This article describes how cc. 39 and 37 create distinct tones of voice and use them to preclude the social pretensions of Egnatius in different spheres. The style of c. 39, markedly oratorical—and non-Catullan—in the syntax of its opening lines, develops into the voice of a respectable senex by way of archaisms of vocabulary and syntax and is capped by a figure of humor otherwise absent from the polymetrics, the apologus. The style thus creates a voice perfectly suited to chastise (...) Egnatius' social ineptitudes and, more importantly, constitutes on the verbal level an embodiment of the standards of the urban elite. Catullus thus illustrates to Egnatius that a subtle system of social gestures can be learned - something which Egnatius, for all his apparent pretensions to social prominence, manifestly has not grasped, marred as he is by the habit of grinning inappropriately. C. 37, which ends with an attack on the same Egnatius, is far different in tone, commingling tokens of artfulness with vulgarity and forcefulness. That mixed style exercises ironic decorum towards Lesbia's lovers, who are themselves an oddly mixed group, well-off on the one hand, but "backstreet adulterers" on the other. But the two tones of voice, and indeed the two groups of lovers, also embody the paradoxes of the Roman construction of stylish behavior, which could be represented as elegant dalliance or reprehensible vice. Inasmuch as Egnatius' fashion affectations, ridiculed at the poem's end, fail to qualify him for the ranks of Lesbia's lovers, he is represented as outside sophisticated society, however it be constructed. In concert the two poems utterly derail Egnatius' social pretensions: c. 39 as it were outflanks him on the "right," barring him from respectable society, and c. 37 outflanks him on the "left," barring him from the "jet set.". Cicero’s first speeches as consul, de lege agraria I and II, delivered to the senate and the people respectively, are virtually identical in outline and broad argument. That allows the rhetorical technique of individual sections to be compared closely. This article uses such comparisons to probe the tactics and ideology of the speeches. In both Cicero’s choice of word and phrase might suggest that he is simply addressing his audiences as suits their stations. But a consideration of the circumstances of (...) the speeches reveals instead that Cicero is directing his audiences to alternate ways of imagining their social and political positions; in effect, Cicero propounds distinct, principled, and communalist definitions of dignitas and libertas, core values of each audience – though sometimes at the price of distorting the intent of the bill. A number of authors have commented on the topic of mandated reporting in cases of suspected child maltreatment and the application of this requirement to researchers. Most of these commentaries focus on the interpretation of current legal standards and offer opinions for or against the imposition of mandated reporting laws on research activities. Authors on both sides of the issue offer ethical arguments, although a direct comparison and analysis of these opposing arguments is rare. This article critically examines the ethical (...) arguments made by authors on both sides of the debate. The conclusion is reached that researchers should be mandated reporters of child maltreatment because the current arguments do not justify their exclusion from current ethical and legal standards. The author makes recommendations for the ethically responsible conduct of research in regard to this topic and legal implications are discussed. (shrink)

We critically evaluate arguments in a recent Journal of Law, Medicine & Ethics article by Svoboda, Adler, and Van Howe disputing the 2012 affirmative infant male circumcision policy recommendations of the American Academy of Pediatrics. We provide detailed evidence in explaining why the extensive claims by these opponents are not supported by the current strong scientific evidence. We furthermore show why their legal and ethical arguments are contradicted by a reasonable interpretation of current U.S. and international law and ethics. After (...) all considerations are taken into account it would be logical to conclude that failure to recommend male circumcision early in infancy may be viewed as akin to failure to recommend childhood vaccination to parents. In each case, parental consent is required and the intervention is not compulsory. Our evaluation leads us to dismiss the arguments by Svoboda et al. Instead, based on the evidence, infant male circumcision is both ethical and lawful. (shrink)

A common element of Western theism is a belief in Providence, in the sense of some kind of (perhaps unknown or inscrutable) Divine Plan for creation, especially if it involves Divine intervention in the world to see to it that His will be done. This positioning of God as a behind-the-scenes agent acting so as to bring about some end of His own desire has the flavor of conspiracy theory. Where some secular conspiracy theorists posit a cabal of powerful individuals (...) (bankers, Freemasons, etc.) “pulling the strings” behind current events, belief in Providence posits God in a similar role (or perhaps God in conflict with a powerful, supernatural force of evil). But is this a fair comparison? Prima facie, there are a number of differences between the two cases, for example, God is posited as beneficent, whereas most conspiracy theories involve more self-serving goals or conspiracy theorists believe they have rational reason for their belief, not mere faith. This paper explores the relationship between these two cases in an attempt to more clearly define the epistemological features of each and to help understand how conclusions about the epistemic virtue of one might (or might not) apply to the other. As late as 1948, when he was making his report to the Literae Humaniores Faculty Board on the work he had done as University Lecturer since 1945, Friedrich Waismann listed three text books that he had ready for publication and one book—as it might be “real book”—which he referred to as “Philosophy and Grammar”. That was his fi nal title for a work he had been preparing since 1929 and which was originally to be called “Logik Sprache Philosophie”. In 1948 (...) that work will have consisted physically in a heavily corrected set of galley proofs, printed for Routledge and Kegan Paul . Renin is the rate‐limiting enzyme in a cascade that leads to production of angiotensin II, which is perhaps our most important regulator of salt and water balance and blood pressure. In this personal perspective, I describe how I entered the renin field 33 years ago by discovering that proteases increased the level of renin activity in biological fluids, so revealing the existence of a ‘pro’ form of the molecule. This led me on a journey that encapsulated all of the major (...) milestones in molecular discovery for renin. These included (1) the elucidation of the steps in renin biosynthesis, (2) the cloning of renin cDNA and its gene, (3) demonstration of the structure of the renin protein, (4) using the renin gene in the first genetic studies in hypertension, (5) finding the mechanism by which the major controller, cyclic AMP, regulates the promoter, (6) showing that a strong enhancer and its weak promoter control this physiologically regulatable gene in accord with the variegation (on/off switching) model, and (7) being the first to identify molecules involved in posttranscriptional control. The renin molecule, its gene and molecular control are now very well understood, but more fine details on the topic of renin continue to emerge to delight ‘reninologists’ and others. This paper explores the role of divine speaking in Christian ethics, critically engaging with the tendency in modern evangelicalism to seek to derive moral principles from Scripture or a biblically-derived ontology, often via deployment of map-making metaphors. The paper sets out the rather different centrality of the divine claim found in biblical accounts of good or righteous human action. Drawing on the criticisms of the anthropologist Tim Ingold of what he calls the “map-making fallacy,” the paper concludes by suggesting the (...) methodological importance of understanding the orientation of the Christian life to be a fundamentally grounded in interpersonal responsivity. This case involves invasive research on captive wild populations of birds to study aggressive animal behavior. The case and associated commentaries raise and examine fundamental issues: whether and under what conditions, such research is ethically justified when the research has no expected, direct application to the human species; the moral status of animals and how one balances concern for the animal’s interests against the value of gains in scientific knowledge. A concept for teaching business ethics and its relationship with business law is developed. Legal regulations form the essential boundaries of the business game. Many students do not realize the degree to which law is dependent upon ethical actors to achieve its objectives. At least three examples are insightful in this regard: First, the interpretive requirements of legal rules often rely on the ethical character of the interpreting business actor to achieve their objectives. Second, law does not prohibit harms from (...) occurring, it only associates costs with behaviors. Third, law cannot compensate society for non-fungible harms. Legal regulations do not sustain the orderly function of society without ethical business actors. (shrink)

One of Śaṅkara's most fundamental claims is that nirguṇa brahman, 'unqualified reality', is the origin of the world of experience. A serious challenge is posed by the Sāṅkhyan philosophers in terms of a principle of material causation, that the properties manifested in the effect are inherited from the material cause. Since nirguṇa brahman and the experienced world are so different, the principle implies that the former cannot be the material cause of the latter. Versions of the principle in relation to (...) alternative kinds of candidates for the role of material cause are discussed, considering the particular cases which motivate both Śaṅkara's and the Sāṅkhyans' metaphysics alike. This study develops a Heideggerian thesis on the significance of Dasein's bodiliness. In Grundbegriffe der aristotelischen Philosophie , Heidegger claims that bodiliness secures the ground for the full being of the human. I situate this thesis squarely within die Sache selbst for Heidegger. Die Sache selbst concerns the issue of how being itself is engendered in human understanding . From as early as 1921, Heidegger explicitly understands his central topic in terms of ki&d12;nh siv . That is, the emergence of (...) being in conjunction with the ontological structure of the human being is ultimately intelligible as a kind of movement. The 1924 thesis makes sense ultimately insofar as bodiliness itself is understood as the ontological movement---the original being-moved or pa&d12;qov ---that allows entities to appear within the domain of human concerns. After examining Heidegger's retrieval of several key Aristotelian concepts , I interpret bodiliness as the always already operative being-pulled-out-ahead-of-itself by its own essential lack. Entities are first able to be present to Dasein because Dasein is opened in this way. Thus, bodiliness on my reading is die Sache selbst. My interpretation of Heidegger's thesis also forms the interpretive starting point for a rereading of Geworfenheit and Gewesenheit as concepts of bodiliness. As Dasein's original pa&d12;qov , bodiliness in Sein und Zeit would go by the name die gewesene Geworfenheit: the a priori or always already operative thrown-open-ness that first allows being to emerge to human understanding.
