An ageing population and increased life expectancy are a characteristic of the Western world. Nevertheless, as Roger Fontaine writes, “although we should be glad about this fact, it should also be stressed that old age reveals profound discrepancies between individuals. In fact, we should not speak of ‘old age’ but ‘old ages’. Specialists make a distinction between normal old age, successful old age, and pathological old age.”Catherine Guchet points out that, at the end of the twentieth century, two images (...) of old age coexist, utilitarian in conception: that of ‘flamboyant’ old age and that of ‘dependent’ old age. The latter is associated with a loss of autonomy and dignity, especially for subjects affected by senile dementia, described as ‘unconscious’. This essay places psychiatrist and philosopher Frantz Fanon’s anti-colonial, anti-racist message from Peau Noire, Masques Blancs/Black Skin, White Masks in conversation with the new diagnoses of “Gender Dysphoria” and “Transvestic Disorder” in the fifth edition of the Diagnostic and Statistical Manual of Mental Disorders. Specifically, the essay discusses sexologist Ray Blanchard’s controversial theory of autogynephilia alongside Fanon’s ambivalent rendering of transgender desire and interracial trans phenomenology in a crucial but frequently overlooked passage in Black Skin. Fanon’s anti-colonial critique of (...) psychiatry allows us to reconsider how Blanchard’s theories on paraphilia engage with the foundational psychoanalytic concepts of identification and desire, as identified by the Freudian and Lacanian models and explored in the writings of Judith Butler, Catherine Millot, Charles Shepherdson, and others. By offering a fresh interpretation of the French text, this essay argues that a “trans of color critique” can benefit from Black Skin’s unexpected insight into trans desire: Fanon’s “man of color,” who simultaneously undergoes a gender transition and a racial transformation, represents the literal embodiment of his critique of colonial racism. Given the role of the new paraphilias in the DSM-V, this essay concludes that a trans of color critique is well positioned to reinforce the anti-colonial message Fanon addressed to the psychiatric and psychoanalytical fields, which have tended to diagnose psychic injury while ignoring its causation, and which continue to neglect the fact that medical access is just as important as material support and security for minority subjects, in particular. Principia Logico-Metaphysica contains a foundational logical theory for metaphysics, mathematics, and the sciences. It includes a canonical development of Abstract Object Theory [AOT], a metaphysical theory that distinguishes between ordinary and abstract objects. This article reports on recent work in which AOT has been successfully represented and partly automated in the proof assistant system Isabelle/HOL. Initial experiments within this framework reveal a crucial but overlooked fact: a deeply-rooted and known paradox is reintroduced in AOT when the logic of complex terms (...) is simply adjoined to AOT’s specially formulated comprehension principle for relations. This result constitutes a new and important paradox, given how much expressive and analytic power is contributed by having the two kinds of complex terms in the system. Its discovery is the highlight of our joint project and provides strong evidence for a new kind of scientific practice in philosophy, namely, computational metaphysics. Our results were made technically possible by a suitable adaptation of Benzmüller’s metalogical approach to universal reasoning by semantically embedding theories in classical higher-order logic. This approach enables one to reuse state-of-the-art higher-order proof assistants, such as Isabelle/HOL, for mechanizing and experimentally exploring challenging logics and theories such as AOT. Theories of explanation need to account for a puzzling feature of our explanatory practices: the fact that we prefer explanations that are relatively abstract but only moderately so. Contra Franklin-Hall ([2016]), I argue that the interventionist account of explanation provides a natural and elegant explanation of this fact. By striking the right balance between specificity and generality, moderately abstract explanations optimally subserve what interventionists regard as the goal of explanation, namely identifying possible interventions that would have changed the explanandum.

Many of us are unmoved when it is objected that some morally or intellectually suspect source agrees with our belief. While we may tend to find this kind of guilt by epistemic association unproblematic, I argue that this tendency is a mistake. We sometimes face what I call the problem of unwelcome epistemic company. This is the problem of encountering agreement about the content of your belief from a source whose faults give you reason to worry about the belief's truth, (...) normative status, etiology, or implications. On the basis of an array of cases, I elaborate four distinct kinds of problems that unwelcome epistemic company poses. Two of these are distinctly epistemic, and two are moral. I canvass possible responses, ranging from stubbornness to an epistemic prudishness that avoids unwelcome company at all costs. Finally, I offer preliminary lessons of the problem and distinguish it from the problem of peer disagreement. (shrink)

Stefan Kirchner leistet einen grundlegenden Beitrag zur aktuellen Organisationsforschung, indem er mit dem Konzept der Organisationsidentität Ansätze des soziologischen Neo-Institutionalismus und der Pfadabhängigkeitstheorie zusammenführt.

This paper argues that the interventionist account of causation faces a dilemma concerning macroscopic causation – i.e., causation by composite objects. Interventionism must either require interventions on a composite object to hold the behavior of its parts fixed, or allow such interventions to vary the behavior of those parts. The first option runs the risk of making wholes causally excluded by their parts, while the second runs the risk of mistakenly ascribing to wholes causal abilities that belong to their parts (...) only. Using as starting point Baumgartner’s well-known argument that interventionism leads to causal exclusion of multiply realized properties, I first show that a similar interventionist exclusion argument can be mounted against the causal efficacy of composite objects. I then show that Woodward’s (2015) updated interventionist account (explicitly designed to address exclusion worries) avoids this problem, but runs into an opposite issue of over-inclusion: it grants to composites causal abilities that belong to their parts only. Finally, I examine two other interventionist accounts designed to address Baumgartner’s argument, and show that when applied to composites, they too fall on one horn (exclusion) or the other (over-inclusion) of the dilemma. I conclude that the dilemma constitutes an open and difficult issue for interventionism. (shrink)

Much recent work on explanation in the interventionist tradition emphasizes the explanatory value of stable causal generalizations—i.e., causal generalizations that remain true in a wide range of background circumstances. We argue that two separate explanatory virtues are lumped together under the heading of `stability’. We call these two virtues breadth and guidance respectively. In our view, these two virtues are importantly distinct, but this fact is neglected or at least under-appreciated in the literature on stability. We argue that an adequate (...) theory of explanatory goodness should recognize breadth and guidance as distinct virtues, as breadth and guidance track different ideals of explanation, satisfy different cognitive and pragmatic ends, and play different theoretical roles in helping us understand the explanatory value of mechanisms. Thus keeping track of the distinction between these two forms of stability yields a more accurate and perspicuous picture of the role that stability considerations play in explanation. (shrink)

Entendemos que, embora o tempo seja tematizado em vários outros textos da juventude ou mesmo em obras heideggerianas mais tardias, é visível nesta conferência de 1924 a preocupação do pensador em conceber, de uma maneira tematicamente explícita, um novo conceito de tempo. Nossa proposta inicial restringe-se, por um lado, em avistar e evidenciar as ideias condutoras da (...) elaboração heideggeriana do conceito de tempo, razão pela qual muitos temas conexos não poderão ser especificamente abordados neste artigo; por outro lado, temos a preocupação de apontar para uma série de estudos voltados particularmente para este texto fundamental dos caminhos trilhados por Heidegger entre 1915 e 1930. This paper defends pro-realism, the view that it is better if moral realism is true rather than any of its rivals. After offering an account of philosophical angst, I make three general arguments. The first targets nihilism: in securing the possibility of moral justification and vindication in objecting to certain harms, moral realism secures something that is non-morally valuable and even essential to the meaning and intelligibility of our lives. The second argument targets antirealism: moral realism secures a desirable independence (...) for moral justification that is qualitatively different from the anti-realistic construal of independence that is only explicable in terms of degrees of distance from our subjective responses and attitudes. Finally, I argue that while the pan-expressivist semantic program of quasi-realism has significant effects on what can be appropriately said in meta-ethical discourse, it provides no comfort to the pro-realist who is already angsty about anti-realism. The rapid diffusion of artificial intelligence (AI) technologies in the defence domain raises challenges for the ethical governance of these systems. A recent shift from the what to the how of AI ethics sees a nascent body of literature published by defence organisations focussed on guidance to implement AI ethics principles. These efforts have neglected a crucial intermediate step between principles and guidance concerning the elicitation of ethical requirements for specifying the guidance. In this article, we outline the key normative (...) choices and corresponding tradeoffs that are involved in specifying guidance for the implementation of AI ethics principles in the defence domain. These correspond to: the AI lifecycle model used; the scope of stakeholder involvement; the accountability goals chosen; the choice of auditing requirements; and the choice of mechanisms for transparency and traceability. We provide initial recommendations for navigating these tradeoffs and highlight the importance of a pro-ethical institutional culture. (shrink)

In a previous volume of Ethical Theory & Moral Practice, Melis Erdur defends the provocative claim that postulating a stance-independent ground for morality constitutes a substantive moral mistake that is isomorphic to the substantive moral mistake that many realists attribute to antirealists. In this discussion paper I reconstruct Erdur’s argument and raise two objections to the general framework in which it arises. I close by explaining why rejecting Erdur’s approach doesn’t preclude normative criticism of metaethical theories.

In this article, we focus on the scholarly and policy debate on autonomous weapon systems and particularly on the objections to the use of these weapons which rest on jus ad bellum principles of proportionality and last resort. Both objections rest on the idea that AWS may increase the incidence of war by reducing the costs for going to war or by providing a propagandistic value. We argue that whilst these objections offer pressing concerns in their own right, they suffer (...) from important limitations: they overlook the difficulties of calculating ad bellum proportionality; confuse the concept of proportionality of effects with the precision of weapon systems; disregard the ever-changing nature of war and of its ethical implications; mistake the moral obligation imposed by the principle of last resort with the impact that AWS may have on political decision to resort to war. Our analysis does not entail that AWS are acceptable or justifiable, but it shows that ad bellum principles are not the best set of ethical principles for tackling the ethical problems raised by AWS; and that developing adequate understanding of the transformations that the use of AWS poses to the nature of war itself is a necessary, preliminary requirement to any ethical analysis of the use of these weapons. Occam's razor—the idea that all else being equal, we should pick the simpler hypothesis—plays a prominent role in ordinary and scientific inference. But why are simpler hypotheses better? One attractive hypothesis known as Bayesian Occam's razor is that more complex hypotheses tend to be more flexible—they can accommodate a wider range of possible data—and that flexibility is automatically penalized by Bayesian inference. In two experiments, we provide evidence that people's intuitive probabilistic and explanatory judgments follow the prescriptions of BOR. In (...) particular, people's judgments are consistent with the two most distinctive characteristics of BOR: They penalize hypotheses as a function not only of their numbers of free parameters but also as a function of the size of the parameter space, and they penalize those hypotheses even when their parameters can be “tuned” to fit the data better than comparatively simpler hypotheses. More than a century ago, Russell launched a forceful attack on causation, arguing not only that modern physics has no need for causal notions but also that our belief in causation is a relic of a pre-scientific view of the world. He thereby initiated a debate about the relations between physics and causation that remains very much alive today. While virtually everybody nowadays rejects Russell's causal eliminativism, many philosophers have been convinced by Russell that the fundamental physical structure of our (...) world doesn't contain causal relations. This raises the question of how to reconcile the central role of causal concepts in the special sciences and in common sense with the putative absence of causation in fundamental physics. (shrink)

Zusammenfassung Ansätze einer globalen Religionsgeschichte haben entscheidend zum Verständnis von Allgemeinbegriffen wie Religion als historisch gewachsen und veränderlich beigetragen. Ebenso haben sie aufgezeigt, dass das Verständnis von Religion in Wechselwirkung mit anderen Allgemeinbegriffen wie Nation geprägt ist. Geschlecht findet in diesen Untersuchungen bislang kaum Berücksichtigung. Dabei bestehen Wechselwirkungen zwischen Geschlecht, Nation und Religion, die wir in diesem Aufsatz in dem Vergleichsmoment von Mutterschaft aufzeigen wollen. Anhand von Fallbeispielen aus Sri Lanka, Israel und Nigeria machen wir deutlich, wie der Vergleichsmoment Mutterschaft (...) in unterschiedlichen Kontexten funktioniert, wie Identitäten daran konstruiert werden, welche Auswirkungen sich dadurch auf Religion, Nation und Geschlecht ergeben und wie Mutterschaft sowohl als Unterdrückungsmechanismus dient, als auch Handlungsmacht darin möglich ist. Intuitions play an important role in the debate on the causal status of high‐level properties. For instance, Kim has claimed that his “exclusion argument” relies on “a perfectly intuitive … understanding of the causal relation.” We report the results of three experiments examining whether laypeople really have the relevant intuitions. We find little support for Kim's view and the principles on which it relies. Instead, we find that laypeople are willing to count both a multiply realized property and its realizers (...) as causes, and regard the systematic overdetermination implied by this view as unproblematic. Proponents of IBE claim that the ability of a hypothesis to explain a range of phenomena in a unifying way contributes to the hypothesis’s credibility in light of these phenomena. I propose a Bayesian justification of this claim that reveals a hitherto unnoticed role for explanatory unification in evaluating the plausibility of a hypothesis: considerations of explanatory unification enter into the determination of a hypothesis’s prior by affecting its ‘explanatory coherence’, that is, the extent to which the hypothesis offers mutually (...) cohesive explanations of various phenomena. In recent years, an active research program has emerged that aims to develop a Humean best-system account (BSA) of laws of nature that improves on Lewis’s canonical articulation of the view. Its guiding idea is that the laws are cognitive tools tailored to the specific needs and limitations of creatures like us. While current versions of this “pragmatic Humean” research program fare much better than Lewis’s account along many dimensions, I will argue that they have trouble making sense of certain (...) key features of the practice of fundamental physics. Indeed, these features seem to go against the very idea that laws are useful for agents like us. In my view, Humeans can address these issues by paying more attention to the explanatory role of laws. Following this idea, I will propose an account on which what makes a systematization the best is a kind of explanatory power, understood along the lines of the unificationist theory of explanation. The resulting view, I will argue, can make sense of those features of laws that other pragmatic accounts of laws have trouble explaining. (shrink)

Este artigo objetiva demonstrar a importância do pensamento de Martin Heidegger (1889-1976) para uma melhor compreensão dos fenômenos da atualidade, tais como as novas tecnologias e o ambiente digital. Heidegger apresenta a essência da técnica como algo não técnico que acaba por atingir diretamente a humanidade numa dominação da técnica sobre o ser humano. O avanço técnico-científico ganha novo espaço e nova abordagem no fim do século XX com o nascimento da internet. Entendemos que a proposta de Heidegger pode auxiliar (...) numa análise crítica da sociedade pós-moderna marcada pela cibercultura e o ciberespaço. A reflexão tem como pano de fundo o livro Ensaios e conferências que, entre outros textos, contém a conferência proferida em 1953: “A questão da técnica”. Nosso autor mais utilizado é Francisco Rüdiger, professor da UFRS e da PUCRS. Os resultados obtidos apontam que a essência da técnica presente nas novas tecnologias, sobretudo, no ambiente digital, a partir de meados do XX, tem afetado a humanidade em seu modo de ser e viver. Com efeito, o pensar técnico gera na humanidade uma grande crise na formação da sua própria identidade, assim como no seu modo de ser e de agir no mundo. Conclui-se, então, que é necessário – como afirma Rüdiger – olhar para as questões da tecnologia e do ambiente digital numa perspectiva analítica e criticamente hermenêutica. A metodologia utilizada foi a hermenêutica fenomenológica a partir de uma ampla análise bibliográfica da temática abordada. (shrink)

Este artigo tem como escopo fazer uma interpretação fenomenológica do texto da aula de habilitação pronunciada por Martin Heidegger em 1915 na Universidade de Friburgo. Apesar de ser um texto citado muitas vezes pelos estudiosos da obra heideggeriana, pouco se conhece a seu respeito e, sobretudo, que e como algumas ideias – as quais serão desenvolvidas em Ser e tempo (1927) – já estão embrionariamente presentes na referida aula. Nesse sentido, seguindo a indicação do próprio título, pretende-se evidenciar em que (...) sentido há uma diferença fundamental, segundo Heidegger, entre o conceito de tempo na história e na física. Aspecto importante da presente interpretação consiste em vir acompanhada da tradução inédita de trechos significativos do texto em questão. (shrink)

The patristic tradition has long censured or denied debts to Epicurean thought. Thus it is surprising to find that Augustine requires and uses Epicurean arguments at three moments in the Confessions essential his theory of friendship: the pear tree incident, the death of his friend, and the decision not to form a philosophical community. I argue that the classical definition of friendship is inadequate to solve these problems. Furthermore, reworking Augustine’s theory of friendship with the use/enjoyment doctrine developed in The (...) Trinity fails to resolve them. Thus the problems raised in the Confessions cannot be exposed or solved through Augustine’s own theoretical framework. I argue that they are, however, central to the Epicurean theory of friendship, which addresses them specifically, and that the Epicurean insistence on the mortality of the soul produces the central problem for Augustine’s notion of friendship. Boethius is largely underrated in the history of Western thought. Scholarship often regarded him and his era Late Antiquity as mere intermediaries between Antiquity and the Middle Ages. This volume shows that Boethius and his time can be appreciated in their own right.".

Forced expropriations of immovable property were common during the Communist era in Eastern Europe. Today, many of the former owners or their heirs are interested in regaining legal ownership of such properties, often decades after the ownership has been reallocated to others. Therefore, the conflict between old and new owners is often resolved in favour of the new owners. While this is understandable from a contemporary political perspective, this approach results in a perpetuation of the results of an earlier human (...) rights violation, thereby resulting in a new human rights violation which will have to be measured against the European Convention on Human Rights (ECHR) if the state in question has ratified it prior to deciding how to handle the long-term effects of expropriations. Firstly, in the article we will devote ourselves to the interpretation of the right to property with an emphasis on the problem of expropriation. Above all, we will elaborate on the definition of the term “property” as well as positive and negative obligations of the Member States regarding this right. Finally, we will address the question of expropriations prior to the entry into force of the Convention and just compensation under Article 41 ECHR. Interpretation of the right to property will be supported by the jurisprudence of the European Court of Human Rights. (shrink)

Dass sich jegliches Geschehen der operativ geschlossenen Verknüpfung von Ereignissen verdankt, ist sicherlich die theorieästhetische Provokation der Moderne. Die Dynamik der Geschlossenheit wird als eine Theoriefigur ins Spiel gebracht, welche die sich seit der Neuzeit entwickelnde Idee der Selbstbezüglichkeit radikalisiert und jegliche Beobachtung von einem Absoluten entlastet. Aus der theorieästhetischen Perspektive wird auch die kultur-phänomenologische Anthropologie Hans Blumenbergs unter dem Signum der operativen Geschlossenheit entfaltet. Indem mit Niklas Luhmann und Hans Blumenberg zwei Perspektiven ins Gespräch gebracht werden, die man sonst (...) nicht in einem Atemzug nennt, kann letztlich Blumenberg in einer innovativen Lesart nicht nur als Denker der Neuzeit, sondern auch als Beobachter der späten Moderne verstanden werden.
