is cross-count identical with an aspect of B. This involves the assumption that both particulars and universals have aspects, and that aspects can mediate between different ways of counting things. I will ask what is new about this account of instantiation and, more importantly, whether it is an improvement on its older relatives. It will turn out that the (...) part of it that is new is the notion of cross-count identity among aspects. As I will show, this notion is both dubious and unnecessary. I will end by presenting a simplified aspect theory of instantiation that does not involve cross-count identity. (shrink)

One frequent argument in the debate over federal funding of human embryo research is the slippery slope argument. Slope arguments can be of several types: either logical, empirical, or full (a combination of logical and empirical slope arguments, with an additional psychological premise). A full slope argument against human embryo research suggests that funding embryo reseach could undermine current protections for human subjects research, erode respect for persons with disabilities, and encourage eugenics practices. While the Panel commissioned by the National (...) Institutes of Health to issue funding guidelines regarding human embryo research acknowledges some slippery slope concerns, the Panel's final report fails to address such concerns in any depth. Given this failure seriously to address these valid concerns, federal funding of embryo research should not proceed at this time. Two different value orientations with regard to nature are presented. The first orientation corresponds to the naturalistic worldview. It emphasizes the need for protecting the environmental order of things. The second value orientation situates our interests and desires above the imperatives of the nature preservation. Nature is grasped, first of all, as raw material to be more or less radically changed. The distinction of two value systems is relevant for our position not just regarding nature around us, but regarding human (...) nature as well. The current bioethical debates on therapy versus enhancement reflect the opposition of these two sets of values. (shrink)

Reichenbach’s use of ‘posits’ to defend his frequentistic theory of probability has been criticized on the grounds that it makes unfalsifiable predictions. The justice of this criticism has blinded many to Reichenbach’s second use of a posit, one that can fruitfully be applied to current debates within epistemology. We show first that Reichenbach’s alternative type of posit creates a difficulty for epistemic foundationalists, and then that its use is equivalent to a particular kind of Jeffrey conditionalization. We conclude that, under (...) particular circumstances, Reichenbach’s approach and that of the Bayesians amount to the same thing, thereby presenting us with a new instance in which chance and credence coincide. President Barack Obama ordered federal regulatory agencies to engage in a retrospective regulatory review process in early 2011. This paper reports the initial results of an analysis of participation in the notice and comment process by business and public interest groups. The focus of the analysis is on comments given to the Environmental Protection Agency (EPA). Some attention is given to the EPA’s identification of regulations to be reviewed, as a result of this process.

This paper presents a conceptual framework for the study of social intelligence in a real-life environment. It is focussed on the dialogue organisation in argumentation, in particular how our understanding of dialogue phenomena in mediated communication may help us to support natural interaction in classroom debates. Dialogue organisation is explored in terms of the cohesive structure of dialogue that emerges as the result of information maintenance and change, specified locally by the adjacency pair and turn-taking, and globally by topic threads. We give a descriptive analysis of their interplay in real chat debates, based on lexical chains of repeated words in an attempt to clarify what feedback participants in the debate require in order to reflect on their contributions to the debate. We then show how this analysis can be used as a basis for conceptual design of a feedback adviser tool to automatically search for topics in student chat debates. Much of the data used in our analysis has been generated as part of the SCALE project SCALE (Internet-based intelligent tool to support collaborative argumentation-based learning in secondary schools) – EU Framework V project. focussed on specifying tools for computer supported argumentation in the classroom. “Frontier” is included in the general category of “limit” (limes: a road bordering a field). But what is at the origin of limit, frontier? An authority, a power that can exercise “the social function of ritual and social significance of the line, the limit whose ritual legitimizes passage, transgression” (Bourdieu, 1982, p. 121). The limit, a traced line, sets up an order that is not only spatial but temporal, since it not only separates a “this side” from a “that side” (...) but also a “before” and an “after”. This dual nature of the limit is at work in the myth of the founding of Rome. Any limit, any frontier, is intentional: it proceeds from a will; it is never arbitrary. Its legitimacy was originally established by a religious ritual and later, by a political procedure. (shrink)

One of the most intriguing and painful anomalies of the modern world—so diffused that it has almost become a universal culture— is the incredible number of individuals and groups who kill, torture, burn, kidnap, imprison or merely outrage other people with a clear conscience when a political motive may be alleged. Added to them is the much larger number of people and institutions that tolerate, approve, encourage, praise and even bless that type of behavior when it occurs within a political (...) context. Included in this generic political violence is „the kind of behavior that is much more serious and that we may call terrorist, the behavior of those who seek to impose their will through the commission of atrocities that sow a generalized terror or a panic fear, and then to manipulate the reactions these atrocities provoke. Here “private” terrorists, as well as “semi-state” and “state” terrorists commit acts that would not be tolerated in normal, non-political life, and the public that approves this conduct would never accept it if it occurred in everyday life. A characteristic of contemporary analytic philosophy is its ample use of thought experiments. We formulate two features that can lead one to suspect that a given thought experiment is a poor one. Although these features are especially in evidence within the philosophy of mind, they can, surprisingly enough, also be discerned in some celebrated scientific thought experiments. Yet in the latter case the consequences appear to be less disastrous. We conclude that the use of thought experiments is more successful in (...) science than in philosophy. (shrink)

Starting from the idea that functions are formally similar to actions in that they are described and explained in a similar way, so that both admit of an accordion effect, I turn to Anscombe’s insight that the point of practical reasoning is to render explicit the relation between the different descriptions of an action generated by the accordion effect. The upshot is, roughly, that an item has a function if what it does can be accounted for by functional reasoning. The aim of Modality and Explanatory Reasoning (MER) is to shed light on metaphysical necessity and the broader class of modal properties to which it belongs. This topic is approached with two goals: to develop a new and reductive analysis of modality, and to understand the purpose and origin of modal thought. I argue that a proper understanding of modality requires us to reconceptualize its relationship to causation and other forms of explanation such as grounding, a relation that connects metaphysically (...) fundamental facts to non-fundamental ones. While many philosophers have tried to give modal analyses of causation and explanation, often in counterfactual terms, I argue that we obtain a more plausible, explanatorily powerful and unified theory if we regard explanation as more fundamental than modality. The function of modal thought is to facilitate a common type of thought experiment – counterfactual reasoning – that allows us to investigate explanatory connections and which is closely related to the controlled experiments of empirical science. Necessity is defined in terms of explanation, and modal facts often reflect underlying facts about explanatory relationships. The study of modal facts is important for philosophy not because these facts are of much metaphysical interest in their own right, but largely because they provide evidence about explanatory connections.
