Since the late 1990s, the use of contralateral prophylactic mastectomy to treat unilateral breast cancer has been on the rise. Over the past two decades, dozens of studies have been conducted in order to understand this trend, which has puzzled and frustrated physicians who find it at odds with efforts to curb the surgical overtreatment of breast cancer, as well as with evidence-based medicine, which has established that the procedure has little oncologic benefit for most patients. Based on the work (...) of Annemarie Mol and John Law, this paper argues that these efforts to understand increased CPM use are limited by the “epistemology problem” in medicine, or, in other words, the tendency to view healthcare controversies and decision making exclusively through the lenses of objective and subjective forms of knowledge. Drawing on public discourse about rationales for choosing CPM, we argue that this surgical trend cannot adequately be understood in terms of what doctors and patients know about breast cancer risk and how CPM affects that risk. In addition, it must be recognized as the outcome of how specific practices of screening, detection, and treatment do or enact the bodies of patients, producing tensions in their lives that cannot be remedied with better or better communicated information. Recognizing the embodied realities of these enactments and their effects on patient decision making, we maintain, is essential for physicians who want to avoid the paternalism that haunts breast cancer treatment in the US. In The life of Richard Owen by his grandson there is an inference to the effect that Owen had objected to his name being used to authorize various statements that Whewell was drafting in opposition to the Vestiges. The inference is drawn from letters that Whewell wrote to Owen on 13 and 15 February 1845. Corroboration of this would corne from a letter of Owen to Whewell, dated 14 February 1845, if extant. Among the Whewell papers at Trinity College, Cambridge, (...) there are several letters from Owen to Whewell, none of which bears that date. There is one, however, dated 14 February 1844 which, on doser inspection, turns out to be the missing link in their correspondance. The evidence for the misdating is not merely that the letter falls naturally into a later sequence. The conclusion is inescapable because Owen refers to an ‘opinion which I have always entertained, and still do strongly, on the subject of a refutation of “Vestiges”’. Since the first edition of Chambers's book did not appear until October 1844, the letter must belong to the following year. My object in this paper is to examine the implications of this letter for a reconstruction of Owen's attitude to that book which Adam Sedgwick could so detest for, among many things, its ‘gross views of physiology’. We present a new partial order for directly forcing morasses to exist that enjoys a significant homogeneity property. We then use this forcing in a reverse Easton iteration to obtain an extension universe with morasses at every regular uncountable cardinal, while preserving all n-superstrong , hyperstrong and 1-extendible cardinals. In the latter case, a preliminary forcing to make the GCH hold is required. Our forcing yields morasses that satisfy an extra property related to the homogeneity of the partial order; we (...) refer to them as mangroves and prove that their existence is equivalent to the existence of morasses. Finally, we exhibit a partial order that forces universal morasses to exist at every regular uncountable cardinal, and use this to show that universal morasses are consistent with n-superstrong, hyperstrong, and 1-extendible cardinals. This all contributes to the second author’s outer model programme, the aim of which is to show that L-like principles can hold in outer models which nevertheless contain large cardinals. (shrink)

Proclaiming Louis Pasteur as the “Founder of Stereochemistry”, the distinguished Scottish chemist, Crum Brown, addressing a late nineteenth-century audience of Edinburgh savants, drew attention—as Pasteur had incessantly done—to the intimate relationship between living organisms and the optical activity of compounds sustaining them. It seemed to Crum Brown “that we must go very much further down in the scale of animate existence than Buridan's ass, before we come to a being incapable of giving practical expression to a distinct preference for one (...) of two objects differing only in being one to the right and the other to the left”. Crum Brown's lecture must have been entertaining, but it was also motivated by a serious desire to do justice to a particular assertion of Pasteur—an assertion which had, moreover, been misunderstood and dismissed by no less a chemical genius than Wilhelm Ostwald. Writing at a time when the majority of his colleagues were stressing the resemblances between inorganic and organic compounds, Pasteur had insisted that he “could not point out the existence of any more profound distinction between the products formed under the influence of life and all others” than that “artificial products have … no molecular asymmetry”. Pasteur was obliged to concede that the chemist might produce enantiomorphic pairs of isomers, but without resorting to a manual separation of crystals he was powerless to imitate Nature's performance, powerless to fabricate by chemical means a separate optical isomer, divorced from its partner. Now it was not only Crum Brown who felt that chemists had brushed aside this proposition of Pasteur. In his 1898 Presidential Address to the chemical section of the British Association, Professor F. R. Japp also complained that the possible vitalistic implications of Pasteur's distinction between natural and artificial products had been misapprehended or tacitly ignored. (shrink)

Rather than being inherently evil, business lobbying is a socially responsible activity which needs to be restrained by ethical standards. To be effective in a business environment, traditional ethical standards need to be translated into language which business persons can speak comfortably. Economical explanations must also be available to explain why ethical standards are appropriate in business. Eight such standards and their validating arguments are proposed with examples showing their use. Internal dialogues regarding the ethics of lobbying objectives and tactics (...) will plausibly occur only in businesses which recognize social responsibility mandates. Public interest stakeholders could hasten this recognition by making use of information made available by the Lobbying Disclosure Act of 1995 to institute external dialogues regarding lobbying by specific businesses and industry groups. Given practical ethical standards and the information on business lobbying provided by the law, the press, corporate activists, consumers, pension fund managers and the public can apply pressure for ethical lobbying practices. In the early 1990s, managers at Exxon decided to seek lower cost disposal in Louisiana for oil-field wastes declared hazardous in Alabama. This decision resulted in injuries to the residents of Grand Bois, Louisiana; the disposal company; Exxon; and the oil industry in the state. Given the need for business and society to manage business operations for mutual benefit, it is essential to understand why businesses injure the public so that similar incidents do not happen again. The authors use three (...) analytical perspectives to suggest how corporations may make unethical decisions without purposefully setting out to do so: their managers may fail to understand changing social expectations for corporate behavior; they may adopt organizational structures, policies, and procedures that block ethical action in the name of efficiency; and they may follow unwritten rules of behavior for career success that exclude ethics. These perspectives suggest that individual Exxon managers may not have been making greed-based decisions, weighing corporate gains against harms to others. The situation more likely involved a failure, for the reasons discussed, to raise ethics questions in making business decisions. This explanation does not make much difference to those injured nor does it absolve those who made the decisions. It does make a difference to society and to companies seeking to understand factors that have to be overcome in any large corporation that wishes to prevent such events from occurring. (shrink)

Is formal logic a failure? It may be, if we accept the context-independent limits imposed by Russell, Frege, and others. In response to difficulties arising from such limitations I present a Toulmin-esque social recontextualization of formal logic. The results of my project provide a positive view of formal logic as a success while simultaneously reaffirming the social and contextual concerns of argumentation theorists, critical thinking scholars, and rhetoricians.

In a 2007 paper, we argued that speakers with Autism Spectrum Disorders exhibit pragmatic abilities which are surprising given the usual understanding of communication in that group. That is, it is commonly reported that people diagnosed with an ASD have trouble with metaphor, irony, conversational implicature and other non-literal language. This is not a matter of trouble with knowledge and application of rules of grammar. The difficulties lie, rather, in successful communicative interaction. Though we did find pragmatic errors within literal (...) talk, the transcribed conversations we studied showed many, many successes. A second paper reinforced our finding of a general level of success. It considered differences within the class of pragmatically-inflected yet literal speech acts. The present paper carries our project forward. It overcomes some of the methodological limitations of the second paper, by increasing sample size, and looking at frequency of use rather than just seeming errors. It also includes a control sample. The emerging results are two-fold. On the one hand, there was a slight, statistically significant difference in frequency of use between our participants and the controls in four sub-categories: indexicals, possessives, polysemy and degree on a scale. In all four, the participants diagnosed with ASDs had fewer occurrences overall, relative to controls. On the other hand, there was no significant difference in error rates between ASDs and controls — not in any of the eight categories of pragmatic determinants of literal content that we coded for. The upshot is that, though there were less-preferred forms for participants with ASDs, they do very well indeed with pragmatic determinants of literal content. (shrink)

Political theory is a field that finds nourishment in others. From economics, history, sociology, psychology, and political science, theorists have drawn a rich repertoire of schemas to parse the social world and make sense of it. With each of these encounters, new subjects are brought into focus as others recede into the background, ushering a change not only in how questions are tackled but also in what questions are thought worth asking.

Management practitioners and scholars have worked diligently to identify methods for ethical decision making in international contexts. Theoretical frameworks such as Integrative Social Contracts Theory (Donaldson and Dunfee, 1994, Academy of Management Review 19, 252–284) and more recently the Global Business Citizenship Approach [Wood et al., 2006, Global Business Citizenship: A Transformative Framework for Ethics and Sustainable Capitalism. (M. E. Sharpe, Armonk, NY)] have produced innovations in practice. Despite these advances, many managers have difficulty implementing these theoretical concepts in daily (...) practice. Using the example of recent decisions by internet service providers Google, Yahoo, and MSN regarding censorship requirements in China, we offer six heuristic questions to help managers to resolve cross-cultural ethical conflicts in which the firm’s way of doing business differs from the practice in the host country. Recognizing that companies can take different approaches to law and ethics (Paine, 1994, Harvard Business Review 72(2), 107–117), our aim is to provide a management decision process to deal with demands or opportunities for engaging in questionable business practices in a host country. Cross cultural ethical conflicts are a major challenge for managers of multinational corporations (MNEs) when an MNE''s business practices and a host country''s practices differ. We develop a set of decision principles to help MNE managers deal with these conflicts and illustrate with examples of ethical conflicts faced by MNEs doing business in contemporary Russia (DeGeorge, 1994). We discuss the generalizability of the principles by comparing them to the Donaldson (1989) and Buller and Kohls (1997) decision models. Recognizing Justice For Citizens With Cognitive Disabilities engages with the most prominent liberal theories of justice today in revealing the path toward equal justice for citizens with cognitive disabilities.

Background: The current study was designed to examine whether ethnic-racial identity moderated the relationship between disordered eating and primary ethnic identification.Methods: Three hundred and ninety-eight undergraduate women were recruited from a large university in Hawai‘i. Participants completed the Eating Disorder Examination Questionnaire, the ERI measure, and reported their primary ethnicity as an index of ethnicity.Results: There was a significant correlation between eating concerns and centrality, r = 0.127, p < 0.05. Moderation analyses indicated that only ERI centrality moderated the predictive (...) effect of ethnicity on the importance of eating concerns, b = 0.05, t = 2.37, p = 0.018.Conclusions: The results suggest that the relationship between self-reported primary ethnicity and EDEQ scores is greater when ethnicity is more central to the individual's identity or when the in-group affect is important to an individual. Findings underscore the need for further research on the underlying mechanisms that account for the differing ways that ERI may affect eating concerns. (shrink)

The news reminds us almost daily that the truth is apparently not highly valued by many in business. This paper develops two prescriptive standards — the Expectation and Reputation guidelines — that may help businesspeople avoid violating clearly accepted truth standards. The guidelines also assist in determining whether truth is required in circumstances where honesty seems in conflict with the practical demands of business. A discussion of why, when and how these guidelines may be applied to facilitate truth-telling by business (...) organizations follows, along with illustrative examples. (shrink)

This paper describes student outcomes from participating in a week-long out-of-school action civics program designed to increase students’ civic and political competence and engagement. Using analysis from four years of survey data, this paper presents findings related to changes in students’ civic competence as a result of participating in the program, including findings related to both first time and repeat campers. Data revealed that participants experienced gains in half of the civic competence construct variables, with first-time campers experiencing significant gains (...) in five of the civic competence construct variables. Data analysis suggests that iEngage, an action civics summer experience, was effective in increasing elements of students’ civic competence, including their ability to get people to care about a problem, organize and run a meeting, write an opinion letter or contact a media outlet to express their views, and contact an elected official or community leader to address an issue. Several researchers have proposed that humans are predisposed to treat ethnic identities as stable and inherent. However, the ethnographic, historical, and genetic records attest to the ubiquity of inter-ethnic migrations across human history. These two claims seem to be at odds. In this article we compare three evolutionary accounts of how people reason about identity stability, and the effect that the cultural evolution of ethnic group boundaries may have on these beliefs. We test our hypotheses among Himba pastoralists in Namibia, (...) whose recent fission from the neighboring Herero makes them ideal for studying the effect of cultural distance on folk beliefs about identity stability. In a vignette experiment, we asked participants whether an individual born in one group who moved to another group would retain their original group membership and cultural characteristics or acquire those of the new group. Across vignette conditions we examine the importance of the direction of migration, parental social influence, and age at migration on perceptions of identity stability. We also compare participant responses to two out-groups, the Herero, and the more distantly related Damara. We find that participants seldom thought of identity as stable or fixed at birth. Furthermore, we show that cultural distance and endogamous preferences are independent of beliefs of identity stability. Himba believed the Damara character was more likely to change identity and cultural traits than was the Herero character, despite their greater cultural distance from the former group, and despite the fact that all participants expressed more anti-Damara than anti-Herero sentiment. Joining the dialogue on the relationship between the law and business ethics, Jeffrey Nesteruk and Eric W. Orts have offeredconceptions of the law as a positive influence rather than a negative curb on corporate behavior. While these “legal optimists” pursue anoble end in promoting higher ethical standards for corporations through the law, they may be overly optimistic in their suggestion that these more skillfully wielded legal models will influence corporate behavior for the better. Reviewing the basic tenets of their two (...) approaches, this paper uses corporate responses to environmental statutes to suggest that while legal optimism may offer hope for promoting corporate ethics, it has definite limitations in its current stage of development. The question of what explains individual differences in expertise within complex domains such as music, games, sports, science, and medicine is currently a major topic of interest in a diverse range of fields, including psychology, education, and sports science, to name just a few. Ericsson and colleagues’ deliberate practice view is highly influential perspective in the literature on expertise and expert performance—but is it viable as a testable scientific theory? Here, reviewing more than 25 years of Ericsson and colleagues’ writings, (...) we document critical inconsistencies in the definition of deliberate practice, along with apparent shifts in the standard for evidence concerning deliberate practice. We also consider the impact of these issues on progress in the field of expertise, focusing on the empirical testability and falsifiability of the deliberate practice view. We then discuss a multifactorial perspective on expertise, and how open science practices can accelerate progress in research guided by this perspective. (shrink)
