In The Idea of Justice , Amartya Sen argues for an approach to justice that is comparative and realization-based rather than transcendental and institutional. While Sen’s arguments for such an approach may not be as convincing as he thought, there are additional arguments for it, and one is that it provides a unique and valuable platform on which an account of justice as a virtue of social and political actors (including institutions and social movements) can be built. Hence (...) new dimensions of comparison are opened up: some actors are better disposed and more successful than others at leading social change in the direction of greater justice. The main objective of this article is to use the capability approach to construct such an account. Six dimensions of acting justly are identified: (1) reducing capability shortfalls; (2) expanding capabilities for all; (3) saving the worst-off as a first step towards their full participation in economy and society, (4) which is also to be promoted by a system of entitlements protecting all from social exclusion; while (5) supporting the empowerment of those whose capabilities are to expand; and (6) respecting ethical values and legitimate procedures. ABSTRACTThis essay brings Martha Nussbaum's politically liberal version of the Capabilities Approach to human development into critical dialogue with the Catholic Social Tradition. Like CST, Nussbaum's focus on embodiment, dependence and dignity entails a social use of property which privileges marginalized people, and both theories explain the underdevelopment of central human capabilities in social rather than exclusively material terms. Whereas CST is metaphysically and theologically ‘thick', however, CA is ‘thin’: its proponents positively eschew metaphysical commitments, believing a (...) commitment to quasi-Rawlsian ‘overlapping consensus' is more consistent with political liberalism. The capability approach of Martha Nussbaum and Amartya Sen places human capabilities at the centre stage of discussions about justice, equality, development and the quality of life. It rejects too much emphasis on mere preference satisfaction or resource provision and highlights the importance of human agency and freedom. This approach has already significantly influenced different fields of application, such as economics and development studies. Only recently have scholars started to explore its relevance for and application to the (...) area of technology and design, which can be crucial factors in the expansion of human capabilities. How does technology influence human capabilities? What difference could a capability approach make to policies and practices of applying ICT in development processes in the South? How can we criticize and improve the design of technology from the perspective of the capability approach? The capabilities approach of Amartya Sen and Martha Nussbaum has become an influential viewpoint for addressing issues of social justice and human de- velopment. It has not yet, however, given adequate theoretical consideration to the requirements of environmental sustainability. Sen has focussed on the instrumental importance of human development for achieving sustainability, but has failed to consider the limits of this account, especially with respect to consumption-reduction. Nussbaum has criticised constraining material consumption for its paternalistic prescription of one (...) particular conception of the good life, without considering it as an imperative of justice. We discuss two possible extensions of the capabilities approach. First, the concept of ca- pability ceilings contains several attractive elements, but it also suffers from some shortcomings. Therefore, second, we advocate constraining people’s combinations of functionings in accordance with a personal budget which con- sists of a fair share of environmental resources. (shrink)

Sabina Alkire shows how Nobel Prize-winning economist Amartya Sen's capability approach can be coherently---and practically---put to work in poverty reduction activities so that the voices and values of the poor matter. This provides economists, philosophers, theologians, and development practitioners with a way forward that addresses both theoretical and practical challenges.

Amartya Sen has developed the so-called capability approach to meet the criticism that income alone may be insufficient as a measure of economic inequality. This is because knowledge about people’s income does not tell us what they are able to acquire with that income. For example, people with the same income may not have the same access to health and transportation services, schools and opportunities in the labor market. Recently, there has been growing interest in empirical studies based on (...) the capability approach. Most of these, however, are only loosely related to quantitative behavioral theory, at least in a concrete and empirically operational way. The purpose of this paper is to demonstrate that the theory of random scale models offers a powerful theoretical and empirical framework for representing and accounting for key aspects of Sen’s theory. When can ever be justified in banning a religious practice? This paper focusses on Martha Nussbaum's capabilities approach. Certain religious practices create a clash between capabilities where the capability to religious belief and expression is in conflict with the capability of equal status and nondiscrimination. One example of such a clash is the case of polygamy. Nussbaum argues that there may be circumstances where polygamy may be acceptable. On the contrary, I argue that the capabilities (...) class='Hi'>approach cannot justify polygamy in any circumstance. Her approach rules out polygamy, but may not rule out all non-monogamous relationships, such as polyamory. Finally, I conclude that the capabilities approach would benefit from a more robust understanding of recognition. (shrink)

Forty years ago Amartya Sen delivered his Tanner Lecture, 'Equality of What?', in which he introduced to the world a novel approach to the idea of equality by way of the notion of 'basic capability' as 'a morally relevant dimension'. We can now see with hindsight that Sen's argument - that we should focus upon equality of basic capabilities ('a person being able to do certain basic things') - launched what has become an academic armada now proceeding under (...) the flag of 'the capability approach'. While that flag has ventured far and wide and engaged many area of inquiry, this volume of essays is the first to explore how the capability approach (the CA) might shed light upon labour law. Three dimensions of the CA's potential for illuminating labour law are examined. Part I enquires into the nature of the basic relationship between CA and labour law - do they share common ground or disagree about what is important? Can the CA provide a normative 'foundation' for labour law? Part II goes further by examining the relationship of the CA and other well-established perspectives on labour law, including economics, history, critical theory, restorative justice, and human rights. Part III examines the possible relevance of the CA to a range of specific labour law issues, such as freedom of association, age discrimination in the workplace, trade, employment policy, and sweatshop goods. Amartya Sen’s capability approach has become increasingly popular in development studies. This paper identifies controllability and operationalisability as two key stumbling blocks which prevent the capability approach from being used even more widely in development practice. It discusses the origins and application of the Choice Framework, a conceptual tool designed to help operationalise the approach. The framework can be used to deconstruct embedded ideologies and analyse the appropriateness of development goals, to map development as a systemic process, (...) and to plan interventions which can result in increased freedom of choice for people. Three examples of the application of the Choice Framework in the field of information and communication for development (ICT4D) are given. The three technologies which are examined, telecentres (Infocentros), Chilecompra and Fair Tracing, can be placed at different places of a determinism continuum, some reducing the spectrum of choices a user has. The paper argues that while frameworks such as the Choice Framework can be developed further to increase the operationalisability of the capability approach, it is up to development funders to accept the fact that people’s choices are never fully predictable and thus Sen’s ‘development as freedom’ will inevitably be a dynamic and open-ended process. The recent ethical debate concerning the implementation of carbon dioxide removal (CDR) has expanded the traditional scope of ethical analysis to investigate the appropriate role of CDR within the larger climate change mitigation discussion. Specifically, the recent scholarship is embedded in the disputed sustainable development landscape that presents various and competing visions of desirable futures. This article unpacks and clarifies the discussion between Darrel Moellendorf and Henry Shue as representatives of two camps in the recent debate, the former supporting carbon (...) removal to achieve poverty-targeting sustainable development and the latter rejecting overreliance on CDR’s potential. Finally, moving beyond this discussion, the article proposes that a capabilities approach to CDR can adequately inform the debate, tackling some important limitations in the recent literature by offering a broader account of human well-being relevant to CDR implementation. This paper provides a critical exploration of the capability approach to human rights (CAHR) with the specific aim of developing its potential for achieving a synthesis between “humanist” or “naturalistic” and “political” or “practical” perspectives in the philosophy of human rights. Section II presents a general strategy for achieving such a synthesis. Section III provides an articulation of the key insights of CAHR (its focus on actual realizations given diverse circumstances, its pluralism of grounds, its emphasis on freedom of (...) choice, its demand for public reasoning, its context-sensitive universalism, and its broad view of obligations). These insights go some way toward the achievement of the desired synthesis. But, as explained in IV.1, in its current form CAHR faces two serious objections by the defenders of the political perspective: the Gap Between Capabilities-Interests and Rights Objection and the Disconnect From Practice Objection. Answering these criticisms requires some amendments to CAHR. Section IV.2 suggests a response to the first objection based on the introduction of a contractualist framework of justification. Sections IV.3 and IV.4 tackle the second objection by introducing a re-characterization of the cosmopolitan standard underlying the humanist perspective and by identifying the differences and relations between various dimensions of a conception of human rights and their significance for actual political practice. The paper illustrates the practical implications of CAHR, in its modified form, for the pursuit of some important rights. (shrink)

The capability approach constitutes a significant contribution to social theory but its potential is diminished by its insufficient treatment of the social construction of meaning. Social meanings enable people to make value judgements about what they will do and be, and also to evaluate how satisfied they are about what they are able to achieve. From this viewpoint, a person’s state of wellbeing must be understood as being socially and psychologically co-constituted in specific social and cultural contexts. In this (...) light, the telos of ‘living well’ which is at the heart of Sen’s version of the capability approach is inadequate and must be modified to a telos of ‘living well together’ which includes consideration of the social structures and institutions which enable people to pursue individual freedoms in relation to others. The policy significance of the capability approach can be further strengthened by paying greater consideration to the political economy of policy decision-making processes and the ways in which conflicts and distributions of power are institutionalized. However, despite its theoretical and philosophical attractiveness, it has been less easy to measure or to translate into policy. According to Martha Nussbaum’s capabilities approach (CA) to justice, a (liberal) society is just if it provides people with the means to actualize basic capabilities that are necessary for a dignified human life. In Frontiers of Justice, Nussbaum (2006) expands the CA to include sentient nonhuman animals in the sphere of justice (as opposed, for instance, to the sphere of compassion). As it does for humans, justice requires that sentient creatures have the ability to access capabilities (...) necessary for their flourishing, as specified by a ‘species norm’ dictating the central capabilities typical to an animal’s kind. The purpose of this paper is to show an application of variety engineering in the social realm. It focuses on reducing environmental complexity by catalysing self-organizing processes. This catalysis is based on the use of Sen and Nussbaum’s capabilities approach. By doing this an organization may improve the quality of the relations with their clients by transforming environmental agents into new suppliers. This approach opens a new dimension of social responsibility for organizations. A particular case is presented (...) in which a regional university in Colombia faces the challenge of attending low-income students coming from small municipalities. They designed a strategy to offer low-cost housing and a daily balanced meal without using the university's own resources. Instead, they managed to involve some agents of the community by developing their capabilities. This kind of variety engineering shows the possibility of new forms of social responsibility in universities by incorporating the capabilities approach into their managerial practices. John Rawls argues that A Theory of Justice suffers from a “serious problem”: the problem of political stability. His theory failed to account for the reality that citizens are deeply divided by reasonable and incompatible religious, philosophical, and moral comprehensive doctrines. This fact of reasonable pluralism may pose a threat to political stability over time and requires a solution. Rawls proposes the idea of an overlapping consensus among incompatible comprehensive doctrines through the use of public reasons in his later Political (...) Liberalism. -/- Rawls’s proposed solution to the problem of political stability has received much criticism. Some, such as Kurt Baier, Brian Barry, George Klosko, and Edward McClennen, argue that an overlapping consensus is relatively unnecessary. Rawls should have acknowledged existing resources in his account that might secure political stability over time without major changes to his original views about justice. Others, including Kent Greenawalt, Michael Sandel, Leif Wenar, and Iris Marion Young believe that an overlapping consensus is too fragile to secure political stability. Rawls correctly identifies a major problem for his original account, but he fails to provide a satisfactory solution. -/- I believe these objections rest on a mistake easily overlooked. Each objection claims that, for Rawls, the possibility of future political stability is to be guaranteed by an overlapping consensus alone. This perspective fails to recognize the central importance of the social minimum in securing political stability. There is, in fact, more resources to secure political stability than Rawls or his critics have recognized. -/- My discussion will begin with a brief explanation of why the problem of political stability raises an important challenge to Rawls’s views on justice and why he argues for an overlapping consensus as a solution to it. I will next consider the more important objections to Rawls’s solution and why these fail. I will argue that the social minimum might better support political stability if it is broadly understood in terms of the capabilities approach. This approach is compatible with Rawls’s political liberalism and it provides a more robust understanding of a just social minimum. Political stability does not rely upon an overlapping consensus alone — and it may be better secured where the capabilities approach plays a more central role. Therefore, Rawls does provide a illuminating solution to the problem of political stability that is more compelling if we incorporate the capabilities approach into political liberalism. (shrink)

Although Nussbaum’s “Capabilities Approach” clearly expresses a commitment to objectivity, this article argues that this commitment is rather ambiguous due to the conception of public reason it endorses. In particular, the CA cannot account for an objective justification of public reason, given certain characteristics of public reason. As a result, the CA jeopardizes the substantive aim it has set itself: to provide an objective justification for public choices regarding human capabilities and their specifications.

In discussions about justice, development, well-being and equality, the capability approach (CA)Footnote1 founded by economist Amartya Sen and philosopher Martha Nussbaum attaches central importance to individual human capabilities. These are the effective freedoms or real opportunities of people to achieve valuable ‘beings and doings’ (also called ‘functionings’ by capability theorists). Resources—including technical artifacts—may contribute to the expansion of one’s capabilities, but there may also be all sorts of ‘conversion factors’ in place that prevent this. The approach (...) highlights the ‘multidimensionality’ of well-being and sees people as active agents shaping their own lives. In 1998 Sen won the Nobel Prize in economics for his work, which has deeply influenced the United Nations Development Program (UNDP). Proponents of the capabilities approach claim that it should be used to give guidance for the implementation of good constitutional laws. This suggests that it also gives us grounds to support attempts to create or protect constitutions based on something like the capabilities approach. The Turkish Republic claims that in order to protect secularism and the equal status of women, it needs to keep certain Islamic practices away from the public domain. The wearing of the headscarf (...) has been singled out as such a practice, and the Turkish Republic has therefore legislated against headscarf wearing in schools, universities, and government buildings. In consequence many women are forced to choose between religion over education and politics in a way that curtails central human capabilities. Nussbaum claims that the best way to help states resolve the dilemma presented by the conflict between religious choice and other central capabilities is to refer to principles embodied in to the US Religious Freedom Restoration Act 1993, which states that a law can burden a person's exercise of religion only when the burden is a furtherance of a compelling state interest. In this paper I consider how this advice partly vindicates the Turkish case and how the solution it yields is in many ways more satisfactory than that of more traditional approaches in political philosophy. The research presented in this paper is the first wave of a longitudinal study of a Cambodian information and communication for development (ICT4D) project, iREACH, aimed at testing a framework for evaluating whether and how such initiatives can contribute to capabilities, empowerment and sustainability. The framework is informed by Amartya Sen’s capability approach (CA), uses a participatory methodology, considers the micro-, meso-, and macro- levels in understanding the role ICT can play in the development process, and adopts a (...) forward-looking longitudinal perspective. Key findings of this research are that the project had contributed to livelihoods and other aspects of well-being in diverse ways, primarily in education, health, and farming. Participants also valued the project because of its contribution to empowerment, particularly gender empowerment. Another way in which participants valued iREACH was of a more intrinsic nature, manifested in a general appreciation of just being part of the world and knowing about events in other parts of Cambodia and beyond. These findings are consistent with the CA’s emphasis on development being about more than economic growth and support the importance of considering external factors, conceptualised here as the meso- and macro- levels, in the conversion of commodities in the form of services provided at iREACH, to capabilities. This paper proposes a conceptual framework to study and evaluate the impact of ‘Algorithmic Management’ (AM) on worker dignity. While the literature on AM addresses many concerns that relate to the dignity of workers, a shared understanding of what worker dignity means, and a framework to study it, in the context of software algorithms at work is lacking. We advance a conceptual framework based on a Capability Approach (CA) as a route to understanding worker dignity under AM. This paper (...) contributes to the existing AM literature which currently is mainly focused on exploitation and violations of dignity and its protection. By using a CA, we expand this focus and can evaluate the possibility that AM might also enable and promote dignity. We conclude that our CA-based conceptual framework provides a valuable means to study AM and then discuss avenues for future research into the complex relationship between worker dignity and AM systems. With our state-guaranteed or internationally recognized human rights, liberalism is rather a common basis of political discussion today. John Rawls’s theory of justice, which set a framework for liberal theory of justice in the last decades of the twentieth century, is notably contractarian. Martha Nussbaum, although claiming to be a neo-Aristotelian, argues that her capabilities approach (hereafter CA) can upgrade the liberal theory of justice, particularly that of political liberalism, to deal with unsolved problems of justice, namely, disability, (...) nationality, and species membership. However, this paper argues that her proposal issuccessful only when her CA-based theory proves its affiliation with political liberalism in more detail. As defined by Rawls, political liberalism produces “free-standing” political conceptions and rejects any metaphysical or religious ideas. It halts conceptions of justice that promote conceptions of good derived from particular comprehensive doctrines. I do not believe a mere convergence between CA and contractarianism is sufficient enough to secure the rational acceptability of her CA-based theory. I suggest that if she wishes to maintain her CA-based theory’s being politically liberal, she either has to prove more of the public, in particular the global public, acceptability of her intuitive ideas of human dignity without relying on her intuitions or alter the meaning of political liberalism itself so that it allows a room for some sort of comprehensive doctrine. The concept of dignity plays a foundational role in the more recent versions of Martha Nussbaum’s capabilities theory. However, despite its centrality to her theory, Nussbaum’s conception of dignity remains under-theorised. In this paper we critically examine the role that dignity plays in Nussbaum’s theory by, first, developing an account of the concept of dignity and introducing a distinction between two types of dignity, status dignity and achievement dignity. Next, drawing on this account, we analyse Nussbaum’s conception of dignity (...) and contrast it with Kant’s conception of dignity. On the basis of this comparison between Nussbaum and Kant, we highlight tensions between Nussbaum’s Aristotelianism, which is central to her conception of dignity, and her commitment to political liberalism. This leads us to conclude that Nussbaum’s claim that her conception of dignity is only a partial political conception is implausible and that her conception of dignity seems to commit her to a satisficing form of perfectionist liberalism. I explore the usefulness of Martha Nussbaum's capabilities approach in regard to the UN Convention on the Rights of Persons with Disabilities (CRPD). The CRPD aims at empowering people with disabilities by granting them a number of civil and political, but also economic, social and cultural rights. Implementing the CRPD will clearly be politically challenging and also very expensive for states. Thus, questions might arise as to whether the requirements set in the CRPD can be justified from an (...) ethical perspective. I will first investigate if Nussbaum's capabilities approach provides support for the rights claimed in the CRPD. Second, I will investigate to what extent Nussbaum's capabilities approach is a useful tool to set priorities among rights in the course of the implementation of the convention. This is an urgent question because seen realistically, it will not be possible to realize all rights at once and thus some rights need to receive greater priority than others. I will argue that the capabilities approach can be regarded as supporting the rights specified in the CRPD, but that it proves unable to guide the implementation process due to an insufficient grounding of the capabilities. Employing the capabilities approach thus leads to only limited results. (shrink)

Marxism as a normative position is critical of liberalism. However, the problems of justice and alienation that Marxism draws attention to can be solved by liberalism without the implementation of a Marxist political project. The purpose of the article is to substantiate the thesis that Martha Nussbaum's capabilities approach (one of the versions of political liberalism) is a more inclusive and rational method of theorizing about the basic principles of justice than Marxism. By analyzing Elizabeth Anderson's theory of (...) liberal egalitarianism "democratic equality", I show that some of Marxist approaches that (1) do not deny the existence of justice and (2) are concerned with the problem of alienation, can apply the arsenal of the moral theory of political liberalism to solve these problems. I also criticize Rawls's and Nussbaum's theories of political liberalism for their procedural vagueness and non-inclusive theory of justice. I present an outline of my position, which I propose to call «extended political liberalism» (hereafter EPL). EPL is currently represented by two arguments: 1) the paideia argument and 2) the argument of the interdependence of the good and the right. The first allows talking about the actual implementation of basic rights and freedoms only when citizens are aware of them and have the opportunity to change their views regarding the personal conception of the good. This is impossible without qualitative basic education. Also, one of the central concepts of EPL is presented within the framework of Paideia's argument - the interpretation of the political conception of justice. Because of this concept, it makes sense to talk about the possibility of citizens' reflection on the reconciliation of the current political conception with the personal conception of the good. This can also be done through the analysis of other conceptions of the good. The second argument is a continuation of the first, appearing as a theoretical mechanism that allows supplementing the existing political conception in case of serious social changes. In conclusion, if we take into account the advantages of the capabilities approach and my criticism of its weaknesses, then a theoretical position will emerge that is quite acceptable to some representatives of Marxism. Moreover, the latter will not have to give up their basic beliefs. The peculiarity of my concept presented in this text is that it is not so much a critique of Marxism as an analysis of the basic normative judgments of political liberalism, with which some Marxists can agree. With this article, I also want to illustrate the strengths of such a concept and point to its prospects for further attempts to interpret the political conception by other normative positions. Praca skupia się na rozwijanej przez filozofkę wersji koncepcji zdolności (capability approach), która jest rozpatrywana w kontekście po- Rawlsowskiego egalitarnego liberalizmu. Biorąc pod uwagę takie zaplecze, książka ma na celu zbadanie warunków możliwości zrealizowania jego podstawowych założeń normatywnych, a więc wartości: wolności, równości i szacunku dla pluralizmu. Zgodnie z proponowaną interpretacją koncepcja Nussbaum ukazuje podstawy egalitarnego liberalizmu w nowym świetle, w tej mierze, w (...) jakiej zwraca uwagę na konieczność uzupełnienia instytucji o odpowiedni model rozumowania praktycznego. Befahigung ist in den letzten Jahrzehnten zu einem zentralen Begriff sowohl in der politischen Philosophie als auch in der Sozialpolitik geworden. Was damit gemeint ist, ist freilich umstritten. Der Band versucht, die Bedeutungsgehalte des Befahigungsbegriffs und daruber seine Leistungsfahigkeit fur die sozialphilosophische und die politische Diskussion zu klaren. Dabei bleibt die Autorin nicht bei der Beschaftigung mit dem Capabilities Approach nach Martha Nussbaum und Amartya Sen stehen, sondern analysiert vor allem die Rezeptionen des Befahigungsansatzes und zwar speziell im (...) Bereich der theologischen Ethik. Als zentrales Problem sowohl des Capabilities Approach als auch der theologischen Ethik wird deren Liberalismusfahigkeit herausgearbeitet. Eine Auseinandersetzung daruber, wie und ob mit dem Befahigungskonzept sozialethisch ein "liberales Minimum", durch das die Freiheit jedes und jeder einzelnen gewahrleistet werden kann, ist das Ergebnis der Untersuchung. Education-related responses to our current democratic crisis have largely been focused on schooling children and youth. This narrow focus has foreclosed or diverted our attention from other possibilities for democratic education, especially as it relates to adult citizens and the ways in which such education can — and must — extend beyond schools and other formal educational institutions. In this paper, Tony DeCesare aims to theorize these possibilities in order to lay some philosophical groundwork for an idea of adult democratic (...) education (ADE) that can help us combat our current democratic crisis and, more generally, strengthen our commitment to and practice of democracy. Drawing on the capability approach, he argues for prioritizing two related capabilities in our theorizing of ADE: (1) democratic capability, and (2) the capability to participate in ADE. These two capabilities are both deeply interconnected and central to a theoretical framework for ADE that is grounded in the capability approach. (shrink)

Throughout the 1990-ies Nussbaum, in collaboration with others, has elaborated and argued for a list of human capabilities which specifies necessary conditions of human flourishing. The capabilities approach has been enormously influential in putting issues of global development and justice, and especially justice for women, on the philosophical and political agenda. Moreover, many international agencies and institutions, including the United Nations Development Program, have started to make use of this approach. Despite of its obvious good intentions (...) the approach deserves more serious critical attention from philosophers than it has received until now. In my paper I take up some fundamental problems with Nussbaum’s philosophical framework. I will argue that Nussbaum’s conception of human nature is still (implicitly) Cartesian and, more in particular, that her conception of reason is outdated. It raises problems with respect to the question of universal values, the possibility of which Nussbaum defends by reference to the faculty of reason. (shrink)

The aim of the paper is to confront some challenges raised by intergenerational justice from the perspective of Martha Nussbaum’s capabilities approach. After having sketched her account, the essay deals with some objections to it from an environmental perspective, arguing that, contrary to some critics, it can be a valuable basis for reflecting on our duties towards future generations. More precisely, I focus on how the CA provides promising insights to address two central problems of intergenerational ethics: 1) (...) the so-called ‘circumstances of justice;’ 2) the problem of the asymmetry between present and future generations. In both cases, I argue that the philosophical anthropology underlying the CA is better suited than the contractualist one to include future generations into the realm of justice and ground our motivation to care for them. After underlining the potential of the CA, in the concluding remarks I will underline a potential flaw of this theory, i.e. the lack of guidance when it comes to the trade-offs between our rights and well-being and those of the unborn. We propose a conceptualization and implementation of AI ethics via the capability approach. We aim to show that conceptualizing AI ethics through the capability approach has two main advantages for AI ethics as a discipline. First, it helps clarify the ethical dimension of AI tools. Second, it provides guidance to implementing ethical considerations within the design of AI tools. We illustrate these advantages in the context of AI tools in medicine, by showing how ethics-based auditing of AI tools (...) in medicine can greatly benefit from our capability-based approach. Biomass such as crops and agricultural waste is increasingly used as the primary resource for products like bioplastics and biofuels. Incorporating the needs, knowledge, skills and values of biomass producers in the design of global value chains – the steps involved in creating any finished product from design to delivery – can contribute to sustainability, reliability and fairness. However, how to involve biomass producers, especially if they are resource poor, remains a challenge. To make sure that inclusion in global biobased (...) value chains is both fair and effective, the capabilities of relevant actors need to be taken into account, especially of those producing biomass. Access to resources determines to what extent a specific actor can participate in a global value chain. Therefore, differences in capabilities should be a central consideration when new (biobased) value chains are designed. Using the capability approach as an ethical framework to realize inclusion, we discern three complementary strategies for setting up inclusive value chains. Firstly, designing for local conversion factors second, providing adaptive design for new capabilities, and third, investing in local conversion factors. Applying these strategies can lead to context-sensitive design of biorefineries that allow for true inclusion of local stakeholders. We support these claims with reference to case-studies of sugarcane production in Jamaica, modified tobacco in South Africa and the non-edible parts of corn (stover) in the US. (shrink)

This first part of this article critiques Sridhar Venkatapuram's conception of health as a capability. It argues that Venkatapuram relies on the problematic concept of dignity, implies that those who are unhealthy lack lives worthy of dignity, sets a low bar for health, appeals to metaphysically problematic thresholds, fails to draw clear connections between appealed-to capabilities and health, and downplays the importance/relevance of health functioning. It concludes by questioning whether justice entitlements should pertain to the capability for health versus (...) health achievements, challenging Venkatapuram's claims about the strength of health entitlements, and demonstrating that the capabilities approach is unnecessary to address social determinants of health. The idea of personalized nutrition is to give tailored dietary advice based on personal health-related data, i.e. phenotoype, genotype, or lifestyle. PN may be seen as part of a general trend towards personalised health care and currently various types of business models are already offering such services in the market. This paper explores ethical issues of PN by examining how PN services within the contextual environment of four future scenarios about health and nutrition in Europe might affect aspects of social (...) justice according to Martha Nussbaum’s capability approach. The scenarios have been created by a mixed group of stakeholders and experts in three consecutive workshops. This resulted in the definition of four future scenarios within a scenario space consisting of two variables: the ‘logic of health care systems’ and ‘conception of health’. Within each scenario, PN is likely to play a more or less important role in improving health by influencing food consumption patterns in society. Nussbaum’s capability approach implies a concept of social justice as a function of a minimum standard of human dignity. This denotes an account for equality in terms of a minimum of entitlements. However, also the ability of achieving individual objectives is essential for social justice. Personalisation advice in health and food consumption patterns, as aimed for by PN, is therefore acceptable provided a minimum of entitlements is guaranteed to all members of a society, and at the same time freedom concerning personal preferences is respected. Potential variation of how different people might benefit from PN should therefore be consistent with the minimum required as defined by the list of capabilities. (shrink)

Climate adaptation and resilience scholars are struggling to address distributive and procedural justice in climate resilience efforts. While the capability approach (CA) has been widely appraised as a suitable justice basis for this context, there are few detailed studies assessing this possibility. This paper addresses this gap by advancing discussions about the prospects of the CA for guiding justice work in climate resilience. With its emphasis on the final value and mutually irreducible character of the concrete beings and doings (...) of individuals, we find the CA relevant for tackling salient aspects of adaptation, such as the multi-faceted and locally specific nature of climate vulnerability. We also present and discuss a capability application that has particular relevance for including distributive and procedural justice considerations in climate resilience. On the other hand, we find that extant arguments in support of the CA neglect the limitations of the CA and some dilemmas involved in applying it, also overestimating the differences between the CA and other justice approaches, especially those based on resources and needs. These problems lead us to advise against treating the CA as a one-size-fits-all solution to the ills of climate resilience and they further raise a need for joining efforts with complementary approaches. -/- . In this paper, I assess Martha Nussbaum's application of the capabilities approach to non-human animals for both its philosophical merits and its potential to affect public policy. I argue that there are currently three main philosophical problems with the theory that need further attention. After discussing these problems, I show how focusing on factory farming would enable Nussbaum to demonstrate the philosophical merits of the capabilities approach as well as to suggest more powerful and effectives changes (...) in our public policies. The ageing populations of the Western world present a wide range of economic, social, and cultural implications, and given the challenges posed by deteriorating maintenance ratios, the scenario is somewhat worrying. In this paper, I investigate whether Martha C. Nussbaum's capabilities approach could secure dignity for older people in long‐term care, despite the per capita decreases in resources. My key research question asks, ‘What implications does Nussbaum's list of central human capabilities have for practical social care?’ My (...) methodology combines Nussbaum's list with ethnographic data gathered from a Finnish sheltered home for older people. On the basis of this study, it seems that the capabilities approach is a plausible framework for the ethics of care because it highlights differences in the ability to function and thus differences in opportunities to pursue a good life. The ideas presented in this article could assist social policy planners and executives in creating policies and practices that help old people to maintain their dignity until the end of their days. This paper compares the capability approach (CA) and libertarian paternalism (LP) to see whether they are compatible. The comparison focuses on rationality, wellbeing, and freedom. The main theoretical framework is Sen’s ‘reason to value’ (RtV). The relevance of this to CA, and LP is analysed, and whether the primacy that CA and LP both accord to reason leads to paternalism is examined. Although the principal focus is on Sen’s, Sunstein’s and Thaler’s original ideas, their key concepts are analysed in (...) the context of the contemporary critical literature on the topic. This critical analysis not only makes it possible to assess whether CA and LP are compatible, but also to see how they perceive rationality, wellbeing, and freedom. The critical analysis further differentiates the various interpretations of RtV in the literature and explains how CA and LP function. (shrink)

International guidelines recommend that prenatal screening for fetal abnormalities should only be offered within a non-directive framework aimed at enabling women in making meaningful reproductive choices. Whilst this position is widely endorsed, developments in cell-free fetal DNA based Non-Invasive Prenatal Testing are now raising questions about its continued suitability for guiding screening policy and practice. This issue is most apparent within debates on the scope of the screening offer. Implied by the aim of enabling meaningful reproductive choices is the idea (...) that screening services should support women in accessing prenatal tests that best enable them to realize the types of reproductive choice that they find important. However, beyond whatever options meet the quality standards required for facilitating an informed decision, the remaining criteria of facilitating autonomous choice is strictly non-directive. As a result, policy makers receive little indication prior to consultation with each individual woman, about what conditions should be prioritized during the offer of screening. In this paper we try to address this issue by using the capabilities approach to further specify the non-directive aim of enabling meaningful reproductive choice. The resulting framework is then used to assess the relative importance of offering prenatal screening where concerning different types of genetic condition. We conclude that greater priority may be ascribed to offering prenatal screening for conditions that more significantly diminish a woman’s central capabilities. It follows that serious congenital and earlier-onset conditions are more likely to fulfill these criteria. (shrink)

In the Proceedings that emerged from the Second International Workshop on the Assessment of Animal Welfare at Farm and Group Level, Sandoe, Christiansen, & Appleby challenged participants to ponder four fundamental questions:a. What is the baseline standard for morally acceptable animal welfare?b. What is a good animal life?c. What farming purposes are legitimate?d. What kinds of compromises are acceptable in a less-than-perfect world?Continued reflection on those questions warrants examination of the shape of our modern agricultural ethic. It also calls for (...) a reexamination of recent work by Nussbaum on extending the capabilities approach to animals and the interface of Nussbaum's work with Rollin's scholarship on telos . The resources of narrative ethics are summoned to navigate the above-mentioned questions and to explore how Nussbaum's approach and Rollin's notion of animals' natures relate to the main storyline associated with developments in agriculture.
