British equality law protections for sex and gender reassignment have grown fraught as activists tussle over legal and social categories of gender, gender transitioning, and sex. This article considers the future of gender-related equality protections in relation to ‘decertification’—an imagined reform that would detach sex and gender from legal personhood. One criticism of decertification is that de-formalising gender membership would undermine equality law protections. This article explores how gender-based equality law could operate in conditions of decertification, drawing on legal thoughtways (...) developed for two other protected characteristics in equality law—religion and belief, and disability—to explore the legal responses and imaginaries that these two grounds make available. Religious equality law focuses on beliefs, communities, and practices, deemed to be stable, multivarious, and subject to deep personal commitment. Disability equality law focuses on embodied disadvantage, approached as social, relational, and fluctuating. While these two equality frameworks have considerable limitations, they offer legal thoughtways for gender oriented to both its hierarchies and its expression, including as disavowal. (shrink)

For the past two decades, the humanistic disciplines have been dominated by poststructuralist theories and, more recently, a not unrelated curricular philosophy best defined as hardline multiculturalism, much discussed and often misunderstood. When linked together, they form an internal contradiction that is the moral challenge of liberal education today. Traditional political alignments cannot explain current divisions among the humanities professoriate. Ideological quarrels only obscure a deeper moral debate between an ascendant poststructuralism and a resurgent liberal humanism. It is important to (...) reappropriate liberal humanism in an effort to revitalize humanistic inquiry and renew its place in creative public discourse, and check a danger posed by poststructuralism's fascination with power and epistemological relativism which threaten to erase the ethical border between education and indoctrination. It is a common complaint against moral philosophers that their abstract theorising bears little relation to the practical problems of everyday life. Professor Braithwaite believes that this criticism need not be inevitable. With the help of the Theory of Games he shows how arbitration is possible between two neighbours, a jazz trumpeter and a classical pianist, whose performances are a source of mutual discord. The solution of the problem in the lecture is geometrical, and is based on the formal analogy (...) between the logic of the situation and the geometry of a parabola. This paper aims to show that moral judgments do not need to be objective in order to be logically respectable. Absence of 'objectivity' does not preclude us from putting moral judgments through standard logical hoops, And, Although derived moral judgments have a descriptive direction of fit, It does not follow that fundamental moral judgments are 'objectively true'. Without invoking objectivity the impersonal form of moral judgments can be justified on the analogy of kant's account of aesthetic judgments. This article seeks to bring small talk about cinema – the type of conversation that can begin with the question “Have you seen any good movies lately?” – into the analytical ambit of cinema and media studies. In order to do so, I argue that such conversation is relevant to the philosophical project of Stanley Cavell. Throughout his attempts to wed film analysis and philosophical reflection, including his seminal studies of Hollywood genres, Cavell has remained committed to the idea that (...) philosophy is not a search for objective absolutes or momentous conclusions. This is a characteristic inconclusiveness that small talk shares. While small talk is often derided as unimportant on account of this very inconclusiveness, the work of Cavell provides a propitious framework for appreciating small talk's underacknowledged philosophical stakes and for reconsidering assumptions about the relative value of communicative practices. Prior to the productive encounters that can be staged between Emmanuel Levinas’sthought and cinema at the level of reception, Jean-Pierre and Luc Dardenne introducehis philosophy to their filmmaking at its moment of inception.1Luc Dardenne’s diary Audos de nos images documents their filmmaking from 1991 to 2005, and isinterspersed with brief but erudite references to Levinas’s work. While Levinasianthinking is one among many cited influences in this text, which also features quotationsfrom the writings of novelists, poets, and other philosophers, along with (...) detailedreferences to other filmmakers, his work is a signal point of inspiration and ethicalaspiration for their filmmaking. The Dardenne brothers seek permanently to unsettlereceived ideas of what cinema is. In this, their approach is bound up explicitly, but notexclusively, with the ethical underpinnings of Levinas’s thought. Levinas’s reformulationof ethics as first philosophy creates a fissure at the root of the philosophy of being. TheDardennes’ films, in turn, perform a Levinasian-inspired challenge to the being ofcinema. At its most extreme moments, to kill or not to kill is the key question that theircinema raises. This tacit rewriting of the interrogative opening to Hamlet’s infamous soliloquy, shifts attention away from a self-centered concern with being or non-being,and towards the survival of the other. The passage from being to non-being, whichwould involve the death of the subject, is displaced here by a preoccupation with killing,or failing to kill, someone else. This particular move from dying to killing lies at the heartof the Dardennes’ mortal ethics. (shrink)

Any account of knowledge has to take account both of the contribution of the world and the contribution of man. Every human endeavour, every activity, every art, every science is a product of a unique interaction between man and the world. Where man is most passive, he merely reflects and reports the world; this is pure discovery, if it ever exists. Where man is most active, the world's contribution lies merely in the provision of the raw material; this is pure (...) invention, if it ever exists. All the arts, all the sciences can be ordered in a continuous array or spectrum ranging from pure discovery to pure invention. That they are all at some point on this continuum gives them a common but fragile thread, justifying our thinking and talking of the unity of the arts and sciences. Philosophy is neither pure discovery nor pure invention; it bears resemblances to both a science and an art. In this paper I propose to try to give reasons why we should regard the philosopher as an artist and philosophy as an art; or, at any rate, I shall try to show that there is an Art of Philosophy. This paper aims to strengthen the liberal theory of public justification defended by John Rawls and his followers, by arguing that advocates of political liberalism can have more to say about how citizens can come to endorse and give priority to liberal justice than has been commonly supposed. The political conception of the person, complete with the two powers of moral personality, contains within it all the resources we need to illustrate why reasonable persons would have at least one good (...) reason to endorse and uphold liberal justice, and to make it regulative of their pursuit of their conceptions of the good. This is achieved by citizens’ feelings of care and affective concern toward their higher-order interests—their sense of justice, and their conception of the good. (shrink)

As the prospects for a negotiated two-state solution to the Israeli–Palestinian conflict have dwindled, Jewish scholars in the United States have increasingly invoked the concept of diaspora to counter a purported Jewish consensus regarding Zionism. In this essay, I critique prominent exponents of this approach (Judith Butler, Jonathan and Daniel Boyarin) from a diasporic (i.e., non-Zionist) standpoint. My concern is not that Butler and the Boyarins attack Israel publicly, endorse a binational solution to the Israeli–Palestinian conflict, and/or support the movement (...) for Boycott, Divestment, and Sanctions—rather, it is that they lack a compelling vision for diasporic politics. Their visions prove wanting because they contest Zionism on the terrain of Jewish identity. To loosen Zionism’s hold, Butler and the Boyarins recover alternative approaches to the attainment or grounding of Jewish identity. Yet when framed as an ethic of particular identity, diasporic thinking can neither rebut Zionism’s political arguments, nor can it develop alternative models of Jewish self-rule. Instead of theorizing Jewish identity, I argue, diasporic thinkers should envision Jewish political solidarity beyond the confines of the nation-state. (shrink)

My ultimate purpose here is to examine, discuss, and interpret a difficult excerpt in Stobaeus’ 5th c. AD anthology, alleging to report—uniquely, it appears—a distinction Chrysippus drew between three different applications of the term stoixe›on or element (i.e., physical element).1 Stobaeus lists this passage as giving opinions specifically of Chrysippus “about the elements out of substance” (per‹ t«n §k t∞w oÈs€aw stoixe€vn), though in holding them he says Chrysippus was following Zeno, the leader of his sect. Hermann Diels (1879) identified (...) this selection as an excerpt (his fr. 21) from Arius Didymus’ late first century BC Epitome of Physical Doctrines.2 I print a translation below, with the text in an Appendix, as it is given in von Arnim (1903). The text is not without its problems, and I indicate in footnotes to the text which of the principal editors’ textual interventions I accept and follow in my translation. Whether this text presents a single, continuous excerpt from Arius Didymus, or instead some compilation of Stobaeus (or an earlier anthologist whose work Stobaeus employed) from dispersed passages of.. This paper seeks to challenge the “fixed line” between disciplines by exploring the interconnections of Sociology and Caribbean Literature. It highlights the Caribbean author as a social activist and policymaker whose aim is to agitate for improvement in various social conditions. The writings of three Caribbean authors—Erna Brodber of Jamaica, as well Frank McField and Roy Bodden of the Cayman Islands—are examined. Through their published and unpublished works, through their fiction and non-fiction, the interconnection between Sociology and Caribbean Literature is (...) explored. Their writings become alternative narratives that address various sociological issues, as the writers are lauded for their social activism which gave a small community in Jamaica its history and which pleads for the youth and agitates for education in the Cayman Islands. These writers, some of whom are trained sociologists, use their training and knowledge in this field and their expertise in creative writing to demonstrate that the lines of demarcation between the disciplines are becoming increasingly blurred. The paper concludes that this fusing of the disciplines means Caribbean authors can be viewed as social activists and policymakers whose works posit new thoughts and present new possibilities to ailing Jamaica and Cayman societies. We have sketched how it is possible to give an analysis for adjoined relative clauses which is consistent with the compositionality principle and have shown that the technique which seems necessary for this analysis can be used to provide a compositional semantics for the NP-S analysis of English relative clauses.It is unlikely that anyone working within the framework of a compositional theory would choose the NP-S analysis for English, since it is clearly much less elegant and simple, in some intuitive (...) sense, than the alternative Nom-S analysis. Our results seem to indicate, however, that such an analysis cannot be ruled out in principle, since any constraint on the theory that would exclude the NP-S analysis would seem to exclude the Hittite analysis as well. So the arguments for the Nom-S analysis in the English case must be based on other grounds, or the Hittite analysis is also incorrect and should be ruled out, or the happy discovery of some as yet unknown principles will allow one but not the other. However, in clinical practice, MMF dose reduction, interruption, or discontinuation due to hematological (...) and gastrointestinal side-effects occurred in up to 50% of the patients. Large retrospective analyses have demonstrated that patients requiring MMF dose manipulation due to adverse events experienced a higher rate of rejection and graft loss. Enteric-coated mycophenolate sodium was developed with the goal of improving upper GI side-effects. Here, we review the efficacy and safety of EC-MPS in de novo kidney transplant recipient, and in stable renal transplant patients who were converted from MMF.
